Terms Used In Tennessee Code 55-50-413

  • Bus: means every motor vehicle designed for carrying more than fifteen (15) passengers including the driver and operated for the transportation of persons. See Tennessee Code 55-50-102
  • Department: means the department of safety acting directly or through its duly authorized officers and agents. See Tennessee Code 55-50-102
  • Driver: means every person who drives or is in actual physical control of a motor vehicle upon a highway or who is exercising control over or steering a vehicle being towed by a motor vehicle. See Tennessee Code 55-50-102
  • Driver license: means a license issued by the department to an individual that authorizes the individual to operate a motor vehicle on the highways. See Tennessee Code 55-50-102
  • Employee: means an operator of a commercial motor vehicle, including an owner-operator or other independent contractor while in the course of operating a commercial motor vehicle, who is employed by an employer. See Tennessee Code 55-50-102
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Person: means every natural person, firm, copartnership, association or corporation. See Tennessee Code 55-50-102
  • State: means :
    (A) For the purposes of commercial driver licenses, a state of the United States and the District of Columbia. See Tennessee Code 55-50-102
  • United States: means the fifty (50) states and the District of Columbia. See Tennessee Code 55-50-102
(1) Beginning January 1, 2011, all persons holding valid commercial driver licenses issued by this state shall be required to maintain a valid medical card and provide the department a copy of each medical card issued, or provide evidence of an exemption from the medical card requirements.
(2) Persons who apply for a commercial driver license on or after January 1, 2012, will be required to provide the department with a copy of their current medical card or provide evidence of an exemption from the medical card requirements prior to issuance of a commercial driver license.
(b) The copies shall be provided in a manner prescribed by the department.
(c) A commercial driver who fails to maintain current proof of the driver’s medical card with the department shall be subject to cancellation of the driver’s commercial driver license.
(d) This section shall not apply to a person holding a commercial driver license to perform transportation services as an employee of the federal government, a state, a political subdivision of a state, or an agency established under a compact between states that has been approved by the congress of the United States; provided, however, that the exemption created by this subsection (d) shall not apply to a passenger, school bus or hazardous material endorsement.
