  • individual: shall include every infant member of the species homo sapiens who is born alive at any stage of development. See Illinois Compiled Statutes 5 ILCS 70/1.36
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Probate: Proving a will
     This Act does not apply if: (i) the frail elderly individual is a person under guardianship pursuant to Article XIa of the Probate Act of 1975; or (ii) the family caregiver is acting as agent under a power of attorney or acting at the direction of an agent under a power of attorney pursuant to the Illinois Power of Attorney Act.
