Terms Used In Florida Statutes 296.44

  • Contractor: means an entity responsible for the day-to-day operations of an adult day health care facility or adult day care center as prescribed by 38 C. See Florida Statutes 296.44
  • Department: means the Department of Veterans' Affairs. See Florida Statutes 296.44
  • Director: means the executive director of the department. See Florida Statutes 296.44
  • Operator: means the person designated to have and 1who has the general administrative charge of an adult day health care facility or adult day care center. See Florida Statutes 296.44
  • person: includes individuals, children, firms, associations, joint adventures, partnerships, estates, trusts, business trusts, syndicates, fiduciaries, corporations, and all other groups or combinations. See Florida Statutes 1.01
  • veteran: means a person who served in the active military, naval, or air service and who was discharged or released under honorable conditions only or who later received an upgraded discharge under honorable conditions, notwithstanding any action by the United States Department of Veterans Affairs on individuals discharged or released with other than honorable discharges. See Florida Statutes 1.01
As used in this part, the term:

(1) “Contractor” means an entity responsible for the day-to-day operations of an adult day health care facility or adult day care center as prescribed by 38 C.F.R. 59.160 or part III of chapter 429, respectively. The contractor may be a for-profit or nonprofit entity that operates the adult day health care facility or adult day care center under the direction of the executive director of the department.
(2) “Department” means the Department of Veterans’ Affairs.
(3) “Director” means the executive director of the department.
(4) “Operator” means the person designated to have and 1who has the general administrative charge of an adult day health care facility or adult day care center. The administrator of a veterans’ nursing home under s. 296.34 or the administrator of the Veterans’ Domiciliary Home of Florida under s. 296.04 may serve as the operator if the adult day health care facility or adult day care center is collocated at an existing veterans’ nursing home or the Veterans’ Domiciliary Home of Florida or is a freestanding facility.
(5) “Participant” means an eligible veteran recipient of basic services or of supportive and optional services provided by an adult day health care facility or adult day care center.
(6) “Program” means a licensed facility operated by the department under part III of chapter 429.
(7) “Veteran” has the same meaning as provided in s. 1.01(14).
