Terms Used In Ohio Code > Chapter 4765 - First Responders, Emergency Medical Technicians

  • Adult: means involving a patient who is not a pediatric patient. See Ohio Code 4765.01
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Air medical organization: means an organization that provides emergency medical services, or transports emergency victims, by means of fixed or rotary wing aircraft. See Ohio Code 4765.01
  • Allegation: something that someone says happened.
  • Ambulance: means any motor vehicle that is used, or is intended to be used, for the purpose of responding to emergency medical situations, transporting emergency patients, and administering emergency medical service to patients before, during, or after transportation. See Ohio Code 4765.01
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Another: when used to designate the owner of property which is the subject of an offense, includes not only natural persons but also every other owner of property. See Ohio Code 1.02
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Bond: includes an undertaking. See Ohio Code 1.02
  • Cardiac monitoring: means a procedure used for the purpose of observing and documenting the rate and rhythm of a patient's heart by attaching electrical leads from an electrocardiograph monitor to certain points on the patient's body surface. See Ohio Code 4765.01
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Emergency medical service: includes such services performed before or during any transport of a patient, including transports between hospitals and transports to and from helicopters. See Ohio Code 4765.01
  • Emergency medical service organization: means a public or private organization using first responders, EMTs-basic, EMTs-I, or paramedics, or a combination of first responders, EMTs-basic, EMTs-I, and paramedics, to provide emergency medical services. See Ohio Code 4765.01
  • Emergency medical service personnel: means first responders, emergency medical technicians-basic, emergency medical technicians-intermediate, emergency medical technicians-paramedic, and persons who provide medical direction to such persons. See Ohio Code 4765.01
  • EMT-basic: means an individual who holds a current, valid certificate issued under section 4765. See Ohio Code 4765.01
  • EMT-I: means an individual who holds a current, valid certificate issued under section 4765. See Ohio Code 4765.01
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Firefighter: means any member of a fire department as defined in section 742. See Ohio Code 4765.01
  • First responder: means an individual who holds a current, valid certificate issued under section 4765. See Ohio Code 4765.01
  • Fraud: Intentional deception resulting in injury to another.
  • Geriatric: means involving a patient who is at least seventy years old or exhibits significant anatomical or physiological characteristics associated with advanced aging. See Ohio Code 4765.01
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • in writing: includes any representation of words, letters, symbols, or figures; this provision does not affect any law relating to signatures. See Ohio Code 1.59
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Internet: means the international computer network of both federal and nonfederal interoperable packet switched data networks, including the graphical subnetwork known as the world wide web. See Ohio Code 1.59
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • paramedic: means an individual who holds a current, valid certificate issued under section 4765. See Ohio Code 4765.01
  • Part-time paid firefighter: means a person who provides firefighting services on less than a full-time basis, is routinely scheduled to be present on site at a fire station or other designated location for purposes of responding to a fire or other emergency, and receives more than nominal compensation for the provision of firefighting services. See Ohio Code 4765.01
  • Pediatric: means involving a patient who is less than sixteen years of age. See Ohio Code 4765.01
  • Person: includes an individual, corporation, business trust, estate, trust, partnership, and association. See Ohio Code 1.59
  • Physician: means an individual who holds a current, valid license issued under Chapter 4731 of the Revised Code authorizing the practice of medicine and surgery or osteopathic medicine and surgery. See Ohio Code 4765.01
  • Physician assistant: means an individual who holds a valid license to practice as a physician assistant issued under Chapter 4730 of the Revised Code. See Ohio Code 4765.01
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Population: means that shown by the most recent regular federal census. See Ohio Code 1.59
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Property: means real and personal property. See Ohio Code 1.59
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Quorum: The number of legislators that must be present to do business.
  • Registered nurse: means an individual who holds a current, valid license issued under Chapter 4723 of the Revised Code authorizing the practice of nursing as a registered nurse. See Ohio Code 4765.01
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rule: includes regulation. See Ohio Code 1.59
  • state: means the state of Ohio. See Ohio Code 1.59
  • Subpoena: A command to a witness to appear and give testimony.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Trauma care: means the assessment, diagnosis, transportation, treatment, or rehabilitation of a trauma victim by emergency medical service personnel or by a physician, nurse, physician assistant, respiratory therapist, physical therapist, chiropractor, occupational therapist, speech-language pathologist, audiologist, or psychologist licensed to practice as such in this state or another jurisdiction. See Ohio Code 4765.01
  • Trauma center: means all of the following:

    (1) Any hospital that is verified by the American college of surgeons as an adult or pediatric trauma center;

    (2) Any hospital that is operating as an adult or pediatric trauma center under provisional status pursuant to section 3727. See Ohio Code 4765.01

  • trauma patient: means a person who has sustained a traumatic injury. See Ohio Code 4765.01
  • traumatic injury: means severe damage to or destruction of tissue that satisfies both of the following conditions:

    (1) It creates a significant risk of any of the following:

    (a) Loss of life;

    (b) Loss of a limb;

    (c) Significant, permanent disfigurement;

    (d) Significant, permanent disability. See Ohio Code 4765.01

  • United States: includes all the states. See Ohio Code 1.59
  • Volunteer: means a person who provides services either for no compensation or for compensation that does not exceed the actual expenses incurred in providing the services or in training to provide the services. See Ohio Code 4765.01
