1. A record or signature shall not be denied legal effect or enforceability solely because it is in electronic form.

Terms Used In Iowa Code 554D.108

  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Iowa Code 554D.103
  • Electronic record: means a record created, generated, sent, communicated, received, or stored by electronic means. See Iowa Code 554D.103
  • Electronic signature: means an electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record. See Iowa Code 554D.103
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Iowa Code 554D.103
  • Signature: includes an electronic signature as defined in section 554D. See Iowa Code 4.1
 2. A contract shall not be denied legal effect or enforceability solely because an electronic record was used in its formation.
 3. If a law requires a record to be in writing, an electronic record satisfies the law.
 4. If a law requires a signature, an electronic signature satisfies the law.
