§ 4520 Guidance and technical assistance by the department

  • Commissioner: means the Commissioner of Education or the commissioner's designee. See Maine Revised Statutes Title 20-A Sec. 1
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Default: means the failure to perform on time any obligation or duty set forth in the rental agreement. See Maine Revised Statutes Title 10 Sec. 1372
  • Electronic mail: means electronic mail sent or delivered by transmission over the Internet. See Maine Revised Statutes Title 10 Sec. 1372
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Fraud: Intentional deception resulting in injury to another.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Last known address: means that address provided by the occupant in the rental agreement or the address provided by the occupant in a subsequent written notice of a change of address. See Maine Revised Statutes Title 10 Sec. 1372
  • Late fee: means any fee or charge assessed for an occupant's failure to pay rent when due. See Maine Revised Statutes Title 10 Sec. 1372
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Leased space: means the individual storage space at the self-service facility which is rented to an occupant under a rental agreement. See Maine Revised Statutes Title 10 Sec. 1372
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgage loan originator: means an individual who for compensation or gain or in the expectation of compensation or gain takes a residential mortgage loan application or offers or negotiates terms of a residential mortgage loan. See Maine Revised Statutes Title 9-A Sec. 13-102
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Occupant: means a person, a sublessee, successor or assignee, entitled to the use of a leased space at a self-service storage facility under a rental agreement. See Maine Revised Statutes Title 10 Sec. 1372
  • Operator: means the owner, operator, lessor or sublessor of a self-service storage facility, an agent or any other person authorized to manage the facility. See Maine Revised Statutes Title 10 Sec. 1372
  • Personal information: includes , but is not limited to, social security numbers, credit or debit card information, bank account numbers, medical information or passport information. See Maine Revised Statutes Title 10 Sec. 1372
  • Personal property: All property that is not real property.
  • Personal property: means movable property, not affixed to land. See Maine Revised Statutes Title 10 Sec. 1372
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Rental agreement: means any written agreement that establishes or modifies the terms, conditions or rules concerning the use and occupancy of a self-service storage facility. See Maine Revised Statutes Title 10 Sec. 1372
  • Self-service storage facility: means any real property used for renting or leasing individual storage spaces under a written rental agreement in which the occupants themselves customarily store and remove their own personal property on a self-service basis. See Maine Revised Statutes Title 10 Sec. 1372
  • Statute: A law passed by a legislature.
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
  • Verified mail: means any method of mailing that is offered by the United States Postal Service and provides evidence of mailing. See Maine Revised Statutes Title 10 Sec. 1372
