  • AASSPs: means anhydrous ammonia safety and security practices established by the commission under section 5. See Michigan Laws 286.773
  • Accredited veterinarian: means a veterinarian approved by the administrator of the United States Department of Agriculture, Animal and Plant Health Inspection Service in accordance with 9 C. See Michigan Laws 287.703
  • Acknowledgment form: means a scale weight ticket, a load slip, or any other evidence of deposit issued by a grain dealer or his or her authorized representative to a depositor that identifies the farm produce being transferred from the possession of the depositor to the possession of the grain dealer. See Michigan Laws 285.62
  • Acknowledgment form: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Act of terrorism: means a willful and deliberate act that is all of the following:
  (i) An act that would be a violent felony under the laws of this state, whether or not committed in this state. See Michigan Laws 750.543b
  • Actor: means a person accused of criminal sexual conduct. See Michigan Laws 750.520a
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Administrative expenses: means the costs described in section 9(2). See Michigan Laws 285.313
  • Administrative premium: means the amount of money charged to and collected from a producer under section 10. See Michigan Laws 285.313
  • Administrator: means the chief officer of the Michigan department of commerce or his or her designated representative. See Michigan Laws 449.1101
  • Administrator: means the director of the department or his or her designated representative. See Michigan Laws 450.4102
  • Administrator: means the office of financial and insurance regulation of the department of energy, labor, and economic growth. See Michigan Laws 451.2102
  • Adoption: means a transfer of ownership, with or without remuneration, of an animal from an animal control shelter or animal protection shelter to an individual for the purpose of being a companion animal for that individual. See Michigan Laws 287.331
  • Adult foster care facility: means that term as defined in section 3 of the adult foster care facility licensing act, MCL 400. See Michigan Laws 750.145m
  • Adult foster care facility licensing act: means 1979 PA 218, MCL 400. See Michigan Laws 750.145m
  • Advertising: means all representations other than those on the label, disseminated in any manner or by any means, and relating to seed within the scope of this act. See Michigan Laws 286.702
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Advisory committee: means the seed potato advisory committee created in section 6. See Michigan Laws 286.682
  • Aeronaut: includes aviator, pilot, balloonist, and every other person having any part in the operation of aircraft while in flight. See Michigan Laws 750.43
  • Affected area: means the area defined in the petition. See Michigan Laws 286.401
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliated person: means a person directly or indirectly controlling the cemetery and includes all of the following:
  •   (i) A person who holds at least a 50% interest in a cemetery. See Michigan Laws 456.522
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agent: means a person that solicits, takes orders, or sells nursery stock in this state for a grower or dealer of nursery stock, but not on the premises or place of business of the grower or dealer of nursery stock. See Michigan Laws 286.202
  • Agent: means an individual other than a broker-dealer who represents a broker-dealer in effecting or attempting to effect purchases or sales of securities or represents an issuer in effecting or attempting to effect purchases or sales of the issuer's securities. See Michigan Laws 451.2102
  • Agent: means a person that buys, receives, sells, exchanges, negotiates, or solicits the sale, resale, exchange, or transfer of 1 or more animals for or on behalf of another person. See Michigan Laws 287.121
  • Agreement: means the bargain of the parties in fact, as found in their language or inferred from other circumstances and from rules, regulations, and procedures given the effect of agreements under laws otherwise applicable to a particular transaction. See Michigan Laws 450.832
  • Agricultural improvements: means any improvements, buildings, structures, or fixtures suitable for use in farming which are located on agricultural land. See Michigan Laws 285.252
  • Agricultural land: means land suitable for use in farming. See Michigan Laws 285.252
  • Agricultural processing: means the enhancement or improvement of the overall value of an agricultural commodity or of an animal or plant product into a product of higher value, including, but not limited to, marketing, agricultural processing, transforming, or packaging. See Michigan Laws 286.432
  • Agricultural product: means any agricultural commodity or product, whether raw or processed, including any commodity or product derived from livestock that is marketed for human or livestock use or consumption. See Michigan Laws 286.903
  • Agricultural seed: means the seed of grass, forage, cereal, fiber, oil plants, and any other seed commonly recognized within this state as agricultural or field seed, lawn seed, or mixtures of those seeds. See Michigan Laws 286.702
  • airport: when used in this act means any location which is used for the landing or taking off of aircraft, which provides facilities for the shelter, supply or care of aircraft, or for receiving or discharging passengers or cargo, and all appurtenant areas used or acquired for airport buildings or other airport facilities, and all appurtenant rights-of-way, either heretofore or hereafter established. See Michigan Laws 259.432
  • Airport: means a structure or an area of land or water that is designed and set aside for the landing and taking off of aircraft, is utilized or to be utilized by and in the interest of the public for the landing and taking off of aircraft, and is licensed by the commission. See Michigan Laws 259.481
  • airport hazard: when used in this act means any structure or tree or use of land or of appurtenances thereof which obstructs the air space required for the safe flight of aircraft in landing or taking off at an airport or is otherwise hazardous or creates hazards to such safe landing or taking off of aircraft. See Michigan Laws 259.433
  • airport hazard area: when used in this act means any area of land or water, or both, upon which an airport hazard might be established if not prevented as provided in this act, including any such area which has been declared to be an "airport hazard area" by the Michigan aeronautics commission in connection with any airport approach plan adopted by said commission. See Michigan Laws 259.434
  • Alcoholic liquor: means that term as defined in section 105 of the Michigan liquor control code of 1998, 1998 PA 58, MCL 436. See Michigan Laws 750.222
  • Allegation: something that someone says happened.
  • Alteration: means a professional sterilization procedure performed by a veterinarian that renders a dog, cat, or ferret incapable of reproducing. See Michigan Laws 287.331
  • Alternative fuel: means a fuel composed of biomass or another fuel that does not have petroleum as a base or a blend of a nonpetroleum-based fuel and a petroleum-based fuel. See Michigan Laws 285.341
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amortization: Paying off a loan by regular installments.
  • Anhydrous ammonia: means an inorganic compound that consists of 1 nitrogen atom and 3 hydrogen atoms and has a chemical formula of NH3. See Michigan Laws 286.773
  • Animal: means any vertebrate animal, other than human beings, including mammals, birds, fish, reptiles, and amphibians, and any domesticated insect. See Michigan Laws 287.523
  • Animal: means mollusks, crustaceans, and vertebrates other than human beings including, but not limited to, livestock, exotic animals, aquaculture species, and domestic animals. See Michigan Laws 287.703
  • animal: means a mammal except livestock as defined in 1937 PA 284, MCL 287. See Michigan Laws 287.331
  • Animal abuse offense: means 1 or more of the following, but does not include the lawful use of an animal to hunt or to participate in field trials or the lawful killing or other use of an animal in farming or a generally accepted animal husbandry or farming practice involving livestock:
  •   (i) A violation of section 49 of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 287.331
  • Animal control officer: means a county animal control officer as described in section 29a and 29b of the dog law of 1919, 1919 PA 339, MCL 287. See Michigan Laws 287.1002
  • Animal control shelter: means a facility operated by a municipality for the impoundment and care of animals that are found in the streets or at large, animals that are otherwise held due to the violation of a municipal ordinance or state law, or animals that are surrendered to the animal control shelter. See Michigan Laws 287.331
  • Animal feed: means edible material that is consumed by an animal and contributes energy, nutrients, or both, to the animal's diet. See Michigan Laws 287.523
  • Animal movement certificate: means animal movement authorization established in a manner approved and issued by the director that contains, at a minimum, the following information regarding animals or an animal:
  •   (i) The point of origin and point of destination. See Michigan Laws 287.703
  • animal protection shelter: means an animal control shelter or animal protection shelter, respectively, registered with the department under section 6 of 1969 PA 287, MCL 287. See Michigan Laws 287.1002
  • Animal protection shelter: means a facility operated by a person, humane society, society for the prevention of cruelty to animals, or any other nonprofit organization for the care of homeless animals. See Michigan Laws 287.331
  • Animal welfare: means the well-being of animals based upon animal husbandry, animal science, and veterinary science practices and standards. See Michigan Laws 287.703
  • annual meeting: when applied to townships, mean the annual meeting required by law to be held on the Saturday immediately preceding the first Monday in April. See Michigan Laws 8.3d
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Apples: means all varieties of apples. See Michigan Laws 286.371
  • Appraisal: A determination of property value.
  • Approach surface: means an imaginary plane longitudinally centered on a runway's centerline extended, and extending outward and upward from each end of that runway's primary surface, which plane has the specifications described in section 2c. See Michigan Laws 259.481
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved laboratory: means a state, federal, or private veterinary diagnostic laboratory approved by the United States Department of Agriculture, Animal and Plant Health Inspection Service, veterinary services, to conduct approved official laboratory tests for a specific reportable animal disease. See Michigan Laws 287.703
  • Aquacultural products: means any products, coproducts, or by-products of aquaculture species. See Michigan Laws 286.872
  • Aquaculture: means the propagation and rearing of aquaculture species on the approved list of aquaculture species under the Michigan aquaculture development act, 1996 PA 199, MCL 286. See Michigan Laws 287.703
  • Aquaculture: means the commercial husbandry of aquaculture species on the approved list of aquaculture species, including, but not limited to, the culturing, producing, growing, using, propagating, harvesting, transporting, importing, exporting, or marketing of aquacultural products under an appropriate permit or registration. See Michigan Laws 286.872
  • Aquaculture facility: means that term as defined in the Michigan aquaculture development act, 1996 PA 199, MCL 286. See Michigan Laws 287.703
  • Aquaculture facility: means a farm or farm operation engaged in any aspect of aquaculture in privately controlled waters capable of holding all life stages of aquaculture species with a barrier or enclosure to prevent their escape into waters of the state. See Michigan Laws 286.872
  • Aquaculture facility registration: means a registration issued by the director allowing a facility to engage in aquaculture. See Michigan Laws 286.872
  • Aquaculture lot: means a group of aquatic animals that share approximately the same risk of exposure to a pathogenic agent or toxin within a defined location due to common management or sharing a common aquatic environment. See Michigan Laws 287.703
  • Aquaculture research permit: means a permit issued by the director to researchers to study and culture aquaculture species not included on the approved list of aquaculture species for the evaluation of aquacultural potential and to provide a scientific basis for including the aquaculture species on the approved list. See Michigan Laws 286.872
  • Aquaculture species: means that term as defined in the Michigan aquaculture development act, 1996 PA 199, MCL 286. See Michigan Laws 287.703
  • Aquaculture species: means aquatic animal organisms including, but not limited to, fish, crustaceans, mollusks, reptiles, or amphibians reared or cultured under controlled conditions in an aquaculture facility. See Michigan Laws 286.872
  • Aquaculture species: means aquatic animal organisms, including, but not limited to, fish, crustaceans, mollusks, reptiles, or amphibians, reared or cultured under controlled conditions for commercial aquaculture or the pet trade. See Michigan Laws 287.121
  • Aquaculturist: means a person involved in or engaged in any aspect of aquaculture. See Michigan Laws 286.872
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Articles of organization: means the original documents filed to organize a limited liability company, as amended or restated by certificates of correction, amendment, or merger, by restated articles, or by other instruments filed or issued under any statute. See Michigan Laws 450.4102
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means the state exposition and fairgrounds authority created in section 9. See Michigan Laws 285.162
  • Authority: means the Michigan family farm development authority established in section 3. See Michigan Laws 285.252
  • Authority: means the farm produce insurance authority created in section 5. See Michigan Laws 285.313
  • Authority board: means the board for the authority appointed under section 9. See Michigan Laws 285.162
  • Autogenous veterinary biological: means all bacteria, viruses, serums, toxins, or analogous products from a specific herd that are custom-made with herd-specific antigens. See Michigan Laws 287.703
  • Automated transaction: means a transaction conducted or performed, in whole or in part, by electronic means or electronic records, in which the acts or records of 1 or both parties are not reviewed by an individual in the ordinary course in forming a contract, performing under an existing contract, or fulfilling an obligation required by the transaction. See Michigan Laws 450.832
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bank: means any of the following:
  •   (i) A banking institution organized under the laws of the United States. See Michigan Laws 451.2102
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Bee disease: means American or European foulbrood, sacbrood, bee paralysis, parasites of bees, or other disease or abnormal condition of the egg, larval, pupal, or adult stages of bees. See Michigan Laws 286.801
  • Bees: means any life stage of the common honey bee, Apis mellifera L. See Michigan Laws 286.801
  • Beginning farmer: means an individual with a low or moderate net worth who engages in farming or wishes to engage in farming. See Michigan Laws 285.252
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Bequeath: To gift property by will.
  • Bequest: Property gifted by will.
  • Biodiesel: means a fuel composed of mono-alkyl esters of long chain fatty acids derived from vegetable oils or animal fats and, in accordance with standards specified by the American society for testing and materials, designated B100, and meeting the requirements of D6751, as approved by the department. See Michigan Laws 285.341
  • Biosecurity: means measures, actions, or precautions taken to prevent the transmission of disease in, among, or between free-ranging and privately owned cervidae species. See Michigan Laws 287.952
  • Blend: means seed consisting of more than 1 variety of a kind, each in excess of 5% of the whole. See Michigan Laws 286.702
  • Board: means the rural development fund board established in section 3. See Michigan Laws 286.942
  • Board: means the board of directors of the authority described in section 7. See Michigan Laws 285.313
  • Bodily injury: means any physical injury. See Michigan Laws 750.462a
  • bonds: means bonds or other obligations outstanding and secured by any such "trust mortgage. See Michigan Laws 451.401
  • Bonds: means bonds issued by the authority pursuant to this act. See Michigan Laws 285.252
  • Brand: means a word, name, symbol, or device, or a combination of any of these that identifies the commercial feed of a manufacturer or distributor and distinguishes it from that of other manufacturers or distributors. See Michigan Laws 287.523
  • Brand: means a word, name, symbol, number, or design used to identify seed of 1 person to distinguish it from the seed of another person. See Michigan Laws 286.702
  • Brandish: means to point, wave about, or display in a threatening manner with the intent to induce fear in another person. See Michigan Laws 750.222
  • Breeder seed: means seed or plant propagating material directly controlled by the originating or, in certain cases, the sponsoring plant breeder or institution, and which provides the source of foundation seed. See Michigan Laws 286.71
  • Broker: means to engage or participate in the marketing of industrial hemp by acting as an intermediary or negotiator between prospective buyers and sellers. See Michigan Laws 286.842
  • broker: means a person that, as a principal or agent, engages in the business of buying, receiving, selling, exchanging, buying for slaughter, negotiating, or soliciting sale, resale, exchange, transportation, or transfer of animals. See Michigan Laws 287.121
  • Broker-dealer: means a person engaged in the business of effecting transactions in securities for the account of others or for the person's own account. See Michigan Laws 451.2102
  • Burial right: means a right of earth interment. See Michigan Laws 456.522
  • Business of debt management: means providing or offering to provide debt management to 1 or more residents of this state. See Michigan Laws 451.412
  • Business owned by persons with disabilities: means a business in which all of the following apply:
  •   (i) More than 50% of the voting shares or interest in the business is owned, controlled, and operated by 1 or more persons with disabilities. See Michigan Laws 450.792
  • Business plan: means a written document of intent that a person submits to the department that defines the methods, protocols, or procedures that the person intends on implementing to be in compliance with this act. See Michigan Laws 287.952
  • Buying station: means a facility or location where livestock are congregated and purchased by the owner or agent of the facility or location for movement or sale. See Michigan Laws 287.121
  • Cannabis: means the plant Cannabis sativa L. See Michigan Laws 286.842
  • Carcasses: means the dead bodies of domestic animals. See Michigan Laws 287.703
  • Caregiver: means an individual who directly cares for or has physical custody of a vulnerable adult. See Michigan Laws 750.145m
  • Cash sale: means a sale in which the title to farm produce is transferred only after a price is decided upon before or at the time of delivery and payment for the farm produce meets 1 of the following:
  •   (i) Payment of the price is made to the depositor in cash or by check, money order, wire transfer, or draft within 10 days of delivery. See Michigan Laws 285.62
  • Cat: means any live domestic cat (felis catus) for use or intended to be used for research, tests or experiments at research facilities. See Michigan Laws 287.381
  • Cat: means a domestic cat of any age of the species Felis catus. See Michigan Laws 287.331
  • Cattle: means ruminating and nonruminating bovine animals sold for slaughter, ruminating and nonruminating bovine animals produced in this state to be fed for slaughter, and ruminating and nonruminating bovine animals to be fed for slaughter and sold in this state more than 30 days after arrival in this state. See Michigan Laws 287.602
  • Cattle: means all bovine (genus bos) animals, bovinelike animals (genus bison) also commonly referred to as American buffalo or bison, and any cross of these species unless otherwise specifically provided. See Michigan Laws 287.703
  • Cease order: means a cease order issued by the director pursuant to section 15. See Michigan Laws 287.523
  • Cemetery: means 1 or a combination of more than 1 of the following:
  •   (i) A burial ground for earth interments. See Michigan Laws 456.522
  • Cemetery owner: means the person who has title to the cemetery. See Michigan Laws 456.522
  • Certificate of limited partnership: means the certificate, and the certificate as amended or restated, referred to in section 201. See Michigan Laws 449.1101
  • certified: means a determination made by a registered certifying agent that an agricultural product has been produced and handled in compliance with the Michigan organic standards. See Michigan Laws 286.903
  • Certified counselor: means an individual who is certified by a training program or certifying organization, approved by the director, that authenticates the competence of individuals who provide education and assistance to other individuals in connection with debt counseling and financial counseling functions. See Michigan Laws 451.412
  • Certified seed: means the progeny of foundation, registered or certified seed if designated foundation and plant propagating materials that are so handled as to maintain satisfactory genetic identity and purity and have met certification standards required by this act and have been approved and certified by the director upon the advice of official seed certifying agencies. See Michigan Laws 286.71
  • Certified seed: means a class of seed that meets the requirements of 1959 PA 221, MCL 286. See Michigan Laws 286.682
  • Certifying agent: means an entity registered by the department that certifies production or handling operations or portions of production or handling operations as meeting the Michigan organic standards. See Michigan Laws 286.903
  • Certifying authority: means the official seed-certifying agency of this state or the authorized seed potato certifying agency of another state, territory, or country. See Michigan Laws 286.682
  • Cervidae livestock facility: means a privately owned cervidae livestock operation on privately controlled lands capable of holding cervidae species. See Michigan Laws 287.952
  • Cervidae livestock operation: means an operation that contains 1 or more privately owned cervidae species involving the producing, growing, propagating, using, harvesting, transporting, exporting, importing, or marketing of cervidae species or cervidae products under an appropriate registration. See Michigan Laws 287.952
  • Cervidae products: means any products, co-products, or by-products of cervidae, including antler, antler velvet, meat, or any part of the animal. See Michigan Laws 287.952
  • Cervidae species: means members of the cervidae family including, but not limited to, deer, elk, moose, reindeer, and caribou. See Michigan Laws 287.952
  • Charitable purpose: means the relief of poverty, the advancement of education or religion, the promotion of health, the promotion of a governmental purpose, or any other purpose the achievement of which is beneficial to the community. See Michigan Laws 451.922
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Chemical irritant: means solid, liquid, or gas that through its chemical or physical properties, alone or in combination with 1 or more other substances, can be used to produce an irritant effect in humans, animals, or plants. See Michigan Laws 750.200h
  • Chemical irritant device: means a device designed or intended to release a chemical irritant. See Michigan Laws 750.200h
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Claimant: means a person to whom a grain dealer owes a financial obligation for farm produce or who is entitled to the farm produce delivered to the grain dealer or the proceeds of the farm produce. See Michigan Laws 285.62
  • Claimant: means a producer who makes a claim for reimbursement from the fund under section 15. See Michigan Laws 285.313
  • Closing: means the permanent shutting down of operations at any establishment at which at least 25 persons are employed. See Michigan Laws 450.732
  • Coercion: includes , but is not limited to, any of the following:
  •   (i) Threatening to harm or physically restrain any individual or the creation of any scheme, plan, or pattern intended to cause an individual to believe that failure to perform an act would result in psychological, reputational, or financial harm to, or physical restraint of, any individual. See Michigan Laws 750.462a
  • Collection point: means a facility or location where livestock are congregated by the owner or agent of the facility or location for transfer or movement. See Michigan Laws 287.121
  • Columbarium: means a building or other aboveground structure that is affixed to land and is a permanent repository for cremated human remains. See Michigan Laws 456.522
  • Commercial feed: means all materials or combination of materials, including feed ingredients, that are distributed or intended for distribution for use as animal feed or for mixing in animal feed. See Michigan Laws 287.523
  • Commercial sexual activity: means 1 or more of the following for which anything of value is given or received by any person:
  •   (i) An act of sexual penetration or sexual contact as those terms are defined in section 520a. See Michigan Laws 750.462a
  • Commingling: means concurrently or subsequently sharing or subsequent use by livestock or other domestic animals of the same pen or same section in a facility or same section in a transportation unit where there is physical contact or contact with bodily excrements, aerosols, or fluids from other livestock or domestic animals. See Michigan Laws 287.703
  • Commingling: means the mixing together of or physical contact between unpackaged organic products and nonorganic agricultural products during production or handling. See Michigan Laws 286.903
  • Commission: means the commission of agriculture and rural development. See Michigan Laws 285.362
  • Commission: means the commission of agriculture and rural development. See Michigan Laws 287.523
  • Commission: means the state beef industry commission. See Michigan Laws 287.602
  • Commission: means the commission of agriculture. See Michigan Laws 286.773
  • commission: means the public trust commission as hereinbefore created. See Michigan Laws 451.302
  • commission: when used in this act means the Michigan aeronautics commission, or any successor thereto established by law. See Michigan Laws 259.435

  • Commission: means the commission of agriculture and rural development. See Michigan Laws 286.942
  • commissioner: means the director of the department of labor and economic growth or a designee of the director. See Michigan Laws 456.522
  • Commodity exchange act: means the commodity exchange act, 7 USC 1 to 27f. See Michigan Laws 451.2103
  • common enterprise: means an enterprise in which the fortunes of the investor are interwoven with those of either the person offering the investment, a third party, or other investors. See Michigan Laws 451.2102c
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Computer program: means a set of statements or instructions to be used directly or indirectly in an information processing system in order to bring about a certain result. See Michigan Laws 450.832
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Conditioning: means drying, cleaning, scarifying, and other operations that change the purity or germination of the seed and require the seed lot to be retested to determine the label information. See Michigan Laws 286.702
  • Confinement research facility: means a facility holding an aquaculture research permit, enclosed in a secure structure, and separated from other aquaculture facilities and in which aquaculture species are isolated and maintained in complete and continuous confinement to prevent their escape into the environment and to prevent the release of any possible pathogens into the environment. See Michigan Laws 286.872
  • Consignee: means a person receiving animals at the point of destination named on an official interstate or intrastate health certificate, official interstate certificate of veterinary inspection or animal movement certificate, entry authorization form, fish disease inspection report, owner-shipper statement, or sales invoice. See Michigan Laws 287.703
  • Consignor: means a person moving animals from a point of origin named on an official interstate or intrastate health certificate, official interstate certificate of veterinary inspection or animal movement certificate, entry authorization form, fish disease inspection report, owner-shipper statement, or sales invoice. See Michigan Laws 287.703
  • Constituent: means a party to a plan of merger, including the survivor. See Michigan Laws 450.4102
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract: means the total legal obligation resulting from the parties' agreement as affected by this act and other applicable law. See Michigan Laws 450.832
  • Contract feeder: means a person that is an independent contractor that feeds animals pursuant to a contract if the feed is supplied, furnished, or otherwise provided to the person. See Michigan Laws 287.523
  • Contribution: means any cash, property, services rendered, or a promissory note or other binding obligation to contribute cash or property or to perform services, which a partner contributes to a limited partnership in the capacity of a partner. See Michigan Laws 449.1101
  • Contribution: means anything of value that a person contributes to the limited liability company as a prerequisite for, or in connection with, membership, including cash, property, services performed, or a promissory note or other binding obligation to contribute cash or property, or to perform services. See Michigan Laws 450.4102
  • Controlled: means exercising the power to make policy decisions in a business. See Michigan Laws 450.771
  • Controlled: means exercising the power to make policy decisions in a business. See Michigan Laws 450.792
  • Controlled atmosphere storage: means the storage of fruits or vegetables in an approved sealed storage room or in an approved sealed storage building, or in a sealed storage space within the room or building, under controlled conditions of time in days, oxygen content, carbon dioxide content, and temperature as established by this act or rules adopted under this act. See Michigan Laws 286.371
  • Controlled substance: means a controlled substance or controlled substance analogue as those terms are defined in section 7104 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 750.222
  • Controlling the pollination: means a method of hybridization that will produce pure seed that is at least 75% hybrid seed. See Michigan Laws 286.702
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative association: means that term as defined in 12 USC 1141j. See Michigan Laws 285.313
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Counselor: means a certified counselor who is an employee or agent of a licensee who engages in financial counseling and debt counseling functions. See Michigan Laws 451.412
  • Credit account: means the account through which a business organization or financial institution allows a person or organization to obtain goods, property, services, or any other thing of value on credit. See Michigan Laws 750.157m
  • Credit card: means either of the following:
  •   (i) Any instrument or device which is sold, issued, or otherwise distributed by a business organization or financial institution for the use of the person or organization identified on the instrument or device for obtaining goods, property, services, or anything of value on credit. See Michigan Laws 750.157m
  • Creditor: means a person for whose benefit a licensee collects and disperses money. See Michigan Laws 451.412
  • Cremation: means the incineration of the body of the deceased person. See Michigan Laws 456.522
  • Crematory: means a building or structure, within which the remains of deceased persons are or are intended to be cremated. See Michigan Laws 456.522
  • Crop seed: means the seed of plants grown as crops, other than the kind or variety included in the pure seed, as determined by methods defined by rule promulgated under this act. See Michigan Laws 286.702
  • Crypt: means a chamber in a mausoleum of sufficient size to entomb the uncremated remains of a deceased person. See Michigan Laws 456.522
  • Cryptocurrency: means digital currency in which encryption techniques are used to regulate the generation of units of currency and verify the transfer of funds, and that operates independently of a central bank. See Michigan Laws 750.157m
  • Cultivar: means unique variety. See Michigan Laws 286.682
  • Customer-formula feed: means commercial feed that consists of a mixture of commercial feeds or feed ingredients, each batch of which is manufactured according to the specific instructions of the final purchaser or purchaser's agent. See Michigan Laws 287.523
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dangerous animal: means a dog or other animal that bites or attacks a person, or a dog that bites or attacks and causes serious injury or death to another dog while the other dog is on the property or under the control of its owner. See Michigan Laws 287.321
  • Dangerous to human life: means that which causes a substantial likelihood of death or serious injury or that is a violation of section 349 or 350. See Michigan Laws 750.543b
  • Dealer: means any person who for compensation or profit delivers for transportation, transports, boards, buys or sells dogs or cats for research purposes and does not mean a person who breeds or raises dogs or cats for sale to a research facility. See Michigan Laws 287.381
  • Dealer: means a person required to be licensed under 1937 PA 284, MCL 287. See Michigan Laws 287.703
  • Debt bondage: includes , but is not limited to, the status or condition of a debt arising from a pledge by the debtor of his or her personal services or those of an individual under his or her control as a security for a debt, if the value of those services as reasonably assessed is not applied toward the liquidation of the debt or the length and nature of those services are not specifically limited and defined.   • Debt management: means the planning and management of the financial affairs of a debtor and the receipt of money from the debtor for distribution to 1 or more of the debtor's creditors in payment or partial payment of the debtor's obligations. See Michigan Laws 451.412
  • Debtor: means a person from which money is collected for the benefit of a creditor of the debtor. See Michigan Laws 451.412
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

  • Depositor: means either of the following:
  •   (i) A person who delivers farm produce to a licensed grain dealer for storage, processing, shipment, or sale and has title to the farm produce at the time of delivery. See Michigan Laws 285.62
  • Depositor: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313

  • Depreciable agricultural property: means personal property suitable for use in farming for which an income tax deduction for depreciation is allowable in computing federal income tax under the internal revenue code. See Michigan Laws 285.252

  • Developmental disability: means an impairment of general intellectual functioning or adaptive behavior that meets all of the following criteria:

  • Distribute: means to deliver other than by administering or dispensing a veterinary biological. See Michigan Laws 287.703
  • Distributed ledger technology: means any distributed ledger protocol and supporting infrastructure, including blockchain, that uses a distributed, decentralized, shared, and replicated ledger, whether use of the ledger is public or private, permissioned or permissionless, and that may include the use of electronic currencies or electronic tokens as a medium of electronic exchange. See Michigan Laws 750.157m
  • Distribution: means a direct or indirect transfer of money or other property or the incurrence of indebtedness by a limited liability company to or for the benefit of its members or assignees of its members in respect of the members' membership interests. See Michigan Laws 450.4102
  • Distributor: means a person that distributes. See Michigan Laws 287.523
  • Dog: means any live dog of the species canis familiaris for use or intended to be used for research tests or experiments at research facilities. See Michigan Laws 287.381
  • Dog: means an animal of the species Canisfamiliaris or Canislupusfamiliaris. See Michigan Laws 287.1002
  • Dog: means a domestic dog of any age of the species Canis familiaris. See Michigan Laws 287.331
  • domestic limited liability company: means an entity that is an unincorporated membership organization formed under this act. See Michigan Laws 450.4102
  • domestic limited partnership: means a partnership formed by 2 or more persons under the laws of this state and having 1 or more general partners and 1 or more limited partners. See Michigan Laws 449.1101
  • domestic limited partnership: means a limited partnership formed under the Michigan revised uniform limited partnership act, 1982 PA 213, MCL 449. See Michigan Laws 450.4102
  • Donor: The person who makes a gift.
  • Dormant seed: means viable seed, excluding hard seed that fail to germinate when provided with the specified germination conditions for the kind of seed in question. See Michigan Laws 286.702
  • Drug: means either of the following:
  •   (i) Any article intended for use in the diagnosis, cure, mitigation, treatment, or prevention of disease in animals. See Michigan Laws 287.523
  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Michigan Laws 450.832
  • Electronic agent: means a computer program or an electronic or other automated means used independently to initiate an action or respond to electronic records or performances in whole or in part, without review or action by an individual. See Michigan Laws 450.832
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Electronic monitoring: means that term as defined in section 85 of the corrections code of 1953, 1953 PA 232, MCL 791. See Michigan Laws 750.520a
  • Electronic record: means a record created, generated, sent, communicated, received, or stored by electronic means. See Michigan Laws 450.832
  • Electronic signature: means an electronic sound, symbol, or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record. See Michigan Laws 450.832
  • Electronic signatures in global and national commerce act: means the electronic signatures in global and national commerce act, 15 USC 7001 to 7031. See Michigan Laws 451.2103
  • electronically transmitted: means any form of communication that meets all of the following:
  •   (i) It does not directly involve the physical transmission of paper. See Michigan Laws 450.4102
  • Embargo order: means an embargo order issued by the director pursuant to section 15. See Michigan Laws 287.523
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Emigrant agent: means a person engaged in recruiting, hiring, soliciting or enticing laborers by any means whatsoever in this state to be employed beyond the limits of this state in farm labor. See Michigan Laws 286.651
  • Employee-owned corporation: means a business operation that is controlled by, and designed to maintain control by, its employees, and in which control is distributed among its employees according to a democratic formula, if the business operation is 1 of the following:
  •   (i) A business operation the management rights of which are represented by voting stock that may be owned only by: employees of the operation, a nonprofit community development corporation, or an employee-owned stock ownership plan in which not less than 50% of the employees participate in each portion of the plan.   • Employer: means a person employing or seeking to employ an employee for farm labor. See Michigan Laws 286.651
  • End user: means the person actually using anhydrous ammonia for a legal purpose. See Michigan Laws 286.773
  • Endowment and perpetual care: means all general work necessary to keep the cemetery property in a presentable condition at all times, including, but not limited to, the cutting of grass at reasonable intervals; the raking, cleaning, filling, seeding, and sodding of graves; the replacement, pruning, or removal of shrubs and trees in order to assure access to interment rights; and the repair and maintenance of enclosures, buildings, drives, walks, and the various memorial gardens.   • Endowment fund: means an institutional fund or part of an institutional fund that, under the terms of a gift instrument, is not wholly expendable by the institution on a current basis. See Michigan Laws 451.922
  • engine: means a device or combination of devices which provide the necessary force or motive power to cause the model rocket to move through the air. See Michigan Laws 259.781
  • Enterprise: includes an individual, sole proprietorship, partnership, corporation, limited liability company, trust, union, association, governmental unit, or other legal entity or a group of persons associated in fact although not a legal entity. See Michigan Laws 750.159f
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Equidae: means all animals of the equine family and includes horses, asses, jacks, jennies, hinnies, mules, donkeys, burros, ponies, and zebras. See Michigan Laws 287.703
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Establishment: includes a factory, plant, office, or other facility, but does not include a construction site or other work place that was intended to be a temporary work place. See Michigan Laws 450.732
  • Ethanol: means a substance that meets the American society for testing and materials standard in effect on the effective date of this act as the D4806 specification for denatured fuel grade ethanol for blending with gasoline. See Michigan Laws 285.341
  • Event of withdrawal of a general partner: means an event that causes a person to cease to be a general partner as provided in section 402. See Michigan Laws 449.1101
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executor: A male person named in a will to carry out the decedent
  • Exhibition facility: means a facility used or intended to be used for public view, show, display, swap, exchange, entertainment, advertisement, educational event, or competition involving animals. See Michigan Laws 287.703
  • Exhibition or exposition: means a congregation, gathering, or collection of animals that are presented or exposed to public view for show, display, swap, exchange, entertainment, educational event, instruction, advertising, or competition. See Michigan Laws 287.703
  • Exhibitor: means a person that presents an animal for public display, exhibition, or competition or enters an animal in a fair, show, exhibition, or exposition. See Michigan Laws 287.703
  • Exotic animal: means a species of animal that is not native to the United States. See Michigan Laws 287.703
  • Expenditures: means payments and contracts for goods, services, and construction which may be acquired competitively and are not regulated by separate authority, and, where the department acts as the sole or primary contracting officer and has selective discretion as to the supplier, vendor, or contractor. See Michigan Laws 450.771
  • Expenditures: means payments and contracts for goods, services, and construction which may be acquired competitively and are not regulated by separate authority, and, where the department acts as the sole or primary contracting officer and has selective discretion as to the supplier, vendor, or contractor. See Michigan Laws 450.792
  • Expert on wolf-dog cross identification: means an individual who has, cumulatively, no fewer than 10 years of training and field experience in wolf and wolf-dog cross behavioral and morphological characteristics and who is recognized as an expert at the state and national levels by others in the same field. See Michigan Laws 287.1002
  • FAA: means the Federal Aviation Administration or a successor agency to the Federal Aviation Administration. See Michigan Laws 259.481
  • Facility: means an adult foster care facility, a home for the aged, or a nursing home. See Michigan Laws 750.145m
  • Facility: means a plant designed for receiving or storing farm produce, a plant designed for value-added agricultural processing, or a retail sales establishment of a business engaged in making retail sales directly to farmers with 75% or more of its gross retail sales volume exempted from sales tax under section 4a(1)(e), (f), (g), and (h) of the general sales tax act, 1933 PA 167, MCL 205.   • Facility: means an indoor or outdoor cage, pen, or similar enclosure where a wolf-dog cross is kept. See Michigan Laws 287.1002
  • Facility: means an indoor or outdoor cage, pen, or similar enclosure where a large carnivore is kept. See Michigan Laws 287.1102
  • Facility: means an edifice, silo, tank, bin, crib, interstice, or protected enclosed structure, or more than 1 edifice, silo, tank, bin, crib, interstice, or protected enclosed structure located contiguous to each other, used to receive, deposit, or store farm produce in bulk. See Michigan Laws 285.62
  • Facility: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Fair: means a competition and educational exhibition of agricultural commodities and manufactured products for which premiums may be paid. See Michigan Laws 287.703
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Fair share program: means a program in which voluntary contributions are made by some creditors to a licensee based on a percentage of the amount disbursed by the licensee on behalf of a debtor. See Michigan Laws 451.412
  • Farm: means that term as it is defined in section 2 of the Michigan right to farm act, 1981 PA 93, MCL 286. See Michigan Laws 286.432
  • Farm: means the land, plants, animals, buildings, structures, including ponds used for agricultural or aquacultural activities, machinery, equipment, and other appurtenances used in the commercial production of farm products. See Michigan Laws 286.472
  • Farm labor: means cultivation and tillage of the soil, dairying, the production, cultivation, growing and harvesting of any agricultural or horticultural commodity, the raising of livestock, bees, furbearing animals or poultry, any practices performed on the farm as an incident to or in conjunction with such farming operations, including preparation for market, delivery to storage or to market or to carriers for transportation to market or any forestry or lumbering operations, and first processing of any agricultural or horticultural commodity during seasonal operations. See Michigan Laws 286.651
  • Farm operation: means the operation and management of a farm or a condition or activity that occurs at any time as necessary on a farm in connection with the commercial production, harvesting, and storage of farm products, and includes, but is not limited to:
  •   (i) Marketing produce at roadside stands or farm markets. See Michigan Laws 286.472
  • farm operation: means those terms as defined in the Michigan right to farm act, 1981 PA 93, MCL 286. See Michigan Laws 286.872
  • Farm produce: means 1 or more of dry edible beans, soybeans, small grains, cereal grains, or corn. See Michigan Laws 285.62
  • Farm produce: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Farm produce handled: means the number of bushels or hundredweight of farm produce that a licensee receives or is otherwise obligated for in a fiscal period. See Michigan Laws 285.62
  • Farm produce handling: means any of the following:
  •   (i) Engaging or participating in the business of purchasing farm produce. See Michigan Laws 285.62
  • Farm produce trucker: means a person engaged in the business of hauling farm produce that issues price later agreements or acknowledgment forms, transfers warehouse receipts, or is responsible for payment to a depositor, but that does not own a facility. See Michigan Laws 285.62
  • Farm product: means those plants and animals useful to human beings produced by agriculture and includes, but is not limited to, forages and sod crops, grains and feed crops, field crops, dairy and dairy products, poultry and poultry products, cervidae, livestock, including breeding and grazing, equine, fish, and other aquacultural products, bees and bee products, berries, herbs, fruits, vegetables, flowers, seeds, grasses, nursery stock, trees and tree products, mushrooms, and other similar products, or any other product which incorporates the use of food, feed, fiber, or fur, as determined by the Michigan commission of agriculture. See Michigan Laws 286.472
  • Farming: means the cultivation of land for the production of agricultural crops and includes the production of poultry and poultry products, the production of livestock including breeding and grazing, the production of grains and feeds, the production of forages and sod, the production of dairy products, the production of fruits and vegetables, the production of timber and timber products, the production of seeds and grasses, and the production of equine. See Michigan Laws 285.252
  • Federal covered investment adviser: means a person registered under the investment advisers act of 1940. See Michigan Laws 451.2102
  • Federal covered security: means a security that is, or upon completion of a transaction will be, a covered security under section 18(b) of the securities act of 1933, 15 USC 77r, or rules or regulations adopted under that provision. See Michigan Laws 451.2102
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Feed ingredient: means each of the constituent materials making up a commercial feed. See Michigan Laws 287.523
  • Fees and charges of the licensee: means the total amount of money charged a debtor by a licensee, including the $50. See Michigan Laws 451.412
  • felony: when used in this act, shall be construed to mean an offense for which the offender, on conviction may be punished by death, or by imprisonment in state prison. See Michigan Laws 750.7
  • Feral swine: means swine that have lived their life or any part of their life as free roaming. See Michigan Laws 287.703
  • Ferret: means an animal of any age of the species Mustela furo. See Michigan Laws 287.331
  • Fiduciary: A trustee, executor, or administrator.
  • Field year: means the number of years a particular seed lot has been grown in the field after greenhouse propagation. See Michigan Laws 286.682
  • Filing: means the receipt under this act of a record by the administrator or a designee of the administrator. See Michigan Laws 451.2102
  • Financial harm: means any of the following:
  •   (i) Conduct prohibited under section 1 of 1968 PA 259, MCL 438. See Michigan Laws 750.462a
  • Financial institution: means a bank, savings and loan association, or credit union, and includes a corporation wholly owned by a financial institution or by the holding company parent of a financial institution. See Michigan Laws 750.157m
  • Financial institution: means a state or national bank, a state or federally chartered savings and loan association, a state or federally chartered savings bank, a state or federally chartered credit union, or other regulated lending institution that maintains a principal office or branch office in this state under the laws of this state or the United States, including, but not limited to, an entity of the federally chartered farm credit system. See Michigan Laws 286.432
  • Financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and that maintains a principal office or branch office located in this state, or a national bank for cooperatives subject to the farm credit act of 1971, Public Law 92-181, 85 Stat. See Michigan Laws 285.62
  • Financial institution: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Financial loss: means the loss to a producer who is not paid in full for farm produce that the producer sold to a grain dealer and delivered under the terms of the sales contract, after deducting any outstanding charges against the farm produce. See Michigan Laws 285.313
  • Financial transaction device: means any of the following:
  •   (i) An electronic funds transfer card. See Michigan Laws 750.157m
  • Finder: means a person who, for consideration, participates in the offer to sell, sale, or purchase of securities by locating, introducing, or referring potential purchasers or sellers. See Michigan Laws 451.2102
  • Firearm: means any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 750.222
  • firearm: except as otherwise specifically defined in statute, includes any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 8.3t
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish disease inspection report: means a document prepared by a fish health laboratory approved by the director, a veterinarian, or a fish health official giving evidence of inspections and diagnostic work performed. See Michigan Laws 287.703
  • Fish health official: means a veterinarian or a fish health specialist approved by the director who is responsible for conducting aquaculture facility inspections and issuing fish disease inspection reports. See Michigan Laws 287.703
  • Flock: means all of the poultry on 1 premises or, in the discretion of the department, a group of poultry that is segregated from all other poultry on the same premises. See Michigan Laws 287.703
  • Flower seed: means the seed of those plants usually grown for their blooms, ornamental foliage, or other ornamental parts and commonly are known and sold under the name of flower seed in this state. See Michigan Laws 286.702
  • flushed: means to move or chase from a cervidae livestock facility. See Michigan Laws 287.952
  • Food additive: means that term as defined in 21 USC 321(s). See Michigan Laws 287.523
  • For an unlawful purpose: includes , but is not limited to, having the intent to do any of the following:
  •   (i) Frighten, terrorize, intimidate, threaten, harass, injure, or kill any person. See Michigan Laws 750.200h
  • Force: includes , but is not limited to, physical violence or threat of physical violence or actual physical restraint or confinement or threat of actual physical restraint or confinement without regard to whether injury occurs. See Michigan Laws 750.462a
  • Forced labor or services: means labor or services that are obtained or maintained by force, fraud, or coercion. See Michigan Laws 750.462a
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign limited liability company: means a limited liability company formed under laws other than the laws of this state. See Michigan Laws 450.4102
  • Foreign limited partnership: means a partnership formed under the laws of any state other than this state and having as partners 1 or more general partners and 1 or more limited partners. See Michigan Laws 449.1101
  • Forest tree seed: means the seeds of those forest trees that are usually grown in nurseries and forests in this state, and that are listed in the rules promulgated under this act. See Michigan Laws 286.702
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Fraud: Intentional deception resulting in injury to another.
  • Freedom of Information Act: A federal law that mandates that all the records created and kept by federal agencies in the executive branch of government must be open for public inspection and copying. The only exceptions are those records that fall into one of nine exempted categories listed in the statute. Source: OCC
  • Fund: means the feed control fund created in section 17. See Michigan Laws 287.523
  • Fund: means the agriculture licensing and inspection fees fund created in section 9 of the insect pest and plant disease act, 1931 PA 189, MCL 286. See Michigan Laws 286.682
  • Fund: means the animal welfare fund created in section 3. See Michigan Laws 287.992
  • Fund: means the rural development fund created in section 5. See Michigan Laws 286.942
  • Fund: means the state exposition and fairgrounds fund created in section 14a. See Michigan Laws 285.162
  • Fund: means the farm produce insurance fund created in section 9. See Michigan Laws 285.313
  • Garbage: means any animal origin products, including those of poultry and fish origin, or other animal material resulting from the handling, processing, preparation, cooking, or consumption of foods. See Michigan Laws 287.703
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • General partner: means a person who has been admitted to a limited partnership as a general partner in accordance with the partnership agreement and named in the certificate of limited partnership as a general partner. See Michigan Laws 449.1101
  • Generally accepted agricultural and management practices: means those practices as defined by the Michigan commission of agriculture. See Michigan Laws 286.472
  • Genetically engineered: refers to an organism whose genome, chromosomal or extrachromosomal, is modified permanently and heritably using recombinant nucleic acid techniques, or the progeny thereof. See Michigan Laws 287.703
  • Genetically engineered: refers to an organism whose genome, chromosomal or extrachromosomal, is modified permanently and heritably using recombinant nucleic acid techniques, or the progeny thereof. See Michigan Laws 286.872
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Gift instrument: means a record or records, including an institutional solicitation, under which property is granted to, transferred to, or held by an institution as an institutional fund. See Michigan Laws 451.922
  • Good moral character: means that term as defined and determined under 1974 PA 381, MCL 338. See Michigan Laws 456.522
  • Governmental agency: means an executive, legislative, or judicial agency, department, board, commission, authority, institution, or instrumentality of the federal, state, or local government. See Michigan Laws 450.832
  • GPS coordinates: means latitude and longitude coordinates derived from a global positioning system. See Michigan Laws 286.842
  • Grain dealer: means a person engaged in the business of receiving, buying, exchanging, selling, or storing farm produce in this state. See Michigan Laws 285.62
  • Grain dealer: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Grain dealers act: means the grain dealers act, 1939 PA 141, MCL 285. See Michigan Laws 285.313
  • Grain merchandiser: means a person engaged in the business of receiving, buying, exchanging, selling, or taking title to farm produce and who is responsible for payment to a depositor but does not operate a truck or a facility. See Michigan Laws 285.62
  • grantee: may be construed as including every person to whom any such interest or estate passes in like manner. See Michigan Laws 8.3e
  • Grantor: The person who establishes a trust and places property into it.
  • grantor: may be construed as including every person from or by whom any estate in lands passes in or by any deed. See Michigan Laws 8.3e
  • Grow: means to plant, propagate, grow, cultivate, or harvest live plants or viable seeds. See Michigan Laws 286.842
  • Grower: means a person registered by the department under this act to grow industrial hemp. See Michigan Laws 286.842
  • Guaranteed: means guaranteed as to payment of all principal and all interest. See Michigan Laws 451.2102
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guarantor: means a person that agrees to be responsible for labeling, information, guarantees, and claims. See Michigan Laws 287.523
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Handle: means to possess, store, or transport industrial hemp on premises owned, operated, or controlled by a registered grower or licensed processor-handler. See Michigan Laws 286.842
  • Handle: means to sell, process, or package agricultural products. See Michigan Laws 286.905
  • Handler: means any person engaged in the business of handling agricultural products as organic products including producers who handle crops or livestock of their own production. See Michigan Laws 286.905
  • Handling operation: means any operation or portion of an operation that sells, transports, receives, or otherwise acquires agricultural products as organic products and processes, packages, or stores such organic products. See Michigan Laws 286.905
  • Harmful biological device: means a device designed or intended to release a harmful biological substance. See Michigan Laws 750.200h
  • Harmful biological substance: means a bacteria, virus, or other microorganism or a toxic substance derived from or produced by an organism that can be used to cause death, injury, or disease in humans, animals, or plants. See Michigan Laws 750.200h
  • Harmful chemical device: means a device that is designed or intended to release a harmful chemical substance. See Michigan Laws 750.200h
  • Harmful chemical substance: means a solid, liquid, or gas that through its chemical or physical properties, alone or in combination with 1 or more other chemical substances, can be used to cause death, injury, or disease in humans, animals, or plants. See Michigan Laws 750.200h
  • Harmful electronic or electromagnetic device: means a device designed to emit or radiate or that, as a result of its design, emits or radiates an electronic or electromagnetic pulse, current, beam, signal, or microwave that is intended to cause harm to others or cause damage to, destroy, or disrupt any electronic or telecommunications system or device, including, but not limited to, a computer, computer network, or computer system. See Michigan Laws 750.200h
  • Harmful radioactive device: means a device that is designed or intended to release a harmful radioactive material. See Michigan Laws 750.200h
  • Harmful radioactive material: means material that is radioactive and that can be used to cause death, injury, or disease in humans, animals, or growing plants by its radioactivity. See Michigan Laws 750.200h
  • Herd: means an isolated group of livestock maintained on common ground for any purpose, or 2 or more groups of livestock under common ownership or supervision that are geographically separated but that have an interchange or movement of livestock without regard to health status as determined by the director. See Michigan Laws 287.703
  • Herd or flock of origin: means any herd or flock in which animals are born and remain until movement or any herd or flock in which animals remain for at least 30 days immediately following direct movement into the herd or flock from another herd or flock. See Michigan Laws 287.703
  • Home for the aged: means that term as defined in section 20106 of the public health code, MCL 333. See Michigan Laws 750.145m
  • Horizontal surface: means an imaginary horizontal plane 150 feet above the elevation established for an airport, the perimeter of which plane is constructed as described in section 2e. See Michigan Laws 259.481
  • housed or kept for the primary purpose of breeding: means that the female dog has previously been bred and whelped. See Michigan Laws 287.331
  • Humane method: means either: (1) A method whereby the animal is rendered insensible to pain by mechanical, electrical, chemical or other means that is rapid and effective, before being shackled, hoisted, thrown, cast or cut; or (2) a method in accordance with ritual requirements of any religious faith whereby the animal suffers loss of consciousness by anemia of the brain caused by the simultaneous and instantaneous severance of the carotid arteries with a sharp instrument.   • Hundredweight: means a unit of weight equal to 100 pounds. See Michigan Laws 286.682
  • Hybrid: means , as applied to kinds or varieties of seed, the first generation seed of a cross, produced by controlling the pollination and by combining 2 or more inbred lines, or 1 inbred line or a single cross with an open pollinated variety, or 2 selected clones, seed lines, varieties, or species, except open pollinated varieties of corn such as zea mays. See Michigan Laws 286.702
  • Imitation harmful substance or device: means a substance or device that is designed or intended to represent 1 or more of the following or that is alleged to be 1 of the following but that is not any of the following:
  •   (i) A harmful biological device. See Michigan Laws 750.200h
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • in bulk: means feed that is not divided into parts or packaged in separate units or any lot that is not in a closed container at the time it passes to the possession of the purchaser and includes that feed at any stage of distribution. See Michigan Laws 287.523
  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 8.3q
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • industrial cooperative: means an establishment in which the owners or members all work in the establishment and are the only persons who work in the establishment. See Michigan Laws 450.732
  • Industrial hemp: means that term as defined in section 3 of the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333. See Michigan Laws 286.842
  • Inert matter: means broken seed 1/2 or less the original size, seeds of legumes or crucifers with seed coats removed, undeveloped or badly injured weed seed, the empty glumes or attached sterile glumes of grasses, stems, leaves, stones, chaff, soil, insects, fungal bodies, material added in coating or pelleting, and all other matter other than pure seed, weed, or crop seed, as determined by methods defined by rule promulgated under this act.   • Infected zone: means an area in this state that has a defined dimension determined by the director in which a specific reportable animal disease is present in animals and separated from a disease-free zone by a surveillance zone. See Michigan Laws 287.703
  • Infectious disease: means a disorder caused by an organism, including, but not limited to, a bacteria, virus, fungus, parasite, prion, or analogous organism, and that can be directly or indirectly passed from animal to animal. See Michigan Laws 287.703
  • Information: means , but is not limited to, data, text, images, sounds, codes, computer programs, software and databases. See Michigan Laws 450.832
  • Information processing system: means an electronic system for creating, generating, sending, receiving, storing, displaying, or processing information. See Michigan Laws 450.832
  • inhabitant: means a resident of a city, township, village, district or county. See Michigan Laws 8.3f
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insect pests: means insects or other invertebrates injurious to plants or plant products. See Michigan Laws 286.202
  • Insolvent: means being unable to pay debts as they become due in the usual course of a debtor's business. See Michigan Laws 450.3104
  • Institution: means any of the following:
  •   (i) A person, other than an individual, organized and operated exclusively for charitable purposes. See Michigan Laws 451.922
  • Institutional fund: means a fund held by an institution exclusively for charitable purposes. See Michigan Laws 451.922
  • Institutional investor: means any of the following, whether acting for itself or for others in a fiduciary capacity:
  •   (i) A depository institution or international banking institution. See Michigan Laws 451.2102a
  • instrument of trust: as used in this act shall be construed to mean and refer to any lawful deed of gift, grant, agreement, or any last will and testament by which the donor, grantor, or testator shall give, grant, devise, or bequeath any property, real, personal or mixed, in trust for general or specific uses; and any and all conditions, terms or directions contained therein, and any act, declaration or instructions of a legal nature made by any corporation or body directing or authorizing trustees thereunder to take, receive, hold, manage or dispose of any of the property of such corporation for general or specific purposes for the benefit of such persons or objects as may be therein designated.   • Instrumentality: means an interest, real or personal property, or other thing of value, the use of which contributes directly and materially to the commission of an offense included in the definition of racketeering. See Michigan Laws 750.159f
  • Insurance company: means a company organized as an insurance company whose primary business is writing insurance or reinsuring risks underwritten by insurance companies and which is subject to supervision by the insurance commissioner or a similar official or agency of a state. See Michigan Laws 451.2102a
  • Insured: means insured as to payment of all principal and all interest. See Michigan Laws 451.2102a
  • Intact dog: means a dog that has not been altered. See Michigan Laws 287.331
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Integrated operator: means a person located within this state that manufactures animal feed for other integrated operators if there is a minimum of 5% ownership by all persons involved in each aspect of the operation that supply or share feed and ingredients. See Michigan Laws 287.523
  • Intellectual disability: means that term as defined in section 100b of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 750.520a
  • interest: means a member's rights in the limited liability company, including, but not limited to, any right to receive distributions of the limited liability company's assets and any right to vote or participate in management. See Michigan Laws 450.4102
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Intermediate school district: means a corporate body established under part 7 of the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 750.520a
  • Interment: means the disposition of human remains by earth interment, entombment, or inurnment. See Michigan Laws 456.522
  • Internal revenue code: means the internal revenue code of 1986, 26 USC 1 to 9833. See Michigan Laws 451.2103
  • International banking institution: means an international financial institution of which the United States is a member and whose securities are exempt from registration under the securities act of 1933. See Michigan Laws 451.2102a
  • Intestate: Dying without leaving a will.
  • Intimate parts: includes the primary genital area, groin, inner thigh, buttock, or breast of a human being. See Michigan Laws 750.520a
  • Intrastate movement: means movement from 1 premises to another within this state. See Michigan Laws 287.703
  • Intrastate offering exemption: means the exemption described in section 202a or any other exemption from federal securities regulation under 15 USC 77c(a)(11) and SEC rule 147, 17 C. See Michigan Laws 451.2451
  • Investment adviser: means a person that, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or the advisability of investing in, purchasing, or selling securities or that, for compensation and as a part of a regular business, issues or promulgates analyses or reports concerning securities. See Michigan Laws 451.2102a
  • Investment adviser representative: means an individual employed by or associated with an investment adviser or federal covered investment adviser and who makes any recommendations or otherwise gives investment advice regarding securities, manages accounts or portfolios of clients, determines which recommendation or advice regarding securities should be given, provides investment advice or holds himself or herself out as providing investment advice, receives compensation to solicit, offer, or negotiate for the sale of or for selling investment advice, or supervises employees who perform any of the foregoing. See Michigan Laws 451.2102a
  • Ionizing radiation: means gamma-ray emissions from radioactive isotopes such as cobalt-60 or cesium-137; x-rays; electron beams; or any other radiation capable of altering a food's molecular structure, used for purposes that include, but are not limited to, controlling microbes, pathogens, parasites, and pests in food, preserving a food, or inhibiting physiological processes such as sprouting or ripening. See Michigan Laws 286.905
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Isolated: means the physical separation of animals by a physical barrier or geographical distance in such a manner that other animals do not have access to the isolated animals' bodies, excrement, aerosols, or discharges, as approved by the director. See Michigan Laws 287.703
  • Issuer: means a person that issues or proposes to issue a security, subject to the following:
  •   (i) The issuer of a voting trust certificate, collateral trust certificate, certificate of deposit for a security, or share in an investment company without a board of directors or individuals performing similar functions, is the person performing the acts and assuming the duties of depositor or manager pursuant to the trust or other agreement or instrument under which the security is issued. See Michigan Laws 451.2102a
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Juror: A person who is on the jury.
  • Kind: means 1 or more related species or subspecies that singly or collectively is known by 1 common name, including, but not limited to, oats, wheat, soybeans, and corn. See Michigan Laws 286.702
  • Label: means a display of written, printed, or graphic matter upon or affixed to the container in which a commercial feed is distributed or on the invoice or delivery slip with which a commercial feed is distributed. See Michigan Laws 287.523
  • Label: includes all labels, and other written, printed, or graphic representation in any form, accompanying or pertaining to any seed in bulk or in containers and includes representation on invoices, bills, and letterheads. See Michigan Laws 286.702
  • Labeling: means all labels and other written, printed, electronic, or graphic matter, and includes advertising. See Michigan Laws 287.523
  • Labeling: means all labels and other written, printed, or graphic matter upon an article or any of its containers or wrappers or accompanying the article. See Michigan Laws 286.905
  • Labor: means work of economic or financial value. See Michigan Laws 750.462a
  • Land-based industries: means food and agriculture, forestry, mining, oil and gas production, and tourism. See Michigan Laws 286.942
  • Large carnivore: means either of the following:
  •   (i) Any of the following cats of the Felidae family, whether wild or captive bred, including a hybrid cross with such a cat:
      (A) A lion. See Michigan Laws 287.1102
  • Large-scale dog breeding kennel: means a facility where more than 15 female intact dogs over the age of 4 months are housed or kept for the primary purpose of breeding. See Michigan Laws 287.331
  • Law enforcement agency: means the department of state police, the department of natural resources, a law enforcement agency of a county, township, city, or village, or a tribal law enforcement agency that is responsible for the prevention and detection of crime and enforcement of the criminal laws of this state. See Michigan Laws 287.703
  • Law enforcement officer: means a person appointed by the state or a local governmental unit who is responsible for the enforcement of the criminal laws of this state. See Michigan Laws 287.952
  • Law enforcement officer: means a person appointed by the state or a local governmental unit who is responsible for the enforcement of the criminal laws of this state. See Michigan Laws 286.872
  • Law enforcement officer: means :

  • Legal entity: means a sole proprietorship, partnership, corporation, limited liability company, or any other entity. See Michigan Laws 456.181
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a commercial feed license issued under this act. See Michigan Laws 287.523
  • License: means a written certificate or exemption order issued by the director under this act. See Michigan Laws 451.412
  • License: means a license issued by the department to a grain dealer in the manner provided under this act. See Michigan Laws 285.62
  • Licensed person: means an individual who is licensed or otherwise legally authorized to practice a professional service by a court, department, board, commission, or agency of this state or another jurisdiction. See Michigan Laws 450.1282
  • Licensed person: means an individual who is licensed or otherwise legally authorized to practice a professional service by a court, department, board, commission, or an agency of this state or another jurisdiction, any corporation or professional services corporation all of whose shareholders are licensed persons, any partnership all of whose partners are licensed persons, or any limited liability company all of whose members and managers are licensed persons.   • Licensee: means that term as defined in section 5 of the adult foster care facility licensing act, MCL 400. See Michigan Laws 750.145m
  • Licensee: means a person that has been issued a license. See Michigan Laws 287.523
  • Licensee: means a person that is licensed, or is required to be licensed, under this act to perform debt management services and is located inside or outside the boundaries of this state. See Michigan Laws 451.412
  • Licensee: means a grain dealer licensed under this act. See Michigan Laws 285.62
  • Licensee: means a person holding a license issued under this act. See Michigan Laws 287.121
  • Licensee: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Licensing and registration fund: means the industrial hemp licensing and registration fund created in section 5. See Michigan Laws 286.842
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limited partner: means a person who has been admitted to a limited partnership as a limited partner in accordance with the partnership agreement and named in the certificate of limited partnership as a limited partner. See Michigan Laws 449.1101
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livestock: means that term as it is defined in section 3 of the animal industry act, 1988 PA 466, MCL 287. See Michigan Laws 285.362
  • Livestock: means cattle, calves, sheep, swine, horses, mules, goats and any other animal which can or may be used in and for the preparation of meat or meat products. See Michigan Laws 287.551
  • Livestock: means those species of animals used for human food or for fiber or those species of animals used for service to humans. See Michigan Laws 287.703
  • Livestock: means that term as defined in section 3 of the animal industry act, 1988 PA 466, MCL 287. See Michigan Laws 287.1002
  • Livestock: means any cattle, sheep, goat, swine, poultry, captive cervidae, ratites, or equine animals used for food, fiber, feed, or other agricultural based consumer products, wild or domesticated game, or other nonplant life including fish or bees. See Michigan Laws 286.905
  • livestock: includes horses, ponies, mules, cattle, calves, swine, sheep, poultry, privately owned cervids, ratites, aquaculture species, and goats. See Michigan Laws 287.121
  • Livestock: means cattle, swine, sheep, goats, or poultry located in this state. See Michigan Laws 287.251
  • Livestock: means animals used for human food and fiber or animals used for service to human beings. See Michigan Laws 287.321
  • Livestock auction: means a livestock congregation point where livestock are accepted on consignment and the auction method is used in the marketing of livestock. See Michigan Laws 287.121
  • Livestock trucker: means a person, not otherwise licensed under this act, that engages in the business of transporting livestock not owned by the person, or the person's employer, from 1 premises to another. See Michigan Laws 287.121
  • Local unit: means a city, village, township, or county. See Michigan Laws 287.1002
  • Local unit of government: means a county, township, city, or village. See Michigan Laws 287.523
  • Local unit of government: means a county, city, township, village, school district, or any authority composed of counties, cities, townships, villages, or school districts, or any combination of these entities. See Michigan Laws 286.942
  • Locator service: means a telephone service that automatically connects callers to a network of member service providers, based on geographic location or another parameter. See Michigan Laws 451.412
  • Lot: means a definite quantity of seed identified by a number or other mark, every portion of which is uniform within recognized tolerances for the factors that appear in the labeling. See Michigan Laws 286.702
  • Low or moderate net worth: means an aggregate net worth of an individual and the individual's spouse and children, if any, of less than $250,000. See Michigan Laws 285.252
  • Low-profit limited liability company: means a limited liability company that has included in its articles of organization a purpose that meets, and that at all times conducts its activities to meet, all of the following requirements:
  •   (i) The limited liability company significantly furthers the accomplishment of 1 or more charitable or educational purposes described in section 170(c)(2)(B) of the internal revenue code of 1986, 26 USC 170, and would not have been formed except to accomplish those charitable or educational purposes. See Michigan Laws 450.4102
  • Major source of agricultural income: means that the producers of grapes within the affected area obtain at least 10% of their gross income as a group in any 5-year period from the production of grapes. See Michigan Laws 286.401
  • Majority in interest: means a majority of votes as allocated by an operating agreement, or by the statute in the absence of an allocation by operating agreement, and held by members entitled to vote on a matter submitted for a vote by members. See Michigan Laws 450.4102
  • Majority leader: see Floor Leaders
  • Manager: means the manager of the authority appointed under section 4. See Michigan Laws 285.162
  • managers: means a person or persons designated to manage the limited liability company pursuant to a provision in the articles of organization stating that the business is to be managed by or under the authority of managers. See Michigan Laws 450.4102
  • Manufacture: means to prepare, grind, mix, package, repackage, or relabel commercial feed for distribution. See Michigan Laws 287.523
  • Manufacturer: means a person that manufactures. See Michigan Laws 287.523
  • Market: means to promote or sell industrial hemp or an industrial hemp commodity or product. See Michigan Laws 286.842
  • Market agency: means a person, including a producer, who sells, offers for sale, markets, distributes, trades, or processes cattle which have been purchased or acquired from a producer or other, or which is marketed on behalf of a producer, and includes meat packing firms and their agents which purchase or consign to purchase cattle. See Michigan Laws 287.602
  • market or exchange: includes an online market or exchange or any other market or exchange operated through a web portal. See Michigan Laws 451.2451
  • Material support or resources: means currency or other financial securities, financial services, lodging, training, safe houses, false documentation or identification, communications equipment, facilities, weapons, lethal substances, explosives, personnel, transportation, including any related physical assets or intangible property, or expert services or expert assistance. See Michigan Laws 750.543b
  • Mausoleum: means a building or other aboveground structure that is affixed to land and is a permanent repository for human remains. See Michigan Laws 456.522
  • Member: means a person that has been admitted to a limited liability company as provided in section 501, or, in the case of a foreign limited liability company, a person that is a member of the foreign limited liability company in accordance with the laws under which the foreign limited liability company is organized. See Michigan Laws 450.4102
  • Member capital: means the assets that a member must provide by payment, transfer, or allocation of net savings to a cooperative as a condition of admission to or retention of membership and with respect to which the member has rights to dividends, redemption, or distributions on dissolution under this chapter. See Michigan Laws 450.3104
  • Membership fee: means a nonredeemable fee that a member must pay to a cooperative as a condition of admission to or retention of membership in the cooperative that is not member capital or a fee for goods, services, or facilities. See Michigan Laws 450.3104
  • Mental health code: means 1974 PA 258, MCL 330. See Michigan Laws 750.145m
  • Mental health professional: means that term as defined in section 100b of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 750.520a
  • Mental illness: means that term as defined in section 400 of the mental health code, MCL 330. See Michigan Laws 750.145m
  • Mental illness: means a substantial disorder of thought or mood that significantly impairs judgment, behavior, capacity to recognize reality, or ability to cope with the ordinary demands of life. See Michigan Laws 750.520a
  • Mentally disabled: means that a person has a mental illness, is intellectually disabled, or has a developmental disability. See Michigan Laws 750.520a
  • Mentally incapable: means that a person suffers from a mental disease or defect that renders that person temporarily or permanently incapable of appraising the nature of his or her conduct. See Michigan Laws 750.520a
  • Mentally incapacitated: means that a person is rendered temporarily incapable of appraising or controlling his or her conduct due to the influence of a narcotic, anesthetic, or other substance administered to that person without his or her consent, or due to any other act committed upon that person without his or her consent. See Michigan Laws 750.520a
  • Merchandise trust: means trusts required by section 16, composed of deposits made in connection with merchandise and service sales made prior to January 1, 2005. See Michigan Laws 456.522
  • Meteorological tower: means a structure, including all guy wires and accessory facilities, on which an anemometer is mounted for the purposes of documenting wind resources for the operation of a wind turbine generator. See Michigan Laws 259.481
  • Michigan investment market: means a person that is a broker-dealer, is exempt from federal registration under section 15(a)(1) of the securities exchange act of 1934, 15 USC 78o, and provides a market or exchange at which transactions in securities that are sold or offered for sale in this state under an intrastate offering exemption take place. See Michigan Laws 451.2451
  • Michigan organic standards: means those organic production and handling standards defined by this act, rules adopted under this act, or both, that are designed to combine organic production or handling practices and an audit trail that will ensure the integrity of organic products from the producer to the consumer. See Michigan Laws 286.907
  • Minor: means an individual under 18 years of age. See Michigan Laws 750.462a
  • Minority: means a person who is black, hispanic, oriental, eskimo, or an American Indian who is not less than 1/4 quantum Indian blood as certified by the person's tribal association and verified by the Indian affairs commission. See Michigan Laws 450.771
  • Minority owned business: means a business enterprise of which more than 50% of the voting shares or interest in the business is owned, controlled, and operated by individuals who are members of a minority and with respect to which more than 50% of the net profit or loss attributable to the business accrues to shareholders who are members of a minority. See Michigan Laws 450.771
  • Mixture: means seed consisting of more than 1 kind, each in excess of 5% of the whole. See Michigan Laws 286.702
  • Model rocket: means an aero-model that ascends into the air without use of aerodynamic lifting forces against gravity and is propelled by means of a model rocket engine. See Michigan Laws 259.781
  • month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 8.3j
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage: means a mortgage, mortgage deed, deed of trust, or other instrument creating a first lien, subject only to title exceptions and encumbrances acceptable to the authority, including any other mortgage liens of equal standing with or subordinate to the mortgage loan retained by a seller or conveyed to a mortgage lender, on a fee interest in agricultural land and agricultural improvements. See Michigan Laws 285.252
  • Mortgage lender: means a state or national bank, trust company, mortgage company, national banking association, savings and loan association, life insurance company, any state or federal governmental agency or instrumentality, including the federal land bank or any of its local associations, or any other financial institution or entity authorized to make mortgage loans in this state. See Michigan Laws 285.252
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgage loan: means a financial obligation secured by a mortgage. See Michigan Laws 285.252
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • motor vehicle: as used in this chapter shall include all vehicles impelled on the public highways of this state by mechanical power, except traction engines, road rollers and such vehicles as run only upon rails or tracks. See Michigan Laws 750.412
  • Municipal corporation: means a county, township, city, or village. See Michigan Laws 456.181
  • Municipal corporation: means a county, city, village, or township. See Michigan Laws 456.522
  • Municipality: means a county, city, village, or township. See Michigan Laws 287.331
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department.   • National housing act: means the national housing act, 12 USC 1701 to 1750g. See Michigan Laws 451.2103
  • National Poultry Improvement Plan: means a plan for the control or eradication of certain poultry diseases that is published in 9 C. See Michigan Laws 287.703
  • Native: means an animal born and raised in this state, or legally imported into this state and having complied with entry requirements prescribed by the director, and having been maintained in this state for at least 30 days. See Michigan Laws 287.703
  • Net proceeds: means the sale price of farm produce, less usual and customary charges and costs of sale of the farm produce. See Michigan Laws 285.313
  • New world camelids: means animals belonging to the genus llama and vicuna of the family camelidae of the order artiodactyla including, but not limited to, the llama, alpaca, vicuna, and guanaco. See Michigan Laws 287.703
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Noncommercial feed: means all materials or combination of materials, not distributed or intended for distribution, that are for manufacturing and use as feed or for mixing in feed. See Michigan Laws 287.523
  • nonissuer distribution: means a transaction or distribution not directly or indirectly for the benefit of the issuer. See Michigan Laws 451.2102b
  • Nonpublic school: means a private, denominational, or parochial elementary or secondary school. See Michigan Laws 750.520a
  • Note: means a note issued by the authority pursuant to this act. See Michigan Laws 285.252
  • Nursery: means any grounds or premises on or in which nursery stock is propagated, grown, or cultivated for the purpose of distributing or selling nursery stock as a business. See Michigan Laws 286.202
  • Nursery dealer: means a person that is not a grower or an original producer of nursery stock in this state, that buys nursery stock for the purpose of reselling or reshipping independently of the control of any nursery grower or nursery dealer, or that is engaged with a nursery grower or nursery dealer in handling nursery stock on a consignment basis. See Michigan Laws 286.202
  • Nursery stock: means all domesticated or wild botanically classified hardy perennial or biennial trees, shrubs, vines, and other plants; cuttings, grafts, scions, buds, bulbs, rhizomes, or roots of any of these; and fruit pits. See Michigan Laws 286.202
  • nurseryman: means a person owning, leasing, managing, or in charge of a nursery. See Michigan Laws 286.202
  • Nursing home: means that term as defined in section 20109 of the public health code, MCL 333. See Michigan Laws 750.145m
  • Oath: A promise to tell the truth.
  • oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 8.3k
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Offal: means the waste parts resulting from the processing of animals, poultry, fish, and aquaculture species. See Michigan Laws 287.703
  • Offer to purchase: includes an attempt or offer to obtain, or solicitation of an offer to sell, a security or interest in a security for value. See Michigan Laws 451.2102b
  • Office: means each location, described by street name, building number, city, and state, where a person engages in the business of debt management. See Michigan Laws 451.412
  • Official identification: means an identification ear tag, tattoo, electronic identification, or other identification approved by the United States Department of Agriculture or the department. See Michigan Laws 287.703
  • official interstate certificate of veterinary inspection: means a form in paper or electronic format approved by the director with a unique identifier that documents the information required under section 20 and that is issued for animals that are being imported to or exported from this state not more than 30 days prior to the importation or exportation of those animals. See Michigan Laws 287.703
  • official intrastate certificate of veterinary inspection: means a form in paper or electronic format approved by the director with a unique identifier that documents the information required under section 20 and that is issued for animals that are being moved within this state not more than 30 days prior to the movement of those animals. See Michigan Laws 287.703
  • Official sample: means a sample of feed taken by the director in accordance with section 7. See Michigan Laws 287.523
  • Official test: means a sample of specific material collected from an animal with official identification by an accredited veterinarian, state or federal veterinary medical officer, or other person authorized by the director and analyzed by a laboratory certified by the United States Department of Agriculture or the department to conduct the test, or a diagnostic injection administered and analyzed by an accredited veterinarian or a state or federal veterinary medical officer. See Michigan Laws 287.703
  • Official vaccination: means a vaccination that the director has designated for a reportable animal disease, administered by an accredited veterinarian or a state or federal veterinary medical officer, and documented on a form supplied by the department. See Michigan Laws 287.703
  • Online: means functioning on or over the internet. See Michigan Laws 451.2451
  • Open storage: means the storage of farm produce for 30 days or less under an acknowledgment form that does not contain a designation of a specific transaction type. See Michigan Laws 285.62
  • Operated: means the activity of being involved in the day to day management of a business. See Michigan Laws 450.771
  • Operated: means the activity of being involved in the day-to-day management of a business. See Michigan Laws 450.792
  • Operating agreement: means a written agreement by the member of a limited liability company that has 1 member, or between all of the members of a limited liability company that has more than 1 member, pertaining to the affairs of the limited liability company and the conduct of its business. See Michigan Laws 450.4102
  • Operator: means any of the following:
  •   (i) A person, an officer of a person, a partner of a person, or a member or manager of a limited liability company, who holds more than 50% voting rights in a cemetery owner. See Michigan Laws 456.522
  • Organic: means a labeling term referring to an agricultural product produced in accordance with the standards described in this act, rules adopted under this act, or both. See Michigan Laws 286.907
  • Organic advisory committee: means the committee created under section 25. See Michigan Laws 286.907
  • Organic agriculture: means an agricultural management system that enhances biodiversity, biological cycles, and soil biological activity to produce healthy plants and animals and fosters human and environmental health. See Michigan Laws 286.907
  • Organic plan: means a plan of management of an organic production or handling operation that has been agreed to by the producer or handler and the certifying agent and that includes written plans concerning all aspects of agricultural production and handling as described in this act, rules adopted under this act, or both. See Michigan Laws 286.907
  • Organic product: means agricultural products including, but not limited to, crops, livestock, livestock products, or other agricultural products that are produced organically for human or livestock use or consumption. See Michigan Laws 286.907
  • organization: means any of the following:
  •   (A) A dental care corporation incorporated under 1963 PA 125, MCL 550. See Michigan Laws 750.157m
  • Originate: means the direct movement of animals from a herd or flock of origin. See Michigan Laws 287.703
  • Other person with authority over a vulnerable adult: includes , but is not limited to, a person with authority over a vulnerable adult in that part of a hospital that is a hospital long-term care unit, but does not include a person with authority over a vulnerable adult in that part of a hospital that is not a hospital long-term care unit.   • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means the person who owns or is responsible for a cervidae livestock operation. See Michigan Laws 287.952
  • Owner: means a person who owns or harbors a dog or other animal. See Michigan Laws 287.321
  • Packer: means any person engaged in the business of slaughtering, or of manufacturing or preparing meat or meat products for sale, either by such person or others; or of manufacturing or preparing livestock products for sale by such person or others. See Michigan Laws 287.551

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.

  • Partnership interest: means a partner's share of the profits and losses of a limited partnership and the right to receive distributions of partnership assets. See Michigan Laws 449.1101
  • Passenger: means any person not the pilot or member of the crew of any aircraft. See Michigan Laws 750.43
  • Patron: means a person whose economic exchange is a regular part of the business of a cooperative or foreign cooperative, if the economic exchange is the same type of regular economic exchange engaged in by any class of members. See Michigan Laws 450.3104
  • Patronage: means the selling or providing of goods, services, or facilities to, or the buying of goods, services, or facilities from members or other persons, or providing labor or services to or by a cooperative. See Michigan Laws 450.3104
  • Pattern of racketeering activity: means not less than 2 incidents of racketeering to which all of the following characteristics apply:
  •   (i) The incidents have the same or a substantially similar purpose, result, participant, victim, or method of commission, or are otherwise interrelated by distinguishing characteristics and are not isolated acts. See Michigan Laws 750.159f
  • percentage: means the percentage by weight. See Michigan Laws 287.523

  • Personal identifying information: means any information used to locate or accurately categorize an individual, household, or business. See Michigan Laws 451.2451
  • Personal injury: means bodily injury, disfigurement, mental anguish, chronic pain, pregnancy, disease, or loss or impairment of a sexual or reproductive organ. See Michigan Laws 750.520a
  • Personal property: All property that is not real property.
  • persons: shall include natural persons, corporations, partnerships, associations, companies, and syndicates. See Michigan Laws 451.302
  • Pet health certificate: means a certificate in a form prescribed by the director in which a veterinarian attests to the species, age, sex, breed, and description of an animal; any medical conditions of the animal; any medical treatment and vaccinations that the animal received while under the control of a pet shop or large-scale dog breeding kennel; and to the fact that at the time of the preparation of the certificate the veterinarian examined the animal and found the animal free from visual evidence of communicable disease.   • Pet shop: means a place where animals are sold or offered for sale, exchange, or transfer. See Michigan Laws 287.331
  • Pet shop: means a pet shop licensed by the department under section 3 of 1969 PA 287, MCL 287. See Michigan Laws 287.1002
  • Physical harm: means any injury to a vulnerable adult's physical condition. See Michigan Laws 750.145m
  • Physically helpless: means that a person is unconscious, asleep, or for any other reason is physically unable to communicate unwillingness to an act. See Michigan Laws 750.520a
  • Pistol: means a loaded or unloaded firearm that is 26 inches or less in length, or a loaded or unloaded firearm that by its construction and appearance conceals itself as a firearm. See Michigan Laws 750.222
  • Places: means vessels, cars and other vehicles, buildings, docks, nurseries, orchards, and other premises where plants or plant products are grown, kept, or handled. See Michigan Laws 286.202
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plant diseases: means fungi, bacteria, nematodes, and viruses, injurious to plants or plant products, and the pathological condition in plants or plant products caused by fungi, bacteria, nematodes, and viruses. See Michigan Laws 286.202
  • Plants or plant products: means trees, shrubs, vines, fruit, forage and cereal plants, and all other plants, cuttings, grafts, scions, buds, and all other parts of plants; including fruit, vegetables, roots, bulbs, pips, seeds, wood, lumber, and all other plant products. See Michigan Laws 286.202
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Plot: means a contiguous area in a field, greenhouse, or indoor growing structure containing the same variety of industrial hemp throughout the area. See Michigan Laws 286.842
  • Pneumatic gun: means that term as defined in section 1 of 1990 PA 319, MCL 123. See Michigan Laws 750.222
  • political subdivision: when used in this act means any county, city, village or township of this state, and any other political subdivision, public corporation, authority, or district in this state which is or may hereafter be authorized by law to construct, enlarge, improve, maintain, equip, operate and regulate airports. See Michigan Laws 259.436
  • Poultry: means , but is not limited to, chickens, guinea fowl, turkeys, waterfowl, pigeons, doves, peafowl, and game birds that are propagated and maintained under the husbandry of humans. See Michigan Laws 287.703
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Predecessor act: means former 1964 PA 265. See Michigan Laws 451.2102b
  • Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. Source: U.S. Courts
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Price amendment: means the amendment to a registration statement filed under the securities act of 1933 or, if an amendment is not filed, the prospectus or prospectus supplement filed under the securities act of 1933 that includes a statement of the offering price, underwriting and selling discounts or commissions, amount of proceeds, conversion rates, call prices, and other matters dependent upon the offering price.   • Price later agreement: means a written or electronically transmitted agreement between a depositor and a grain dealer where the grain dealer receives title to farm produce and the depositor retains the option to price the farm produce after delivery based on conditions in the agreement. See Michigan Laws 285.62
  • Price later agreement: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Primary surface: means an imaginary plane longitudinally centered on a runway, which plane has the specifications described in section 2b. See Michigan Laws 259.481
  • Prior entry permit: means a code that is obtained from the department for specific species of animals imported into this state that is recorded on the official interstate health certificate, official interstate certificate of veterinary inspection, or fish disease inspection report before entry into this state. See Michigan Laws 287.703
  • Prior movement permit: means prior documented permission given by the director before intrastate movement of an animal. See Michigan Laws 287.703
  • Privately controlled waters: means waters controlled within ponds, vats, raceways, tanks, and any other indoor or outdoor structure wholly within or on land owned or leased by an aquaculturist and used with an aquaculture facility or confinement research facility. See Michigan Laws 286.872
  • Privately owned cervid: means all species of the cervid family including, but not limited to, deer, elk, moose, and all other members of the family cervidae propagated and maintained under the husbandry of humans for the production of meat and other agricultural products, sport, exhibition, or any other purpose approved by the director. See Michigan Laws 287.703
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Proceeds: means any real, personal, or intangible property obtained through the commission of an offense included in the definition of racketeering, including any appreciation in the value of the property. See Michigan Laws 750.159f
  • Process: means to convert raw industrial hemp into a marketable form. See Michigan Laws 286.842
  • Processing: means processes that include, but are not limited to, cooking, baking, heating, drying, mixing, grinding, churning, separating, extracting, cutting, fermenting, eviscerating, preserving, dehydrating, freezing, or other manufacturing process and includes the packaging, canning, jarring, or otherwise enclosing of food in a container. See Michigan Laws 286.907
  • Processing: means drying, cleaning, packaging, or otherwise changing the physical characteristics of farm produce. See Michigan Laws 285.62
  • Processor: means a person engaged in processing farm produce and storing the farm produce for a period of 24 hours or more. See Michigan Laws 285.62
  • Processor-handler: means a person licensed by the department under this act to process, handle, broker, or market industrial hemp. See Michigan Laws 286.842
  • Producer: means a person who raises or feeds cattle for market. See Michigan Laws 287.602
  • Producer: means a person who engages in the business of growing or producing agricultural products. See Michigan Laws 286.907
  • Producer: means a person that owns, rents, leases, or operates a farm on land and who has an interest in and receives all or any part of the proceeds from the sale and delivery in Michigan of farm produce produced from the land to a grain dealer licensed under the grain dealers act. See Michigan Laws 285.313
  • Producer premium: means the amount of money charged to and collected from a producer under section 11. See Michigan Laws 285.313
  • Producer security activities: means any action by the director under section 22 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Product name: means the name of the commercial feed that identifies it as to kind, class, or specific use and distinguishes it from all other products bearing the same brand name. See Michigan Laws 287.523
  • Production of agricultural goods: means commercial farming, including, but not limited to, cultivation of the soil; growing and harvesting of an agricultural, horticultural, or floricultural commodity; dairying; raising of livestock, bees, fish, fur-bearing animals, or poultry; or turf or tree farming. See Michigan Laws 286.432
  • Professional service: means a type of personal service to the public that requires that the provider obtain a license or other legal authorization as a condition precedent to providing that service. See Michigan Laws 450.1282
  • Professional service: means a type of personal service to the public that requires as a condition precedent to the rendering of the service the obtaining of a license or other legal authorization. See Michigan Laws 450.4902
  • Professional services corporation: means a corporation formed under former 1962 PA 192 or a corporation incorporated under and governed by chapter 2A of the business corporation act, 1972 PA 284, MCL 450. See Michigan Laws 450.4902
  • Program: means the qualified agricultural loan origination program established under this act. See Michigan Laws 286.432
  • Program: means the industrial hemp licensing and registration program established by this act. See Michigan Laws 286.842
  • program: means the program for reimbursement of claims described in this act. See Michigan Laws 285.313
  • Property: means real estate, personal property, and any thing or substance connected with real estate or personal property whether or not it has value. See Michigan Laws 286.202
  • Proprietary account: means the account which is maintained by a business organization in the name of an individual person or organization and through which the business organization allows the person or organization to obtain goods, property, services, or any other thing of value on credit. See Michigan Laws 750.157m
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prosecuting agency: means the attorney general of this state, or his or her designee, or the prosecuting attorney of a county, or his or her designee. See Michigan Laws 750.159f
  • protective committee: shall include all persons who propose or purport to act, or who are now acting, for and in behalf of others and/or themselves with respect to a security and/or for the purpose of protecting and preserving the common interests of the holders or owners of the particular security. See Michigan Laws 451.302
  • Proximity: means a radial distance of 2 miles from the site of damage. See Michigan Laws 286.401
  • Public health code: means 1978 PA 368, MCL 333. See Michigan Laws 750.145m
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public school: means a public elementary or secondary educational entity or agency that is established under the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 750.520a
  • Pullorum-typhoid: means a disease of poultry caused by Salmonella pullorum or Salmonella gallinarum. See Michigan Laws 287.703
  • Pullorum-typhoid clean flock: means a flock that receives and maintains this status by fulfilling the requirements prescribed in the National Poultry Improvement Plan. See Michigan Laws 287.703
  • Purchaser: means a person who receives a pistol from another person by purchase, gift, or loan. See Michigan Laws 750.222
  • Pure seed: means seed exclusive of inert matter and all other seeds not of the seed being considered, as determined by methods defined by rule promulgated under this act. See Michigan Laws 286.702
  • Qualified agricultural loan: means a loan that is issued under the program and that meets all of the following conditions:
  •   (i) The loan is made to 1 of the following:
      (A) A person that is engaged in and intending to remain engaged in this state as an owner or operator of a farm in the production of agricultural goods that suffered a qualified loss of 25% or more in major enterprises or a qualified loss of 50% or more in production of any 1 crop on a farm located within this state. See Michigan Laws 286.432
  • Qualified financial institution: means a financial institution that has a physical location in this state or whose principal office is located in this state, or both. See Michigan Laws 286.432
  • Qualified loss: means a reduction of gross revenue from any agricultural commodity after receipt of any insurance proceeds and other reimbursements as a result of the same crop loss. See Michigan Laws 286.432
  • Quantity statement: means a writing containing the net weight of a solid or net weight or net volume of a liquid. See Michigan Laws 287.523
  • Quarantine: means enforced isolation of an animal or group of animals or restriction of movement of an animal or group of animals, equipment, feed and food products, or vehicles to or from any structure, premises, or area of this state, including the entirety of this state, determined by the director. See Michigan Laws 287.703
  • Quorum: The number of legislators that must be present to do business.
  • racketeering: means committing, attempting to commit, conspiring to commit, or aiding or abetting, soliciting, coercing, or intimidating a person to commit an offense for financial gain by obtaining money, property, or any other thing of value, involving any of the following:
  •   (a) A felony violation of section 8 of the tobacco products tax act, 1993 PA 327, MCL 205. See Michigan Laws 750.159g
  • Ratite: means flightless birds having a flat breastbone without the keellike prominence characteristic of most flying birds. See Michigan Laws 287.703
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reasonable assistance: means safely controlling an animal by corralling, stabling, kenneling, holding, tying, chemically restraining, or confining by halter or leash or crowding the animal in a safe and sensible manner so an examination or testing procedure considered necessary by the director can be performed. See Michigan Laws 287.703
  • Receiving point: means a facility where farm produce is received, weighed, and stored and an acknowledgment form is issued. See Michigan Laws 285.62
  • Reckless act or reckless failure to act: means conduct that demonstrates a deliberate disregard of the likelihood that the natural tendency of the act or failure to act is to cause physical harm, serious physical harm, or serious mental harm. See Michigan Laws 750.145m
  • Recombinant nucleic acid techniques: means laboratory techniques through which genetic material is isolated and manipulated in vitro and then inserted into an organism. See Michigan Laws 287.703
  • Recombinant nucleic acid techniques: means laboratory techniques through which genetic material is isolated and manipulated in vitro and then inserted into an organism. See Michigan Laws 286.872
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Michigan Laws 450.832
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Michigan Laws 451.922
  • Records: means all label information and the source of this information required by this act for the seed being considered, and all information relating to the shipment or shipments involved with seed, such as invoices, vouchers, freight bills, and other records. See Michigan Laws 286.702
  • Redemption: means any method by which a cooperative exchanges cash or debt instruments for member capital, including, but not limited to, repurchase, redemption, refund, or repayment. See Michigan Laws 450.3104
  • Referendum: means a method of member voting that utilizes secret ballot and established polling places as provided in the cooperative's bylaws or under section 409. See Michigan Laws 450.3104
  • Regulated financial institution: means a state or nationally chartered bank, savings and loan association or savings bank, credit union, trust company, or other state or federally chartered lending institution or a regulated affiliate or regulated subsidiary of any of these entities. See Michigan Laws 456.522
  • Relocation: means the transfer of a part of a corporation's operation from 1 establishment to another existing or proposed establishment located at a distance from the first establishment which results in at least a 25-person reduction in the number of employees at the first establishment, but does not include a transfer from an establishment in 1 part of a political subdivision to an establishment in another part of the same political subdivision. See Michigan Laws 450.732
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rendered products: means waste material derived in whole or in part from meat of an animal or other animal material and other refuse of any character that has been associated with any such material at any time during the handling, preparation, cooking, or consumption of food that has been ground and heat-treated to a minimum temperature of 170 degrees Fahrenheit for a minimum of 30 minutes to make products including, but not limited to, animal protein meal, poultry protein meal, fish protein meal, grease, or tallow. See Michigan Laws 287.703
  • Renders criminal assistance: means that the person with the intent to avoid, prevent, hinder, or delay the discovery, apprehension, prosecution, trial, or sentencing of a person who he or she knows or has reason to know has violated this chapter or is wanted as a material witness in connection with an act of terrorism pursuant to section 39 of chapter VII of the code of criminal procedure, 1927 PA 175, MCL 767. See Michigan Laws 750.543b
  • Reportable animal disease: means an animal disease on the current reportable animal disease list maintained by the state veterinarian that poses a serious threat to the animal industry, public health, or animal health. See Michigan Laws 287.703
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Representative sample: means a sample taken from a seed lot that is of sufficient size to supply an adequate amount of seed for laboratory testing and that is secured and submitted according to the guidelines approved by the director. See Michigan Laws 286.702
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Research facility: means any school, hospital, laboratory, institution, organization or person that uses or intends to use dogs or cats in research, tests or experiments, and that (1) purchases or transports such animals, or (2) receives any funds from the state or local government or any agency or instrumentality thereof to finance its operations by means of grants, loans or otherwise. See Michigan Laws 287.381
  • Research fund: means the industrial hemp research and development fund created in section 4. See Michigan Laws 286.842
  • Resident: means an individual who resides in a facility. See Michigan Laws 750.145m
  • Resident of this state: means 1 of the following, as applicable:
  •   (i) If a person is an individual, his or her principal residence is located in this state. See Michigan Laws 451.2451
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Restricted noxious weed seed: means the seeds of the plants that are objectionable in the fields, lawns, and gardens of this state but can be controlled by ordinary good cultural practices, and that are listed in the rules promulgated under this act. See Michigan Laws 286.702
  • reviewed: means performing inquiry and analytical procedures that provide an accountant with a reasonable basis for expressing limited assurance that there are no material modifications that should be made to the statement for it to conform with generally accepted accounting principles. See Michigan Laws 285.62
  • Revocation: means the removal of a grain dealer's license under this act in accordance with the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 285.62
  • Riding stable: means any establishment in which, for business purposes, 6 or more horses or ponies are rented, hired, or loaned for riding. See Michigan Laws 287.111
  • Rifle: means a firearm designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed metallic cartridge to fire only a single projectile through a rifled bore for each single pull of the trigger. See Michigan Laws 750.222
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 287.523
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 286.682
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 286.702
  • Runway: means the portion of an airport designated as either of the following:
  •   (i) An area used for the landing or takeoff of aircraft. See Michigan Laws 259.481
  • Sale: means transfer of title. See Michigan Laws 285.313
  • sale: means the exchange of ownership. See Michigan Laws 287.523
  • Sale: includes every contract of sale, contract to sell, or disposition of, a security or interest in a security for value, and "offer to sell" includes every attempt or offer to dispose of, or solicitation of an offer to purchase, a security or interest in a security for value. See Michigan Laws 451.2102c
  • Sales barn: means any establishment where horses or ponies owned by others are sold or offered for sale. See Michigan Laws 287.111
  • School district: means a general powers school district organized under the revised school code, 1976 PA 451, MCL 380. See Michigan Laws 750.520a
  • seal: shall be construed to include any of the following:
  •   (a) The impression of the seal on the paper alone. See Michigan Laws 8.3n
  • sealed storage building: means sealed storage spaces in which controlled atmosphere is maintained, inferred, advertised, or represented as having a controlled atmosphere. See Michigan Laws 286.371
  • Secured loan: means a financial obligation secured by a lien on an interest in depreciable agricultural property. See Michigan Laws 285.252
  • securities: shall include bonds, notes, debentures, and any other instrument of like character used to evidence indebtedness. See Michigan Laws 451.302
  • Securities and exchange commission: means the United States securities and exchange commission. See Michigan Laws 451.2102c
  • Security: means a note; stock; treasury stock; security future; bond; debenture; evidence of indebtedness; certificate of interest or participation in a profit-sharing agreement; collateral trust certificate; preorganization certificate or subscription; transferable share; investment contract; voting trust certificate; certificate of deposit for a security; fractional undivided interest in oil, gas, or other mineral rights; put, call, straddle, option, or privilege on a security, certificate of deposit, or group or index of securities, including an interest in or based on the value of that put, call, straddle, option, or privilege on that security, certificate of deposit, or group or index of securities; put, call, straddle, option, or privilege entered into on a national securities exchange relating to foreign currency; an investment in a viatical or life settlement agreement; or, in general, an interest or instrument commonly known as a "security"; or a certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing. See Michigan Laws 451.2102c
  • Security procedure: means a procedure employed for the purpose of verifying that an electronic signature, record, or performance is that of a specific person or for detecting changes or errors in the information in an electronic record. See Michigan Laws 450.832
  • Seed: means the seed or propagating materials of cereals, grain crops, vegetable crops, oil crops, fiber crops, forage crops, grasses, legumes, turf species, tuberous crops, and other crops used in agricultural products which are produced or processed for the purpose of being sold, offered or exposed for sale, for planting, sowing or seeding processes within this state. See Michigan Laws 286.71
  • Seed lot: means all the seed potatoes of the same variety that are of a single class and specific seed source and are harvested from a field or stored together in a specific storage facility. See Michigan Laws 286.682
  • Seed potato: means the tuber that is used for the reproduction of the potato. See Michigan Laws 286.682
  • Seizure: means a legal process carried out by a court order against a definite amount of seed. See Michigan Laws 286.702
  • Seizure order: means a seizure order issued by the director pursuant to section 15. See Michigan Laws 287.523
  • Self-regulatory organization: means a national securities exchange registered under the securities exchange act of 1934, a national securities association of broker-dealers registered under the securities exchange act of 1934, a clearing agency registered under the securities exchange act of 1934, or the municipal securities rule-making board established under the securities exchange act of 1934. See Michigan Laws 451.2102c
  • Seller: means a person who sells, furnishes, loans, or gives a pistol to another person. See Michigan Laws 750.222
  • Seller: means a person selling anhydrous ammonia at wholesale or retail to an end user for a legal purpose. See Michigan Laws 286.773
  • Serious bodily injury: means any physical injury requiring medical treatment, regardless of whether the victim seeks medical treatment. See Michigan Laws 750.462a
  • Serious impairment of a body function: means that term as defined in section 58c of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 750.200h
  • Serious injury: means permanent, serious disfigurement, serious impairment of health, or serious impairment of a bodily function of a person. See Michigan Laws 287.321
  • Serious mental harm: means a mental injury that results in a substantial alteration of mental functioning that is manifested in a visibly demonstrable manner. See Michigan Laws 750.145m
  • Serious physical harm: means a physical injury that threatens the life of a vulnerable adult, that causes substantial bodily disfigurement, or that seriously impairs the functioning or well-being of the vulnerable adult. See Michigan Laws 750.145m
  • Service: means to include securities issued by a person in or on a market or exchange for sale or to assist in facilitating securities transactions in or on a market or exchange. See Michigan Laws 451.2451
  • Service of process: The service of writs or summonses to the appropriate party.
  • Services: means an ongoing relationship between a person and an individual in which the individual performs activities under the supervision of or for the benefit of the person, including, but not limited to, commercial sexual activity and sexually explicit performances. See Michigan Laws 750.462a
  • Services in a learned profession: means services rendered by a dentist, an osteopathic physician, a physician, a surgeon, a doctor of divinity or other clergy, or an attorney-at-law. See Michigan Laws 450.4102
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sewage sludge: means solid, semisolid, liquid, or ash residue generated during treatment of domestic or industrial sewage in a treatment works. See Michigan Laws 286.909
  • Sexual contact: includes the intentional touching of the victim's or actor's intimate parts or the intentional touching of the clothing covering the immediate area of the victim's or actor's intimate parts, if that intentional touching can reasonably be construed as being for the purpose of sexual arousal or gratification, done for a sexual purpose, or in a sexual manner for:
  •   (i) Revenge. See Michigan Laws 750.520a
  • Sexual penetration: means sexual intercourse, cunnilingus, fellatio, anal intercourse, or any other intrusion, however slight, of any part of a person's body or of any object into the genital or anal openings of another person's body, but emission of semen is not required. See Michigan Laws 750.520a
  • sexually delinquent person: when used in this act shall mean any person whose sexual behavior is characterized by repetitive or compulsive acts which indicate a disregard of consequences or the recognized rights of others, or by the use of force upon another person in attempting sex relations of either a heterosexual or homosexual nature, or by the commission of sexual aggressions against children under the age of 16. See Michigan Laws 750.10a
  • shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 8.4c
  • shield: as used in this chapter , shall include any flag, standard, color, ensign, coat-of-arms or shield, or copy, picture or representation thereof, made of any substance or represented or produced thereon, and of any size, evidently purporting to be such flag, standard, color, ensign, coat-of-arms or shield of the United States or of this state, or a copy, picture or representation thereof. See Michigan Laws 750.244
  • Short-barreled rifle: means a rifle having 1 or more barrels less than 16 inches in length or a weapon made from a rifle, whether by alteration, modification, or otherwise, if the weapon as modified has an overall length of less than 26 inches. See Michigan Laws 750.222
  • Short-barreled shotgun: means a shotgun having 1 or more barrels less than 18 inches in length or a weapon made from a shotgun, whether by alteration, modification, or otherwise, if the weapon as modified has an overall length of less than 26 inches. See Michigan Laws 750.222
  • Shortage: means that a grain dealer does not have a sufficient amount of farm produce by class and quality to cover the grain dealer's outstanding warehouse receipt obligations for that farm produce. See Michigan Laws 285.62
  • Shotgun: means a firearm designed or redesigned, made or remade, and intended to be fired from the shoulder and designed or redesigned and made or remade to use the energy of the explosive in a fixed shotgun shell to fire through a smooth bore either a number of ball shot or a single projectile for each single function of the trigger. See Michigan Laws 750.222
  • silencer: means 1 or more of the following:
  •   (a) A device for muffling, silencing, or deadening the report of a firearm. See Michigan Laws 750.224
  • Slaughter premises: means all facilities, buildings, structures, including all immediate grounds where slaughtering occurs under federal or state inspection, or otherwise authorized by the director. See Michigan Laws 287.703
  • Slaughterer: means any person regularly engaged in the commercial slaughtering of livestock. See Michigan Laws 287.551
  • Social welfare act: means 1939 PA 280, MCL 400. See Michigan Laws 750.145m
  • solicitor: shall include all persons who procure or solicit directly or indirectly, or who are now procuring or soliciting directly or indirectly the deposit of securities with a depositary under a protective committee agreement or similar instrument and/or who procure or solicit directly or indirectly, or who are now procuring or soliciting directly or indirectly, the consent of holders or owners of securities to a protective committee agreement or similar instrument. See Michigan Laws 451.302
  • Sow: means a female swine that has farrowed or given birth to or aborted 1 litter or more. See Michigan Laws 287.703
  • State: means a state, territory, or possession of the United States, the District of Columbia, or the Commonwealth of Puerto Rico. See Michigan Laws 449.1101
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or possession subject to the jurisdiction of the United States. See Michigan Laws 450.832
  • state: when used in this act means the state of Michigan. See Michigan Laws 259.438
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 451.2102c
  • state: when applied to the different parts of the United States, shall be construed to extend to and include the District of Columbia and the several territories belonging to the United States; and the words "United States" shall be construed to include the district and territories. See Michigan Laws 8.3o
  • State animal anticruelty laws: means the laws and standards provided for the adequate care of animals in chapter IX of the Michigan penal code, 1931 PA 328, MCL 750. See Michigan Laws 287.992
  • State national harmonization program: means the state national harmonization program for seed potatoes developed by the plant protection and quarantine program of the Animal and Plant Health Inspection Service in the United States Department of Agriculture. See Michigan Laws 286.682
  • State veterinarian: means the chief animal health official of this state as appointed by the director under section 7, or his or her authorized representative. See Michigan Laws 287.703
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Stockyard: means any place, establishment or facility commonly known as a stockyard, conducted or operated for compensation or profit as a public market, consisting of pens or other enclosures, and their appurtenances, for the handling, keeping and holding of livestock for the purpose of sale or shipment. See Michigan Laws 287.551
  • Stop sale: means an administrative order restraining the sale, disposition, and movement of a definite amount of seed. See Michigan Laws 286.702
  • Storage: means the deposit of farm produce in trust with a grain dealer by a depositor. See Michigan Laws 285.62
  • Storage loss: means a loss to a depositor resulting from the failure of a licensee that has not fully satisfied its storage obligation to the depositor, net of any outstanding charges against the farm produce. See Michigan Laws 285.313
  • structure: when used in this act means any object constructed or installed by man, including, but without limitation, buildings, towers, smoke stacks and overhead transmission lines, but not including highways and their appurtenances. See Michigan Laws 259.439
  • Structure: means an object constructed or installed, including, but not limited to, a building, tower, antenna, smokestack, or overhead transmission line. See Michigan Laws 259.481
  • Subpoena: A command to a witness to appear and give testimony.
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Substituted proceeds: means any real, personal, or intangible property obtained or any gain realized by the sale or exchange of proceeds. See Michigan Laws 750.159h
  • Summons: Another word for subpoena used by the criminal justice system.
  • Surveillance zone: means an area in this state that has a defined dimension determined by the director to be at risk for a specific reportable animal disease and is located adjacent and contiguous to an infected zone. See Michigan Laws 287.703
  • survivor: means the constituent that survives a merger, as identified in the certificate of merger. See Michigan Laws 450.4102
  • Sweep arrangement: means an arrangement that provides for a temporary or permanent transfer of funds from 1 trust account to another trust account when a predetermined time, account balance, or other condition occurs or is fulfilled. See Michigan Laws 451.412
  • Swine: means any of the ungulate mammals of the family suidae. See Michigan Laws 287.703
  • Synthetic: means a substance that is formulated or manufactured by a chemical process or by a process that chemically changes a substance extracted from naturally occurring plant, animal, or mineral sources except those substances created by naturally occurring biological processes. See Michigan Laws 286.909
  • Telecommunication facilities: means either or both of the following:
  •   (i) Telecommunication facilities as defined in section 2 of the metropolitan extension telecommunications rights-of-way oversight act, 2002 PA 48, MCL 484. See Michigan Laws 286.942
  • Telecommunications system: means that term as defined in section 219a. See Michigan Laws 750.200h
  • Temporary facility: means a facility that does not have a receiving point and is used by a licensee to store farm produce. See Michigan Laws 285.62
  • Terrorist: means any person who engages or is about to engage in an act of terrorism. See Michigan Laws 750.543b
  • terrorist organization: means an organization that, on the effective date of the amendatory act that added this section, is designated by the United States state department as engaging in or sponsoring an act of terrorism. See Michigan Laws 750.543c
  • Testate: To die leaving a will.
  • Testator: A male person who leaves a will at death.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Testing facility: means a safety compliance facility licensed under the medical marihuana facilities licensing act, 2016 PA 281, MCL 333. See Michigan Laws 286.842
  • THC: means that term as defined in section 3 of the Michigan Regulation and Taxation of Marihuana Act, 2018 IL 1, MCL 333. See Michigan Laws 286.842
  • Tolerance: means the allowable deviation from any percentage claim used on a label and is based on the law of normal variation from a mean. See Michigan Laws 286.702
  • Ton: means a net weight of 2,000 pounds avoirdupois. See Michigan Laws 287.523
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Townships: means government survey townships, and need not be in the same county. See Michigan Laws 286.401
  • Toxic substance: means a natural or synthetic chemical or radiologic material in concentrations that alone or in combination with other natural or synthetic chemicals presents a threat to the health, safety, or welfare of human or animal life or that has the capacity to produce injury or illness through ingestion, inhalation, or absorption through the body surface. See Michigan Laws 287.703
  • Toxicological disease: means any condition caused by or related to a toxic substance. See Michigan Laws 287.703
  • Transaction: means an action or set of actions occurring between 2 or more persons relating to the conduct of business, commercial, or governmental affairs. See Michigan Laws 450.832
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transitional surface: means an imaginary plane perpendicular to a runway centerline and to that centerline extended through the runway's primary surface and approach surface, which plane extends outward and upward from each side of the runway's primary surface and approach surface at a slope of 7 to 1 for the distances described in section 2d. See Michigan Laws 259.481
  • Treated: means that the seed has received an effective application of substance or method designed to reduce, control, or repel certain disease organisms, fungi, insects, or other pests attacking the seed or seedlings or has received some other treatment to improve its planting value. See Michigan Laws 286.702
  • tree: when used in this act, means any object of natural growth. See Michigan Laws 259.440
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • trust mortgage: means any trust mortgage, trust indenture or deed of trust given to secure bonds or other obligations issued and authenticated as therein set forth. See Michigan Laws 451.401
  • Trustee: A person or institution holding and administering property in trust.
  • trustee: means the trustee or trustees of any such "trust mortgage. See Michigan Laws 451.401
  • turtle: includes all animals commonly known as turtles, tortoises, terrapins, and all other animals of the order testudinata, class reptilia. See Michigan Laws 287.311
  • Type: means a group of varieties so nearly similar that individual varieties cannot be clearly differentiated except under special conditions. See Michigan Laws 286.702
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Unincorporated cooperative: means either of the following:
  •   (i) An association of 2 or more persons that is organized on a cooperative basis and that is not a corporation. See Michigan Laws 450.3104
  • United States: shall be construed to include the district and territories. See Michigan Laws 8.3o
  • Usury: Charging an illegally high interest rate on a loan. Source: OCC
  • Utility runway: means a runway that is constructed for and intended to be used by propeller-driven aircraft with a maximum gross weight of 12,500 pounds or less. See Michigan Laws 259.481
  • Valid claim: means a claim arising from a failure of a licensee that occurs after the effective date of this act, is found valid by the department, and is approved by the board, less all credits and offsets associated with farm produce delivered and sold in this state by a producer to the licensee or to a location in this state designated in advance of the delivery. See Michigan Laws 285.313
  • Variety: means a subdivision of a kind that is distinct, uniform, and stable; distinct in the sense that the variety can be differentiated by 1 or more identifiable morphological, physiological, or other characteristics from all other varieties of public knowledge; uniform in the sense that variations in essential and distinctive characteristics are describable, and stable in the sense that the variety will remain unchanged in its essential and distinctive characteristics and its uniformity when reproduced or reconstituted as required by the different categories of varieties; for example, heritage oats, augusta wheat, corsoy soybeans. See Michigan Laws 286.702
  • Variety: means a subdivision of a species that has the following characteristics:
  •   (i) The subdivision is uniform, in the sense that variations between the subdivision and other subdivisions in essential and distinctive characteristics are describable. See Michigan Laws 286.842
  • Vegetable seed: means the seed of those crops that are grown in gardens or on truck farms and that generally are known and sold under the name of vegetable or herb seed in this state. See Michigan Laws 286.702
  • Vendor: means a person engaged in the selling of seed. See Michigan Laws 286.702
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veterinarian: means a person licensed to practice veterinary medicine under part 188 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 287.331
  • Veterinarian: means a person licensed to practice veterinary medicine under article 15 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 287.703
  • Veterinarian: means a person licensed to practice veterinary medicine under article 15 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 287.1002
  • Veterinarian: means a person licensed to practice veterinary medicine under article 15 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 287.1102
  • Veterinary biological: means all bacteria, viruses, serums, toxins, and analogous products of natural or synthetic origin, or products prepared from any type of genetic engineering, such as diagnostics, antitoxins, vaccines, live microorganisms, killed microorganisms, or the antigenic or immunizing components of microorganisms intended for use in the diagnosis, treatment, or prevention of diseases in animals. See Michigan Laws 287.703
  • Victim: means the person alleging to have been subjected to criminal sexual conduct. See Michigan Laws 750.520a
  • Violent felony: means a felony in which an element is the use, attempted use, or threatened use of physical force against an individual, or the use, attempted use, or threatened use of a harmful biological substance, a harmful biological device, a harmful chemical substance, a harmful chemical device, a harmful radioactive substance, a harmful radioactive device, an explosive device, or an incendiary device. See Michigan Laws 750.543b
  • Visual approach procedure: means an approach in which an aircraft on an instrument flight rules flight plan, operating in visual flight rules conditions under the control of an air traffic control authorization, may proceed to the airport of destination in visual flight rules conditions. See Michigan Laws 259.481
  • Vote: means an affirmative vote, approval, or consent. See Michigan Laws 450.4102
  • Vulnerable adult: means 1 or more of the following:
  •   (i) An individual age 18 or over who, because of age, developmental disability, mental illness, or physical disability requires supervision or personal care or lacks the personal and social skills required to live independently. See Michigan Laws 750.145m
  • Warehouse receipt: means that term as defined in section 2 of the grain dealers act, MCL 285. See Michigan Laws 285.313
  • Warehouse receipt: means a written or electronically transmitted receipt issued by a grain dealer to a depositor at the time the grain dealer accepts farm produce for storage. See Michigan Laws 285.62
  • Waters of the state: means groundwaters, lakes, rivers, and streams and all other watercourses and waters within the jurisdiction of the state and also the Great Lakes bordering the state. See Michigan Laws 286.872
  • Web portal: means an online entity through which persons are able to effect transactions in securities. See Michigan Laws 451.2451
  • Weed seed: means the seeds of all plants generally recognized as weeds within the state, as determined by methods defined by rule promulgated under this act, and includes prohibited and restricted noxious weed seeds. See Michigan Laws 286.702
  • Weighmaster: means a person registered under this act that weighs livestock at a livestock auction licensed under this act. See Michigan Laws 287.121
  • Wild animal: means that term as defined in section 43508 of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 287.703
  • Wolf: means an animal of the species Canisrufus or Canislupus, but does not include an animal of the species Canislupusfamiliaris. See Michigan Laws 287.1002
  • Wolf-dog cross: means a canid resulting from the breeding of any of the following:
  •   (i) A wolf with a dog. See Michigan Laws 287.1002
  • Woman owned business: means a business of which more than 50% of the voting shares or interest in the business is owned, controlled, and operated by women and with respect to which more than 50% of the net profit or loss attributable to the business accrues to the women shareholders. See Michigan Laws 450.771
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
