(a) Proceedings for adoption shall be brought in the superior court for the district in which, at the time of filing or granting the petition, the petitioner or the person to be adopted resides or is in military service, or in which the agency having the care, custody, or control of the minor is located.

Terms Used In Alaska Statutes 25.23.030

  • action: includes any matter or proceeding in a court, civil or criminal. See Alaska Statutes 01.10.060
  • agency: means any person certified, licensed, or otherwise specially empowered by law or regulation to place minors for adoption. See Alaska Statutes 25.23.240
  • child: means a son or daughter, whether by birth or by adoption. See Alaska Statutes 25.23.240
  • court: means the superior court of this state, and, when the context requires, the court of another state empowered to grant petitions for adoption or guardianship or to terminate parental rights. See Alaska Statutes 25.23.240
  • minor: means a person who has not reached the age of majority. See Alaska Statutes 25.23.240
  • person: includes a corporation, company, partnership, firm, association, organization, business trust, or society, as well as a natural person. See Alaska Statutes 01.10.060
  • state: means the State of Alaska unless applied to the different parts of the United States and in the latter case it includes the District of Columbia and the territories. See Alaska Statutes 01.10.060
  • Venue: The geographical location in which a case is tried.
(b) If the court finds in the interest of substantial justice, under Alaska Stat. § 22.10.040, that the adoption proceeding should be heard in another judicial district, the court may transfer, stay, or dismiss the proceeding in whole or in part on conditions that are just.
(c) Proceedings for the termination of parental rights on the grounds set out in child relationships” class=”unlinked-ref” datatype=”S” sessionyear=”2023″ statecd=”AK”>Alaska Stat. § 25.23.180 (c)(2) shall be brought in the superior court for the district in which the child that is the subject of the action resides.
(d) The venue for an adoption proceeding for a child in state custody under Alaska Stat. Chapter 47.10 is the

(1) superior court where the child-in-need-of-aid proceeding is pending as provided under AS 47.10.111; or
(2) judicial district in which the petitioner resides if the petitioner provides notice to all of the parties to the child-in-need-of-aid proceeding and no party objects.
