Terms Used In Iowa Code > Chapter 692A - Sex Offender Registry

  • Aggravated offense: means a conviction for any of the following offenses:
     (1) Sexual abuse in the first degree in violation of section 709. See Iowa Code 692A.101
  • Aggravated offense against a minor: means a conviction for any of the following offenses, if such offense was committed against a minor, or otherwise involves a minor:
     (1) Sexual abuse in the first degree in violation of section 709. See Iowa Code 692A.101
  • Appearance: means to appear in person at a sheriff's office. See Iowa Code 692A.101
  • Arrest: Taking physical custody of a person by lawful authority.
  • Change: means to add, begin, or terminate. See Iowa Code 692A.101
  • Child: includes child by adoption. See Iowa Code 4.1
  • Child care facility: means the same as defined in section 237A. See Iowa Code 692A.101
  • clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
  • Contract: A legal written agreement that becomes binding when signed.
  • Convicted: means found guilty of, pleads guilty to, or is sentenced or adjudicated delinquent for an act which is an indictable offense in this state or in another jurisdiction including in a federal, military, tribal, or foreign court, including but not limited to a juvenile who has been adjudicated delinquent, but whose juvenile court records have been sealed under section 232. See Iowa Code 692A.101
  • Conviction: A judgement of guilt against a criminal defendant.
  • Conviction: includes the conviction of a juvenile prosecuted as an adult. See Iowa Code 692A.101
  • Criminal or juvenile justice agency: means an agency or department of any level of government or an entity wholly owned, financed, or controlled by one or more such agencies or departments which performs as its principal function the apprehension, prosecution, adjudication, incarceration, or rehabilitation of criminal or juvenile offenders. See Iowa Code 692A.101
  • Department: means the department of public safety. See Iowa Code 692A.101
  • Dependent: A person dependent for support upon another.
  • Employee: means an offender who is self-employed, employed by another, and includes a person working under contract, or acting or serving as a volunteer, regardless of whether the self-employment, employment by another, or volunteerism is performed for compensation. See Iowa Code 692A.101
  • Employment: means acting as an employee. See Iowa Code 692A.101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Foreign court: means a court of a foreign nation that is recognized by the United States department of state that enforces the right to a fair trial during the period in which a conviction occurred. See Iowa Code 692A.101
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habitually lives: means living in a place with some regularity, and with reference to where the sex offender actually lives, which could be some place other than a mailing address or primary address but would entail a place where the sex offender lives on an intermittent basis. See Iowa Code 692A.101
  • Incarcerated: means to be imprisoned by placing a person in a jail, prison, penitentiary, juvenile facility, or other correctional institution or facility or a place or condition of confinement or forcible restraint regardless of the nature of the institution in which the person serves a sentence for a conviction. See Iowa Code 692A.101
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
  • Internet identifier: means an electronic mail address, instant message address or identifier, or any other designation or moniker used for self-identification during internet communication or posting, including all designations used for the purpose of routing or self-identification in internet communications or postings. See Iowa Code 692A.101
  • Internet site: means a specific location on the internet that is determined by internet protocol numbers, by a domain name, or by both, including but not limited to domain names that use the designations ". See Iowa Code 4.1
  • Jurisdiction: means any state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Northern Mariana Islands, the United States Virgin Islands, or a federally recognized Indian tribe. See Iowa Code 692A.101
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Loiter: means remaining in a place or circulating around a place under circumstances that would warrant a reasonable person to believe that the purpose or effect of the behavior is to enable a sex offender to become familiar with a location where a potential victim may be found, or to satisfy an unlawful sexual desire, or to locate, lure, or harass a potential victim. See Iowa Code 692A.101
  • Minor: means a person under eighteen years of age. See Iowa Code 692A.101
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • property: includes personal and real property. See Iowa Code 4.1
  • Public library: means any library that receives financial support from a city or county pursuant to section 256. See Iowa Code 692A.101
  • real property: include lands, tenements, hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Iowa Code 4.1
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Relevant information: means the following information with respect to a sex offender:
     (1) Criminal history, including warrants, articles, status of parole, probation, or supervised release, date of arrest, date of conviction, and registration status. See Iowa Code 692A.101
  • Residence: means each dwelling or other place where a sex offender resides, sleeps, or habitually lives, or will reside, sleep, or habitually live, including a shelter or group home. See Iowa Code 692A.101
  • Rule: includes "regulation". See Iowa Code 4.1
  • School: means a public or nonpublic elementary or secondary school. See Iowa Code 692A.114
  • Sex act: means as defined in section 702. See Iowa Code 692A.101
  • Sex offender: means a person who is required to be registered under this chapter. See Iowa Code 692A.101
  • Sex offense: means an indictable offense for which a conviction has been entered that is enumerated in section 692A. See Iowa Code 692A.101
  • Sex offense against a minor: means an offense for which a conviction has been entered for a sex offense classified as a tier I, tier II, or tier III offense under this chapter if such offense was committed against a minor, or otherwise involves a minor. See Iowa Code 692A.101
  • Sexually motivated: means the same as defined in section 229A. See Iowa Code 692A.101
  • Sexually violent offense: means an offense for which a conviction has been entered for any of the following indictable offenses:
  • Sexually violent predator: means a sex offender who has been convicted of an offense which would qualify the offender as a sexually violent predator under the federal Violent Crime Control and Law Enforcement Act of 1994, 42 U. See Iowa Code 692A.101
  • SORNA: means the Sex Offender Registration and Notification Act, which is Tit. See Iowa Code 692A.101
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • Student: means a sex offender who enrolls in or otherwise receives instruction at an educational institution, including a public or private elementary school, secondary school, trade or professional school, or institution of higher education. See Iowa Code 692A.101
  • Superintendent: means the superintendent or superintendent's designee of a public school or the authorities in charge of a nonpublic school. See Iowa Code 692A.101
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • United States: includes all the states. See Iowa Code 4.1
  • Vehicle: means a vehicle owned or operated by an offender, including but not limited to a vehicle for personal or work-related use, and including a watercraft or aircraft, that is subject to registration requirements under chapter 321, 328, or 462A. See Iowa Code 692A.101
  • year: means twelve consecutive months. See Iowa Code 4.1
