Terms Used In Nebraska Statutes > Political Subdivisions Self-Funding Benefits Act

  • Accruals: shall mean funds to cover all expected claims, reserves, and expenses to operate the self-funded portion of the employee benefit plan for a plan year. See Nebraska Statutes 13-1604
  • Acquire: when used in connection with a grant of power or property right to any person shall include the purchase, grant, gift, devise, bequest, and obtaining by eminent domain. See Nebraska Statutes 49-801
  • Action: shall include any proceeding in any court of this state. See Nebraska Statutes 49-801
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Attorney: shall mean attorney at law. See Nebraska Statutes 49-801
  • Bequest: Property gifted by will.
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Covered dependent: shall mean a dependent who is enrolled in an employee benefit plan. See Nebraska Statutes 13-1605
  • Covered employee: shall mean an employee who is enrolled in an employee benefit plan. See Nebraska Statutes 13-1606
  • Dependent: A person dependent for support upon another.
  • Devise: To gift property by will.
  • Employee benefit plan: shall mean a plan provided pursuant to section 13-1614 for covered employees and covered dependents. See Nebraska Statutes 13-1607
  • Excess insurance: shall mean (1) aggregate insurance, (2) specific insurance, or (3) insurance in excess of a deductible, of which the plan sponsor assumes some or all of the risk for the deductible, purchased from an insurer. See Nebraska Statutes 13-1608
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Independent actuary: shall mean a member in good standing of the Society of Actuaries or the American Academy of Actuaries who is not an employee of the plan sponsor. See Nebraska Statutes 13-1609
  • Insurer: shall mean an insurer as defined in section 44-103 which holds a certificate of authority to transact the business of insurance in this state. See Nebraska Statutes 13-1610
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Month: shall mean calendar month. See Nebraska Statutes 49-801
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: shall include bodies politic and corporate, societies, communities, the public generally, individuals, partnerships, limited liability companies, joint-stock companies, and associations. See Nebraska Statutes 49-801
  • Personal property: All property that is not real property.
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plan sponsor: shall mean any political subdivision providing an employee benefit plan. See Nebraska Statutes 13-1611
  • Political subdivision: shall include villages, cities, counties, school districts, public power districts, community colleges, natural resources districts, and all other units of local government. See Nebraska Statutes 13-1612

  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
