Terms Used In Louisiana Revised Statutes 33:3981.1

  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.

A.  The city of Shreveport, after having been petitioned by sixty percent of the property owners within the area to be served which is outside of the municipal limits but within Caddo Parish, or by a vote of a majority in number and amount of the resident property taxpayers in such area voting at an election held for this purpose, is hereby vested with full power and authority in its discretion to establish, acquire, construct, improve, extend, and maintain outside of the limits of the municipality, but within the parish of Caddo, a sewerage system or systems, including such sewerage disposal facilities as may be required, with all necessary equipment and installations in connection therewith, including such extensions as may be proper to connect the system or systems with the sewerage disposal facilities of the municipality or any other available system or facilities, whether within or without the municipality.

B.  The city of Shreveport shall have full power and authority to levy and collect local or special assessments on the real property to be benefited thereby within the area to be served, sufficient in amount to defray the total cost of said work, including the cost of street intersections and installations and connections necessary to connect said system with the main sewer system of the municipality or necessary to connect said system with any disposal facilities whether within or without the municipality, including the cost of establishing, constructing, improving, and extending any such disposal facilities, whether by purchase, lease, or otherwise, or including the cost of the construction of complete sewerage disposal facilities, either within or without the municipality all within the form and manner and subject to the limitations and restrictions contained in this Subpart, except that the provisions of La. Rev. Stat. 33:3982 shall not apply.

C.  Any construction or improvements shall be performed in compliance of the provisions of La. Rev. Stat. 38:2212.  The term “sewerage district” as used in this Subpart shall include the city of Shreveport.  The election provided for in this Section shall be held in accordance with Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950.
