Terms Used In Idaho Code > Title 67
- Account: means an arrangement under a terms of service agreement in which a custodian carries, maintains, processes, receives or stores a digital asset of the user or provides goods or services to the user. See Idaho Code 15-14-102
- Account: means a contract of deposit of funds between a depositor and a financial institution, and includes a checking account, savings account, certificate of deposit, share account and other like arrangement;
(2) "Beneficiary" means a person named in a trust account as one for whom a party to the account is named as trustee;
(3) "Financial institution" means any organization authorized to do business under state or federal laws relating to financial institutions, including, without limitation, banks and trust companies, savings banks, building and loan associations, savings and loan companies or associations, and credit unions;
(4) "Joint account" means an account payable on request to one (1) or more of two (2) or more parties whether or not mention is made of any right of survivorship;
(5) A "multiple-party account" is any of the following types of account:
(a) a joint account;

See Idaho Code 30-21-102 action: as used in this chapter is to be construed, whenever it is necessary so to do, as including a special proceeding of a civil nature. See Idaho Code 5-240 Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session. Adjournment sine die: The end of a legislative session "without day." These adjournments are used to indicate the final adjournment of an annual or the two-year session of legislature. Administration of criminal justice: means performance of any of the following activities: detection, apprehension, detention, pretrial release, posttrial release, prosecution, adjudication, correctional supervision, or rehabilitation of accused persons or criminal offenders. See Idaho Code 67-3001 Administrative costs: means personnel costs, capital outlay, and reasonable expenses incurred by other state agencies to effectuate the purposes of this chapter. See Idaho Code 67-7404 Administrative employee: means any person, nonclassified or classified, appointed to a position that meets the criteria set forth in the federal fair labor standards act, 29 U. See Idaho Code 67-5302 Administrator: means the administrator of the division of purchasing as created by section 67-9204, Idaho Code. See Idaho Code 67-9203 Administrator: means the director of the Idaho department of finance or his designee. See Idaho Code 30-14-102 Administrator: means the administrator of the division of human resources in the governor’s office. See Idaho Code 67-5302 Administrator: means the state treasurer or his or her duly authorized agents or employees. See Idaho Code 14-501 Advisory commission: means the housing trust fund advisory commission established in section 67-8106, Idaho Code. See Idaho Code 67-8102 Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court. Affordable housing: means housing affordable to families whose incomes do not exceed eighty percent (80%) of the median income for the service area or areas within the jurisdiction of the governmental entity. See Idaho Code 67-8203 Agency: means all officers, departments, divisions, bureaus, boards, commissions and institutions of the state, including the public utilities commission, but excluding:
- Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
- A verdict of "not guilty."
Idaho Code 67-9203Agent: means an attorney in fact granted authority under a durable or nondurable power of attorney. See Idaho Code 15-14-102 Agent: means an individual, other than a broker-dealer, who represents a broker-dealer in effecting or attempting to effect purchases or sales of securities or who represents an issuer in effecting or attempting to effect purchases or sales of the issuer's securities. See Idaho Code 30-14-102 Allocation plan: means the plan, approved and revised annually by the advisory commission, providing for the method and priorities of allocation of housing trust fund moneys and providing the procedures for loan and grant application for housing trust fund moneys. See Idaho Code 67-8102 Amortization: Paying off a loan by regular installments. Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. Source: FDIC Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year. Apparent owner: means the person whose name appears on the records of the holder as the person entitled to property held, issued, or owing by the holder. See Idaho Code 14-501 Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal. Appointing authority: means the officer, board, commission, person or group of persons authorized by statute or lawfully delegated authority to make appointments to or employ personnel in any department. See Idaho Code 67-5302 Apportionable estate: means the value of the gross estate as finally determined for purposes of the estate tax to be apportioned reduced by:
Idaho Code 15-3-1302Appraisal: A determination of property value. Appropriate: means to legally obligate by contract or otherwise commit to use by appropriation or other official act of a governmental entity. See Idaho Code 67-8203 Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty. Arrest: Taking physical custody of a person by lawful authority. Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account. Association: means the Idaho housing and finance association. See Idaho Code 67-8102 Attorney general: means the chief legal officer of this state. See Idaho Code 14-501 Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court. Authority: means the Idaho energy resources authority created pursuant to section 67-8904, Idaho Code. See Idaho Code 67-8903 Authority: means the Idaho state building authority created and established pursuant to section 67-6403, Idaho Code. See Idaho Code 67-6402 Bailiff: a court officer who enforces the rules of behavior in courtrooms. Balanced budget: A budget in which receipts equal outlays. Bank: means :
Idaho Code 30-14-102Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings. Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC Bequest: Property gifted by will. Bid: means a written offer to perform a contract to sell or otherwise supply property in response to a solicitation. See Idaho Code 67-9203 Bidder: means a vendor who has submitted a bid on property to be acquired by the state. See Idaho Code 67-9203 Bingo: means the traditional game of chance played for a prize determined prior to the start of the game. See Idaho Code 67-7702 Bingo-raffle advisory board: means a board of six (6) persons chosen by the governor to make advisory recommendations regarding bingo and raffle operations and regulation in Idaho. See Idaho Code 67-7702 Board: means the board of directors of the authority. See Idaho Code 67-8903 Board: means the board of trustees of the Idaho state historical society. See Idaho Code 67-4112 board: as used in this chapter shall mean the board of directors of a district. See Idaho Code 67-4902 bond bank authority: means the Idaho bond bank authority. See Idaho Code 67-8702 Bonds: means bonds, notes or other obligations of the authority issued under this chapter. See Idaho Code 67-8702 Bonds: means any bonds, notes, certificates or other obligations or evidences of indebtedness issued by the authority. See Idaho Code 67-8903 Broker-dealer: means a person engaged in the business of effecting transactions in securities for the account of others or for the person's own account. See Idaho Code 30-14-102 Bureau: means the bureau of criminal identification in the Idaho state police. See Idaho Code 67-3001 Business association: means a nonpublic corporation, limited liability company, joint stock company, investment company, business trust, partnership, or association for business purposes of two (2) or more individuals, whether or not for profit, including, but not limited to, a banking organization, financial organization, insurance company, or utility. See Idaho Code 14-501 Business corporation: means a domestic business corporation incorporated under or subject to chapter 29, title 30, Idaho Code, or a foreign business corporation. See Idaho Code 30-21-102 Business trust: means a trust formed under the statutory law of another state that is not a foreign statutory trust and does not have a predominately donative purpose. See Idaho Code 30-21-102 Candidate: means an individual who seeks nomination, election, or reelection to public office and who has taken any of the following actions:
Idaho Code 67-6602Capital improvements: means improvements with a useful life of ten (10) years or more, by new construction or other action, which increase the service capacity of a public facility. See Idaho Code 67-8203 Capital improvements plan: means a plan adopted pursuant to this chapter that identifies capital improvements for which development impact fees may be used as a funding source. See Idaho Code 67-8203 Carries: means engages in the transmission of an electronic communication. See Idaho Code 15-14-102 Catalog of electronic communications: means information that identifies each person with which a user has had an electronic communication, the time and date of the communication and the electronic address of the person. See Idaho Code 15-14-102 Certification: means a written or electronic assertion that a statement or report is true or as represented. See Idaho Code 67-1001A Chambers: A judge's office. Charitable organization: means an organization that has been in continuous existence in the county of operation of the charitable bingo game or raffle for at least one (1) year, that conducts charitable activities, and that is exempt from taxation under section 501(c)(3), 501(c)(4), 501(c)(6), 501(c)(8), 501(c)(10), 501(c)(19) or 501(d) of the Internal Revenue Code and is exempt from income taxation under title 63, Idaho Code, as a bona fide nonprofit charitable, civic, religious, fraternal, patriotic or veterans organization or as a nonprofit volunteer fire department, or as a nonprofit volunteer rescue squad, or as a nonprofit volunteer educational booster group, parent-teacher organization or association. See Idaho Code 67-7702 Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes. check: refers to a check or the electronic equivalent of a check, including an authorization given by a borrower to a creditor to withdraw an agreed upon amount from any account held by the borrower. See Idaho Code 28-46-401 Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority. Class: means a group of positions sufficiently similar as to the duties performed, degree of supervision exercised or required, minimum requirements of training, experience or skill, and other characteristics that the same title, the same tests of fitness and the same schedule of compensation may be applied to each position in the group. See Idaho Code 67-5302 Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records. Codicil: An addition, change, or supplement to a will executed with the same formalities required for the will itself. Commercial registered agent: means a person listed under section 30-21-405, Idaho Code. See Idaho Code 30-21-102 Commission: means the Idaho state lottery commission as defined in section 67-7404, Idaho Code. See Idaho Code 67-7702 Commission: means the Idaho public utilities commission created pursuant to section 61-201, Idaho Code. See Idaho Code 67-8903 Commission: means the Idaho personnel commission. See Idaho Code 67-5302 Commission: means the commission on human rights created by this chapter;
(2) "Commissioner" means a member of the commission;
(3) "Discriminatory practice" means a practice designated as discriminatory under the terms of this chapter;
(4) "National origin" includes the national origin of an ancestor;
(5) "Person" includes an individual, association, corporation, joint apprenticeship committee, joint-stock company, labor union, legal representative, mutual company, partnership, any other legal or commercial entity, the state, or any governmental entity or agency;
(6) "Employer" means a person, wherever situated, who hires five (5) or more employees for each working day in each of twenty (20) or more calendar weeks in the current or preceding calendar year whose services are to be partially or wholly performed in the state of Idaho, except for domestic servants hired to work in and about the person’s household. See Idaho Code 67-5902Commission: means the Idaho state lottery commission. See Idaho Code 67-7404 Common disaster: A sudden and extraordinary misfortune that brings about the simultaneous or near-simultaneous deaths of two or more associated persons, such as husband and wife. Common enterprise: means an enterprise in which the fortunes of the investor are interwoven with those of either the person offering the investment, a third party, or other investors; and
Idaho Code 30-14-102Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action. Common-law business trust: means a common-law trust that does not have a predominately donative purpose. See Idaho Code 30-21-102 Community: means a group of people linked by common policy, common social interests and interaction with one another. See Idaho Code 67-9003 Community college district: means any community college district organized and existing under chapter 21, title 33, Idaho Code. See Idaho Code 67-6402 Compensation: includes any advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge or transfer of money or anything of value, and any contract, agreement, promise or other obligation, whether or not legally enforceable, to do any of the foregoing, for services rendered or to be rendered, but does not include reimbursement of expenses if such reimbursement does not exceed the amount actually expended for such expenses and is substantiated by an itemization of such expenses. See Idaho Code 67-6602 Compensatory mitigation: means the restoration, re-establishment or rehabilitation, establishment or creation, enhancement, and in certain circumstances preservation of aquatic resources for the purpose of offsetting unavoidable adverse impacts that remain after all appropriate and practicable avoidance and minimization have been achieved. See Idaho Code 67-9502 Compensatory mitigation project: means compensatory mitigation implemented by the permittee as a requirement of a corps of engineers section 404 wetland permit, i. See Idaho Code 67-9502 Compensatory time: means approved time off from duty provided in compensation for overtime hours worked. See Idaho Code 67-5302 Conservator: means a person appointed by a court to manage the estate of a living individual. See Idaho Code 15-14-102 Contract: means an agreement for the acquisition of property, including a purchase order. See Idaho Code 67-9203 Contractor: means a vendor who has been awarded a contract. See Idaho Code 67-9203 Contractor: means a person who receives compensation from another person for either full-time or part-time work based on a contract or compensation agreement, but who is not an employee of that person. See Idaho Code 67-6602 Contribution: includes any advance, conveyance, forgiveness of indebtedness, deposit, distribution, loan, payment, gift, pledge, subscription or transfer of money or anything of value, and any contract, agreement, promise or other obligation, whether or not legally enforceable, to make a contribution, in support of or in opposition to any candidate, political committee or measure. See Idaho Code 67-6602 Council: means the Idaho state council for the deaf and hard of hearing. See Idaho Code 67-7302 Counterclaim: A claim that a defendant makes against a plaintiff. Court: means the court in this state having jurisdiction in matters relating to the content of this chapter. See Idaho Code 15-14-102 Court: means district courts of this state, including the magistrates division, and includes, when the context requires, any judge of the court;
(2) "Clerk" and "clerk of the court" mean the duly elected and acting clerk of the district court and ex officio auditor and recorder and duly appointed deputies;
(3) "Master jury list" means the voter registration lists for the county which shall be supplemented with names from other sources prescribed pursuant to section 2-206, Idaho Code, in order to foster the policy and protect the rights secured by sections 2-202 and 2-203, Idaho Code;
(4) "Voter registration lists" means the most current official records, maintained by the county clerk, of persons registered to vote in any national, state, county, or municipal election;
(5) "Jury selection system" means any physical device or automated system for the management of the names or identifying numbers of prospective jurors;
(6) "Prospective jury panel" means the list of names or identifying numbers of prospective jurors drawn at random from the master jury list pursuant to section 2-208, Idaho Code, and who are not disqualified pursuant to section 2-209, Idaho Code. See Idaho Code 2-204Court: means any court created by the constitution and laws of the state of Idaho; and clerks of the district court. See Idaho Code 67-3001 Court reporter: A person who makes a word-for-word record of what is said in court and produces a transcript of the proceedings upon request. Criminal history records: means physical and automated information on individuals collected and maintained by the Idaho state police as a result of arrest or the initiation of a criminal proceeding by felony summons or information. See Idaho Code 67-3001 Criminal justice agency: means a governmental agency or subdivision of a government entity that performs the administration of criminal justice pursuant to a statute, and that allocates a substantial portion of its budget to the administration of criminal justice. See Idaho Code 67-3001 Custodian: means a person that carries, maintains, processes, receives or stores a digital asset of a user. See Idaho Code 15-14-102 Deaf: includes several kinds of deafness: prelingually deaf, postlingually deaf and deafened as defined by the Gallaudet university study on hearing loss. See Idaho Code 67-7302 Decedent: A deceased person. Decision maker: means a person authorized to act for an individual under a substitute decision-making document, whether denominated a decision maker, agent, attorney in fact, proxy, representative or by another title. See Idaho Code 15-15-102 Deed: The legal instrument used to transfer title in real property from one person to another. Defaulter: means one who misappropriates public funds held by him in any official or fiduciary capacity; or fails to provide an accounting as specified by the state controller for such funds. See Idaho Code 67-1001A Department: means the Idaho state police. See Idaho Code 67-3001 Department: means any department, agency, institution or office of the state of Idaho. See Idaho Code 67-5302 Dependent: A person dependent for support upon another. Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial. Depository institution: means :
Idaho Code 30-14-102Designated recipient: means a person chosen by a user using an online tool to administer digital assets of the user. See Idaho Code 15-14-102 Developer: means any person or legal entity undertaking development, including a party that undertakes the subdivision of property pursuant to sections 50-1301 through 50-1334, Idaho Code. See Idaho Code 67-8203 Development: means any construction or installation of a building or structure, or any change in use of a building or structure, or any change in the use, character or appearance of land, which creates additional demand and need for public facilities or the subdivision of property that would permit any change in the use, character or appearance of land. Idaho Code 67-8903Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic or similar capabilities. See Idaho Code 15-14-102 Electronic bingo device: means an electronic device used by a bingo player to monitor bingo cards purchased at the time and place of a licensed organization’s bingo session and that:
Idaho Code 67-7702Electronic communication: has the meaning set forth in 18 U. See Idaho Code 15-14-102 Electronic communication service: means a custodian that provides to a user the ability to send or receive an electronic communication. See Idaho Code 15-14-102 Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Idaho Code 67-5902EMS: means emergency medical services. See Idaho Code 67-8806 EMS provider: means an emergency medical technician, advanced emergency medical technician, or paramedic licensed by the department of health and welfare pursuant to sections 56-1011 through 56-1018B, Idaho Code, and an ambulance-based clinician as defined in the rules governing emergency medical services as adopted by the department of health and welfare. See Idaho Code 67-8806 En banc: In the bench or "full bench." Refers to court sessions with the entire membership of a court participating rather than the usual quorum. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs. Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Estate tax: means a federal, state, or foreign tax, however denominated, imposed because of the death of an individual and interest and penalties associated with the tax. Examine: means open to inspection; to review or evaluate the books, papers, accounts, bills, vouchers, other documents of state funds and property, or accounts or financial records of all state agencies and entities receiving state funds in accordance with generally accepted accounting practices. See Idaho Code 67-1001A Exceptional meritorious conduct: means an act of bravery and self-sacrifice, at the risk of serious injury or loss of one’s own life, which is so conspicuous as to clearly distinguish the individual above his comrades. Idaho Code 67-6602Executive session: A portion of the Senate's daily session in which it considers executive business. Executor: A male person named in a will to carry out the decedent Exempt employee: means any employee, classified or nonclassified, who is determined to be an executive, professional or administrative employee as defined herein, or who qualifies for any other exemption from cash compensation for overtime under applicable federal law. See Idaho Code 67-5302 Expenditure: includes any payment, contribution, subscription, distribution, loan, advance, deposit, or gift of money or anything of value, and includes a contract, promise, or agreement, whether or not legally enforceable, to make an expenditure. See Idaho Code 67-6602 Expenses: means all costs of doing business including, but not limited to, prizes, commissions and other compensation paid to retailers, advertising and marketing costs, personnel costs, capital outlay, reasonable expenses incurred by other state agencies to effectuate the purposes of this chapter, depreciation of property and equipment, and other operating costs, all of which are to be recorded on the accrual basis of accounting in accordance with generally accepted accounting principles. Federal covered investment adviser: means a person registered under the investment advisers act of 1940, as cited in section 30-14-103, Idaho Code. See Idaho Code 30-14-102 Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. See Idaho Code 67-7503 Person: shall be construed to mean and include an individual, association, corporation, club, trust, estate, society, company, joint stock company, receiver, trustee, assignee, referee or any other person acting in a fiduciary or representative capacity, whether appointed by a court or otherwise, and any combination of individuals. See Idaho Code 67-7702 Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency or instrumentality, or other legal entity. See Idaho Code 15-14-102 Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality or other legal entity. See Idaho Code 15-15-102 Person: means an individual, corporation, partnership, firm, association, joint venture, proprietorship, club or any other legal entity. See Idaho Code 67-9101 Person: means any individual, partnership, corporation, association, governmental subdivision or agency, or public or private organization or entity of any character. See Idaho Code 67-9502 Person: means an individual; corporation; business trust; estate; trust; partnership; limited liability company; association; joint venture; government; governmental subdivision, agency, or instrumentality; public corporation; or any other legal or commercial entity. See Idaho Code 30-14-102 Person: means an individual, business association, state or other government, governmental subdivision or agency, public corporation, public authority, estate, trust, two (2) or more persons having a joint or common interest, or any other legal or commercial entity. See Idaho Code 14-501 Person: means an individual, business corporation, nonprofit corporation, partnership, limited partnership, limited liability company, general cooperative association, limited cooperative association, unincorporated nonprofit association, statutory trust, business trust, common-law business trust, estate trust, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Idaho Code 30-21-102 Person: means an individual, corporation, association, firm, partnership, committee, political party, club or other organization or group of persons. See Idaho Code 67-6602 Personal care: means an arrangement or service to provide an individual shelter, food, clothing, transportation, education, recreation, social contact or assistance with the activities of daily living. See Idaho Code 15-15-102 Personal representative: means an executor, administrator, special administrator or person that performs substantially the same function under the law of this state other than this chapter. See Idaho Code 15-14-102 Personnel system: means the procedure for administering employees in accordance with this chapter. See Idaho Code 67-5302 Place of public accommodation: means a business, accommodation, refreshment, entertainment, recreation, or transportation facility of any kind, whether licensed or not, whose goods, services, facilities, privileges, advantages or accommodations are extended, offered, sold, or otherwise made available to the public;
(10) "Educational institution" means a public or private institution and includes an academy, college, elementary or secondary school, extension course, kindergarten, nursery, school system, or university and a business, nursing, professional, secretarial, technical, or vocational school and includes an agent of an educational institution;
(11) "Real property" includes buildings, structures, real estate, lands, tenements, leaseholds, interests in real estate cooperatives, condominiums, and hereditaments, corporeal and incorporeal or any interest therein;
(12) "Real estate transaction" includes the sale, exchange, rental or lease of real property;
(13) "Housing accommodation" includes any improved or unimproved real property, or part thereof, which is used or occupied, or as the home or residence of one (1) or more individuals;
(14) "Real estate broker or salesman" means a person, whether licensed or not, who, for or with the expectation of receiving a consideration, lists, sells, purchases, exchanges, rents, or leases real property, or who negotiates or attempts to negotiate any of these activities, or who holds himself out as engaged in these activities, or who negotiates or attempts to negotiate a loan secured or to be secured by mortgage or other encumbrance upon real property, or who is engaged in the business of listing real property in a publication; or a person employed by or acting on behalf of any of these;
(15) "Disability" means a physical or mental condition of a person, whether congenital or acquired, which constitutes a substantial limitation to that person and is demonstrable by medically accepted clinical or laboratory diagnostic techniques. See Idaho Code 67-8002 Remand: When an appellate court sends a case back to a lower court for further proceedings. Remote computing service: means a custodian that provides to a user computer processing services or the storage of digital assets by means of an electronic communications system, as defined in 18 U. See Idaho Code 15-14-102 Renewable energy: means a source of energy that occurs naturally, is regenerated naturally or uses as a fuel source, a waste product or byproduct from a manufacturing process including, but not limited to, open or closed-loop biomass, fuel cells, geothermal energy, waste heat, cogeneration, solar energy, waterpower and wind. See Idaho Code 67-8903 Renewable energy generation project: means an electric generating facility or system that uses renewable energy as its primary source of energy to generate electricity. See Idaho Code 67-8903 Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals). Request: means a proper request for withdrawal, or a check or order for payment, which complies with all conditions of the account, including special requirements concerning necessary signatures and regulations of the financial institutions; but if the financial institution conditions withdrawal or payment on advance notice, for purposes of this part the request for withdrawal or payment is treated as immediately effective and a notice of intent to withdraw is treated as a request for withdrawal;
(13) "Sums on deposit" means the balance payable on a multiple-party account including interest, dividends, and in addition any deposit life insurance proceeds added to the account by reason of the death of a party;
(14) "Trust account" means an account in the name of one (1) or more parties as trustee for one (1) or more beneficiaries where the relationship is established by the form of the account and the deposit agreement with the financial institution and there is no subject of the trust other than the sums on deposit in the account; it is not essential that payment to the beneficiary be mentioned in the deposit agreement. Idaho Code 67-3001retirement board: as used in this chapter shall mean the retirement board created by section 59-1304, Idaho Code. See Idaho Code 1-2001 Revenues: means all receipts, purchase payments, loan repayments, lease payments, rents, fees and charges, and all other income or receipts derived by the authority from a participating utility. See Idaho Code 67-8903 Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust). Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). See Idaho Code 67-7404 Site system: means the computer hardware, software and peripheral equipment used by a licensed organization at the site of its bingo session that provides electronic bingo cards or bingo card monitoring devices to players, and that receipts the sale or rental of such cards and devices and generates reports relative to such sales or rentals. See Idaho Code 67-7702 Sole ownership: The type of property ownership in which one individual holds legal title to the property and has full control of it. Sole source: means the only vendor from whom specific property is available to procure. See Idaho Code 67-9203 Solicitation: means an invitation to bid, a request for proposal or a request for quote issued pursuant to this chapter for the purpose of procuring property. See Idaho Code 67-9203 Specifications: means the standards or requirements for property to be procured as explicitly stated in a solicitation or contract. See Idaho Code 67-7404 State sales tax account: means any fund or account in the state treasury in which state sales tax moneys are deposited, but only to the extent moneys in such fund or account are attributable to the state sales tax moneys. Statutory trust: means a trust formed under the statutory law of a jurisdiction other than this state. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held. Source: OCC Unincorporated nonprofit association: means a domestic unincorporated nonprofit association formed under or subject to chapter 27, title 30, Idaho Code, or a nonprofit association formed under or subject to the law of a jurisdiction other than this state that would be an unincorporated nonprofit association if formed under or subject to the law of this state. See Idaho Code 30-21-102 User: means a person that has an account with a custodian. See Idaho Code 15-14-102 User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services. Utility: means a person who owns or operates for public use any plant, equipment, property, franchise, or license for the transmission of communications or the production, storage, transmission, sale, delivery, or furnishing of electricity, water, steam, or gas. See Idaho Code 14-501 Vacation leave: means a period of exemption from work granted to employees during which time said employees shall be compensated. See Idaho Code 67-5302 Valuation: means the most recent annual actuarial valuation. See Idaho Code 1-2004A Valuation date: means the date of such valuation. See Idaho Code 1-2004A Value: means any ticket shall be taken at face value. See Idaho Code 67-7404 Value: means , with respect to an interest in property, fair market value as finally determined for purposes of the estate tax that is to be apportioned, reduced by any outstanding debt secured by the interest without reduction:
Idaho Code 15-3-1302Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate. vendor: means any person who submits a bid, proposal or offer as part of a major procurement for goods or services as defined in subsection (11) of this section. See Idaho Code 67-7404 Vendor: means an applicant, licensee or manufacturer, distributor or supplier, licensed or unlicensed, that furnishes or supplies bingo or raffle equipment, disposable or nondisposable cards, and any and all related gaming equipment. See Idaho Code 67-7702 Vendor: means a person or entity capable of supplying property to the state. See Idaho Code 67-9203 Venue: The geographical location in which a case is tried. Vessel: shall include every description of watercraft or other artificial contrivance used, or capable of being used, as a means of transportation on the waters of the state of Idaho. See Idaho Code 67-7503 Veteran: means any person who has been discharged or released from active duty in the armed forces under honorable conditions provided the person has served on active duty for a minimum of one hundred eighty (180) consecutive days. See Idaho Code 67-9403 Veteran: is a s defined in section 65-203, Idaho Code. See Idaho Code 67-5302 Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House. Warrant: means a negotiable instrument payable by the state treasury when funds become available for the stated purpose; a warrant may include, but is not necessarily limited to, a payment mechanism such as direct deposit, electronic fund transfer, paper warrant or other financial instrument.
