Terms Used In New Jersey Statutes 40A:9-128.1

  • Arrest: Taking physical custody of a person by lawful authority.
  • Conviction: A judgement of guilt against a criminal defendant.
  • person: includes corporations, companies, associations, societies, firms, partnerships and joint stock companies as well as individuals, unless restricted by the context to an individual as distinguished from a corporate entity or specifically restricted to one or some of the above enumerated synonyms and, when used to designate the owner of property which may be the subject of an offense, includes this State, the United States, any other State of the United States as defined infra and any foreign country or government lawfully owning or possessing property within this State. 3. a. Notwithstanding any provision of law to the contrary, a county shall not issue a law enforcement badge or a badge that may be mistaken as a law enforcement badge to any county elected official who is not elected as a law enforcement officer.

b. As used in this section, “law enforcement officer” means a person who is empowered to act for the detection, apprehension, arrest, conviction, detention, or rehabilitation of persons in violation of the law.
