78B-24-101. Definitions. As used in this chapter:
(1) |
“Child” means an unemancipated individual under 18 years old. |
Terms Used In Utah Code 78B-24-101
- Child: means an unemancipated individual under 18 years old. See Utah Code 78B-24-101
- Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
- Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
- Parent: means an individual recognized as a parent under other law of this state. See Utah Code 78B-24-101
- Person: means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality, or other legal entity. See Utah Code 78B-24-101
- State: includes a federally recognized Indian tribe. See Utah Code 78B-24-101
- United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5

(a) |
“Child-placing agency” means a person with authority under other law of this state to identify or place a child for adoption. |
(b) |
“Child-placing agency” does not include a parent of a child. |

“Custody” means the exercise of physical care and supervision of a child. |
(4) |
(a) |
“Intercountry adoption” means an adoption or placement for adoption of a child who resides in a foreign country at the time of adoption or placement. |
(b) |
“Intercountry adoption” includes an adoption finalized in the child’s country of residence or in a state. |

(5) |
“Parent” means an individual recognized as a parent under other law of this state. |
(6) |
“Person” means an individual, estate, business or nonprofit entity, public corporation, government or governmental subdivision, agency, or instrumentality, or other legal entity. |
(7) |
“Record” means information:
(a) |
inscribed on a tangible medium; or |
(b) |
stored in an electronic or other medium and retrievable in perceivable form. |

(a) |
“State” means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any other territory or possession subject to the jurisdiction of the United States. |
(b) |
“State” includes a federally recognized Indian tribe. |
