Terms Used In Washington Code > Chapter 70A.105 - On-site sewage disposal systems

  • Additive: means any commercial product intended to affect the performance or aesthetics of an on-site sewage disposal system. See Washington Code 70A.105.020
  • Alternative methods of effluent disposal: means systems approved by the department of health, including at least, mound systems, alternating drainfields, anaerobic filters, evapotranspiration systems, and aerobic systems. See Washington Code 70A.105.020
  • Contract: A legal written agreement that becomes binding when signed.
  • Department: means the department of health. See Washington Code 70A.105.020
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Failure: means : (a) Effluent has been discharged on the surface of the ground prior to approved treatment; or (b) effluent has percolated to the surface of the ground; or (c) effluent has contaminated or threatens to contaminate a groundwater supply. See Washington Code 70A.105.020
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Nonwater-carried sewage disposal devices: means any device that stores and treats nonwater-carried human urine and feces. See Washington Code 70A.105.020
  • On-site sewage disposal system: means any system of piping, treatment devices, or other facilities that convey, store, treat, or dispose of sewage on the property where it originates or on nearby property under the control of the user where the system is not connected to a public sewer system. See Washington Code 70A.105.020
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • person: may be construed to include the United States, this state, or any state or territory, or any public or private corporation or limited liability company, as well as an individual. See Washington Code 1.16.080
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
