Sec. 2. If the child is a ward of:
(2) an agency; or
(1) a guardian;

- Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
(3) the department;
the court shall provide for the custody of the child in the adoption decree.
