Terms Used In New Hampshire Revised Statutes 171-B:10

  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • person: may extend and be applied to bodies corporate and politic as well as to individuals. See New Hampshire Revised Statutes 21:9
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
At the hearing, the person whose mental condition is the subject of the hearing shall have the right to legal counsel, to present evidence on such person’s own behalf, and to cross-examine witnesses. Such person shall also have the right to summon as witnesses the expert who filed the report pursuant to N.H. Rev. Stat. § 171-B:7 and to cross-examine the expert. The hearing shall be a public hearing. A transcript, which may, at the court’s discretion, consist only of an audio recording, shall be made of the entire proceedings.
