Terms Used In Iowa Code > Chapter 8A

  • Account: means any of the four accounts created under section 508C. See Iowa Code 508C.5
  • Active cleanup: means removal, treatment, or isolation of a contaminant from groundwater through the directed efforts of humans. See Iowa Code 455E.2
  • Actuarial certification: means a written statement by a member of the American academy of actuaries or other individual acceptable to the commissioner that an individual carrier is in compliance with the provisions of section 513C. See Iowa Code 513C.3
  • Address: means mailing address, including a zip code. See Iowa Code 501A.102
  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • adjusted competitive bid threshold: means the same as the adjusted competitive bid threshold for vertical infrastructure applicable to counties as established by the state department of transportation pursuant to section 314. See Iowa Code 468.3
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Aerobic structure: means an animal feeding operation structure other than an egg washwater storage structure which employs bacterial action which is maintained by the utilization of air or oxygen and which includes aeration equipment. See Iowa Code 459.102
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • affiliated: means any entity or person who directly or indirectly through one or more intermediaries, controls or is controlled by, or is under common control with, a specified entity or person. See Iowa Code 513C.3
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agricultural drainage well: means a vertical opening to an aquifer or permeable substratum which is constructed by any means including but not limited to drilling, driving, digging, boring, augering, jetting, washing, or coring, and which is capable of intercepting or receiving surface or subsurface drainage water from land directly or by a drainage system. See Iowa Code 460.101
  • Agricultural drainage well area: means an area of land where surface or subsurface water drains into an agricultural drainage well directly or through a drainage system connecting to the agricultural drainage well. See Iowa Code 460.101
  • Agricultural products: include horticultural, viticultural, forestry, dairy, livestock, poultry, bee and any other farm products. See Iowa Code 499.2
  • Alien society: means an association organized under the laws of another country. See Iowa Code 512B.2
  • Allegation: something that someone says happened.
  • Alluvial aquifer area: means an area underlaid by sand or gravel aquifers situated beneath floodplains along stream valleys and includes alluvial deposits associated with stream terraces and benches, contiguous wind-blown sand deposits, and glacial outwash deposits. See Iowa Code 459B.102
  • Alternative drainage system: means a drainage system constructed as part of a drainage district in order to drain surface or subsurface water from land due to the closing of an agricultural drainage well. See Iowa Code 460.101
  • Alternative voting method: means a method of voting other than a written ballot, including voting by electronic, telephonic, internet, or other means that reasonably allows members the opportunity to vote. See Iowa Code 501A.102

  • Animal feeding operation: means a lot, yard, corral, building, or other area in which animals are confined and fed and maintained for forty-five days or more in any twelve-month period, and all structures used for the storage of manure from animals in the operation. See Iowa Code 459.102
  • Animal feeding operation structure: means a confinement building, manure storage structure, dry bedded confinement feeding operation structure as defined in section 459B. See Iowa Code 459.102
  • Animal truck wash effluent: means a combination of manure, washwater-induced runoff, or other runoff derived from an animal truck wash facility, which may include solids. See Iowa Code 459A.102
  • Animal truck wash effluent structure: means an impoundment which is part of an animal truck wash facility, if the primary function of the impoundment is to collect and store animal truck wash effluent. See Iowa Code 459A.102
  • Animal truck wash facility: means an operation engaged in washing single-unit trucks, truck-tractors, semitrailers, or trailers used to transport animals. See Iowa Code 459A.102
  • Animal unit: means the same as defined in section 459. See Iowa Code 459A.102
  • Animal unit: means a unit of measurement based upon the product of multiplying the number of animals of each category by a special equivalency factor as follows:

  • Animal unit capacity: means a measurement used to determine the maximum number of animal units that may be maintained as part of an open feedlot operation. See Iowa Code 459A.102

  • Animal weight capacity: means the product of multiplying the maximum number of animals which the owner or operator confines in an animal feeding operation at any one time by the average weight during a production cycle. See Iowa Code 459.102
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Apartment: means one or more rooms occupying all or a part of a floor or floors in a building of one or more floors or stories and notwithstanding whether the apartment be intended for use or used as a residence, office, for the operation of any industry or business or for any other use not prohibited by law. See Iowa Code 499B.2
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appraisal: A determination of property value.
  • appraisers: shall mean the persons appointed and qualified to ascertain the value of all land taken and the amount of damage arising from the construction of levee or drainage improvements. See Iowa Code 468.3
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Area: means an area of land or water or both land and water. See Iowa Code 465C.1
  • Arrest: Taking physical custody of a person by lawful authority.
  • Articles: means the articles of organization of a cooperative as originally filed or subsequently amended as provided in this chapter. See Iowa Code 501A.102
  • Articles: means the cooperative's articles of association. See Iowa Code 501.101
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Association: means a business entity on a cooperative plan and organized under the laws of this state or another state or that is chartered to conduct business under the laws of another state. See Iowa Code 501A.102
  • Association: means the Iowa life and health insurance guaranty association created in section 508C. See Iowa Code 508C.5
  • Association: means a corporation formed under this chapter. See Iowa Code 499.2
  • ASTM international: means the American society for testing and materials international. See Iowa Code 459A.102
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Auditor: means the county auditor or a deputy auditor or employee designated by the county auditor. See Iowa Code 331.101
  • authorized: when used in the context of an assessment, means that a resolution has been passed by the board of directors of the association whereby an assessment will be called immediately or in the future from member insurers for a specified amount. See Iowa Code 508C.5
  • Authorized person: means a person who is one of the following:
  • Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.
  • Bailiff: a court officer who enforces the rules of behavior in courtrooms.
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Basic or standard health benefit plan: means the core group of health benefits developed pursuant to section 513C. See Iowa Code 513C.3
  • basin: means an impoundment which is part of an open feedlot operation, if the primary function of the impoundment is to collect and store settled open feedlot effluent. See Iowa Code 459A.102
  • Bedding: means crop, vegetation, or forage residue or similar materials placed in a dry bedded confinement building for the care of animals. See Iowa Code 459B.102
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Benefit contract: means the agreement for provision of benefits authorized by section 512B. See Iowa Code 512B.2
  • Benefit member: means an adult member who is designated by the laws or rules of the society to be a benefit member under a benefit contract. See Iowa Code 512B.2
  • Benefit plan: means a specific employee, union, or association of natural persons benefit plan. See Iowa Code 508C.5
  • Bequest: Property gifted by will.
  • Beverage: means wine as defined in section 123. See Iowa Code 455C.1
  • Beverage container: means any sealed glass, plastic, or metal bottle, can, jar or carton containing a beverage. See Iowa Code 455C.1
  • Block of business: means all the individuals insured under the same individual health benefit plan. See Iowa Code 513C.3
  • Board: means the board of directors of a cooperative. See Iowa Code 501A.102
  • Board: means the state advisory board for preserves established by this chapter. See Iowa Code 465C.1
  • Board: means the board of supervisors of a county. See Iowa Code 331.101
  • Board: means the cooperative's board of directors. See Iowa Code 501.101
  • Brand family: means all styles of cigarettes sold under the same trademark and differentiated from one another by means of additional modifiers or descriptors, including but not limited to "menthol" "lights" "kings" and "100s" and including any brand name (alone or in conjunction with any other word), trademark, logo, symbol, motto, selling message, recognizable pattern of colors, or any other indicia of product identification identical or similar to, or identifiable with, a previously known brand of cigarettes. See Iowa Code 453D.2
  • Building: means and includes one or more buildings, whether attached to one or more buildings or unattached; provided, however, that if there is more than one building, all such buildings shall be described and included in the declaration, or an amendment thereto, and comprise an integral part of a single horizontal property regime. See Iowa Code 499B.2
  • building: means a building used in conjunction with a confinement feeding operation to house animals and in which any manure from the animals is stored as dry bedded manure. See Iowa Code 459B.102
  • Business entity: means a person organized under statute or common law in this state or another jurisdiction for purposes of engaging in a commercial activity on a profit, cooperative, or not-for-profit basis, including but not limited to a corporation or entity taxed as a corporation under the Internal Revenue Code, nonprofit corporation, cooperative or cooperative association, partnership, limited partnership, limited liability company, limited liability partnership, investment company, joint stock company, joint stock association, or trust, including but not limited to a business trust. See Iowa Code 501A.102
  • Business entity: means a corporation, association, partnership, limited liability company, limited liability partnership, or other legal entity. See Iowa Code 522B.1
  • Business entity: means a corporation, association, partnership, limited liability company, limited liability partnership, or any other legal entity. See Iowa Code 522C.2
  • called: when used in the context of an assessment, means that a notice has been issued by the association to member insurers requiring that an authorized assessment be paid within the time frame set forth within the notice. See Iowa Code 508C.5
  • Capacity per pupil: means the sum of a school district's property tax infrastructure capacity per pupil and the sales tax capacity per pupil. See Iowa Code 292.1
  • Carrier: means any entity that provides individual health benefit plans in this state. See Iowa Code 513C.3
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Cemetery: means a space held for the purpose of permanent burial, entombment, or interment of human remains that is owned or managed by a political subdivision or private entity, or a cemetery regulated pursuant to chapter 523I. See Iowa Code 459.102
  • Certificate: means the document issued as written evidence of the benefit contract. See Iowa Code 512B.2
  • Certificate of clearance: means a permit prescribed by the department for the transportation or the delivery of oil or gas or product and issued or registered in accordance with the rule or order requiring the permit. See Iowa Code 458A.2
  • Certificate of organization: means the certificate required by section 489. See Iowa Code 489.102
  • Chambers: A judge's office.
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Charter: means a formal document establishing the functions, powers, organization, structure, privileges, rights, and duties of county government not inconsistent with state law. See Iowa Code 331.101
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child: includes child by adoption. See Iowa Code 4.1
  • Cigarette: means cigarette as defined in section 453C. See Iowa Code 453D.2
  • Civil forfeiture: The loss of ownership of property used to conduct illegal activity.
  • Clerk: means the clerk of the district court or the clerk's designee. See Iowa Code 331.101
  • clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Commercial enterprise: means a building which is used as a part of a business that manufactures goods, delivers services, or sells goods or services, which is customarily and regularly used by the general public during the entire calendar year and which is connected to electric, water, and sewer systems. See Iowa Code 459.102
  • Commercial enterprise: means the same as defined in section 459. See Iowa Code 459B.102
  • Commercial manure service: means a sole proprietor or business association as defined in section 202B. See Iowa Code 459.102

  • Commodity contract: means any of the following:
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • confinement building: means a building used in conjunction with a confinement feeding operation to house animals. See Iowa Code 459.102
  • Confinement feeding operation: means the same as defined in section 459. See Iowa Code 459A.102
  • Confinement feeding operation: means an animal feeding operation in which animals are confined to areas which are totally roofed. See Iowa Code 459.102
  • Confinement feeding operation: means the same as defined in section 459. See Iowa Code 459B.102
  • Confinement feeding operation structure: means an animal feeding operation structure that is part of a confinement feeding operation. See Iowa Code 459.102
  • Confinement site manure applicator: means a person, other than a commercial manure service or a commercial manure service representative, who applies manure on land if the manure originates from a manure storage structure. See Iowa Code 459.102
  • Consumer: means any person who purchases a beverage in a beverage container for use or consumption. See Iowa Code 455C.1
  • Consumer: means a person who purchases portable electronics in a retail transaction. See Iowa Code 522E.1
  • Contaminant: means any chemical, ion, radionuclide, synthetic organic compound, microorganism, waste, or other substance which does not occur naturally in groundwater or which naturally occurs at a lower concentration. See Iowa Code 455E.2
  • Contamination: means the direct or indirect introduction into groundwater of any contaminant caused in whole or in part by human activities. See Iowa Code 455E.2
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Continuing care: means housing together with supportive services, nursing services, medical services, or other health related services, furnished to a resident, regardless of whether or not the lodging and services are provided at the same location, with or without other periodic charges, and pursuant to one or more contracts effective for the life of the resident or a period in excess of one year, including mutually cancelable contracts, and in consideration of an entrance fee. See Iowa Code 523D.1
  • Continuing care retirement community: means a facility which provides continuing care to residents other than residents related by consanguinity or affinity to the person furnishing their care. See Iowa Code 523D.1
  • Contract: means an agreement between an invention developer and a customer under which the invention developer promises to perform invention development services for the customer. See Iowa Code 523G.3
  • Contract: A legal written agreement that becomes binding when signed.
  • contract owner: means the person who is identified as the legal owner of a policy or contract under the terms of the policy or contract or who is otherwise vested with legal title to the policy or contract through a valid assignment completed in accordance with the terms of the policy or contract and properly recorded as the owner on the books of the insurer. See Iowa Code 508C.5
  • Contractual obligation: means an obligation under a covered policy or contract or a certificate under a group policy or contract, or a portion thereof for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Contribution: means any benefit provided by a person to a limited liability company that is any of the following:
  • Control: means the same as defined in section 521A. See Iowa Code 507C.2
  • Controlled substance: means controlled substance as defined in section 124. See Iowa Code 453B.1
  • conversion plan: means a plan authorized by section 508B. See Iowa Code 508B.1
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative: means a business association organized under this chapter. See Iowa Code 501A.102
  • Cooperative: means a cooperative association organized under this chapter or converted to this chapter pursuant to section 501. See Iowa Code 501.101
  • Corner: means a point at which two or more lines meet. See Iowa Code 355.1
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • cost of improvements: means the costs of any improvement which is subject to special assessment including, but not limited to, the costs of engineering, preliminary reports, property valuations, estimates, plans, specifications, notices, acquisition of land, easements, rights-of-way, construction, repair, supervision, inspection, testing, notices and publication, interest during construction and for a reasonable period following the completion of construction, and may include the default fund which shall amount to not more than ten percent of the total cost of an improvement assessed against benefited property. See Iowa Code 468.3
  • Council of co-owners: means all the co-owners of the building. See Iowa Code 499B.2
  • Counter employee: means any employee at least eighteen years of age employed by a rental company that offers the products described in this chapter. See Iowa Code 522A.2
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Counterfeit substance: means a counterfeit substance as defined in section 124. See Iowa Code 453B.1
  • County attorney: means the county attorney or a deputy county attorney or assistant county attorney designated by the county attorney. See Iowa Code 331.101
  • Covered: means organic or inorganic material placed upon an animal feeding operation structure used to store manure as provided by rules adopted by the department after receiving recommendations which shall be submitted to the department by the college of agriculture and life sciences at Iowa state university of science and technology. See Iowa Code 459.102
  • Covered policy: means a policy or contract or a portion of a policy or contract for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Creditor: is a person having a claim against an insurer, whether the claim is matured or unmatured, liquidated or unliquidated, secured or unsecured, absolute, fixed or contingent. See Iowa Code 507C.2
  • Custodial account: means an account established by agreement between a licensed service company and a custodian under section 523C. See Iowa Code 523C.1
  • Custodial agreement: means an agreement entered into between a licensed service company and a custodian under section 523C. See Iowa Code 523C.1
  • Custodian: means an institution meeting the requirements established by the commissioner which institution has entered into a custodial agreement or reserve account agreement with a licensed service company. See Iowa Code 523C.1
  • Customer: means a person who is solicited by, inquires about, seeks the services of, or enters into a contract with an invention developer. See Iowa Code 523G.3
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dealer: means any person who engages in the sale of beverages in beverage containers to a consumer. See Iowa Code 455C.1
  • Dealer: means any person who ships, transports, or imports into this state or acquires, purchases, possesses, manufactures, or produces in this state any of the following:
     (1) Seven or more grams of a taxable substance other than marijuana, but including a taxable substance that is a mixture of marijuana and other taxable substances. See Iowa Code 453B.1
  • Dealer agent: means a person who solicits or picks up empty beverage containers from a dealer for the purpose of returning the empty beverage containers to a distributor or manufacturer. See Iowa Code 455C.1
  • Decedent: A deceased person.
  • Deceptive practice: means communicating a false or fraudulent statement, providing false pretense, making a false promise or misleading statement, misrepresenting a fact, omitting a material fact, or failing to make all disclosures required by this chapter. See Iowa Code 523G.3
  • Dedication: means the allocation of an area as a preserve by a public agency or by a private owner by written stipulation in a form approved by the state advisory board for preserves. See Iowa Code 465C.1
  • deed: is a pplied to an instrument conveying lands, but does not imply a sealed instrument; and the words "bond" and "indenture" do not necessarily imply a seal, and the word "undertaking" means a promise or security in any form. See Iowa Code 4.1
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Delinquency proceeding: means a proceeding instituted against an insurer for the purpose of liquidating, rehabilitating, reorganizing or conserving the insurer, and a summary proceeding under section 507C. See Iowa Code 507C.2
  • delivery: means any method of delivery used in conventional commercial practice, including delivery in person, by mail, commercial delivery, and electronic transmission. See Iowa Code 489.102
  • Department: means the department of revenue. See Iowa Code 453D.2
  • Department: means the department of natural resources created under section 455A. See Iowa Code 455A.1
  • Department: means the department of natural resources created under section 455A. See Iowa Code 455B.101
  • Department: means the department of administrative services. See Iowa Code 8A.101
  • Department: means the department of natural resources created under section 455A. See Iowa Code 455C.1
  • Department: means the department of natural resources created pursuant to section 455A. See Iowa Code 455D.1

  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Depository: means an institution designated by the commissioner as an authorized custodian for purposes of sections 523C. See Iowa Code 523C.1
  • Descendent: One who is directly descended from another such as a child, grandchild, or great grandchild.
  • Designated agricultural drainage well area: means an agricultural drainage well area in which there is located an anaerobic lagoon or earthen manure storage basin required to obtain a construction permit by the department of natural resources. See Iowa Code 460.101
  • Designated area: means a known sinkhole, a cistern, an abandoned well, an unplugged agricultural drainage well, an agricultural drainage well surface inlet, a drinking water well, a designated wetland, or a water source. See Iowa Code 459A.102

  • Distributor: means a person, notwithstanding established residency or location, who purchases non-tax-paid cigarettes and stores, sells, or otherwise disposes of the cigarettes. See Iowa Code 453D.2
  • Distributor: means any person who engages in the sale of beverages in beverage containers to a dealer in this state, including any manufacturer who engages in such sales. See Iowa Code 455C.1
  • distributor: means a person other than a manufacturer or manufacturer's agent who engages in the business of selling or distributing a household hazardous material within the state, for the purpose of resale. See Iowa Code 455F.1
  • Division: means the division of soil conservation and water quality created within the department of agriculture and land stewardship pursuant to section 159. See Iowa Code 460.101
  • Division: means dividing a tract or parcel of land into two parcels of land by conveyance or for tax purposes. See Iowa Code 355.1
  • Docket: A log containing brief entries of court proceedings.
  • Document: means any form required to be processed by the department under this chapter regulating animal feeding operations, including but not limited to applications or related materials for permits as provided in section 459. See Iowa Code 459.102
  • Doing business: means any of the following acts, whether effected by mail or otherwise:
  • Domestic business entity: means a business entity organized under the laws of this state, including but not limited to a limited liability company as defined in section 489. See Iowa Code 501A.102
  • Domestic cooperative: means a cooperative association or other cooperative organized under this chapter or chapter 497, 498, 499, or 501. See Iowa Code 501A.102
  • Domestic cooperative: means an entity organized on a cooperative basis under chapter 497, 498, or 499 or a cooperative organized under chapter 501 or 501A. See Iowa Code 489.102
  • Domestic society: means an association organized under the laws of this state. See Iowa Code 512B.2
  • Domiciliary state: means the state in which an insurer is incorporated or organized, or, in the case of an alien insurer, its state of entry. See Iowa Code 507C.2
  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Dosage unit: means the unit of measurement in which a substance is dispensed to the ultimate user. See Iowa Code 453B.1
  • Drainage district: means a drainage district established pursuant to chapter 468. See Iowa Code 460.101
  • Drainage system: means tile lines, laterals, surface inlets, or other improvements which are constructed to facilitate the drainage of land. See Iowa Code 460.101
  • Dry bedded confinement feeding operation: means a confinement feeding operation in which animals are confined to areas which are totally roofed and in which all manure is stored as dry bedded manure. See Iowa Code 459B.102
  • Dry bedded confinement feeding operation structure: means a dry bedded manure confinement feeding operation building or a dry bedded manure storage structure. See Iowa Code 459B.102
  • Dry bedded manure: means manure from animals that meets all of the following requirements:
  • Dry bedded manure storage structure: means a covered or uncovered structure, other than a building, used to store dry bedded manure originating from a confinement feeding operation. See Iowa Code 459B.102
  • Dry manure: means manure which meets all of the following conditions:
  • Earthen manure storage basin: means an earthen cavity, either covered or uncovered, which, on a regular basis, receives waste discharges from a confinement feeding operation if accumulated wastes from the basin are completely removed at least once each year. See Iowa Code 459.102
  • Earthen storage structure: means an earthen cavity, either covered or uncovered, including but not limited to an anaerobic lagoon or earthen manure storage basin which is used to store manure, sewage, wastewater, industrial waste, or other waste as regulated by the department of natural resources, if stored in a liquid or semiliquid state. See Iowa Code 460.101
  • Educational institution: means a building in which an organized course of study or training is offered to students enrolled in kindergarten through grade twelve and served by local school districts, accredited or approved nonpublic schools, area education agencies, community colleges, institutions of higher education under the control of the state board of regents, and accredited independent colleges and universities. See Iowa Code 459.102
  • Educational institution: means the same as defined in section 459. See Iowa Code 459B.102
  • Effluent: means open feedlot effluent or animal truck wash effluent. See Iowa Code 459A.102
  • Egg washwater storage structure: means an aerobic or anaerobic structure used to store the wastewater resulting from the washing and in-shell packaging of eggs. See Iowa Code 459.102
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Electronic transmission: means any process of communication not directly involving the physical transfer of paper that is suitable for the retention, retrieval, and reproduction of information by the recipient. See Iowa Code 489.102
  • Eligible elector: means eligible elector as defined in section 39. See Iowa Code 275.1
  • Eligible individual: means an individual who is a resident of this state and who either has qualifying existing coverage or has had qualifying existing coverage within the immediately preceding thirty days, or an individual who has had a qualifying event occur within the immediately preceding thirty days. See Iowa Code 513C.3
  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Endorsee: means an unlicensed employee or authorized representative of a licensed portable electronics vendor. See Iowa Code 522E.1
  • Enrollment: means the process of soliciting or accepting enrollments or applications from a consumer under a portable electronics insurance policy, which includes informing the consumer of the availability of coverage, preparing and delivery of the certificate of insurance or notice of proposed insurance, or otherwise assisting the consumer in making an informed decision whether or not to elect to purchase portable electronics insurance. See Iowa Code 522E.1
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entrance fee: means an initial or deferred transfer to a provider of a sum of money or other property made or promised to be made as full or partial consideration for acceptance of a specified individual in a facility if the amount exceeds either of the following:
  • Environmental protection commission: means the environmental protection commission created under section 455A. See Iowa Code 455A.1
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • executor: includes administrator, and the term "administrator" includes executor, where the subject matter justifies such use. See Iowa Code 4.1
  • Exploration: means an on-site geologic examination from the surface of an area by core, rotary, percussion, or other drilling for the purpose of obtaining stratigraphic or metallic mineral resource information or establishing the nature of a known metallic mineral deposit. See Iowa Code 458A.2
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Facility: means the place or places in which a provider undertakes to provide continuing care or senior adult congregate living services to an individual. See Iowa Code 523D.1
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family member: means a person related to another person as parent, grandparent, child, grandchild, sibling, or a spouse of such a related person. See Iowa Code 459.102
  • Farming: means the same as defined in section 9H. See Iowa Code 501.101
  • Federal home loan bank: means a federal home loan bank established under the federal Home Loan Bank Act, 12 U. See Iowa Code 507C.2
  • Fee: means a payment made by a customer to an invention developer, including reimbursements for expenditures made or costs incurred by the invention developer. See Iowa Code 523G.3
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Felony: A crime carrying a penalty of more than a year in prison.
  • Fiduciary: A trustee, executor, or administrator.
  • Field: means the general area underlaid by one or more pools. See Iowa Code 458A.2
  • Filed rate: means , for a rating period related to each block of business, the rate charged to all individuals with similar rating characteristics for individual health benefit plans. See Iowa Code 513C.3
  • Fingerprints: means an impression of the lines on a human finger taken for the purposes of identification. See Iowa Code 522C.2
  • First-party claim: means a claim filed by a person insured under the insurance policy against which the claim is made. See Iowa Code 522C.2
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1

  • Foreign country: means another jurisdiction not in a state. See Iowa Code 507C.2
  • Foreign guaranty association: means a similar entity presently existing in or to be created in the future by the legislature of any other state. See Iowa Code 507C.2
  • Foreign limited liability company: means an unincorporated entity formed under the law of a jurisdiction other than this state and denominated by that law as a limited liability company. See Iowa Code 489.102
  • Foreign society: means an association organized under the laws of another state or territory of the United States. See Iowa Code 512B.2
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Formal delinquency proceeding: means any liquidation or rehabilitation proceeding. See Iowa Code 507C.2
  • Formed animal truck wash effluent structure: means a covered or uncovered impoundment used to store effluent from an animal truck wash facility, which has walls and a floor constructed of concrete, concrete block, wood, steel, or similar materials. See Iowa Code 459A.102
  • Formed manure storage structure: means a covered or uncovered impoundment used to store manure from an animal feeding operation, which has walls and a floor constructed of concrete, concrete block, wood, steel, or similar materials. See Iowa Code 459.102
  • Forward contract: means a contract for the purchase, sale, or transfer of a commodity, as defined in section 1 of the federal Commodity Exchange Act, 7 U. See Iowa Code 507C.2
  • Fraud: Intentional deception resulting in injury to another.
  • Free-trial offer: means an offer to a consumer under which portable electronics insurance is provided free of charge for a limited time period subsequent to which a charge is made to the consumer for the insurance. See Iowa Code 522E.1
  • Frozen ground: means soil that is impenetrable due to frozen soil moisture but does not include soil that is only frozen to a depth of two inches or less. See Iowa Code 459.102
  • Fund: means the Iowa resources enhancement and protection fund created under section 455A. See Iowa Code 455A.1
  • Fund: means the school infrastructure fund created in section 12. See Iowa Code 292.1
  • Garnishment: Generally, garnishment is a court proceeding in which a creditor asks a court to order a third party who owes money to the debtor or otherwise holds assets belonging to the debtor to turn over to the creditor any of the debtor
  • Gas: means and includes all natural gas and all other fluid hydrocarbons which are produced at the wellhead and not hereinabove defined as oil. See Iowa Code 458A.2
  • general assets: includes all property or its proceeds in excess of the amount necessary to discharge the sum or sums secured by the property or its proceeds. See Iowa Code 507C.2
  • Geographic territory: means the geographical area within a perimeter formed by the outermost boundaries served by a distributor. See Iowa Code 455C.1
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Government lot: means a tract, within a section, which is normally described by a lot number as represented and identified on the township plat of the United States public land survey system. See Iowa Code 355.1
  • Governmental entity: means any unit of government in the executive, legislative, or judicial branch of government; an agency or political subdivision; any unit of another state government, including its political subdivisions; any unit of the United States government; or any association or other organization whose membership consists primarily of one or more of any of the foregoing.   • Governmental subdivision: means a county, city, school district, or combination thereof. See Iowa Code 8A.101

  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Groundwater: means any water of the state, as defined in section 455B. See Iowa Code 455E.2
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guaranty association: means the Iowa insurance guaranty association created in chapter 515B, the Iowa life and health insurance guaranty association created in chapter 508C, and any other similar entity either presently existing or to be created by the general assembly for the payment of claims of insolvent insurers.   • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • High-quality water resource: means the same as defined in section 459. See Iowa Code 459A.102

  • Household hazardous material: means a product used for residential purposes and designated by rule of the department of natural resources and may include any hazardous substance as defined in section 455B. See Iowa Code 455F.1
  • Illegal gas: means gas which has been produced from any well within this state in excess of the quantity permitted by any rule or order of the department. See Iowa Code 458A.2
  • Illegal oil: means oil which has been produced from any well within the state in excess of the quantity permitted by any rule or order of the department. See Iowa Code 458A.2
  • Illegal product: means any product derived in whole or in part from illegal oil or illegal gas. See Iowa Code 458A.2
  • Impaired insurer: means a member insurer which, after July 1, 1987, is not an insolvent insurer but is placed under an order of rehabilitation or conservation by a court of competent jurisdiction. See Iowa Code 508C.5
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Indemnity fee: means a fee provided in section 459. See Iowa Code 459.102
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Individual: means a natural person. See Iowa Code 522C.2
  • Individual health benefit plan: means any hospital or medical expense incurred policy or certificate, hospital or medical service plan, or health maintenance organization subscriber contract sold to an individual, or any discretionary group trust or association policy, whether issued within or outside of the state, providing hospital or medical expense incurred coverage to individuals residing within this state. See Iowa Code 513C.3
  • Initial board: means the board of a newly reorganized district that is selected pursuant to section 275. See Iowa Code 275.1
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • insolvent: means any of the following:
     (1) For an insurer issuing only assessable fire insurance policies, either of the following:
     (a) The inability to pay any obligation within thirty days after it becomes payable. See Iowa Code 507C.2
  • Insolvent insurer: means a member insurer which, after July 1, 1987, is placed under an order of liquidation with a finding of insolvency by a court of competent jurisdiction. See Iowa Code 508C.5
  • Insurance: means any of the lines of authority an insurer is authorized to sell in this state. See Iowa Code 522B.1
  • Insurance: includes any and all contracts, arrangements, or agreements contemplated by, falling within, and coming under section 87. See Iowa Code 507E.2A
  • Insurance producer: means a person required to be licensed under the laws of this state to sell, solicit, or negotiate insurance. See Iowa Code 522B.1
  • Insurer: means a person who has done, purports to do, is doing or is licensed to do insurance business, and is or has been subject to the authority of, or to liquidation, rehabilitation, reorganization, supervision, or conservation by an insurance commissioner. See Iowa Code 507C.2
  • Insurer: means a person engaged in the business of insurance who is regulated under chapter 508, 512B, 515, or 520. See Iowa Code 522B.1
  • Insurer: includes an insurer that issues a policy of workers' compensation, a self-insured business for purposes of workers' compensation liability, or a group or self-insured plan as described in section 87. See Iowa Code 507E.2A
  • Insurer-member: means an insurer who is a member of a federal home loan bank. See Iowa Code 507C.2
  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Intellectual disability: means a disability of children and adults who as a result of inadequately developed intelligence have a significant impairment in ability to learn or to adapt to the demands of society, and, if a diagnosis is required, "intellectual disability" means a diagnosis of mental retardation as defined in the diagnostic and statistical manual of mental disorders, fourth edition, text revised, published by the American psychiatric association. See Iowa Code 4.1
  • Interest: means a voting interest or other interest in a cooperative as described in the cooperative's articles of association. See Iowa Code 501.101
  • Interest holder: means a person who owns an interest in a cooperative, whether or not that interest has voting rights. See Iowa Code 501.101
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Internal Revenue Code: means the same as defined in section 422. See Iowa Code 450B.1
  • Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
  • Internet site: means a specific location on the internet that is determined by internet protocol numbers, by a domain name, or by both, including but not limited to domain names that use the designations ". See Iowa Code 4.1
  • Invention: means an original concept which may be rendered into an artistic, educational, or technological expression, including works, compositions, designs, machines, manufacturing or engineering techniques, analyses, or processes. See Iowa Code 523G.3
  • Invention developer: means a person who performs invention development services in this state or offers, through any means of communication, to perform invention development services in this state. See Iowa Code 523G.3
  • Iowa limited liability company: means a limited liability company governed by chapter 489. See Iowa Code 501A.102
  • Irrevocable trust: A trust arrangement that cannot be revoked, rescinded, or repealed by the grantor.
  • Joint districts: means districts that lie in two or more adjacent area education agencies. See Iowa Code 275.1
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Judicial officer: means a supreme court justice, a judge of the court of appeals, a district judge, a district associate judge, an associate juvenile judge, an associate probate judge, or a magistrate. See Iowa Code 4.1
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Karst terrain: means the same as defined in section 459. See Iowa Code 459A.102
  • Karst terrain: means land having karst formations that exhibit surface and subterranean features of a type produced by the dissolution of limestone, dolomite, or other soluble rock and characterized by closed depressions, sinkholes, or caves. See Iowa Code 459.102
  • Karst terrain: means the same as defined in section 459. See Iowa Code 459B.102
  • Land: means land which is used or which is suitable for use for any purpose, if the land is located within an agricultural drainage well area which includes land used or suitable for use in farming. See Iowa Code 460.101
  • Land surveying: means surveying of land pursuant to chapter 542B. See Iowa Code 355.1
  • land surveyor: shall mean a person licensed as a professional land surveyor under the provisions of chapter 542B. See Iowa Code 468.3
  • Laws: means the society's articles of incorporation, constitution, and bylaws, however designated. See Iowa Code 512B.2
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legacy: A gift of property made by will.
  • Legatee: A beneficiary of a decedent
  • Legislative session: That part of a chamber's daily session in which it considers legislative business (bills, resolutions, and actions related thereto).
  • levee: shall be construed to include, in addition to its ordinary and accepted meaning, embankments, revetments, retards, or any other approved system of construction which may be deemed necessary to adequately protect the banks of any river or stream, within or adjacent to any county, from wash, cutting, or erosion. See Iowa Code 468.3
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • liabilities: includes but is not limited to reserves required by statute or by the division's rules or specific requirements imposed by the commissioner upon a company at the time of or subsequent to admission. See Iowa Code 507C.2
  • License: means a document issued pursuant to this chapter by the commissioner authorizing a person to act as an insurance producer for the lines of authority specified in the document. See Iowa Code 522B.1
  • License period: means all of that three-year period beginning as described in paragraph "b" subparagraph (1) or (2), as applicable, and ending the second succeeding year on the last calendar day of the month in which the initial license was issued. See Iowa Code 522E.1
  • Licensed service company: means a service company which is licensed by the commissioner pursuant to this chapter. See Iowa Code 523C.1
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Limited common elements: means and includes those common elements which are specified in or determined under the declaration to be reserved for the use of one or more apartments to the exclusion of the other apartments, such as special corridors, stairways and elevators, sanitary services common to the apartments of a particular floor, and the like. See Iowa Code 499B.2
  • Limited licensee: means a person at least eighteen years of age or an entity authorized to sell certain insurance coverages relating to the rental of vehicles. See Iowa Code 522A.2
  • Limited lines insurance: means any authority granted by the home state which restricts the authority of the license to less than the total authority prescribed in the associated major lines pursuant to section 522B. See Iowa Code 522B.1
  • Lineal descendant: Direct descendant of the same ancestors.
  • Liquid manure: means manure that meets all of the following requirements:
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livestock: means the same as defined in section 717. See Iowa Code 501A.102
  • Livestock: includes but is not limited to an animal classified as an ostrich, rhea, or emu. See Iowa Code 4.1
  • Livestock market: means any place where animals are assembled from two or more sources for public auction, private sale, or on a commission basis, which is under state or federal supervision, including a livestock sale barn or auction market, if such animals are kept for ten days or less. See Iowa Code 459.102
  • Living unit: means a room, apartment, cottage, or other area within a facility set aside for the exclusive use or control of one or more identified residents. See Iowa Code 523D.1
  • local deferred patronage dividends: means that portion of the member's deferred patronage dividends which is proportional to the deferred patronage dividends described in section 499. See Iowa Code 499.2
  • Local match percentage: means a percentage equivalent to either of the following, whichever is less:
  • Lodge: means a subordinate member unit of the society, whether known as a camp, court, council, branch, or by any other designation. See Iowa Code 512B.2
  • Long-term stockpile location: means an area where a person stockpiles manure for more than six months in any two-year period. See Iowa Code 459.102
  • Lot: means a tract of land, generally a subdivision of a city or town block, represented and identified as a lot on a recorded plat. See Iowa Code 355.1
  • Magistrate: means a judicial officer appointed under chapter 602, article 6, part 4. See Iowa Code 4.1
  • Major water source: means a water source that is a lake, reservoir, river, or stream located within the territorial limits of the state, or any marginal river area adjacent to the state, if the water source is capable of supporting a floating vessel capable of carrying one or more persons during a total of a six-month period in one out of ten years, excluding periods of flooding, which has been identified by rules adopted by the commission. See Iowa Code 459.102
  • Major water source: means the same as defined in section 459. See Iowa Code 459B.102
  • Majority leader: see Floor Leaders
  • manager: is a person who is actively involved in the operation of a commercial manure service and takes an important part in making management decisions substantially contributing to or affecting the success of the commercial manure service. See Iowa Code 459.102
  • Manager: means a person that under the operating agreement of a manager-managed limited liability company is responsible, alone or in concert with others, for performing the management functions stated in section 489. See Iowa Code 489.102
  • Manager-managed limited liability company: means a limited liability company that qualifies under section 489. See Iowa Code 489.102
  • Manufacturer: means any person who bottles, cans, or otherwise fills beverage containers for sale to distributors or dealers. See Iowa Code 455C.1
  • Manufacturer: means a person who manufactures or produces a household hazardous material for resale in this state. See Iowa Code 455F.1
  • Manure: means animal excreta or other commonly associated wastes of animals, including but not limited to bedding, litter, or feed losses. See Iowa Code 459.102
  • Manure: means the same as defined in section 459. See Iowa Code 459B.102
  • Manure storage structure: means the same as defined in section 459. See Iowa Code 459A.102
  • Manure storage structure: means a formed manure storage structure or an unformed manure storage structure. See Iowa Code 459.102
  • marginally adjacent territory: means a district or territory which is separated from a second district or territory by property which is part of a third school district which completely surrounds one of the two districts. See Iowa Code 275.1
  • Marijuana: means marijuana as defined in section 124. See Iowa Code 453B.1
  • Master settlement agreement: means master settlement agreement as defined in section 453C. See Iowa Code 453D.2
  • Meander line: means a traverse approximately along the margin of a body of water. See Iowa Code 355.1
  • Measure: means an ordinance, amendment, resolution, or motion. See Iowa Code 331.101
  • medical expense policy: means an accident and sickness insurance policy that provides hospital, medical, and surgical expense coverage. See Iowa Code 514A.3
  • Member: means a person or entity reflected on the books of a cooperative as the owner of governance rights of a membership interest of the cooperative and includes patron and nonpatron members. See Iowa Code 501A.102
  • Member: means a person who owns a voting interest in a cooperative. See Iowa Code 501.101
  • Member: means a person that has become a member of a limited liability company under section 489. See Iowa Code 489.102
  • Member control agreement: means an instrument which controls the investment or governance of nonpatron members, which may be executed by the board and one or more nonpatron members and which may provide for their individual or collective rights to elect directors or to participate in the distribution or allocation of profits or losses. See Iowa Code 501A.102
  • Member insurer: means a person licensed or who holds a certificate of authority to transact in this state any kind of insurance for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Member-managed limited liability company: means a limited liability company that is not a manager-managed limited liability company. See Iowa Code 489.102
  • Membership: means the interest established by a member owning a voting interest. See Iowa Code 501.101
  • Membership interest: includes patron membership interests and nonpatron membership interests. See Iowa Code 501A.102
  • Metallic mineral resources: means the valuable minerals of an area containing metals such as, but not restricted to, lead, copper, zinc, and iron that are presently recoverable or may be recoverable in the future. See Iowa Code 458A.2
  • Minority leader: See Floor Leaders
  • Misdemeanor: Usually a petty offense, a less serious crime than a felony, punishable by less than a year of confinement.
  • month: means a calendar month, and the word "year" and the abbreviation "A. See Iowa Code 4.1
  • Monument: means a physical structure which marks the location of a corner or other survey point. See Iowa Code 355.1
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgage loan: A loan made by a lender to a borrower for the financing of real property. Source: OCC
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • motion: means a statement of policy or an order for action to be taken. See Iowa Code 331.101
  • mutual company: means a level premium and natural premium life insurance company authorized under chapter 508 upon the mutual plan and includes a domestic company which meets the requirements of section 508. See Iowa Code 508B.1
  • Natural resource commission: means the natural resource commission created under section 455A. See Iowa Code 455A.1
  • Navigator: means a public or private entity or an individual that is qualified and licensed, if appropriate, to engage in the activities and meet the standards described in Iowa Code 522D.1
  • Negotiate: means the act of conferring directly with or offering advice directly to a purchaser or prospective purchaser of a particular contract of insurance concerning any of the substantive benefits, terms, or conditions of the contract, provided that the person engaged in that act either sells insurance or obtains insurance from insurers for purchasers. See Iowa Code 522B.1
  • Netting agreement: means an agreement, including terms and conditions incorporated by reference therein, including a master agreement, which master agreement, together with all schedules, confirmations, definitions, and addenda thereto and transactions under any thereof, shall be treated as one netting agreement, that documents one or more transactions between parties to the agreement for or involving one or more qualified financial contracts and that provides for the netting or liquidation of qualified financial contracts or present or future payment obligations or payment entitlements thereunder, including liquidation or closeout values relating to such obligations or entitlements among the parties to the netting agreement. See Iowa Code 507C.2
  • New construction: means construction of a new facility or the expansion of an existing facility if the expansion involves an increase in the number of living units in excess of twenty-five percent. See Iowa Code 523D.1
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nonparticipating manufacturer: means any tobacco product manufacturer that is not a participating manufacturer. See Iowa Code 453D.2
  • Nonpatron member: means a member who holds a nonpatron membership interest. See Iowa Code 501A.102
  • Nonpatron membership interest: means a membership interest that does not require the holder to conduct patronage for or with the cooperative to receive financial rights or distributions. See Iowa Code 501A.102
  • Nonpublic school: means any school, other than a public school, which is accredited pursuant to section 256. See Iowa Code 280.2
  • Nonrefillable beverage container: means a beverage container not intended to be refilled for sale by a manufacturer. See Iowa Code 455C.1
  • NPDES permit: means a permit issued by the department under the national pollutant discharge elimination system pursuant to the federal Water Pollution Control Act of 1972, 33 U. See Iowa Code 459A.102
  • oath: includes affirmation in all cases where an affirmation may be substituted for an oath, and in like cases the word "swear" includes "affirm". See Iowa Code 4.1
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Offset line: means a supplementary traverse close to and approximately parallel with an irregular boundary line. See Iowa Code 355.1
  • Oil: means and includes crude petroleum oil and other hydrocarbons regardless of gravity which are produced at the wellhead in liquid form and the liquid hydrocarbons known as distillate or condensate recovered or extracted from gas, other than gas produced in association with oil and commonly known as casinghead gas. See Iowa Code 458A.2
  • One hundred year floodplain: means the land adjacent to a major water source, if there is at least a one percent chance that the land will be inundated in any one year, according to calculations adopted by rules adopted pursuant to section 459. See Iowa Code 459.102
  • One hundred year floodplain: means the same as defined in section 459. See Iowa Code 459B.102
  • Open feedlot: means a lot, yard, corral, building, or other area used to house animals in conjunction with an open feedlot operation. See Iowa Code 459A.102
  • Open feedlot effluent: means a combination of manure, precipitation-induced runoff, or other runoff from an open feedlot before its settleable solids have been removed. See Iowa Code 459A.102
  • Open feedlot operation structure: means an open feedlot, settled open feedlot effluent basin, a solids settling facility, or an alternative technology system. See Iowa Code 459A.102
  • Operating agreement: means the agreement, whether or not referred to as an operating agreement and whether oral, in a record, implied, or in any combination thereof, of all the members of a limited liability company, including a sole member, concerning the matters described in section 489. See Iowa Code 489.102
  • operation: means an unroofed or partially roofed animal feeding operation if crop, vegetation, or forage growth or residue cover is not maintained as part of the animal feeding operation during the period that animals are confined in the animal feeding operation. See Iowa Code 459A.102
  • Ordinance: means a county law of a general and permanent nature. See Iowa Code 331.101
  • Organizer: means a person that acts under section 489. See Iowa Code 489.102
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means a person who holds legal or equitable title to any of the following:
  • Owner: means the person who has the right to drill into and produce from a pool and to appropriate the oil or gas that person produces therefrom either for that person or others or for that person and others. See Iowa Code 458A.2
  • Participating manufacturer: means participating manufacturer as defined in section II(jj) of the master settlement agreement and all amendments to the master settlement agreement. See Iowa Code 453D.2
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Patron: means a person or entity who conducts patronage with the cooperative, regardless of whether the person is a member. See Iowa Code 501A.102
  • Patron member: means a member holding a patron membership interest. See Iowa Code 501A.102
  • Patron membership interest: means the membership interest requiring the holder to conduct patronage for or with the cooperative, as specified by the cooperative to receive financial rights or distributions. See Iowa Code 501A.102
  • Patronage: means business, transactions, or services done for or with the cooperative as defined by the cooperative. See Iowa Code 501A.102
  • Person: means an individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership, association, or any other legal entity. See Iowa Code 508C.5
  • Person: means and includes any natural person, corporation, association, partnership, receiver, trustee, personal representative, guardian, fiduciary or other representative of any kind, and includes any department, agency, or instrumentality of the state or of any governmental subdivision thereof. See Iowa Code 458A.2
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See Iowa Code 489.102
  • person: means individual, corporation, limited liability company, government or governmental subdivision or agency, business trust, estate, trust, partnership or association, or any other legal entity. See Iowa Code 4.1
  • Person: means an individual or a business entity. See Iowa Code 522B.1
  • Person: means an individual or a business entity. See Iowa Code 522C.2
  • personal property: include money, goods, chattels, evidences of debt, and things in action. See Iowa Code 4.1
  • persons with mental illness: include persons with psychosis, persons who are severely depressed, and persons with any type of mental disease or mental disorder, except that mental illness does not refer to intellectual disability, or to insanity, diminished responsibility, or mental incompetency as defined and used in the Iowa criminal code or in the rules of criminal procedure, Iowa court rules. See Iowa Code 4.1
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • plan: means a plan which provides for the management of open feedlot effluent, or animal truck wash effluent, including the application of effluent as provided in section 459A. See Iowa Code 459A.102
  • Plan sponsor: means any of the following:
  • Plat of survey: means a graphical representation of a survey of one or more parcels of land, including a complete and accurate description of each parcel within the plat, prepared by a licensed professional land surveyor. See Iowa Code 355.1
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • policy of accident and sickness insurance: includes a policy or contract covering insurance against loss resulting from sickness, or from bodily injury or death by accident, or both. See Iowa Code 514A.1
  • Policy owner: means a person who is identified as the legal owner of an insurance policy or contract under the terms of the insurance policy or contract, or who is otherwise vested with legal title to the insurance policy or contract through a valid assignment completed in accordance with the terms of the insurance policy or contract and is properly recorded as the legal owner of the policy or contract in the records of the insurer. See Iowa Code 522B.1
  • Policyholder: means a person, determined by the mutual company, who is the holder of a policy or annuity contract for the purposes of section 508B. See Iowa Code 508B.1
  • Pollution prevention techniques: means any of the following practices employed by the user of a toxic substance:
  • Pool: means an underground reservoir containing a common accumulation of oil or gas or both; each zone of a structure which is completely separated from any other zone in the same structure is a pool, as that term is used in this chapter. See Iowa Code 458A.2
  • Portable electronics: means any of the following devices:
     (1) Personal, self-contained, easily carried by an individual, battery-operated electronic communication, viewing, listening, recording, gaming, computing, or global positioning devices, including cell or satellite phones, pagers, personal global positioning satellite units, portable computers, portable audio listening, video viewing or recording devices, digital cameras, video camcorders, portable gaming systems, docking stations, and automatic answering devices, including their accessories and service related to the use of the devices. See Iowa Code 522E.1
  • Portable electronics insurance: means a contract providing coverage for the repair or replacement of portable electronics against any one or more of the following causes of loss: loss, theft, mechanical failure, malfunction, damage, or other applicable perils. See Iowa Code 522E.1
  • Portable electronics insurance license: means a document issued by the commissioner pursuant to this chapter authorizing a portable electronics vendor to offer or sell portable electronics insurance in this state. See Iowa Code 522E.1
  • Portable electronics vendor: means any person in the business, directly or indirectly, of selling, reselling, soliciting, or leasing portable electronics, their accessories, and related services to consumers. See Iowa Code 522E.1
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Premium: means all moneys paid by an individual and eligible dependents as a condition of receiving coverage from a carrier or an organized delivery system, including any fees or other contributions associated with an individual health benefit plan. See Iowa Code 513C.3
  • Premium: means a premium, rate, dues, or other required contribution by whatever name known, which is payable under the certificate. See Iowa Code 512B.2
  • Premium: means amounts or consideration, by whatever name called, received on covered policies or contracts less returned premiums, considerations, and deposits and less dividends and experience credits. See Iowa Code 508C.5
  • Preserve: means an area of land or water formally dedicated under this chapter for maintenance as nearly as possible in its natural condition though it need not be completely primeval in character at the time of dedication or an area which has unusual flora, fauna, geological, archaeological, scenic, or historical features of scientific or educational value. See Iowa Code 465C.1
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Principal office: means the principal executive office of a limited liability company or foreign limited liability company, whether or not the office is located in this state. See Iowa Code 489.102
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Processed marijuana: means all marijuana except unprocessed marijuana plants. See Iowa Code 453B.1
  • Producer database: means the national database of insurance producers maintained by the national association of insurance commissioners, its affiliates, or subsidiaries. See Iowa Code 522B.1
  • Product: means any commodity made from oil or gas and includes refined crude oil, crude tops, topped crude, processed crude, processed crude petroleum, residue from crude petroleum, cracking stock, uncracked fuel oil, fuel oil, treated crude oil, residuum, gas oil, casinghead gasoline, natural-gas gasoline, kerosene, benzine, wash oil, waste oil, blended gasoline, lubricating oil, blends or mixtures of oil with one or more liquid products or by-products derived from oil or gas, and blends or mixtures of two or more liquid products or by-products derived from oil or gas, whether hereinabove enumerated or not. See Iowa Code 458A.2
  • Professional engineer: means the same as defined in section 459. See Iowa Code 459A.102
  • Professional engineer: means a person engaged in the practice of engineering as defined in section 542B. See Iowa Code 459.102
  • Program: means the school infrastructure program established in section 292. See Iowa Code 292.1
  • Property: includes the land whether committed to the horizontal property regime in fee or as a leasehold interest, the building, all other improvements located thereon, and all easements, rights and appurtenances belonging thereto. See Iowa Code 499B.2
  • property: includes personal and real property. See Iowa Code 4.1
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Provider: means a person undertaking through a lease or other type of agreement to provide care in a continuing care retirement community or senior adult congregate living facility, even if that person does not own the facility. See Iowa Code 523D.1
  • Public adjuster: means any person who for compensation or any other thing of value acts on behalf of an insured by doing any of the following:
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • Public improvement project: means a project relating to the construction of the principal structures, works, component parts, and accessories of any of the following:
  • Public records: means the same as defined in section 22. See Iowa Code 8A.101
  • Public school: means any school directly supported in whole or in part by taxation. See Iowa Code 280.2
  • Public thoroughfare: means a road, street, or bridge that is constructed or maintained by the state or a political subdivision. See Iowa Code 459.102
  • Public use area: means any of the following:
  • Public use area: means the same as defined in section 459. See Iowa Code 459B.102
  • public utility: shall include any person, partnership, business association, or corporation, domestic or foreign, owning or operating any facilities for:
  • Qualified confinement feeding operation: means a confinement feeding operation having an animal unit capacity of any of the following:
  • Qualified escrow fund: means qualified escrow fund as defined in section 453C. See Iowa Code 453D.2
  • Qualified financial contract: means a commodity contract, forward contract, repurchase agreement, securities contract, swap agreement, and any similar agreement that the commissioner determines by regulation, resolution, or order to be a qualified financial contract for the purposes of this chapter. See Iowa Code 507C.2
  • Qualified stockpile cover: means a barrier impermeable to precipitation that is used to protect a stockpile from precipitation. See Iowa Code 459.102
  • Qualified stockpile structure: means any of the following:
  • Qualifying event: means any of the following:
  • qualifying previous coverage: means benefits or coverage provided under any of the following:
     (1) Any group health insurance that provides benefits similar to or exceeding benefits provided under the standard health benefit plan, provided that such policy has been in effect for a period of at least one year. See Iowa Code 513C.3
  • Quorum: The number of legislators that must be present to do business.
  • Rating characteristics: means demographic characteristics of individuals which are considered by the carrier in the determination of premium rates for the individuals and which are approved by the commissioner. See Iowa Code 513C.3
  • Rating period: means the period for which premium rates established by a carrier are in effect. See Iowa Code 513C.3
  • real property: include lands, tenements, hereditaments, and all rights thereto and interests therein, equitable as well as legal. See Iowa Code 4.1
  • Reasonable market demand: means the demand for oil or gas for reasonable current requirements for consumption and use within and without the state, together with such quantities as are reasonably necessary for building up or maintaining reasonable working stocks and reasonable reserves of oil or gas or product. See Iowa Code 458A.2
  • Receiver: means receiver, liquidator, rehabilitator, or conservator as the context requires. See Iowa Code 507C.2
  • Receivership court: means a court in an insolvent or impaired insurer's state having jurisdiction over the conservation, rehabilitation, or liquidation of the insurer. See Iowa Code 508C.5
  • Recess: A temporary interruption of the legislative business.
  • Reciprocal state: means a state other than this state in which section 507C. See Iowa Code 507C.2
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Iowa Code 489.102
  • Record: means the same as defined in section 516E. See Iowa Code 523C.1
  • Recorded vote: means a record, roll call vote. See Iowa Code 331.101
  • Recorder: means the county recorder or a deputy recorder or employee designated by the county recorder. See Iowa Code 331.101
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Recycling: includes but is not limited to the composting of yard waste which has been previously separated from other waste, but does not include any form of energy recovery. See Iowa Code 455D.1
  • Redemption center: means a facility at which consumers may return empty beverage containers and receive payment for the refund value of the empty beverage containers. See Iowa Code 455C.1
  • Regional collection center: means a secured facility at which collection, sorting, and packaging of household hazardous materials and hazardous materials from conditionally exempt small quantity generators are accomplished prior to transportation of these materials to the final disposal site. See Iowa Code 455F.1
  • register: include any mode of permanent recording including but not limited to, card files, microfilm or microfiche, electronic records and the like. See Iowa Code 331.101
  • Registered office: means the office that a limited liability company or foreign limited liability company is required to designate and maintain under section 489. See Iowa Code 489.102
  • Registered voter: means registered voter as defined in section 39. See Iowa Code 275.1
  • Regular board: means the board of a reorganized district that begins to function at the organizational meeting following the second regular school election held after the effective date of the school reorganization, and is comprised of members who were elected to the current terms or were appointed to replace members who were elected. See Iowa Code 275.1
  • Regulations: means all regulations, or resolutions adopted by the supreme governing body or board of directors which are intended to have general application to the members of the society. See Iowa Code 512B.2
  • Religious institution: means a building in which an active congregation is devoted to worship. See Iowa Code 459.102
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Rental agreement: means any written agreement setting forth the terms and conditions governing the use of a vehicle provided by a rental company for rental. See Iowa Code 522A.2
  • Rental company: means any person or entity in the business of primarily providing vehicles intended for the private transportation of passengers to the public under a rental agreement for a period not to exceed ninety days. See Iowa Code 522A.2
  • Rental period: means the term of the rental agreement. See Iowa Code 522A.2
  • Renter: means any person obtaining the use of a vehicle from a rental company under the terms of a rental agreement for a period not to exceed ninety days. See Iowa Code 522A.2
  • Reorganized company: means the domestic stock company into which a mutual company has been converted, converted and merged, or converted and consolidated. See Iowa Code 508B.1
  • Repurchase agreement: means an agreement, including related terms, that provides for the transfer of certificates of deposit, eligible bankers' acceptances, or securities that are direct obligations of, or that are fully guaranteed as to principal and interest by, the United States or an agency of the United States against the transfer of funds by the transferee of the certificates of deposit, eligible bankers' acceptances or securities, with a simultaneous agreement by the transferee to transfer to the transferor certificates of deposit, eligible bankers' acceptances, or securities as described above, at a date certain not later than one year after the transfers or on demand against the transfer of funds. See Iowa Code 507C.2
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Research college: means an accredited public or private college or university, including but not limited to a university under the control of the state board of regents as provided in chapter 262, or a community college under the jurisdiction of a board of directors for a merged area as provided in chapter 260C, if the college or university performs research or experimental activities regarding animal agriculture or agronomy. See Iowa Code 459A.102
  • Reserve account agreement: means an agreement entered into between a licensed service company and a depository under section 523C. See Iowa Code 523C.1
  • Resident: means an individual, sixty years of age or older, entitled to receive care in a continuing care retirement community or a senior adult congregate living facility. See Iowa Code 523D.1
  • Resident: means a person to whom a contractual obligation is owed and who resides in a state on the date of entry of a court order that determines a member insurer is an impaired insurer or a court order that determines a member insurer is an insolvent insurer. See Iowa Code 508C.5
  • Residential: means a permanent place of abode, which is a person's home as opposed to a person's place of business. See Iowa Code 455F.1
  • Residential service contract: means a contract or agreement between a residential customer and a service company which undertakes, for a predetermined fee and for a specified period of time, to maintain, repair, or replace all or any part of the structural components, appliances, or electrical, plumbing, heating, cooling, or air-conditioning systems of residential property containing not more than four dwelling units. See Iowa Code 523C.1
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Restricted network provision: means a provision of an individual health benefit plan that conditions the payment of benefits, in whole or in part, on the use of health care providers that have entered into a contractual arrangement with the carrier to provide health care services to covered individuals. See Iowa Code 513C.3
  • Restricted spray irrigation equipment: means spray irrigation equipment which disperses manure through an orifice at a maximum pressure of eighty pounds per square inch or more. See Iowa Code 459.102
  • Retailer: means a person offering for sale or selling a household hazardous material to the ultimate consumer, within the state. See Iowa Code 455F.1
  • Retracement plat of survey: means a graphical representation of a survey of one or more parcels or tracts of land prepared by a licensed professional land surveyor and described by an existing recorded property description used for the transfer of land. See Iowa Code 355.1
  • Revocable trust: A trust agreement that can be canceled, rescinded, revoked, or repealed by the grantor (person who establishes the trust).
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan. There is no fee to the borrower, who receives a full refund of all fees paid. The right of rescission is guaranteed by the Truth in Lending Act (TILA). Source: OCC
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • road: include public bridges, and may be held equivalent to the words "county way" "county road" "common road" and "state road". See Iowa Code 4.1
  • Rule: includes "regulation". See Iowa Code 4.1
  • Sales tax capacity per pupil: means the estimated amount of revenues that a school district receives or would receive from the secure an advanced vision for education fund pursuant to section 423F. See Iowa Code 292.1
  • Satellite facility: means a secured facility at which collection and storage of household hazardous materials and hazardous materials from conditionally exempt small quantity generators are accomplished prior to transportation of these materials to a regional collection center. See Iowa Code 455F.1
  • School districts affected: means the school districts named in the reorganization petition whether a school district is affected in whole or in part. See Iowa Code 275.1
  • School infrastructure: means activities initiated on or after July 1, 2000, as authorized in section 296. See Iowa Code 292.1
  • seal: shall include an impression upon the paper alone, or upon wax, a wafer affixed to the paper, or an official stamp of a notarial officer as provided in chapter 9B. See Iowa Code 4.1
  • Secretary: means the secretary of state. See Iowa Code 501A.102
  • Secured claim: means a claim secured by mortgage, trust deed, pledge, deposit as security, escrow, or otherwise, but not including special deposit claims or claims against general assets. See Iowa Code 507C.2
  • Securities contract: means a contract for the purchase, sale, or loan of a security, including an option for the repurchase or sale of a security, certificate of deposit, or group or index of securities, including an interest therein or based on the value thereof, or an option entered into on a national securities exchange relating to foreign currencies, or the guarantee of a settlement of cash or securities by or to a securities clearing agency. See Iowa Code 507C.2
  • security: includes a mortgage loan, mortgage-related securities, and an interest in any mortgage loan or mortgage-related security. See Iowa Code 507C.2
  • Sell: means to exchange a contract of insurance by any means, for money or its equivalent, on behalf of an insurer. See Iowa Code 522B.1
  • Senior adult congregate living facility: means a facility which provides senior adult congregate living services to residents other than residents related by consanguinity or affinity to the person furnishing their care. See Iowa Code 523D.1
  • Senior adult congregate living services: means housing and one or more supportive services furnished to a resident, with or without other periodic charges, in consideration of an entrance fee. See Iowa Code 523D.1
  • Service company: means a person who issues and performs, or arranges to perform, services pursuant to a residential service contract. See Iowa Code 523C.1
  • Service of process: The service of writs or summonses to the appropriate party.
  • services: means acts required, promised to be performed, or actually performed by an invention developer for a customer pursuant to a contract which involves facilitating the development, promotion, licensing, publishing, exhibiting, or marketing of an invention. See Iowa Code 523G.3
  • settled effluent: means a combination of manure, precipitation-induced runoff, or other runoff originating from an open feedlot after its settleable solids have been removed. See Iowa Code 459A.102
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Sheriff: means the county sheriff or a deputy sheriff designated by the sheriff. See Iowa Code 331.101
  • Sign: means , with the present intent to authenticate or adopt a record, to do any of the following:
  • Signature: includes an electronic signature as defined in section 554D. See Iowa Code 4.1
  • Simulated controlled substance: means a simulated controlled substance as defined in section 124. See Iowa Code 453B.1
  • Small animal feeding operation: means the same as defined in section 459. See Iowa Code 459A.102
  • Small animal feeding operation: means an animal feeding operation which has an animal unit capacity of five hundred or fewer animal units. See Iowa Code 459.102
  • Small animal truck wash facility: means an animal truck wash facility, if all of the following apply:
  • Snow covered ground: means soil covered by one inch or more of snow or soil covered by one-half inch or more of ice. See Iowa Code 459.102
  • Society: means a fraternal benefit society, unless otherwise indicated. See Iowa Code 512B.2
  • solicitation: means attempting to sell insurance or asking or urging a person to apply for a particular kind of insurance from a particular company. See Iowa Code 522B.1
  • Solids: includes settleable solids and scraped solids. See Iowa Code 459A.102
  • Solids settling facility: means a basin, terrace, diversion, or other structure or solids removal method which is part of an open feedlot operation and which is designed and operated to remove settleable solids from open feedlot effluent. See Iowa Code 459A.102
  • Spray irrigation equipment: means mechanical equipment used for the aerial application of manure, if the equipment receives manure from a manure storage structure during application via a pipe or hose connected to the structure, and includes a type of equipment customarily used for the aerial application of water to aid the growing of general farm crops. See Iowa Code 459.102
  • Stamping agent: means a person authorized to affix tax stamps to packages or other containers of cigarettes pursuant to chapter 453A or any person that is required to pay the tax imposed pursuant to chapter 453A on cigarettes. See Iowa Code 453D.2
  • State: means a state, the District of Columbia, Puerto Rico, or a United States possession, territory, or protectorate. See Iowa Code 508C.5
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the United States Virgin Islands, or any territory or insular possession subject to the jurisdiction of the United States. See Iowa Code 489.102
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
  • State: means a state, district, or territory of the United States and the Panama Canal Zone. See Iowa Code 507C.2
  • state agency: means a unit of state government, which is an authority, board, commission, committee, council, department, or independent agency as defined in section 7E. See Iowa Code 8A.101
  • State law: includes the Constitution of the State of Iowa and state statutes. See Iowa Code 331.101
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • stock company: means a life insurance company authorized under chapter 508 upon the stock plan and includes a domestic company which meets the requirements of section 508. See Iowa Code 508B.1
  • Stockpile: means to store solids from any of the following:
  • Stockpile: means dry manure originating from a confinement feeding operation that is stored at a particular location outside a manure storage structure. See Iowa Code 459.102
  • Stockpile: means to store dry bedded manure outside of a dry bedded manure confinement feeding operation building or a dry bedded manure storage structure. See Iowa Code 459B.102
  • Stockpile dry manure: means to create or add to a stockpile. See Iowa Code 459.102
  • Structure: means any of the following:
  • Structured settlement annuity: means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injuries suffered by the plaintiff or other claimant. See Iowa Code 508C.5
  • Subdivision: means a tract of land divided into three or more lots. See Iowa Code 355.1
  • Subdivision plat: means a graphical representation of the subdivision of land, prepared by a licensed professional land surveyor, having a number or letter designation for each lot within the plat and a succinct name or title that is unique for the county where the land is located. See Iowa Code 355.1
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Supervisor: means a member of the board of supervisors. See Iowa Code 331.101
  • Supportive services: includes but is not limited to one or any combination of the following services: laundry, maintenance, housekeeping, emergency nursing care, activity services, security, dining options, transportation, beauty and barber services, health care, and personal care, including personal hygiene, eating, bathing, dressing, and supervised medication administration. See Iowa Code 523D.1
  • Surface water: means water occurring on the surface of the ground. See Iowa Code 460.101
  • Surface water drain tile intake: means an opening to a drain tile which allows surface water to enter the drain tile without filtration through the soil profile. See Iowa Code 459.102
  • Surface water intake: means an artificial opening to a drain tile line which drains into an agricultural drainage well, if the artificial opening allows surface water to enter the drain tile line without filtration through the soil profile. See Iowa Code 460.101
  • Surveyor: means a licensed professional land surveyor who engages in the practice of land surveying pursuant to chapter 542B. See Iowa Code 355.1
  • Swap agreement: means an agreement, including the terms and conditions incorporated by reference in an agreement, that is a rate swap agreement, basis swap, commodity swap, forward rate agreement, interest rate future, interest rate option, forward foreign exchange agreement, spot foreign exchange agreement, rate cap agreement, rate floor agreement, rate collar agreement, currency swap agreement, cross-currency rate swap agreement, currency future, or currency option or any other similar agreement, and includes any combination of agreements and an option to enter into an agreement. See Iowa Code 507C.2
  • Swine farrow-to-finish operation: means a confinement feeding operation in which porcine animals are produced and in which a primary portion of the phases of the production cycle are conducted at one confinement feeding operation. See Iowa Code 459.102
  • Taxable substance: means a controlled substance, a counterfeit substance, a simulated controlled substance, or marijuana, or a mixture of materials that contains a controlled substance, counterfeit substance, simulated controlled substance, or marijuana. See Iowa Code 453B.1
  • Taxpayer: means a qualified heir liable for the inheritance tax imposed under chapter 450 on qualified real property. See Iowa Code 450B.1
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
  • Testator: A male person who leaves a will at death.
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tobacco product manufacturer: means tobacco product manufacturer as defined in section 453C. See Iowa Code 453D.2
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Traditional cooperative: means a cooperative or cooperative association organized under chapter 497, 498, 499, or 501. See Iowa Code 501A.102
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: includes an assignment, conveyance, deed, bill of sale, lease, mortgage, security interest, encumbrance, gift, or transfer by operation of law. See Iowa Code 489.102
  • Transfer: shall include the sale and every other and different mode, direct or indirect, of disposing of or of parting with property or with an interest in the property, or with the possession of the property or of fixing a lien upon the property or upon an interest in the property, absolutely or conditionally, voluntarily, by or without judicial proceedings. See Iowa Code 507C.2
  • Transferable interest: means the right, as originally associated with a person's capacity as a member, to receive distributions from a limited liability company in accordance with the operating agreement, whether or not the person remains a member or continues to own any part of the right. See Iowa Code 489.102
  • Transferee: means a person to which all or part of a transferable interest has been transferred, whether or not the transferor is a member. See Iowa Code 489.102
  • Treasurer: means the county treasurer or a deputy treasurer or employee designated by the county treasurer. See Iowa Code 331.101
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trial jury: A group of citizens who hear the evidence presented by both sides at trial and determine the facts in dispute. Federal criminal juries consist of 12 persons. Federal civil juries consist of six persons.
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trustee: A person or institution holding and administering property in trust.
  • Unallocated annuity contract: means a guaranteed investment contract, deposit administration contract, or any other annuity contract which is not issued to and owned by an individual, except to the extent of any annuity benefits guaranteed to an individual by an insurer under such a contract or certificate. See Iowa Code 508C.5
  • undertaking: means a promise or security in any form. See Iowa Code 4.1
  • Unformed animal truck wash effluent structure: means a covered or uncovered impoundment used to store animal truck wash effluent, other than a formed animal truck wash effluent structure. See Iowa Code 459A.102
  • Unformed manure storage structure: means a covered or uncovered impoundment used to store manure, other than a formed manure storage structure, which includes an anaerobic lagoon, aerobic structure, or earthen manure storage basin. See Iowa Code 459.102
  • Uniform application: means the current version of the national association of insurance commissioners uniform application for resident and nonresident insurance producer licensing. See Iowa Code 522B.1
  • Uniform business entity application: means the current version of the national association of insurance commissioners uniform business entity application for resident and nonresident business entities. See Iowa Code 522B.1
  • Uniform business entity application: means the current version of the national association of insurance commissioners' uniform business entity application for resident and nonresident business entities. See Iowa Code 522C.2
  • Uniform Commercial Code: A set of statutes enacted by the various states to provide consistency among the states' commercial laws. It includes negotiable instruments, sales, stock transfers, trust and warehouse receipts, and bills of lading. Source: OCC
  • Uniform individual application: means the current version of the national association of insurance commissioners' uniform individual application for resident and nonresident individuals. See Iowa Code 522C.2
  • United States: includes all the states. See Iowa Code 4.1
  • Units sold: means units sold as defined in section 453C. See Iowa Code 453D.2
  • Unprocessed marijuana plant: means any cannabis plant at any level of growth, whether wet, dry, harvested, or growing. See Iowa Code 453B.1
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Usury: Charging an illegally high interest rate on a loan. Source: OCC
  • utilities board: means the utilities board within the utilities division of the department of commerce. See Iowa Code 476.1
  • Variable Rate: Having a "variable" rate means that the APR changes from time to time based on fluctuations in an external rate, normally the Prime Rate. This external rate is known as the "index." If the index changes, the variable rate normally changes. Also see Fixed Rate.
  • Vehicle: means a motor vehicle under section 321. See Iowa Code 522A.2
  • Venue: The geographical location in which a case is tried.
  • Verdict: The decision of a petit jury or a judge.
  • Veto: The procedure established under the Constitution by which the President/Governor refuses to approve a bill or joint resolution and thus prevents its enactment into law. A regular veto occurs when the President/Governor returns the legislation to the house in which it originated. The President/Governor usually returns a vetoed bill with a message indicating his reasons for rejecting the measure. In Congress, the veto can be overridden only by a two-thirds vote in both the Senate and the House.
  • Voting interest: means an interest in a cooperative that has voting rights. See Iowa Code 501.101
  • Waste: means and includes:
  • Waste reduction: means practices which reduce, avoid, or eliminate both the generation of solid waste and the use of toxic materials so as to reduce risks to health and the environment and to avoid, reduce, or eliminate the generation of wastes or environmental pollution at the source and not merely achieved by shifting a waste output or waste stream from one environmental medium to another environmental medium.   • Water of the state: means the same as defined in section 455B. See Iowa Code 459A.102
  • Water of the state: means the same as defined in section 455B. See Iowa Code 459.102
  • Water source: means the same as defined in section 459. See Iowa Code 459A.102
  • Water source: means a lake, river, reservoir, creek, stream, ditch, or other body of water or channel having definite banks and a bed with water flow, except lakes or ponds without outlet to which only one landowner is riparian. See Iowa Code 459.102
  • Water source: means the same as defined in section 459. See Iowa Code 459B.102
  • week: means seven consecutive days. See Iowa Code 4.1
  • Well: means any hole drilled to determine stratigraphic sequence, mineralization, or for the discovery of oil or gas. See Iowa Code 458A.2
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
  • year: means twelve consecutive months. See Iowa Code 4.1
