  • AASHTO Manual for Bridge Evaluation: means the "Manual for Bridge Evaluation" incorporated by reference in §650. See 23 CFR 650.505
  • abuse: means any act or failure to act which was performed, or which was failed to be performed, knowingly, recklessly, or intentionally, and which caused, or may have caused, injury or death to an individual with developmental disabilities, and includes but is not limited to such acts as: Verbal, nonverbal, mental and emotional harassment; rape or sexual assault; striking; the use of excessive force when placing such an individual in bodily restraints; the use of bodily or chemical restraints which is not in compliance with Federal and State laws and regulations, or any other practice which is likely to cause immediate physical or psychological harm or result in long term harm if such practices continue. See 45 CFR 1326.19

  • Acceptance service: The service established and conducted under the regulations for the determination and certification or other identification of the compliance of livestock with specifications. See 7 CFR 53.1
  • Access: means making a record available to a subject individual. See 32 CFR 1701.2
  • Accessible route: means a continuous unobstructed path connecting accessible elements and spaces in a building or within a site that can be negotiated by a person with a severe disability using a wheelchair and that is also safe for and usable by people with other disabilities. See 24 CFR 100.201
  • Accommodation: means an adjustment made to an employee's job or work environment that enables the employee to perform the duties of the position. See 14 CFR 29.1519
  • Account information: "Account information" is information that is specifically connected to the customer's service relationship with the carrier, including such things as an account number or any component thereof, the telephone number associated with the account, or the bill's amount. See 47 CFR 64.2003
  • Accreditation: means a determination by a recognized accreditation body (or, in the case of direct accreditation, by FDA) that a third-party certification body meets the applicable requirements of this subpart. See 43 CFR 9180.1
  • Accreditation body: means an authority that performs accreditation of third-party certification bodies. See 43 CFR 9180.1
  • Accredited third-party certification body: means a third-party certification body that a recognized accreditation body (or, in the case of direct accreditation, FDA) has determined meets the applicable requirements of this subpart and is accredited to conduct food safety audits and to issue food or facility certifications to eligible entities. See 43 CFR 9180.1
  • ACFM: means actual cubic feet per minute. See 46 CFR 197.204
  • Acne: A disease involving the oil glands and hair follicles of the skin which is manifested by blackheads, whiteheads, acne pimples, and acne blemishes. See 46 CFR 169.553
  • Acne drug product: A drug product used to reduce the number of acne blemishes, acne pimples, blackheads, and whiteheads. See 46 CFR 169.553

  • Active borrower: A borrower who has an outstanding account in the records of the Office of the Deputy Chief Financial Officer (ODCFO), including collection-only or an unsatisfied account balance where a voluntary conveyance was accepted without release from liability of foreclosure did not satisfy the indebtedness. See 25 CFR 170.440
  • Address of record: An "address of record" whether postal or electronic, is an address that the carrier has associated with the customer's account for at least 30 days. See 47 CFR 64.2003
  • ADEA: means the Age Discrimination in Employment Act of 1967, as amended, 29 U. See 45 CFR 1172.3
  • Adequate housing: A housing unit of adequate size and design to meet the specific needs of low-income families and the requirements governing the particular housing program providing the services or financial assistance. See 25 CFR 166.218
  • Administrative Cost of Issuing a Loan Guarantee: means the total of all administrative expenses that DOE incurs during:

    (1) The evaluation of an Application for a loan guarantee. See 41 CFR 101-28.203

  • Administrative law judge: The person authorized to conduct hearings in administrative enforcement proceedings brought under the EAA or to hear appeals from the imposition of temporary denial orders. See 41 CFR 102-40.25
  • Administrative law judge: as used in this part means an administrative law judge appointed pursuant to 5 U. See 43 CFR 3486.4
  • Administrative offset: means the withholding of funds payable by the United States (including funds payable by the United States on behalf of a State government) to any person, or the withholding of funds held by the United States for any person, in order to satisfy a debt owed to the United States. See 45 CFR 1150.1
  • Administrator: means the head of the Farm Service Agency or designee. See 27 CFR 24.96

  • Affiliate: The term "affiliate" has the same meaning given such term in section 3(1) of the Communications Act of 1934, as amended, 47 U. See 47 CFR 64.2003
  • Affiliated: For purposes of this subpart, entities are affiliated if either entity has an attributable interest in the other or if a third party has an attributable interest in both entities. See 47 CFR 76.1300
  • Affirmation: A person filing an affidavit under this part must affirm that "all information contained in the application is complete and correct and that the information does not contain a false claim, statement, or representation. See 25 CFR 39.118

  • Agency record: means all material and information, including electronic, the office that issued the initial administrative determination relied on or considered in reaching its initial administrative determination, or which otherwise is related to the initial administrative determination.   • Agreed price: means the price agreed to by the Construction Manager/General Contractor (CM/GC) contractor and the contracting agency to provide construction services for a specific scope and schedule. See 50 CFR 260.27
  • Agricultural Marketing Service: The Agricultural Marketing Service of the Department. See 7 CFR 54.1

  • Apple producer: is a farmer in the United States or its territories that produced apples, on not less than 10 acres, for sale in 1999 or 2000. See 27 CFR 24.270
  • Applicability: This section applies to commercial motor vehicle drivers licensed by Canada and Mexico. See 49 CFR 1572.201
  • Applicant: Any person who has applied for service under the regulations. See 7 CFR 54.1

  • Assessment criteria: Statutorily established criteria that must be assessed for the Secretary to make a determination with respect to foreign availability. See 41 CFR 102-40.150
  • Assistance: Finance assistance in the form of a loan, grant, or subsidy received. See 25 CFR 170.440
  • Assistant Secretary: The Assistant Secretary for Export Enforcement, Bureau of Industry and Security. See 41 CFR 102-40.25
  • Assistant Secretary: means the Assistant Secretary for Conservation and Renewable Energy or official to whom the Assistant Secretary's functions may be redelegated by the Secretary. See 41 CFR 101-26.507-4

  • Associate Administrator: means the Associate Administrator for Pipeline Safety, or his or her delegate. See 49 CFR 190.3
  • ATA: means a measure of pressure expressed in terms of atmosphere absolute (includes barometric pressure). See 46 CFR 197.204
  • Attorney: means any person who is eligible to practice law in, and is a member in good standing of the bar of, the highest court of any State, possession, territory, or Commonwealth of the United States, or of the District of Columbia, and is not under any order suspending, enjoining, restraining, disbarring, or otherwise restricting him or her in the practice of law. See 49 CFR 1503.103
  • Attorney General: means the Attorney General of the United States. See 41 CFR 101-28.203
  • Attorney General: means the Attorney General of the United States or his designee. See 41 CFR 101-28.306-3
  • Authority: Pursuant to sections 5(f) and 5(h) of the Export Administration Act (EAA), the Under Secretary of Commerce for Export Administration directs the Bureau of Industry and Security (BIS) in gathering and analyzing all the evidence necessary for the Secretary to determine foreign availability. See 41 CFR 102-40.150
  • Authorization: means any approval that a siting authority must issue under applicable law prior to the deployment of personal wireless service facilities, including, but not limited to, zoning approval and building permit. See 47 CFR 1.6002
  • Authorized bandwidth: The occupied or necessary bandwidth, whichever is greater, authorized to be used by a station. See 47 CFR 74.401
  • Authorized person: means any current or past officer, employee, elected official, managing general agent, agent, or contractor of an insurance provider, FCIC, or any other government agency whose duties require access to the ITS to administer the Act. See 27 CFR 19.489
  • Automated Payment Fees: means credit card payment, debit card payment, and bill processing fees, including fees for payments made by interactive voice response (IVR), web, or kiosk. See 47 CFR 64.6000
  • Automatic relay station: A remote pickup broadcast base station which is actuated by automatic means and is used to relay transmissions between remote pickup broadcast base and mobile stations, between remote pickup broadcast mobile stations and from remote pickup broadcast mobile stations to broadcasting stations. See 47 CFR 74.401
  • Available-in-fact: An item is available-in-fact to a country if it is produced within the country or if it may be obtained by that country from a third country. See 41 CFR 102-40.150
  • Award: Financial assistance that provides support or stimulation to accomplish a public purpose. See 32 CFR 32.2
  • Award: A grant or a cooperative agreement other than a technology investment agreement (TIA). See 32 CFR 34.2
  • Backtesting: means the comparison of an FDIC-supervised institution's internal estimates with actual outcomes during a sample period not used in model development. See 32 CFR 202.13
  • Base Allocation: means the fixed amount of funds for each State as set forth in §440. See 41 CFR 101-26.507-4
  • Base file subscriber list information: A directory publisher requests base file subscriber list information when the publisher requests, as of a given date, all of a carrier's subscriber list information that the publisher wishes to include in one or more directories. See 47 CFR 64.2305
  • Base temperature: means the temperature used to compute heating and cooling degree days. See 41 CFR 101-26.507-4
  • Basic employee death benefit: means the basic employee death benefit as defined in §843. See 14 CFR 302.714
  • Basic pay: means the pay an employee receives that is subject to civil service retirement deductions. See 14 CFR 29.1519
  • Basic security: Consists of all equipment serving as security for Rural Development loans. See 25 CFR 213.22
  • Bell: means a compartment either at ambient pressure (open bell) or pressurized (closed bell) that allows the diver to be transported to and from the underwater work site, allows the diver access to the surrounding environment, and is capable of being used as a refuge during diving operations. See 46 CFR 197.204
  • Benchmarking: means the comparison of an FDIC-supervised institution's internal estimates with relevant internal and external data or with estimates based on other estimation techniques. See 32 CFR 202.13
  • Benchmarking: means the comparison of a Board-regulated institution's internal estimates with relevant internal and external data or with estimates based on other estimation techniques. See 31 CFR 205.26
  • Benzene: means liquefied or gaseous benzene (C46 CFR 197.505
  • Best value: means the proposal offering the most overall public benefits as determined through an evaluation of the amount of the concession payment and other appropriate considerations. See 23 CFR 710.703
  • Biomass: means biologically generated energy sources such as heat derived from combustion of plant matter, or from combustion of gases or liquids derived from plant matter, animal wastes, or sewage, or from combustion of gases derived from landfills, or hydrogen derived from these same sources. See 41 CFR 101-26.607
  • BLM: means the Bureau of Land Management. See 43 CFR 3601.5
  • Bond option contract: means a bond option, bond future, or any other instrument linked to a bond that gives rise to similar counterparty credit risk. See 32 CFR 202.13
  • Bonded premises: The premises of an alcohol fuel plant where distilled spirits are produced, processed, and stored, and used or distributed as described in the application for alcohol fuel producer permit. See 27 CFR 19.662
  • Borrower: means any Person that enters into a Loan Guarantee Agreement with DOE and issues Guaranteed Obligations. See 41 CFR 101-28.203
  • Borrower: When a loan is made to an individual, the individual is the borrower. See 25 CFR 213.22
  • Borrower: means a mortgagor who is an original borrower under the HECM Loan Agreement and Note. See 24 CFR 206.3
  • Bottom time: means the total elapsed time measured in minutes from the time the diver leaves the surface in descent to the time to the next whole minute that the diver begins ascent. See 46 CFR 197.204
  • Brakes: Every motor vehicle shall be equipped with brakes as required pursuant to 49 U. See 29 CFR 500.105
  • Branch: The Livestock Market News Branch of the Division. See 7 CFR 53.1
  • Breathing zone: means the area within one foot of a person's mouth and nose. See 46 CFR 197.505
  • Bridge: A structure including supports erected over a depression or an obstruction, such as water, highway, or railway, and having a track or passageway for carrying traffic or other moving loads, and having an opening measured along the center of the roadway of more than 20 feet between undercopings of abutments or spring lines of arches, or extreme ends of openings for multiple boxes. See 50 CFR 29.220
  • Bridge inspection experience: Active participation in bridge inspections in accordance with the NBIS, in either a field inspection, supervisory, or management role. See 50 CFR 29.220
  • Bridge inspection experience: The term "bridge inspection experience" has the same meaning as in §650. See 23 CFR 650.505
  • Bridge inspection refresher training: The National Highway Institute "Bridge Inspection Refresher Training Course"1 or other State, local, or federally developed instruction aimed to improve quality of inspections, introduce new techniques, and maintain the consistency of the inspection program. See 50 CFR 29.220
  • Broadband Internet access service: "Broadband Internet access service" is defined as a mass-market retail service by wire or radio that provides the capability to transmit data to and receive data from all or substantially all Internet endpoints, including any capabilities that are incidental to and enable the operation of the communications service, but excluding dial-up service. See 47 CFR 54.400
  • Budget period: means the interval of time into which a project period is divided for budgetary and funding purposes, and for which a grant is made. See 45 CFR 1336.10
  • Building: means a structure, facility or portion thereof that contains or serves one or more dwelling units. See 24 CFR 100.201
  • Building entrance on an accessible route: means an accessible entrance to a building that is connected by an accessible route to public transportation stops, to accessible parking and passenger loading zones, or to public streets or sidewalks, if available. See 24 CFR 100.201
  • Bursting pressure: means the pressure at which a pressure containment device would fail structurally. See 46 CFR 197.204
  • Business entity: is a corporation, partnership, joint operation, trust, limited liability company, or cooperative. See 27 CFR 24.270
  • Business entity: is a corporation, partnership, joint operation, trust, limited liability company, or cooperative. See 27 CFR 24.284
  • Business environment and internal control factors: means the indicators of an FDIC-supervised institution's operational risk profile that reflect a current and forward-looking assessment of the FDIC-supervised institution's underlying business risk factors and internal control environment. See 32 CFR 202.13
  • Buying groups: The term "buying group" or "agent" for purposes of the definition of a multichannel video programming distributor set forth in paragraph (e) of this section, means an entity representing the interests of more than one entity distributing multichannel video programming that:

    (1) Agrees to be financially liable for any fees due pursuant to a satellite cable programming, satellite broadcast programming, or terrestrial cable programming contract which it signs as a contracting party as a representative of its members or whose members, as contracting parties, agree to joint and several liability. See 47 CFR 76.1000

  • CAA: means a Community Action Agency. See 41 CFR 101-26.507-4
  • Calendar day: means each day shown on the calendar but, if another definition is set forth in the State contract specifications, that definition will apply. See 50 CFR 221.25
  • Call detail information: Any information that pertains to the transmission of specific telephone calls, including, for outbound calls, the number called, and the time, location, or duration of any call and, for inbound calls, the number from which the call was placed, and the time, location, or duration of any call. See 47 CFR 64.2003
  • Candidate: means an alien or other individual designated by TSA who applies for flight training or recurrent training. See 49 CFR 1552.1
  • Carcass: The commercially prepared or dressed body of any animal intended for human food. See 7 CFR 54.1
  • Carcass Data Service: The service established and conducted under the regulations to provide producers and other interested persons with data on carcass characteristics. See 7 CFR 54.1
  • Cargo Preference Act: means the Cargo Preference Act of 1954, 46 U. See 41 CFR 101-28.203
  • Carlot: "Carlot"means any number of containers which contain a product of the same kind located on or unloaded from the same conveyance and available for inspection at the same time and location: Provided, That:

    (1) Product of the same carlot shall be considered to be separate lots whenever the product differs markedly as to quality and/or condition, and such differences are definitely associated with certain brands, varieties, sizes or container markings. See 7 CFR 51.2

  • carrier: shall include an entity that provides interconnected VoIP service, as that term is defined in section 9. See 47 CFR 64.2003
  • Carrier power: The average power at the output terminals of a transmitter (other than a transmitter having a suppressed, reduced or controlled carrier) during one radio frequency cycle under conditions of no modulation. See 47 CFR 74.401
  • Case: means the number of containers (cased or uncased) which, by the particular industry are ordinarily packed in a shipping container. See 7 CFR 52.2
  • Cash contributions: The recipient's cash outlay, including the outlay of money contributed to the recipient by third parties. See 32 CFR 34.2
  • Cash flow budget: is a projection listing all anticipated cash inflows (including all farm income, nonfarm income and all loan advances) and all cash outflows (including all farm and nonfarm debt service and other expenses) to be incurred by the borrower during the period of the budget. See 27 CFR 24.270
  • CCC: means the Commodity Credit Corporation. See 25 CFR 39.113

  • Cellulosic biofuel: means any liquid fuel produced from cellulosic feedstocks. See 41 CFR 101-26.801
  • Center frequency: The center frequency, f47 CFR 15.503
  • central office code: refers to the second three digits (NXX) of a ten-digit telephone number in the form NXX-NXX-XXXX, where N represents any one of the numbers 2 through 9 and X represents any one of the numbers 0 through 9. See 47 CFR 52.7
  • central office code administrator: refers to the entity or entities responsible for managing central office codes in each area code. See 47 CFR 52.7
  • Certificate: means a certificate of review issued pursuant to the Act. See 41 CFR 101-28.306-3
  • Certificate: A document issued or authorized to be issued under this subpart by an inspector to allow the interstate movement of regulated articles to any destination. See 24 CFR 200.80
  • Certification service: The service established and conducted under the regulations for the determination and certification or other identification of the compliance of products with specifications. See 7 CFR 54.1
  • Certified agency: is an agency that has been granted certification by the Assistant Secretary in accordance with the requirements of this part. See 24 CFR 115.100
  • Chairman: means the Chairman, National Endowment for the Arts. See 45 CFR 1151.3
  • Chairman: means the Chairman of the National Endowment for the Humanities. See 45 CFR 1170.3
  • Chairman: means the Chairman of the National Endowment for the Humanities. See 45 CFR 1172.3
  • Chairperson: means the Chairperson of the Endowment, or his or her designee. See 45 CFR 1150.1
  • Charge: means the statement of facts issued under 24 CFR 103. See 24 CFR 180.100
  • Chattel security: Chattel property which may consist of, but is not limited to, inventory. See 25 CFR 213.22
  • Chief: The Chief of the Branch, or any officer or employee of the Branch to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in his stead. See 7 CFR 54.1
  • Chief: The Chief of the Branch, or any officer or employee of the Branch to whom authority has heretofore been delegated, or to whom authority may hereafter be delegated, to act in his stead. See 7 CFR 53.1
  • Chief Counsel: means the Chief Counsel of PHMSA. See 49 CFR 190.3

  • Cholecystokinetic drug product: A drug product that causes contraction of the gallbladder and is used during the course of diagnostic gallbladder studies (cholecystography). See 46 CFR 197.334
  • Claimant: Any party who makes a foreign availability submission, excluding TACs. See 41 CFR 102-40.150
  • Class: A subdivision of a product based on essential physical characteristics that differentiate between major groups of the same kind of species. See 7 CFR 54.1
  • Class: See "Grade. See 7 CFR 52.2
  • Class: A subdivision of livestock based on essential physical characteristics that differentiate between major groups of the same kind of species. See 7 CFR 53.1
  • Closed-loop biomass: means any organic material from a plant which is planted exclusively for purposes of being used at a qualified renewable energy facility to generate electricity. See 41 CFR 101-26.607
  • Closing agent: An attorney or title insurance company which is approved as a loan closing agent in accordance with subpart B of part 1927 of this chapter. See 25 CFR 170.512
  • Coal tar: The tar used for medicinal purposes that is obtained as a byproduct during the destructive distillation of bituminous coal at temperatures in the range of 900 °C to 1,100 °C. See 46 CFR 197.484
  • coated seed: means any seed unit covered with any substance that changes the size, shape, or weight of the original seed. See 7 CFR 201.2
  • COLA: means a cost-of-living adjustment. See 14 CFR 302.714
  • Collect Calling: means an arrangement whereby the called party takes affirmative action clearly indicating that it will pay the charges associated with a call originating from an Inmate Telephone. See 47 CFR 64.6000
  • Collodion-like vehicle: A solution containing pyroxylin (nitrocellulose) in an appropriate nonaqueous solvent that leaves a transparent cohesive film when applied to the skin in a thin layer. See 46 CFR 197.404
  • Collodion-like vehicle: A solution containing pyroxylin (nitrocellulose) in an appropriate nonaqueous solvent that leaves a transparent cohesive film when applied to the skin in a thin layer. See 46 CFR 197.452
  • Colonias: As defined in exhibit C of subpart L of part 1940 of this chapter. See 25 CFR 162.560

  • Commission: means the Federal Maritime Commission. See 46 CFR 540.2

  • Commission: as used in this subpart includes any bureau, division, office, branch, section, or unit of the Federal Maritime Commission and any officer or employee of such bureau, division, office, branch, section, or unit. See 46 CFR 502.24

  • Community: A community includes cities, towns, boroughs, villages, and unincorporated places which have the characteristics of incorporated areas with support services such as shopping, post office, schools, central sewer and water facilities, police and fire protection, hospitals, medical and pharmaceutical facilities, etc. See 25 CFR 162.361
  • Community beneficiaries: refers to persons who receive services or benefits from a program, but not to AmeriCorps members or to staff of the organization operating the program. See 45 CFR 2522.520
  • Community pit: means a relatively small, defined area from which BLM can make disposals of mineral materials to many persons. See 43 CFR 3601.5
  • Company: means any corporation, limited liability company, business trust, general or limited partnership, association, or similar organization. See 42 CFR 476.110
  • Comparable quality: An item is of comparable quality to an item controlled under the EAR if it possesses the characteristics specified in the Commerce Control List (CCL) for that item and is alike in key characteristics that include, but are not limited to: (1) Function. See 41 CFR 102-40.150
  • Competitive area: means a competitive area as described in §351. See 12 CFR 220.118
  • Competitive service appointment: includes new appointments, reinstatements, reemployment, and transfers as defined in §210. See 12 CFR 220.118
  • Complainant: refers to the person filing a complaint. See 40 CFR 141.553
  • Complainant: means the person (including the Assistant Secretary) who filed a complaint under the statutes covered by this part. See 24 CFR 180.100
  • complaint: includes , but is not limited to, any report or communication, whether formal or informal, written or oral, received by the P&A system, including media accounts, newspaper articles, electronic communications, telephone calls (including anonymous calls) from any source alleging abuse or neglect of an individual with a developmental disability. See 45 CFR 1326.19
  • Complaint: means a complaint filed under the statutes covered by this part. See 24 CFR 180.100
  • complex tunnel: means a tunnel characterized by advanced or unique structural elements or functional systems. See 23 CFR 650.505
  • Compliance: Conformity of a product to the specifications under which the product was purchased or sold, with particular reference to the quality, cleanliness, state of refrigeration, method of processing, and trim of products. See 7 CFR 54.1
  • Compliance: Every person and its officers, agents, drivers, representatives and employees directly concerned with the installation and maintenance of equipment and accessories shall comply and be conversant with the requirements and specifications of this part, and no person shall operate any motor vehicle, or cause or permit it to be operated, unless it is equipped in accordance with said requirements and specifications. See 29 CFR 500.105
  • Compliance: Conformity of livestock to the specifications under which the livestock was purchased or sold, with particular reference to the weight, quality or other characterics of livestock. See 7 CFR 53.1
  • Compliance agreement: A written agreement between the Animal and Plant Health Inspection Service and a person engaged in the business of moving regulated articles interstate, in which the person agrees to comply with the provisions of this subpart. See 24 CFR 200.70
  • Compliance agreement: A written agreement between a person engaged in growing, handling, or moving regulated articles, and the Plant Protection and Quarantine Programs, wherein the former agrees to comply with the requirements of this subpart identified in the agreement by the inspector who executes the agreement on behalf of the Plant Protection and Quarantine Programs as applicable to the operations of such person. See 24 CFR 200.80
  • Compliance required: Every person subject to this Act who drives a motor vehicle or is responsible for the hiring, supervision, training, assignment or dispatching of drivers shall comply and be conversant with the requirements of this section. See 29 CFR 500.105
  • Component: means any directorate, mission manager, or other sub-organization in the ODNI or reporting to the Director, that has been designated or established in the ODNI pursuant to Section 103 of the National Security Act of 1947, as amended, including the National Counterterrorism Center (NCTC), the National Counterproliferation Center (NCPC) and the Office of the National Counterintelligence Executive (ONCIX), or such other offices and officials as may be established by law or as the Director may establish or designate in the ODNI, for example, the Program Manager, Information Sharing Environment (ISE) and the Inspector General (IG). See 32 CFR 1701.2
  • Comprehensive bridge inspection training: Training that covers all aspects of bridge inspection and enables inspectors to relate conditions observed on a bridge to established criteria (see the Bridge Inspector's Reference Manual for the recommended material to be covered in a comprehensive training course). See 50 CFR 29.220
  • comprehensive tunnel inspection training: means the FHWA-approved training that covers all aspects of tunnel inspection and enables inspectors to relate conditions observed in a tunnel to established criteria. See 23 CFR 650.505
  • Concession agreement: means an agreement between a highway agency and a concessionaire under which the concessionaire is given the right to operate and collect revenues or fees for the use of a federally funded highway in return for compensation to be paid to the highway agency. See 23 CFR 710.703
  • Condition: means the degree of soundness of the product which may affect its merchantability and includes, but is not limited to those factors which are subject to change as a result of age, improper preparation and processing, improper packaging, improper storage or improper handling. See 7 CFR 52.2
  • Condition: The degree of acceptability of the container with respect to freedom from defects which affect the serviceability, including appearance as well as usability, of the container for its intended purpose. See 7 CFR 70.36
  • Conditional access: The mechanisms that provide for selective access and denial of specific services and make use of signal security that can prevent a signal from being received except by authorized users. See 47 CFR 76.1200
  • Conditional Commitment: means a Term Sheet offered by DOE and accepted by the offeree of the Term Sheet, all in accordance with §609. See 41 CFR 101-28.203
  • consent order: is a formal decree accepting an agreement between a party to an adjudicatory hearing proceeding held to determine whether that party has violated statutes or Commission rules or policies and the appropriate operating Bureau, with regard to such party's future compliance with such statutes, rules or policies, and disposing of all issues on which the proceeding was designated for hearing. See 47 CFR 1.93
  • Consenting owner: means the owner, operator, or crewmember of a vessel carrying a voluntary fishery data collector. See 41 CFR 102-42.130
  • Consignee: means the person, partnership, corporation or entity in a foreign country to whom noncomplying goods are sent. See 41 CFR 109-1.108
  • Construction services: means the physical construction work undertaken by a CM/GC contractor to construct a project or a portion of the project (including early work packages). See 50 CFR 260.27
  • Consumer: means the party to be billed for any interstate call from an inmate telephone. See 47 CFR 64.710
  • Consumer: means the party paying a Provider of Inmate Calling Services. See 47 CFR 64.6000
  • Contamination: Contamination occurs when at least one telephone number within a block of telephone numbers is not available for assignment to end users or customers. See 47 CFR 52.7
  • Contract: means (except as used in the definitions for "grant" and "subgrant" in this section and except where qualified by "Federal") a procurement contract under a grant or subgrant, and means a procurement subcontract under a contract. See 32 CFR 33.3
  • Contract: Either:

    (1) A procurement contract made by a recipient under a DoD Component's award or by a subrecipient under a subaward. See 32 CFR 34.2

  • Contract of Insurance: means the agreement evidenced by the issuance of a Mortgage Insurance Certificate or by the endorsement of the Commissioner upon the credit instrument given in connection with an insured mortgage, incorporating by reference the regulations in this subpart and the applicable provisions of the Act. See 24 CFR 203.251
  • Contract time: means the number of workdays or calendar days specified in a contract for completion of the contract work. See 50 CFR 221.25
  • Contract verification service: A program allowing institutions or other large purchasers of commodity products to have those products compared to contractual requirements. See 7 CFR 54.1
  • Contracting agency: means the State Transportation Agency (STA), and any State or local government agency, public-private partnership, or Indian tribe (as defined in 2 CFR 200. See 50 CFR 260.27
  • Contracting Officer: means the Secretary of Energy or a DOE official authorized by the Secretary to enter into, administer or terminate DOE Loan Guarantee Agreements and related contracts on behalf of DOE. See 41 CFR 101-28.203
  • Control: means either (1) holding 50 percent or more of the outstanding voting securities of an issuer. See 41 CFR 101-28.306-3
  • Controlled countries: Albania, Armenia, Azerbaijan, Belarus, Bulgaria, Cambodia, Cuba, Estonia, Georgia, Kazakhstan, Kyrgyzstan, Laos, Latvia, Lithuania, Moldova, Mongolia, North Korea, Romania, Russia, Tajikistan, Turkmenistan, Ukraine, Uzbekistan, Vietnam and the People's Republic of China. See 41 CFR 102-40.150
  • Controlled substance: means any drug or other substance, or immediate precursor included in the definition in section 102 of the Controlled Substances Act (21 U. See 24 CFR 100.201
  • Controlling entity: means an entity which directly or indirectly controls a member or applicant, and is not controlled by any other entity. See 41 CFR 101-28.306-3
  • Controlling Participant: means an individual or entity serving in a capacity for a Covered Project that makes the individual or entity subject to Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212
  • Conviction: means a judgment or any other determination of guilt of a criminal offense by any court of competent jurisdiction, whether entered upon a verdict or plea, including a plea of no contest. See 27 CFR 19.489
  • Cooling Degree Days: means a population-weighted annual average of the climatological cooling degree days for each weather station within a State, as determined by DOE. See 41 CFR 101-26.507-4
  • Cooperative agreement: A cooperative agreement between the Agricultural Marketing Service and another Federal agency or a State agency, or other agency, organization or person as specified in the Agricultural Marketing Act of 1946, as amended, for conducting the service. See 7 CFR 53.1

  • Cost reimbursement: Amount determined by the Administrator that equals the customary and reasonable costs incurred in preparing a package for a loan or grant. See 25 CFR 162.560
  • Cost sharing or matching: means the value of the third party in-kind contributions and the portion of the costs of a federally assisted project or program not borne by the Federal Government. See 32 CFR 33.3
  • Cost sharing or matching: That portion of project or program costs not borne by the Federal Government. See 32 CFR 34.2
  • covered CMRS: means broadband PCS, cellular, and 800/900 MHz SMR licensees that hold geographic area licenses or are incumbent SMR wide area licensees, and offer real-time, two-way switched voice service, are interconnected with the public switched network, and utilize an in-network switching facility that enables such CMRS systems to reuse frequencies and accomplish seamless hand-offs of subscriber calls.   • Covered functions: means those functions of a covered entity the performance of which makes the entity a health plan, health care provider, or health care clearinghouse. See 45 CFR 164.103
  • Covered multifamily dwellings: means buildings consisting of 4 or more dwelling units if such buildings have one or more elevators. See 24 CFR 100.201
  • Covered Project: means a project in which the participation of a Controlling Participant is conditioned on Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212

  • CTAP selection priority candidate: means a CTAP eligible who applied for and was determined to be well-qualified by the agency and whom the agency must select over any other applicant for the vacancy, unless the action to be taken is listed as an exception under §330. See 12 CFR 221.116
  • Current spouse: means a living person who is married to the employee, Member, or retiree at the time of the employee's, Member's, or retiree's death. See 7 CFR 58.37
  • Current spouse annuity: means a recurring benefit under CSRS that is payable (after the employee's, Member's, or retiree's death) to a current spouse who meets the requirements of §831. See 7 CFR 58.37
  • Custodial property: Borrower-owned real property and improvements which serve as security for an Rural Development loan, have been abandoned by the borrower, and of which the respective Agency has taken possession. See 25 CFR 170.616
  • Customer: means a consumer who has a customer relationship with you. See 42 CFR 476.110

  • Davis-Bacon Act: means the statute referenced in section 1702(k) of the Act. See 41 CFR 101-28.203
  • Day: means calendar day. See 49 CFR 1572.400

  • Debt: means an amount of money that has been determined to be owed by any person to FCIC or an insurance provider, excluding money owed to an insurance provider's agent, under any program administered under the Act. See 27 CFR 19.489

  • Decompression sickness: means a condition caused by the formation of gas or gas bubbles in the blood or body tissue as a result of pressure reduction. See 46 CFR 197.204
  • Decompression table: means a profile or set of profiles of ascent rates and breathing mixtures designed to reduce the pressure on a diver safely to atmospheric pressure after the diver has been exposed to a specific depth and bottom time. See 46 CFR 197.204
  • Decontrol: Removal of license requirements under the EAR. See 41 CFR 102-40.150
  • Decontrol assessment: An assessment of the foreign availability of an item to a country or countries for purposes of determining whether decontrol is warranted. See 41 CFR 102-40.150
  • Defect: Any nonconformance of a container from specified requirements. See 7 CFR 70.36

  • Direct loan accounts: For a borrower with a direct loan, the term "installation on note and other charges" as used in this Subpart, will be the sum of the following:

  • Displaced: describes an individual in one of the following categories:

    (1) A current career or career-conditional (tenure group I or II) competitive service employee of any agency at grade GS-15 (or equivalent) or below whose current performance rating of record is at least fully successful (Level 3) or equivalent and who:

  • Disposable pay: means the part of an employee's pay that remains after deductions that are required to be withheld by law have been made. See 45 CFR 1150.1
  • Distilling: The conduct by any person of operations that constitute, as defined by 26 U. See 27 CFR 29.45
  • Distilling apparatus: A still or condenser, as defined in this section, and any other apparatus to be used for the purpose of distilling. See 27 CFR 29.45
  • Dive location: means that portion of a vessel or facility from which a diving operation is conducted. See 46 CFR 197.204
  • Dive team: means the divers and diver support personnel involved in a diving operation, including the diving supervisor. See 46 CFR 197.204
  • Diver: means a person working beneath the surface, exposed to hyperbaric conditions, and using underwater breathing apparatus. See 46 CFR 197.204
  • Diver-carried reserve breathing gas: means a supply of air or mixed-gas, as appropriate, carried by the diver in addition to the primary or secondary breathing gas supplied to the diver. See 46 CFR 197.204
  • Diving installation: means all of the equipment used in support of a commercial diving operation. See 46 CFR 197.204
  • Diving mode: means a type of diving requiring SCUBA, surface-supplied air, or surface-supplied mixed-gas equipment, with related procedures and techniques. See 46 CFR 197.204
  • Diving stage: means a suspended platform constructed to carry one or more divers and used for putting divers into the water and bringing them to the surface when in-water decompression or a heavy-weight diving outfit is used. See 46 CFR 197.204
  • Diving supervisor: means the person having complete responsibility for the safety of a commercial diving operation including the responsibility for the safety and health of all diving personnel in accordance with this subpart. See 46 CFR 197.204
  • Division: Livestock, Poultry, Grain and Seed Division. See 7 CFR 53.1
  • Division Administrator: means the chief FHWA official assigned to conduct business in a particular State. See 50 CFR 221.25

  • Duplication: means the process of making a copy of a document necessary to respond to a Freedom of Information Act or other request. See 46 CFR 503.50
  • Duplicative support: "Duplicative support" exists when a Lifeline subscriber is receiving two or more Lifeline services concurrently or two or more subscribers in a household are receiving Lifeline services or Tribal Link Up support concurrently. See 47 CFR 54.400
  • Dwelling Unit: means a house, including a stationary mobile home, an apartment, a group of rooms, or a single room occupied as separate living quarters. See 41 CFR 101-26.507-4
  • Dwelling unit: means a single unit of residence for a family or one or more persons. See 24 CFR 100.201
  • Early work package: means a portion or phase of physical construction work (including but not limited to site preparation, structure demolition, hazardous material abatement/treatment/removal, early material acquisition/fabrication contracts, or any action that materially affects the objective consideration of alternatives in the NEPA review process) that is procured after NEPA is complete but before all design work for the project is complete.   • EIR: means a written report prepared by a TSA Inspector or other authorized agency official detailing the results of an inspection or investigation of a violation of a TSA requirement, including copies of any relevant evidence. See 49 CFR 1503.103

  • element: includes network elements, interconnection, and methods of obtaining interconnection and access to unbundled elements. See 47 CFR 51.501
  • Eligible cellulosic biofuels production facility: means a facility--

    (1) Located in the United States (including U. See 41 CFR 101-26.801

  • Eligible Lender: means either:

    (1) Any Person formed for the purpose of, or engaged in the business of, lending money that, as determined by DOE in each case, is:

    (i) Not debarred or suspended from participation in a Federal government contract or participation in a non-procurement activity (under a set of uniform regulations implemented for numerous agencies, such as DOE, at 2 CFR part 180). See 41 CFR 101-28.203

  • Eligible Non-Borrowing Spouse: means a Non-Borrowing Spouse who meets all Qualifying Attributes for a Deferral Period. See 24 CFR 206.3
  • Eligible operational risk offsets: means amounts, not to exceed expected operational loss, that:

  • Emergency: means an occurrence, such as an equipment failure, a container rupture, or a control equipment failure, which results or may result in an unexpected release of benzene. See 46 CFR 197.505

  • Export warehouse: A bonded internal revenue warehouse for the storage of tobacco products and cigarette papers and tubes, upon which the internal revenue tax has not been paid, for subsequent shipment to a foreign country, Puerto Rico, the Virgin Islands, or a possession of the United States, or for consumption beyond the jurisdiction of the internal revenue laws of the United States. See 27 CFR 46.92
  • Exporter: means the person, partnership, corporation or entity that initiates the export of noncomplying goods. See 41 CFR 109-1.108
  • Exposure category: means any of the wholesale, retail, securitization, or equity exposure categories. See 32 CFR 202.13
  • Facility: means a deepwater port, or an artificial island, installation, or other device on the Outer Continental Shelf subject to Coast Guard jurisdiction. See 46 CFR 197.204
  • Facility: means any structure, or structures of an eligible entity under one ownership at one general physical location, or, in the case of a mobile facility, traveling to multiple locations, that manufactures/processes, packs, holds, grows, harvests, or raises animals for food for consumption in the United States. See 43 CFR 9180.1
  • facility: includes all or any portion of structures, equipment, or other real or personal property or interests therein, and the provision of facilities includes the construction, expansion, renovation, remodeling, alteration or acquisition of facilities. See 41 CFR 101-6.216
  • Facility: means all or any portion of buildings, structures, equipment, roads, walks, parking lots, or other real or personal property or interest in such property. See 45 CFR 1170.3
  • Facility certification: means an attestation, issued for purposes of section 801(q) or 806 of the FD&C Act by an accredited third-party certification body, after conducting a regulatory audit and any other activities necessary to establish whether a facility complies with the applicable food safety requirements of the FD&C Act and FDA regulations. See 43 CFR 9180.1
  • Facility Fee: means the fee, to be paid in the amount and in the manner provided in the Term Sheet, to cover the Administrative Cost of Issuing a Loan Guarantee for the period from the Borrower's acceptance of the Term Sheet through issuance of the Guarantee. See 41 CFR 101-28.203
  • Fair Housing Act matters: refers to proceedings under this part pursuant to the Fair Housing Act and the implementing regulations at 24 CFR parts 100 and 103. See 24 CFR 180.100
  • Fair market value: means the price at which a highway agency and concessionaire are ready and willing to enter into a concession agreement for a federally funded highway on, or as if in, the open market for a reasonable period of time and in an arm's length transaction to any willing, knowledgeable, and able buyer.   • False information: Information, known to be incorrect, provided with the intent to obtain benefits which would not have been obtainable based on correct information. See 25 CFR 170.440
  • Family Unit: means all persons living together in a dwelling unit. See 41 CFR 101-26.507-4

  • Farmer program loans: This includes Farm Ownership (FO), Soil and Water (SW), Recreation (RL), Economic Opportunity (EO), Operating (OL), Emergency (EM), Economic Emergency (EE), Special Livestock (SL), Softwood Timber (ST) loans, and Rural Housing loans for farm service buildings (RHF).   • FDA: means the Food and Drug Administration. See 46 CFR 308.524
  • Federal Claims Collection Standards: means the standards currently published at 4 CFR Chapter II. See 45 CFR 1150.1
  • Federal financial assistance: includes (1) grants and loans of Federal funds, (2) the grant or donation of Federal property and interests in property, (3) the detail of Federal personnel, (4) the sale and lease of, and the permission to use (on other than a casual or transient basis), Federal property or any interest in such property without consideration or at a nominal consideration, or at a consideration which is reduced for the purposes of assisting the recipient, or in recognition of the public interest to be served by such sale or lease to the recipient, and (5) any Federal agreement, arrangement, or other contract which has as one of its purposes the provision of assistance.   • FHWA Division Administrator: means the chief Federal Highway Administration (FHWA) official assigned to conduct business in a particular State. See 50 CFR 260.18
  • Filing: A pleading or other document allowed or required to be filed in accordance with this part shall be considered filed when postmarked, if mailed, or when received, if hand delivered. See 24 CFR 200.20
  • Fill-in area: The area where the coverage contour of an FM translator or booster station is within the protected contour of the associated primary station (i. See 47 CFR 74.1201
  • Final administrative disposition: means an agency's completion of a case following a reasonable cause finding, including, but not limited to, an agency-approved settlement or a final, administrative decision issued by commissioners, hearing officers or administrative law judges. See 24 CFR 115.100
  • Final decision: A decision or order assessing a civil penalty, denial of export privileges or other sanction, or otherwise disposing of or dismissing a case, which is not subject to further review under this part, but which is subject to collection proceedings or judicial review in an appropriate Federal district court as authorized by law.   • Final report: means a report documenting a completed RD&T study or activity. See 49 CFR 1540.1
  • Finance Office: means the DOE Office of the Chief Financial Officer (or any office to which that Office's authority may be redelegated by the Secretary of Energy). See 41 CFR 101-26.607
  • Financially interested person: Any person having a financial interest in the livestock involved, including but not limited to the shipper, receiver, producer, seller, buyer, or carrier of the livestock or products. See 7 CFR 53.1
  • First aid antibiotic: An antibiotic-containing drug product applied topically to the skin to help prevent infection in minor cuts, scrapes, and burns. See 46 CFR 169.525
  • First occupancy: means a building that has never before been used for any purpose. See 24 CFR 100.201
  • First regular monthly payment: means the first annuity check payable on a recurring basis (other than an estimated payment or an adjustment check) after OPM has initially adjudicated the regular rate of annuity payable under CSRS and has paid the annuity accrued since the time of retirement.   • Flight school: means any pilot school, flight training center, air carrier flight training facility, or flight instructor certificated under 14 CFR part 61, 121, 135, 141, or 142. See 49 CFR 1552.1
  • Flight school employee: means a flight instructor or ground instructor certificated under 14 CFR part 61, 141, or 142. See 49 CFR 1552.21
  • Flight training: means instruction received from a flight school in an aircraft or aircraft simulator. See 49 CFR 1552.1
  • FM broadcast booster station: A station in the broadcasting service operated for the sole purpose of retransmitting the signals of an FM radio broadcast station, by amplifying and reradiating such signals, without significantly altering any characteristic of the incoming signal other than its amplitude. See 47 CFR 74.1201
  • FM translator: A station in the broadcasting service operated for the purpose of retransmitting the signals of an AM or FM radio broadcast station or another FM broadcast translator station without significantly altering any characteristics of the incoming signal other than its frequency and amplitude, in order to provide radio broadcast service to the general public. See 47 CFR 74.1201
  • FNS: means the Food and Nutrition Service, USDA. See 24 CFR 200.20
  • FOIA: means the Freedom of Information Act. See 32 CFR 1701.2
  • Food: has the meaning given in section 201(f) of the FD&C Act, except that food does not include pesticides (as defined in 7 U. See 43 CFR 9180.1
  • Force account: means a basis of payment for the direct performance of highway construction work with payment based on the actual cost of labor, equipment, and materials furnished and consideration for overhead and profit. See 50 CFR 221.25
  • Foreign availability to non-controlled countries: In this category are denied license assessments, decontrol assessments, and evaluations of eligibility for expedited licensing (see §768. See 41 CFR 102-40.150
  • Formal approval: means approval in writing or the electronic transmission of such approval. See 50 CFR 221.25
  • former spouse: includes only persons who were married to an employee or Member on or after May 7, 1985, or who were the spouse of a retiree who retired on or after May 7, 1985, regardless of the date of termination of the marriage. See 7 CFR 58.37

  • health care provider: is a ny:

    (1) Post-secondary educational institution offering health care instruction, including a teaching hospital or medical school;

    (2) Community health center or health center providing health care to migrants;

    (3) Local health department or agency;

    (4) Community mental health center;

    (5) Not-for-profit hospital;

    (6) Rural health clinic;

    (7) Skilled nursing facility; or

    (8) Consortium of health care providers consisting of one or more entities described in paragraphs (a)(1) through (7) of this section. See 47 CFR 54.600

  • Health oversight agency: means an agency or authority of the United States, a State, a territory, a political subdivision of a State or territory, or an Indian tribe, or a person or entity acting under a grant of authority from or contract with such public agency, including the employees or agents of such public agency or its contractors or persons or entities to whom it has granted authority, that is authorized by law to oversee the health care system (whether public or private) or government programs in which health information is necessary to determine eligibility or compliance, or to enforce civil rights laws for which health information is relevant.   • Imminent hazard: means the existence of a condition relating to a gas or hazardous liquid pipeline facility that presents a substantial likelihood that death, serious illness, severe personal injury, or a substantial endangerment to health, property, or the environment may occur before the reasonably foreseeable completion date of a formal administrative proceeding begun to lessen the risk of such death, illness, injury or endangerment.   • Injurious corrosion: means an advanced state of corrosion which may impair the structural integrity or safe operation of the equipment. See 46 CFR 197.204
  • Inmate: means a person detained at a Jail or Prison, regardless of the duration of the detention. See 47 CFR 64.6000
  • Inmate: means a person incarcerated in or otherwise confined to a correctional institution. See 45 CFR 164.501
  • Inspection Date: means the date established by the Program Manager on which a regularly scheduled routine inspection begins for a tunnel. See 23 CFR 650.505
  • Inspection service: means :

    (1) The Service established and conducted under the regulations in this part for the determination and certification or other identification as to the grade, the quality and/or condition of fresh fruits or vegetables and related products including the condition of container. See 7 CFR 51.2

  • Inspector: Any employee of the Plant Protection and Quarantine Programs, Animal and Plant Health Inspection Service, U. See 24 CFR 200.193
  • Inspector: means any employee of the Department authorized by the Secretary or any other person licensed by the Secretary, to investigate, sample, inspect, and certify, in accordance with the regulations in this part, to any interested party the quality, quantity and/or condition of any fresh product covered in this part, and to perform related duties in connection with the inspection service.   • Inspector: Any employee of the Animal and Plant Health Inspection Service, U. See 24 CFR 200.70

  • Insurable interest annuity: means the recurring payments under CSRS to a retiree who has elected a reduction in annuity to provide a survivor annuity to a person with an insurable interest in the retiree. See 7 CFR 58.37
  • Insurance Provider: means a legal entity which has entered into a Standard Reinsurance Agreement, Livestock Price Reinsurance Agreement, or other reinsurance agreement, as applicable, with FCIC for the applicable reinsurance year. See 27 CFR 19.489
  • Insured loan accounts: "Loan insurance charge" means a separate insurance charge applying to FO and SW insured loans evidenced by promissory note forms bearing a form date before January 8, 1959. See 25 CFR 170.110
  • Insured mortgage: means a mortgage which has been insured by the endorsement of the credit instrument by the Commissioner, or the Commissioner's duly authorized representative. See 24 CFR 200.3
  • Insurer: means any insurance company, underwriter, corporation, or association or underwriters, ship owners' protection and indemnity association, or other insurer acceptable to the Commission. See 46 CFR 540.2
  • Insurer: means any insurance company, underwriter, corporation or association of underwriters, ship owners' protection and indemnity association, or other insurer acceptable to the Commission. See 46 CFR 540.21
  • Intercreditor Agreement: means any agreement or instrument (or amendment or modification thereof) among DOE and one or more other Persons providing financing or other credit arrangements to the Borrower or an Eligible Project) or that otherwise provides for rights of DOE in respect of a Borrower or in respect of an Eligible Project, in each case in form and substance satisfactory to DOE.   • Interest credit: The terms "interest credit" and "interest credit assistance" as they relate to Single Family Housing (SFH) loans, are interchangeable with the term "payment assistance. See 25 CFR 170.512

  • Jock itch: A chronic and recurrent infection caused by certain dermatophytic fungi. See 46 CFR 169.541
  • judge: means any administrative law judge appointed pursuant to 5 U. See 27 CFR 26.97
  • Judicial Officer: means an official of the USDA delegated authority by the Secretary of Agriculture, pursuant to the Act of April 4, 1940 (7 U. See 24 CFR 200.20
  • Large plant: An alcohol fuel plant that produces (including receives) more than 500,000 proof gallons of spirits per calendar year. See 27 CFR 19.662
  • Law: refers to both state fair housing laws and local fair housing laws. See 24 CFR 115.100
  • Law enforcement official: means an officer or employee of any agency or authority of the United States, a State, a territory, a political subdivision of a State or territory, or an Indian tribe, who is empowered by law to:

    (1) Investigate or conduct an official inquiry into a potential violation of law. See 45 CFR 164.103

  • Lease: means an agreement, license, permit, or easement, oral or in writing, by which possession or use of land or interests therein is given for a specified purpose, and which is a valid contract under the laws of a State. See 23 CFR 750.703
  • Lender: means a person who engages in a residential real estate-related lending transaction. See 24 CFR 100.141
  • Limited permit: A document issued or authorized to be issued by an inspector to allow the interstate movement of noncertified regulated articles to a specified destination for limited handling, utilization, or processing or for treatment. See 24 CFR 200.80
  • Liquidated damages: means the daily amount set forth in the contract to be deducted from the contract price to cover additional costs incurred by a State transportation department because of the contractor's failure to complete the contract work within the number of calendar days or workdays specified. See 50 CFR 221.25
  • Liquidation: The act of selling security or EO property to close the loan when no further assistance will be given. See 25 CFR 213.22
  • Live Agent Fee: means a fee associated with the optional use of a live operator to complete Inmate Calling Services transactions. See 47 CFR 64.6000
  • Liveboating: means the support of a surfaced-supplied diver from a vessel underway. See 46 CFR 197.204
  • Livestock: Cattle, sheep, swine, or goats. See 7 CFR 53.1
  • Livestock: Bovine, ovine, porcine. See 7 CFR 54.1
  • Livestock Price Reinsurance Agreement: means a cooperative financial assistance agreement between FCIC and an insurance provider to deliver eligible livestock price insurance contracts under the authority of the Act and establishes the terms and conditions under which FCIC will provide subsidy and reinsurance on eligible livestock price insurance policies sold.   • Load rating: The determination of the live load carrying capacity of a bridge using bridge plans and supplemented by information gathered from a field inspection. See 50 CFR 29.220

  • Loan Agreement: The signed agreement between Rural Development and the intermediary setting forth the terms and conditions of the loan. See 25 CFR 170.452
  • Loan Guarantee Agreement: means a written agreement that, when entered into by DOE and a Borrower, and, if applicable, an Eligible Lender, establishes the obligation of DOE to guarantee the payment of all or a portion of the principal of, and interest on, specified Guaranteed Obligations, subject to the terms and conditions specified in the Loan Guarantee Agreement.   • Local Applicant: means a CAA or other public or non profit entity unit of general purpose local government. See 41 CFR 101-26.507-4
  • local exchange carrier: means any person that is engaged in the provision of telephone exchange service or exchange access. See 47 CFR 52.21
  • Local public agency: means any city, county, township, municipality, or other political subdivision that may be empowered to cooperate with the State transportation department in highway matters. See 50 CFR 221.25
  • long-term database method: means a database method that complies with the performance criteria set forth in §52. See 47 CFR 52.21
  • Lot: Lot means any number of containers of the same size and type which contain a processed product of the same type and style located in the same warehouse or conveyance, and which is available for inspection service at any time: Provided, that the number of containers comprising lot may not exceed the maximum number specified in the sampling plans in §52.   • Low income: An adjusted annual income that does not exceed the "lower" income limit according to size of household as established by the United States Department of Housing and Urban Development (HUD) for the county or Metropolitan Statistical Area (MSA) where the property is located.   • Marker residue: means the residue selected for assay whose concentration is in a known relationship to the concentration of the residue of carcinogenic concern in the last tissue to deplete to its S46 CFR 308.524
  • Market value: The most probable price which property should bring, as of a specific date, in a competitive and open market, assuming the buyer and seller are prudent and knowledgeable, and the price is not affected by undue stimulus such as forced sale or loan interest subsidy. See 25 CFR 170.512
  • marketing agreement: means any marketing agreement or any amendment thereto which may be entered into pursuant to section 8b of the act. See 27 CFR 26.97
  • marketing order: means any order or any amendment thereto which may be issued pursuant to section 8c of the act, and after notice and hearing as required by said section. See 27 CFR 26.97
  • Marriage: means a marriage recognized in law or equity under the whole law of the jurisdiction with the most significant interest in the marital status of the employee, Member, or retiree unless the law of that jurisdiction is contrary to the public policy of the United States. See 7 CFR 58.37

  • Non-Borrowing Spouse: means the spouse, as defined by the law of the state in which the spouse and borrower reside or the state of celebration, of the HECM borrower at the time of closing and who is also not a borrower. See 24 CFR 206.3

  • Notified substance: means the substance that is the subject of your GRAS notice. See 45 CFR 400.204

  • number portability: means the ability of users of telecommunications services to retain, at the same location, existing telecommunications numbers without impairment of quality, reliability, or convenience when switching from one telecommunications carrier to another. See 47 CFR 52.21

  • Operational loss: means a loss (excluding insurance or tax effects) resulting from an operational loss event. See 32 CFR 202.13

  • Operational risk: means the risk of loss resulting from inadequate or failed internal processes, people, and systems or from external events (including legal risk but excluding strategic and reputational risk). See 32 CFR 202.13
  • Operational risk: means the risk of loss resulting from inadequate or failed internal processes, people, and systems or from external events (including legal risk but excluding strategic and reputational risk). See 31 CFR 205.26
  • Operational risk exposure: means the 99. See 32 CFR 202.13
  • Operational risk exposure: means the 99. See 31 CFR 205.26
  • Operations involving benzene: means any operation that could subject a worker to benzene exposures above the PEL, including cargo transfer operations involving connecting or disconnecting liquid or vapor hoses. See 46 CFR 197.505
  • Operator: The person who is primarily responsible for carrying out the weather modification activity. See 41 CFR 102-72.69
  • OPS: means the Office of Pipeline Safety, which is part of the Pipeline and Hazardous Materials Safety Administration, U. See 49 CFR 190.3
  • opt-in approval: refers to a method for obtaining customer consent to use, disclose, or permit access to the customer's CPNI. See 47 CFR 64.2003
  • opt-out approval: refers to a method for obtaining customer consent to use, disclose, or permit access to the customer's CPNI. See 47 CFR 64.2003
  • Organization: Any of the following entities which are legally authorized to work in designated counties and/or colonias and are:

    (1) A State, State agency, or unit of general local government or. See 25 CFR 162.560

  • Organization: (1) Public or private nonprofit corporations, agencies, institutions, Indian tribes, and other associations. See 25 CFR 166.218
  • Organization: An organization is defined as one of the following:

    (1) A State, commonwealth, trust territory, other political subdivision, or public nonprofit corporation authorized to receive and administer HPG funds. See 25 CFR 166.408

  • Other retail exposure: means an exposure (other than a securitization exposure, an equity exposure, a residential mortgage exposure, a pre-sold construction loan, a qualifying revolving exposure, or the residual value portion of a lease exposure) that is managed as part of a segment of exposures with homogeneous risk characteristics, not on an individual-exposure basis, and is either:

    (1) An exposure to an individual for non-business purposes. See 32 CFR 202.13

  • Overcrowding: Guidance is provided at 7 CFR 3560. See 25 CFR 166.408
  • Overseas: has the meaning given that term in §210. See 12 CFR 220.118
  • Packager: Any eligible organization which is reimbursed with Housing Application Packaging Grants (HAPG) funds. See 25 CFR 162.560
  • Packing plant: means the premises, buildings, structures, and equipment including but not limited to, machines, utensils, fixtures, employed or used with respect to preparation and packing the product. See 7 CFR 51.2
  • Partially reduced annuity: means the recurring payments under CSRS to a retiree who has elected less than the maximum allowable reduction in annuity to provide a current spouse annuity or a former spouse annuity. See 7 CFR 58.37
  • party: refers to any person who participates in a proceeding by the timely filing of a petition for rule making, comments on a notice of proposed rule making, a petition for reconsideration, or responsive pleadings in the manner prescribed by this subpart. See 47 CFR 1.400
  • Party: means the respondent or TSA. See 49 CFR 1503.103
  • Party: BIS and any person named as a respondent under this part. See 41 CFR 102-40.25
  • Party: means a person who files a petition for appeal with NAO and an office that issued the IAD if that office participates in the NAO appeal. See 41 CFR 102-42.155
  • party: as used in this subpart includes the aggrieved person. See 24 CFR 180.500
  • Party: is a person who has full participation rights in a proceeding under this part. See 24 CFR 180.100
  • party: means the person alleged to have violated a statute or regulation to which a civil penalty applies and includes an individual or public or private corporation, partnership or other association, or a governmental entity. See 33 CFR 1.07-5
  • Party: as used in this part includes the person initiating a proceeding, such as an applicant, complainant, or petitioner. See 43 CFR 3486.4
  • Passenger: means any person who is to embark on a vessel at any U. See 46 CFR 540.2
  • passenger accommodations: includes all temporary and all permanent passenger sleeping facilities. See 46 CFR 540.2

  • Passenger compartment: Every motor vehicle transporting passengers, other than a bus, shall have a passenger compartment meeting the following requirements:

  • Passenger revenue: means those monies wherever paid by passengers who are to embark at any U. See 46 CFR 540.2
  • Paying agency: means the agency that employs the individual who owes a debt to the United States. See 45 CFR 1150.1
  • Payments: The mortgage shall:

    (1) Come due on the first of the month. See 24 CFR 203.17

  • Payroll office: means the office in the paying agency that is primarily responsible for payroll records and the coordination of pay matters with the appropriate personnel office. See 45 CFR 1150.1
  • Pediculicide drug product: A drug product for the treatment of head, pubic (crab), and body lice. See 46 CFR 197.460
  • Peer exchange: means a periodic review of a State DOT's RD&T program, or portion thereof, by representatives of other State DOT's, for the purpose of exchange of information or best practices. See 49 CFR 1540.1
  • Percentage change: means the percent change in the price index as defined in section 8462(a)(2) of title 5, United States Code. See 14 CFR 302.714
  • Percentage of completion method: refers to a system under which payments are made for construction work according to the percentage of completion of the work, rather than to the grantee's cost incurred. See 32 CFR 33.3
  • Performance bond: means a bond to ensure compliance with the terms of the contract and reclamation of the site as BLM requires. See 43 CFR 3601.5
  • Performance standard: means the standard in §197. See 46 CFR 197.505
  • Permanent position: means an appointment without time limitation. See 14 CFR 29.1519
  • Permit: The document issued pursuant to 26 U. See 27 CFR 19.662
  • Person: Any individual, corporation, company, society, or association, or other organized group of any of the foregoing. See 24 CFR 200.193
  • Person: Any individual, partnership, corporation, or other legal entity, or Government agency. See 7 CFR 53.1
  • Person: includes individuals, limited liability companies, corporations, partnerships, associations, and other legal entities existing under or authorized by the laws of the United States or any State thereof or the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands or any territory or possession of the United States, or the laws of any foreign country.   • Personal exposure: means the concentration of airborne benzene to which a person would be exposed if that person were not using a properly fitted respirator in compliance with §197. See 46 CFR 197.505
  • Persons whose activities relate to weather modification: Persons engaged in weather modification activities or engaged in the distribution or sale of weather modification apparatus or materials known by them to be destined for use in weather modification activities. See 41 CFR 102-72.69
  • Persons with Disabilities: means any individual (1) who is a handicapped individual as defined in section 7(6) of the Rehabilitation Act of 1973, (2) who is under a disability as defined in section 1614(a)(3)(A) or 223(d)(1) of the Social Security Act or in section 102(7) of the Developmental Disabilities Services and Facilities Construction Act, or (3) who is receiving benefits under chapter 11 or 15 of title 38, U. See 41 CFR 101-26.507-4
  • PHMSA: means the Pipeline and Hazardous Materials Safety Administration of the United States Department of Transportation. See 49 CFR 190.3
  • Pink bollworm: The live insect known as the pink bollworm of cotton (Pectinophora gossypiella Saund. See 24 CFR 200.80
  • Plant: An alcohol fuel plant. See 27 CFR 19.662
  • Plaster vehicle: A fabric, plastic, or other suitable backing material in which medication is usually incorporated for topical application to the skin. See 46 CFR 197.404
  • Plaster vehicle: A fabric, plastic, or other suitable backing material in which medication is usually incorporated for topical application to the skin. See 46 CFR 197.452
  • pleading: means any written notice, motion, petition, request, opposition, reply, brief, proposed findings, exceptions, memorandum of law, or other paper filed with the Commission in a hearing proceeding. See 47 CFR 1.204
  • Pleading: means a complaint, an answer, motion and any amendment of these documents permitted under this subpart as well as any other written submission to the ALJ or a party during the course of the hearing proceedings. See 49 CFR 1503.103
  • Pooling Administrator: refers to the entity or entities responsible for administering a thousands-block number pool. See 47 CFR 52.7
  • portal: means the entrance and exit of the tunnel exposed to the environment; portals may include bare rock, constructed tunnel entrance structures, or buildings. See 23 CFR 650.505
  • Preconstruction services: means consulting to provide a contracting agency and its designer with information regarding the impacts of design on the physical construction of the project, including but not limited to: Scheduling, work sequencing, cost engineering, constructability, cost estimating, and risk identification. See 50 CFR 260.27
  • Premises: means the interior or exterior spaces, parts, components or elements of a building, including individual dwelling units and the public and common use areas of a building. See 24 CFR 100.201
  • Prepaid Calling: means a presubscription or comparable service in which a Consumer, other than an Inmate, funds an account set up through a Provider of Inmate Calling Services. See 47 CFR 64.6000
  • Prepaid Collect Calling: means a calling arrangement that allows an Inmate to initiate an Inmate Calling Services call without having a pre-established billing arrangement and also provides a means, within that call, for the called party to establish an arrangement to be billed directly by the Provider of Inmate Calling Services for future calls from the same Inmate. See 47 CFR 64.6000
  • Present value factor: means the amount of money (earning interest at an assumed rate) required at the time of annuity commencement to fund an annuity that starts at the rate of $1 a month and is payable in monthly installments for the annuitant's lifetime based on mortality rates for annuitants paid from the Civil Service Retirement and Disability Fund. See 7 CFR 58.37
  • Pressure vessel: means a container capable of withstanding an internal maximum working pressure over 15 psig. See 46 CFR 197.204
  • Previous Participation: means a Controlling Participant's previous participation in Covered Projects, and, if applicable, other federal, state and local housing programs, in accordance with the definition of Risk. See 24 CFR 200.212
  • Primary advertising classification: A primary advertising classification is the principal business heading under which a subscriber to telephone exchange service for businesses chooses to be listed in the yellow pages, if the carrier either assigns that heading or is obligated to provide yellow pages listings as part of telephone exchange service to businesses. See 47 CFR 64.2305
  • primary recipient: means any recipient which is authorized or required to extend Federal financial assistance to another recipient. See 41 CFR 101-6.216
  • Primary station: The AM or FM radio broadcast station radiating the signals which are retransmitted by an FM broadcast translator station or an FM broadcast booster station. See 47 CFR 74.1201
  • Principal residence: means the dwelling where the borrower and, if applicable, Non-Borrowing Spouse, maintain their permanent place of abode, and typically spend the majority of the calendar year. See 24 CFR 206.3
  • Prior approval: means documentation evidencing consent prior to incurring specific cost. See 32 CFR 33.3
  • Prior approval: Written or electronic approval by an authorized official evidencing prior consent. See 32 CFR 34.2
  • Prior lien: A security instrument (such as a mortgage or deed of trust) or a judgment which was of public record before the Rural Development security instrument(s) as well as real estate taxes or assessments which are or will become a lien against the property which is superior to Rural Development's security instrument(s). See 25 CFR 170.512
  • Prison: means a facility operated by a territorial, state, or federal agency that is used primarily to confine individuals convicted of felonies and sentenced to terms in excess of one year. See 47 CFR 64.6000
  • Private collection contractor: means a private debt collector under contract with an agency to collect a non-tax debt owed to the United States. See 45 CFR 1150.1
  • private nonprofit organization: is a corporation which: is owned and controlled by private persons. See 25 CFR 162.209
  • probable cause: means a reasonable ground for belief that an individual with developmental disability(ies) has been, or may be, subject to abuse or neglect, or that the health or safety of the individual is in serious and immediate jeopardy. See 45 CFR 1326.19
  • procedures: means the written documentation of policies, methods, considerations, criteria, and other conditions that direct the actions of personnel so that a desired end result is achieved consistently. See 23 CFR 650.505
  • proceeding: means a proceeding upon the basis of which a marketing agreement may be entered into or a marketing order may be issued. See 27 CFR 26.97
  • Processed product: means any fruit, vegetable, or other food product covered under the regulations in this part which has been preserved by any recognized commercial process, including, but not limited to canning, freezing, dehydrating, drying, the addition of chemical substances, or by fermentation. See 7 CFR 52.2
  • Processing: Drying, curing, smoking, cooking, seasoning, or flavoring or any combination of such processes, with or without fabricating. See 7 CFR 54.1
  • Products: Meats, prepared meats, meat by-products, or meat food products. See 7 CFR 54.1
  • Program: means the appropriate technology small grants program. See 41 CFR 101-26.803-4
  • Program Allocation: means the base allocation plus formula allocation for each State. See 41 CFR 101-26.507-4
  • Program income: Gross income earned by the recipient that is directly generated by a supported activity or earned as a result of the award. See 32 CFR 34.2
  • Program manager: The individual in charge of the program, that has been assigned or delegated the duties and responsibilities for bridge inspection, reporting, and inventory. See 50 CFR 29.220
  • Program Manager: means the individual in charge of the inspection program who has been assigned or delegated the duties and responsibilities for tunnel inspection, reporting, and inventory. See 23 CFR 650.505
  • Program or activity: means all of the operations of any entity described in paragraphs (h)(1) through (4) of this section, any part of which is extended Federal financial assistance:

    (1)(i) A department, agency, special purpose district, or other instrumentality of a State or of a local government. See 45 CFR 1151.3

  • program or activity: means all of the operations of any entity described in paragraphs (g)(1) through (4) of this section, any part of which is extended Federal financial assistance:

    (1)(i) A department, agency, special purpose district, or other instrumentality of a State or of a local government. See 45 CFR 1170.3

  • Program or activity: means all of the operations of:

    (1)(i) A department, agency, special purpose district, or other instrumentality of a State or local government, or

    (ii) The entity of such State or local government that distributes Federal financial assistance and each such department or agency (and each other State or local government entity) to which the assistance is extended, in the case of assistance to a State or local government. See 45 CFR 1172.3

  • Program property: SFH and MFH inventory property that can be used to effectively carry out the objectives of their respective loan programs with financing through that program. See 25 CFR 170.616
  • Project: A related series of weather modification activities having a common objective. See 41 CFR 102-72.69
  • Project: means a property consisting of site, improvements and, where permitted, equipment meeting the provisions of the applicable section of the Act, other applicable statutes and regulations, and terms, conditions and standards established by the Commissioner. See 24 CFR 200.3
  • Project costs: All allowable costs, as set forth in the applicable Federal cost principles, incurred by a recipient and the value of the contributions made by third parties in accomplishing the objectives of the award during the project period. See 32 CFR 34.2
  • Project period: The period established in the award document during which Federal sponsorship begins and ends. See 32 CFR 34.2
  • Project Sponsor: means any Person that assumes substantial responsibility for the development, financing, and structuring of an Eligible Project and, if not the Applicant, owns or controls, by itself and/or through individuals in common or affiliated business entities, a five percent or greater interest in the proposed Eligible Project, the Borrower or the Applicant. See 41 CFR 101-28.203
  • Properly addressed: means a document that shows an address contained in agency records, a residential, business, or other address submitted by a person on any document provided under this part, or any other address obtained by other reasonable and available means. See 49 CFR 1503.103
  • Property: Real property and personal property (equipment, supplies, intangible property and debt instruments), unless stated otherwise. See 32 CFR 32.2
  • Property: Real property and personal property (equipment, supplies, and intellectual property), unless stated otherwise. See 32 CFR 34.2
  • Proprietor: The person qualified under this subpart to operate an alcohol fuel plant. See 27 CFR 19.662
  • Psoriasis: A condition of the scalp or body characterized by irritation, itching, redness, and extreme excess shedding of dead epidermal cells. See 46 CFR 197.484
  • Psychotherapy notes: means notes recorded (in any medium) by a health care provider who is a mental health professional documenting or analyzing the contents of conversation during a private counseling session or a group, joint, or family counseling session and that are separated from the rest of the individual's medical record. See 45 CFR 164.501
  • Public agency: means any organization with administrative or functional responsibilities which are directly or indirectly affiliated with a governmental body of any nation, State, or local jurisdiction. See 50 CFR 221.25
  • Public health authority: means an agency or authority of the United States, a State, a territory, a political subdivision of a State or territory, or an Indian tribe, or a person or entity acting under a grant of authority from or contract with such public agency, including the employees or agents of such public agency or its contractors or persons or entities to whom it has granted authority, that is responsible for public health matters as part of its official mandate. See 45 CFR 164.501
  • public nonprofit organization: is a nonprofit corporation other than a private nonprofit corporation, including a municipal corporation or other corporate agency of a State or local government. See 25 CFR 162.209
  • Public transportation agency: means a publicly owned operator of public transportation eligible to receive Federal assistance under 49 U. See 49 CFR 1503.103
  • Publicly owned equipment: means equipment previously purchased or otherwise acquired by the public agency involved primarily for use in its own operations. See 50 CFR 221.25
  • purchase assignment: as used in this subpart shall normally be considered to include performance of the following functions:

    (1) Arranging with requiring agencies for phased submission of requirements and procurement requisitions. See 41 CFR 101-25.201

  • purity: means the name or names of the kind, type, or variety and the percentage or percentages thereof; the percentage of other agricultural seed or crop seed; the percentage of weed seeds, including noxious-weeds seeds; the percentage of inert matter; and the names of the noxious-weed seeds and the rate of occurrence of each. See 7 CFR 201.2
  • PVHO: means pressure vessel for human occupancy but does not include pressure vessels for human occupancy that may be subjected to external pressures in excess of 15 psig but can only be subjected to maximum internal pressures of 15 psig or less (i. See 46 CFR 197.204
  • Qualified: refers to an RPL registrant who:

    (1) Meets OPM-established or -approved qualification standards and requirements for the position, including minimum educational requirements, and agency-established selective factors (as this term is used in OPM's "Operating Manual: Qualification Standards for General Schedule Positions"). See 12 CFR 220.118

  • qualifying assistance program: means any of the federal or Tribal assistance programs the participation in which, pursuant to §54. See 47 CFR 54.400
  • Qualifying court order: means a court order acceptable for processing as defined in §838. See 14 CFR 302.722
  • Qualifying court order: means a court order that awards a former spouse annuity and that satisfies the requirements of section 8341(h) of title 5, United States Code, for awarding a former spouse annuity. See 7 CFR 58.37
  • qualifying low-income consumer: is a consumer who meets the qualifications for Lifeline, as specified in §54. See 47 CFR 54.400
  • Quality: A combination of the inherent properties of a product which determines its relative degree of excellence. See 7 CFR 54.1
  • Quality: means the inherent properties of any processed product which determine the relative degree of excellence of such product, and includes the effects of preparation and processing, and may or may not include the effects of packing media, or added ingredients. See 7 CFR 52.2
  • Random sampling: A process of selecting a sample from a lot, or portion of production, whereby each unit in the lot of portion of production, has an equal chance of being chosen. See 7 CFR 70.36
  • Readily available biographical information: "Readily available biographical information" is information drawn from the customer's life history and includes such things as the customer's social security number, or the last four digits of that number. See 47 CFR 64.2003
  • Real property: Land, including land improvements, structures and appurtenances thereto, but excluding movable machinery and equipment. See 32 CFR 32.2
  • Real property: means land, including land improvements, structures and appurtenances thereto, excluding movable machinery and equipment. See 32 CFR 33.3

  • Recipient: means any state or its political subdivision, any instrumentality of a state or its political subdivision, any public or private agency, institution, organization, or other entity, or any person to which federal financial assistance is extended directly or through another recipient, including any successor, assignee, or transferee of a recipient, but excluding the ultimate beneficiary of the assistance. See 45 CFR 1151.3
  • Recipient: means any state or its political subdivision, any instrumentality of a state or its political subdivision, any public or private agency, institution, organization, or other entity, or any person to which Federal financial assistance is extended directly or through another recipient, including any successor, assignee, or transferee of a recipient, but excluding the ultimate beneficiary of the assistance. See 45 CFR 1170.3
  • Recipient: means any State or its political subdivision, any instrumentality of a State or its political sub-division, any public or private agency, institution, organization, or other entity, or any person to which Federal financial assistance is extended, directly or through another recipient. See 45 CFR 1172.3
  • Recipient: has the meaning provided in 24 CFR 1. See 24 CFR 180.100
  • Recipient: means an organization which has applied for financial assistance, and to which financial assistance is awarded under this Act. See 45 CFR 1336.10
  • Recognized accreditation body: means an accreditation body that FDA has determined meets the applicable requirements of this subpart and is authorized to accredit third-party certification bodies under this subpart. See 43 CFR 9180.1
  • Recommended decision: A decision of the administrative law judge in proceedings involving violations other than those relating to part 760 of the EAR, which is subject to review by the Under Secretary of Commerce for Industry and Security, who issues a written order affirming, modifying or vacating the recommended decision. See 41 CFR 102-40.25
  • Record: means any item, collection, or grouping of information about an individual that is maintained by the ODNI including, but not limited to, information such as an individual's education, financial transactions, medical history, and criminal or employment history that contains the individual's name, or an identifying number, symbol, or any other identifier assigned to an individual. See 32 CFR 1701.2
  • records: as used in this subpart does not include qualifying documents required under subpart D of this part, or bonds required under subpart F of this part. See 27 CFR 19.577
  • Recoverable cost: is a contractual or noncontractual program loan cost expense chargeable to a borrower, property account, or part of the loan subsidy. See 25 CFR 170.512

  • Recurrent training: means periodic training required under 14 CFR part 61, 121,125, 135, or Subpart K of part 91. See 49 CFR 1552.1

  • regional database: means an SMS database or an SMS/SCP pair that contains information necessary for carriers to provide number portability in a region as determined by the NANC. See 47 CFR 52.21
  • Registered Internet-based TRS User: has the meaning set forth in 47 CFR 64. See 47 CFR 52.21
  • Regulated airport: Any airport or portions of an airport in a quarantined State declared regulated in accordance with provisions in §301. See 24 CFR 200.70
  • Regulated area: Any quarantined State, or any portion thereof, designated as a regulated area in §301. See 24 CFR 200.193
  • Regulated area: Any quarantined State, territory, or district, or any portion thereof, listed as a regulated area in §301. See 24 CFR 200.80

  • Regulatory method: means the aggregate of all experimental procedures for measuring and confirming the presence of the marker residue of the sponsored compound in the target tissue of the target animal. See 46 CFR 308.524
  • Reinstatement: means that the policy will retain the same plan of insurance, coverage levels, price percentages, endorsements and options the person had prior to termination, provided the person continues to meet all eligibility requirements, comply with the terms of the policy, and there is no evidence of misrepresentation or fraud. See 27 CFR 19.489
  • Reliable evidence: Relevant information that is credible and dependable. See 41 CFR 102-40.150
  • Remote pickup broadcast base station: A remote pickup broadcast station authorized for operation at a specified location. See 47 CFR 74.401
  • Remote pickup broadcast stations: A term used in this subpart to include both remote pickup broadcast base stations and remote pickup broadcast mobile stations. See 47 CFR 74.401
  • Renewable energy facility: means a single module or unit, or an aggregation of such units, that generates electric energy which is independently metered and which results from the utilization of a renewable energy source. See 41 CFR 101-26.607
  • Renewable energy source: means solar heat, solar light, wind, ocean, geothermal heat, and biomass, except for--

    (1) Heat from the burning of municipal solid waste. See 41 CFR 101-26.607

  • Renewable energy system: means a system which when installed in connection with a dwelling--

    (1) Transmits or uses solar energy, energy derived from geothermal deposits, energy derived from biomass (or any other form of renewable energy which DOE subsequently specifies through an amendment of this part) for the purpose of heating or cooling such dwelling or providing hot water or electricity for use within such dwelling. See 41 CFR 101-26.507-4

  • Rental properties: Rental properties are defined as single-unit or multi-unit dwellings used for occupancy by tenants, owners, or members of an owner's immediate family. See 25 CFR 166.408
  • Replacement housing: The replacement of existing, individual owner occupied housing where repair and rehabilitation assistance is not economically feasible or practical. See 25 CFR 166.408
  • Representative: means an individual properly authorized by an appellant in writing to act for the appellant in conjunction with an appeal pending in NAO. See 41 CFR 102-42.155
  • Required by law: means a mandate contained in law that compels an entity to make a use or disclosure of protected health information and that is enforceable in a court of law. See 45 CFR 164.103
  • Research: Basic, applied, and advanced research activities. See 32 CFR 34.2
  • Research: means a systematic study directed toward fuller scientific knowledge or understanding of the subject studied. See 49 CFR 1540.1
  • Research: means a systematic investigation, including research development, testing, and evaluation, designed to develop or contribute to generalizable knowledge. See 45 CFR 164.501
  • Residential Energy Expenditures: means the average annual cost of purchased residential energy, including the cost of renewable energy resources. See 41 CFR 101-26.507-4
  • Residential real estate-related lending transaction: means the making of a loan:

    (1) For purchasing, constructing, improving, repairing, or maintaining a dwelling. See 24 CFR 100.141

  • Residue: means any compound present in edible tissues of the target animal which results from the use of the sponsored compound, including the sponsored compound, its metabolites, and any other substances formed in or on food because of the sponsored compound's use. See 46 CFR 308.524
  • Residue of carcinogenic concern: means all compounds in the total residue of a demonstrated carcinogen excluding any compounds judged by FDA not to present a carcinogenic risk. See 46 CFR 308.524
  • Respondent: refers to the person against whom a complaint is filed. See 40 CFR 141.553
  • Respondent: means the person named in a Notice of Proposed Civil Penalty, a Final Notice of Proposed Civil Penalty and Order, or a complaint. See 49 CFR 1503.103
  • Respondent: Any person named as the subject of a charging letter, proposed charging letter, temporary denial order, or other order proposed or issued under this part. See 41 CFR 102-40.25
  • Respondent: means the person accused of violating one of the statutes covered by this part, including a recipient. See 24 CFR 180.100
  • Restricted destination permit: A document issued or authorized to be issued by an inspector to allow the interstate movement of regulated articles not certified under all applicable Federal domestic plant quarantines to a specified destination for other than scientific purposes. See 24 CFR 200.80
  • Retail: (i) A retail exposure of an FDIC-supervised institution is in default if:

    (A) The exposure is 180 days past due, in the case of a residential mortgage exposure or revolving exposure. See 32 CFR 202.13

  • Retail: (i) A retail exposure of a Board-regulated institution is in default if:

  • Retainer ring: A die cut polyethylene foam pad coated on one side with medical grade acrylic pressure-sensitive adhesive. See 46 CFR 197.432
  • Retiree: means a former employee or Member who is receiving recurring payments under FERS based on service by the employee or Member. See 14 CFR 302.24
  • Retiree: means a retiree as defined in §842. See 14 CFR 302.714
  • Retiree: as used in this subpart , does not include a current spouse, former spouse, child, or person with an insurable interest receiving a survivor annuity. See 7 CFR 58.37
  • Review: means the process of examining documents located in response to a commercial use request to determine whether any portion of any document located is permitted to be withheld. See 46 CFR 503.50
  • Revolving funds: means a fund that has two types of deposit accounts, one of which will be HFIL funds from FSA and the other will be comprised of repayments of loans from the ultimate recipients, interest earned on funds in the account and cash, or other short-term marketable assets that the intermediary lender chooses to deposit. See 27 CFR 24.96
  • RHS: RHS means the Rural Housing Service, or a successor agency. See 25 CFR 166.408
  • Ringworm: A skin infection caused by certain dermatophytic fungi. See 46 CFR 169.541
  • Risk: In order to determine whether a Controlling Participant's participation in a project would constitute an unacceptable risk, the Commissioner must determine whether the Controlling Participant could be expected to participate in the Covered Project in a manner consistent with furthering the Department's purposes. See 24 CFR 200.212
  • Risk parameter: means a variable used in determining risk-based capital requirements for wholesale and retail exposures, specifically probability of default (PD), loss given default (LGD), exposure at default (EAD), or effective maturity (M). See 32 CFR 202.13

  • rural area: is a n area that is entirely outside of a Core Based Statistical Area; is within a Core Based Statistical Area that does not have any Urban Area with a population of 25,000 or greater; or is in a Core Based Statistical Area that contains an Urban Area with a population of 25,000 or greater, but is within a specific census tract that itself does not contain any part of a Place or Urban Area with a population of greater than 25,000. See 47 CFR 54.600
  • Rural area: The definition in 7 CFR part 3550 applies. See 25 CFR 166.218

  • satellite broadcast programming vendor: means a fixed service satellite carrier that provides service pursuant to section 119 of title 17, United States Code, with respect to satellite broadcast programming. See 47 CFR 76.1000
  • satellite cable programming: means video programming which is transmitted via satellite and which is primarily intended for direct receipt by cable operators for their retransmission to cable subscribers, except that such term does not include satellite broadcast programming. See 47 CFR 76.1000
  • satellite cable programming vendor: means a person engaged in the production, creation, or wholesale distribution for sale of satellite cable programming, but does not include a satellite broadcast programming vendor. See 47 CFR 76.1000
  • Saturation diving: means saturating a diver's tissues with the inert gas in the breathing mixture to allow an extension of bottom time without additional decompression. See 46 CFR 197.204
  • Scenario analysis: means a systematic process of obtaining expert opinions from business managers and risk management experts to derive reasoned assessments of the likelihood and loss impact of plausible high-severity operational losses. See 32 CFR 202.13
  • Schedule status: For direct and insured loans, a borrower will be on schedule when the sum of regular payments through the last preceding due date of the note equals the sum of installments on the note and other charges due through the same date. See 25 CFR 170.110

  • Separated employee: means a former employee or Member who has been separated from the service but who has not met all the requirements for retirement under FERS or who has not filed an application for retirement under FERS. See 14 CFR 302.24
  • Service: Grading service or acceptance service. See 7 CFR 53.1

  • service portability: means the ability of users of telecommunications services to retain existing telecommunications numbers without impairment of quality, reliability, or convenience when switching from one telecommunications service to another, without switching from one telecommunications carrier to another.     (1) business, repair, and amusement services,

    (2) management, legal, engineering, architectural, and other professional services, and

  • Servicing official: For loans to individuals as defined in paragraph (d) of this section, the servicing official is the County Supervisor. See 25 CFR 170.512

  • similarly situated: means , for the purposes of evaluating alternative programming contracts offered by a defendant programming vendor or by a terrestrial cable programming vendor alleged to have engaged in conduct described in §76. See 47 CFR 76.1000
  • Single Family Housing: RHS Rural Housing loans for individuals for construction of, repair of, or purchase of a dwelling to be occupied by one household. See 25 CFR 162.361
  • Single sampling: A sampling scheme where the decision to accept or reject an inspection lot with respect to a specified requirement is made after the inspection of a single sample. See 7 CFR 70.36
  • Site: A parcel of land proposed as a dwelling site, with or without development. See 25 CFR 162.361

  • Site Commission: means any form of monetary payment, in-kind payment, gift, exchange of services or goods, fee, technology allowance, or product that a Provider of Inmate Calling Services or affiliate of an Provider of Inmate Calling Services may pay, give, donate, or otherwise provide to an entity that operates a correctional institution, an entity with which the Provider of Inmate Calling Services enters into an agreement to provide ICS, a governmental agency that oversees a correctional facility, the city, county, or state where a facility is located, or an agent of any such facility.   • Siting authority: means a State government, local government, or instrumentality of a State government or local government, including any official or organizational unit thereof, whose authorization is necessary prior to the deployment of personal wireless service facilities. See 47 CFR 1.6002
  • Small plant: An alcohol fuel plant that produces (including receives) not more than 10,000 proof gallons of spirits per calendar year. See 27 CFR 19.662
  • Soil: That part of the upper layer of earth in which plants can grow. See 24 CFR 200.193
  • Solicitation: means an announcement that DOE is accepting Applications that is widely disseminated to the public on the DOE Web site or otherwise, and which satisfies the requirements of §609. See 41 CFR 101-28.203
  • Special provisions: means additions and revisions to the standard and supplemental specifications applicable to an individual project. See 50 CFR 260.18
  • Special tax: The special (occupational) tax on manufacturers of tobacco products, manufacturers of cigarette papers and tubes, and export warehouse proprietors, imposed by 26 U. See 27 CFR 46.92
  • Specialty items: means work items identified in the contract which are not normally associated with highway construction and require highly specialized knowledge, abilities or equipment not ordinarily available in the type of contracting organizations qualified and expected to bid on the contract. See 50 CFR 221.25
  • Specifications: Description with respect to the class, grade, other quality, quantity or condition of livestock approved by the Administrator, and available for use by the industry regardless of the origin of the descriptions. See 7 CFR 53.1

  • State transportation department: The term "State transportation department" is defined in 23 U. See 50 CFR 29.220
  • Station: As used in this subpart, each remote pickup broadcast transmitter, and its associated accessory equipment necessary to the radio communication function, constitutes a separate station. See 47 CFR 74.401
  • Statute: when used in this chapter means Subtitle VII of Title 49 of the United States Code (Transportation). See 43 CFR 3486.4
  • Statutory objective: means any purpose of a program or activity expressly stated in any Federal statute, State statute, or local statute or ordinance adopted by an elected, general purpose legislative body. See 45 CFR 1172.3
  • STEL: means an airborne concentration of five parts of benzene per million parts of air (five ppm), as averaged over any 15 minute period. See 46 CFR 197.505
  • Still: Any apparatus capable of being used for separating alcoholic or spirituous vapors, or spiritous solutions, or spirits, from spirituous solutions or mixtures, but shall not include stills used for laboratory purposes or stills used for distilling water or other nonalcoholic materials where the cubic distilling capacity is one gallon or less. See 27 CFR 29.45
  • Structural defect: A defect in the dwelling or unit, installation or set-up of a unit, or a related facility or a deficiency in the site or site development which directly and significantly reduces the useful life, habitability, or integrity of the dwelling or unit. See 25 CFR 162.372
  • Structure: means a pole, tower, base station, or other building, whether or not it has an existing antenna facility, that is used or to be used for the provision of personal wireless service (whether on its own or comingled with other types of services). See 47 CFR 1.6002
  • Studio: Any room or series of rooms equipped for the regular production of broadcast programs of various kinds. See 47 CFR 74.401
  • Subaward: An award of financial assistance in the form of money, or property in lieu of money, made under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 32 CFR 32.2
  • Subaward: Financial assistance in the form of money, or property in lieu of money, provided under an award by a recipient to an eligible subrecipient or by a subrecipient to a lower tier subrecipient. See 32 CFR 34.2
  • subdistribution agreement: means an arrangement by which a local cable operator is given the right by a satellite cable programming vendor or satellite broadcast programming vendor to distribute the vendor's programming to competing multichannel video programming distributors. See 47 CFR 76.1000
  • Subdivision: Five or more contiguous (developed or undeveloped) lots or building sites. See 25 CFR 162.361
  • Subgrant: means an award of financial assistance in the form of money, or property in lieu of money, made under a grant by a grantee to an eligible subgrantee. See 32 CFR 33.3
  • Subgrantee: means the government or other legal entity to which a subgrant is awarded and which is accountable to the grantee for the use of the funds provided. See 32 CFR 33.3
  • Subgrantee: means an entity managing a weatherization project which receives a grant of funds awarded under this part from a grantee. See 41 CFR 101-26.507-4
  • Subrecipient: The legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds provided. See 32 CFR 32.2
  • Subrecipient: The legal entity to which a subaward is made and which is accountable to the recipient for the use of the funds provided. See 32 CFR 34.2
  • Subscriber list information: Subscriber list information is any information:

    (1) Identifying the listed names of subscribers of a carrier and such subscribers' telephone numbers, addresses, or primary advertising classifications (as such classifications are assigned at the time of the establishment of such service), or any combination of such listed names, numbers, addresses, or classifications. See 47 CFR 64.2305

  • Sufficient quantity: The amount of an item that would render the U. See 41 CFR 102-40.150
  • Suitable property: For FSA inventory property, real property that can be used for agricultural purposes, including those farm properties that may be used as a start up or add-on parcel of farmland. See 25 CFR 170.616
  • Supervisor: An official person designated by the Director or Chief to supervise and maintain uniformity and accuracy of service under the regulations. See 7 CFR 53.1
  • Supervisory assistance: Any type of assistance to low-income families which will assist those families in meeting the eligibility requirements for, or the financial and managerial responsibilities of, homeownership or tenancy in an adequate housing unit. See 25 CFR 166.218
  • Supplement: means any data and information that you submit regarding a filed GRAS notice after we respond to your notice by letter in accordance with §170. See 45 CFR 400.204
  • Supplement: means any data and information that you submit regarding a filed GRAS notice after we respond to your notice by letter in accordance with §570. See 47 CFR 1.749
  • Supplies: means all tangible personal property other than "equipment" as defined in this part. See 32 CFR 33.3
  • Supplies: Tangible expendable personal property that is charged directly to the award and that has a useful life of less than one year or an acquisition cost of less than $5000 per unit. See 32 CFR 34.2
  • Support: means financial support or award under the program by grants, cooperative agreements or contracts. See 41 CFR 101-26.803-4
  • Support Office Director: means the Director of the DOE Field Support Office with the responsibility for grant administration or any official to whom that function may be redelegated by the Assistant Secretary. See 41 CFR 101-26.507-4
  • Supported services: Voice Telephony services and broadband Internet access services are supported services for the Lifeline program. See 47 CFR 54.400
  • Supportive Services: means those services and activities provided in connection with minority business enterprise programs which are designed to increase the total number of minority businesses active in the highway program and contribute to the growth and eventual self-sufficiency of individual minority businesses so that such businesses may achieve proficiency to compete, on an equal basis, for contracts and subcontracts. See 49 CFR 1503.409
  • Suppressive area: That portion of a regulated area where eradication of infestation is undertaken as an objective, as designated by the Deputy Administrator under §301. See 24 CFR 200.193
  • Suppressive area: That part of a regulated area where eradication of infestation is undertaken as an objective, as designated by the Deputy Administrator under §301. See 24 CFR 200.80
  • Surface-supplied air diving: means a diving mode in which the diver is supplied from the dive location or bell with compressed breathing air including oxygen or oxygen enriched air if supplied for treatment. See 46 CFR 197.204
  • Surplus: describes an agency employee in one of the following three categories:

    (1) A current career or career-conditional (tenure group I or II) competitive service employee at grade GS-15 (or equivalent) or below who received a Certification of Expected Separation under part 351 of this chapter or other official agency certification or notification indicating that the employee's position is surplus (for example, a notice of position abolishment or a notice of eligibility for discontinued service retirement). See 12 CFR 221.116

  • Surplus property: For FSA inventory property, real property that cannot be used for agricultural purposes including nonfarm properties. See 25 CFR 170.616
  • Survivor: means a person entitled to benefits under part 843 or 846 of this chapter based on the death of an employee, separated employee, retiree, or survivor. See 14 CFR 302.24
  • Survivor: means a person receiving a current spouse annuity or a former spouse annuity, or the beneficiary of an insurable interest annuity. See 14 CFR 302.714
  • Suspension: An action by a DoD Component that temporarily withdraws Federal sponsorship under an award, pending corrective action by the recipient or pending a decision to terminate the award by the DoD Component. See 32 CFR 32.2
  • Suspension: means depending on the context, either:

    (1) Temporary withdrawal of the authority to obligate grant funds pending corrective action by the grantee or subgrantee or a decision to terminate the grant, or

    (2) An action taken by a suspending official in accordance with agency regulations implementing E. See 32 CFR 33.3

  • Suspension: An action by a DoD Component that temporarily withdraws Federal sponsorship under an award, pending corrective action by the recipient or pending a decision to terminate the award by the DoD Component. See 32 CFR 34.2
  • System of records: means a group of records under ODNI's control from which information about an individual is retrieved by the name of the individual or by an identifying number, symbol, or other particular assigned to the individual. See 32 CFR 1701.2
  • Systems: A complete remote pickup broadcast facility consisting of one or more mobile stations and/or one or more base stations authorized pursuant to a single license. See 47 CFR 74.401
  • TAC certification: A statement that a TAC submits to BIS, supported by reasonable evidence, documented as in a FAS, that foreign availability to a controlled country exists for an item that falls within the TAC's area of technical expertise. See 41 CFR 102-40.150
  • Target tissue: means the edible tissue selected to monitor for residues in the target animals, including, where appropriate, milk or eggs. See 46 CFR 308.524
  • Tax refund offset: means the reduction of a tax refund by the amount of a past-due legally enforceable debt owed to the Endowment or any other Federal agency. See 45 CFR 1150.1
  • Tax year: The period from July 1 of one calendar year through June 30 of the following calendar year. See 27 CFR 46.92
  • Team leader: Individual in charge of an inspection team responsible for planning, preparing, and performing field inspection of the bridge. See 50 CFR 29.220
  • Team Leader: means the on-site individual in charge of an inspection team responsible for planning, preparing, performing, and reporting on tunnel inspections. See 23 CFR 650.505
  • Technical assistance: Any specific expertise necessary to carry out housing efforts by or for low-income families to improve the quantity and/or quality of housing available to meet their needs. See 25 CFR 166.218
  • Technology transfer: means those activities that lead to the adoption of a new technique or product by users and involves dissemination, demonstration, training, and other activities that lead to eventual innovation. See 49 CFR 1540.1
  • Telecommunications carrier: A telecommunications carrier is any provider of telecommunications services, except that such term does not include aggregators of telecommunications services (as defined in 47 U. See 47 CFR 64.2305
  • Telecommunications service: The term "telecommunications service" has the same meaning given to such term in section 3(46) of the Communications Act of 1934, as amended, 47 U. See 47 CFR 64.2003
  • Telephone exchange service: Telephone exchange service means:

    (1) Service within a telephone exchange, or within a connected system of telephone exchanges within the same exchange area operated to furnish to subscribers intercommunicating service of the character ordinarily furnished by a single exchange, and which is covered by the exchange service charge, or

    (B) Comparable service provided through a system of switches, transmission equipment, or other facilities (or combination thereof) by which a subscriber can originate and terminate a telecommunications service. See 47 CFR 64.2305

  • Telephone number of record: The telephone number associated with the underlying service, not the telephone number supplied as a customer's "contact information. See 47 CFR 64.2003
  • Tenant: Any person who resides in a single- or multi-unit rental property. See 25 CFR 166.408
  • Term Sheet: means a written offer for the issuance of a loan guarantee, executed by the Secretary (or a DOE official authorized by the Secretary to execute such offer), delivered to the offeree, that sets forth the detailed terms and conditions under which DOE and the Applicant will execute a Loan Guarantee Agreement. See 41 CFR 101-28.203
  • Termination: The cancellation of an award, in whole or in part, at any time prior to the date of completion. See 32 CFR 32.2
  • Termination: means permanent withdrawal of the authority to obligate previously-awarded grant funds before that authority would otherwise expire. See 32 CFR 33.3
  • Termination: The cancellation of an award, in whole or in part, under an agreement at any time prior to either:

    (1) The date on which all work under an award is completed. See 32 CFR 34.2

  • Terms: As used in this part:

    Commercial driver's license (CDL) is used as defined in 49 CFR 383. See 49 CFR 1572.400

  • terrestrial cable programming: means video programming which is transmitted terrestrially or by any means other than satellite and which is primarily intended for direct receipt by cable operators for their retransmission to cable subscribers, except that such term does not include satellite broadcast programming or satellite cable programming. See 47 CFR 76.1000
  • terrestrial cable programming vendor: means a person engaged in the production, creation, or wholesale distribution for sale of terrestrial cable programming, but does not include a satellite broadcast programming vendor or a satellite cable programming vendor. See 47 CFR 76.1000
  • Test animals: means the species selected for use in the toxicity tests. See 46 CFR 308.524
  • Testing: refers to the use of an individual or individuals ("testers") who, without a bona fide intent to rent or purchase a house, apartment, or other dwelling, pose as prospective renters or purchasers for the purpose of gathering information that may indicate whether a housing provider is complying with fair housing laws. See 24 CFR 115.100
  • Third party in-kind contributions: The value of non-cash contributions provided by non-Federal third parties. See 32 CFR 34.2
  • Third-Party Financial Transaction Fees: means the exact fees, with no markup, that Providers of Inmate Calling Services are charged by third parties to transfer money or process financial transactions to facilitate a Consumer's ability to make account payments via a third party. See 47 CFR 64.6000
  • This chapter: Title 27, Code of Federal Regulations, Chapter I (27 CFR Chapter I). See 27 CFR 29.45
  • Threat Assessment Fee: means the fee required, in this part, for the cost of TSA adjudicating security threat assessments, appeals, and waivers under 49 CFR part 1572. See 49 CFR 1572.400
  • Threshold assessment: means FDA's review of data and information about a sponsored compound to determine whether chronic bioassays in test animals are necessary to resolve questions concerning the carcinogenicity of the compound. See 46 CFR 308.524
  • Time of retirement: means the effective commencing date for a retired employee's or Member's annuity. See 7 CFR 58.37
  • Timekeeping device: means a device for measuring the time of a dive in minutes. See 46 CFR 197.204
  • Tires: Every motor vehicle shall be equipped with tires of adequate capacity to support its gross weight. See 29 CFR 500.105
  • Tobacco products: Cigars, cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own tobacco. See 27 CFR 46.92
  • Tobacco Products: Cigars, cigarettes, smokeless tobacco, pipe tobacco, and roll-your-own tobacco. See 27 CFR 46.163

  • Transfer in bond: The transfer of spirits between alcohol fuel plants or between a distilled spirits plant qualified under 26 U. See 27 CFR 19.662
  • Treatment: means the provision, coordination, or management of health care and related services by one or more health care providers, including the coordination or management of health care by a health care provider with a third party. See 45 CFR 164.501
  • Tribal entity: means an eligible entity established pursuant to the Indian Reorganization Act. See 27 CFR 24.96
  • Tribal lands: include any federally recognized Indian tribe's reservation, pueblo, or colony, including former reservations in Oklahoma; Alaska Native regions established pursuant to the Alaska Native Claims Settlement Act (85 Stat. See 47 CFR 54.400
  • Tribal Organization: means the recognized governing body of any Indian tribe or any legally established organization of Native Americans which is controlled, sanctioned, or chartered by such governing body. See 41 CFR 101-26.507-4
  • Triggering Event: means an occurrence in connection with a Covered Project that subjects a Controlling Participant to Previous Participation review under this subpart, as further described in §200. See 24 CFR 200.212
  • TRQ: means Tariff Rate Quota. See 25 CFR 39.118
  • TSA agent: means an entity approved by TSA to collect and transmit fingerprints and applicant information, in accordance with 49 CFR part 1572, and fees in accordance with this part. See 49 CFR 1572.400
  • TSA decision maker: means the Administrator, acting in the capacity of the decision maker on appeal, or any person to whom the Administrator has delegated the Administrator's decision-making authority in a civil penalty action. See 49 CFR 1503.103
  • tunnel: means an enclosed roadway for motor vehicle traffic with vehicle access limited to portals, regardless of type of structure or method of construction, that requires, based on the owner's determination, special design considerations that may include lighting, ventilation, fire protection systems, and emergency egress capacity. See 23 CFR 650.505
  • tunnel inspection experience: means active participation in the performance of tunnel inspections in accordance with the National Tunnel Inspection Standards, in either a field inspection, supervisory, or management role. See 23 CFR 650.505
  • tunnel inspection refresher training: means an FHWA-approved training course that aims to improve the quality of tunnel inspections, introduce new techniques, and maintain the consistency of the tunnel inspection program. See 23 CFR 650.505
  • tunnel-specific inspection procedures: means the written documentation of the directions necessary to plan for, and conduct an inspection. See 23 CFR 650.505
  • TWA: means an airborne concentration of one part of benzene per million parts of air (one ppm), as averaged over an eight-hour period. See 46 CFR 197.505
  • Ultimate recipient: means Native American tribe, tribal entity, or member of either that receives a loan from an intermediary lender's HFIL revolving fund. See 27 CFR 24.96
  • Ultimate recipient: The entity receiving financial assistance from the intermediary. See 25 CFR 170.452
  • Umbilical: means the hose bundle between a dive location and a diver or bell, or between a diver and a bell, that supplies the diver or bell with a life-line, breathing gas, communications, power, and heat as appropriate to the diving mode or conditions. See 46 CFR 197.204
  • Unauthorized assistance: Any loan, interest subsidy, grant, or portion thereof received by a recipient for which there was no regulatory authorization or for which the recipient was not eligible. See 25 CFR 170.440
  • Under Secretary: The Under Secretary for Industry and Security, United States Department of Commerce. See 41 CFR 102-40.25
  • Underwater diver bridge inspection training: Training that covers all aspects of underwater bridge inspection and enables inspectors to relate the conditions of underwater bridge elements to established criteria (see the Bridge Inspector's Reference Manual section on underwater inspection for the recommended material to be covered in an underwater diver bridge inspection training course). See 50 CFR 29.220
  • Underwater inspection: Inspection of the underwater portion of a bridge substructure and the surrounding channel, which cannot be inspected visually at low water by wading or probing, generally requiring diving or other appropriate techniques. See 50 CFR 29.220
  • Unearned passenger revenue: means that passenger revenue received for water transportation and all other accommodations, services, and facilities relating thereto not yet performed. See 46 CFR 540.2
  • Unit of General Purpose Local Government: means any city, county, town, parish, village, or other general purpose political subdivision of a State. See 41 CFR 101-26.507-4
  • Unit of measure: means the level (for example, organizational unit or operational loss event type) at which the FDIC-supervised institution's operational risk quantification system generates a separate distribution of potential operational losses. See 32 CFR 202.13
  • United States: includes the Commonwealth of Puerto Rico, the Virgin Islands or any territory or possession of the United States. See 46 CFR 540.2
  • United States: includes the Commonwealth of Puerto Rico, the Virgin Islands or any territory or possession of the United States. See 46 CFR 540.21
  • United States: means the several States, the District of Columbia, the Commonwealth of Puerto Rico, the Virgin Islands, Guam, American Samoa and any territory or possession of the United States of America. See 41 CFR 101-28.203

  • Updated subscriber list information: A directory publisher requests updated subscriber list information when the publisher requests changes to all or any part of a carrier's subscriber list information occurring between specified dates. See 47 CFR 64.2305
  • USDA: means the United States Department of Agriculture. See 27 CFR 19.489
  • Useful and efficient service: means (1) acceptable performance of the critical or essential elements of the position. See 14 CFR 29.1519
  • User: The person or agency at whose request inspection is conducted. See 7 CFR 70.36
  • UWB bandwidth: For the purpose of this subpart, the UWB bandwidth is the frequency band bounded by the points that are 10 dB below the highest radiated emission, as based on the complete transmission system including the antenna. See 47 CFR 15.503
  • Vacancy: means any vacant position to be filled by a competitive service permanent or time-limited appointment. See 12 CFR 220.118
  • Vacancy: means a vacant competitive service position at grade GS-15 (or equivalent) or below to be filled for a total of 121 days or more, including all extensions, regardless of whether the agency issues a specific vacancy announcement. See 12 CFR 221.116
  • Vacancy: means a vacant competitive service position at grade GS-15 (or equivalent) or below to be filled for 121 days or more, including extensions. See 12 CFR 225.104
  • Vacant position: means an unoccupied position of the same grade or pay level and tenure for which the employee is qualified for reassignment that is located in the same commuting area and is serviced by the same appointing authority of the employing agency. See 14 CFR 29.1519
  • valid photo ID: is a government-issued means of personal identification with a photograph such as a driver's license, passport, or comparable ID that is not expired. See 47 CFR 64.2003
  • Very low-income: An adjusted annual income that does not exceed the very low-income limit according to size of household as established by HUD for the county of MSA where the property is located. See 25 CFR 166.408
  • Vessel: means any commercial vessel having berth or stateroom accommodations for 50 or more passengers and embarking passengers at U. See 46 CFR 540.2
  • Vessel: means any waterborne craft including mobile offshore drilling units required to have a Certificate of Inspection issued by the Coast Guard or any waterborne craft connected with a deepwater port or within the deepwater port safety zone, or any waterborne craft engaged in activities related to the Outer Continental Shelf. See 46 CFR 197.204
  • Vessel: means any commercial vessel having berth or stateroom accommodations for 50 or more passengers and embarking passengers at U. See 46 CFR 540.21
  • video programming vendor: means a person engaged in the production, creation, or wholesale distribution of video programming for sale. See 47 CFR 76.1300
  • Visible: means capable of being seen, wehter or not readable, without visual aid by a person of normal visual acuity. See 23 CFR 750.703
  • Voice telephony service: "Voice telephony service" is defined as voice grade access to the public switched network or its functional equivalent. See 47 CFR 54.400
  • Volume tank: means a pressure vessel connected to the outlet of a compressor and used as an air reservoir. See 46 CFR 197.204
  • Voyage: means voyage of a vessel to or from U. See 46 CFR 540.21
  • Waiver: means an annuitant's written request to forfeit a specified amount of annuity as described in this subpart. See 14 CFR 302.722
  • wall: is a concrete structure, the side of a bridge, the wall of a mine or another physical structure that is dense enough and thick enough to absorb the majority of the signal transmitted by the imaging system. See 47 CFR 15.503
  • Wall imaging system: A field disturbance sensor that is designed to detect the location of objects contained within a "wall" or to determine the physical properties within the "wall. See 47 CFR 15.503
  • Wart remover drug product: A topical agent used for the removal of common or plantar warts. See 46 CFR 197.404
  • Weather modification activity: Any activity performed with the intention of producing artificial changes in the composition, behavior, or dynamics of the atmosphere. See 41 CFR 102-72.69
  • Weather modification apparatus: Any apparatus used with the intention of producing artificial changes in the composition, behavior, or dynamics of the atmosphere. See 41 CFR 102-72.69
  • Weatherization Project: means a project conducted in a single geographical area which undertakes to weatherize dwelling units that are energy inefficient. See 41 CFR 101-26.507-4
  • Whole-ship charter: means an arrangement between a passenger vessel operator and a corporate or institutional entity:

    (1) Which provides for the purchase of all the passenger accommodations on a vessel for a particular voyage or series of voyages. See 46 CFR 540.2

  • Wholesale: (i) An FDIC-supervised institution's wholesale obligor is in default if:

    (A) The FDIC-supervised institution determines that the obligor is unlikely to pay its credit obligations to the FDIC-supervised institution in full, without recourse by the FDIC-supervised institution to actions such as realizing collateral (if held). See 32 CFR 202.13

  • Wholesale: (i) A Board-regulated institution's wholesale obligor is in default if:

    (A) The Board-regulated institution determines that the obligor is unlikely to pay its credit obligations to the Board-regulated institution in full, without recourse by the Board-regulated institution to actions such as realizing collateral (if held). See 31 CFR 205.26

  • Wholesale exposure: means a credit exposure to a company, natural person, sovereign, or governmental entity (other than a securitization exposure, retail exposure, pre-sold construction loan, or equity exposure). See 32 CFR 202.13
  • Wholesale exposure: means a credit exposure to a company, natural person, sovereign, or governmental entity (other than a securitization exposure, retail exposure, pre-sold construction loan, or equity exposure). See 31 CFR 205.26
  • Witchweed: Parasitic plants of the genus Striga and reproductive parts thereof, including seeds. See 24 CFR 200.193
  • Work zone impacts: refer to work zone-induced deviations from the normal range of transportation system safety and mobility. See 49 CFR 1572.400
  • Workday: means a calendar day during which construction operations could proceed for a major part of a shift, normally excluding Saturdays, Sundays, and State-recognized legal holidays. See 50 CFR 221.25
