(1) A person at least 16 years old or older may apply to the division for an identification card.

Terms Used In Utah Code 53-3-803

  • Division: means the Driver License Division of the department created in Section 53-3-103. See Utah Code 53-3-102
  • driver: includes any person who is required to hold a CDL under Part 4, Uniform Commercial Driver License Act, or federal law. See Utah Code 53-3-102
  • Extension: means a renewal completed in a manner specified by the division. See Utah Code 53-3-102
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: includes a person who:
         (14)(a) qualifies as a guardian of a minor or incapacitated person pursuant to testamentary or court appointment; or
         (14)(b) is appointed by a court to manage the estate of a minor or incapacitated person. See Utah Code 68-3-12.5
  • Identification card: means a card for identification issued under this part. See Utah Code 53-3-802
  • License: means the privilege to drive a motor vehicle. See Utah Code 53-3-102
  • License certificate: means the evidence of the privilege issued under this chapter to drive a motor vehicle. See Utah Code 53-3-102
  • Person: means :
         (24)(a) an individual;
         (24)(b) an association;
         (24)(c) an institution;
         (24)(d) a corporation;
         (24)(e) a company;
         (24)(f) a trust;
         (24)(g) a limited liability company;
         (24)(h) a partnership;
         (24)(i) a political subdivision;
         (24)(j) a government office, department, division, bureau, or other body of government; and
         (24)(k) any other organization or entity. See Utah Code 68-3-12.5
  • Regular identification card: means an identification card issued under this chapter to a person whose card was obtained by providing evidence of lawful presence in the United States with one of the document requirements described in Subsection 53-3-804(2)(i)(i). See Utah Code 53-3-102
(2) A person younger than 16 years old may apply to the division for an identification card with the consent of the applicant’s parent or guardian.
(3)

     (3)(a) If a person is unable to apply for the card due to his youth or incapacitation, the application may be made on behalf of that person by his parent or guardian.
     (3)(b) A parent or guardian applying for an identification card on behalf of a child or incapacitated person shall provide:

          (3)(b)(i) identification, as required by the commissioner; and
          (3)(b)(ii) the consent of the incapacitated person, as required by the commissioner.
(4) The division may not issue a Utah identification card or an extension of a regular identification card to a person who holds an unexpired Utah license certificate issued under Part 2, Driver Licensing Act unless:

     (4)(a) the Utah license certificate is canceled; and
     (4)(b) if the Utah license certificate is in the person’s possession, the Utah license certificate is surrendered to the division.
