Terms Used In Rhode Island General Laws > Chapter 12-16.1 - Uniform Rendition of Prisoners as Witnesses in Criminal Proceeding Act

  • Arrest: Taking physical custody of a person by lawful authority.
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Penal institutions: includes a jail, prison, penitentiary, house of correction, or other place of penal detention. See Rhode Island General Laws 12-16.1-1
  • person: may be construed to extend to and include co-partnerships and bodies corporate and politic. See Rhode Island General Laws 43-3-6
  • Service of process: The service of writs or summonses to the appropriate party.

  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.

  • Witness: means a person who is confined in a penal institution in any state and whose testimony is desired in another state in any criminal proceeding or investigation by a grand jury or in any criminal action before a court. See Rhode Island General Laws 12-16.1-1
