  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.

  • Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.
  • Arrest: Taking physical custody of a person by lawful authority.
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Average annual salary: means the average annual salary of an officer during the five (5) years of highest annual salary in the ten (10) years immediately preceding an officer's retirement date, determined without regard to any salary reduction agreement established under Section 125 of the Internal Revenue Code. See Indiana Code 5-10-5.5-1
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • board: means the statewide 911 board established by Indiana Code 36-8-16.8-1

  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • commission: refers to the fire prevention and building safety commission. See Indiana Code 36-8-17-1
  • commission: refers to the merit commission for a merit system established under this chapter. See Indiana Code 36-8-3.5-0.2
  • Commission: means the alcohol and tobacco commission. See Indiana Code 5-10-5.5-1
  • community fast responder: means a volunteer who may be summoned to perform cardiopulmonary resuscitation, defibrillation, or other emergency services under the direction of a nonprofit corporation. See Indiana Code 36-8-23-1
  • community fast responder nonprofit corporation: means a nonprofit corporation that organizes or directs community fast responders. See Indiana Code 36-8-23-2
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • district: refers to a fire protection district established under IC 36-8-11. See Indiana Code 36-8-3.5-0.4
  • DROP: means the deferred retirement option plan established by this chapter. See Indiana Code 36-8-8.5-4
  • DROP entry date: means the date that a member's DROP election becomes effective. See Indiana Code 36-8-8.5-6
  • DROP frozen benefit: means a member's monthly retirement benefit calculated under the provisions of the applicable fund and based on:

  • DROP retirement date: means the future retirement date selected by a member at the time the member makes a DROP election. See Indiana Code 36-8-8.5-8
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash.   • Eligible employee: means the sheriff of a county or a county police officer. See Indiana Code 36-8-10-2

  • fire company: means each organization or group doing duty as part of the fire department, including engine companies, hose companies, those in the telephone or telegraph service, inspectors, mechanics, watchmen, and others in charge of apparatus for extinguishing fires.   • fire department: means a paid fire department or a volunteer fire department that renders fire prevention or fire protection services to a political subdivision. See Indiana Code 36-8-17-2
  • fire department: has the meaning set forth in IC 36-8-17-2. See Indiana Code 36-8-17.5-1

  • firefighter gear: means any clothing designed, intended, or marketed to be a structural firefighting protective ensemble or ensemble element that includes:

  • Fraud: Intentional deception resulting in injury to another.
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • governing board: refers to the following:

  • Grantor: The person who establishes a trust and places property into it.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Highway: includes county bridges and state and county roads, unless otherwise expressly provided. See Indiana Code 1-1-4-5

  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.

  • participating unit: refers to a unit or fire protection district that adopts an ordinance or a resolution under section 6 of this chapter. See Indiana Code 36-8-19-2
  • Pension engineers: means technical consultants qualified to supervise and assist in the establishment, maintenance, and operation of a pension trust on an actuarially sound basis. See Indiana Code 36-8-10-2
  • PFAS chemical: has the meaning set forth in Indiana Code 36-8-27-1
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • plan: refers to a siren coverage plan adopted by a county under section 13 of this chapter. See Indiana Code 36-8-21.5-3
  • planned siren: refers to a siren that satisfies all of the following:

  • police department: means a police department established by:

  • pre-planning inspection: means an inspection of a Class 1 structure (as defined in IC 22-12-1-4) in a place or public way performed by the fire department to determine firefighting strategies necessary to minimize the hazard to firefighters responding to any fire or explosion at the structure, including:

  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • provider unit: refers to the participating unit that is responsible for providing the fire protection services within the territory. See Indiana Code 36-8-19-3

  • public safety agency: has the meaning set forth in Indiana Code 36-8-16.8-2

  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • review panel: refers to a mental health disability review panel established under section 4 of this chapter. See Indiana Code 36-8-8.3-2
  • Salary: means the total compensation, exclusive of expense allowances, paid to any officer by the department or the commission, determined without regard to any salary reduction agreement established under Section 125 of the Internal Revenue Code. See Indiana Code 5-10-5.5-1
  • severe weather: means :

  • Summons: Another word for subpoena used by the criminal justice system.
  • system board: refers to the board of trustees of the Indiana public retirement system established by Indiana Code 36-8-8-2.3

  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trust fund: means the assets of the pension trust and consists of voluntary contributions from the department, money paid from the wages of employee beneficiaries, and other payments or contributions made to the pension trust, including the income and proceeds derived from the investment of them.   • Trustee: refers to the trustee of the pension trust, who may be one (1) or more corporate trustees or the treasurer of the county serving under bond. See Indiana Code 36-8-10-2
  • unit: has the meaning set forth in IC 36-1-2-23. See Indiana Code 36-8-16.8-5

  • Uphold: The decision of an appellate court not to reverse a lower court decision.

  • veteran: includes "Hoosier veteran" and applies to the construction of all Indiana statutes, unless the construction is expressly excluded by the terms of the statute, is plainly repugnant to the intent of the general assembly or of the context of the statute, or is inconsistent with federal law.
