Notwithstanding Alaska Stat. § 11.31.140(d),

(1) a person may not be charged under Alaska Stat. § 11.31.100 if the crime allegedly attempted by the defendant is defined in such a way that an attempt to engage in the proscribed conduct constitutes commission of the crime itself;

Terms Used In Alaska Statutes 11.31.150

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
(2) a person may not be charged under Alaska Stat. § 11.31.110 if the solicitation in question is defined as a specific crime under other provisions of law.
