  • Allied dental educational program: a dental hygiene, dental assisting, or laboratory technology educational program. See South Dakota Codified Laws 36-6A-1
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Board: the State Board of Dentistry. See South Dakota Codified Laws 36-6A-1
  • Collaborative agreement: a written agreement between a supervising dentist and a dental hygienist authorizing the preventive and therapeutic services that may be performed by the dental hygienist under collaborative supervision. See South Dakota Codified Laws 36-6A-1
  • Collaborative supervision: the supervision of a dental hygienist requiring a collaborative agreement between a supervising dentist and a dental hygienist. See South Dakota Codified Laws 36-6A-1
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Complete evaluation: a comprehensive examination, review of medical and dental history, the formulation of a diagnosis, and the establishment of a written treatment plan, documented in a written or electronic record to be maintained by the dentist's clinic or other treatment facility or institution.   • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Day: the period from midnight to midnight. See South Dakota Codified Laws 2-14-2
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Dental: pertaining to dentistry. See South Dakota Codified Laws 36-6A-1
  • Dental assistant: a person who, under the supervision of a dentist or dental hygienist, renders assistance as authorized by this chapter. See South Dakota Codified Laws 36-6A-1
  • Dental auxiliary: any person, other than a dental hygienist, that works under the supervision of a dentist and provides dental services to a patient. See South Dakota Codified Laws 36-6A-1
  • Dental hygienist: a person licensed as a dental hygienist pursuant to this chapter, who, under the supervision of a dentist, renders the diagnostic, preventive, or therapeutic dental services, and any educational services provided pursuant thereto, as authorized by this chapter, as well as any related extra-oral procedure required in the practice of those services.   • Dental radiographer: a person registered as a dental radiographer pursuant to this chapter. See South Dakota Codified Laws 36-6A-1
  • Dental specialist: a dentist in a specialty recognized by the board that has graduated from a postdoctoral specialty program recognized and approved by the American Dental Association Commission on Dental Accreditation. See South Dakota Codified Laws 36-6A-1
  • Dentist: a person licensed as a dentist pursuant to this chapter. See South Dakota Codified Laws 36-6A-1
  • Dentistry: the examination, evaluation, diagnosis, prevention, or treatment, including surgery and the prescribing of drugs, of diseases, disorders, or conditions of the human oral cavity or its adjacent or associated tissues and structures of the maxillofacial area, and their impact on the human body.   • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fraud: Intentional deception resulting in injury to another.
  • General supervision: the supervision of a dental hygienist requiring that a dentist authorize the procedures to be carried out, and that the patient to be treated is a patient of record of the supervising dentist, or a dentist practicing within the same entity or clinic as the supervising dentist, and has had a complete evaluation within the previous thirteen months of the delegation of procedures.   • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good faith: an honest intention to abstain from taking any unconscientious advantage of another, even through the forms or technicalities of law, together with an absence of all information or belief of facts which would render the transaction unconscientious. See South Dakota Codified Laws 2-14-2
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Lay member: a person who is not a health professional, and who is not a parent, spouse, sibling, or child of a health professional or health professional student. See South Dakota Codified Laws 36-6A-1
  • Licensee: a dentist or dental hygienist. See South Dakota Codified Laws 36-6A-1
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • Oral health review: a limited assessment of a person's oral health through a dentist's review of dental and medical history following a limited clinical inspection by a dental hygienist working under collaborative supervision. See South Dakota Codified Laws 36-6A-1
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patient of record: a patient who has undergone a complete evaluation performed by a dentist. See South Dakota Codified Laws 36-6A-1
  • Person: includes natural persons, partnerships, associations, cooperative corporations, limited liability companies, and corporations. See South Dakota Codified Laws 2-14-2
  • Practitioner: a dentist or dental hygienist. See South Dakota Codified Laws 36-6A-1
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Quorum: The number of legislators that must be present to do business.
  • Registered dental assistant: a person registered as a registered dental assistant pursuant to this chapter who is authorized to perform expanded functions under the direct supervision of a dentist as authorized by this chapter. See South Dakota Codified Laws 36-6A-1
  • Registrant: a dental radiographer or registered dental assistant. See South Dakota Codified Laws 36-6A-1

  • Subpoena: A command to a witness to appear and give testimony.
  • Teledentistry: the practice of dentistry where the patient and the dentist are not in the same physical location, and which utilizes the exchange of clinical information and images over remote distances. See South Dakota Codified Laws 36-6A-1

  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
