Notwithstanding ORS § 163.107, when an element of a crime charged is that the victim of the crime is a police officer as defined in ORS § 181A.355 and the crime was related to the officer’s performance of official duties, the state may alternatively prove that the victim of the crime is a certified reserve officer or a reserve officer, as those terms are defined in ORS § 181A.355, and the crime was related to the officer’s performance of official duties.
