(a) Before the 21st day after the date the person receives notice under § 486.023, the person in writing may:
(1) accept the determination and recommended penalty; or
(2) make a request for a hearing on the occurrence of the violation, the amount of the penalty, or both.
(b) If the person accepts the determination and recommended penalty or if the person fails to respond to the notice, the department by order shall impose the penalty.
Terms Used In Texas Health and Safety Code 486.024
- Department: means the Department of State Health Services. See Texas Health and Safety Code 486.001
- in writing: includes any representation of words, letters, or figures, whether by writing, printing, or other means. See Texas Government Code 312.011
- Person: includes corporation, organization, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, and any other legal entity. See Texas Government Code 311.005
