41-6a-1713.  Penalty for littering on a highway.

(1)  A person who violates any of the provisions of Section 41-6a-1712 is guilty of an infraction and shall be fined:

  • Highway: means the entire width between property lines of every way or place of any nature when any part of it is open to the use of the public as a matter of right for vehicular travel. See Utah Code 41-6a-102
  • Person: means a natural person, firm, copartnership, association, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, governmental agency, public corporation, or any other legal or commercial entity. See Utah Code 41-6a-102
(a)  not less than $200 for a violation; or

(b)  not less than $500 for a second or subsequent violation within three years of a previous violation of this section.

(2)  The sentencing judge may require that the offender devote at least eight hours in cleaning up:

(a)  litter caused by the offender; and

(b)  existing litter from a safe area designated by the sentencing judge.
