  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Allegation: something that someone says happened.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appointing authority: means the person or group of persons authorized by law or delegated authority to make appointments to fill positions. See Arizona Laws 41-741
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • At will: means an employment relationship where either party to the relationship may sever the relationship at any time for any reason other than an unlawful reason. See Arizona Laws 41-741
  • Break in service: means a separation from state employment, regardless of the reason for separation. See Arizona Laws 41-741
  • Change in assignment: means movement of an employee to a different position in the same state agency or another state agency. See Arizona Laws 41-741
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Covered employee: means an employee who:

    (a) Before September 29, 2012, is in the state service, is not uncovered pursuant to section 41-742, subsection A and has remained in covered status without a break in service since that date. See Arizona Laws 41-741

  • Covered service: means that employment status conferring rights of appeal as prescribed in sections 41-782 and 41-783 or Section 41-1830. See Arizona Laws 41-741
  • Department: means the department of administration. See Arizona Laws 41-701.01
  • Director: means the director of the department of administration. See Arizona Laws 41-701.01
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Employee: means all officers and employees of this state, whether in covered service or uncovered service, unless otherwise prescribed. See Arizona Laws 41-741
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • Full authority peace officer: means a peace officer whose authority to enforce the laws of this state is not limited by the rules adopted by the Arizona peace officer standards and training board. See Arizona Laws 41-741
  • including: means not limited to and is not a term of exclusion. See Arizona Laws 1-215
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Person: includes a corporation, company, partnership, firm, association or society, as well as a natural person. See Arizona Laws 1-215
  • Probationary period: means a working test period of employment in a covered service position for evaluation of the employee's work. See Arizona Laws 41-741
  • Process: means a citation, writ or summons issued in the course of judicial proceedings. See Arizona Laws 1-215
  • Rules: means rules adopted by the department of administration, human resources division. See Arizona Laws 41-741
  • State agency: means a department, board, office, authority, commission or other governmental budget unit of this state and includes an agency assigned to a department for administrative purposes. See Arizona Laws 41-741
  • State personnel board: means the board established by section 41-781. See Arizona Laws 41-741
  • State personnel system: means all state agencies and employees of those agencies that are not exempted by this article. See Arizona Laws 41-741
  • State service: means all offices and positions of employment in state government that, before September 29, 2012, were subject to the provisions of articles 5 and 6 of this chapter that were in effect before September 29, 2012. See Arizona Laws 41-741
  • Supervisor: means a state employee who has one or more other state employees reporting directly to the person and, for those state employees, typically has the authority to:

    (a) Approve sick or annual leave. See Arizona Laws 41-741

  • Uncovered employee: means an employee in uncovered service. See Arizona Laws 41-741
  • Uncovered service: means employment at will and includes all state employees except those in covered service. See Arizona Laws 41-741
  • United States: includes the District of Columbia and the territories. See Arizona Laws 1-215
