  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Town: shall include city and wards or precincts therein; "selectboard members" and "board of civil authority" shall extend to and include the mayor and aldermen of cities; "trustees" shall extend to and include bailiffs of incorporated villages; and the laws applicable to the inhabitants and officers of towns shall be applicable to the inhabitants and similar officers of all municipal corporations. § 5142. Persons not authorized to marry

The following persons are not authorized to marry, and a town clerk shall not knowingly issue a civil marriage license, when:

(1) either party is under 18 years of age;

(2) either party lacks capacity to understand the nature of the conduct at issue;

(3) either party is 18 years of age or older and under guardianship, without the written consent of the party’s guardian;

(4) the parties are prohibited from marrying under 15 V.S.A. § 1a on account of consanguinity or affinity; or

(5) either party has a living spouse, as prohibited under 13 V.S.A. § 206. (Amended 1965, No. 194, § 10, eff. Feb. 1, 1967; 1967, No. 147, § 47, eff.
