Terms Used In Michigan Laws > Chapter 700 > Act 386 of 1998

  • Active business operations: means all business operations that are not inactive business operations. See Michigan Laws 700.7112
  • Active duty firearms standard: means the in-service standard for the training and qualification of active duty law enforcement officers as mandated by the commission under the commission on law enforcement standards act, 1965 PA 203, MCL 28. See
  • Added fat: means the addition of fat tissue originating from portions consisting of less than 12% muscle tissue in each portion. See Michigan Laws 700.3404
  • Added water: means greater moisture content than normally found in meat and, except for poultry, is determined by total moisture minus 4 times the percentage of protein. See Michigan Laws 700.3404
  • Adjudication of guilt: means any of the following:

    (i) Entry of a judgment or verdict of guilty, or guilty but mentally ill, following a trial. See

  • Administrative admission: means the admission of an individual with a developmental disability to a center pursuant to section 509. See Michigan Laws 330.1500
  • Administrator: means a local governmental unit or a nonprofit community organization under contract with a local governmental unit to administer a homestead program under this act. See Michigan Laws 700.2706
  • Administrator: means a local governmental unit, or a nonprofit community organization under contract with a local governmental unit. See Michigan Laws 700.2502
  • Adulterated: means food to which any of the following apply:

    (i) It bears or contains any poisonous or deleterious substance that may render it injurious to health unless the substance is not an added substance and the quantity of that substance in the food does not ordinarily render it injurious to health. See Michigan Laws 700.2504

  • Adulterated: means food or milk products to which any of the following apply:

    (i) It bears or contains any poisonous or deleterious substance that may render it injurious to health except that, if the substance is not an added substance, the food or milk product is not considered adulterated if the quantity of that substance in the food or milk product does not ordinarily render it injurious to health.   • Advance: means a transfer of funds made by a municipality to an authority or to another person on behalf of the authority in anticipation of repayment by the authority. See Michigan Laws 700.2909
  • Advance: means a transfer of funds made by a municipality to an authority or to another person on behalf of the authority in anticipation of repayment by the authority. See Michigan Laws 700.3206
  • Advance: means a transfer of funds made by a municipality to an authority or to another person on behalf of the authority in anticipation of repayment by the authority. See Michigan Laws 700.3413
  • Advertisement: means a representation disseminated in any manner or by any means, other than by labeling, for the purpose of inducing, or which is likely to induce, directly or indirectly, the purchase of food. See Michigan Laws 700.2504
  • Agency: means this state, a state authority, agency, fund, commission, board, or department of this state. See Michigan Laws 700.5424
  • Agent: includes , but is not limited to, an attorney-in-fact under a durable or nondurable power of attorney and an individual authorized to make decisions as a patient advocate concerning another's health care. See Michigan Laws 700.1103
  • Agent: means an agent or attorney in fact acting under a written power of attorney and within the scope of his, her, or its authority. See Michigan Laws 700.2901
  • Agricultural processing facility: means 1 or more facilities or operations that transform, package, sort, or grade livestock or livestock products, agricultural commodities, or plants or plant products, excluding forest products, into goods that are used for intermediate or final consumption including goods for nonfood use, and surrounding property. See Michigan Laws 700.2106
  • Alcoholic liquor: means that term as defined in section 105 of the Michigan liquor control code of 1998, 1998 PA 58, MCL 436. See
  • Alternative devise: means a devise that is expressly created by the will and, under the terms of the will, can take effect instead of another devise on the happening of 1 or more events, including survival of the testator or failure to survive the testator, whether an event is expressed in condition-precedent, condition-subsequent, or another form. See Michigan Laws 700.2601
  • Ancillary facility: means any revolving credit agreement, agreement establishing a line of credit or letter of credit, reimbursement agreement, interest rate exchange or similar agreement, currency exchange agreement, interest rate floor or cap, options, puts or calls to hedge payment, currency, rate, spread or similar exposure, or similar agreements, investment agreements, float agreements, forward agreements or other investment arrangements, insurance contract, surety bond, commitment to purchase or sell securities, purchase or sale agreements or commitments or other contracts or agreements and other security agreements approved by the authority, including without limitation any arrangements referred to in this act.   • annual meeting: when applied to townships, mean the annual meeting required by law to be held on the Saturday immediately preceding the first Monday in April. See Michigan Laws 324.51302
  • Applicable environmental requirement: means an applicable federal environmental requirement, an applicable state environmental requirement, or an environmental requirement established by a local unit of government. See Michigan Laws 324.80309
  • Applicable state environmental requirement: means any of the following or a rule promulgated or permit, order, or other legally binding document issued under any of the following:

    (i) Article II or chapter 1 or 3 of article III. See Michigan Laws 324.80309

  • Applicant: means an individual and the spouse of that individual if that spouse intends to occupy the property with the individual. See Michigan Laws 700.2606
  • Applicant: means an individual and the spouse of that individual if that spouse intends to occupy the property with the individual. See Michigan Laws 700.2706
  • Applicant: means 1 or more individuals, corporations, nonprofit corporations, partnerships, associations, limited liability companies, labor organizations, mutual corporations, joint stock companies, trusts, unincorporated associations, trustees, and entities formed under the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2901
  • Applicant: means an individual and the spouse of that individual if that spouse intends to occupy the property with the individual. See Michigan Laws 700.2502
  • Applicant: means an individual and the spouse of that individual if that spouse intends to occupy the property with the individual. See Michigan Laws 700.2511
  • Application: means a written request to the probate register for an order of informal probate or informal appointment under part 3 of article III. See Michigan Laws 700.1103
  • Application period: means the period beginning when an application for a permit is received by the state and ending when the application is considered to be administratively complete under section 1305 and any applicable fee has been paid. See Michigan Laws 324.80303
  • Approved laboratory: means a laboratory that has been evaluated by the department and is approved to perform tests on manufacturing milk and milk products. See Michigan Laws 700.1101
  • Articles: means the articles of incorporation of an authority. See Michigan Laws 324.80215
  • Articles pyrotechnic: means pyrotechnic devices for professional use that are similar to consumer fireworks in chemical composition and construction but not intended for consumer use, that meet the weight limits for consumer fireworks but are not labeled as such, and that are classified as UN0431 or UN0432 under 49 CFR 172. See Michigan Laws 324.1908
  • Artificial flavoring: means any flavoring containing any sapid or aromatic constituent manufactured by synthesis or similar process. See Michigan Laws 700.3404
  • Ascertainable standard: means a standard relating to an individual's health, education, support, or maintenance within the meaning of section 2041(b)(1)(A) or 2514(c)(1) of the internal revenue code, 26 USC 2041 and 2514. See Michigan Laws 700.7103
  • Assessed value: means the taxable value as determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.2909
  • Assessed value: means the taxable value as determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.3206
  • Assessed value: means the taxable value as determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.3413
  • Associated equipment: means any of the following that are not radio equipment:

    (i) An original system, part, or component of a personal watercraft at the time that boat was manufactured, or a similar part or component manufactured or sold for replacement. See Michigan Laws 324.80201

  • Attended terminal: means a terminal, other than a remote control terminal, where an individual knowledgeable in the aboveground liquid storage tank filling operation is physically in attendance and control during the entire delivery of a flammable liquid and has as his or her primary responsibility supervising the storage tank filling operation. See Michigan Laws 330.1426
  • Attorney: means , if appointed to represent a child under the provisions referenced in section 5213, an attorney serving as the child's legal advocate in the manner defined and described in section 13a of chapter XIIA of the probate code of 1939, 1939 PA 288, MCL 712A. See Michigan Laws 700.1103
  • Audited financial statement: means a fiscal year end financial statement prepared by a certified public accountant according to generally accepted accounting principles. See Michigan Laws 700.1101
  • Authority: means the Michigan state housing development authority created in the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2901
  • Authority: means a historical neighborhood tax increment finance authority created under this act. See Michigan Laws 700.2909
  • Authority: means a joint city-state environmental management authority created pursuant to section 902. See Michigan Laws 324.80215
  • Authority: means a corridor improvement authority created under section 4(1) or a joint authority created under section 4(2). See Michigan Laws 700.3206
  • Authority: means a neighborhood improvement authority created under this act. See Michigan Laws 700.3413
  • Authority: means a brownfield redevelopment authority created under this act. See Michigan Laws 700.1301
  • Authority: means the Michigan tobacco settlement finance authority created under section 4. See Michigan Laws 700.6303
  • Authorized individual: means an individual who by section 2959 or by the laws of the United States, including members of the diplomatic and consular service of the United States designated by foreign service regulations, is empowered to supervise the execution of international wills. See Michigan Laws 700.2951
  • Baseline environmental assessment: means that term as defined in part 201 or 213. See Michigan Laws 700.1301
  • Bed and breakfast: means a private residence that offers sleeping accommodations to transient tenants in 14 or fewer rooms for rent, is the innkeeper's residence in which the innkeeper resides while renting the rooms to transient tenants, and serves breakfasts, or other meals in the case of a bed and breakfast described in section 1107(t)(ii), at no extra cost to its transient tenants.   • Beneficiary: includes , but is not limited to, the following:

    (i) In relation to a trust, a person that is a trust beneficiary as defined in section 7103. See Michigan Laws 700.1103

  • Beneficiary designation: means the naming in a governing instrument of a beneficiary of an insurance or annuity policy, of an account with POD designation, of a security registered in beneficiary form (TOD), of a pension, profit-sharing, retirement, or similar benefit plan, or of another nonprobate transfer at death. See Michigan Laws 700.1103
  • Beneficiary form: means a registration of a security that indicates the present owner of the security and the owner's intention regarding the person who will become the security's owner upon the owner's death. See Michigan Laws 700.6301
  • Benefited parties: means persons, firms, or corporations that enter into ancillary facilities with the authority according to the provisions of this act. See Michigan Laws 700.6303
  • Binders: means food and nonfood substances used as an ingredient in comminuted meats for binding, stabilizing, thickening, or maintaining viscosity of the product. See Michigan Laws 700.3404
  • Blighted: means property that meets any of the following criteria as determined by the governing body:

    (i) Has been declared a public nuisance in accordance with a local housing, building, plumbing, fire, or other related code or ordinance. See Michigan Laws 700.1301

  • Board: means the governing body of an authority. See Michigan Laws 700.2909
  • Board: means the board of directors of the authority. See Michigan Laws 324.80215
  • Board: means the governing body of an authority. See Michigan Laws 700.3206
  • Board: means the Michigan natural resources trust fund board established in section 1905. See Michigan Laws 324.1901
  • Board: means the governing body of an authority. See Michigan Laws 700.3413
  • Board: means the board of directors of an enterprise community development corporation. See Michigan Laws 700.1105
  • Board: means the governing body of an authority. See Michigan Laws 700.1301
  • Board: means the board of directors of the authority. See Michigan Laws 700.6303
  • Board: means the municipal fire service classification board created by section 2. See
  • Board: means the state administrative board created in 1921 PA 2, MCL 17. See Michigan Laws 700.2106
  • Board: means the state fire safety board created in section 3b. See Michigan Laws 330.1426
  • Boating safety certificate: means either of the following:

    (i) The document issued by the department under this part that certifies that the individual named in the document has successfully completed a boating safety course and passed an examination approved and administered as required under section 80211. See Michigan Laws 324.80201

  • Boating safety course: means a course that meets both of the following requirements:

    (i) Provides instruction on the safe operation of a personal watercraft that meets or exceeds the minimum course content for boating or personal watercraft education established by the national association of state boating law administrators education committee (October 1996). See Michigan Laws 324.80201

  • Bond: means a bond, note, or other obligation issued by the authority under this act. See Michigan Laws 700.6303
  • Bonds or other evidences of indebtedness: means any instrument providing for the payment of money, executed by or on behalf of a public corporation or which a public corporation has assumed and agreed to pay, including, without limitation on the foregoing bonds, notes, contracts, leases and certificates, but shall not include bonds or other evidences of indebtedness issued pursuant to Act No. See Michigan Laws 700.8204
  • Border crossing facility: means a business that is 1 or more of the following as determined by the board of the Michigan strategic fund:

    (i) That was located in a qualified border local governmental unit as defined in section 8g and was displaced or otherwise negatively affected by the development of the international border crossing and is unable to recover from the displacement or negative effect without the establishment of a renaissance zone. See Michigan Laws 700.2106

  • Borrower: means a public corporation exercising the power to issue bonds as provided in this act or a county treasurer exercising the power to issue notes as provided in this act. See Michigan Laws 700.7611
  • Brownfield plan: means a plan that meets the requirements of section 13 and section 13b and is adopted under section 14. See Michigan Laws 700.1301
  • Building: means a structure, framework, or place for housing 1 or more persons or a tank, receptacle, or container for the storage of commodities or other materials. See Michigan Laws 330.1426
  • Bulk milk pickup tanker: means a vehicle including a truck, tank, and those appurtenances necessary for its use used by a bulk milk hauler/sampler to transport bulk raw milk for pasteurization from a dairy farm to a dairy plant, receiving station, or transfer station. See Michigan Laws 700.1102
  • Bureau: means the bureau of fire services created in section 1b. See Michigan Laws 330.1426
  • Business operations: means engaging in commerce in any form with a state sponsor of terror, including by acquiring, developing, maintaining, owning, selling, possessing, leasing, or operating equipment, facilities, personnel, products, services, personal property, real property, or any other apparatus of business or commerce. See Michigan Laws 700.7112
  • Butter: means the product usually known as butter that is made exclusively from wholesome milk or cream, or both, with or without common salt, and with or without additional coloring matter and containing not less than 80% by weight of milk fat. See Michigan Laws 700.1102
  • By-products or variety meats: means hearts, livers, brains, tongues, tripe, stomach, lungs, melts, eyes, weasand meats, head meat, cheek meat, salivary glands, udder, lips, ears, snouts, skin, feet, spleens, slaughterhouse by-products, spinal cords, cracklings or crackling meal, packinghouse by-products, food processor by-products, partially defatted fatty tissues, and partially defatted chopped meat. See Michigan Laws 700.3404
  • Candling: means the examination, in a partially darkened room or place, of the interior of an egg by twirling the egg before a bright light passing through an aperture in an opaque shield or by another approved method. See Michigan Laws 700.3404
  • Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in section 3(d), exceeds the initial assessed value. See Michigan Laws 700.2909
  • Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in section 3(e), exceeds the initial assessed value. See Michigan Laws 700.3206
  • Captured assessed value: means the amount in any 1 year by which the current assessed value of the development area, including the assessed value of property for which specific local taxes are paid in lieu of property taxes as determined in section 3(d), exceeds the initial assessed value.   • Captured taxable value: means the amount in 1 year by which the current taxable value of an eligible property subject to a brownfield plan, including the taxable value or assessed value, as appropriate, of the property for which specific taxes are paid in lieu of property taxes, exceeds the initial taxable value of that eligible property.   • certificate: means the certificate issued pursuant to section 6. See Michigan Laws 700.2716
  • Certificate: means a commission-issued document that identifies a qualified retired law enforcement officer who is certified under 18 USC 926C and this act. See
  • Certificate holder: means a qualified retired law enforcement officer who is issued a certificate by the commission. See
  • certified: means official recognition by the commission that a retired law enforcement officer has met the active duty firearms standard in this state and is eligible to carry a concealed firearm under 18 USC 926C. See
  • Certified health department: means a county, district, or city health department that meets the criteria for certification of health departments established by this act and that is authorized by the director to enforce this act for retail groceries, food processors, or fair concessions. See Michigan Laws 700.2703
  • Channel: means either of the following:

    (i) The deepest part of a stream, bay, or straight through which the main current flows. See Michigan Laws 324.80201

  • Charitable trust: means a trust, or portion of a trust, created for a charitable purpose described in section 7405(1). See Michigan Laws 700.7103
  • charter county: means a home rule county created under Act No. See Michigan Laws 700.5210
  • Cheese: means natural cheeses, processed cheeses, blended cheeses, cheese foods, cheese spreads, nonstandard cheese products, and related foods described in 21 CFR part 133. See Michigan Laws 700.1102
  • Chief executive officer: means the mayor or city manager of a city or the supervisor of a township. See Michigan Laws 700.2909
  • Chief executive officer: means the mayor of a city, the president of a village, or the supervisor of a township. See Michigan Laws 700.3206
  • Chief executive officer: means the mayor or city manager of a city or the president or village manager of a village. See Michigan Laws 700.3413
  • Chief executive officer: means the mayor or city manager of a city, the president of a village, the supervisor of a township, or the county executive of a county or, if a county does not have a county executive, the chairperson of the county board of commissioners. See Michigan Laws 700.1105
  • Chief executive officer: means the mayor of a city, the village manager of a village, the township supervisor of a township, or the county executive of a county or, if the county does not have an elected county executive, the chairperson of the county board of commissioners.   • chief of an organized fire department: means the chief operating officer of an organized fire department. See Michigan Laws 330.1426
  • Child: includes , but is not limited to, an individual entitled to take as a child under this act by intestate succession from the parent whose relationship is involved. See Michigan Laws 700.1103
  • Child: means an individual less than 17 years of age. See Michigan Laws 324.80192
  • Child: means an individual less than 14 years of age. See Michigan Laws 700.5412
  • Citation: means that term as described in section 17a. See Michigan Laws 324.1908
  • Claim: includes , but is not limited to, in respect to a decedent's or protected individual's estate, a liability of the decedent or protected individual, whether arising in contract, tort, or otherwise, and a liability of the estate that arises at or after the decedent's death or after a conservator's appointment, including funeral and burial expenses and costs and expenses of administration.   • Class member: includes , but is not limited to, an individual who fails to survive the testator but who would have taken under a devise in the form of a class gift had he or she survived the testator. See Michigan Laws 700.2601
  • Clean corporate citizen: means a facility that has demonstrated environmental stewardship and a strong environmental ethic by meeting the criteria in this part. See Michigan Laws 324.80309
  • cleaned-in-place: means the procedure by which sanitary pipelines or pieces of dairy equipment are mechanically cleaned in place by circulation. See Michigan Laws 700.1102
  • Clearinghouse: means the missing child information clearinghouse established under section 9. See Michigan Laws 324.80192
  • Clinical certificate: means the written conclusion and statements of a physician or a licensed psychologist that an individual is a person requiring treatment, together with the information and opinions, in reasonable detail, that underlie the conclusion, on the form prescribed by the department or on a substantially similar form. See Michigan Laws 330.1400
  • Code: means the United States internal revenue code of 1986, as amended, and any successor provision of law. See Michigan Laws 700.6303
  • Color additive: means a dye, pigment, or other substance that is made by a process of synthesis or similar artifice or is extracted, isolated, or otherwise derived, with or without intermediate or final change of identity from a vegetable, animal, mineral, or other source, or when added or applied to a food or any part of a food is capable alone or through reaction with other substances of imparting color to the food.   • Combined brownfield plan: means a brownfield plan that also includes the information necessary to submit the plan to the department or Michigan strategic fund under section 15(20). See Michigan Laws 700.1301
  • Combustible liquid: means a liquid with a flash point at or above 100 degrees Fahrenheit and below 200 degrees Fahrenheit. See Michigan Laws 330.1426
  • Commercial housing property: means that portion of real property not occupied by an owner of that real property that is classified as residential real property under section 34c of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.2716
  • Commercial manufacturer: means a person engaged in the manufacture of consumer fireworks. See Michigan Laws 324.1908
  • Commercial property: means land improvements classified by law for general ad valorem tax purposes as real property including buildings and improvements assessable as real property pursuant to sections 8(d) and 14(6) of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.2716
  • Comminuted: means chopped, diced, flaked, ground, or otherwise reduced to minute particles. See Michigan Laws 700.3404
  • Commission: means the state tax commission created by 1927 PA 360, MCL 209. See Michigan Laws 700.2716
  • Commission: means the commission of natural resources. See Michigan Laws 324.80208
  • Commission: means the commission on law enforcement standards established under section 3 of the commission on law enforcement standards act, 1965 PA 203, MCL 28. See
  • Commission: means the Michigan commission on law enforcement standards created in section 3 of the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28. See

    (i) Has been in existence for at least 10 years. See Michigan Laws 700.3806

  • Company: means any sole proprietorship, organization, association, corporation, partnership, joint venture, limited partnership, limited liability partnership, limited liability company, or other entity or business association, including all wholly owned subsidiaries, majority-owned subsidiaries, parent companies, or affiliates of those entities or business associations, that exists for profit-making purposes. See Michigan Laws 700.7112
  • Competent clinical opinion: means the clinical judgment of a physician, psychiatrist, or licensed psychologist. See Michigan Laws 330.1400
  • Concession: means an agreement between the department and a person under terms and conditions as specified by the department to provide services or recreational opportunities for public use. See Michigan Laws 324.83101
  • Conservator: means a person appointed by a court to manage a protected individual's estate. See Michigan Laws 700.1103
  • Construction period tax capture revenues: means funds equal to the amount of income tax levied and imposed in a calendar year upon wages paid to individuals physically present and working within the eligible property for the construction, renovation, or other improvement of eligible property that is an eligible activity within a transformational brownfield plan. See Michigan Laws 700.1301
  • Consumer: means an individual who is a member of the public, takes possession of food, is not functioning in the capacity of an operator of a food establishment or food processor, and does not offer the food for resale. See Michigan Laws 700.2504
  • Consumer fireworks: means fireworks devices that are designed to produce visible effects by combustion, that are required to comply with the construction, chemical composition, and labeling regulations promulgated by the United States consumer product safety commission under 16 CFR parts 1500 and 1507, and that are listed in APA standard 87-1, 3.   • Consumer fireworks certificate: means a certificate issued under section 4. See Michigan Laws 324.1908
  • Contested case: means that term as defined in section 3 of the administrative procedures act of 1969, 1969 PA 306, MCL 24. See
  • Controlled substance: means that term as defined in section 7104 of the public health code, 1978 PA 368, MCL 333. See
  • Conviction: means a final conviction, the payment of a fine, a plea of guilty or nolo contendere if accepted by the court, a finding of guilt, or a probate court or family division disposition on a violation of this part, regardless of whether the penalty is rebated or suspended.   • Coordinator: means the coordinator of environmental education provided for in section 2503. See Michigan Laws 324.2502
  • Core item: means a provision in the food code that is not designated as a priority item or a priority foundation item. See Michigan Laws 700.2504
  • Corporation: means an enterprise community development corporation organized under this act. See Michigan Laws 700.1105
  • Corrective action: means that term as defined in part 111 or part 213. See Michigan Laws 700.1301
  • Cost-of-living adjustment factor: means a fraction, the numerator of which is the United States consumer price index for the prior calendar year and the denominator of which is the United States consumer price index for 1997. See Michigan Laws 700.1103
  • costs: means the costs of purchasing, acquiring, constructing, improving, enlarging, extending, or repairing a public improvement, including any engineering, architectural, legal, accounting, financial, and other expenses incident to the public improvement. See Michigan Laws 700.7611
  • Cottage food operation: means a person who produces or packages cottage food products only in a kitchen of that person's primary domestic residence within this state. See Michigan Laws 700.2504
  • Cottage food product: means a food that is not potentially hazardous food as that term is defined in the food code. See Michigan Laws 700.2504
  • County treasurer: means an elected county treasurer or a county treasurer appointed under section 5 of 1923 PA 199, MCL 201. See Michigan Laws 700.7611
  • Court: means the probate court or the court with responsibility with regard to mental health services for the county of residence of the subject of a petition, or for the county in which the subject of a petition was found. See Michigan Laws 330.1400
  • Court: means the probate court or the court with responsibility with regard to mental health matters for the county in which an individual with a developmental disability resides or was found. See Michigan Laws 330.1500
  • Court: means the probate court or, when applicable, the family division of circuit court. See Michigan Laws 700.1103
  • Court: means the probate court for the county in which an individual, for whom a request for substance use disorder treatment and rehabilitation services has been made or a petition for involuntary treatment has been filed, either resides or is found. See Michigan Laws 700.5412
  • Court: means the probate court or the court with responsibility with regard to mental health services for the county in which a minor who has requested hospitalization, for whom a request for hospitalization has been made, or who has been hospitalized pursuant to this chapter either resides or was found. See Michigan Laws 700.7201
  • Court: means the probate court or the court with responsibility with regard to mental health services for the county of residence of an individual with developmental disability, or for the county in which the individual was found if a county of residence cannot be determined. See Michigan Laws 700.7410
  • Cream: means any of the following:

    (i) Light cream containing not less than 18% but not more than 30% milkfat. See Michigan Laws 700.1102

  • Credit card: means a card or device issued under a credit card arrangement by a person licensed under 1984 PA 379, MCL 493. See Michigan Laws 700.5510
  • Credit card arrangement: means an unsecured extension of credit for purchasing goods or services from the credit card issuer or any other person that is made to the holder of a credit card and that is accessed with a credit card. See Michigan Laws 700.5510
  • Credit card policy: means a policy adopted by resolution of a local unit under section 3. See Michigan Laws 700.5510
  • Criminal abuse: means 1 or more of the following:

    (i) An assault that is a violation or an attempt or conspiracy to commit a violation of sections 81 to 90 of the Michigan penal code, Act No. See Michigan Laws 700.7615

  • Criteria for judicial admission: means the criteria specified in section 515 for admission of an adult with a developmental disability to a center, private facility, or alternative program of care and treatment under section 518. See Michigan Laws 330.1500
  • Dairy animal: means any domesticated lactating mammal, including a cow, goat, sheep, water buffalo, or other hooved mammal, which is managed and milked to obtain milk for human consumption. See Michigan Laws 700.1103
  • Dairy farm: means any place or premises where 1 or more dairy animals are kept for milking purposes, and from which a part or all of the milk is provided, sold, or offered for sale. See Michigan Laws 700.1103
  • Dealer: means a person and an authorized representative of that person who annually purchases from a manufacturer, or who is engaged in selling or manufacturing, 6 or more personal watercraft that require certificates of number under part 801. See Michigan Laws 324.80201
  • Dealer: means a person, not a manufacturer, engaged in the business of buying and selling explosives. See Michigan Laws 330.1512
  • Delinquent tax revenues: means the delinquent taxes, interest, penalties and fees, and chargebacks of uncollected delinquent taxes due or to become due to local units of government to be collected by a county treasurer as agent for the local unit of government in connection with a delinquent tax system and pledged to any borrowing by a county treasurer under section 7b. See Michigan Laws 700.7611
  • Delinquent tax system: means the delinquent tax revolving fund in any county created and designated under section 87b of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.7611
  • Department: means the department of treasury. See Michigan Laws 700.2716
  • Department: means the department of agriculture and rural development. See Michigan Laws 700.2505
  • Department: means the department, agency, or officer authorized by this act to approve or deny an application for a particular permit. See Michigan Laws 324.80303
  • Department: means the department of environmental quality. See Michigan Laws 324.80309
  • Department: means the department of state police. See Michigan Laws 324.80192
  • Department: means the department of environmental quality. See Michigan Laws 324.2301
  • Department: means the department of environmental quality. See Michigan Laws 324.2701
  • Department: means the director of the department of natural resources or his or her designee to whom the director delegates a power or duty by written instrument. See Michigan Laws 324.80208
  • Department: means the department of licensing and regulatory affairs. See Michigan Laws 324.1908
  • Department: means the department of treasury. See Michigan Laws 700.5424
  • Department: means the department of environmental quality. See Michigan Laws 700.1301
  • Department: means the department of labor and economic growth. See Michigan Laws 330.1426
  • Department: means the department of natural resources. See Michigan Laws 324.80201
  • Department: means the Michigan department of agriculture. See Michigan Laws 700.1103
  • Department: means the department of natural resources. See Michigan Laws 324.83101
  • Department of natural resources: means the principal state department created in section 501. See Michigan Laws 324.80208
  • Department specific activities: means baseline environmental assessments, due care activities, response activities, and other environmentally related actions that are eligible activities and are identified as a part of a brownfield plan that are in addition to the minimum due care activities required by part 201, including, but not limited to:

    (i) Response activities that are more protective of the public health, safety, and welfare and the environment than required by section 20107a, 20114, or 21304c of the natural resources and environmental protection act, 1994 PA 451, MCL 324. See Michigan Laws 700.1301

  • Dependent: means any individual who was substantially reliant for support upon the income of the deceased public safety officer. See
  • deposit: includes purchase of, or investment in, shares of a credit union. See Michigan Laws 700.5109
  • deposit: includes the purchase of, or investment in, shares of a credit union. See Michigan Laws 700.5301
  • Depository: means that department of the financial institution which is responsible for managing, investing, and reinvesting funds placed in an investment pool. See Michigan Laws 700.5316
  • Descendant: means , in relation to an individual, all of his or her descendants of all generations, with the relationship of parent and child at each generation being determined by the definitions of child and parent contained in this act. See Michigan Laws 700.1103
  • Development area: means that area described in section 5 to which a development plan is applicable that is located inside a historic district. See Michigan Laws 700.2909
  • Development area: means that area described in section 5 to which a development plan is applicable. See Michigan Laws 700.3206
  • Development area: means that area described in section 5 to which a development plan is applicable. See Michigan Laws 700.3413
  • Development plan: means that information and those requirements for a development area set forth in section 22. See Michigan Laws 700.2909
  • Development plan: means that information and those requirements for a development area set forth in section 21. See Michigan Laws 700.3206
  • Development plan: means that information and those requirements for a development area set forth in section 19. See Michigan Laws 700.3413
  • Development plan: means a written plan that addresses the criteria in section 7 and includes all of the following:

    (i) A map of the proposed renaissance zone that indicates the geographic boundaries, the total area, and the present use and conditions generally of the land and structures within those boundaries. See Michigan Laws 700.2106

  • Development program: means the implementation of the development plan. See Michigan Laws 700.2909
  • Development program: means the implementation of the development plan. See Michigan Laws 700.3206
  • Development program: means the implementation of the development plan. See Michigan Laws 700.3413
  • Devise: means , when used as a noun, a testamentary disposition of real or personal property and, when used as a verb, to dispose of real or personal property by will. See Michigan Laws 700.1103
  • Devise: includes , but is not limited to, an alternative devise, a devise in the form of a class gift, and an exercise of a power of appointment. See Michigan Laws 700.2601
  • Devisee: means a person designated in a will to receive a devise. See Michigan Laws 700.1103
  • Devisee: includes , but is not limited to, the following:

    (i) A class member if the devise is in the form of a class gift. See Michigan Laws 700.2601

  • Direct and proximate: means that the antecedent event is a substantial factor in the result. See
  • Director: means the director of the department or his or her designee. See Michigan Laws 700.2505
  • Director: means the director of the state department authorized under this act to approve or deny an application for a particular permit or the director's designee. See Michigan Laws 324.80303
  • Director: means the director of the department or his or her designee. See Michigan Laws 324.80309
  • Director: means the director of the department. See Michigan Laws 324.2301
  • Director: means the director of the department of natural resources. See Michigan Laws 324.80208
  • Director: means the director of the department of labor and economic growth. See Michigan Laws 330.1426
  • Director: means the director of the department of natural resources. See Michigan Laws 324.80201
  • Director: means the director of the Michigan department of agriculture or his or her designee. See Michigan Laws 700.1103
  • Director: means the director of the department of state police. See Michigan Laws 330.1512
  • Director: means the director of the department. See Michigan Laws 324.83101
  • Disability: means cause for a protective order as described in section 5401. See Michigan Laws 700.1103
  • Disclaimable interest: includes , but is not limited to, property, the right to receive or control property, and a power of appointment. See Michigan Laws 700.2901
  • Discretionary trust provision: means a provision in a trust, regardless of whether the terms of the trust provide a standard for the exercise of the trustee's discretion and regardless of whether the trust contains a spendthrift provision, that provides that the trustee has discretion, or words of similar import, to determine 1 or more of the following:

    (i) Whether to distribute to or for the benefit of an individual or a class of beneficiaries the income or principal or both of the trust. See Michigan Laws 700.7103

  • Display fireworks: means large fireworks devices that are explosive materials intended for use in fireworks displays and designed to produce visible or audible effects by combustion, deflagration, or detonation, as provided in 27 CFR 555. See Michigan Laws 324.1908
  • Distributee: means a person that receives a decedent's property from the decedent's personal representative or trust property from the trustee other than as a creditor or purchaser. See Michigan Laws 700.1103
  • Distributor: means a person other than a producer or processor who offers for sale, holds for sale, or sells at wholesale milk or dairy products. See Michigan Laws 700.1103
  • district: means the territory of a next Michigan development corporation. See Michigan Laws 700.3616
  • Do-not-resuscitate order: means that term as defined in section 2 of the Michigan do-not-resuscitate procedure act, 1996 PA 193, MCL 333. See Michigan Laws 700.1103
  • Domestic residence: means a single-family dwelling or an area within a rental unit where a single person or family actually resides. See Michigan Laws 700.2505
  • Dry milk product: means a product resulting from the drying of milk or a dairy product. See Michigan Laws 700.1103
  • Dryer: means equipment that dries milk or a dairy product. See Michigan Laws 700.1103
  • Elected county executive: means the elected county executive in a county organized under 1966 PA 293, MCL 45. See Michigan Laws 700.2106
  • Elector: means an individual who has the qualifications of an elector under section 492 of the Michigan election law, 1954 PA 116, MCL 168. See
  • eligible activity: means 1 or more of the following:

    (i) For all eligible properties, eligible activities include all of the following:

    (A) Department specific activities. See Michigan Laws 700.1301

  • Eligible next Michigan business: means a business engaged in the shipment of tangible personal property via multimodal commerce; a supply chain business providing a majority of its services to businesses engaged in the shipment of tangible personal property, including inventory, via multimodal commerce; a manufacturing or assembly facility receiving a majority of its production components via multimodal commerce; a manufacturing or assembly facility shipping a majority of products via multimodal commerce; or a light manufacturing or assembly facility that packages, kits, labels, or customizes products and ships those products via multimodal commerce. See Michigan Laws 700.2106
  • Eligible property: means , except as otherwise provided in this subdivision, property for which eligible activities are identified under a brownfield plan that was used or is currently used for commercial, industrial, public, or residential purposes, including personal property located on the property, to the extent included in the brownfield plan, and that is 1 or more of the following:

    (i) Is in a qualified local governmental unit and is a facility or a site or property as those terms are defined in part 213, historic resource, functionally obsolete, or blighted and includes parcels that are adjacent or contiguous to that property if the development of the adjacent and contiguous parcels is estimated to increase the captured taxable value of that property. See Michigan Laws 700.1301

  • Eligible urban entity: means a city with a population of 100,000 or more and is the largest city within a metropolitan statistical area as defined by the United States office of management and budget. See Michigan Laws 700.3616
  • Encumbered tobacco revenues: means that portion of the TSRs that is pledged by the authority to the repayment of any bonds under the terms of the applicable authority resolution, trust agreement, or trust indenture. See Michigan Laws 700.6303
  • Enhanced driver license: means an operator's or chauffeur's license issued to an individual under this act for the following purposes:

    (i) Use in entering the United States at land and sea ports. See Michigan Laws 324.80220

  • Enhanced official state personal identification card: means an official state personal identification card issued under this act to an individual who is a United States citizen who resides in this state for the following purposes:

    (i) Use in entering the United States at land and sea ports. See Michigan Laws 324.80220

  • Enterprise community: means an area designated as an enterprise community by the United States department of housing and urban development or the United States department of agriculture. See Michigan Laws 700.1105
  • Environmental education: means the teaching of factual information regarding the natural environment, including basic sciences, ecological sciences, agricultural sciences, and other relevant subject matter, and the interdisciplinary process of developing a citizenry that is knowledgeable about the total environment and has the capacity and the commitment to engage in inquiry, problem solving, decision making, and action that will assure environmental quality. See Michigan Laws 324.2502
  • Environmental law: means a federal, state, or local law, rule, regulation, or ordinance that relates to the protection of the environment or human health. See Michigan Laws 700.1104
  • Environmental management system: means the part of an overall management system that addresses environmental concerns through allocating resources, assigning responsibilities, and evaluating practices, procedures, and processes to achieve sound environmental performance. See Michigan Laws 324.80309
  • Environmental policy: means a policy, signed by an authorized official of the facility, that does all of the following:

    (i) Articulates the facility's environmental mission and values. See Michigan Laws 324.80309

  • Estate: includes the property of the decedent, trust, or other person whose affairs are subject to this act as the property is originally constituted and as it exists throughout administration. See Michigan Laws 700.1104
  • Evaluation: means a food safety audit, inspection, or food safety and sanitation assessment, whether announced or unannounced, that identifies violations or verifies compliance with this act and determines the degree of active control by food establishment operators over foodborne illness risk factors. See Michigan Laws 700.2505
  • Executive director: means the executive director of the commission appointed under this act. See
  • Exempt property: means property of a decedent's estate that is described in section 2404. See Michigan Laws 700.1104
  • Explosive: means blasting powder, nitroglycerine, dynamite, TNT and any other form of high explosive, blasting material, fuse other than an electric circuit breaker, detonator and other detonating agent, a chemical compound or mechanical mixture containing oxidizing or combustible units, or other ingredients, in such proportions, quantities or packing that ignition by fire, friction, concussion or other means of detonation of the compound or mixture or any part thereof may result in the sudden generation and release of highly heated gases or gaseous pressures capable of producing effects damaging or detrimental to or destructive of life, limb or property. See Michigan Laws 330.1512
  • Extended retail food establishment: means a retail grocery that does both of the following:

    (i) Serves or provides an unpackaged food for immediate consumption. See Michigan Laws 700.2505

  • Extenders: means food substances used as an ingredient in comminuted meats primarily for replacement of meat ingredients. See Michigan Laws 700.3404
  • Facility: except as otherwise provided in this act, means a building or group of contiguous buildings. See Michigan Laws 700.2716
  • Facility: means any of the following that is situated in this state and is subject to an applicable state environmental requirement or applicable federal environmental requirement:

    (i) A source as defined in section 5501. See Michigan Laws 324.80309

  • Facility: means that term as defined in part 201. See Michigan Laws 700.1301
  • Facility: means all of the following that regularly admit individuals with developmental disability and provide residential and other services:

    (i) A facility as defined in section 100b. See Michigan Laws 700.7410

  • Fair: means a fair or exhibition operated and managed under 1929 PA 11, MCL 46. See Michigan Laws 700.2505
  • Family allowance: means the allowance prescribed in section 2403. See Michigan Laws 700.1104
  • Family residential real estate: means real property located in this state, to be newly constructed for residential purposes and intended for occupancy by a single family, 2 families, or 3 families and that is constructed using funds provided as a construction period loan, a bridge loan, or other temporary financing with a term of not more than 24 months and that are provided under the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2901
  • Farm tank: means the farm bulk milk tank, milk tank truck, or silo used for the storage or cooling of milk, or both, before pickup and transport from the farm. See Michigan Laws 700.1104
  • Fat: means the quantity of adipose tissue determined by chemical analysis. See Michigan Laws 700.3404
  • Federal act: means the federal food, drug, and cosmetic act, chapter 675, 52 Stat. See Michigan Laws 700.2505
  • Federal act: means the federal food, drug, and cosmetic act, 21 USC 301 to 321, 331 to 360dd, 360hh to 376, and 378 to 399. See Michigan Laws 700.1104
  • Federal bankruptcy code: means the federal bankruptcy code, 11 USC 101 to 1330. See Michigan Laws 700.6303
  • Felony: means , except as otherwise provided in this subdivision, that term as defined in section 1 of chapter I of the code of criminal procedure, 1927 PA 175, MCL 761. See Michigan Laws 324.80314
  • Festival: means an event, staged by a local community or local organization, that centers on and celebrates a certain aspect of that community or organization. See Michigan Laws 700.2505
  • Fiduciary: includes , but is not limited to, a personal representative, funeral representative, guardian, conservator, trustee, plenary guardian, partial guardian, and successor fiduciary. See Michigan Laws 700.1104
  • Fiduciary: means any of the following:

    (i) The Michigan legislative retirement system board of trustees for the Tier 1 retirement plan available under the Michigan legislative retirement system act, 1957 PA 261, MCL 38. See Michigan Laws 700.7112

  • Fiduciary: includes , but is not limited to, an agent, a conservator, a guardian if no conservator has been appointed, a guardian ad litem, a personal representative, a trustee, a probate court acting through a protective order under this act, and a temporary, successor, or foreign fiduciary. See Michigan Laws 700.2901
  • Fiduciary power: means a management power relating to the administration or management of assets similar to those powers granted to a personal representative in section 3715 and a trustee in sections 7816 and 7817, and granted by law to a fiduciary or conferred upon a fiduciary in a governing instrument. See Michigan Laws 700.2901
  • Financial institution: means an organization authorized to do business under state or federal laws relating to a financial institution and includes, but is not limited to, a bank, trust company, savings bank, building and loan association, savings and loan company or association, credit union, insurance company, and entity that offers mutual fund, securities brokerage, money market, or retail investment accounts. See Michigan Laws 700.1104
  • financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and, except as provided in subsection (2), maintains a principal office or branch office located in this state under the laws of this state or the United States. See Michigan Laws 700.5201
  • financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and which maintains a principal office or branch office located in this state under the laws of this state or the United States. See Michigan Laws 700.5216
  • financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and which maintains a principal office or branch office located in this state under the laws of this state or the United States. See Michigan Laws 700.5301a
  • financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and that maintains a principal office or branch office located in this state under the laws of this state or the United States. See Michigan Laws 700.5306a
  • Financial institution: means a state or nationally chartered bank or a state or federally chartered savings and loan association, savings bank, or credit union whose deposits are insured by an agency of the United States government and which maintains a principal office or branch office located in this state under the laws of this state or the United States and which is eligible to be a depository of surplus funds belonging to the state under section 6 of 1855 PA 105, MCL 21. See Michigan Laws 700.5316
  • Financial transaction device: means any of the following:

    (i) An electronic funds transfer card. See Michigan Laws 700.5506

  • Financing costs: means all capitalized interest, operating and debt service reserves, costs of issuance, fees for credit and liquidity enhancements, any item of expense directly or indirectly payable or reimbursable by the authority and related to the authorization, sale, or issuance of bonds, including without limitation underwriting fees, counsel fees, fees of the attorney general and fees and expenses of consultants and fiduciaries, and other costs as the authority determines to be desirable in issuing, securing, and marketing the bonds. See Michigan Laws 700.6303
  • Fire alarm system: means an assemblage of components that indicates or provides a warning of a fire emergency, installation of which is required by the bureau under rules promulgated under section 3c. See Michigan Laws 330.1426
  • Fire hazard: means a building, premises, place, or thing that, because of its nature, location, occupancy, condition, or use, may cause loss, damage, or injury to persons or property by fire, explosion, or action of the elements. See Michigan Laws 330.1426
  • Fire service classification scale: means the criteria by which a fire service delivery system is evaluated. See
  • Fire service delivery system: means all the equipment, personnel, procedures, and resources which are utilized in the prevention and suppression of fire. See
  • Fire suppression system: means an integrated combination of a fire alarm system and fire suppression equipment that, as a result of predetermined temperature, rate of temperature rise, products of combustion, flame, or human intervention, will discharge a fire extinguishing substance over a fire area, installation of which is required by the bureau under rules promulgated under section 3c. See Michigan Laws 330.1426
  • firearm: except as otherwise specifically defined in statute, includes any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 324.51503c
  • Firearm: means any weapon which will, is designed to, or may readily be converted to expel a projectile by action of an explosive. See Michigan Laws 324.80314
  • Firearm: means that term as defined in section 1 of 1927 PA 372, MCL 28. See
  • Firearms records: means any form, information, or record required for submission to a government agency under sections 2, 2a, 2b, and 5b, or any form, permit, or license issued by a government agency under this act. See Michigan Laws 324.80314
  • Firefighter: means a member of an organized fire department, including a volunteer member or a member paid on call, who is responsible for, or is in a capacity that includes responsibility for, the extinguishment of fires, the directing of the extinguishment of fires, the prevention and detection of fires, and the enforcement of the general fire laws of this state. See Michigan Laws 330.1426
  • Firefighter: means that term as defined in section 2 of the firefighters training council act, 1966 PA 291, MCL 29. See Michigan Laws 330.1532
  • Firefighter training: means that term as defined in section 2 of the firefighters training council act, 1966 PA 291, MCL 29. See Michigan Laws 330.1532
  • fireworks: means any composition or device, except for a starting pistol, a flare gun, or a flare, designed for the purpose of producing a visible or audible effect by combustion, deflagration, or detonation. See Michigan Laws 324.1908
  • Fireworks safety fund: means the fireworks safety fund created in section 11. See Michigan Laws 324.1908
  • Firm: means a sole proprietorship, partnership, association, or corporation. See Michigan Laws 330.1426
  • Fiscal year: means the fiscal year of the authority. See Michigan Laws 700.2909
  • Fiscal year: means the fiscal year of the authority. See Michigan Laws 700.3206
  • Fiscal year: means the fiscal year of the authority. See Michigan Laws 700.3413
  • Fiscal year: means the fiscal year of the authority. See Michigan Laws 700.1301
  • Flammable liquid: means a liquid with a flash point below 100 degrees Fahrenheit and a vapor pressure that does not exceed 40 pounds per square inch absolute at 100 degrees Fahrenheit. See Michigan Laws 330.1426
  • Food: means articles used for food or drink for humans or other animals, chewing gum, and articles used for components of any such article. See Michigan Laws 700.2505
  • Food additive: means any substance, the intended use of which, directly or indirectly, results in or may be reasonably expected to result in its becoming a component or otherwise affecting the characteristics of any food if that substance is not generally recognized among experts as having been adequately shown through scientific procedures to be safe under the conditions of its intended use. See Michigan Laws 700.2505
  • Food code: means "Food Code, 2009 Recommendations of the United States Public Health Service Food and Drug Administration" which regulates the design, construction, management, and operation of certain food establishments. See Michigan Laws 700.2505
  • Food establishment: means an operation where food is processed, packed, canned, preserved, frozen, fabricated, stored, prepared, served, vended, sold, or offered for sale. See Michigan Laws 700.2505
  • Food processor: means a food establishment that processes, manufactures, wholesales, packages, labels, or stores food. See Michigan Laws 700.2505
  • Food service establishment: means a fixed or mobile restaurant, coffee shop, cafeteria, short order cafe, luncheonette, grill, tearoom, sandwich shop, soda fountain, tavern, bar, cocktail lounge, nightclub, drive-in, industrial feeding establishment, private organization serving the public, rental hall, catering kitchen, delicatessen, theater, commissary, food concession, or similar place in which food or drink is prepared for direct consumption through service on the premises or elsewhere, and any other eating or drinking establishment or operation where food is served or provided for the public. See Michigan Laws 700.2505

  • Food service program: means the systematic activity of the department and a local health department for effective administration and enforcement of the food code and this act, including all of the following:

    (i) Periodic evaluations of food service establishments, temporary food service establishments, vending machines, and vending machine locations for compliance with law. See Michigan Laws 700.2703

  • Food warehouse: means a food establishment that stores or distributes food for wholesale. See Michigan Laws 700.2505
  • Foodborne illness outbreak: means an incident where any of the following occur:

    (i) Two or more persons, not of the same household, have ingested a common food and have a similar disease or similar symptoms or excrete the same pathogens, and there is a time, place, or person association between these persons. See Michigan Laws 700.2703

  • Foreign country: means a country, including a political subdivision thereof, other than the United States, that authorizes the issuance of support orders and 1 or more of the following:

    (i) That has been declared under the law of the United States to be a foreign reciprocating country. See Michigan Laws 552.2102

  • Foreign personal representative: means a personal representative appointed by another jurisdiction. See Michigan Laws 700.1104
  • Foreign support order: means a support order of a foreign tribunal. See Michigan Laws 552.2102
  • Forest products processing facility: means 1 or more facilities or operations that transform, package, sort, recycle, or grade forest or paper products into goods that are used for intermediate or final use or consumption or for the creation of biomass or alternative fuels through the utilization of forest products or forest residue, and surrounding property. See Michigan Laws 700.2106
  • Forest recreation account: means the forest recreation account of the legacy fund provided for in section 2005. See Michigan Laws 324.2001
  • Forest recreation account: means the forest recreation account of the Michigan conservation and recreation legacy fund provided for in section 2005. See Michigan Laws 324.83101
  • Formal proceedings: means proceedings conducted before a judge with notice to interested persons. See Michigan Laws 700.1104
  • Formal voluntary hospitalization: means hospitalization of an individual based on both of the following:

    (i) The execution of an application for voluntary hospitalization by the individual or by a patient advocate designated under the estates and protected individuals code, 1998 PA 386, MCL 700. See Michigan Laws 330.1400

  • Former employing law enforcement agency: means a law enforcement agency in this state that was the employer of, or that issued an oath of office to, a law enforcement officer licensed under the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28. See
  • Freezer: means mechanical equipment used to lower the temperature of a mix while, at the same time, incorporating air into the mix. See Michigan Laws 700.1104
  • Frozen desserts: means desserts made from dairy products described in 21 CFR part 135, the mixes, and other similar frozen dairy products that include, but are not limited to, frozen yogurt, soft serve ice cream, and quiescently frozen confections unless otherwise specified by the department. See Michigan Laws 700.1104
  • Functionally obsolete: means that the property is unable to be used to adequately perform the function for which it was intended due to a substantial loss in value resulting from factors such as overcapacity, changes in technology, deficiencies or superadequacies in design, or other similar factors that affect the property itself or the property's relationship with other surrounding property. See Michigan Laws 700.1301
  • fund: means the forest and mineral resource development fund created in section 703. See Michigan Laws 324.80210
  • Funds: means the money of a public corporation, the investment of which is not otherwise subject to a public act of this state or bond authorizing ordinance or resolution of a public corporation that permits investment in fewer than all of the investment options listed in subsection (1) or imposes 1 or more conditions upon an investment in an option listed in subsection (1). See Michigan Laws 700.5306a
  • Funeral establishment: means that term as defined in section 1801 of the occupational code, 1980 PA 299, MCL 339. See Michigan Laws 700.1104
  • Funeral representative: means an individual designated to have the right and power to make decisions about funeral arrangements and the handling, disposition, or disinterment of a decedent's body, including, but not limited to, decisions about cremation, and the right to possess cremated remains of the decedent as provided in section 3206. See Michigan Laws 700.1104
  • Funeral representative designation: means a written document executed and with the effect as described in sections 3206 to 3206b. See Michigan Laws 700.1104
  • Game and fish protection account: means the game and fish protection account of the legacy fund provided for in section 2010. See Michigan Laws 324.2001
  • General personal representative: means a personal representative other than a special personal representative. See Michigan Laws 700.1104
  • Governing body: means the legislative body, council, commission, board, or other body having legislative powers of a public corporation. See Michigan Laws 700.5306a
  • Governing body: means the board of supervisors of a county, the township board of a township, the council, common council, or commission of a city, the council, commission or board of trustees of a village, the board of education or district board of a school district, the county drain commissioner or drainage board of a drainage district, the legislative body of a metropolitan district, the port commission of a port district and, in the case of any other public corporation, the official or official body to whom is designated general governing or legislative powers by law. See Michigan Laws 700.5404
  • Governing body: means the legislative body or the official or official body that exercises the general governing powers of a public corporation, or in the case of this state or an agency of this state, the official body designated by law to issue the obligation to be replaced. See Michigan Laws 700.5408
  • Governing body: means the board, council, or other official body that has general governing powers over a local unit. See Michigan Laws 700.5414
  • Governing body: means the body in which the legislative powers of a municipality are vested. See Michigan Laws 700.1105
  • Governing body: means any of the following:

    (i) The council, commission, or other entity vested with the legislative power of a village. See Michigan Laws 700.5506

  • Governing body: means any of the following:

    (i) The council, commission, or other entity vested with the legislative power of a village. See Michigan Laws 700.5510

  • Governing body: means the elected body having legislative powers of a municipality creating an authority under this act. See Michigan Laws 700.1301
  • Governing body: means for a county, the board of commissioners; for a city, the body having legislative powers; for a village, the body having legislative powers; for a township, the township board; for a school district, the board of education; for a port district, the port commission; for a metropolitan district, the legislative body of the district; for a municipal health facilities corporation, the board of trustees; for a nonprofit subsidiary municipal health facilities corporation, the nonprofit subsidiary board; and for an authority, the body in which is lodged general governing powers. See Michigan Laws 700.7611
  • governing body of a municipality: means the elected body of a municipality having legislative powers. See Michigan Laws 700.2909
  • governing body of a municipality: means the elected body of a municipality having legislative powers. See Michigan Laws 700.3413
  • Governing entity: means either of the following, as applicable:

    (i) For any public body except a public body described in subparagraph (ii), the governing board of the public body. See

  • Governing instrument: means a deed; will; trust; funeral representative designation; insurance or annuity policy; account with POD designation; security registered in beneficiary form (TOD); pension, profit-sharing, retirement, or similar benefit plan; instrument creating or exercising a power of appointment or a power of attorney; or dispositive, appointive, or nominative instrument of any similar type. See Michigan Laws 700.1104
  • Governing instrument: includes , but is not limited to, a court order. See Michigan Laws 700.1501
  • Governing instrument: means a deed, assignment, bill of sale, will, trust, beneficiary designation, contract, instrument creating or exercising a power of appointment or a power of attorney, or another instrument under which property devolves, a property right is created, or a contract right is created. See Michigan Laws 700.2901
  • Grade: means the fire protection level which a fire service delivery system achieves on the fire service classification scale. See
  • grantee: may be construed as including every person to whom any such interest or estate passes in like manner. See Michigan Laws 324.30323
  • grantor: may be construed as including every person from or by whom any estate in lands passes in or by any deed. See Michigan Laws 324.30323
  • Guardian: means a person who has qualified as a guardian of a minor or a legally incapacitated individual under a parental or spousal nomination or a court appointment and includes a limited guardian as described in sections 5205, 5206, and 5306. See Michigan Laws 700.1104
  • Guide for the control of molluscan shellfish: means section II, model ordinance, national shellfish sanitation program guide for the control of molluscan shellfish, 2009, recommendations of the U. See Michigan Laws 700.2506
  • HACCP plan: means a written document that delineates the formal procedures for following the hazard analysis and critical control point principles developed by the National Advisory Committee on Microbiological Criteria for Foods. See Michigan Laws 700.2506
  • Hazardous material: means explosives, pyrotechnics, flammable gas, flammable compressed gas, nonflammable compressed gas, flammable liquid, combustible liquid, oxidizing material, poisonous gas, poisonous liquid, irritating material, etiologic material, radioactive material, corrosive material, or liquefied petroleum gas. See Michigan Laws 330.1426
  • Hazardous substance: means a substance defined as hazardous or toxic or otherwise regulated by an environmental law. See Michigan Laws 700.1104
  • Health care corporation: means a nonprofit health care corporation operating under the nonprofit health care corporation reform act, Act No. See Michigan Laws 700.7615
  • Health care insurer: means an insurer authorized to provide health insurance in this state or a legal entity that is self-insured and provides health care benefits to its employees. See Michigan Laws 700.7615
  • Health maintenance organization: means an organization licensed under part 210 of the public health code, Act No. See Michigan Laws 700.7615
  • Health professional: means an individual licensed or otherwise authorized to engage in a health profession under article 15 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 700.5412
  • Heir: means , except as controlled by section 2720, a person, including the surviving spouse or the state, that is entitled under the statutes of intestate succession to a decedent's property. See Michigan Laws 700.1104
  • Highly restricted personal information: includes an individual's photograph or image, social security number, digitized signature, and medical and disability information and source documents presented by an applicant to obtain a personal identification card under section 1. See Michigan Laws 324.80205
  • Highly restricted personal information: means an individual's photograph or image, social security number, digitized signature, and medical and disability information. See Michigan Laws 324.80301
  • Historic district: means that term as defined in section 1a of the local historic districts act, 1970 PA 169, MCL 399. See Michigan Laws 700.2909
  • Historic resource: means that term as defined in section 90a of the Michigan strategic fund act, 1984 PA 270, MCL 125. See Michigan Laws 700.1301
  • Homestead agreement: means a written contract between a housing commission and a qualified buyer that contains the terms under which the qualified buyer may acquire the single-family public housing property. See Michigan Laws 700.2706
  • Homestead agreement: means a written contract between a resident organization or successor entity and a qualified buyer that contains the terms under which the qualified buyer may acquire the public housing property. See Michigan Laws 700.2511
  • Homestead allowance: means the allowance prescribed in section 2402. See Michigan Laws 700.1104
  • Hospital: means a hospital licensed under part 215 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 700.5412
  • Housing: means privately owned housing or publicly owned housing, individual or multifamily. See Michigan Laws 700.2909
  • Housing: means publicly owned housing, individual or multifamily. See Michigan Laws 700.3413
  • Housing commission: means a housing commission or housing authority as defined under section 3 of the housing cooperation law, 1937 PA 293, MCL 125. See Michigan Laws 700.2706
  • Housing commission: means a housing commission or housing authority as defined under section 3 of the housing cooperation law, 1937 PA 293, MCL 125. See Michigan Laws 700.2511
  • Housing project: means that term as defined under section 3 of the housing cooperation law, 1937 PA 293, MCL 125. See Michigan Laws 700.2706

  • Imminent or substantial hazard: means a condition at a food establishment that the director determines requires immediate action to prevent endangering the health of people. See Michigan Laws 700.2506
  • Imminent or substantial health hazard: means a determination by the director of either or both of the following:

    (i) A condition that exists at a dairy farm or dairy plant requiring immediate action to prevent endangering the public health or safety. See Michigan Laws 700.1104

  • in writing: shall be construed to include printing, engraving, and lithographing; except that if the written signature of a person is required by law, the signature shall be the proper handwriting of the person or, if the person is unable to write, the person's proper mark, which may be, unless otherwise expressly prohibited by law, a clear and classifiable fingerprint of the person made with ink or another substance. See Michigan Laws 324.51502
  • Inactive business operations: means the mere continued holding or renewal of rights to property previously operated for the purpose of generating revenues but not presently deployed for that purpose. See Michigan Laws 700.7112
  • Incapacitated individual: means an individual who is impaired by reason of mental illness, mental deficiency, physical illness or disability, chronic use of drugs, chronic intoxication, or other cause, not including minority, to the extent of lacking sufficient understanding or capacity to make or communicate informed decisions. See Michigan Laws 700.1105
  • Income: includes earnings or other periodic entitlements to money from any source and any other property subject to withholding for support under the law of this state. See Michigan Laws 552.2102
  • Income tax: means the tax levied and imposed under part 1 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 700.1301
  • Income tax capture revenues: means funds equal to the amount for each tax year by which the aggregate income tax from individuals domiciled within the eligible property subject to a transformational brownfield plan exceeds the initial income tax value. See Michigan Laws 700.1301
  • Income-withholding order: means an order or other legal process directed to an obligor's employer or other debtor, as defined by the support and parenting time enforcement act, 1982 PA 295, MCL 552. See Michigan Laws 552.2102
  • Informal proceedings: means proceedings for probate of a will or appointment of a personal representative conducted by the probate register without notice to interested persons. See Michigan Laws 700.1105
  • Infrastructure improvements: means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. See Michigan Laws 700.1301
  • Initial assessed value: means the assessed value of all the taxable property within the boundaries of the development area at the time the ordinance establishing the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality at the time the resolution is adopted. See Michigan Laws 700.2909
  • Initial assessed value: means the assessed value, as equalized, of all the taxable property within the boundaries of the development area at the time the resolution establishing or amending the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality for which equalization has been completed at the time the resolution is adopted. See Michigan Laws 700.3206
  • Initial assessed value: means the assessed value of all the taxable property within the boundaries of the development area at the time the ordinance establishing the tax increment financing plan is approved, as shown by the most recent assessment roll of the municipality at the time the resolution is adopted.   • Initial taxable value: means the taxable value of an eligible property identified in and subject to a brownfield plan at the time the resolution adding that eligible property in the brownfield plan is adopted, as shown either by the most recent assessment roll for which equalization has been completed at the time the resolution is adopted or, if provided by the brownfield plan, by the next assessment roll for which equalization will be completed following the date the resolution adding that eligible property in the brownfield plan is adopted.   • initiate a service credit purchase: means to complete payment or to enter into a tax-deferred payment arrangement in a form and manner prescribed by the retirement system. See Michigan Laws 324.80195
  • Inspection: means the checking or testing of observable practices against standards established in or adopted by this act, accompanied by a report of findings. See Michigan Laws 700.2506
  • Interested person or entity: means an adult relative or friend of the respondent, an official or representative of a public or private agency, corporation, or association concerned with the individual's welfare, or any other person found suitable by the court. See Michigan Laws 700.7410
  • Interests of the trust beneficiaries: means the beneficial interests provided in the terms of the trust. See Michigan Laws 700.7103
  • International will: means a will executed in conformity with this part. See Michigan Laws 700.2951
  • Investment officer: means the treasurer or other person designated by statute or charter of a public corporation to act as the investment officer. See Michigan Laws 700.5306a
  • Investment pool: means a local government investment pool authorized in section 3. See Michigan Laws 700.5414
  • Involuntary mental health treatment: means court-ordered hospitalization, alternative treatment, or combined hospitalization and alternative treatment as described in section 468. See Michigan Laws 330.1400
  • Iran: means any agency or instrumentality of Iran. See Michigan Laws 700.7209
  • Iran linked business: means either of the following:

    (i) A person engaging in investment activities in the energy sector of Iran, including a person that provides oil or liquefied natural gas tankers or products used to construct or maintain pipelines used to transport oil or liquefied natural gas for the energy sector of Iran. See Michigan Laws 700.7209

  • Issue: means an individual's descendant. See Michigan Laws 700.1105
  • Issuing officer: means an officer of a local police or sheriff's department, or a designated officer of the state police. See Michigan Laws 330.1512
  • Issuing state: means the state in which a tribunal issues a support order or a judgment determining parentage of a child. See Michigan Laws 552.2102
  • Issuing tribunal: means the tribunal of a state or foreign country that issues a support order or a judgment determining parentage of a child. See Michigan Laws 552.2102
  • Joint property: means property that is owned by 2 or more persons with rights of survivorship, and includes a tenancy by the entireties in real property, a tenancy in personal property as provided in section 1 of 1927 PA 212, MCL 557. See Michigan Laws 700.2901
  • Joint tenants with the right of survivorship: includes , but is not limited to, co-owners or ownership of property held under circumstances that entitle 1 or more to the whole of the property on the death of the other or others, but does not include forms of co-ownership registration in which the underlying ownership of each party is in proportion to that party's contribution. See Michigan Laws 700.1105
  • Juice: means the aqueous liquid expressed or extracted from 1 or more fruits or vegetables, purees of the edible portions of 1 or more fruits or vegetables, or any concentrates of such liquid or puree. See Michigan Laws 700.2506
  • Label: means a display of written, printed, or graphic matter on the immediate container of any article and includes a requirement imposed under this act that any word, statement, or other information appearing on the display also appear on the outside container or wrapper of the retail package of the article or be easily legible through the outside container or wrapper. See Michigan Laws 700.2506
  • Label: means a display of written, printed, or graphic matter upon the immediate container of any article conforming to a requirement imposed under this act that any word, statement, or other information appearing on the label also appears on the outside container or wrapper of the retail package of the article or be easily legible through the outside container or wrapper. See Michigan Laws 700.1104
  • Labeling: means all labels and other written, printed, or graphic matter upon an article, any of its containers or wrappers, or accompanying the article. See Michigan Laws 700.2506
  • Labeling: means all labels and other written, printed, or graphic matter upon an article or any of its containers or wrappers or accompanying the article. See Michigan Laws 700.1104
  • Lamb: means meat derived from sheep less than 1 year of age. See Michigan Laws 700.3404
  • Land bank fast track authority: means an authority created under the land bank fast track act, 2003 PA 258, MCL 124. See Michigan Laws 700.1301
  • Land use plan: means a plan prepared under former 1921 PA 207, former 1943 PA 184, or a site plan under the Michigan zoning enabling act, 2006 PA 110, MCL 125. See Michigan Laws 700.3206
  • Land use plan: means a plan prepared under former 1921 PA 207 or a site plan under the Michigan zoning enabling act, 2006 PA 110, MCL 125. See Michigan Laws 700.3413
  • Law: includes decisional and statutory law and rules and regulations having the force of law. See Michigan Laws 552.2102
  • Law enforcement agency: means the department; a police agency of a city, village, or township; a sheriff's department; or any other governmental law enforcement agency in this state. See Michigan Laws 324.80192
  • Law enforcement agency: means an entity of this state or of a local unit of government of this state that employs peace officers. See Michigan Laws 324.2707
  • Law enforcement agency: means an entity that is established and maintained in accordance with the laws of this state and is authorized by the laws of this state to appoint or employ law enforcement officers. See
  • Law enforcement officer: means :

    (i) Except as provided in subparagraph (ii), an individual employed by a law enforcement agency as 1 or more of the following:

    (A) An individual authorized by law, including common law, to prevent and detect crime and enforce the general criminal laws of this state. See

  • law enforcement officer: means that term as defined in section 2 of the commission on law enforcement standards act, 1965 PA 203, MCL 28. See
  • Law enforcement officer: means that term as defined in section 2 of the commission on law enforcement standards act, 1965 PA 203, MCL 28. See Michigan Laws 330.1410
  • Law enforcement training academy: means any of the following:

    (i) An agency basic law enforcement training academy. See

  • Law of another state: means a law or ordinance enacted by any of the following:

    (i) Another state. See Michigan Laws 324.80102

  • Lawyer-guardian ad litem: means an attorney appointed under section 5213 or 5219 who has the powers and duties referenced by and provided in section 5213. See Michigan Laws 700.1105
  • Lease: includes , but is not limited to, an oil, gas, or other mineral lease. See Michigan Laws 700.1105
  • Lease: means a conveyance by the department to a person of a portion of the state's interest in land under specific terms and for valuable consideration, thereby granting to the lessee the possession of that portion conveyed during the period stipulated. See Michigan Laws 324.83101
  • Legacy fund: means the Michigan conservation and recreation legacy fund established in section 40 of article IX of the state constitution of 1963 and provided for in section 2002. See Michigan Laws 324.2001
  • Legally incapacitated individual: means an individual, other than a minor, for whom a guardian is appointed under this act or an individual, other than a minor, who has been adjudged by a court to be an incapacitated individual. See Michigan Laws 700.1105
  • LEIN: means law enforcement information network regulated under the C. See Michigan Laws 324.80192
  • Letters: includes , but is not limited to, letters testamentary, letters of guardianship, letters of administration, and letters of conservatorship. See Michigan Laws 700.1105
  • License: means documentation of licensure by the commission under this act. See
  • License holder: means the person who is legally responsible for the operation of a food establishment including the owner, the owner's agent, or other person operating under apparent authority of the owner and who possesses a valid license to operate a food establishment. See Michigan Laws 700.2506
  • License limitation: means an action by which the director imposes restrictions or conditions, or both, on a license of a food establishment. See Michigan Laws 700.2506
  • Licensing standards: means the requirements with which a person must comply for licensure as a law enforcement officer under this act. See
  • Licensure: means a determination by the commission that both of the following occurred in compliance with this act and rules promulgated under this act:

    (i) The person to whom the license is issued commenced employment as a law enforcement officer, subject to a written oath of office or other written instrument conferring law enforcement authority. See

  • Limited food processor: means a food processor that had in the preceding licensing year or is reasonably anticipated to have in the current licensing year $25,000. See Michigan Laws 700.2506
  • Line of duty: means either of the following:

    (i) Any action which an officer whose primary function is crime control or reduction, enforcement of the criminal law, or suppression of fires is obligated or authorized by rule, regulations, condition of employment or service, or law to perform, including those social, ceremonial, or athletic functions to which the officer is assigned, or for which the officer is compensated, by the public agency he or she serves. See

  • Local administration: means administration by a personal representative appointed in this state under an appointment proceeding described in article III. See Michigan Laws 700.4101
  • Local corrections officer: means that term as defined in section 2 of the local corrections officers training act, 2003 PA 125, MCL 791. See Michigan Laws 324.80314
  • Local government agency: means a county, city, village, or township in this state. See Michigan Laws 324.80220
  • Local governmental unit: means a county, city, village, or township. See Michigan Laws 700.2606
  • Local governmental unit: means a county, city, village, or township. See Michigan Laws 700.2706
  • Local governmental unit: means a county, city, village, township, or charter township. See Michigan Laws 700.3616
  • Local governmental unit: means a county, city, village, township, or, for taxes levied after 2009, any other taxing jurisdiction that levies an ad valorem property tax. See Michigan Laws 700.2106
  • Local governmental unit: means a county, city, village, or township. See Michigan Laws 700.2502
  • Local governmental unit: means a county, city, village, or township. See Michigan Laws 700.2511
  • Local health department: means that term as defined in section 1105 of the public health code, MCL 333. See Michigan Laws 700.2506
  • Local personal representative: includes a personal representative appointed in this state under an appointment proceeding described in article III and excludes a foreign personal representative who acquires the power of a local personal representative under section 4203. See Michigan Laws 700.4101
  • Local taxes: means all taxes levied other than taxes levied for school operating purposes. See Michigan Laws 700.1301
  • Local unit: means a county, city, village, township, school district, authority, or any other political subdivision organized under the laws of this state. See Michigan Laws 700.5316
  • Local unit: means a county, city, village, township, authority created pursuant to state law or municipal charter, special assessment district, municipal board or commission established under state law or municipal charter, or intergovernmental board, commission, or council established pursuant to the urban cooperation act of 1967, Act No. See Michigan Laws 700.5414
  • Local unit: means any of the following:

    (i) A village. See Michigan Laws 700.5506

  • Local unit: means any of the following:

    (i) A village. See Michigan Laws 700.5510

  • Local unit of government: means a county, city, township, village, school district, the Huron-Clinton metropolitan authority, or any authority composed of counties, cities, townships, villages, or school districts, or any combination thereof, which authority is legally constituted to provide public recreation. See Michigan Laws 324.1901
  • Local unit of government: means a municipality or county. See Michigan Laws 324.80208
  • Local unit of government: means a city, village, or township. See Michigan Laws 324.1908
  • Low-impact fireworks: means ground and handheld sparkling devices as that phrase is defined under APA standard 87-1, 3. See Michigan Laws 324.1908
  • Low-risk food: means any of the following:

    (i) Raw or prepackaged food that is not potentially hazardous food (time/temperature control for safety food). See Michigan Laws 700.2506

  • Manufacturer: means a person engaged in any of the following:

    (i) The manufacture, construction, or assembly of personal watercraft or associated equipment. See Michigan Laws 324.80201

  • Marihuana: means that term as defined in section 7106 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 330.1420
  • Marine safety act: means former Act No. See Michigan Laws 324.80103
  • Master settlement agreement: means the settlement agreement and related documents entered into on November 23, 1998, and incorporated into a consent decree and final judgment entered into on December 7, 1998, in Kelley Ex Rel. See Michigan Laws 700.6303
  • Meat: means the edible part of clean, sound striated muscle of cattle, swine, sheep, deer and other cervids, goat, turkey, duck, ratite, or chicken slaughtered in compliance with all applicable laws, with or without the accompanying and overlying fat, and sinew, nerve, gland, and blood vessels which normally accompany the muscle tissues and which are not separated from it in the process of dressing. See Michigan Laws 700.3404
  • Medical benefit plan: means a plan to provide for the payment of medical, optical, or dental benefits, including, but not limited to, hospital and physician services, prescription drugs, and related benefits. See
  • mental disability: includes Alzheimer's disease and dementia. See Michigan Laws 324.80192
  • Mental health professional: means an individual who is trained and experienced in the area of mental illness or developmental disabilities and who is 1 of the following:

    (i) A physician who is licensed to practice medicine or osteopathic medicine and surgery in this state under article 15 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 700.1106

  • Mental illness: means a substantial disorder of thought or mood that significantly impairs judgment, behavior, capacity to recognize reality, or ability to cope with the ordinary demands of life. See Michigan Laws 330.1400
  • Michigan bridge card: means the card used for the electronic benefit transfer system for food stamp distribution required under section 14h of the social welfare act, 1939 PA 280, MCL 400. See Michigan Laws 700.2506
  • Michigan conservation and recreation legacy fund: means the Michigan conservation and recreation legacy fund established in section 40 of article IX of the state constitution of 1963 and provided for in section 2002. See Michigan Laws 324.80208
  • Michigan prudent investor rule: means the fiduciary investment and management rule prescribed by part 5 of this article. See Michigan Laws 700.1106
  • Michigan state housing development authority: means the Michigan state housing development authority created under section 21 of the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2706
  • Michigan state housing development authority: means the Michigan state housing development authority created under section 21 of the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2511
  • Michigan strategic fund: means the Michigan strategic fund as described in the Michigan strategic fund act, 1984 PA 270, MCL 125. See Michigan Laws 700.3616
  • Michigan strategic fund: means the Michigan strategic fund created under the Michigan strategic fund act, 1984 PA 270, MCL 125. See Michigan Laws 700.1301
  • Michigan tribal law enforcement officer: means an individual employed as a law enforcement officer by a federally recognized Indian tribe that has trust lands located within this state, subject to a written instrument authorizing the individual to enforce the laws of this state. See
  • Michigan vehicle code: means Act No. See Michigan Laws 324.80103
  • Micro market: means an operation that does all of the following:

    (i) Offers for sale commercially prepackaged foods properly labeled for individual sale as required under section 3-201. See Michigan Laws 700.2506

  • Milk: means the lacteal secretion, practically free from colostrum, obtained by the complete milking of 1 or more healthy cows, goats, sheep, or other dairy animals. See Michigan Laws 700.1105
  • Milk buyer: means any milk producer, milk producer marketing organization, dairy plant, receiving station, transfer station, or bulk milk hauler that either takes delivery of raw milk or a raw milk product or manages the sale of the raw milk or raw milk product, or both. See Michigan Laws 700.1105
  • milk plant: means any place, premises, or establishment where milk or dairy products are collected, handled, processed, stored, pasteurized, aseptically processed, packaged, or prepared for distribution. See Michigan Laws 700.1103
  • milk product: means products that include, but are not limited to, evaporated milk, condensed skim milk, condensed milk, condensed buttermilk, condensed milk solids, concentrate milk, nonfat dry milk, dry milk, dry cream, dry whey, dry buttermilk, butter, buttermilk, cheese, cheese products, ice cream, sherbet, frozen desserts, dairy confections, or novelties, related dairy products with butter fat or milk solids substitutions, filtered milk components, infant formula manufactured with dairy ingredients, whey, whey cream, and other products for human consumption not regulated under the grade A milk law of 2001 or as determined appropriate by the director. See Michigan Laws 700.1103
  • Milk tank truck: means both a bulk milk pickup tanker and a milk transport tank. See Michigan Laws 700.1105
  • Milk tank truck cleaning facility: means any place, premises, or establishment, separate from a dairy plant, receiving station, or transfer station where a milk tank truck is cleaned and sanitized. See Michigan Laws 700.1105
  • Milk tank truck driver: means any person who transports raw or pasteurized dairy products to or from a dairy plant, receiving station, or transfer station. See Michigan Laws 700.1105
  • Milk transportation company: means the company that is the person responsible for a milk tank truck. See Michigan Laws 700.1105
  • Minor: means an individual who is less than 18 years of age. See Michigan Laws 700.1106
  • Minor: means an individual who is less than 18 years of age. See Michigan Laws 324.1908
  • Minor: means an individual 14 or more years of age and less than 18 years of age. See Michigan Laws 700.5412
  • Minor requiring treatment: means either of the following:

    (i) A minor with a substantial disorder of thought or mood that significantly impairs judgment, behavior, capacity to recognize reality, or ability to cope with the ordinary demands of life. See Michigan Laws 700.7201

  • Minor ward: means a minor for whom a guardian is appointed solely because of minority. See Michigan Laws 700.1106
  • Misbranded: means food to which any of the following apply:

    (i) Its labeling is false or misleading in any particular. See Michigan Laws 700.2506

  • Misbranded: means food to which any of the following apply:

    (i) Its labeling is false or misleading in any particular. See Michigan Laws 700.1106

  • Misdemeanor: means a violation of a penal law of this state or violation of a local ordinance substantially corresponding to a violation of a penal law of this state that is not a felony or a violation of an order, rule, or regulation of a state agency that is punishable by imprisonment or a fine that is not a civil fine, or both. See Michigan Laws 324.80314
  • Missing senior or vulnerable adult: means a resident of this state who is 1 of the following:

    (i) At least 60 years of age and is believed to be incapable of returning to his or her residence without assistance and is reported missing by a person familiar with that individual. See

  • Mix: means ice cream mix, yogurt mix, sherbet mix, and any other unfrozen pasteurized liquid mixture which is to be manufactured into a frozen dessert including a liquid mixture intended for processing into quiescently frozen confections. See Michigan Laws 700.1106
  • Mobile food establishment: means a food establishment operating from a vehicle, including a watercraft, that returns to a mobile food establishment commissary for servicing and maintenance at least once every 24 hours. See Michigan Laws 700.2506
  • Mobile food establishment commissary: means an operation that is capable of servicing a mobile food establishment. See Michigan Laws 700.2506
  • Money: means legal tender or a note, draft, certificate of deposit, stock, bond, check, or credit card. See Michigan Laws 700.1106
  • Money: means any legal tender, note, draft, certificate of deposit, stock, bond, check, or credit card. See Michigan Laws 700.7615
  • month: means a calendar month; the word "year" a calendar year; and the word "year" alone shall be equivalent to the words "year of our Lord". See Michigan Laws 324.30501
  • Monument fund: means the Michigan police officers memorial monument fund created in section 3. See Michigan Laws 330.1410
  • Mortgage: means a conveyance, agreement, or arrangement in which property is encumbered or used as security. See Michigan Laws 700.1106
  • Motorboat: means a vessel propelled wholly or in part by machinery. See Michigan Laws 324.80103
  • Municipality: means a city or township in which a historic district is located. See Michigan Laws 700.2909
  • Municipality: means 1 of the following:

    (i) A city. See Michigan Laws 700.3206

  • Municipality: means a city or a village. See Michigan Laws 700.3413
  • Municipality: means a city, village, township, or county. See Michigan Laws 700.3806
  • Municipality: means a city, village, or township. See Michigan Laws 324.80208
  • Municipality: means a county, city, village, or township. See Michigan Laws 600.588
  • Municipality: means a county, city, village, or township. See Michigan Laws 700.1105
  • Municipality: means a city, village, township, or county. See
  • Municipality: means all of the following:

  • Net proceeds: means the amount of proceeds remaining following each sale of bonds which are not required by the authority to establish and fund reserve or escrow funds or termination or settlement payments under ancillary facilities and to provide the financing costs and other expenses and fees directly related to the authorization and issuance of bonds. See Michigan Laws 700.6303
  • Net revenues: means the revenues of a public improvement remaining after deducting the reasonable expenses of administration, operation, and maintenance of the public improvement. See Michigan Laws 700.7611
  • Next Michigan development corporation: means an eligible act 7 entity or eligible urban entity that meets the requirements of section 4 and has been so designated by the board of the Michigan strategic fund. See Michigan Laws 700.3616
  • Next Michigan development corporation: means that term as defined in section 3 of the next Michigan development act. See Michigan Laws 700.2106
  • Next Michigan development district: means that term as defined in section 3 of the next Michigan development act. See Michigan Laws 700.2106
  • Next Michigan renaissance zone: means a renaissance zone created under section 8h. See Michigan Laws 700.2106
  • NFPA: means the national fire protection association headquartered at 1 Batterymarch Park, Quincy, Massachusetts. See Michigan Laws 324.1908
  • Noncommercial transportation: means the occasional transportation of personal property by an individual not for compensation or in the furtherance of a commercial enterprise, and transportation not regulated under the motor carrier safety act of 1963, 1963 PA 181, MCL 480. See Michigan Laws 330.1426
  • Nonperishable food: means food that is not perishable food. See Michigan Laws 700.2506
  • Nonprofit community organization: means an organization exempt from taxation under section 501(c)(3) of the internal revenue code of 1986 with experience in housing issues and that contracts with a housing commission to administer an urban homesteading program for single-family public housing under this act. See Michigan Laws 700.2706
  • Nonprofit community organization: means an organization exempt from taxation under section 501(c)(3) of the internal revenue code of 1986 with experience in housing issues and that contracts with a local governmental unit to administer an urban homestead program under this act. See Michigan Laws 700.2502
  • Nonprofit dental care corporation: means a dental care corporation incorporated under Act No. See Michigan Laws 700.7615
  • Nonresident decedent: means a decedent who was domiciled in another jurisdiction at the time of his or her death. See Michigan Laws 700.1106
  • oath: shall be construed to include the word "affirmation" in all cases where by law an affirmation may be substituted for an oath; and in like cases the word "sworn" shall be construed to include the word "affirmed". See Michigan Laws 324.30502
  • Obligation: means evidence of indebtedness including, but not limited to, a bond, refunding bond, revenue bond, note, certificate of indebtedness and other like instrument issued by a public corporation, and any coupon representing interest on the obligation. See Michigan Laws 700.5408
  • Obligations: means any evidence of indebtedness, such as bonds, bills, notes, orders, certificates of indebtedness or other like instruments, issued by a public corporation. See Michigan Laws 700.5404
  • Obligee: means 1 or more of the following:

    (i) An individual to whom a duty of support is or is alleged to be owed or in whose favor a support order or a judgment determining parentage of a child has been issued. See Michigan Laws 552.2102

  • Obligor: means an individual about whom 1 of the following is true, or the estate of a decedent about whom 1 of the following was true before the individual's death:

    (i) Owes or is alleged to owe a duty of support. See Michigan Laws 552.2102

  • Obligor: means either of the following:

    (i) A person or entity that has borrowed the proceeds of an obligation from a public corporation and is contractually obligated to make loan repayments sufficient to pay principal of and interest on the obligation. See Michigan Laws 700.5408

  • Obsolete properties tax: means the specific tax levied under this act. See Michigan Laws 700.2716
  • Obsolete property: means commercial property or commercial housing property, that is 1 or more of the following:

    (i) Blighted, as that term is defined in section 2 of the brownfield redevelopment financing act, 1996 PA 381, MCL 125. See Michigan Laws 700.2716

  • Obsolete property rehabilitation district: means an area of a qualified local governmental unit established as provided in section 3. See Michigan Laws 700.2716
  • Off-road vehicle account: means the off-road vehicle account of the legacy fund provided for in section 2015. See Michigan Laws 324.2001
  • Offering for sale: means selling, offering to sell, holding for sale, preparing for sale, trading, bartering, offering as a gift as an inducement for sale of, and advertising for sale in any media. See Michigan Laws 700.1107
  • Officer: means the village president, clerk, or treasurer, a village trustee, or an appointed person authorized by the council. See
  • officer: means any individual serving a public agency or any authority, district, board, or other entity created in whole or in part by 1 or more cities, counties, villages, or townships, in an official capacity, with or without compensation, as a law enforcement officer, firefighter, or member of a rescue squad or ambulance crew. See
  • Operate: means to be in control of a vessel while the vessel is under way and is not secured in some manner such as being docked or at anchor. See Michigan Laws 324.80103
  • Operate: means to be in control of a personal watercraft while the personal watercraft is under way and is not docked or at anchor or secured in another way. See Michigan Laws 324.80201
  • Operating expenses: means the reasonable operating expenses of the authority, including without limitation the cost of preparation of accounting and other reports, costs of maintenance of the ratings on the bonds, insurance premiums, and costs of authority meetings or other required activities of the authority, counsel fees, including the fees of the attorney general, and fees and expenses incurred for consultants and fiduciaries and any other costs described in section 4(12). See Michigan Laws 700.6303
  • Operator: means the person who is in control or in charge of a personal watercraft while that vessel is under way. See Michigan Laws 324.80201
  • Opioid antagonist: means naloxone hydrochloride or any other similarly acting and equally safe drug approved by the federal food and drug administration for the treatment of drug overdose. See Michigan Laws 324.2707
  • Opioid-related overdose: means a condition, including, but not limited to, extreme physical illness, decreased level of consciousness, respiratory depression, coma, or death, that results from the consumption or use of an opioid or another substance with which an opioid was combined or that a reasonable person would believe to be an opioid-related overdose that requires medical assistance. See Michigan Laws 324.2707
  • Order: means the legislative enactment of a county treasurer's powers under this act. See Michigan Laws 700.7611
  • Ordinance: means an ordinance, resolution, or other appropriate legislative enactment of the governing body of a public corporation. See Michigan Laws 700.7611
  • Organization: means a corporation, business trust, estate, trust, partnership, limited liability company, association, or joint venture; governmental subdivision, agency, or instrumentality; public corporation; or another legal or commercial entity. See Michigan Laws 700.1106
  • Organized fire department: means an organization or department which provides a fire service delivery system within a municipality and is a fire department of a municipality or is a fire service delivery system designated by a municipality pursuant to a contract with that municipality. See
  • Organized fire department: means a department, authority, or other governmental entity that safeguards life and property from damage from explosion, fire, or disaster and that provides fire suppression and other related services in this state. See Michigan Laws 330.1426
  • Organized fire department: means that term as defined in section 2 of the firefighters training council act, 1966 PA 291, MCL 29. See Michigan Laws 330.1532
  • Other security: means a mutually acceptable producer security agreement, acceptable to the director, approved and signed by the milk buyer and all milk sellers selling milk to that milk buyer. See Michigan Laws 700.1107
  • Outstanding: means , when used with respect to bonds, all bonds other than bonds that shall have been paid in full at maturity or that may be considered not outstanding under the applicable authority resolution, trust indenture or trust agreement authorizing the issuance of the bonds and when used with respect to ancillary facilities, all ancillary facilities other than ancillary facilities that have been paid in full or that may be considered not outstanding under such ancillary facilities. See Michigan Laws 700.6303
  • Owned by or under the control of: means that a land bank fast track authority or a qualified local unit of government has 1 or more of the following:

    (i) An ownership interest in the property. See Michigan Laws 700.1301

  • Owner: means a person who claims or is entitled to lawful possession of a vessel by virtue of that person's legal title or equitable interest in a vessel. See Michigan Laws 324.80103
  • Owner: means a person with an ownership interest in property, and includes a trustee, a board of trustees of property, and a person with a freehold interest in property. See Michigan Laws 330.1426
  • Owner: means a person who claims or is entitled to lawful possession of a personal watercraft by virtue of that person's legal title or equitable interest in a personal watercraft. See Michigan Laws 324.80201
  • Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 700.2910
  • Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 700.3206a
  • Parcel: means an identifiable unit of land that is treated as separate for valuation or zoning purposes. See Michigan Laws 700.3414
  • Parent: includes , but is not limited to, an individual entitled to take, or who would be entitled to take, as a parent under this act by intestate succession from a child who dies without a will and whose relationship is in question. See Michigan Laws 700.1106
  • Partial guardian: means that term as defined in section 600 of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 700.1106
  • Partial guardian: means a guardian who possesses fewer than all of the legal rights and powers of a plenary guardian, and whose rights, powers, and duties have been specifically enumerated by court order. See Michigan Laws 700.7410
  • Participant: means a local unit which has entered into a contract with a financial institution and has placed funds in an investment pool managed by that financial institution. See Michigan Laws 700.5316
  • Participant: means a local unit participating in the investment pool. See Michigan Laws 700.5414
  • Participating county: means a county that has been authorized by the county governing body to enter into a contract with another local unit pursuant to section 4. See Michigan Laws 700.5414
  • Patient advocate: means an individual designated to exercise powers concerning another individual's care, custody, and medical or mental health treatment or authorized to make an anatomical gift on behalf of another individual, or both, as provided in section 5506. See Michigan Laws 700.1106
  • Patient advocate designation: means the written document executed and with the effect as described in sections 5506 to 5515. See Michigan Laws 700.1106
  • Paying agent: means any one of the banks or trust companies or other financial institutions where the obligations or interest coupons are made payable. See Michigan Laws 700.5404
  • Paying agent: means either of the following:

    (i) For an obligation that is not registered as to payment of principal by or on behalf of the public corporation that issued the obligation, any bank or trust company designated by the public corporation to make payment of principal of or interest on the obligation. See Michigan Laws 700.5408

  • Payor: means a trustee, insurer, business entity, employer, government, governmental subdivision or agency, or other person authorized or obligated by law or a governing instrument to make payments. See Michigan Laws 700.1106
  • Peace officer: means , except as otherwise provided in this act, an individual who is employed as a law enforcement officer, as that term is defined under section 2 of the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28. See Michigan Laws 324.80314
  • Peace officer: means an officer of a law enforcement agency of the state, the federal government, or a county, township, city, or village who is responsible for the prevention and detection of crime and enforcement of the criminal laws of this state, and includes a motor carrier officer appointed under section 6d of 1935 PA 59, MCL 28. See
  • Peace officer: means 1 or more of the following:

    (i) A regularly employed member of a law enforcement agency authorized and established under law, including common law, who is responsible for the prevention and detection of crime and the enforcement of the general criminal laws of this state. See Michigan Laws 324.2707

  • Peace officer: means any of the following:

    (i) A sheriff. See Michigan Laws 324.80104

  • Peace officer: means 1 or both of the following:

    (i) A law enforcement officer as that term is defined in section 2 of the commission on law enforcement standards act, 1965 PA 203, MCL 28. See Michigan Laws 324.80201

  • Perishable food: means any food that the manufacturer, packer, or retailer, in conjunction with the department, determines to have a significant risk of spoilage, loss of value, or loss of palatability within 90 days of the date of packaging. See Michigan Laws 700.2506
  • Permanent and total disability: means medically determinable consequences of a catastrophic, line-of-duty injury that permanently prevent a former public safety officer from performing any gainful work. See
  • Permanent building or structure: is a building or structure that is affixed to a foundation on a site that has fixed utility connections and that is intended to remain on the site for more than 180 consecutive calendar days. See Michigan Laws 324.1908
  • Permit: means a permit or operating license required by any of the following sections or by rules promulgated thereunder, or, in the case of section 9112, by an ordinance adopted thereunder:

    (i) Section 3104, floodplain alteration permit. See Michigan Laws 324.80303

  • Person: means an individual, sole proprietorship, partnership, corporation, association, or other legal entity. See Michigan Laws 700.2506
  • person: may extend and be applied to bodies politic and corporate, as well as to individuals. See Michigan Laws 324.30503
  • Person: means an individual or an organization. See Michigan Laws 700.1106
  • Person: means an individual, partnership, corporation, association, governmental entity, or other legal entity. See Michigan Laws 324.80208
  • Person: means an individual, agent, association, charitable organization, company, limited liability company, corporation, labor organization, legal representative, partnership, unincorporated organization, or any other legal or commercial entity. See Michigan Laws 324.1908
  • Person: means an individual, corporation, limited or general partnership, association, joint venture, limited liability company, or a governmental entity, including this state. See Michigan Laws 700.6303
  • Person: means any of the following:

    (i) An individual, corporation, company, limited liability company, business association, partnership, society, trust, or any other nongovernmental entity, organization, or group. See Michigan Laws 700.7209

  • Person: means an individual, partnership, corporation, or voluntary association. See Michigan Laws 330.1426
  • Person: includes an entity and an individual, but does not include a fiduciary, an estate, or a trust. See Michigan Laws 700.2901
  • Person: means an individual, partnership, corporation, association, limited liability company, governmental entity, or other legal entity. See Michigan Laws 700.2106
  • Person: means an individual, corporation, limited liability company, partnership, association, governmental entity, or other legal entity. See Michigan Laws 324.80201
  • Person: means an individual, firm, partnership, corporation, association or other legal entity but does not include an officer of a law enforcement agency or of a fire department, while acting in his official capacity. See Michigan Laws 330.1512
  • Person: means an individual, partnership, company, limited liability company, cooperative, association, firm, trustee, educational institution, state or local government unit, or corporation. See Michigan Laws 700.1107
  • Person familiar with the missing senior or vulnerable adult: means a missing senior's or vulnerable adult's guardian, custodian, or guardian ad litem or an individual who provides the missing senior or vulnerable adult with home health aid services, possesses a health care power of attorney for the missing senior or vulnerable adult, has proof that the missing senior or vulnerable adult has a medical condition, or otherwise has information regarding the missing senior or vulnerable adult. See
  • Person in loco parentis: means an individual who is not the parent or guardian of a child or minor but who has legal custody of the child or minor and is providing support and care for the child or minor. See Michigan Laws 700.5412
  • Person in loco parentis: means a person who is not the parent or guardian of a minor, but who has either legal custody of a minor or physical custody of a minor and is providing support and care for the minor. See Michigan Laws 700.7202
  • person interested in an estate: includes , but is not limited to, the incumbent fiduciary; an heir, devisee, child, spouse, creditor, and beneficiary and any other person that has a property right in or claim against a trust estate or the estate of a decedent, ward, or protected individual; a person that has priority for appointment as personal representative; and a fiduciary representing an interested person. See Michigan Laws 700.1105
  • person requiring treatment: means (a), (b), (c), or (d):

    (a) An individual who has mental illness, and who as a result of that mental illness can reasonably be expected within the near future to intentionally or unintentionally seriously physically injure himself, herself, or another individual, and who has engaged in an act or acts or made significant threats that are substantially supportive of the expectation. See Michigan Laws 330.1401

  • Person-centered planning: means a process for planning and supporting the individual receiving services that builds upon the individual's capacity to engage in activities that promote community life and that honors the individual's preferences, choices, and abilities. See Michigan Laws 700.7615
  • Personal information: means information that identifies an individual, including the individual's photograph or image, name, address (but not the 5-digit zip code), driver license number, social security number, telephone number, digitized signature, and medical and disability information. See Michigan Laws 324.80205
  • Personal information: means information that identifies an individual, including an individual's driver identification number, name, address not including zip code, and telephone number. See Michigan Laws 324.80301
  • Personal representative: includes , but is not limited to, an executor, administrator, successor personal representative, and special personal representative, and any other person, other than a trustee of a trust subject to article VII, who performs substantially the same function under the law governing that person's status. See Michigan Laws 700.1106
  • Personal watercraft: means a vessel that meets all of the following requirements:

    (i) Uses a motor-driven propeller or an internal combustion engine powering a water jet pump as its primary source of propulsion. See Michigan Laws 324.80201

  • Pesticide chemical: means any substance that, alone, in chemical combination, or in formulation with 1 or more other substances, is a pesticide within the meaning of the federal insecticide, fungicide, and rodenticide act, 7 USC 136 to 136y, and is used in the production, storage, or transportation of raw agricultural commodities. See Michigan Laws 700.2506
  • Petition: means a written request to the court for an order after notice. See Michigan Laws 700.1106
  • Petitioner: means a person that institutes a proceeding under section 281a. See Michigan Laws 700.5412
  • Physician orders for scope of treatment form: means that term as defined in section 5674 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 700.1106
  • Pipeline: means a pipeline that conveys a flammable liquid from a crude petroleum wellhead collection site to a refinery or terminal or from a refinery to a terminal. See Michigan Laws 330.1426
  • Pistol: means a loaded or unloaded firearm that is 26 inches or less in length, or a loaded or unloaded firearm that by its construction and appearance conceals it as a firearm. See Michigan Laws 324.80314
  • Place of public assemblage: means a room or other space in a building if the room or other space can accommodate 50 or more individuals, including connected rooms and spaces that share a common means of entrance and egress. See Michigan Laws 330.1426
  • Plenary guardian: means that term as defined in section 600 of the mental health code, 1974 PA 258, MCL 330. See Michigan Laws 700.1106
  • Plenary guardian: means a guardian who possesses the legal rights and powers of a full guardian of the person, or of the estate, or both. See Michigan Laws 700.7410
  • Political subdivision: means a county, metropolitan authority, municipality, or combination of those entities in this state. See Michigan Laws 324.80201
  • Pollution prevention: means eliminating or minimizing the initial generation of waste at the source, reuse of waste, or utilizing environmentally sound on-site or off-site recycling. See Michigan Laws 324.80310
  • Portfolio: means all property of every kind and character held by a fiduciary on behalf of a fiduciary estate. See Michigan Laws 700.1501
  • Power of withdrawal: means a presently exercisable general power of appointment other than a power that is either of the following:

    (i) Exercisable by a trustee and limited by an ascertainable standard. See Michigan Laws 700.7103

  • Preadmission screening unit: means a service component of a community mental health services program established under section 409. See Michigan Laws 330.1400
  • Premises: means a lot or parcel of land, exclusive of buildings, and includes a parking lot, tourist camp, trailer camp, airport, stockyard, junkyard, wharf, pier, and any other place or enclosure. See Michigan Laws 330.1426
  • Priority foundation item: means a provision in the food code whose application supports, facilitates, or enables 1 or more priority items. See Michigan Laws 700.2506
  • Priority item: means a provision in the food code whose application contributes directly to the elimination, prevention, or reduction to an acceptable level of hazards associated with foodborne illness or injury if there is no other provision that more directly controls the hazard. See Michigan Laws 700.2506
  • Private facility: means an adult foster care facility operated under contract with a community mental health services program or on a private pay basis that agrees to do both of the following:

    (i) Accept the judicial admission of an individual with developmental disability. See Michigan Laws 330.1500

  • Privileged communication: means a communication made to a psychiatrist or psychologist in connection with the examination, diagnosis, or treatment of a patient, or to another person while the other person is participating in the examination, diagnosis, or treatment or a communication made privileged under other applicable state or federal law. See Michigan Laws 700.7615
  • probate register: means the official of the court designated to perform the functions of register as provided in section 1304. See Michigan Laws 700.1107
  • Proceeding: includes an application and a petition, and may be an action at law or a suit in equity. See Michigan Laws 700.1106
  • Processing deadline: means the last day of the processing period. See Michigan Laws 324.80303
  • Processing period: means the following time period after the close of the application period, for the following permit, as applicable:

    (i) Twenty days for a permit under section 61525 or 62509. See Michigan Laws 324.80303

  • Processor: means the owner or operator of a dairy plant. See Michigan Laws 700.1107
  • Producer: means a person who owns or operates a dairy farm and sells or distributes milk produced on that farm including a person who markets milk on behalf of a producer pursuant to a marketing agreement. See Michigan Laws 700.1107
  • Professional conservator: means a person that provides conservatorship services for a fee. See Michigan Laws 700.1106
  • Professional guardian: means a person that provides guardianship services for a fee. See Michigan Laws 700.1106
  • Program: means the urban homesteading program for vacant land described in this act. See Michigan Laws 700.2606
  • Program: means a permit program or regulatory program administered by the department under this act. See Michigan Laws 324.2701
  • Program: means a hospital, clinic, organization, or health professional licensed under part 62 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 700.5412
  • Property: means anything that may be the subject of ownership, and includes both real and personal property or an interest in real or personal property. See Michigan Laws 700.1106
  • Property: means anything that may be the subject of ownership. See Michigan Laws 700.2901
  • Protected individual: means a minor or other individual for whom a conservator has been appointed or other protective order has been made as provided in part 4 of article V. See Michigan Laws 700.1106
  • Protective proceeding: means a proceeding under the provisions of part 4 of article V. See Michigan Laws 700.1106
  • Public body: means either of the following, within this state:

    (i) A multicounty metropolitan district authorized and established pursuant to state law by 2 or more counties with a combined population of not less than 3,000,000, for the purpose of cooperative planning, promoting, acquiring, constructing, owning, developing, maintaining, or operating parks. See

  • Public corporation: means a county, city, village, township, port district, drainage district, special assessment district, or metropolitan district of this state, or a board, commission, or another authority or agency created by or under an act of the legislature of this state. See Michigan Laws 700.5306a
  • Public corporation: means any county, city, village, township, charter township, school district, community college district, port district, metropolitan district, drainage district, the state or any officer, agency, commission or department thereof, or any other public or governmental authority or agency within the state with the power to issue obligations. See Michigan Laws 700.5404
  • Public corporation: means a body corporate organized pursuant to the laws of this state to carry out a public governmental or proprietary function, including, but not limited to, this state, an agency of this state, or a school district, intermediate school district, city, village, township, county, district, commission, authority, university, college, or any combination of these, which is a corporate entity. See Michigan Laws 700.5408
  • Public corporation: means a county, city, village, township, school district, port district, or metropolitan district of the state or a combination of these if authorized by law to act jointly; an authority created by or under an act of the legislature; or a municipal health facilities corporation or subsidiary municipal health facilities corporation incorporated as provided in the municipal health facilities corporations act, 1987 PA 230, MCL 331. See Michigan Laws 700.7611
  • Public corporation: means any body corporate organized by or pursuant to the laws of this state to carry out a public governmental or propriety function, including, without limitation on the foregoing, the state or any school district, city, village, township, county, district, commission, authority, university, college, or any combination thereof, which is a corporate entity. See Michigan Laws 700.8204
  • Public entity: means this state or an agency or authority of this state, school district, community college district, intermediate school district, city, village, township, county, public authority, or public airport authority. See Michigan Laws 700.7209
  • Public facility: means housing, a street, plaza, pedestrian mall, and any improvements to a street, plaza, or pedestrian mall including street furniture and beautification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, transit-oriented development, transit-oriented facility, or building, including access routes designed and dedicated to use by the public generally, or used by a public agency. See Michigan Laws 700.2910
  • Public facility: means a street, plaza, pedestrian mall, and any improvements to a street, plaza, or pedestrian mall including street furniture and beautification, sidewalk, trail, lighting, traffic flow modification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, transit-oriented development, transit-oriented facility, or building, including access routes, that are either designed and dedicated to use by the public generally or used by a public agency, or that are located in a qualified development area and are for the benefit of or for the protection of the health, welfare, or safety of the public generally, whether or not used by 1 or more business entities, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and designed to accommodate foreseeable development of public facilities in adjoining areas. See Michigan Laws 700.3206a
  • Public facility: means housing, a street, plaza, pedestrian mall, and any improvements to a street, plaza, or pedestrian mall including street furniture and beautification, park, parking facility, recreational facility, right-of-way, structure, waterway, bridge, lake, pond, canal, utility line or pipe, or building, including access routes designed and dedicated to use by the public generally, or used by a public agency. See Michigan Laws 700.3414
  • Public health code: means 1978 PA 368, MCL 333. See Michigan Laws 700.2506
  • public improvement: means the whole or a part of any of these improvements or of any combination of these improvements or any interest or participation in these improvements, as determined by the governing body. See Michigan Laws 700.7611
  • Public improvements: means only the following improvements: housing facilities; garbage disposal plants; rubbish disposal plants; incinerators; transportation systems, including plants, works, instrumentalities, and properties used or useful in connection with those systems; sewage disposal systems, including sanitary sewers, combined sanitary and storm sewers, plants, works, instrumentalities, and properties used or useful in connection with the collection, treatment, or disposal of sewage or industrial wastes; storm water systems, including storm sewers, plants, works, instrumentalities, and properties used or useful in connection with the collection, treatment, or disposal of storm water; water supply systems, including plants, works, instrumentalities, and properties used or useful in connection with obtaining a water supply, the treatment of water, or the distribution of water; utility systems for supplying light, heat, or power, including plants, works, instrumentalities, and properties used or useful in connection with those systems; approved cable television systems, approved cable communication systems, or telephone systems, including plants, works, instrumentalities, and properties used or useful in connection with those systems; automobile parking facilities, including within or as part of the facilities areas or buildings that may be rented or leased to private enterprises serving the public; yacht basins; harbors; docks; wharves; terminal facilities; elevated highways; bridges over, tunnels under, and ferries across bodies of water; community buildings; public wholesale markets for farm and food products; stadiums; convention halls; auditoriums; dormitories; hospitals and other health care facilities; buildings devoted to public use; museums; parks; recreational facilities; reforestation projects; aeronautical facilities; and marine railways; or any right or interest in or equipment for these improvements. See Michigan Laws 700.7611
  • public threat: means a clear, present, persistent, ongoing, and random threat to public safety. See
  • Purchaser: means a person who receives a pistol from another person by purchase or gift. See Michigan Laws 324.80314
  • Qualified buyer: means an applicant who meets the criteria in section 4. See Michigan Laws 700.2706
  • Qualified buyer: means an applicant who meets the criteria in section 4. See Michigan Laws 700.2502
  • Qualified buyer: means an applicant who meets the criteria in section 6. See Michigan Laws 700.2511
  • Qualified development area: means a development area that meets 1 of the following:

    (i) All of the following:

    (A) Is located within a city with a population of 700,000 or more. See Michigan Laws 700.3206a

  • Qualified eligible next Michigan business: means an eligible next Michigan business that has been certified in accordance with section 8h. See Michigan Laws 700.2106
  • Qualified loan rate: means an interest rate not to exceed the adjusted prime rate determined in section 23 of 1941 PA 122, MCL 205. See Michigan Laws 700.2502
  • Qualified local governmental unit: means 1 or more of the following:

    (i) A city with a median family income of 150% or less of the statewide median family income as reported in the 1990 federal decennial census that meets 1 or more of the following criteria:

    (A) Contains or has within its borders an eligible distressed area as that term is defined in section 11(u)(ii) and (iii) of the state housing development authority act of 1966, 1966 PA 346, MCL 125. See Michigan Laws 700.2716

  • Qualified local governmental unit: means that term as defined in the obsolete property rehabilitation act, 2000 PA 146, MCL 125. See Michigan Laws 700.1301
  • Qualified local governmental unit: means either of the following:

    (i) A county. See Michigan Laws 700.2106

  • Qualified retired law enforcement officer: means that term as defined in 18 USC 926C(c). See
  • Qualified trust beneficiary: means a trust beneficiary to whom 1 or more of the following apply on the date the trust beneficiary's qualification is determined:

    (i) The trust beneficiary is a distributee or permissible distributee of trust income or principal. See Michigan Laws 700.7103

  • Qualifying statute: means that term as defined in the master settlement agreement, which is 1999 PA 244, MCL 445. See Michigan Laws 700.6303
  • Quorum: means , except as otherwise defined, 1 of the following:

    (i) Three council members, if the village has adopted an ordinance reducing the number of trustees under chapter II. See

  • Rates: means the charges, fees, rentals, and rates that may be fixed and imposed for the services, facilities, and commodities furnished by a public improvement. See Michigan Laws 700.7611
  • Raw agricultural commodity: means any food in its raw or natural state including fruits that are washed, colored, or otherwise treated in their unpeeled natural form before marketing. See Michigan Laws 700.2507
  • Receiving station: means any place, premise, or establishment where raw milk is received, collected, handled, stored, or cooled and is prepared for further transporting. See Michigan Laws 700.1107
  • Reciprocating jurisdiction: means a state of the United States of America, the District of Columbia, the Commonwealth of Puerto Rico, or a territory or possession of the United States of America that has enacted a law identical to this part or provides access to its courts and administrative agencies that is substantially equivalent to the access provided in this part. See Michigan Laws 324.1801
  • Recovery zone: means a tool and die renaissance recovery zone created in section 8d. See Michigan Laws 700.2106
  • Recreation improvement account: means the recreation improvement account of the legacy fund provided for in section 2020. See Michigan Laws 324.2001
  • Recreation passport fee: means a state park and state-operated public boating access site recreation passport fee paid under section 805 of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 324.2001
  • Registered name: means either a name that is registered as "doing business as" at the county clerk's office in the county in which the producer or processor resides or that is registered with the state of Michigan as a legal entity registered to do business within the state under an assumed name. See Michigan Laws 700.1107
  • Registering entity: means a person who originates or transfers a security title by registration, and includes a broker maintaining security accounts for customers and a transfer agent or other person acting for or as an issuer of securities. See Michigan Laws 700.6301
  • Registering tribunal: means a tribunal in which a support order or judgment determining parentage of a child is registered. See Michigan Laws 552.2102
  • Registrar: means the state registrar as defined in section 2805 of the public health code, 1978 PA 368, MCL 333. See Michigan Laws 324.80192
  • Regulatory authority: means the department, the local health department, or the authorized representative having jurisdiction over the food establishment. See Michigan Laws 700.2507
  • Rehabilitated facility: means a commercial property or commercial housing property that has undergone rehabilitation or is in the process of being rehabilitated, including rehabilitation that changes the intended use of the building. See Michigan Laws 700.2716
  • Rehabilitation: means changes to obsolete property other than replacement that are required to restore or modify the property, together with all appurtenances, to an economically efficient condition. See Michigan Laws 700.2716
  • Release: means the transfer of an individual who is subject to an order of combined hospitalization and alternative treatment from 1 treatment program to another in accordance with his or her individual plan of services. See Michigan Laws 330.1400
  • Release: means that term as defined in part 201 or part 213. See Michigan Laws 700.1301
  • Remote control terminal: means a terminal where filling an aboveground liquid storage tank with a flammable liquid is controlled at a remote location by the individual who conveyed the flammable liquid to the terminal. See Michigan Laws 330.1426
  • Renaissance zone: means a geographic area designated under this act. See Michigan Laws 700.2106
  • Renewable energy facility: means a facility that creates energy, fuels, or chemicals directly from the wind, the sun, trees, grasses, biosolids, algae, agricultural commodities, processed products from agricultural commodities, or residues from agricultural processes, wood or forest processes, food production and processing, or the paper products industry. See Michigan Laws 700.2106
  • Replacement obligation: means an obligation and any coupon representing interest in connection with the obligation issued under this act. See Michigan Laws 700.5408
  • Rerun: means a frozen dessert that is not placed in its final container immediately after passing through the freezing process and is intended to be melted and reprocessed or refrozen. See Michigan Laws 700.1107
  • reserve officer: means , except as otherwise provided in this act, an individual authorized on a voluntary or irregular basis by a duly authorized police agency of this state or a political subdivision of this state to act as a law enforcement officer, who is responsible for the preservation of the peace, the prevention and detection of crime, and the enforcement of the general criminal laws of this state, and who is otherwise eligible to possess a firearm under this act. See Michigan Laws 324.80314
  • Residence address: means the place that is the settled home or domicile at which a person legally resides, which meets the definition of residence as defined in section 11 of the Michigan election law, 1954 PA 116, MCL 168. See Michigan Laws 324.80205
  • Resident: means every person who resides in this state and establishes that he or she is legally present in the United States. See Michigan Laws 324.80205
  • Resident creditor: means a person domiciled or doing business in this state that is, or could be, a claimant against a nonresident decedent's estate. See Michigan Laws 700.4101
  • Resident organization: means a group of residents made up of not less than 50% of total residents of the specific housing project who contract with a housing commission to manage that housing project for not less than 5 years with the intent to acquire legal ownership of the housing project under this act. See Michigan Laws 700.2511
  • Residential district: means an area of a municipality zoned and used principally for residential housing. See Michigan Laws 700.2909
  • Residential district: means an area of a municipality where 75% or more of the area is zoned for residential housing. See Michigan Laws 700.3414
  • Residential rental property: means that term as defined in section 7ff of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.2106
  • Residual interests: means 1 or more of the following as provided in any sale agreement:

    (i) The unencumbered tobacco revenues. See Michigan Laws 700.6303

  • Respondent: means an individual alleged in a petition filed under section 281a to be an individual who has a substance use disorder and who may be ordered under section 281b or 281c to undergo involuntary treatment. See Michigan Laws 700.5412
  • Respondent: means the individual who is the subject of a petition for guardianship filed under this chapter. See Michigan Laws 700.7410
  • Responding tribunal: means the authorized tribunal in a responding state or foreign country. See Michigan Laws 552.2102
  • Response activity: means either of the following:

    (i) Response activity as that term is defined in part 201. See Michigan Laws 700.1301

  • Restraint: means the use of a physical device to restrict an individual's movement. See Michigan Laws 700.7615
  • Retail: means selling or offering for sale dairy products directly to a consumer. See Michigan Laws 700.1107
  • Retail food establishment: means an operation that sells or offers to sell food directly to a consumer. See Michigan Laws 700.1107
  • Retail food establishment: means an operation that sells or offers to sell food directly to a consumer. See Michigan Laws 700.2507
  • Retail grocery: means an operation that sells or offers to sell food to consumers for off-premises consumption. See Michigan Laws 700.2507
  • Retail location: means a facility listed under NFPA 1124, 7. See Michigan Laws 324.1908
  • Retailer: means a person who sells consumer fireworks or low-impact fireworks for resale to an individual for ultimate use. See Michigan Laws 324.1908
  • Retired federal law enforcement officer: means an individual who was an officer or agent employed by a law enforcement agency of the United States government whose primary responsibility was enforcing laws of the United States, who was required to carry a firearm in the course of his or her duties as a law enforcement officer, and who retired in good standing from his or her employment as a federal law enforcement officer. See Michigan Laws 324.80314
  • retired law enforcement officer: means an individual who was a police officer or law enforcement officer who was licensed or certified as described in the Michigan commission on law enforcement standards act, 1965 PA 203, MCL 28. See Michigan Laws 324.80314
  • Revenues: means the income derived from the rates charged for the services, facilities, and commodities furnished by a public improvement. See Michigan Laws 700.7611
  • Review board: means the renaissance zone review board created in section 5. See Michigan Laws 700.2106
  • Roundtable: means the agriculture and rural communities roundtable convened under section 2303. See Michigan Laws 324.2301
  • Rule: means a rule promulgated pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 324.80208
  • Rule: means that term as defined in section 7 of the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 324.1908
  • Rule: means a rule promulgated under the administrative procedures act of 1969, 1969 PA 306, MCL 24. See
  • Rules: means administrative rules promulgated under this act pursuant to the administrative procedures act of 1969, 1969 PA 306, MCL 24. See Michigan Laws 700.2507
  • Rural area: means an area that lies outside of the boundaries of an urban area. See Michigan Laws 700.2106
  • Rural county: means a county with a population of less than 70,000. See Michigan Laws 324.2301
  • Sale agreement: means any agreement authorized under this act in which this state provides for the sale of all or a portion of the state's tobacco receipts under section 8. See Michigan Laws 700.6303
  • Sanitary standards: means the dairy equipment construction standards or accepted dairy system operating practices formulated by 1 of the following:

    (i) 3-A sanitary standards committees representing the international association for food protection, the United States public health service, the United States department of agriculture, and the dairy industry committee. See Michigan Laws 700.1108

  • Sanitizing: means the application of any effective method or sanitizing agent in compliance with the federal act to a clean surface for the destruction of pathogens and other organisms as far as is practicable. See Michigan Laws 700.1108
  • Scheduled process: means the aseptic process selected by the processor as adequate under the conditions of manufacture for a given product to be free of viable microorganisms having a public health significance as well as microorganisms of nonhealth significance capable of reproducing in the food under normal nonrefrigerated conditions. See Michigan Laws 700.1108
  • Scrutinized company: means , except for a company described in subdivision (i), and for a social development company or a company that only meets the criteria of this subdivision because an independently owned franchisee of that company is a scrutinized company, any company that has business operations that involve contracts with or provision of supplies or services to a state sponsor of terror; companies in which a state sponsor of terror has any direct or indirect equity share, consortiums, or projects commissioned by a state sponsor of terror; or companies involved in consortiums and projects commissioned by a state sponsor of terror and 1 or more of the following:

    (i) More than 10% of the company's total revenues or assets are directly invested in or earned from or significantly contributed to a state sponsor of terror and the company has failed to take substantial action. See Michigan Laws 700.7112

  • seal: shall be construed to include any of the following:

    (a) The impression of the seal on the paper alone. See Michigan Laws 324.30505

  • Seclusion: means the temporary placement of a recipient in a room, alone, where egress is prevented by any means. See Michigan Laws 700.7615
  • Security: includes , but is not limited to, a note, stock, treasury stock, bond, debenture, evidence of indebtedness, certificate of interest or participation in an oil, gas, or mining title or lease or in payments out of production under such a title or lease, collateral trust certificate, transferable share, voting trust certificate, or interest in a regulated investment company or other entity generally referred to as a mutual fund or, in general, an interest or instrument commonly known as a security, or a certificate of interest or participation for, a temporary or interim certificate, receipt, or certificate of deposit for, or any warrant or right to subscribe to or purchase any of the items listed in this subdivision. See Michigan Laws 700.1107
  • Security: means an evidence of debt such as a bond, note, contract, obligation, refunding obligation, certificate of indebtedness, or other similar instrument issued by an agency, which pledges payment of the debt by the agency from an identified source of revenue. See Michigan Laws 700.5424
  • Security: means a share, participation, or other interest in property, in a business, or in an obligation of an enterprise or other issuer, and includes a certificated security, uncertificated security, and security account. See Michigan Laws 700.6301
  • Seller: means a person who sells or gives a pistol to another person. See Michigan Laws 324.80314
  • Serious impairment of a body function: means that term as defined in section 58c of the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 324.1908
  • Serious violation: means a violation of this act, an order issued under this act, or a rule promulgated or adopted by reference under this act for which a substantial probability exists that death or serious impairment of a body function to a person other than the violator may result unless the violator did not and could not, with the exercise of reasonable diligence, know of the presence of the violation. See Michigan Laws 324.1908
  • Settlement: means , in reference to a decedent's estate, the full process of administration, distribution, and closing. See Michigan Laws 700.1107
  • Settlor: means a person, including a testator or a trustee, who creates a trust. See Michigan Laws 700.7103
  • Sexually oriented business: includes , but is not limited to, an adult bookstore, adult video store, adult cabaret, adult motion picture theater, sexual device shop, or sexual encounter center or an establishment that regularly features live performances characterized by the exposure of a specified anatomical area or by a specified sexual activity or in which persons appear in a state of nudity or seminudity in the performance of their duties. See Michigan Laws 700.2904
  • shall not apply: means that the pertinent provision is not operative as to certain persons or things or in conjunction with a particular date or dates. See Michigan Laws 324.51510
  • Shellfish: means all species of any of the following:

    (i) Oyster, clams, or mussels whether shucked or in the shell, raw, including postharvest processed, frozen or unfrozen, or whole or in parts. See Michigan Laws 700.3404

  • Shellfish dealer: means an interstate wholesaler handling shellfish. See Michigan Laws 700.2507
  • Shellfish dealer certification: means the issuance of a numbered certificate to a person indicating that the person is in compliance with the requirements of the guide for the control of molluscan shellfish and that the person has permission from the department to conduct 1 or more of the following shellfish activities, as defined in the guide for the control of molluscan shellfish:

    (i) Shellstock shipper. See Michigan Laws 700.2507

  • Skeletal meat: means the meat that is attached to a part of the skeleton, including head and cheek meat. See Michigan Laws 700.3404
  • Slow--no wake speed: means the use of a vessel at a very slow speed so that the resulting wake or wash is minimal. See Michigan Laws 324.80201
  • Smoked fish rules: means R 285. See Michigan Laws 700.2507
  • Snowmobile account: means the snowmobile account of the legacy fund provided for in section 2025. See Michigan Laws 324.2001
  • Solid waste: means solid waste as defined in part 115. See Michigan Laws 324.80215
  • Special effects: means a combination of chemical elements or chemical compounds capable of burning independently of the oxygen of the atmosphere and designed and intended to produce an audible, visual, mechanical, or thermal effect as an integral part of a motion picture, radio, television, theatrical, or opera production or live entertainment. See Michigan Laws 324.1908
  • Special personal representative: means a personal representative as described by sections 3614 to 3618. See Michigan Laws 700.1107
  • Special transitory food unit: means a temporary food establishment that is licensed to operate throughout the state without the 14-day limits or a mobile food establishment that is not required to return to a commissary. See Michigan Laws 700.2507
  • Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 700.2910
  • Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 700.3206a
  • Specific local tax: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 700.3414
  • Specific taxes: means a tax levied under 1974 PA 198, MCL 207. See Michigan Laws 700.1301
  • Specified sexual activity: means the fondling or other erotic touching of covered or uncovered human genitals, pubic area, buttocks, anus, anal cleft, or female breast. See Michigan Laws 700.2904
  • Spendthrift provision: means a term of a trust that restrains either the voluntary or involuntary transfer of a trust beneficiary's interest. See Michigan Laws 700.7103
  • Standard driver license: means an operator's license or chauffeur's license issued under the Michigan vehicle code, 1949 PA 300, MCL 257. See Michigan Laws 324.80220
  • Standard methods: means the sixteenth edition of "Standard Methods for the Examination of Dairy Products" published by the American public health association, dated 1992, incorporated by reference. See Michigan Laws 700.1108
  • Standard official state personal identification card: means an official state personal identification card issued under 1972 PA 222, MCL 28. See Michigan Laws 324.80220
  • Standing committees: means the committees of the senate and house of representatives with primary responsibility for agriculture. See Michigan Laws 324.2301
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 552.2102
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or a territory or insular possession subject to the jurisdiction of the United States. See Michigan Laws 700.1107
  • State agency: means either the department or the governing body of the state park that is participating in an authority. See Michigan Laws 324.80215
  • State brownfield redevelopment fund: means the state brownfield redevelopment fund created in section 8a. See Michigan Laws 700.1301
  • State court judge: means a judge of the district court, circuit court, probate court, or court of appeals or justice of the supreme court of this state who is serving either by election or appointment. See Michigan Laws 324.80314
  • State court retired judge: means a judge or justice described in subdivision (q) who is retired, or a retired judge of the recorders court. See Michigan Laws 324.80314
  • State fire marshal: means the state fire marshal appointed under section 1b of the fire prevention code, 1941 PA 207, MCL 29. See Michigan Laws 324.1908
  • State fire marshal: means the individual appointed by the director under section 1b. See Michigan Laws 330.1426
  • State forest: means those lands designated as state forests by the department. See Michigan Laws 324.83101
  • State park improvement account: means the state park improvement account of the legacy fund provided for in section 2030. See Michigan Laws 324.2001
  • State sponsor of terror: means , subject to section 10 as to applicability, any country determined by the United States secretary of state to have repeatedly provided support for acts of international terrorism. See Michigan Laws 700.7112
  • State treasurer: means the state treasurer of this state or his or her designee who shall be designated by a written instrument signed by the state treasurer and maintained in a permanent file and whose signature shall have the same force and effect as the signature of the state treasurer for all purposes under this act. See Michigan Laws 700.6303
  • Stepchild: means a child of the surviving, deceased, or former spouse of the testator or of the donor of a power of appointment, who is not the testator's or donor's child. See Michigan Laws 700.2601
  • Sterilized or aseptic milk and dairy products: means products hermetically sealed in a container and thermally processed or otherwise processed so as to render the product free of microorganisms capable of reproducing in the product under normal nonrefrigeration conditions of storage and distribution and free of viable microorganisms including spores of public health significance. See Michigan Laws 700.1108
  • Strategic plan: means a plan agreed to by this state and a municipality concerning an enterprise community that includes both of the following:

    (i) Certification of the authority to adopt a strategic plan in an application for nomination as an enterprise community under applicable federal regulations. See Michigan Laws 700.1105

  • Subject of a petition: means an individual regarding whom a petition has been filed with the court asserting that the individual is or is not a person requiring treatment or for whom an objection to involuntary mental health treatment has been made under section 484. See Michigan Laws 330.1400
  • Substantial interest: means 1 or more of the following:

    (i) Owning real property or a business located in the enterprise community. See Michigan Laws 700.1105

  • Successor: means a person, other than a creditor, who is entitled to property of a decedent under the decedent's will or this act. See Michigan Laws 700.1107
  • Successor personal representative: means a personal representative, other than a special personal representative, who is appointed to succeed a previously appointed personal representative. See Michigan Laws 700.1107
  • Suitable for hospitalization: means a determination concerning a minor that all of the following criteria are met:

    (i) The minor is a minor requiring treatment. See Michigan Laws 700.7202

  • Sulfiting agents: means any of the following:

    (i) Sulfur dioxide. See Michigan Laws 700.2507

  • Supervised administration: means the proceedings described in part 5 of article III. See Michigan Laws 700.1107
  • Supplemental environmental project: means an environmentally beneficial project that an alleged violator agrees to undertake in settlement of an enforcement action, but which the alleged violator is not otherwise legally required to undertake. See Michigan Laws 324.80310
  • Support order: means a judgment, decree, order, decision, or directive, whether temporary, final, or subject to modification, issued in a state or foreign country for the benefit of a child, a spouse, or a former spouse, that provides for monetary support, health care, arrearages, retroactive support, or reimbursement for financial assistance provided to an individual obligee in place of child support. See Michigan Laws 552.2102
  • Support plan: means a written plan that specifies the personal support services or any other supports that are to be developed with and provided for a recipient. See Michigan Laws 700.7615
  • Support provision: means a provision in a trust that provides the trustee shall distribute income or principal or both for the health, education, support, or maintenance of a trust beneficiary, or language of similar import. See Michigan Laws 700.7103
  • Surplus funds: means money which belongs to or is under the control of the local unit and is available for investment, not being required by law or agreement with bondholders to be segregated and invested in a specified manner. See Michigan Laws 700.5316
  • Survive: means that an individual neither predeceases an event, including the death of another individual, nor is considered to predecease an event under section 2104 or 2702. See Michigan Laws 700.1107
  • surviving descendant: means a devisee or a descendant who neither predeceased the testator nor is considered to have predeceased the testator under section 2702. See Michigan Laws 700.2601
  • Surviving spouse: means the husband or wife of the deceased officer at the time of the officer's death, and includes a spouse living apart from the officer at the time of the officer's death for any reason. See
  • Survivor: means any of the following:

    (i) A spouse of a law enforcement officer killed on duty. See Michigan Laws 330.1410

  • Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 700.2910
  • Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 700.3206a
  • Tax increment revenues: means the amount of ad valorem property taxes and specific local taxes attributable to the application of the levy of all taxing jurisdictions upon the captured assessed value of real and personal property in the development area. See Michigan Laws 700.3414
  • Tax increment revenues: means the amount of ad valorem property taxes and specific taxes attributable to the application of the levy of all taxing jurisdictions upon the captured taxable value of each parcel of eligible property subject to a brownfield plan and personal property located on that property, regardless of whether those taxes began to be levied after the brownfield plan was adopted. See Michigan Laws 700.1301
  • Taxable value: means the value determined under section 27a of the general property tax act, 1893 PA 206, MCL 211. See Michigan Laws 700.2716

  • Taxes levied for school operating purposes: means all of the following:

    (i) The taxes levied by a local school district for operating purposes. See Michigan Laws 700.1301

  • Temporary food establishment: means a food establishment that operates at a fixed location for a temporary period not to exceed 14 consecutive days. See Michigan Laws 700.2507
  • Temporary license: means a written authorization issued by the director to operate for a specified limited time period. See Michigan Laws 700.2507
  • Terminal: means a location where an aboveground liquid storage tank containing a flammable liquid is located. See Michigan Laws 330.1426
  • terms of the trust: means the manifestation of the settlor's intent regarding a trust's provisions as expressed in the trust instrument or as may be established by other evidence that would be admissible in a judicial proceeding. See Michigan Laws 700.1107
  • Testacy proceeding: means a proceeding to establish a will or determine intestacy. See Michigan Laws 700.1107
  • Testator: includes an individual of either gender. See Michigan Laws 700.1107
  • Testator: includes the donee of a power of appointment if the power is exercised in the testator's will. See Michigan Laws 700.2601
  • THC: means delta-9-tetrahydrocannabinol acid. See Michigan Laws 330.1420
  • Transfer station: means any place, premises, or establishment where milk or dairy products are transferred directly from 1 milk tank truck to another. See Michigan Laws 700.1108
  • Transformational brownfield plan: means a brownfield plan that meets the requirements of section 13c and is adopted under section 14a and, as designated by resolution of the governing body and approved by the Michigan strategic fund, will have a transformational impact on local economic development and community revitalization based on the extent of brownfield redevelopment and growth in population, commercial activity, and employment that will result from the plan. See Michigan Laws 700.1301
  • Treatment plan: means a written plan that specifies the goal-oriented treatment or training services, including rehabilitation or habilitation services, that are to be developed with and provided for a recipient. See Michigan Laws 700.7615
  • Tribunal: means a court, administrative agency, or quasi-judicial entity authorized to establish, enforce, or modify support orders or to determine parentage of a child. See Michigan Laws 552.2102
  • Trimming: means removing leaves, roots, and other extraneous materials in preparation for grading, sorting, and sale as a whole fruit or vegetable. See Michigan Laws 700.2507
  • Trust: includes , but is not limited to, an express trust, private or charitable, with additions to the trust, wherever and however created. See Michigan Laws 700.1107
  • Trust: means a fiduciary relationship with respect to property that subjects the person who holds title to the property to equitable duties to deal with the property for the benefit of another person, which fiduciary relationship arises as a result of a manifestation of an intention to create it. See Michigan Laws 700.2901
  • Trust beneficiary: means a person to whom 1 or both of the following apply:

    (i) The person has a present or future beneficial interest in a trust, vested or contingent. See Michigan Laws 700.7103

  • Trust fund: means the Michigan natural resources trust fund established in section 35 of article IX of the state constitution of 1963. See Michigan Laws 324.1901
  • Trust instrument: means a governing instrument that contains the terms of the trust, including any amendment to a term of the trust. See Michigan Laws 700.7103
  • Trust protector: means a person or committee of persons appointed pursuant to the terms of the trust who has the power to direct certain actions with respect to the trust. See Michigan Laws 700.7103
  • Trustee: includes an original, additional, or successor trustee, whether or not appointed or confirmed by the court. See Michigan Laws 700.1107
  • trustee of a trust created by will: includes a trustee to whom property is transferred by will to the extent of the devised property. See Michigan Laws 700.1103
  • TSRs: means the portion, which may include any or all, of this state's tobacco receipts sold to the authority under this act and any sale agreement. See Michigan Laws 700.6303
  • Unattended terminal: means a terminal, other than a remote control terminal or an attended terminal, where an individual knowledgeable in the aboveground liquid storage tank filling operation is only in attendance during a portion of the time when a flammable liquid is being delivered or the individual's primary responsibility is a function other than supervising the storage tank filling operation. See Michigan Laws 330.1426
  • Uniform commercial code: means the uniform commercial code, 1962 PA 174, MCL 440. See Michigan Laws 700.6303
  • United States: shall be construed to include the district and territories. See Michigan Laws 324.51501
  • Urban area: means an urbanized area as determined by the economics and statistics administration, United States bureau of the census according to the 1990 census. See Michigan Laws 700.2106
  • Use: means operate, navigate, or employ. See Michigan Laws 324.80104
  • Use: means operate, navigate, or employ. See Michigan Laws 324.80201
  • Vacant property: means surplus vacant residential property owned by the local governmental unit. See Michigan Laws 700.2606
  • Veal: means meat derived from a calf not more than 1 year of age. See Michigan Laws 700.3404
  • Vehicle: means a tank vehicle or bulk transportation vehicle, excluding the tractor of a tank vehicle or bulk transportation vehicle. See Michigan Laws 330.1426
  • Vending company base location: means a vending machine location or other food establishment required to be separately licensed under section 4105(5). See Michigan Laws 700.2507
  • Vending machine: means a self-service device that, upon insertion of a coin, paper currency, token, card, or key, or by manual operation, dispenses unit servings of food in bulk or in packages without the necessity of replenishing the device between each vending operation. See Michigan Laws 700.2507
  • Vending machine location: means the room, enclosure, space, or area in which 1 or more vending machines are installed and operated, or a micro market. See Michigan Laws 700.2507
  • Verified financial statement: means a financial statement that contains a notarized statement, signed and sworn to by an authorized representative of the dairy plant, attesting that the financial statement is correct. See Michigan Laws 700.1108
  • Vessel: means every description of watercraft used or capable of being used as a means of transportation on water. See Michigan Laws 324.80104
  • Vessel: means every description of watercraft used or capable of being used as a means of transportation on water. See Michigan Laws 324.80201
  • Violation notice: means a written notice or formal enforcement action by the department, the United States environmental protection agency, or the enforcing agency of a local unit of government in response to a violation of an applicable environmental requirement. See Michigan Laws 324.80310
  • Ward: means an individual for whom a guardian is appointed. See Michigan Laws 700.1108
  • Watercraft: means a contrivance used or designed for navigation on water, including a vessel, boat, motor vessel, steam vessel, vessel operated by machinery either permanently or temporarily affixed, scow, tugboat, or any marine equipment that is capable of carrying passengers, except a ferry. See Michigan Laws 324.80301
  • Waters of this state: means any waters within the territorial limits of this state, and includes those waters of the Great Lakes that are under the jurisdiction of this state. See Michigan Laws 324.80104
  • Waters of this state: means any waters within the territorial limits of this state, and includes those waters of the Great Lakes that are under the jurisdiction of this state. See Michigan Laws 324.80201
  • Waterways account: means the waterways account of the legacy fund provided for in section 2035. See Michigan Laws 324.2001
  • Wholesale: means selling or offering to sell dairy products to retailers, jobbers, or distributors rather than directly to a consumer. See Michigan Laws 700.1108
  • Wholesale: means selling other than directly to consumers. See Michigan Laws 700.2507
  • Wholesaler: means any person who sells consumer fireworks or low-impact fireworks to a retailer or any other person for resale. See Michigan Laws 324.1908
  • Wild game: means animals from their natural state and not cultivated, domesticated, or tamed. See Michigan Laws 700.2507
  • Withholding tax capture revenues: means the amount for each calendar year by which the income tax withheld under part 3 of the income tax act of 1967, 1967 PA 281, MCL 206. See Michigan Laws 700.1301
  • Work plan: means a plan that describes each individual activity to be conducted to complete eligible activities and the associated costs of each individual activity. See Michigan Laws 700.1301
  • Zone: means , for an authority established before June 6, 2000, a brownfield redevelopment zone designated under this act. See Michigan Laws 700.1301
