The commissioner may initiate action to seize and condemn a carcass or meat food product, or a dead, dying, disabled, or diseased animal that is being transported in intrastate commerce, or is held for sale in this state after transportation in intrastate commerce if:

- Commissioner: means the agriculture commissioner or the designee or authorized representative of the commissioner. See North Dakota Code 4.1-01-01
- State: when applied to the different parts of the United States, includes the District of Columbia and the territories. See North Dakota Code 1-01-49
1. The article is or has been prepared, sold, transported, or otherwise distributed or offered or received for distribution in violation of this chapter; 2. The article is adulterated or misbranded and not suitable for use as human food; or
3. The article is in any other way violative of this chapter.
