Terms Used In Indiana Code 20-28-5-8.5

  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Conviction: A judgement of guilt against a criminal defendant.
   Sec. 8.5. The department may, after holding a hearing on the matter, reinstate the license of a person whose license has been revoked under section 8 of this chapter if the person’s conviction has been reversed, vacated, or set aside on appeal.
