Terms Used In Maine Revised Statutes Title 30-A Sec. 5353

  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Development plan: means a plan proposed by an educational institution of higher learning or a private redevelopment corporation for the redevelopment and renewal of a project area. See Maine Revised Statutes Title 30-A Sec. 5352
  • Educational institution of higher learning: means an educational institution, no part of the net earnings of which inures to the benefit of any private shareholder or individual, which provides an educational program for which it awards a baccalaureate or more advanced degree, or provides for not less than a 2-year program which is acceptable for full credit towards such a degree.   • Hospital: means any public or private hospital licensed by the State, no part of the net earnings of which inures to the benefit of any private shareholder or individual. See Maine Revised Statutes Title 30-A Sec. 5352
  • Municipality: means any municipality which is authorized under chapter 203, directly or through its urban renewal authority, to undertake and carry out redevelopment or renewal projects. See Maine Revised Statutes Title 30-A Sec. 5352
  • Private redevelopment corporation: means any corporation which is wholly owned or controlled by one or more educational institutions of higher learning or a corporation which operates on behalf of an educational institution on a nonprofit basis. See Maine Revised Statutes Title 30-A Sec. 5352
  • Project area: means a slum area or a blighted, deteriorated or deteriorating area. See Maine Revised Statutes Title 30-A Sec. 5352
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • United States: includes territories and the District of Columbia. See Maine Revised Statutes Title 1 Sec. 72
The legislative body of any municipality may approve, after a public hearing, a development plan proposed by any educational institution of higher learning or hospital located in the municipality, or by a private redevelopment corporation, for the redevelopment and renewal of a project area, adjacent to or in the immediate vicinity of the location of principal buildings of the institution or hospital, or a major branch of the institution or hospital, where teaching or research is done or where students or faculty live, and the area of an urban renewal project, assisted under the United States Housing Act of 1949, Public Law 81-171, Title I, as amended, which is being undertaken by the municipality or its urban renewal authority. Any state educational institution of higher learning, hospital or private redevelopment corporation may prepare these development plans. Any city may authorize any educational institution of higher learning or hospital established and maintained by the city to prepare development plans. [PL 1987, c. 737, Pt.
