Terms Used In Maine Revised Statutes > Title 22 > Subtitle 3 > Part 3 - Children

Abandoned animal: means an animal that has been deserted by its owner or keeper, excluding animals that are part of a population control effort. See Maine Revised Statutes Title 7 Sec. 3907
Abandonment: means any conduct on the part of the parent showing an intent to forego parental duties or relinquish parental claims. See Maine Revised Statutes Title 22 Sec. 4002
Abuse or neglect: means a threat to a child's health or welfare by physical, mental or emotional injury or impairment, sexual abuse or exploitation including under Title 17?A, sections 282, 852, 853 and 855 or deprivation of essential needs, or lack of protection from these, by a person responsible for the child. See Maine Revised Statutes Title 22 Sec. 4002
Accredited: means an educational institution that is approved by the United States Department of Education or a regional or national accrediting agency recognized by the United States Department of Education. See Maine Revised Statutes Title 32 Sec. 1521
Act: means the Animal Welfare Act. See Maine Revised Statutes Title 7 Sec. 3907
Actuary: means a member of the American Academy of Actuaries who is also a member of the Society of Actuaries or the Casualty Actuarial Society and is qualified to sign a statement of actuarial opinion. See Maine Revised Statutes Title 24-A Sec. 6201
Acute pain: means pain that is the normal, predicted physiological response to a noxious chemical or thermal or mechanical stimulus. See Maine Revised Statutes Title 22 Sec. 7246
Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
Adjusted base minimum price: means the base minimum price plus any amounts established by the Maine Milk Commission to reflect the increased costs of production pursuant to section 2954, subsection 2, paragraph A. See Maine Revised Statutes Title 7 Sec. 3152
Administer: means an action to apply a prescription drug directly to a person by any means by a licensed or certified health care professional acting within that professional's scope of practice. See Maine Revised Statutes Title 22 Sec. 7246
Adult: means a person 18 years of age or over. See Maine Revised Statutes Title 15 Sec. 3003
Adult: means a person who has attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72
Adult day care: means an ongoing program of health, social, maintenance and rehabilitative services available to persons needing this level of service, as determined by an assessment of their functional abilities and need for health and social services. See Maine Revised Statutes Title 22 Sec. 6202
Adults with long-term care needs: means adults who have physical or mental limitations which restrict their ability to carry out activities of daily living and impede their ability to live independently, or who are at risk of being placed, or who already have been placed in an institutional setting. See Maine Revised Statutes Title 22 Sec. 6202
Advanced emergency medical person: means an emergency medical services person licensed to perform advanced emergency medical treatment. See Maine Revised Statutes Title 32 Sec. 83
Adverse result: means :

Advertisement: means all representations disseminated in any manner or by any means, other than by labeling, for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of food. See Maine Revised Statutes Title 22 Sec. 2152

Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.

Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.

Agency liquor store: means a person that is licensed by the bureau to sell spirits, wine and malt liquor to be consumed off the premises. See Maine Revised Statutes Title 28-A Sec. 2

Aggravating factor: means any of the following circumstances with regard to the parent. See Maine Revised Statutes Title 22 Sec. 4002

Agreement: means a contract, grant or other method of payment. See Maine Revised Statutes Title 22 Sec. 6202

Agreement: means a commercial relationship, not required to be evidenced in writing, of definite or indefinite duration, between a certificate of approval holder and a wholesale licensee, under which the wholesale licensee is authorized to distribute one or more of the certificate of approval holder's brands of malt liquor, wine or beverages. See Maine Revised Statutes Title 28-A Sec. 1451

Agreement of the parties: means the mutual agreement of the parties or their authorized representatives, and is distinguished from a unilateral condition imposed by any party to the agreement. See Maine Revised Statutes Title 10 Sec. 2361-A

Alcohol: means the substance known as ethyl alcohol, hydrated oxide of ethyl or spirit of wine which is commonly produced by the fermentation or distillation of grain, starch, molasses, sugar, potatoes or other substances, and includes all dilutions and mixtures of these substances. See Maine Revised Statutes Title 28-A Sec. 2

Allegation: something that someone says happened.

Ambulance: means any vehicle, whether an air, ground or water vehicle, that is designed, constructed or routinely used or intended to be used for the transportation of ill or injured persons. See Maine Revised Statutes Title 32 Sec. 83

Ambulance service: means any person, persons or organization that holds itself out to be a provider of transportation of ill or injured persons or that routinely provides transportation for ill or injured persons. See Maine Revised Statutes Title 32 Sec. 83

Amenable species: means a species of exotic animal, as defined by the federal acts, the anatomy and biology of which are substantially the same as an animal that is currently inspected. See Maine Revised Statutes Title 22 Sec. 2511

Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.

American Sign Language proficiency interview: means a holistic language evaluation that is used to determine global American Sign Language proficiency and that is administered by an educational testing service organization and evaluated by an American Sign Language evaluation service organization recognized by the director. See Maine Revised Statutes Title 32 Sec. 1521

Amortization: Paying off a loan by regular installments.

Animal: means every living, sentient creature not a human being. See Maine Revised Statutes Title 7 Sec. 3907

Animal control: means control of dogs, cats, and domesticated or undomesticated animals in accordance with section 3948. See Maine Revised Statutes Title 7 Sec. 3907

Animal control officer: means the person appointed periodically by a municipality pursuant to chapter 725. See Maine Revised Statutes Title 7 Sec. 3907

Animal food manufacturer: means a person engaged in the business of preparing animal food, including poultry food, derived wholly or in part from livestock or poultry carcasses or parts or products of carcasses. See Maine Revised Statutes Title 22 Sec. 2511

Animal shelter: means a:

Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.

Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.

Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.

Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.

Appointment of agent: means a statement appointing an agent for service of process filed by a domestic entity that is not a filing entity or a nonqualified foreign entity under section 112. See Maine Revised Statutes Title 5 Sec. 102

Appraisal: A determination of property value.

Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization

Arrest: Taking physical custody of a person by lawful authority.

ASPIRE-TANF: means the ASPIRE-TANF program established in section 3781?A. See Maine Revised Statutes Title 22 Sec. 3762

Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.

Assistance unit: means the individuals whose need the department considers when determining whether an applicant or recipient is eligible for program benefits. See Maine Revised Statutes Title 22 Sec. 3811

Association: means the Maine Guaranteed Access Reinsurance Association under section 3953. See Maine Revised Statutes Title 24-A Sec. 3952

At large: means off the premises of the owner and not under the control of any person whose personal presence and attention would reasonably control the conduct of the animal. See Maine Revised Statutes Title 7 Sec. 3907

At risk: means , with regard to a person, that the person is a member of an economically disadvantaged family, a recipient or former recipient of services under the child protection or child welfare system of the State, in foster care, homeless, a member of a family exposed to substance use disorder, identified as having special needs, identified as having a physical or mental disability or identified as having limited English proficiency. See Maine Revised Statutes Title 22 Sec. 3931

At-risk: means there is reasonable cause to suspect that a child's health, safety and welfare is in jeopardy due to abuse, neglect, abandonment or similar circumstances and that return to the child's or the child's parent's country of origin or country of last habitual residence would not be in the best interest of the child. See Maine Revised Statutes Title 22 Sec. 4099-I

Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.

Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.

Auditorium: means a commercially operated indoor or outdoor facility designed or used for the gathering of an audience for speeches and live performances of theater, music, dance or other performing arts that charges a fee and has adequate facilities for the sale and consumption of liquor. See Maine Revised Statutes Title 28-A Sec. 2

Authentication: means the process of verifying the identity and credentials of a person before authorizing access to prescription data. See Maine Revised Statutes Title 22 Sec. 7262

Authority: means the Finance Authority of Maine as established by this chapter. See Maine Revised Statutes Title 10 Sec. 963-A

Authority: means the Finance Authority of Maine. See Maine Revised Statutes Title 10 Sec. 1099-A

Authorized: means the granting of access privileges to prescription data. See Maine Revised Statutes Title 22 Sec. 7262

Average final compensation: means :

Average final compensation: means the average annual rate of earnable compensation of a member during the 3 years of creditable service, not necessarily consecutive, in which the average annual rate of earnable compensation is highest or during the member's entire period of creditable service if the period is less than 3 years. See Maine Revised Statutes Title 3 Sec. 701

Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.

Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.

Base minimum price: means Class I, Class II and Class III prices established pursuant to the northeast marketing area milk marketing order. See Maine Revised Statutes Title 7 Sec. 3152

Basic emergency medical services person: means a person licensed to perform basic emergency medical treatment. See Maine Revised Statutes Title 32 Sec. 83

Basic health care services: means health care services that an enrolled population might reasonably require in order to be maintained in good health and includes, at a minimum, emergency care, inpatient hospital care, inpatient physician services, outpatient physician services, ancillary services such as x-ray services and laboratory services and all benefits mandated by statute and mandated by rule applicable to health maintenance organizations. See Maine Revised Statutes Title 24-A Sec. 4202-A

Bed and breakfast: means a place that advertises itself as a bed and breakfast where the public for a fee may obtain overnight accommodations that include a sleeping room or rooms and at least one meal per day. See Maine Revised Statutes Title 28-A Sec. 2

Beneficiary: means a person or persons designated by a member to receive a benefit under this Part or a person otherwise entitled to receive a benefit under this Part. See Maine Revised Statutes Title 5 Sec. 17001

Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. ^{Source: OCC}

Beneficiary: means any person who receives or is designated to receive a benefit provided by this chapter. See Maine Revised Statutes Title 3 Sec. 701

Benefit: means any payment made, or required to be made, to a beneficiary under chapter 423, subchapter V or chapter 425, subchapter V. See Maine Revised Statutes Title 5 Sec. 17001

Benefit corporation: means a corporation:

Bequest: Property gifted by will.

Blend price: means the price of milk per hundredweight computed as the sum of the Class I price multiplied by the percentage of milk sold as Class I milk, the Class II price multiplied by the percentage sold as Class II milk and the Class III price multiplied by the percentage sold as Class III milk. Board: means the Board of the Maine Children's Trust Incorporated. See Maine Revised Statutes Title 22 Sec. 3881

Board: means the board of trustees, established under section 12004?F, subsection 9, to administer the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001

Board: means the Maine Retirement Savings Board under section 172. See Maine Revised Statutes Title 5 Sec. 171

Board: means the Emergency Medical Services' Board established pursuant to section 88. See Maine Revised Statutes Title 32 Sec. 83

Board: means the Maine Dairy Promotion Board. See Maine Revised Statutes Title 7 Sec. 2997

Board: means the Board of Environmental Protection. See Maine Revised Statutes Title 32 Sec. 1741

Boarding kennel: means any place, building, tract of land or abode in or on which 3 or more privately owned companion animals are kept at any one time for their owners in return for a fee or compensation and includes a facility where 3 or more companion animals are kept for training purposes for compensation. Bond: means revenue obligation security. See Maine Revised Statutes Title 10 Sec. 963-A

Boston market dealer: means any dealer as defined in subsection 4 who purchases milk from producers subject to the price regulations of the northeast marketing area milk marketing order. See Maine Revised Statutes Title 7 Sec. 3152

Boston market producer: means any Maine milk producer selling to a dealer marketing milk subject to the northeast marketing area milk marketing order, or any agricultural cooperative that buys milk from or handles milk for such a producer and sells it to such a dealer. See Maine Revised Statutes Title 7 Sec. 3152

bottle: means to package spirits, wine or malt liquor for sale in containers. See Maine Revised Statutes Title 28-A Sec. 2

Bottle club: means a person operating on a regular, profit or nonprofit basis a facility for social activities in which members or guests provide their own liquor, where no liquor is sold on the bottle club premises, which maintains suitable facilities for the use of members on a regular basis or charges an admission fee to members or the general public and where members, guests or others are regularly permitted to consume liquor. See Maine Revised Statutes Title 28-A Sec. 2

Bottler: means a person that packages spirits, wine or malt liquor for sale in containers and is not engaged in distilling, brewing, fermenting or rectifying liquor. See Maine Revised Statutes Title 28-A Sec. 2

Breeding kennel: means a location where 5 or more adult female dogs or cats capable of breeding are kept and some or all of the offspring are offered for sale, sold or exchanged for value or a location where more than 16 dogs or cats raised on the premises are sold to the public in a 12-month period. See Maine Revised Statutes Title 7 Sec. 3907

Brewery: means a person that engages in the activities under either paragraph A or B, or both:

Broker: means a person who, for a fee, commission or other valuable consideration, arranges or offers to arrange a transaction involving the sale, for purposes other than resale, of a new motor vehicle and who is not:

Bureau: means the Bureau of Health. See Maine Revised Statutes Title 22 Sec. 1692-A

Bureau: means the Department of Administrative and Financial Services, Bureau of Alcoholic Beverages and Lottery Operations. See Maine Revised Statutes Title 28-A Sec. 2

Business day: means any day of the calendar year other than a Saturday, Sunday or legal holiday. See Maine Revised Statutes Title 7 Sec. 3907

Business entity: means a partnership, corporation, firm, association or other legal entity. See Maine Revised Statutes Title 28-A Sec. 2

butt diameter: means the diameter of the severed stem butt, measured outside the bark, the short way through the center, disregarding crevices and cracks. See Maine Revised Statutes Title 10 Sec. 2361-A

Butt measure: means the lineal measure of the butt end of tree length wood, without subsequent conversion to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A

Butt scale: means the volume measure of wood based solely on measurement of the butt end of individual trees and converted to volume by any means. See Maine Revised Statutes Title 10 Sec. 2361-A

Bylaws: means those bylaws established by the interstate commission pursuant to section 7268 for its governance or for directing or controlling its actions and conduct. See Maine Revised Statutes Title 22 Sec. 7262

Cable television company: means any person owning, controlling, operating, managing or leasing a cable television system within the State. See Maine Revised Statutes Title 30-A Sec. 2001

Cable television system: means any facility that, in whole or in part, receives directly or indirectly over the air, amplifies or otherwise modifies the signals transmitting programs broadcast by one or more television or radio stations and distributes those signals by wire or cable to subscribing members of the public who pay for that service. See Maine Revised Statutes Title 30-A Sec. 2001

Campsite: means a camping location containing tents, registered tent trailers, registered pickup campers, registered recreational vehicles, registered trailers or similar devices used for camping. See Maine Revised Statutes Title 12 Sec. 682

Capitated basis: means fixed per-member, per-month payments or percentage-of-premium payments pursuant to which the provider assumes full risk for the cost of contracted services without regard to the type, value or frequency of services provided. See Maine Revised Statutes Title 24-A Sec. 4202-A

Carrier: means a health maintenance organization, an insurer, a nonprofit hospital, a medical service corporation or any other entity responsible for the payment of benefits or provision of services under a group contract. See Maine Revised Statutes Title 24-A Sec. 4202-A

Case plan prescription: means a plan developed by the family support team. See Maine Revised Statutes Title 22 Sec. 4092

Cat: means a member of the genus and species known as Felis catus. See Maine Revised Statutes Title 7 Sec. 3907

Cat identification: means :

Catering: means service of liquor with or without food by a person to groups at a prearranged function. See Maine Revised Statutes Title 28-A Sec. 2

Cave: includes natural subsurface water and drainage systems, but does not include any mine, tunnel or other artificial excavation. See Maine Revised Statutes Title 12 Sec. 544-J

Cave life: means any life-form normally found in a cave. See Maine Revised Statutes Title 12 Sec. 544-J

Certificate: means the document issued by the commissioner to a person indicating that the person is certified by the State as qualified to perform the job indicated in that document. See Maine Revised Statutes Title 32 Sec. 1371

Certificate: means a certificate of competency issued by the department stating that an applicant has met the requirements for the specified operator classification. See Maine Revised Statutes Title 32 Sec. 4171

Certificate of approval holder: means :

certificate of approval holder: means an in-state manufacturer of malt liquor or wine licensed under section 1355?A or an out-of-state manufacturer of or out-of-state wholesaler of malt liquor or wine that has been issued a certificate of approval under section 1361. Certified responsible managing supervisor: means a person certified by the State as qualified to determine whether the plan and installation of fire sprinkler systems meet the standards provided by law, rule and regulation. See Maine Revised Statutes Title 32 Sec. 1371

Chambers: A judge's office.

Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.

Chief executive officer: means the Chief Executive Officer of the Maine Public Employees Retirement System. See Maine Revised Statutes Title 5 Sec. 17001

Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.

Child: means a person under 6 years of age who has not entered kindergarten. See Maine Revised Statutes Title 22 Sec. 3931

Child: means any natural or legally adopted, born or unborn, progeny of a member. See Maine Revised Statutes Title 5 Sec. 17001

child: means an unmarried person who has not attained 21 years of age. See Maine Revised Statutes Title 22 Sec. 4099-I

Child abuse and neglect prevention council: means a community organization that provides continuous year-round service as a county's primary organization that serves to encourage and coordinate community efforts to prevent child abuse from occurring. See Maine Revised Statutes Title 22 Sec. 3872

Child care: means a regular service of care and education provided for compensation for any part of a day less than 24 hours to a child or children under 16 years of age whose parents work outside the home, attend an educational program or are otherwise unable to care for their children. See Maine Revised Statutes Title 22 Sec. 3731

Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72

Child protection proceeding: means a proceeding on a child protection petition under subchapter VI, a subsequent proceeding to review or modify a case disposition under section 4038, an appeal under section 4006, a proceeding on a termination petition under subchapter VI, or a proceeding on a medical treatment petition under subchapter VIII. See Maine Revised Statutes Title 22 Sec. 4002

Child sex trafficking: means the recruitment, harboring, transportation, provision or obtaining of a child for the purposes of a commercial sex act as defined in 22 United States Code § 7102(4). See Maine Revised Statutes Title 22 Sec. 4002

Chronic pain: means pain that persists beyond the usual course of an acute disease or healing of an injury. See Maine Revised Statutes Title 22 Sec. 7246

Civic auditorium: means a municipal, county or state or a quasi-municipal, quasi-county or quasi-state owned or operated auditorium or civic center. See Maine Revised Statutes Title 28-A Sec. 2

Civil forfeiture: The loss of ownership of property used to conduct illegal activity.

Class A lounge: means a place where liquor is sold at tables, booths and counters. See Maine Revised Statutes Title 28-A Sec. 2

Class A restaurant: means a place that is regularly used for the purpose of providing full meals for the public on the premises, that is equipped with a separate and complete kitchen and that maintains adequate dining room equipment and capacity for preparing and serving full meals upon the premises. See Maine Revised Statutes Title 28-A Sec. 2

Clerk: means the person described in Title 13?C, chapter 5?A. See Maine Revised Statutes Title 5 Sec. 102

Clerk filing: means the public organic document of a domestic filing entity formed under Title 13?C. See Maine Revised Statutes Title 5 Sec. 102

Client company: means a person, association, partnership, corporation or other entity that leases employees from an employee leasing company pursuant to contract. See Maine Revised Statutes Title 32 Sec. 14051

Club: means a group of individuals incorporated and operating in a bona fide manner solely for purposes of recreational, social, patriotic or fraternal nature and not for pecuniary gain. See Maine Revised Statutes Title 28-A Sec. 2

Commercial clerk: means a clerk who is listed under section 106. See Maine Revised Statutes Title 5 Sec. 102

commercial lease: means a nonresidential tenancy of premises by a for-profit business entity. See Maine Revised Statutes Title 14 Sec. 6017

Commercial processor: means a person who maintains an official establishment under this chapter for the purpose of processing livestock, meat, meat food products, poultry or poultry products other than for the exclusive use in the household of the owner of the commodity by the owner and members of the owner's household and the owner's nonpaying guests and employees. See Maine Revised Statutes Title 22 Sec. 2511

Commercial registered agent: means an individual or a domestic or foreign entity listed under section 106. See Maine Revised Statutes Title 5 Sec. 102

Commercial slaughterhouse: means a person engaged in the business of slaughtering livestock or poultry other than as a custom slaughterhouse. See Maine Revised Statutes Title 22 Sec. 2511

Commercial sporting camp: means a building or group of buildings devoted primarily to the offering of primitive lodging facilities for a fee to persons primarily in pursuit of primitive recreation or snowmobiling. See Maine Revised Statutes Title 12 Sec. 682

commission: means the Interstate Prescription Monitoring Program Commission created pursuant to section 7266. See Maine Revised Statutes Title 22 Sec. 7262

Commission: means the State Liquor and Lottery Commission established in Title 5, section 12004?G, subsection 14. See Maine Revised Statutes Title 28-A Sec. 2

Commissioner: means the Commissioner of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 1-A

Commissioner: means the Commissioner of Agriculture, Conservation and Forestry or the commissioner's duly authorized agent. See Maine Revised Statutes Title 7 Sec. 3907

Common consumption area: means an area designated as a common area within an entertainment district in which customers of more than one common consumption area licensee are permitted to consume spirits, wine and malt liquor sold by the common consumption area licensees. See Maine Revised Statutes Title 28-A Sec. 2

Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.

Community: means a geographical area represented by a community coalition and served or to be served by a project. See Maine Revised Statutes Title 22 Sec. 3931

Community coach: means an employee of or contractor with a community contractor who is trained under subsection 11 and performs administrative functions in carrying out the duties of a project. See Maine Revised Statutes Title 22 Sec. 3931

Community coalition: means a group of stakeholders, service providers or other members within a community under subsection 7 that sponsors and collaborates in the implementation and administration of a project. See Maine Revised Statutes Title 22 Sec. 3931

Community contractor: means a nonprofit organization that is the applicant and responsible lead member of a community coalition for a project. See Maine Revised Statutes Title 22 Sec. 3931

Community provider: means a child care center, family child care provider or other service provider that has entered into a contract with a community contractor to provide services as part of a project. See Maine Revised Statutes Title 22 Sec. 3931

Community Reinvestment Act: The Act is intended to encourage depository institutions to help meet the credit needs of the communities in which they operate, including low- and moderate-income neighborhoods. It was enacted by the Congress in 1977. ^{Source: OCC}

Community-based offshore wind energy project: means a wind energy development, as defined by Title 35?A, section 3451, subsection 11, with an aggregate generating capacity of less than 3 megawatts that meets the following criteria: the generating facilities are wholly or partially located on or above the coastal submerged lands of the State; the generating facilities are located within one nautical mile of one or more islands that are within the unorganized and deorganized areas of the State and the project will offset part or all of the electricity requirements of those island communities; and the development meets the definition of "community-based renewable energy project" as defined by Title 35?A, section 3602, subsection 1. Community-based program: means a program of adult day care offered outside of a long-term health care facility and which meets the licensing and program standards of the Department of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 6202

Companion animal: means a cat or dog. See Maine Revised Statutes Title 7 Sec. 3907

Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.

Conditional license: means a license granted to an applicant who has met the requirements of section 1524?C but who is not certified with the Registry of Interpreters for the Deaf, Inc. See Maine Revised Statutes Title 32 Sec. 1521

Constable: means a law enforcement officer appointed by municipal officers pursuant to law. See Maine Revised Statutes Title 7 Sec. 3907

Consumer package: means a container or package that contains a product in its final form for sale to the end-use consumer. See Maine Revised Statutes Title 22 Sec. 2511

Content information: when used with respect to any wire, oral or electronic communication, includes any information concerning the substance, purport or meaning of that communication. See Maine Revised Statutes Title 16 Sec. 641

Continuance: Putting off of a hearing ot trial until a later time.

Continuing care: means furnishing shelter for the life of the individual or for a period in excess of one year and either health care, supportive services, or both, under an agreement requiring prepayment as defined in subsection 12, whether or not the shelter and services are provided at the same location, to 3 or more older individuals not related by blood or marriage to the providers. See Maine Revised Statutes Title 24-A Sec. 6201

Continuing care agreement: means the contract or contracts which create the obligation to provide continuing care, including, but not limited to, mutually terminable contracts. See Maine Revised Statutes Title 24-A Sec. 6201

Contract: A legal written agreement that becomes binding when signed.

Controlled substance: means a controlled substance included in schedules II, III or IV of 21 United States Code § 812 or 21 C. See Maine Revised Statutes Title 22 Sec. 7246

Conviction: A judgement of guilt against a criminal defendant.

Copayment: means an amount an enrollee must pay in order to receive a specific service that is not fully prepaid. See Maine Revised Statutes Title 24-A Sec. 4202-A

Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.

Corporation: means a corporation organized and incorporated under the laws of the State or authorized to transact business within the State. See Maine Revised Statutes Title 28-A Sec. 2

Council: means the Maine Children's Cabinet Early Childhood Advisory Council established pursuant to Title 5, section 12004?J, subsection 18. See Maine Revised Statutes Title 22 Sec. 3731

Council: means the Animal Welfare Advisory Council as established by Title 5, section 12004?I, subsection 2?C or its duly authorized agent. See Maine Revised Statutes Title 7 Sec. 3907

Council: means the Maine Dairy and Nutrition Council. See Maine Revised Statutes Title 7 Sec. 2997

Counterclaim: A claim that a defendant makes against a plaintiff.

Court: includes , but is not limited to, the Probate Court and District Court, or any other state court with juvenile jurisdiction. See Maine Revised Statutes Title 22 Sec. 4099-I

Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.

Covered employee: means an individual who is 18 years of age or older who is employed by a covered employer and who has wages or other compensation that are allocable to the State during a calendar year. See Maine Revised Statutes Title 5 Sec. 171

Covered employer: means a person or entity engaged in a business, industry, profession, trade or other enterprise in the State, whether for profit or not for profit, that has not offered to its employees, effective in form or operation at any time within the current calendar year or 2 preceding calendar years, a specified tax-favored retirement plan. See Maine Revised Statutes Title 5 Sec. 171

Covered person: means an individual covered as a policyholder, participant or dependent under a plan, policy or contract of medical insurance. See Maine Revised Statutes Title 24-A Sec. 3952

Credible scientific evidence: means the results of a study, the experimental design and conduct of which have undergone independent scientific peer review, that are published in a peer-reviewed journal or in a publication of an authoritative federal or international governmental agency, including but not limited to the United States Department of Health and Human Services, National Toxicology Program, Food and Drug Administration and Centers for Disease Control and Prevention; the United States Environmental Protection Agency; the World Health Organization; and the European Union, European Chemicals Agency. See Maine Revised Statutes Title 32 Sec. 1741

Creditable service: means a person's membership service, the person's prior service and service for which credit is allowable under sections 17755 and 17756; section 17760, subsection 3; section 18258; sections 18355 and 18356; and section 18360, subsection 2. See Maine Revised Statutes Title 5 Sec. 17001

Creditable service: means service rendered while a member of the former Maine Legislative Retirement System, the Legislative Retirement Program, the former Maine State Retirement System or the State and Teacher Retirement Program for which credit is allowed under section 802. Criminal record information system: means a system including equipment, facilities, procedures and agreements for the collection, processing, preservation and dissemination of criminal record information including criminal history record information. See Maine Revised Statutes Title 16 Sec. 632

Critical area: means any natural area documented by the Natural Areas Program that is conserved or protected in its natural condition through voluntary action. See Maine Revised Statutes Title 12 Sec. 544

Culturally and linguistically appropriate services: means services that are designed to serve culturally diverse populations in their preferred languages; function effectively within the context of cultural beliefs, behaviors and needs presented by TANF and ASPIRE-TANF participants and their communities; contribute to a work environment that supports diversity; promote community engagement; build trust and relationships with TANF and ASPIRE-TANF participants; actively support and enable TANF and ASPIRE-TANF participants to make informed choices; and value and facilitate the exchange of information with TANF and ASPIRE-TANF participants. Custodial parent: means a parent with custody. See Maine Revised Statutes Title 22 Sec. 4002

Custodian: means the person who has legal custody and power over the person of a child. See Maine Revised Statutes Title 22 Sec. 4002

Custom processor: means a person who maintains a registered establishment under this chapter for the purpose of processing livestock, meat, meat food products, poultry or poultry products exclusively for use in the household of the owner of the commodity by the owner and members of the owner's household and the owner's nonpaying guests and employees. Custom slaughterhouse: means a person who maintains a registered establishment under this chapter for the purposes of slaughtering livestock or poultry for another person's exclusive use by that person and members of that person's household and that person's nonpaying guests and employees, and who is not engaged in the business of buying or selling carcasses, parts of carcasses, meat or meat food products or any cattle, sheep, swine, goats, poultry or other designated animals useable as human food. See Maine Revised Statutes Title 22 Sec. 2511

Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.

Dangerous dog: means a dog or wolf hybrid that causes the death of or inflicts serious bodily injury on an individual or a domesticated animal who is not trespassing on the dog or wolf hybrid owner's or keeper's premises at the time of the injury or death; a dog or wolf hybrid that causes a reasonable and prudent person who is not on the dog or wolf hybrid owner's or keeper's premises and is acting in a reasonable and nonaggressive manner to fear imminent serious bodily injury by assaulting or threatening to assault that individual or individual's domesticated animal; or a dog or wolf hybrid that inflicts bodily injury on an individual or a domesticated animal who is not trespassing on the dog or wolf hybrid owner's or keeper's premises at the time of the injury and has previously been determined by a court of competent jurisdiction to be a nuisance dog. Dealer: means any person or entity who purchases or receives milk from a producer within the State for processing and sale within or outside the State. See Maine Revised Statutes Title 7 Sec. 3152

Dealer: shall mean any person engaged in the business of dealing in, selling, buying, exchanging or trading in weighing or measuring devices in this State;

Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

Detention: means the holding of a person in a facility characterized by either physically restrictive construction or intensive staff supervision that is intended to prevent a person who is placed in or admitted to the facility from departing at will. See Maine Revised Statutes Title 15 Sec. 3003

Devise: To gift property by will.

Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.

Dismissal: The dropping of a case by the judge without further consideration or hearing. ^Source:

Docket: A log containing brief entries of court proceedings.

Dog: means a member of the genus and species known as canis familiaris, except that in chapters 720, 721, 725, 727, 729 and 739 "dog" means a member of the genus and species known as canis familiaris or any canine, regardless of generation, resulting from the interbreeding of a member of canis familiaris with a wolf hybrid. Dog licensing agent: means a veterinarian office or animal shelter that licenses dogs for a municipality. See Maine Revised Statutes Title 7 Sec. 3907

Domestic entity: means an entity whose internal affairs are governed by the laws of this State. See Maine Revised Statutes Title 5 Sec. 102

Domestic partner: means one of 2 unmarried adults who are domiciled together under long-term arrangements that evidence a commitment to remain responsible indefinitely for each other's welfare. See Maine Revised Statutes Title 1 Sec. 72

Domestic violence: means conduct described in Title 17?A, chapters 9, 11, 12 and 13; Title 17?A, sections 432, 433, 506, 506?A, 506?B, 758, 805, 806, 852 and 853; and Title 19?A, section 4102, subsection 1, when the victim of that conduct or threat is a family or household member, as defined in Title 19?A, section 4102, subsection 6, paragraphs A to E or dating partner, as defined in Title 19?A, section 4102, subsection 4. (1) Workers' compensation benefits;

(2) Maintenance, if any;

(3) Any money paid by an employer to a 3rd party under a tax sheltered annuity contract or a deferred compensation plan for the future benefit of an employee provided that the money is not derived from amounts excluded from earnable compensation by paragraph B; and

Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. Electronic funds transfer: means the use of an electronic device for the purpose of ordering, instructing or authorizing a financial institution or credit union to debit or credit an account. See Maine Revised Statutes Title 28-A Sec. 2

Embedded professional development: means an activity performed by a community coach to encourage rule-specific knowledge, skills and dispositions to support responsive caregiving and developmentally appropriate teaching practices implemented for learning that is integrated into the work day, consists of assessing and finding solutions for authentic and immediate problems of practice as part of a cycle of continuous improvement and is grounded in day-to-day teaching practice designed to enhance a teacher's or caregiver's practices with the intent of improving children's social, emotional and cognitive development. Emergency medical treatment: means those skills, techniques and judgments, as defined by the board, which are directed to maintaining, improving or preventing the deterioration of the medical condition of the patient and which are appropriate to be delivered by trained persons at the scene of a patient's illness or injury outside the hospital and during transportation to the hospital. Employee: means :

Enrollee: means an individual who is enrolled in a health maintenance organization. See Maine Revised Statutes Title 24-A Sec. 4202-A

Enterprise fund: means the Maine Retirement Savings Program Enterprise Fund established in section 178. See Maine Revised Statutes Title 5 Sec. 171

Entertainment district: means an area that is located within a municipality that is established by ordinance of the municipal legislative body in accordance with section 221. See Maine Revised Statutes Title 28-A Sec. 2

Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.

Entity: means a person that has a separate legal existence or has the power to acquire an interest in real property in its own name other than:

Entrance fee: means an initial payment of a sum of money or any other consideration that assures a subscriber a place in a facility for a term of years or for life. See Maine Revised Statutes Title 24-A Sec. 6201

Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. ^{Source: U.S. Courts}

ERISA: means the federal Employee Retirement Income Security Act of 1974, as amended, 29 United States Code § 1001 et seq. See Maine Revised Statutes Title 5 Sec. 171

Escrow: Money given to a third party to be held for payment until certain conditions are met.

Essential tool: means a tool, implement or other device required by the manufacturer, including but not limited to a tablet, scanner, diagnostic machine, computer, computer program, computer software, website, website portal or similar tool, with respect to which there is no other similar tool or device available from any source other than the manufacturer or the representative of a manufacturer that will perform the function necessary to the diagnosis or repair of a manufacturer's express warranty claim on a new motor vehicle. See Maine Revised Statutes Title 10 Sec. 1171

Estates: shall be construed to mean both real estate and personal property. See Maine Revised Statutes Title 36 Sec. 501

Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.

Evidence of coverage: means any certificate, agreement or contract issued to a group contract holder or an enrollee setting out the coverage to which an enrollee is entitled. See Maine Revised Statutes Title 24-A Sec. 4202-A

Ex officio: Literally, by virtue of one's office.

Executive session: A portion of the Senate's daily session in which it considers executive business.

Executor: A male person named in a will to carry out the decedent

Exploration: means an examination of an area for the purpose of discovering the presence of minerals with techniques which include all of the manual, mechanical, electronic or chemical methods of determining the presence, size and quality of a mineral deposit. See Maine Revised Statutes Title 12 Sec. 549-A

Explosives: means explosive materials which are used to explore, develop or mine a mineral deposit. See Maine Revised Statutes Title 12 Sec. 549-A

Facility: means a physical plant in which continuing care is provided in accordance with this chapter. See Maine Revised Statutes Title 24-A Sec. 6201

facility: means any aboveground oil storage tank or tanks, together with associated piping, and transfer and dispensing facilities located over land or water of the State at a single location for more than 4 months per year and used or intended to be used for the storage or supply of oil. See Maine Revised Statutes Title 10 Sec. 963-A

Facility: means any physical structure. See Maine Revised Statutes Title 15 Sec. 3003

Factory branch: means a branch office maintained by a manufacturer which manufactures or assembles motor vehicles for sale to distributors or motor vehicle dealers or which is maintained for directing and supervising the representatives of the manufacturer. See Maine Revised Statutes Title 10 Sec. 1171

Factory representative: means a representative employed by a manufacturer or employed by a factory branch for the purpose of making or promoting the sale of motor vehicles or for supervising, servicing, instructing or contracting motor vehicle dealers or prospective motor vehicle dealers. See Maine Revised Statutes Title 10 Sec. 1171

Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.

Family: means a child, the child's parent and all people living in the household of the child who are supported by the income of the child's parent and related to the child or child's parent by blood, marriage or adoption. See Maine Revised Statutes Title 22 Sec. 3931

Family support team: means a specialized team of professionals evaluating children who are suspected victims of child abuse and neglect as defined in section 4002, subsection 1. See Maine Revised Statutes Title 22 Sec. 4092

Federal Act: means the Federal Food, Drug and Cosmetic Act (Title 21 U. See Maine Revised Statutes Title 22 Sec. 2152

Federal acts: means the Federal Meat Inspection Act and the Poultry Products Inspection Act. See Maine Revised Statutes Title 22 Sec. 2511

federal Affordable Care Act: means the federal Patient Protection and Affordable Care Act, Public Law 111-148, as amended by the federal Health Care and Education Reconciliation Act of 2010, Public Law 111-152, and any amendments to or regulations or guidance issued under those acts. See Maine Revised Statutes Title 24-A Sec. 14

Federal Government: means the United States of America or any agency or instrumentality, corporate or otherwise, of the United States of America. See Maine Revised Statutes Title 30-A Sec. 2001

Federal Meat Inspection Act: means the Act so entitled, approved March 4, 1907, 34 Stat. See Maine Revised Statutes Title 22 Sec. 2511

Federal poverty level: means the nonfarm income official poverty line for a family of the size involved, as defined by the federal Office of Management and Budget and revised annually in accordance with the United States Omnibus Budget Reconciliation Act of 1981, Section 673, Subsection 2. See Maine Revised Statutes Title 22 Sec. 3762

Feral cat: means a cat without owner identification of any kind that consistently exhibits extreme fear in the presence of people. See Maine Revised Statutes Title 7 Sec. 3907

Fetal alcohol spectrum disorder: means a condition whose effects include having facial characteristics, growth restriction, central nervous system abnormalities or other characteristics consistent with prenatal alcohol exposure identified in a child from birth to 12 months of age. See Maine Revised Statutes Title 22 Sec. 4002

Fiduciary: A trustee, executor, or administrator.

Filing entity: means an entity that is created by the filing of a public organic document. See Maine Revised Statutes Title 5 Sec. 102

financial assistance: means guarantees, leases, insurance, financing credits, loans or the purchase or discounts thereof, letters of credit, financing assistance payments, grants or other financial aid. See Maine Revised Statutes Title 10 Sec. 963-A

Financial document: means a lease, installment sale agreement, conditional sale agreement, note, mortgage, loan agreement or other instrument pertaining to an extension of financial assistance. See Maine Revised Statutes Title 10 Sec. 963-A

Fire sprinkler system: means an assembly of overhead piping or conduits that conveys water with or without other agents to dispersal openings or devices to extinguish, control or contain fire and to provide protection from exposure to fire or the products of combustion, planned in accordance with a national or state standard. See Maine Revised Statutes Title 32 Sec. 1371

Fire sprinkler system contractor: means a person licensed by the commissioner to undertake the planning, installation or inspection of a fire sprinkler system or any part of such a system. See Maine Revised Statutes Title 32 Sec. 1371

Fiscal agent: means an incorporated community organization, agency or institution designated by the child abuse and neglect prevention council and authorized by the Department of Health and Human Services to receive and distribute grants to that child abuse and neglect prevention council. See Maine Revised Statutes Title 22 Sec. 3872

Fiscal year: means the provider's fiscal year. See Maine Revised Statutes Title 24-A Sec. 6201

Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.

Flight nurse: means any registered professional nurse, currently licensed in the State, who has completed a prehospital care curriculum authorized by the Emergency Medical Services' Board. See Maine Revised Statutes Title 32 Sec. 83

Food: means articles used for food or drink for humans or other animals, chewing gum and articles used for components of any such article. See Maine Revised Statutes Title 22 Sec. 2152

Food contact chemical of high concern: means a chemical identified by the department pursuant to section 1742. See Maine Revised Statutes Title 32 Sec. 1741

Food establishment: includes a caregiver, as defined in section 2422, subsection 8?A, and a registered dispensary, as defined in section 2422, subsection 6, that prepare food containing cannabis for medical use by a qualifying patient pursuant to chapter 558?C. See Maine Revised Statutes Title 22 Sec. 2152

Food salvage establishment: means a food establishment engaged in reconditioning or by other means salvaging distressed merchandise and includes any food establishment that sells, buys, warehouses or distributes any salvaged merchandise. See Maine Revised Statutes Title 22 Sec. 2152

Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. ^{Source: OCC}

Foreign entity: means an entity other than a domestic entity. See Maine Revised Statutes Title 5 Sec. 102

Foreign qualification document: means an application for a certificate of authority or other foreign qualification filing with the Secretary of State by a foreign entity. See Maine Revised Statutes Title 5 Sec. 102

Foster parent: means a person whose home is licensed by the department as a family foster home as defined in section 8101, subsection 3 and with whom the child lives pursuant to a court order or agreement with the department. See Maine Revised Statutes Title 22 Sec. 4002

Franchise: means an oral or written arrangement for a definite or indefinite period in which a manufacturer, distributor or wholesaler grants to a motor vehicle dealer a license to use a trade name, service mark or related characteristic, and in which there is a community of interest in the marketing of motor vehicles or services related thereto at wholesale, retail, leasing or otherwise. See Maine Revised Statutes Title 10 Sec. 1171

Franchisee: means a motor vehicle dealer to whom a franchise is offered or granted. See Maine Revised Statutes Title 10 Sec. 1171

Franchisor: means a manufacturer, distributor or wholesaler who grants a franchise to a motor vehicle dealer. See Maine Revised Statutes Title 10 Sec. 1171

Fraud: Intentional deception resulting in injury to another.

Full age: means the age of 18 and over. See Maine Revised Statutes Title 1 Sec. 72

Fund: means the repository for funds donated to the Maine Children's Trust Incorporated by the taxpayers of the State through an income tax checkoff pursuant to Title 36, section 5285 as well as federal grants and contracts, privately donated funds and in-kind donations for prevention programs, or by any means for the purposes of this chapter. See Maine Revised Statutes Title 22 Sec. 3881

Fund: means the Waste Oil Furnace Loan Fund established by this subchapter. See Maine Revised Statutes Title 10 Sec. 1099-A

Fund: means the Controlled Substances Prescription Monitoring Program Fund established in section 7247. See Maine Revised Statutes Title 22 Sec. 7246

Funded debt: means an obligation for the payment of which some fund is set aside. See Maine Revised Statutes Title 30-A Sec. 2001

Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor

General obligation security: means a note, bond or other certificate of indebtedness to the payment of which is pledged the full faith and credit of the issuing body. See Maine Revised Statutes Title 30-A Sec. 2001

General public benefit: means a material positive impact on society and the environment, taken as a whole, assessed against a 3rd-party standard, from the business and operations of a benefit corporation. See Maine Revised Statutes Title 13-C Sec. 1802

Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.

Golf course: means a commercially operated facility, whether publicly or privately owned, that offers golfing facilities to the public for a fee, including a regulation-size golf course of no fewer than 9 holes and an average total of not less than 1,200 yards per 9 holes, that has a value of not less than $100,000 and that has adequate facilities for the sale and consumption of liquor. See Maine Revised Statutes Title 28-A Sec. 2

Good faith: means honesty in fact and the observation of reasonable commercial standards of fair dealing in the trade as is defined and interpreted in the Uniform Commercial Code, Title 11, section 1?1201, subsection (20). See Maine Revised Statutes Title 10 Sec. 1171

Governance interest: means the right under the organic law or organic rules of an entity, other than as a governor, agent, assignee or proxy, to:

Government entity: means a state or local government agency, including but not limited to a law enforcement entity or any other investigative entity, agency, department, division, bureau, board or commission or an individual acting or purporting to act for or on behalf of a state or local government agency. Governor: means a person by or under whose authority the powers of an entity are exercised and under whose direction the business and affairs of the entity are managed pursuant to the organic law and organic rules of the entity. See Maine Revised Statutes Title 5 Sec. 102

Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. ^{Source: Federal Reserve}

Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,

Grandparent: means the parent of a child's parent. See Maine Revised Statutes Title 22 Sec. 4002

Grantee: means the person to whom a freehold estate or interest in land is conveyed. See Maine Revised Statutes Title 1 Sec. 72

Green wood: means trees or parts of trees that have been freshly felled. See Maine Revised Statutes Title 10 Sec. 2361-A

Group contract holder: means an entity or person that has purchased coverage from a health maintenance organization that provides, at a minimum, basic health care services to enrollees. See Maine Revised Statutes Title 24-A Sec. 4202-A

Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.

Guardian: means a person lawfully invested with the power, and charged with the duty, of taking care of a person and managing the property and rights of the person, who, because of age, is considered incapable of administering the person's own affairs. See Maine Revised Statutes Title 15 Sec. 3003

Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.

Hard cider: means liquor produced by fermentation of the juice of apples or pears, including, but not limited to, flavored, sparkling or carbonated cider, that contains not less than 1/2 of 1% alcohol by volume and not more than 8. See Maine Revised Statutes Title 28-A Sec. 2

Hauler: means the person, company or other entity that owns the truck or trailer on which a load of wood is transported. See Maine Revised Statutes Title 10 Sec. 2361-A

Health care: means the provision of any one or more of the following services:

Health care practitioner: has the meaning set forth in Title 24, section 2502, subsection 1?A. See Maine Revised Statutes Title 32 Sec. 83

Health care provider: means an appropriately licensed, certified or registered provider of mental or physical health care, in either the public or private sector. See Maine Revised Statutes Title 5 Sec. 17001

Health care services: means any services included in the furnishing of medical care, dental care or hospitalization to an individual, or any services incident to the furnishing of that care or hospitalization, as well as the furnishing of any other services to an individual to prevent, alleviate, cure or heal human illness or injury. See Maine Revised Statutes Title 24-A Sec. 4202-A

health insurance: means insurance of human beings against bodily injury, disablement or death by accident or accidental means, or the expense thereof, or against disablement or expense resulting from sickness, and every insurance appertaining thereto, including provision for the mental and emotional welfare of human beings by defraying the costs of legal services only to the extent provided for in chapter 38. See Maine Revised Statutes Title 24-A Sec. 704

Health maintenance organization: means an organization authorized under chapter 56 to operate a health maintenance organization in this State. See Maine Revised Statutes Title 24-A Sec. 3952

Health maintenance organization: means a public or private organization that is organized under the laws of the Federal Government, this State, another state or the District of Columbia or a component of such an organization, and that:

Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.

High-priced item or service: means an item or service covered under the original Medicare fee-for-service program under Part A and Part B of Title XVIII of the Social Security Act that the board, in consultation with and based on analysis by the Department of Health and Human Services and Maine Health Data Organization, has identified in advance of a plan year that contributes to association costs and offers an opportunity for savings. See Maine Revised Statutes Title 24-A Sec. 3952

Historic site: means any area of land owned, leased or otherwise controlled by the State, with or without buildings, improvements or other structures, that has been classified by the director for public use wholly or primarily because of its historical, archaeological or scientific interest or value. See Maine Revised Statutes Title 12 Sec. 1801

Home health services: means those services performed by home health care providers required to be licensed under Title 22, chapter 419. See Maine Revised Statutes Title 24-A Sec. 6201

Home rule authority: means the powers granted to municipalities under chapter 111; section 3001; and the Constitution of Maine, Article VIII, Part Second. See Maine Revised Statutes Title 30-A Sec. 2001

Home visitor: means a person who provides services to a participant in the participant's home. See Maine Revised Statutes Title 22 Sec. 3931

Home visitor services: means interactions between a home visitor and a parent that on the part of the home visitor are nurturing, responsive and intentional and that support the parent in the parent's role as the primary teacher of the parent's child and assist the parent in using the parent's home and the community as the child's learning environment. See Maine Revised Statutes Title 22 Sec. 3931

Homeless youth: means a person 21 years of age or younger who is unaccompanied by a parent or guardian and is without shelter where appropriate care and supervision are available, whose parent or legal guardian is unable or unwilling to provide shelter and care or who lacks a fixed, regular and adequate nighttime residence. See Maine Revised Statutes Title 22 Sec. 4099-D

Hotel: means a place where the public obtains sleeping accommodations for consideration and where food is offered for sale to the public, whether or not under one roof. See Maine Revised Statutes Title 28-A Sec. 2

Hotel guest: means a person whose name and address are registered on a registry maintained by a hotel and who is the bona fide occupant of a room of the hotel. See Maine Revised Statutes Title 28-A Sec. 2

Humane agent: means an employee of the department who assists in enforcing this Part. See Maine Revised Statutes Title 7 Sec. 3907

Humanely clean conditions: means that both indoor areas and outdoor enclosures are cleaned on a periodic basis to remove excretions and other waste materials, dirt and trash with sufficient frequency to minimize health hazards and to provide adequately clean living conditions for the species of animal. See Maine Revised Statutes Title 7 Sec. 3907

Humanely trap: means to trap an animal using traps and trapping methods that are designed to avoid injury to animals to the greatest extent practicable for animal control or animal rescue purposes. See Maine Revised Statutes Title 7 Sec. 3907

Immediate container: means a consumer package or any other container in which livestock products or poultry products are packed. See Maine Revised Statutes Title 22 Sec. 2511

in writing: include printing and other modes of making legible words. See Maine Revised Statutes Title 1 Sec. 72

In-plan covered services: includes emergency services. See Maine Revised Statutes Title 24-A Sec. 4202-A

Income: means annual contributions made to the fund through the income tax checkoff. See Maine Revised Statutes Title 22 Sec. 3881

Incorporated civic organization: means an organization incorporated as a corporation without stock under Title 13, chapter 81 or Title 13?B with a civic or charitable purpose, including but not limited to relief of poverty, advancement of education and the arts, promotion of social health, safety and welfare, fostering community and economic development, protection against animal cruelty, combating community deterioration, lessening the burdens of government and providing assistance to the underprivileged and distressed. See Maine Revised Statutes Title 28-A Sec. 2

Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. ^{Source: FDIC}

Independent: means having no material relationship with a benefit corporation or a subsidiary of the benefit corporation, except that serving as benefit director or benefit officer does not make an individual not independent. See Maine Revised Statutes Title 13-C Sec. 1802

Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.

Infant: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72

Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.

Inspect: means to visually examine a fire sprinkler system or a portion of the system to verify that it appears to be in working order and free from physical damage. See Maine Revised Statutes Title 32 Sec. 1371

Inspection: means access to and review of juvenile case records in a manner prescribed by the Supreme Judicial Court. See Maine Revised Statutes Title 15 Sec. 3003

Inspector: means an employee or official of the State or an employee or official of the Federal Government or of any other governmental entity of this State, authorized by the commissioner to perform inspection functions under this chapter under an agreement between the commissioner and the governmental entity. See Maine Revised Statutes Title 22 Sec. 2511

Installation: means the initial placement of a sprinkler system or part of the system or the extension, modification or alteration of a system or part after the initial placement. See Maine Revised Statutes Title 32 Sec. 1371

Insured: means any individual, partnership, corporation, association or other entity which is the beneficiary of a loan insurance agreement with the authority. See Maine Revised Statutes Title 10 Sec. 963-A

insurer: includes an insurance company, a nonprofit hospital and medical service organization, a fraternal benefit society, a health maintenance organization, a self-insured employer subject to state regulation as described in section 2848?A, a 3rd-party administrator, a multiple-employer welfare arrangement, a reinsurer that reinsures health insurance in this State or a captive insurance company established pursuant to chapter 83 that insures the health coverage risks of its members. Intentionally added chemical: means a chemical that was added during the manufacture of a product or product component to provide a specific characteristic, appearance or quality or to perform a specific function. See Maine Revised Statutes Title 32 Sec. 1741

Inter vivos: Transfer of property from one living person to another living person.

Interest: means :

Interest holder: means a direct holder of an interest. See Maine Revised Statutes Title 5 Sec. 102

Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. ^{Source: OCC}

Interim care: means the status of temporary physical control of a juvenile by a person authorized by section 3501. See Maine Revised Statutes Title 15 Sec. 3003

Internal Revenue Code: means the United States Internal Revenue Code of 1986, as amended. See Maine Revised Statutes Title 5 Sec. 171

Interpreter: means a person who provides any of the following services:

Interpreting: means the process when a linguistic intermediary between a deaf or hard-of-hearing person and another person translates the spoken utterances or signs, gestures or writing of either person into a linguistic form other than that which that person uses as a primary and preferred form of communication. See Maine Revised Statutes Title 32 Sec. 1521

Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.

IRA: means a traditional IRA or Roth IRA. See Maine Revised Statutes Title 5 Sec. 171

jeopardy: means serious abuse or neglect, as evidenced by:

Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.

Juvenile: means a person who had not attained 18 years of age at the time the person allegedly committed a juvenile crime. See Maine Revised Statutes Title 15 Sec. 3003

Juvenile case records: means all records, regardless of form or means of transmission, that comprise a juvenile court file of an individual case, including, but not limited to, court-generated information, information and documents filed by filers, transcripts of depositions, hearings, proceedings and interviews, documentary exhibits in the custody of the clerk of the court, electronic records, videotapes and records of other proceedings filed with the clerk of the court. See Maine Revised Statutes Title 15 Sec. 3003

Juvenile community corrections officer: means an agent of the Department of Corrections authorized:

Juvenile Court: means the District Court exercising the jurisdiction conferred by section 3101. See Maine Revised Statutes Title 15 Sec. 3003

Juvenile crime: has the meaning set forth in section 3103. See Maine Revised Statutes Title 15 Sec. 3003

Keeper: means a person in possession or control of a dog or other animal. See Maine Revised Statutes Title 7 Sec. 3907

Keg: means a container capable of holding at least 5 gallons of liquid. See Maine Revised Statutes Title 28-A Sec. 2

Kennel: means 5 or more dogs kept in a single location under one ownership for breeding, hunting, show, training, field trials, sledding, competition or exhibition purposes. See Maine Revised Statutes Title 7 Sec. 3907

Legal custodian: means a person who has legal custody of a juvenile. See Maine Revised Statutes Title 15 Sec. 3003

Legal custody: means the right to the care, custody and control of a juvenile and the duty to provide food, clothing, shelter, ordinary medical care, education and discipline for a juvenile, and, in an emergency, to authorize surgery or other extraordinary care. Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).

Legislator: means a member of the Legislature who is actively serving as of December 3, 1986, or who is elected subsequent to December 2, 1986. See Maine Revised Statutes Title 3 Sec. 701

Lessee: means a tenant under a lease and may include an installment purchaser. See Maine Revised Statutes Title 10 Sec. 963-A

Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.

License: means a full, temporary, provisional or conditional license issued by the board under this chapter. See Maine Revised Statutes Title 32 Sec. 83

License: means the document issued by the commissioner to a contractor authorizing the contractor to engage in the fire sprinkler system business in this State. See Maine Revised Statutes Title 32 Sec. 1371

Licensed establishment: means a person required to hold a license under section 2514. See Maine Revised Statutes Title 22 Sec. 2511

Licensed establishment: means premises to which a license for the sale of spirits, wine or malt liquor to be consumed on or off the licensed premises applies and any person or organization that is licensed to sell spirits, wine or malt liquor during the times and in the places and manners as specified in the license. Line make: means motor vehicles that are offered for sale, lease or distribution under a common name, trademark, service mark or brand name. See Maine Revised Statutes Title 10 Sec. 1171

Liquor: means spirits, wine, malt liquor or hard cider, or any substance containing liquor, intended for human consumption, that contains more than 1/2 of 1% of alcohol by volume. See Maine Revised Statutes Title 28-A Sec. 2

Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.

Livestock: means cattle; equines; sheep; goats; swine; domesticated cervids, fowl and rabbits; members of the family Camelidae, genus lama and genus vicugna; bison; and ratites. See Maine Revised Statutes Title 7 Sec. 3907
