Terms Used In Florida Statutes > Chapter 817

  • Benefit: means gain or advantage, or anything regarded by the person to be benefited as a gain or advantage, including the doing of an act beneficial to any person in whose welfare he or she is interested, including any commission, gift, gratuity, property, commercial interest, or any other thing of economic value not authorized by law. See Florida Statutes 817.706
  • business entity: means any corporation, partnership, limited partnership, company, limited liability company, proprietorship, firm, enterprise, franchise, association, self-employed individual, or trust, whether fictitiously named or not, doing business in this state. See Florida Statutes 817.011
  • Business relationship: means a relationship between two or more individuals or entities where there exists an oral or written contract or agreement for goods or services. See Florida Statutes 774.209
  • Buyer: means any individual who is solicited to purchase, or who purchases, the services of a credit service organization. See Florida Statutes 817.7001
  • Caregiver: includes , but is not limited to, relatives, court-appointed or voluntary guardians, adult household members, neighbors, health care providers, and employees and volunteers of facilities as defined in subsection (6). See Florida Statutes 774.209
  • Caregiver: means a parent, adult household member, or other person responsible for a child's welfare. See Florida Statutes 817.05
  • Child: means any person under the age of 18 years. See Florida Statutes 817.05
  • Credit counseling agency: means any organization providing debt management services or credit counseling services. See Florida Statutes 817.801
  • Credit counseling services: means confidential money management, debt reduction, and financial educational services. See Florida Statutes 817.801
  • Credit service organization: means any person who, with respect to the extension of credit by others, sells, provides, performs, or represents that he or she can or will sell, provide, or perform, in return for the payment of money or other valuable consideration, any of the following services:
  • Creditor contribution: means any sum that a creditor agrees to contribute to a credit counseling agency, whether directly or by setoff against amounts otherwise payable to the creditor on behalf of debtors. See Florida Statutes 817.801
  • Debt management services: means services provided to a debtor by a credit counseling organization for a fee to:
    (a) Effect the adjustment, compromise, or discharge of any unsecured account, note, or other indebtedness of the debtor; or
    (b) Receive from the debtor and disburse to a creditor any money or other thing of value. See Florida Statutes 817.801
  • Disabled adult: means a person 18 years of age or older who suffers from a condition of physical or mental incapacitation due to a developmental disability, organic brain damage, or mental illness, or who has one or more physical or mental limitations that restrict the person's ability to perform the normal activities of daily living. See Florida Statutes 774.209
  • Elderly person: means a person 60 years of age or older who is suffering from the infirmities of aging as manifested by advanced age or organic brain damage, or other physical, mental, or emotional dysfunctioning, to the extent that the ability of the person to provide adequately for the person's own care or protection is impaired. See Florida Statutes 774.209
  • Extension of credit: means the right to defer payment of debt or to incur debt and defer its payment offered or granted primarily for personal, family, or household purposes. See Florida Statutes 817.7001
  • Harm: means pecuniary or other loss, disadvantage, or injury to the person affected. See Florida Statutes 817.706
  • oath: includes affirmations. See Florida Statutes 88.6011
  • person: includes individuals, children, firms, associations, joint adventures, partnerships, estates, trusts, business trusts, syndicates, fiduciaries, corporations, and all other groups or combinations. See Florida Statutes 88.6011
  • Person: means any individual, corporation, partnership, trust, association, or other legal entity. See Florida Statutes 817.801
  • political subdivision: include counties, cities, towns, villages, special tax school districts, special road and bridge districts, bridge districts, and all other districts in this state. See Florida Statutes 88.6011
  • Property: means anything of value and includes:
    (a) Real property, including things growing on, affixed to, and found in land. See Florida Statutes 774.209
  • Public contractor: means , for purposes of ss. See Florida Statutes 817.706
  • Public servant: means :
    (a) Any officer or employee of a governmental entity, including any executive, legislative, or judicial branch officer or employee;
    (b) Any person, except a witness, who acts as a general or special magistrate, receiver, auditor, arbitrator, umpire, referee, consultant, or hearing officer while performing a governmental function; or
    (c) A candidate for election or appointment to any of the officer positions listed in this subsection, or an individual who has been elected to, but has yet to officially assume the responsibilities of, public office. See Florida Statutes 817.706
  • registered mail: include certified mail with return receipt requested. See Florida Statutes 88.6011
  • Services: means anything of value resulting from a person's physical or mental labor or skill, or from the use, possession, or presence of property, and includes:
    (a) Repairs or improvements to property. See Florida Statutes 774.209
  • Value: means value determined according to any of the following:
  • veteran: means a person who served in the active military, naval, or air service and who was discharged or released under honorable conditions only or who later received an upgraded discharge under honorable conditions, notwithstanding any action by the United States Department of Veterans Affairs on individuals discharged or released with other than honorable discharges. See Florida Statutes 88.6011
  • writing: includes handwriting, printing, typewriting, and all other methods and means of forming letters and characters upon paper, stone, wood, or other materials. See Florida Statutes 88.6011
