Terms Used In Louisiana Civil Code 2315.3

  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

In addition to general and special damages, exemplary damages may be awarded upon proof that the injuries on which the action is based were caused by a wanton and reckless disregard for the rights and safety of the person through an  act of pornography involving juveniles, as defined by La. Rev. Stat. 14:81.1, regardless of whether the defendant was prosecuted for his acts.
