Upon a determination by the commissioner that there exist operational deficiencies in a residential health care facility which show:
Terms Used In N.Y. Public Health Law 2806-B
- Caretaker: means a person appointed pursuant to the provisions of section twenty-eight hundred six-b of this article, to act as a fiduciary responsible to the court which appoints him for the conserving and preserving of the rights and property of the operator of a residential health care facility, while also preserving and providing for the rights of the patients in such facility to care appropriate to their needs in a clean and wholesome environment in accordance with applicable federal and state laws and regulations. - Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Residential health care facility: means a nursing home or a facility providing health-related service. See N.Y. Public Health Law 2801
