Terms Used In Idaho Code > Title 18 > Chapter 58 - Public Health and Safety

  • Academy of nutrition and dietetics: means the national organization that credentials dietetics professionals and accredits undergraduate and graduate programs that prepare dietetics professionals. See Idaho Code 54-3502
  • Account: means the Idaho grape growers and wine producers account in the dedicated fund. See Idaho Code 54-3603
  • ACEND: means the accrediting organization of the academy of nutrition and dietetics that is recognized by the United States department of education as the accrediting agency for education programs that prepare dietetics professionals. See Idaho Code 54-3502
  • Administer: means the direct application of a controlled substance whether by injection, inhalation, ingestion, or any other means to the body of a patient or research subject by:
Idaho Code 37-2701
  • Agent: means an authorized person who acts on behalf of or at the direction of a manufacturer, distributor or dispenser. See Idaho Code 37-2701
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Applicant: means a person applying for a license or permit under this chapter. See Idaho Code 54-2903
  • Audiologist: means a natural person who meets the requirements of this chapter, is duly licensed in accordance with this chapter and is engaged in the practice of audiology. See Idaho Code 54-2903
  • Available: means physically present at the time and place indicated or that the person could be physically present at the time and place indicated if a specific request was made. See Idaho Code 54-3102
  • Bachelor social worker: means an individual who is licensed under this chapter and may be designated as a licensed bachelor social worker (LBSW). See Idaho Code 54-3202
  • Backflow assembly tester: means a person who tests backflow prevention assemblies and who holds a current Idaho backflow assembly tester license. See Idaho Code 54-2403
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the state board of drinking water and wastewater professionals as provided in section 54-2404, Idaho Code. See Idaho Code 54-2403
  • Board: means the state board of pharmacy created in chapter 17, title 54, Idaho Code, or its successor agency. See Idaho Code 37-2701
  • board: as used in this chapter shall mean the state board of registration for professional geologists, hereinafter provided by this chapter. See Idaho Code 54-2802
  • Board: means the speech, hearing and communication services licensure board. See Idaho Code 54-2903
  • Board: means the board of architects and landscape architects. See Idaho Code 54-3002
  • Board: means the state certified shorthand reporters board. See Idaho Code 54-3102
  • Board: means the state board of social work examiners hereinafter provided in this chapter. See Idaho Code 54-3202
  • Board: means the state board of denturitry. See Idaho Code 54-3303
  • Board: means the Idaho state licensing board of professional counselors and marriage and family therapists. See Idaho Code 54-3401
  • Board: means the Idaho state board of medicine. See Idaho Code 54-3502
  • Bureau: means the drug enforcement administration, United States department of justice, or its successor agency. See Idaho Code 37-2701
  • CDR: means the credentialing organization of the academy of nutrition and dietetics that awards and administers credentials to individuals at entry, specialist and advanced levels who have met CDR’s specified criteria to practice in the dietetics profession, including successful completion of its national accredited certification examination and recertification by continuing professional education and/or examination. See Idaho Code 54-3502
  • Certified: means the board has confirmed that an applicant has met all the requirements for licensure under this chapter and has approved the issuance of a license to practice in Idaho under the provisions of this chapter. See Idaho Code 54-2403
  • Chambers: A judge's office.
  • Clinical social worker: means an individual who is licensed under this chapter and may be designated as a licensed clinical social worker (LCSW). See Idaho Code 54-3202
  • Collection system: means that portion of the wastewater system in which wastewater is received from the premises of the discharger and conveyed to the point of treatment through a series of lines, pipes, manholes, pumps/liftstations and other appurtenances. See Idaho Code 54-2403
  • Commission: means the Idaho grape growers and wine producers commission. See Idaho Code 54-3603
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Contract: A legal written agreement that becomes binding when signed.
  • Controlled substance: means a drug, substance or immediate precursor in schedules I through VI of article II of this chapter. See Idaho Code 37-2701
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Denture: means any removable full upper or lower prosthetic dental appliance to be worn in the human mouth. See Idaho Code 54-3303
  • Denturist: means a person licensed under this chapter to engage in the practice of denturitry. See Idaho Code 54-3303
  • Department: means the department of self-governing agencies. See Idaho Code 54-2903
  • Department: means the department of self-governing agencies of the state of Idaho. See Idaho Code 54-3002
  • Department: means the department of self-governing agencies of the state of Idaho. See Idaho Code 54-3401
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Dietetics: means the integration, application and communication of principles derived from food, nutrition, social, business and basic sciences to achieve and maintain optimal nutrition status of individuals through the development, provision and management of effective food and nutrition services in a variety of settings. See Idaho Code 54-3502
  • Dietitian: means a person licensed under the provisions of this chapter as a licensed dietitian (LD) who:

  • Dispense: means to deliver a controlled substance to an ultimate user or research subject by or pursuant to the lawful order of a practitioner, including the packaging, labeling, or compounding necessary to prepare the substance for that delivery. See Idaho Code 37-2701
  • Distribute: means to deliver other than by administering or dispensing a controlled substance. See Idaho Code 37-2701
  • Distribution system: means that portion of the water utility in which water is stored and conveyed from the water treatment plant or other supply point to the premises of a consumer. See Idaho Code 54-2403
  • Division: means the division of occupational and professional licenses. See Idaho Code 54-2403
  • Division: means the Idaho division of occupational and professional licenses. See Idaho Code 37-2701
  • Division: means the division of occupational and professional licenses. See Idaho Code 54-2903
  • Division administrator: means the chief administrative officer of the division of occupational and professional licenses. See Idaho Code 54-3401
  • Drinking water operator: means any person who operates public drinking water systems, water treatment plants or other systems in order to treat water so that it is safe to drink and who holds a current Idaho water system operator license. See Idaho Code 54-2403
  • Drug: means : (1) substances recognized as drugs in the official United States Pharmacopoeia, official Homeopathic Pharmacopoeia of the United States, or official National Formulary, or any supplement to any of them; (2) substances intended for use in the diagnosis, cure, mitigation, treatment or prevention of disease in man or animals; (3) substances, other than food, intended to affect the structure or any function of the body of man or animals; and (4) substances intended for use as a component of any article specified in clause (1), (2), or (3) of this subsection. See Idaho Code 37-2701
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • experience under supervision: means a face-to-face process by which an approved supervisor facilitates the professional growth of a supervisee and monitors the supervisee’s clinical performance. See Idaho Code 54-3401
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fraud: Intentional deception resulting in injury to another.
  • geology: is a fundamental science dealing with the physical earth, the organisms, materials and structures composing the earth, the physical forces affecting the earth, and the utilization of the knowledge of the earth and its constituent rocks, minerals, liquids, gases and other materials insofar as these factors may influence the safety and public welfare. See Idaho Code 54-2802
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grower: means any person who owns, operates or plants a native vineyard of four (4) or more acres. See Idaho Code 54-3603
  • Hearing aid: means any wearable electronic instrument or other device designed for the purpose of aiding or compensating for a loss of human hearing and any parts, attachments or accessories, including earmolds attached to the hearing aid, but excluding batteries and cords. See Idaho Code 54-2903
  • Hearing aid dealer and fitter: means a person licensed pursuant to this chapter to provide hearing aid evaluations and to sell, dispense and fit hearing aids in the state of Idaho. See Idaho Code 54-2903
  • Idaho grape product: means juices, raisins, wines and other grape by-products produced in Idaho and grapes grown in Idaho for the production of juices, raisins, wines and other grape by-products. See Idaho Code 54-3603
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Isomer: means the optical isomer, except as used in section 37-2705(d), Idaho Code. See Idaho Code 37-2701
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Jurisprudence: The study of law and the structure of the legal system.
  • Laboratory analyst: means any person responsible for conducting laboratory analysis tasks in the laboratory of a wastewater system. See Idaho Code 54-2403
  • Landscape architect: means a person who holds a license to practice landscape architecture in the state of Idaho under the authority of this chapter. See Idaho Code 54-3002
  • Landscape architect-in-training: means a person who has met the qualifications of section 54-3003(2)(a) and (b), Idaho Code, and is working under the supervision of a licensed landscape architect. See Idaho Code 54-3002
  • Landscape architecture: means the performance of professional services such as consultations, investigation, reconnaissance, research, planning, design or responsible supervision in connection with the development of land and incidental water areas where, and to the extent that the dominant purpose of such services is the preservation, enhancement or determination of proper land uses, natural land features, ground cover and planting, naturalistic and aesthetic values, approaches to buildings, structures, facilities or other improvements, natural drainage and the consideration and determination of inherent problems of the land relating to erosion, wear and tear, light or other hazards, but shall not include the application of geological principles. See Idaho Code 54-3002
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a physical document issued by the division certifying that an individual has met the appropriate qualifications and has been granted the authority to practice in Idaho under the provisions of this chapter. See Idaho Code 54-2403
  • License: means a license issued by the board under this chapter. See Idaho Code 54-2903
  • Licensed associate marriage and family therapist: means any person licensed under this chapter as an associate marriage and family therapist to practice marriage and family therapy under supervision as set forth in this chapter. See Idaho Code 54-3401
  • Licensed clinical professional counselor: means any person licensed under this chapter as a licensed clinical professional counselor to practice clinical professional counseling as set forth in this chapter. See Idaho Code 54-3401
  • Licensed marriage and family therapist: means any person licensed under this chapter to practice marriage and family therapy as defined in this chapter. See Idaho Code 54-3401
  • Licensed professional counselor: means any person licensed under this chapter to practice professional counseling as defined in this chapter. See Idaho Code 54-3401
  • Licensure board: means the dietetic licensure board established by this chapter. See Idaho Code 54-3502
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Manufacture: means the production, preparation, propagation, compounding, conversion or processing of a controlled substance, and includes extraction, directly or indirectly, from substances of natural origin, or independently by means of chemical synthesis, or by a combination of extraction and chemical synthesis, and includes any packaging or repackaging of the substance or labeling or relabeling of its container, except that this term does not include the preparation or compounding of a controlled substance:

  • Marriage and family therapy: means the evaluation and treatment of mental and emotional disorders, whether cognitive, affective or behavioral, within the context of marriage and family systems. See Idaho Code 54-3401
  • Master social worker: means an individual who is licensed under this chapter and may be designated as a licensed master social worker (LMSW). See Idaho Code 54-3202
  • MNT: means an evidence-based application of the nutrition care process. See Idaho Code 54-3502
  • Month: means a calendar month, unless otherwise expressed. See Idaho Code 73-114
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Native vineyard: means acreages planted in vinifera and/or other grapes cultivated primarily for the purpose of vinification. See Idaho Code 54-3603
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nutrition care process: means a systematic approach to providing high-quality nutrition care that consists of four (4) distinct, interrelated steps:

  • Oath: A promise to tell the truth.
  • Official court reporter: means the official court reporter of a federal district court in the state or the district court reporter of any state district court, but does not include any reporter of the magistrates division of any state district court. See Idaho Code 54-3102
  • operating personnel: means any person who is employed, retained, or appointed to conduct the tasks associated with the day to day operation and maintenance of a public drinking water system or a public wastewater system. See Idaho Code 54-2403
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: includes a corporation as well as a natural person;

  • Person: means individual, corporation, government, or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Idaho Code 37-2701
  • Person: means any partnership, association, corporation, cooperative or other business unit or device. See Idaho Code 54-3603
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Practice of audiology: means to apply the principles, methods and procedures of measurement, evaluation, testing, counseling, consultation and instruction that relate to the development and disorders of hearing, vestibular functions and related language and speech disorders to prevent, modify or rehabilitate the disorders or to assist individuals in auditory and related skills for communication, and may include intraoperative monitoring and the fitting, adjustment, programming, selling and dispensing of hearing aids and assistive devices.   • Practice of denturitry: means :

  • Practice of marriage and family therapy: means the rendering of professional marriage and family therapy services to individuals, couples and families, singly or in groups, whether such services are offered directly to the general public or through organizations, either public or private. See Idaho Code 54-3401
  • Practice of professional counseling: means the application of mental health, psychological, and human development principles in order to facilitate human development and adjustment throughout the life span; prevent, assess, and treat mental, emotional or behavioral disorders and associated distresses which interfere with mental health; conduct assessments for the purpose of establishing treatment goals and objectives; and plan, implement and evaluate treatment plans using counseling treatment interventions. See Idaho Code 54-3401
  • Practice of sign language interpreting: means the application of the process of providing effective communication between and among persons who are deaf, hard of hearing or deaf-blind, speech impaired and those who can hear. See Idaho Code 54-2903
  • Practice of speech-language pathology: means the application of principles, methods and procedures of measurement, evaluation, testing, counseling, rehabilitation, screening, consultation and instruction that relate to the development and disorders of human communication including, but not limited to, speech (articulation, fluency, voice, accent reduction) and language, swallowing, cognitive communication disorders, augmentative and alternative communication systems and related hearing disorders. See Idaho Code 54-2903
  • Practitioner: means :
  • Idaho Code 37-2701
  • Prescribe: means a direction or authorization permitting an ultimate user to lawfully obtain or be administered controlled substances. See Idaho Code 37-2701
  • Prescriber: means an individual currently licensed, registered or otherwise authorized to prescribe and administer controlled substances in the course of professional practice. See Idaho Code 37-2701
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Producer: means any person who owns, operates or conducts a bonded winery within this state where at least five hundred (500) cases of wine per year are vinified in whole or in part for sale. See Idaho Code 54-3603
  • professional geologist: as used in this chapter , shall mean a person who has been duly registered by the state board of registration for professional geologists. See Idaho Code 54-2802
  • Property: includes both real and personal property. See Idaho Code 73-114
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provisional permit: means a permit issued to an applicant who is registered to obtain required experience to become licensed. See Idaho Code 54-2903
  • Provisionally licensed dietitian: means a person provisionally licensed under the provisions of this chapter. See Idaho Code 54-3502
  • Public: means any person, firm, corporation, partnership, company, government agency, institution or any other entity recognized by law. See Idaho Code 54-3002
  • Quorum: The number of legislators that must be present to do business.
  • Registered mail: includes certified mail. See Idaho Code 73-114
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Responsible charge: means active, daily, on-site, or on call responsibility, for the performance of operations or active, ongoing, on-site and on call direction of employees and assistants at a public drinking water system or a public wastewater system. See Idaho Code 54-2403
  • Responsible charge operator: means an operator of a public drinking water system, designated by the system owner, who holds a valid certificate at a class equal to or greater than the drinking water system classification, who is in responsible charge of the public drinking water system. See Idaho Code 54-2403
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Rules of professional responsibility: means those rules, if any, promulgated by the board. See Idaho Code 54-3002
  • seal: includes an impression of such seal upon the paper, alone, as well as upon wax or a wafer affixed thereto; or, alternatively, the seal may be the mark of a rubber stamp providing substantially the same information as the impression. See Idaho Code 73-111
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Shorthand reporting: means the making of written symbols or abbreviations in shorthand or machine shorthand writing of a verbatim record of any oral court proceedings, deposition, or proceedings before any grand jury, referee, or court commissioner, contemporaneous with the event. See Idaho Code 54-3102
  • Sign language interpreter: means a natural person who meets the requirements of this chapter, is duly licensed in accordance with this chapter, and who engages in the practice of sign language interpreting. See Idaho Code 54-2903
  • Speech-language pathologist: means a natural person who meets the requirements of this chapter, is duly licensed in accordance with this chapter, and who engages in the practice of speech-language pathology. See Idaho Code 54-2903
  • Speech-language pathologist aide: means a natural person who meets the requirements of this chapter, is duly licensed in accordance with this chapter, and who works under the direction and supervision of a speech-language pathologist. See Idaho Code 54-2903
  • Speech-language pathologist assistant: means a natural person who meets the requirements of this chapter, is duly licensed in accordance with this chapter, and works under the direction and supervision of a speech-language pathologist. See Idaho Code 54-2903
  • State: when applied to the different parts of the United States, includes the District of Columbia and the territories; and the words "United States" may include the District of Columbia and territories. See Idaho Code 73-114
  • State: when applied to a part of the United States, includes any state, district, commonwealth, territory, insular possession thereof, and any area subject to the legal authority of the United States of America. See Idaho Code 37-2701
  • Statute: A law passed by a legislature.
  • Subpoena: A command to a witness to appear and give testimony.
  • Subpoena duces tecum: A command to a witness to produce documents.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Ultimate user: means a person who lawfully possesses a controlled substance for his own use or for the use of a member of his household or for administering to an animal owned by him or by a member of his household. See Idaho Code 37-2701
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Wastewater operator: means a person who operates public wastewater systems, or public wastewater treatment plants or other systems, in order to remove harmful pollutants from domestic and industrial liquid waste so that it is safe to return to the environment, and who holds a current Idaho wastewater system operator license. See Idaho Code 54-2403
  • Winery: means a place, premises and/or establishment within the state of Idaho for the manufacture and/or bottling of wine for sale. See Idaho Code 54-3603
