A coroner may, upon receipt of an affidavit from any person stating that he believes or has reasonable grounds to believe that a person who is dead and buried died from poisoning or other illegal cause, order the body exhumed and a post-mortem examination or autopsy conducted.

Terms Used In Kentucky Statutes 72.440

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Post-mortem examination: means a physical examination of the body by a medical examiner or by a coroner or deputy coroner who has been certified by the Justice and Public Safety Cabinet and may include an autopsy performed by a pathologist. See Kentucky Statutes 72.405
