(1) A court of this state shall treat a foreign country as if it were a state of the United
States for the purpose of applying Articles 1 and 2.

Terms Used In Kentucky Statutes 403.806

  • Foreign: when applied to a corporation, partnership, limited partnership, business trust, statutory trust, or limited liability company, includes all those incorporated or formed by authority of any other state. See Kentucky Statutes 446.010
  • State: when applied to a part of the United States, includes territories, outlying possessions, and the District of Columbia. See Kentucky Statutes 446.010

(2) Except as otherwise provided in subsection (3) of this section, a child custody determination made in a foreign country under factual circumstances in substantial conformity with the jurisdictional standards of KRS § 403.800 to KRS § 403.880 shall be recognized and enforced under Article 3.
(3) A court of this state need not apply KRS § 403.800 to KRS § 403.880 if the child custody law of a foreign country violates fundamental principles of human rights.
