Terms Used In Idaho Code > Title 67

  • Abandoned: means the failure of the parent to maintain a normal parental relationship with his child including, but not limited to, reasonable support or regular personal contact. See Idaho Code 30-21-414
  • Abused: means any case in which a child has been the victim of:

  • Account: means an arrangement under a terms of service agreement in which a custodian carries, maintains, processes, receives or stores a digital asset of the user or provides goods or services to the user. See Idaho Code 15-14-102
  • Acquisition: means the process of procuring property. See Idaho Code 67-9203
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Act: means the Idaho uniform business organizations code. See Idaho Code 30-21-102
  • Adaptive equipment: means any piece of equipment or any item that is used to increase, maintain, or improve the parenting capabilities of a parent with a disability. See Idaho Code 30-21-213
  • Adaptive equipment: means any piece of equipment or any item that is used to increase, maintain or improve the parenting capabilities of a parent with a disability. See Idaho Code 30-21-414
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • Adjournment sine die: The end of a legislative session "without day." These adjournments are used to indicate the final adjournment of an annual or the two-year session of legislature.
  • Adjudicatory hearing: means a hearing to determine:

  • Administration of criminal justice: means performance of any of the following activities: detection, apprehension, detention, pretrial release, posttrial release, prosecution, adjudication, correctional supervision, or rehabilitation of accused persons or criminal offenders.   • Administrative costs: means personnel costs, capital outlay, and reasonable expenses incurred by other state agencies to effectuate the purposes of this chapter. See Idaho Code 67-7404
  • Administrator: means the administrator of the division of purchasing as created by section 67-9204, Idaho Code. See Idaho Code 67-9203
  • Administrator: means the director of the Idaho department of finance or his designee. See Idaho Code 30-14-102
  • Administrator: means the administrator of the division of human resources in the governor’s office. See Idaho Code 67-5302
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Advisory commission: means the housing trust fund advisory commission established in section 67-8106, Idaho Code. See Idaho Code 67-8102
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Affordable housing: means housing affordable to families whose incomes do not exceed eighty percent (80%) of the median income for the service area or areas within the jurisdiction of the governmental entity. See Idaho Code 67-8203
  • Agency: means all officers, departments, divisions, bureaus, boards, commissions and institutions of the state, including the public utilities commission, but excluding:

  • Agent: means an attorney in fact granted authority under a durable or nondurable power of attorney. See Idaho Code 15-14-102
  • Agent: means an individual, other than a broker-dealer, who represents a broker-dealer in effecting or attempting to effect purchases or sales of securities or who represents an issuer in effecting or attempting to effect purchases or sales of the issuer's securities. See Idaho Code 30-14-102
  • Aggravated circumstances: includes , but is not limited to:
  • Idaho Code 30-21-414
  • Allocation plan: means the plan, approved and revised annually by the advisory commission, providing for the method and priorities of allocation of housing trust fund moneys and providing the procedures for loan and grant application for housing trust fund moneys. See Idaho Code 67-8102
  • Amortization: Paying off a loan by regular installments.
  • Annual report: means the report required by section 30-21-213, Idaho Code. See Idaho Code 30-21-102
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appointing authority: means the officer, board, commission, person or group of persons authorized by statute or lawfully delegated authority to make appointments to or employ personnel in any department. See Idaho Code 67-5302
  • Appraisal: A determination of property value.
  • Appropriate: means to legally obligate by contract or otherwise commit to use by appropriation or other official act of a governmental entity. See Idaho Code 67-8203
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Association: means the Idaho housing and finance association. See Idaho Code 67-8102
  • Assumed business name: means :

  • Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means the Idaho energy resources authority created pursuant to section 67-8904, Idaho Code. See Idaho Code 67-8903
  • Authority: means the Idaho state building authority created and established pursuant to section 67-6403, Idaho Code. See Idaho Code 67-6402
  • Authorized agency: means the department, a local agency, a person, an organization, corporation, benevolent society or association licensed or approved by the department or the court to receive children for control, care, maintenance or placement. See Idaho Code 30-21-414
  • Balanced budget: A budget in which receipts equal outlays.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Bequest: Property gifted by will.
  • Bid: means a written offer to perform a contract to sell or otherwise supply property in response to a solicitation. See Idaho Code 67-9203
  • Bidder: means a vendor who has submitted a bid on property to be acquired by the state. See Idaho Code 67-9203
  • Bingo: means the traditional game of chance played for a prize determined prior to the start of the game. See Idaho Code 67-7702
  • Bingo-raffle advisory board: means a board of six (6) persons chosen by the governor to make advisory recommendations regarding bingo and raffle operations and regulation in Idaho. See Idaho Code 67-7702
  • Board: means the board of directors of the authority. See Idaho Code 67-8903
  • Board: means the board of trustees of the Idaho state historical society. See Idaho Code 67-4112
  • board: as used in this chapter shall mean the board of directors of a district. See Idaho Code 67-4902
  • bond bank authority: means the Idaho bond bank authority. See Idaho Code 67-8702
  • Bonds: means bonds, notes or other obligations of the authority issued under this chapter. See Idaho Code 67-8702
  • Bonds: means any bonds, notes, certificates or other obligations or evidences of indebtedness issued by the authority. See Idaho Code 67-8903
  • Broker-dealer: means a person engaged in the business of effecting transactions in securities for the account of others or for the person's own account. See Idaho Code 30-14-102
  • Bureau: means the bureau of criminal identification in the Idaho state police. See Idaho Code 67-3001
  • Business corporation: means a domestic business corporation incorporated under or subject to chapter 29, title 30, Idaho Code, or a foreign business corporation. See Idaho Code 30-21-102
  • Candidate: means an individual who has taken affirmative action to seek nomination or election to public office. See Idaho Code 67-6602
  • Capital improvements: means improvements with a useful life of ten (10) years or more, by new construction or other action, which increase the service capacity of a public facility. See Idaho Code 67-8203
  • Capital improvements plan: means a plan adopted pursuant to this chapter that identifies capital improvements for which development impact fees may be used as a funding source. See Idaho Code 67-8203
  • Case plan hearing: means a hearing to approve, modify or reject the case plan as provided in section 16-1621, Idaho Code. See Idaho Code 30-21-414
  • Catalog of electronic communications: means information that identifies each person with which a user has had an electronic communication, the time and date of the communication and the electronic address of the person. See Idaho Code 15-14-102
  • Certification: means a written or electronic assertion that a statement or report is true or as represented. See Idaho Code 67-1001A
  • Charitable organization: means an organization that has been in continuous existence in the county of operation of the charitable bingo game or raffle for at least one (1) year, that conducts charitable activities, and that is exempt from taxation under section 501(c)(3), 501(c)(4), 501(c)(6), 501(c)(8), 501(c)(10), 501(c)(19) or 501(d) of the Internal Revenue Code and is exempt from income taxation under title 63, Idaho Code, as a bona fide nonprofit charitable, civic, religious, fraternal, patriotic or veterans organization or as a nonprofit volunteer fire department, or as a nonprofit volunteer rescue squad, or as a nonprofit volunteer educational booster group, parent-teacher organization or association.   • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Child: means an individual who is under the age of eighteen (18) years. See Idaho Code 30-21-414
  • Circumstances of the child: includes , but is not limited to, the joint legal custody or joint physical custody of the child. See Idaho Code 30-21-414
  • Class: means a group of positions sufficiently similar as to the duties performed, degree of supervision exercised or required, minimum requirements of training, experience or skill, and other characteristics that the same title, the same tests of fitness and the same schedule of compensation may be applied to each position in the group. See Idaho Code 67-5302
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself.
  • Commercial registered agent: means a person listed under section 30-21-405, Idaho Code. See Idaho Code 30-21-102
  • Commission: means the Idaho state lottery commission. See Idaho Code 67-7404
  • Commission: means the Idaho state lottery commission as defined in section 67-7404, Idaho Code. See Idaho Code 67-7702
  • Commission: means the Idaho public utilities commission created pursuant to section 61-201, Idaho Code. See Idaho Code 67-8903
  • Commission: means the Idaho personnel commission. See Idaho Code 67-5302
  • Commission: means the commission on human rights created by this chapter;
  • Idaho Code 67-5902
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community: means a group of people linked by common policy, common social interests and interaction with one another. See Idaho Code 67-9003
  • Community college district: means any community college district organized and existing under chapter 21, title 33, Idaho Code. See Idaho Code 67-6402
  • Compensation: includes any advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge or transfer of money or anything of value, and any contract, agreement, promise or other obligation, whether or not legally enforceable, to do any of the foregoing, for services rendered or to be rendered, but does not include reimbursement of expenses if such reimbursement does not exceed the amount actually expended for such expenses and is substantiated by an itemization of such expenses.   • Compensatory time: means approved time off from duty provided in compensation for overtime hours worked. See Idaho Code 67-5302
  • Computer worker: means any person, nonclassified or classified, appointed to a position that meets the criteria set forth in the federal fair labor standards act, 29 U. See Idaho Code 67-5302
  • Concurrent planning: means a planning model that prepares for and implements different outcomes at the same time. See Idaho Code 30-21-414
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Conservator: means a person appointed by a court to manage the estate of a living individual. See Idaho Code 15-14-102
  • Content of an electronic communication: means information concerning the substance or meaning of the communication that:

  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: means an agreement for the acquisition of property, including a purchase order. See Idaho Code 67-9203
  • Contractor: means a vendor who has been awarded a contract. See Idaho Code 67-9203
  • Contribution: includes any advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge, subscription or transfer of money or anything of value, and any contract, agreement, promise or other obligation, whether or not legally enforceable, to make a contribution, in support of or in opposition to any candidate, political committee or measure. See Idaho Code 67-6602
  • Council: means the Idaho state council for the deaf and hard of hearing. See Idaho Code 67-7302
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Court: means district court or magistrate’s division thereof, or if the context requires, a magistrate or judge thereof. See Idaho Code 30-21-414
  • Court: means the court in this state having jurisdiction in matters relating to the content of this chapter. See Idaho Code 15-14-102
  • Court: means any court created by the constitution and laws of the state of Idaho; and clerks of the district court. See Idaho Code 67-3001
  • Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request.
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Criminal history records: means physical and automated information on individuals collected and maintained by the Idaho state police as a result of arrest or the initiation of a criminal proceeding by felony summons or information. See Idaho Code 67-3001
  • Criminal justice agency: means a governmental agency or subdivision of a government entity that performs the administration of criminal justice pursuant to a statute, and that allocates a substantial portion of its budget to the administration of criminal justice. See Idaho Code 67-3001
  • Custodian: means a person, other than a parent or legal guardian, to whom legal or joint legal custody of the child has been given by court order. See Idaho Code 30-21-414
  • Custodian: means a person that carries, maintains, processes, receives or stores a digital asset of a user. See Idaho Code 15-14-102
  • Deaf: includes several kinds of deafness: prelingually deaf, postlingually deaf and deafened as defined by the Gallaudet university study on hearing loss. See Idaho Code 67-7302
  • Decedent: A deceased person.
  • Decision maker: means a person authorized to act for an individual under a substitute decision-making document, whether denominated a decision maker, agent, attorney in fact, proxy, representative or by another title. See Idaho Code 15-15-102
  • Defaulter: means one who misappropriates public funds held by him in any official or fiduciary capacity; or fails to provide an accounting as specified by the state controller for such funds. See Idaho Code 67-1001A
  • Department: means the department of health and welfare and its authorized representatives. See Idaho Code 30-21-414
  • Department: means the Idaho state police. See Idaho Code 67-3001
  • Department: means any department, agency, institution or office of the state of Idaho. See Idaho Code 67-5302
  • Depository institution: means :

  • Designated recipient: means a person chosen by a user using an online tool to administer digital assets of the user. See Idaho Code 15-14-102
  • Developer: means any person or legal entity undertaking development, including a party that undertakes the subdivision of property pursuant to sections 50-1301 through 50-1334, Idaho Code. See Idaho Code 67-8203
  • Development: means any construction or installation of a building or structure, or any change in use of a building or structure, or any change in the use, character or appearance of land, which creates additional demand and need for public facilities or the subdivision of property that would permit any change in the use, character or appearance of land.   • Development approval: means any written authorization from a governmental entity which authorizes the commencement of a development. See Idaho Code 67-8203
  • Development impact fee: means a payment of money imposed as a condition of development approval to pay for a proportionate share of the cost of system improvements needed to serve development. See Idaho Code 67-8203
  • device: means any equipment for installation on board a vessel which is designed to receive, retain, treat, or discharge sewage, and any process to treat such sewage. See Idaho Code 67-7503
  • Devise: To gift property by will.
  • Digital asset: means an electronic record in which an individual has a right or interest. See Idaho Code 15-14-102
  • Director: means the director of the lottery. See Idaho Code 67-7404
  • Director: means the executive director of the Idaho housing and finance association. See Idaho Code 67-8102
  • Director: means the director of the department of administration as created by section 67-5701, Idaho Code. See Idaho Code 67-9203
  • Director: means the director of the Idaho state police. See Idaho Code 67-3001
  • Disability: means , with respect to an individual, any mental or physical impairment which substantially limits one (1) or more major life activities of the individual including, but not limited to, self-care, manual tasks, walking, seeing, hearing, speaking, learning or working or a record of such an impairment, or being regarded as having such an impairment.   • Disposition: means the formal or informal conclusion of a criminal proceeding at whatever stage it occurs in the criminal justice system. See Idaho Code 67-3001
  • Docket: A log containing brief entries of court proceedings.
  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Duck race: means a charitable raffle played by releasing numbered, inanimate toys (ducks) into a body of moving water. See Idaho Code 67-7702
  • Educational institution: means a public or private institution and includes an academy, college, elementary or secondary school, extension course, kindergarten, nursery, school system, or university and a business, nursing, professional, secretarial, technical, or vocational school and includes an agent of an educational institution;

  • Electioneering communication: means any communication broadcast by television or radio, printed in a newspaper or on a billboard, directly mailed or delivered by hand to personal residences, or telephone calls made to personal residences, or otherwise distributed that:

  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic or similar capabilities. See Idaho Code 15-14-102
  • Electronic bingo device: means an electronic device used by a bingo player to monitor bingo cards purchased at the time and place of a licensed organization’s bingo session and that:

  • Electronic communication: has the meaning set forth in 18 U. See Idaho Code 15-14-102
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Eligible: means a person who has been determined to be qualified for a classified position and whose name has been placed on the register of eligibles. See Idaho Code 67-5302
  • Employer: means a person, wherever situated, who hires five (5) or more employees for each working day in each of twenty (20) or more calendar weeks in the current or preceding calendar year whose services are to be partially or wholly performed in the state of Idaho, except for domestic servants hired to work in and about the person’s household.   • Employment agency: means a person regularly undertaking with or without compensation to procure employees for an employer or to procure for employees opportunities to work for an employer and includes an agent of such a person;

  • EMS: means emergency medical services; and

  • EMS provider: means an emergency medical services provider certified by the department of health and welfare pursuant to sections 56-1011 through 56-1018B, Idaho Code, and an ambulance-based clinician as defined in the rules governing emergency medical services as adopted by the department of health and welfare.   • Enforcement officer: means all persons designated as peace officers and authorized special deputies under Idaho law. See Idaho Code 67-7503
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity filing: means a record delivered to the secretary of state for filing pursuant to this act. See Idaho Code 30-21-102
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Ex officio: Literally, by virtue of one's office.
  • Examine: means open to inspection; to review or evaluate the books, papers, accounts, bills, vouchers, other documents of state funds and property, or accounts or financial records of all state agencies and entities receiving state funds in accordance with generally accepted accounting practices.   • Executive official: means :

  • Expenditure: includes any payment, contribution, subscription, distribution, loan, advance, deposit, or gift of money or anything of value, and includes a contract, promise, or agreement, whether or not legally enforceable, to make an expenditure. See Idaho Code 67-6602
  • Expenses: means all costs of doing business including, but not limited to, prizes, commissions and other compensation paid to retailers, advertising and marketing costs, personnel costs, capital outlay, reasonable expenses incurred by other state agencies to effectuate the purposes of this chapter, depreciation of property and equipment, and other operating costs, all of which are to be recorded on the accrual basis of accounting in accordance with generally accepted accounting principles.   • expressly advocating: means any communication containing a message advocating election, passage or defeat including, but not limited to, the name of the candidate or measure, or expression such as "vote for" "elect" "support" "cast your ballot for" "vote against" "defeat" or "reject. See Idaho Code 67-6602
  • Extraordinary costs: means those costs incurred as a result of an extraordinary impact. See Idaho Code 67-8203
  • Extraordinary impact: means an impact which is reasonably determined by the governmental entity to: (i) result in the need for system improvements, the cost of which will significantly exceed the sum of the development impact fees to be generated from the project or the sum agreed to be paid pursuant to a development agreement as allowed by section 67-8214(2), Idaho Code, or (ii) result in the need for system improvements which are not identified in the capital improvements plan.   • face: means an electronic facsimile of a bingo card or face, from a permutation of bingo cards formulated by a manufacturer licensed in Idaho, which is stored and/or displayed in a bingo card-monitoring device. See Idaho Code 67-7702
  • Facility: means any facility necessary, used or useful in connection with the generation, transmission or distribution of electric power and energy and any renewable energy generation project, in each case including, but not limited to, all real and personal property, fuel supplies and transportation facilities, pollution control facilities, and all equipment and improvements necessary or desirable in connection with a facility. See Idaho Code 67-8903
  • Facility: means any work or undertaking, whether new construction or rehabilitation, which is designed and financed pursuant to the provisions of this act and designed for use as an office building, laboratory, library, dining room, instructional facility, motor vehicle parking, storage or service facility or for any other use by any state body or community college district and all other real or personal properties which are necessary, convenient, or desirable appurtenances, such as but not limited to streets, sewers, utilities, parks, site preparation, landscaping, and such equipment which may be necessary to constitute a fully equipped and modern building as the authority determines to be necessary or convenient to accomplish the purposes of this act.   • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Fee payer: means that person who pays or is required to pay a development impact fee. See Idaho Code 67-8203
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiduciary: means an original, additional or successor personal representative, conservator, agent or trustee. See Idaho Code 15-14-102
  • Fiduciary: A trustee, executor, or administrator.
  • Filed record: means a record filed by the secretary of state pursuant to this act. See Idaho Code 30-21-102
  • Filing: means the receipt under this chapter of a record by the administrator or a designee of the administrator. See Idaho Code 30-14-102
  • Filing entity: means an entity whose formation requires the filing of a public organic record. See Idaho Code 30-21-102
  • Financial statement: means a quantitative report summarizing the financial position of an entity as of a particular date and the operating results of that entity for a particular period. See Idaho Code 67-1001A
  • Fingerprints: means the fingerprint impressions submitted to and compiled by the bureau, in a manual or automated form, pursuant to section 67-3004, Idaho Code. See Idaho Code 67-3001
  • Floor leaders: The Majority Leader and Minority Leader are elected by their respective party conferences to serve as the chief Senate spokesmen for their parties and to manage and schedule the legislative and executive business of the Senate. By custom, the Presiding Officer gives the floor leaders priority in obtaining recognition to speak on the floor of the Senate.
  • Food service facilities: includes restaurants, cafeterias, snack bars, and goods and services customarily offered in connection with any of the foregoing, and also includes vending machines dispensing foods when operated independently or in conjunction with such facilities.   • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Foster care: means twenty-four (24) hour substitute parental care for children placed away from their parents or guardians by persons who may or may not be related to the children and for whom the state agency has placement and care responsibility. See Idaho Code 30-21-414

  • Fraud: Intentional deception resulting in injury to another.
  • Full-time employee: means any employee working a forty (40) hour workweek. See Idaho Code 67-5302
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good faith: means honesty in fact. See Idaho Code 15-15-102
  • Governmental entity: means any unit of local government that is empowered in this enabling legislation to adopt a development impact fee ordinance. See Idaho Code 67-8203
  • Governor: means :

  • Grant administrator: means the supreme court or any organization or agency as may be designated by the supreme court in accordance with such procedures as may be adopted by the supreme court. See Idaho Code 30-21-414
  • Grantor: The person who establishes a trust and places property into it.
  • Gross revenues: means all moneys paid by players during a bingo game or session for the playing of bingo or raffle events and does not include money paid for concessions; provided that the expenses of renting electronic bingo devices from a licensed vendor and the fees collected from players for the use of electronic bingo devices must be reported separately on the organization’s annual bingo report and must be netted for purposes of determining gross revenues as follows: only fees collected from players in excess of the rental charges paid to licensed vendors will be considered to be a part of gross revenues; and if the costs of renting electronic bingo devices from a licensed vendor exceed the fees collected from players for use of electronic bingo devices, the difference will be considered an administrative expense for purposes of section 67-7709(1)(d), Idaho Code.   • Guardian ad litem: means a person appointed by the court pursuant to a guardian ad litem volunteer program to act as special advocate for a child under this chapter. See Idaho Code 30-21-414
  • Guardian ad litem coordinator: means a person or entity receiving moneys from the grant administrator for the purpose of carrying out any of the duties set forth in section 16-1632, Idaho Code. See Idaho Code 30-21-414
  • Guardian ad litem program: means the program to recruit, train and coordinate volunteer persons to serve as guardians ad litem for abused, neglected or abandoned children. See Idaho Code 30-21-414
  • Hard of hearing: means those persons whose hearing is impaired to an extent that makes hearing difficult but does not preclude the understanding of spoken communication through the ear alone, with or without a hearing aid. See Idaho Code 67-7302
  • Health care: means a service or procedure to maintain, diagnose, treat or otherwise affect an individual's physical or mental condition. See Idaho Code 15-15-102
  • Hearing impaired: means those who are deaf or hard of hearing. See Idaho Code 67-7302
  • Historical record: means any record, artifact, object, historical or archaeological site or structure, document, evidence or public or private writing pursuant to the provisions of title 9, Idaho Code, relevant to the history of the state of Idaho. See Idaho Code 67-4112
  • Holiday: means the following:

  • Housing accommodation: includes any improved or unimproved real property, or part thereof, which is used or occupied, or as the home or residence of one (1) or more individuals;

  • Inter vivos: Transfer of property from one living person to another living person.

  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time.   • Internal control: means a coordinated system of methods and measures designed to safeguard assets, check the accuracy and reliability of accounting data, promote operational efficiency, and encourage adherence to prescribed managerial policies. See Idaho Code 67-1001A
  • Investment adviser: means a person that, for compensation, engages in the business of advising others, either directly or through publications or writings, as to the value of securities or the advisability of investing in, purchasing or selling securities or that, for compensation and as a part of a regular business, issues or promulgates analyses or reports concerning securities.   • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction of formation: means the jurisdiction whose law includes the organic law of an entity. See Idaho Code 30-21-102

  • Lottery contractor: means a person with whom the lottery has contracted for the purposes of providing goods and services for the state lottery. See Idaho Code 67-7404
  • Lottery revenue: means revenue derived from the sale of lottery tickets and shares. See Idaho Code 67-7404
  • Lowest responsible bidder: means the responsible bidder whose bid reflects the lowest acquisition price to be paid by the state, except that when specifications are valued or comparative performance evaluations are conducted, the results of such examinations and the relative score of valued specifications will be weighed, as set out in the specifications, in determining the lowest acquisition price.   • Major procurement: means any contract with a vendor supplying lottery tickets or shares, data processing systems utilized to track, sell, distribute or validate lottery tickets or shares, any goods or services involving the determination or generation of winners in any lottery game or any auditing services.   • Manufactured home: means a structure, constructed according to HUD/FHA mobile home construction and safety standards, transportable in one (1) or more sections, which, in the traveling mode, is eight (8) feet or more in width or is forty (40) body feet or more in length, or when erected on site, is three hundred twenty (320) or more square feet, and which is built on a permanent chassis and designed to be used as a dwelling with or without a permanent foundation when connected to the required utilities, and includes the plumbing, heating, air conditioning, and electrical systems contained therein, except that such term shall include any structure which meets all the requirements of this subsection except the size requirements and with respect to which the manufacturer voluntarily files a certification required by the secretary of housing and urban development and complies with the standards established under 42 U.   • Manufacturer: means any person engaged in manufacturing, assembling, or importing of marine sanitation devices or of vessels subject to the standards and regulations promulgated under the federal water pollution control act, as amended. See Idaho Code 67-7503
  • Marital deduction: The deduction(s) that can be taken in the determination of gift and estate tax liabilities because of the existence of a marriage or marital relationship.
  • Measure: means any proposal, to be voted statewide, submitted to the people for their approval or rejection at an election, including any initiative, referendum, recall election for statewide or legislative district offices, or revision of or amendment to the state constitution.   • Nonregistered foreign entity: means a foreign entity that is not registered to do business in this state pursuant to a statement of registration filed by the secretary of state. See Idaho Code 30-21-102
  • Oath: A promise to tell the truth.
  • Offer to purchase: includes an attempt or offer to obtain, or solicitation of an offer to sell, a security or interest in a security for value. See Idaho Code 30-14-102
  • Offer to sell: includes every attempt or offer to dispose of, or solicitation of an offer to purchase, a security or interest in a security for value. See Idaho Code 30-14-102
  • Offset: means to withhold payment, in full or part, from a recipient of state money whenever that recipient has an outstanding debt to the state. See Idaho Code 67-1001A
  • Online tool: means an electronic service provided by a custodian that allows the user, in an agreement distinct from the terms-of-service agreement between the custodian and user, to provide directions for disclosure or nondisclosure of digital assets to a third person. See Idaho Code 15-14-102
  • Open contract: means a contract awarded by the state through the division of purchasing as a result of a competitive solicitation to one (1) or more vendors who have agreed to allow all agencies to procure specified property under the terms and conditions set forth in the contract.   • Overtime work: means time worked on holidays and time worked in excess of forty (40) hours in a period of one hundred sixty-eight (168) consecutive hours, except that in the case of those employees engaged in law enforcement, correctional and fire protection activities characterized by irregular shift work schedules, time worked in excess of one hundred sixty (160) hours in a period of twenty-eight (28) consecutive days shall constitute overtime work within the meaning of this chapter.   • Permanency hearing: means a hearing to review, approve, reject or modify the permanency plan of the department, and review reasonable efforts in accomplishing the permanency plan. See Idaho Code 30-21-414
  • Permanency plan: means a plan for a continuous residence and maintenance of nurturing relationships during the child’s minority. See Idaho Code 30-21-414
  • Person: means an individual, corporation, association, firm, partnership, committee, political party, club or other organization or group of persons. See Idaho Code 67-6602
  • Person: shall be construed to mean and include an individual, association, corporation, club, trust, estate, society, company, joint stock company, receiver, trustee, assignee, referee or any other person acting in a fiduciary or representative capacity, whether appointed by a court or otherwise, and any combination of individuals. See Idaho Code 67-7404
  • Person: means an individual, partnership, firm, corporation or association, but does not include an individual on board a public vessel. See Idaho Code 67-7503
  • Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency or instrumentality, or other legal entity. See Idaho Code 15-14-102
  • Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality or other legal entity. See Idaho Code 15-15-102
  • Person: shall be construed to mean and include an individual, association, corporation, club, trust, estate, society, company, joint stock company, receiver, trustee, assignee, referee or any other person acting in a fiduciary or representative capacity, whether appointed by a court or otherwise, and any combination of individuals.   • Person: means an individual, corporation, partnership, firm, association, joint venture, proprietorship, club or any other legal entity. See Idaho Code 67-9101
  • Person: means an individual; corporation; business trust; estate; trust; partnership; limited liability company; association; joint venture; government; governmental subdivision, agency, or instrumentality; public corporation; or any other legal or commercial entity. See Idaho Code 30-14-102
  • Person: includes an individual, association, corporation, joint apprenticeship committee, joint-stock company, labor union, legal representative, mutual company, partnership, any other legal or commercial entity, the state, or any governmental entity or agency;

  • Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, statutory trust, business trust, common-law business trust, estate trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity.   • Personal care: means an arrangement or service to provide an individual shelter, food, clothing, transportation, education, recreation, social contact or assistance with the activities of daily living. See Idaho Code 15-15-102
  • Personal representative: means an executor, administrator, special administrator or person that performs substantially the same function under the law of this state other than this chapter. See Idaho Code 15-14-102
  • Personnel system: means the procedure for administering employees in accordance with this chapter. See Idaho Code 67-5302
  • Place of public accommodation: means a business, accommodation, refreshment, entertainment, recreation, or transportation facility of any kind, whether licensed or not, whose goods, services, facilities, privileges, advantages or accommodations are extended, offered, sold, or otherwise made available to the public;

  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Political committee: means :

  • Political office: means a public office for which partisan politics is a basis for nomination, election or appointment. See Idaho Code 67-5302
  • Political organization: means a party that sponsors candidates for election to political office. See Idaho Code 67-5302
  • Political treasurer: means an individual appointed by a candidate or political committee as provided in section 67-6603, Idaho Code. See Idaho Code 67-6602
  • Position: means a group of duties and responsibilities legally assigned or delegated by one (1) or more appointing authorities and requiring the employment of one (1) person. See Idaho Code 67-5302
  • Power of attorney: means a record that grants an agent authority to act in the place of a principal. See Idaho Code 15-14-102
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Predecessor act: means the act repealed by section 30-14-702, Idaho Code. See Idaho Code 30-14-102
  • Present value: means the total current monetary value of past, present, or future payments, contributions or dedications of goods, services, materials, construction or money. See Idaho Code 67-8203
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Pretrial conference: A meeting of the judge and lawyers to discuss which matters should be presented to the jury, to review evidence and witnesses, to set a timetable, and to discuss the settlement of the case.
  • Preventive maintenance: means :

  • Principal: means an individual who grants authority to an agent in a power of attorney. See Idaho Code 15-14-102
  • Principal office: means the principal executive office of an entity, whether or not the office is located in this state. See Idaho Code 30-21-102
  • Private property: means all property protected by the constitution of the United States or the constitution of the state of Idaho. See Idaho Code 67-8002
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Proceeding: includes a civil action, arbitration, mediation, administrative proceeding, criminal prosecution and investigatory action. See Idaho Code 30-21-102
  • Procure: means to obtain property for state use in a manner other than by gift including, but not limited to, purchase, lease or rent. See Idaho Code 67-9203
  • Professional entity: means an entity formed for the sole and specific purpose of rendering professional services, allied professional services, and services ancillary to the professional services and that has as its interest holders only:

  • Project: means a particular development on an identified parcel of land. See Idaho Code 67-8203
  • Project improvements: means site improvements and facilities that are planned and designed to provide service for a particular development project and that are necessary for the use and convenience of the occupants or users of the project. See Idaho Code 67-8203
  • Property: means anything that may be subject to ownership, whether real or personal or legal or equitable, or any interest or right therein. See Idaho Code 15-15-102
  • Property: means goods, services, parts, supplies and equipment, both tangible and intangible, including, but not limited to, designs, plans, programs, systems, techniques and any rights or interests in such property. See Idaho Code 67-9203
  • Property: means all property, whether real, personal, or mixed or tangible or intangible, or any right or interest therein. See Idaho Code 30-21-102
  • Proportionate share: means that portion of the cost of system improvements determined pursuant to section 67-8207, Idaho Code, which reasonably relates to the service demands and needs of the project. See Idaho Code 67-8203
  • Protected person: means an individual for whom a conservator has been appointed. See Idaho Code 15-14-102
  • Protective order: means an order issued by the court in a child protection case, prior to the adjudicatory hearing, to enable the child to remain in the home pursuant to section 16-1615(8), Idaho Code[,] or following an adjudicatory hearing to preserve the unity of the family and to ensure the best interests of the child, pursuant to section 16-1619(10), Idaho Code.   • Protective supervision: is a legal status created by court order in a child protective case whereby the child is in the legal custody of his or her parent(s), guardian(s) or other legal custodian(s), subject to supervision by the department. See Idaho Code 30-21-414
  • Psychotropic medication: means a drug prescribed to affect psychological functioning, perception, behavior or mood. See Idaho Code 30-21-414
  • Public buildings: means all county courthouses, and all city halls and buildings used primarily as governmental offices of the state or any county or city. See Idaho Code 67-6902
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public education entity: means community colleges, public school districts, public charter schools and the Idaho digital learning academy. See Idaho Code 67-5302
  • Public facilities: means :

  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public office: means any state office or position, state senator, state representative, and judge of the district court that is filled by election. See Idaho Code 67-6602
  • Public organic record: means the record, the filing of which by the secretary of state is required to form an entity, and any amendment to or restatement of that record. See Idaho Code 30-21-102
  • public record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Idaho Code 30-14-102
  • Quorum: The number of legislators that must be present to do business.
  • Raffle: means a game in which the prize is won by random drawing of the name or number of one (1) or more persons purchasing chances. See Idaho Code 67-7702
  • range: means an area owned by the state of Idaho or a state agency for the public use of rifles, shotguns, pistols, silhouettes, skeet, trap, black powder, archery or any other similar sport shooting. See Idaho Code 67-9101
  • Readily achievable: means easily accomplishable and able to be carried out without much difficulty or expense. See Idaho Code 67-5902
  • Real estate broker or salesman: means a person, whether licensed or not, who, for or with the expectation of receiving a consideration, lists, sells, purchases, exchanges, rents, or leases real property, or who negotiates or attempts to negotiate any of these activities, or who holds himself out as engaged in these activities, or who negotiates or attempts to negotiate a loan secured or to be secured by mortgage or other encumbrance upon real property, or who is engaged in the business of listing real property in a publication; or a person employed by or acting on behalf of any of these;

  • Recreational vehicle: means a vehicular type unit primarily designed as temporary quarters for recreational, camping, or travel use, which either has its own motive power or is mounted on or drawn by another vehicle. See Idaho Code 67-8203
  • Redemption value: means the sum total of all winnings upon the ticket presented for payment. See Idaho Code 67-7404
  • Register: means a list of names of persons who have been determined to be eligible for employment in a classified position as determined on the basis of examination and merit factors as established by the administrator. See Idaho Code 67-5302
  • Registered agent: means an agent of an entity that is authorized to receive service of any process, notice, or demand required or permitted by law to be served on the entity. See Idaho Code 30-21-102
  • Registered foreign entity: means a foreign entity that is registered to do business in this state pursuant to a statement of registration filed by the secretary of state. See Idaho Code 30-21-102
  • Regulatory taking: means a regulatory or administrative action resulting in deprivation of private property that is the subject of such action, whether such deprivation is total or partial, permanent or temporary, in violation of the state or federal constitution. See Idaho Code 67-8002
  • Relative: means a child’s grandparent, great grandparent, aunt, great aunt, uncle, great uncle, brother-in-law, sister-in-law, first cousin, sibling and half-sibling. See Idaho Code 30-21-414
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Renewable energy: means a source of energy that occurs naturally, is regenerated naturally or uses as a fuel source, a waste product or byproduct from a manufacturing process including, but not limited to, open or closed-loop biomass, fuel cells, geothermal energy, waste heat, cogeneration, solar energy, waterpower and wind. See Idaho Code 67-8903
  • Renewable energy generation project: means an electric generating facility or system that uses renewable energy as its primary source of energy to generate electricity. See Idaho Code 67-8903
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • retailer: means a person with whom the lottery has contracted for the purpose of selling tickets or shares in lottery games to the public. See Idaho Code 67-7404
  • Retainable offense: means :

  • Revenues: means all receipts, purchase payments, loan repayments, lease payments, rents, fees and charges, and all other income or receipts derived by the authority from a participating utility. See Idaho Code 67-8903
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • Sale: includes every contract of sale, contract to sell, or disposition of, a security or interest in a security for value. See Idaho Code 30-14-102
  • seal: includes an impression of such seal upon the paper, alone, as well as upon wax or a wafer affixed thereto; or, alternatively, the seal may be the mark of a rubber stamp providing substantially the same information as the impression. See Idaho Code 73-111
  • Securities and exchange commission: means the United States securities and exchange commission. See Idaho Code 30-14-102
  • Security: means a note; stock; treasury stock; security future; bond; debenture; evidence of indebtedness; certificate of interest or participation in a profit-sharing agreement; collateral trust certificate; preorganization certificate or subscription; transferable share; investment contract; voting trust certificate; certificate of deposit for a security; fractional undivided interest in oil, gas or other mineral rights; put, call, straddle, option or privilege on a security, certificate of deposit, or group or index of securities, including an interest therein or based on the value thereof; put, call, straddle, option, or privilege entered into on a national securities exchange relating to foreign currency; or, in general, an interest or instrument commonly known as a "security"; or a certificate of interest or participation in, temporary or interim certificate for, receipt for, guarantee of, or warrant or right to subscribe to or purchase, any of the foregoing.   • Self-regulatory organization: means a national securities exchange registered under the securities exchange act of 1934, a national securities association of broker-dealers registered under the securities exchange act of 1934, a clearing agency registered under the securities exchange act of 1934, or the municipal securities rulemaking board established under the securities exchange act of 1934. See Idaho Code 30-14-102
  • Service area: means any defined geographic area identified by a governmental entity or by intergovernmental agreement in which specific public facilities provide service to development within the area defined, on the basis of sound planning or engineering principles or both. See Idaho Code 67-8203
  • Service of process: The service of writs or summonses to the appropriate party.
  • Service unit: means a standardized measure of consumption, use, generation or discharge attributable to an individual unit of development calculated in accordance with generally accepted engineering or planning standards for a particular category of capital improvements. See Idaho Code 67-8203
  • Session: means a period of time not to exceed eight (8) hours in any one (1) day in which players are allowed to participate in bingo games operated by a charitable or nonprofit organization. See Idaho Code 67-7702
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sewage: means human body wastes and the wastes from toilets and other receptacles intended to receive or retain body wastes. See Idaho Code 67-7503
  • Share: means any intangible evidence of participation in a game conducted by the state lottery. See Idaho Code 67-7404
  • Shelter care: means places designated by the department for temporary care of children pending court disposition or placement. See Idaho Code 30-21-414
  • Sign: means with present intent to authenticate or adopt a record:

  • Site system: means the computer hardware, software and peripheral equipment used by a licensed organization at the site of its bingo session that provides electronic bingo cards or bingo card monitoring devices to players, and that receipts the sale or rental of such cards and devices and generates reports relative to such sales or rentals.   • Sole source: means the only vendor from whom specific property is available to procure. See Idaho Code 67-9203
  • Solicitation: means an invitation to bid, a request for proposal or a request for quote issued pursuant to this chapter for the purpose of procuring property. See Idaho Code 67-9203
  • Specifications: means the standards or requirements for property to be procured as explicitly stated in a solicitation or contract. See Idaho Code 67-9203
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Idaho Code 30-14-102
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Idaho Code 30-21-102
  • State: means the state of Idaho. See Idaho Code 67-6402
  • State agencies: means all state agencies or departments, boards, commissions, councils and institutions of higher education but shall not include the elected constitutional officers and their staffs, the legislature and its staffs or the judiciary. See Idaho Code 67-831
  • State agency: means the state of Idaho and any officer, agency, board, commission, department or similar body of the executive branch of the state government. See Idaho Code 67-8002
  • State body: means any department, board, commission, or agency of the state of Idaho. See Idaho Code 67-6402
  • State educational agency: means the following state agencies and educational institutions supervised by the Idaho state board of education:

  • State institution of higher education: means Boise state university, Idaho state university or Lewis-Clark state college. See Idaho Code 67-9203
  • state lottery: means the state lottery established and operated pursuant to this chapter. See Idaho Code 67-7404
  • State sales tax account: means any fund or account in the state treasury in which state sales tax moneys are deposited, but only to the extent moneys in such fund or account are attributable to the state sales tax moneys. See Idaho Code 67-8702
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Statutes at large: A chronological listing of the laws enacted each Congress. They are published in volumes numbered by Congress.
  • Statutory trust: means a trust formed under the statutory law of a jurisdiction other than this state. See Idaho Code 30-21-102
  • Subject of record: means the person who is or may be the primary subject of a record of criminal justice information or any representative of the person designated by power of attorney or notarized authorization. See Idaho Code 67-3001
  • Substitute decision-making document: means a record created by an individual to authorize a decision maker to act for the individual with respect to property, health care or personal care. See Idaho Code 15-15-102
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supportive services: means services which assist a parent with a disability to compensate for those aspects of their disability which affect their ability to care for their child and which will enable them to discharge their parental responsibilities. See Idaho Code 30-21-213
  • Supportive services: as used in this chapter , shall mean services that assist parents with a disability to compensate for those aspects of their disability that affect their ability to care for their child and that will enable them to discharge their parental responsibilities. See Idaho Code 30-21-414
  • System improvement costs: means costs incurred for construction or reconstruction of system improvements, including design, acquisition, engineering and other costs attributable thereto, and also including, without limitation, the type of costs described in section 50-1702(h), Idaho Code, to provide additional public facilities needed to serve new growth and development. See Idaho Code 67-8203
  • Telecommunications: means all present and future forms of hardware, software or services used or required for transmitting voice, data, video or images over a distance. See Idaho Code 67-831
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Terms of service agreement: means an agreement that controls the relationship between a user and a custodian. See Idaho Code 15-14-102
  • Testator: A male person who leaves a will at death.
  • Testatrix: The female counterpart of a testator.
  • Testify: Answer questions in court.
  • Ticket: means any tangible evidence issued by the lottery to provide participation in a game conducted by the state lottery. See Idaho Code 67-7404
  • Transact business: means to engage in any commercial or other activity that is intended to or likely to produce a financial benefit, whether it is for the purpose of profit to the person who engages in the activity or for the purpose of supporting a charitable, benevolent or other nonprofit function. See Idaho Code 30-21-803
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: includes :

  • true name: shall include the assumed business name which appears on the application for authority to do business or registration statement. See Idaho Code 30-21-803
  • Trustee: means a fiduciary with legal title to property under an agreement or declaration that creates a beneficial interest in another. See Idaho Code 15-14-102
  • Trustee: A person or institution holding and administering property in trust.
  • Trustor: The person who makes or creates a trust. Also known as the grantor or settlor.
  • Type of entity: means a generic form of entity:

  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Unincorporated nonprofit association: means a domestic unincorporated nonprofit association formed under or subject to chapter 27, title 30, Idaho Code, or a nonprofit association formed under or subject to the law of a jurisdiction other than this state that would be an unincorporated nonprofit association if formed under or subject to the law of this state. See Idaho Code 30-21-102
  • User: means a person that has an account with a custodian. See Idaho Code 15-14-102
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Vacation leave: means a period of exemption from work granted to employees during which time said employees shall be compensated. See Idaho Code 67-5302
  • Value: means any ticket shall be taken at face value. See Idaho Code 67-7404
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • vendor: means any person who submits a bid, proposal or offer as part of a major procurement for goods or services as defined in subsection (11) of this section. See Idaho Code 67-7404
  • Vendor: means an applicant, licensee or manufacturer, distributor or supplier, licensed or unlicensed, that furnishes or supplies bingo or raffle equipment, disposable or nondisposable cards, and any and all related gaming equipment. See Idaho Code 67-7702
  • Vendor: means a person or entity capable of supplying property to the state. See Idaho Code 67-9203
  • Verdict: The decision of a petit jury or a judge.
  • Vessel: shall include every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on the waters of the state of Idaho. See Idaho Code 67-7503
  • Veteran: is a s defined in section 65-502, Idaho Code. See Idaho Code 67-5302
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Warrant: means a negotiable instrument payable by the state treasury when funds become available for the stated purpose; a warrant may include, but is not necessarily limited to, a payment mechanism such as direct deposit, electronic fund transfer, paper warrant or other financial instrument. See Idaho Code 67-1001A
  • Written: means inscribed on a tangible medium. See Idaho Code 30-21-102
