Terms Used In Iowa Code > Chapter 8A - Department of Administrative Services

  • Accident or health insurance: means hospital, surgical, or major medical insurance, or a combination of these. See Iowa Code 509B.1
  • Account: means the same as defined in section 554. See Iowa Code 554E.1
  • Account: means any of the four accounts created under section 508C. See Iowa Code 508C.5
  • Accredited state: means a state in which the insurance department or regulatory agency has qualified as meeting the minimum financial regulatory standards promulgated and established by the national association of insurance commissioners. See Iowa Code 510A.2
  • Act: means Section 1223 of the Housing and Urban Development Act of 1968, Pub. See Iowa Code 518B.1
  • Active cleanup: means removal, treatment, or isolation of a contaminant from groundwater through the directed efforts of humans. See Iowa Code 455E.2
  • Activity and use limitations: means restrictions or obligations created under this chapter with respect to real property. See Iowa Code 455I.2
  • Actuary: means a person who is a member in good standing of the American academy of actuaries. See Iowa Code 521C.2
  • Actuary: means a person who is a member in good standing of the American academy of actuaries. See Iowa Code 510.1B

  • Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
  • adjusted competitive bid threshold: means the same as the adjusted competitive bid threshold for vertical infrastructure applicable to counties as established by the state department of transportation pursuant to section 314. See Iowa Code 468.3
  • Adjusted risk-based capital report: means a risk-based capital report adjusted by the commissioner pursuant to section 521F. See Iowa Code 521F.2
  • Adjusted risk-based capital report: means a risk-based capital report adjusted by the commissioner pursuant to section 521E. See Iowa Code 521E.1
  • Administrator: means an individual holding a professional administrator license issued under chapter 272 who is employed in a school district administrative position by a school district or area education agency pursuant to a contract issued by a board of directors under section 279. See Iowa Code 284A.2
  • Advertisement: means the attempt by dissemination, solicitation, or circulation to directly or indirectly induce any person to enter into any obligation or acquire any title or interest in land offered for sale or lease to the public in this state. See Iowa Code 543C.1
  • Advertising: means any written, electronic, or printed communication or any communication by means of recorded telephone messages or transmitted on radio, television, the internet, or similar communications media, including film strips, motion pictures, and videos, published, disseminated, circulated, or placed directly before the public in this state, for the purpose of creating an interest in or inducing a person to sell, assign, devise, bequest, or transfer the death benefit or ownership of a life insurance policy pursuant to a viatical settlement contract. See Iowa Code 508E.2
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affected area: means any real property affected, suspected of being affected, or modeled to be likely affected by a release occurring at an enrolled site. See Iowa Code 455H.103
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affiliate: means a corporate parent, subsidiary, or predecessor of a participant, a co-owner or cooperator of a participant, a spouse, parent, or child of a participant, an affiliated corporation or enterprise of a participant, or any other person substantially involved in the legal affairs or management of a participant, as defined by the department. See Iowa Code 455H.103
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agency: means the department of natural resources created by section 455A. See Iowa Code 455I.2
  • Agricultural land: means land in tracts of ten acres or more excluding any buildings or other structures located on the land, and not laid off into lots of less than ten acres or divided by streets and alleys into parcels of less than ten acres, lying within a school corporation and in good faith used for agricultural or horticultural purposes. See Iowa Code 425A.2
  • Alcohol concentration: means the number of grams of alcohol per any of the following:
  • Alcoholic beverage: includes alcohol, wine, spirits, beer, or any other beverage which contains ethyl alcohol and is fit for human consumption. See Iowa Code 462A.2
  • Allegation: something that someone says happened.
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Applicant: means a person authorized to regularly lend moneys to be secured by a mortgage on real property in this state, a licensed real estate broker, a licensed attorney, a participating abstractor, or a licensed closing agent. See Iowa Code 16.92
  • Appraisal: A determination of property value.
  • appraisers: shall mean the persons appointed and qualified to ascertain the value of all land taken and the amount of damage arising from the construction of levee or drainage improvements. See Iowa Code 468.3
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • approval by the members: means approved or ratified by the affirmative vote of a majority of the votes represented and voting at a duly held meeting at which a quorum is present, which affirmative votes also constitute a majority of the required quorum, or by a written ballot or written consent in conformity with this chapter or by the affirmative vote, written ballot, or written consent of such greater proportion, including the votes of all the members of any class, unit, or grouping as may be provided in the articles, bylaws, or this chapter for any specified member action. See Iowa Code 504.141
  • Area: means an area of land or water or both land and water. See Iowa Code 465C.1
  • Arrest: Taking physical custody of a person by lawful authority.
  • articles: includes amended and restated articles of incorporation and articles of merger. See Iowa Code 504.141
  • Articles of incorporation: means the articles of incorporation described in section 490. See Iowa Code 490.140
  • Assessed value: means the base year assessed value, as adjusted by section 437A. See Iowa Code 437A.3
  • Asset: means any of the following:
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Assets: means property whether real, personal, mixed, tangible, or intangible and any right or interest therein, including all rights under a contract or other agreement. See Iowa Code 521I.1
  • Associated asset: means an asset that meets the requirements of section 489. See Iowa Code 489.14102
  • Associated member: means a member that meets the requirements of section 489. See Iowa Code 489.14102
  • Association: means the joint underwriting association established pursuant to this section and sections 519A. See Iowa Code 519A.2
  • Association: means the Iowa county and state mutual insurance guaranty association established pursuant to section 518C. See Iowa Code 518C.3
  • Association: means the Iowa life and health insurance guaranty association created in section 508C. See Iowa Code 508C.5
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means a watershed management authority created pursuant to a chapter 28E agreement as provided in this subchapter. See Iowa Code 466B.21
  • authorized: when used in the context of an assessment, means that a resolution has been passed by the board of directors of the association whereby an assessment will be called immediately or in the future from member insurers for a specified amount. See Iowa Code 508C.5
  • Authorized emergency vessel: means any vessel which is designated or authorized by the commission for use in law enforcement, search and rescue, and disaster work. See Iowa Code 462A.2
  • Authorized shares: means the shares of all classes a domestic or foreign corporation is authorized to issue. See Iowa Code 490.140
  • Authorized-control-level risk-based capital: means the number determined under the risk-based capital formula in accordance with the risk-based capital instructions. See Iowa Code 521E.1
  • Authorized-control-level risk-based capital: means the number determined under the risk-based capital formula in accordance with the risk-based capital instructions. See Iowa Code 521F.2
  • Background levels: means concentrations of hazardous substances naturally occurring and generally present in the environment in the vicinity of an enrolled site or an affected area and not the result of releases. See Iowa Code 455H.103
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • base year assessed value: means the average of the total of these values for each taxpayer for the assessment dates of January 1, 1993, through January 1, 1997, allocated among taxing districts in proportion to the allocation of the taxpayer's January 1, 1998, assessed value among taxing districts. See Iowa Code 437A.3
  • Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.
  • Beginning administrator: means an individual serving under an administrator license, issued by the board of educational examiners under chapter 272, who is assuming a position as a school district principal or superintendent for the first time. See Iowa Code 284A.2
  • Beginning teacher: includes an individual who is an initial teacher. See Iowa Code 284.2
  • Beneficial shareholder: means a person who owns the beneficial interest in shares, which may be a record shareholder or a person on whose behalf shares are registered in the name of an intermediary or nominee. See Iowa Code 490.140
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Benefit corporation: means a corporation that includes in its articles of incorporation a statement that the corporation is subject to this subchapter. See Iowa Code 490.1701
  • Benefit plan: means a specific employee, union, or association of natural persons benefit plan. See Iowa Code 508C.5
  • Bequest: Property gifted by will.
  • Board: means the engineering and land surveying examining board provided by this chapter. See Iowa Code 542B.2
  • Board: means a board of directors of a watershed management authority. See Iowa Code 466B.21
  • Board: means the state advisory board for preserves established by this chapter. See Iowa Code 465C.1
  • board of directors: means the board of directors of a corporation except that no person or group of persons are the board of directors because of powers delegated to that person or group pursuant to section 504. See Iowa Code 504.141
  • Boat livery: means a person who holds a vessel for hire, renting, leasing, or chartering including hotels, motels, or resorts which furnish a vessel to guests as part of the services of the business. See Iowa Code 462A.2
  • Boundary waters: means the waters of the Mississippi, Missouri, and Big Sioux rivers. See Iowa Code 482.2

  • Business: means any trade, occupation, activity, or enterprise engaged in for the purpose of selling or distributing tobacco products in this state. See Iowa Code 453A.42
  • Business of viatical settlements: means an activity involved in but not limited to the offering, soliciting, negotiating, procuring, effectuating, purchasing, investing, financing, monitoring, tracking, underwriting, selling, transferring, assigning, pledging, hypothecating, or in any other manner acquiring an interest in a life insurance policy by means of a viatical settlement contract. See Iowa Code 508E.2
  • Bylaws: means the code or codes of rules other than the articles adopted pursuant to this chapter for the regulation or management of the affairs of a corporation irrespective of the name or names by which such rules are designated. See Iowa Code 504.141
  • called: when used in the context of an assessment, means that a notice has been issued by the association to member insurers requiring that an authorized assessment be paid within the time frame set forth within the notice. See Iowa Code 508C.5
  • Capital: means the capital stock component of a statutory surplus as defined in Iowa law. See Iowa Code 521I.1
  • Capital lease: means a lease classified as a capital lease under generally accepted accounting principles. See Iowa Code 437A.3
  • Capital lease: means a lease classified as a capital lease under generally accepted accounting principles. See Iowa Code 437B.2
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Centrally assessed property tax: means property tax imposed with respect to the value of property determined by the director pursuant to Iowa Code 437A.3

  • Certificate: means a certificate of title. See Iowa Code 462A.2

  • Certificate of organization: means the certificate required by section 489. See Iowa Code 489.102
  • Charge: means any consideration, the admission price or fee asked in return for invitation or permission to enter or go upon the land. See Iowa Code 461C.2
  • Charitable gift annuity: means a transfer of property by a donor to a charitable organization in return for an annuity payable over one or two lives, if the actuarial value of the annuity is less than the value of the property transferred and the difference in value constitutes a charitable deduction for federal tax purposes. See Iowa Code 508F.1
  • Charitable organization: means an entity described by any of the following:
  • Chemical test: means an analysis of a person's blood, breath, urine, or other bodily substance for the determination of the presence of alcohol, a controlled substance, or a drug. See Iowa Code 462A.2
  • Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.
  • Child: includes child by adoption. See Iowa Code 4.1
  • Chronically ill: means any of the following:
  • Claimant: means an insured making a first-party claim or a person instituting a liability claim against an insolvent insurer. See Iowa Code 518C.3
  • Class: means a group of memberships which have the same rights with respect to voting, dissolution, redemption, and transfer. See Iowa Code 504.141
  • Clean claim: means a claim that has no defect or impropriety, including a lack of any required substantiating documentation, or other circumstances requiring special treatment, that prevents timely payment from being made on the claim. See Iowa Code 510B.1
  • clerk: means clerk of the court in which the action or proceeding is brought or is pending; and the words "clerk's office" mean the office of that clerk. See Iowa Code 4.1
  • Clerk of court: An officer appointed by the court to work with the chief judge in overseeing the court's administration, especially to assist in managing the flow of cases through the court and to maintain court records.
  • Cogeneration facility: means a facility with a capacity of two hundred megawatts or less that uses the same energy source for the sequential generation of electrical or mechanical power in combination with steam, heat, or other forms of useful energy and, except for ownership, meets the criteria to be a qualifying cogeneration facility as defined in the federal Public Utility Regulatory Policies Act of 1978, 16 U. See Iowa Code 437A.3
  • Commercial fish helper: means a person who is licensed by the state to assist a commercial fisher or a commercial roe harvester in operating commercial gear or in taking, attempting to take, possessing, or transporting commercial fish, roe species, roe, or turtles. See Iowa Code 482.2
  • Commercial fisher: means a person who is licensed by the state to take, attempt to take, possess, transport, sell, barter, or trade turtles or turtle eggs, commercial fish except roe species, or fish parts except roe. See Iowa Code 482.2
  • Commercial fishing: means taking, attempting to take, possessing, or transporting of commercial fish or turtles for the purpose of selling, bartering, trading, offering, or exposing for sale. See Iowa Code 482.2
  • Commercial gear: means the capturing equipment used by commercial fishers, commercial roe harvesters, and commercial turtle harvesters. See Iowa Code 482.2
  • Commercial roe buyer: means a person who is licensed by the state to engage in the business of buying, selling, bartering, or trading of roe and roe species. See Iowa Code 482.2
  • Commercial roe harvester: means a person who is licensed by the state to engage in the harvest and sale, barter, or trade of roe and roe species. See Iowa Code 482.2
  • Commercial turtle buyer: means a person who is licensed by the state to engage in the business of buying, selling, bartering, or trading commercial turtles or turtle eggs. See Iowa Code 482.2
  • Commercial turtle harvester: means a person who is licensed by the state to take, attempt to take, possess, transport, and sell, barter, or trade commercial turtles or turtle eggs. See Iowa Code 482.2
  • Commercial turtle harvesting: means taking, attempting to take, possessing, or transporting of commercial turtles or turtle eggs for the purpose of selling, bartering, trading, offering, or exposing for sale. See Iowa Code 482.2

  • Common interest community: means a condominium, cooperative, or other real property with respect to which a person, by virtue of the person's ownership of a parcel of real property, is obligated to pay property taxes or insurance premiums for, or for maintenance or improvement of, other real property described in a recorded covenant that creates the common interest community. See Iowa Code 455I.2
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Company: includes a city that owns or operates a municipal utility providing local exchange services pursuant to chapter 476. See Iowa Code 433.12
  • Company: means an electric cooperative referred to in section 437A. See Iowa Code 437.1
  • Company-action-level risk-based capital: means , with respect to any insurer, the product of two and the insurer's authorized-control-level risk-based capital. See Iowa Code 521E.1
  • Company-action-level risk-based capital: means the product of two and the health organization's authorized-control-level risk-based capital. See Iowa Code 521F.2
  • Competitive bidding procedure: means the advertisement for, solicitation of, or the procurement of bids; the manner and condition in which bids are received; and the procedure by which bids are opened, accessed, accepted, rejected, or awarded. See Iowa Code 8A.301
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Comprehensive evaluation: means a summative evaluation of a beginning administrator conducted by an evaluator in accordance with section 284A. See Iowa Code 284A.2
  • Comprehensive evaluation: means a summative evaluation of a beginning teacher conducted by an evaluator for purposes of determining a beginning teacher's level of competency, for recommendation for licensure based upon the Iowa teaching standards, and to determine whether the teacher's practice meets the school district expectations for a career teacher. See Iowa Code 284.2
  • Concurrent resolution: A legislative measure, designated "S. Con. Res." and numbered consecutively upon introduction, generally employed to address the sentiments of both chambers, to deal with issues or matters affecting both houses, such as a concurrent budget resolution, or to create a temporary joint committee. Concurrent resolutions are not submitted to the President/Governor and thus do not have the force of law.
  • Conduit bank: means a length of one or more underground conduits or ducts, whether or not enclosed in concrete, designed to contain underground cables, including a gallery or cable tunnel for power cables. See Iowa Code 437A.3
  • Conservation easement: means an easement as defined in section 457A. See Iowa Code 462B.1
  • Constant attendance: means the presence of a commercial fisher whenever commercial gear is in use. See Iowa Code 482.2
  • Consumer: includes any master-metered facility even though the electricity or natural gas delivered to such facility may ultimately be used by another person. See Iowa Code 437A.3
  • Consumer: includes any master-metered facility even though the water delivered to such facility may ultimately be used by another person. See Iowa Code 437B.2
  • Contaminant: means any chemical, ion, radionuclide, synthetic organic compound, microorganism, waste, or other substance which does not occur naturally in groundwater or which naturally occurs at a lower concentration. See Iowa Code 455E.2
  • Contamination: means the direct or indirect introduction into groundwater of any contaminant caused in whole or in part by human activities. See Iowa Code 455E.2
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: means the same as defined in section 554D. See Iowa Code 554E.1
  • Contract: A legal written agreement that becomes binding when signed.
  • contract owner: means the person who is identified as the legal owner of a policy or contract under the terms of the policy or contract or who is otherwise vested with legal title to the policy or contract through a valid assignment completed in accordance with the terms of the policy or contract and properly recorded as the owner on the books of the member insurer. See Iowa Code 508C.5
  • Contractual obligation: means an obligation under a covered policy or contract or a certificate under a group policy or contract, or a portion thereof for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Contribution: means any benefit provided by a person to a limited liability company that is any of the following:
  • controlled: has the meaning ascribed in section 521A. See Iowa Code 510A.2
  • Controlled insurer: means a licensed insurer that is controlled, directly or indirectly, by an insurance producer. See Iowa Code 510A.2
  • Controlled substance: means any drug, substance, or compound that is regulated under chapter 124, including any counterfeit substance or simulated controlled substance, as well as any metabolite or derivative of the drug, substance, or compound. See Iowa Code 462A.2
  • Controlling person: means a person who directly or indirectly has the power to direct or cause to be directed, the management, control, or activities of the reinsurance intermediary. See Iowa Code 521C.2
  • Controlling producer: means an insurance producer who, directly or indirectly, controls an insurer. See Iowa Code 510A.2
  • Conviction: A judgement of guilt against a criminal defendant.
  • Cooperative association: means an entity that is structured and operated on a cooperative basis pursuant to 26 U. See Iowa Code 490.140
  • Coordinator: means the local food and farm program coordinator created in section 267A. See Iowa Code 267A.2
  • Corporate action: means any action taken by or on behalf of the corporation, including any action taken by the incorporator, the board of directors, a committee of the board of directors, an officer or agent of the corporation, or the shareholders. See Iowa Code 490.145
  • Corporation: means a public benefit, mutual benefit, or religious corporation. See Iowa Code 504.141
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Corrective order: means an order issued by the commissioner specifying corrective actions which the commissioner has determined are required. See Iowa Code 521F.2
  • Corrective order: means an order issued by the commissioner of insurance specifying corrective actions which the commissioner has determined are required. See Iowa Code 521E.1
  • Cost: means the same as defined in section 384. See Iowa Code 468.585
  • cost of improvements: means the costs of any improvement which is subject to special assessment including, but not limited to, the costs of engineering, preliminary reports, property valuations, estimates, plans, specifications, notices, acquisition of land, easements, rights-of-way, construction, repair, supervision, inspection, testing, notices and publication, interest during construction and for a reasonable period following the completion of construction, and may include the default fund which shall amount to not more than ten percent of the total cost of an improvement assessed against benefited property. See Iowa Code 468.3
  • Cost-sharing: means any coverage limit, copayment, coinsurance, deductible, or other out-of-pocket cost obligation imposed by a health benefit plan on a covered person. See Iowa Code 510B.1
  • Council: means the local food and farm program council established in section 267A. See Iowa Code 267A.2
  • Counter employee: means any employee at least eighteen years of age employed by a rental company that offers the products described in this chapter. See Iowa Code 522A.2
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • Covered claim: means an unpaid claim, including one for unearned premiums, which arises out of and is within the coverage and subject to the applicable limits of an insurance policy subject to this chapter which is issued by an insurer, if the insurer becomes an insolvent insurer on or after July 1, 2000, and one of the following conditions exists:
     (1) The claimant is a resident of this state at the time of the event giving rise to the covered claim. See Iowa Code 518C.3
  • covered contract: means a policy or contract, or a portion of a policy or contract, for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Covered person: means a policyholder, subscriber, or other person participating in a health benefit plan that has a prescription drug benefit managed by a pharmacy benefits manager. See Iowa Code 510B.1
  • Credit report: A detailed report of an individual's credit history prepared by a credit bureau and used by a lender in determining a loan applicant's creditworthiness. Source: OCC
  • Cut-off switch: means an operable factory-installed or dealer-installed emergency cut-off engine stop switch that is installed on a personal watercraft. See Iowa Code 462A.2
  • Cut-off switch lanyard: means the cord used to attach the person of the operator of a personal watercraft to the cut-off switch. See Iowa Code 462A.2
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Date of the defective corporate action: means the date or, if the defective corporate action occurred or may have occurred on more than one date, the range of dates, or the approximate date or range of dates, if the exact date or range of dates is unknown or not readily ascertainable, the defective corporate action was purported to have been taken. See Iowa Code 490.145
  • Dealer: means a person who engages in whole or in part in the business of buying, selling, or exchanging vessels either outright or on conditional sale, bailment, lease, security interest, or otherwise, and who has an established place of business for sale, trade, and display of vessels. See Iowa Code 462A.2
  • Dealer: means a person who engages in whole or in part in the business of buying, selling, or exchanging vessels either outright or on conditional sale, bailment, lease, security interest, or otherwise, and who has an established place of business for sale, trade, and display of vessels.   • debtors: shall include the debtors of one or more subsidiary corporations, and the debtors of one or more affiliated corporations, proprietors or partnerships if the business of the policyholder and of such affiliated corporations, proprietors or partnerships is under common control through stock ownership, contract, or otherwise.   • Decedent: A deceased person.
  • Dedication: means the allocation of an area as a preserve by a public agency or by a private owner by written stipulation in a form approved by the state advisory board for preserves. See Iowa Code 465C.1
  • deed: is a pplied to an instrument conveying lands, but does not imply a sealed instrument; and the words "bond" and "indenture" do not necessarily imply a seal, and the word "undertaking" means a promise or security in any form. See Iowa Code 4.1
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defective corporate action: means all of the following:
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Degree: means a postsecondary credential conferring on the recipient the title of associate, bachelor, master, or doctor, or an equivalent title, signifying educational attainment based on study which may be supplemented by experience or achievement testing. See Iowa Code 261B.2
  • Delegates: means those persons elected or appointed to vote in a representative assembly for the election of a director or directors or on other matters. See Iowa Code 504.141
  • delivered: means any method of delivery used in conventional commercial practice, including delivery in person, by mail, commercial delivery, and electronic transmission. See Iowa Code 488.102
  • Delivery: means the physical transfer of electricity or natural gas to a consumer. See Iowa Code 437A.3

  • dissolved corporation: means a corporation whose articles of dissolution have become effective and includes a successor entity to which the remaining assets of the corporation are transferred subject to its liabilities for purposes of liquidation. See Iowa Code 490.1403

  • district: means a district defined by a county and one or more cities within the county pursuant to an agreement entered into by the county and cities in accordance with chapter 28E and this part with respect to drainage improvements which the county and cities determine benefit the property located in the cities and the designated unincorporated area of the county.   • Dividing insurer: means a domestic stock insurer that approves a plan of division. See Iowa Code 521I.1
  • Division: means the Iowa title guaranty division in the authority, the director of the division, or a designee of the director. See Iowa Code 16.92
  • division: means a transaction in which a domestic stock insurer splits into two or more resulting domestic stock insurers. See Iowa Code 521I.1
  • division: means the insurance division. See Iowa Code 505.1
  • Docket: A log containing brief entries of court proceedings.
  • Document: means any of the following:
  • domestic business corporation: means a corporation for profit, which is not a foreign corporation, incorporated under this chapter. See Iowa Code 490.140
  • Domestic cooperative: means an entity organized on a cooperative basis under chapter 497, 498, or 499, a cooperative organized under chapter 499A, or a cooperative organized under chapter 501 or 501A. See Iowa Code 489.102
  • Domestic corporation: means a corporation. See Iowa Code 504.141
  • Domestic health organization: means a health organization domiciled in this state. See Iowa Code 521F.2
  • Domestic insurer: means an insurance company domiciled in this state and licensed to transact the business of insurance under chapter 508, 512B, 515, or 520, except that it shall not include any of the following:
  • domestic nonprofit corporation: means a corporation incorporated under the laws of this state and subject to the provisions of chapter 504. See Iowa Code 490.140
  • Domestic stock insurer: means a stock insurer domiciled and organized under the laws of this state pursuant to chapter 508, 514B, or 515, including domestic stock insurers affiliated with a mutual insurance holding company organized pursuant to section 521A. See Iowa Code 521I.1
  • Donee: The recipient of a gift.
  • Donor: The person who makes a gift.
  • Drainage improvement: includes the construction, improvement, or repair of the principal structures, works, component parts and accessories of a storm sewer, drainage conduit, channel, or levee for the collection, detention, or discharge of drainage or surface waters. See Iowa Code 468.585
  • Electric company: includes a combination natural gas company and electric company. See Iowa Code 437A.3
  • Electric competitive service area: means an electric service area assigned by the utilities board under chapter 476 as of January 1, 1999, including utility property and facilities described in section 476. See Iowa Code 437A.3
  • Electric cooperative: means an electric utility provider formed or organized as an electric cooperative under the laws of this state or elsewhere. See Iowa Code 437A.3
  • Electric cooperative: means an electric utility provider formed or organized as an electric cooperative under the laws of this state or elsewhere. See Iowa Code 437.1
  • Electric power generating plant: means a nameplate rated electric power generating plant, which produces electric energy from other forms of energy, including all taxable land, buildings, and equipment used in the production of such electric energy. See Iowa Code 437A.3

  • Electronic: means relating to technology having electrical, digital, magnetic, wireless, optical, electromagnetic, or similar capabilities. See Iowa Code 490.140
  • Electronic funds transfer: The transfer of money between accounts by consumer electronic systems-such as automated teller machines (ATMs) and electronic payment of bills-rather than by check or cash. (Wire transfers, checks, drafts, and paper instruments do not fall into this category.) Source: OCC
  • Electronic mail: means an electronic transmission directed to a unique electronic mail address. See Iowa Code 490.140
  • Electronic mail address: means a destination, commonly expressed as a string of characters, consisting of a unique user name or mailbox, commonly referred to as the "local part" of the address, and a reference to an internet domain, commonly referred to as the "domain part" of the address, whether or not displayed, to which electronic mail may be sent or delivered.   • Electronic record: means information that is stored in an electronic or other nontangible medium and is retrievable in paper form through an automated process used in conventional commercial practice, unless otherwise authorized in accordance with section 490. See Iowa Code 490.140
  • Electronic transmission: means any process of communication not directly involving the physical transfer of paper that is suitable for the retention, retrieval, and reproduction of information by the recipient. See Iowa Code 489.102
  • electronically transmitted: means any process of communication not directly involving the physical transfer of paper that is suitable for the retention, retrieval, and reproduction of information by the recipient. See Iowa Code 488.102
  • electronically transmitted: means any process of communication not directly involving the physical transfer of paper that is suitable for the retention, retrieval, and reproduction of information by the recipient. See Iowa Code 504.141
  • electronically transmitted: means any form or process of communication not directly involving the physical transfer of paper or another tangible medium, which is all of the following:
  • Eligible entity: means a domestic or foreign unincorporated entity or a domestic or foreign nonprofit corporation. See Iowa Code 490.140
  • Eligible interests: means interests or memberships. See Iowa Code 490.140
  • Eligible retired state employee: means a former employee of the government of the state of Iowa, including but not limited to any departments, agencies, boards, bureaus, or commissions of the state of Iowa, who is receiving the minimum level of retirement benefits for eligibility under this section and who is participating in a state health or medical group insurance plan which covers the former employee and the former employee's spouse at the time of the death of the former employee.   • employees: shall include the employees of one or more subsidiary corporations, and the employees, individual proprietors, and partners of one or more affiliated corporations, proprietors or partnerships if the business of the employer and of such affiliated corporations, proprietors or partnerships is under common control through stock ownership, contract, or otherwise.   • Endangered species: means any species of fish, plant life, or wildlife which is in danger of extinction throughout all or a significant part of its range. See Iowa Code 481B.1
  • engineering: means "professional engineer" or "professional engineering". See Iowa Code 542B.2
  • Enrolled site: means any property which has been or is suspected to be the site of or affected by a release and which has been enrolled pursuant to this chapter by a participant. See Iowa Code 455H.103
  • Entitlement: A Federal program or provision of law that requires payments to any person or unit of government that meets the eligibility criteria established by law. Entitlements constitute a binding obligation on the part of the Federal Government, and eligible recipients have legal recourse if the obligation is not fulfilled. Social Security and veterans' compensation and pensions are examples of entitlement programs.
  • Entity: includes a domestic or foreign business corporation; domestic or foreign nonprofit corporation; domestic or foreign unincorporated entity; estate; trust; state; the United States; governmental subdivision; and foreign government. See Iowa Code 504.141
  • Entity: includes a domestic and foreign business corporation; domestic and foreign nonprofit corporation; estate; trust; domestic and foreign unincorporated entity; and a state, the United States, and a foreign government. See Iowa Code 490.140
  • Environmental claim: means a civil action for damages for environmental harm and includes a civil action under this chapter for recovery of the costs of conducting a response action, but does not include a civil action for damages for a breach of contract or another agreement between persons or for a breach of a warranty that exists pursuant to the Code or common law of this state.   • Environmental covenant: means a servitude arising under an environmental response project that imposes activity and use limitations or the written document creating such servitude. See Iowa Code 455I.2

  • Environmental harm: means injury, death, loss, or threatened loss to a person or property caused by exposure to or the release of a hazardous substance. See Iowa Code 455H.304
  • Environmental response project: means a plan or work performed for environmental remediation or flood control affecting real property and conducted under or by one of the following:
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one.   • Escheat: Reversion of real or personal property to the state when 1) a person dies without leaving a will and has no heirs, or 2) when the property (such as a bank account) has been inactive for a certain period of time. Source: OCC
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Established place of business: means the place actually occupied either continuously or at regular periods by a dealer or manufacturer where the dealer's or manufacturer's books and records are kept and a large share of the dealer's or manufacturer's business is transacted. See Iowa Code 462A.2
  • Evaluation: means a summative evaluation of an administrator used to determine whether the administrator's practice meets school district expectations and the Iowa standards for school administrators adopted pursuant to section 256. See Iowa Code 284A.2
  • Evaluator: means an administrator or other practitioner who successfully completes an evaluator training program pursuant to section 284. See Iowa Code 284.2
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Ex officio: Literally, by virtue of one's office.
  • executor: includes administrator, and the term "administrator" includes executor, where the subject matter justifies such use. See Iowa Code 4.1
  • Executor: A male person named in a will to carry out the decedent
  • Expenses: means reasonable expenses of any kind, including reasonable fees and expenses of counsel and experts, that are incurred in connection with a matter. See Iowa Code 490.140
  • Extra-contractual claim: means , without limitation, a claim relating to bad faith in the payment of claims, punitive or exemplary damages, or attorney fees and costs. See Iowa Code 508C.5
  • Facility: means the multistate life and health insurance resolution facility created pursuant to section 508D. See Iowa Code 508D.3
  • Facility: means an institution providing health care services or a health care setting, including but not limited to hospitals and other licensed inpatient centers, ambulatory surgical or treatment centers, skilled nursing centers, residential treatment centers, diagnostic, laboratory and imaging centers, and rehabilitation and other therapeutic health settings. See Iowa Code 510B.1
  • Failure of authorization: means the failure to authorize, approve, or otherwise effect a corporate action in compliance with the provisions of this chapter, the articles of incorporation or bylaws, a corporate resolution, or any plan or agreement to which the corporation is a party, if and to the extent such failure would render such corporate action void or voidable. See Iowa Code 490.145
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Farm property: means the residence, personal effects, other farm buildings and other personal property used in conjunction with a farming operation. See Iowa Code 518B.1
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system.   • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Fiduciary: A trustee, executor, or administrator.
  • Filed document: means a document filed by the secretary of state under any provision of this chapter except subchapter XV or section 490. See Iowa Code 490.120
  • Filed document: means a document filed with the secretary of state under any provision of this chapter except subchapter XV or section 504. See Iowa Code 504.111

  • Financing entity: means an underwriter, placement agent, lender, purchaser of securities, purchaser of a policy or certificate from a viatical settlement provider, credit enhancer, or any entity that has a direct ownership in a policy or certificate that is the subject of a viatical settlement contract, but subject to all of the following:
     (1) Whose principal activity related to the transaction is providing funds to effect the viatical settlement or purchase of one or more viaticated policies. See Iowa Code 508E.2
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Fish or wildlife: means any member of the animal kingdom, including any mammal, fish, amphibian, mollusk, crustacean, arthropod, or other invertebrate, and includes any part, product, egg, or offspring, or the dead body of parts thereof. See Iowa Code 481B.1
  • Fixed Rate: Having a "fixed" rate means that the APR doesn't change based on fluctuations of some external rate (such as the "Prime Rate"). In other words, a fixed rate is a rate that is not a variable rate. A fixed APR can change over time, in several circumstances:
    • You are late making a payment or commit some other default, triggering an increase to a penalty rate
    • The bank changes the terms of your account and you do not reject the change.
    • The rate expires (if the rate was fixed for only a certain period of time).
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • foreign business corporation: means a corporation incorporated under a law other than the law of this state which would be a business corporation if incorporated under the law of this state. See Iowa Code 490.140
  • Foreign corporation: means a corporation organized under laws other than the laws of this state which would be a nonprofit corporation if formed under the laws of this state. See Iowa Code 504.141
  • Foreign health organization: means a health organization that is not domiciled in this state. See Iowa Code 521F.2
  • Foreign insurer: means an insurance company not domiciled in this state which is licensed to transact the business of insurance in this state under chapter 508, 512B, 515, or 520. See Iowa Code 521E.1
  • Foreign limited liability company: means an unincorporated entity formed under the law of a jurisdiction other than this state and denominated by that law as a limited liability company. See Iowa Code 489.102
  • Foreign limited liability limited partnership: means a foreign limited partnership whose general partners have limited liability for the obligations of the foreign limited partnership under a provision similar to section 488. See Iowa Code 488.102
  • Foreign limited partnership: means a partnership formed under the laws of a jurisdiction other than Iowa and required by those laws to have one or more general partners and one or more limited partners. See Iowa Code 488.102
  • Foreign nonprofit corporation: means a corporation incorporated under a law other than the law of this state which would be a nonprofit corporation if incorporated under the law of this state. See Iowa Code 490.140
  • Foreign professional limited liability company: means a limited liability company organized under laws other than the laws of this state for a purpose for which a professional limited liability company may be organized under this article. See Iowa Code 489.1101
  • Foreign protected series: means an arrangement, configuration, or other structure established by a foreign limited liability company which has attributes comparable to a protected series established under this article. See Iowa Code 489.14102
  • Foreign registration statement: means the foreign registration statement described in section 490. See Iowa Code 490.140
  • Foreign series limited liability company: means a foreign limited liability company that has at least one foreign protected series. See Iowa Code 489.14102
  • Foreign unincorporated entity: means an unincorporated entity whose internal affairs are governed by an organic law of a jurisdiction other than this state. See Iowa Code 504.141
  • Fraud: Intentional deception resulting in injury to another.
  • Fraudulent viatical settlement act: includes any of the following:
  • fund: means the federal riot reinsurance reimbursement fund referred to in this chapter. See Iowa Code 518B.1
  • Fund: means the local food and farm program fund created in section 267A. See Iowa Code 267A.2
  • Game fish: means all species and size categories of fish not included as "commercial species" or minnows. See Iowa Code 482.2
  • General partner: means :
  • Generation and transmission electric cooperative: means an electric cooperative which owns both transmission lines and property which is used to generate electricity. See Iowa Code 437A.3
  • Germane: On the subject of the pending bill or other business; a strict standard of relevance.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Governmental entity: means any unit of government in the executive, legislative, or judicial branch of government; an agency or political subdivision; any unit of another state government, including its political subdivisions; any unit of the United States government; or any association or other organization whose membership consists primarily of one or more of any of the foregoing. See Iowa Code 8A.101
  • Governmental subdivision: means a county, city, school district, or combination thereof. See Iowa Code 8A.101
  • Governmental subdivision: includes an authority, county, district, and municipality. See Iowa Code 504.141
  • Governor: means any person under whose authority the powers of an entity are exercised and under whose direction the activities and affairs of the entity are managed pursuant to the organic law governing the entity and its organic rules. See Iowa Code 490.140
  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • Grantor: means any person with sufficient fee title or other property ownership interests necessary to create a valid environmental covenant under Iowa law. See Iowa Code 455I.2
  • Grantor: The person who establishes a trust and places property into it.
  • Gross estate: The total fair market value of all property and property interests, real and personal, tangible and intangible, of which a decedent had beneficial ownership at the time of death before subtractions for deductions, debts, administrative expenses, and casualty losses suffered during estate administration.
  • Groundwater: means any water of the state, as defined in section 455B. See Iowa Code 455E.2
  • Group policy: means a group accident or health insurance policy issued by an insurance company under chapter 509, a group accident or health contract issued by a health service corporation under chapter 514, or a plan for health care services provided by a health maintenance organization under chapter 514B, or issued or provided by any similar corporation or organization. See Iowa Code 509B.1
  • Guarantor: A party who agrees to be responsible for the payment of another party's debts should that party default. Source: OCC
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Health benefit plan: means a policy, contract, certificate, or agreement offered or issued by a third-party payor to provide, deliver, arrange for, pay for, or reimburse any of the costs of health care services. See Iowa Code 510B.1
  • Health care professional: means a physician or other health care practitioner licensed, accredited, registered, or certified to perform specified health care services consistent with state law. See Iowa Code 510B.1
  • Health care provider: means a health care professional or a facility. See Iowa Code 510B.1
  • Health carrier: means an entity subject to the insurance laws and regulations of this state, or subject to the jurisdiction of the commissioner, including an insurance company offering sickness and accident plans, a health maintenance organization, a nonprofit health service corporation, or a plan established pursuant to chapter 509A for public employees. See Iowa Code 510B.1
  • Health organization: means a health maintenance organization, limited service organization, dental or vision plan, hospital, medical and dental indemnity or service corporation or other managed care organization licensed under chapter 514 or 514B, or any other entity engaged in the business of insurance, risk transfer, or risk retention, that is subject to the jurisdiction of the commissioner of insurance. See Iowa Code 521F.2
  • Holder: means the grantee of an environmental covenant as specified in section 455I. See Iowa Code 455I.2
  • Holder: means the possessor of a fee interest, a tenant, lessee, occupant or person in control of the premises; provided, however, holder shall not mean the state of Iowa, its political subdivisions, or any public body or any agencies, departments, boards, or commissions thereof. See Iowa Code 461C.2
  • Household hazardous material: means a product used for residential purposes and designated by rule of the department of natural resources and may include any hazardous substance as defined in section 455B. See Iowa Code 455F.1
  • Impaired insurer: means a member insurer which is not an insolvent insurer and is placed under an order of rehabilitation or conservation by a court of competent jurisdiction. See Iowa Code 508C.5
  • Import: means to bring into, or introduce into, or attempt to bring into, or attempt to introduce into, any place subject to the jurisdiction of this state. See Iowa Code 481B.1
  • Inboard: means a vessel in which the engine is located internally, the propulsion system is rigidly attached to the engine, and the propulsion mechanism is within the confines of the vessel's extreme length and beam. See Iowa Code 462A.2
  • Inboard-outdrive: means a vessel in which the power plant or engine is located inside of the vessel and the propulsion mechanism is located outside of the transom. See Iowa Code 462A.2
  • Incorporated city utility provider: means a corporation with assets worth one million dollars or more which has one or more platted villages located within the territorial limits of the tract of land which it owns, and which provides electricity to ten thousand or fewer customers. See Iowa Code 437A.3
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Independent casualty actuary: means a casualty actuary who is a member of the American academy of actuaries and who is not an employee, principal, the direct or indirect owner of, affiliated with, or in any way controlled by the insurer or insurance producer. See Iowa Code 510A.2
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • Individual: includes the estate of an incompetent individual. See Iowa Code 504.141
  • Individual: means a natural person. See Iowa Code 490.140
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Insolvent insurer: means an insurer against which a final order of liquidation with a finding of insolvency has been entered on or after July 1, 2000, by a court of competent jurisdiction of this state. See Iowa Code 518C.3
  • Insolvent insurer: means a member insurer which is placed under an order of liquidation with a finding of insolvency by a court of competent jurisdiction. See Iowa Code 508C.5
  • Insurance producer: means a person required to be licensed under the laws of this state to sell, solicit, or negotiate insurance. See Iowa Code 510A.2
  • insured: refer to coverage under a group policy, individual policy, or converted policy on a premium-paying basis, and do not include coverage provided solely as an accrued liability or by reason of a disability extension. See Iowa Code 509B.1
  • Insurer: means a person licensed to transact the business of insurance in this state. See Iowa Code 521C.2
  • Insurer: means a person duly licensed in this state as an insurance company pursuant to this subtitle. See Iowa Code 510.1B
  • Insurer: means a person duly licensed in this state as an insurance company pursuant to this subtitle. See Iowa Code 510.1B
  • Insurer: means a person licensed to transact insurance business in this state under either chapter 518 or chapter 518A either at the time the policy was issued or when the insured event occurred. See Iowa Code 518C.3

  • Intangible property: Property that has no intrinsic value, but is merely the evidence of value such as stock certificates, bonds, and promissory notes.
  • Intellectual disability: means a diagnosis of intellectual disability or intellectual developmental disorder, global developmental delay, or unspecified intellectual disability or intellectual developmental disorder which diagnosis shall be made only when the onset of the person's condition was during the developmental period and based on an assessment of the person's intellectual functioning and level of adaptive skills. See Iowa Code 4.1
  • Intensive assistance: means the provision of organizational support and technical assistance to teachers, other than beginning teachers, for the remediation of identified teaching and classroom management concerns for a period not to exceed twelve months. See Iowa Code 284.2
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest: means either or both of the following rights under the organic law governing an unincorporated entity:
  • Interest holder: means a person who holds of record an interest. See Iowa Code 490.140
  • Interest holder liability: means any of the following:
     (1) Personal liability for a debt, obligation, or other liability of a domestic or foreign corporation or eligible entity that is imposed on a person by any of the following:
     (a) Solely by reason of the person's status as a shareholder, member, or interest holder. See Iowa Code 490.140
  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Internal Revenue Code: means the Internal Revenue Code of 1986 as designated by the Tax Reform Act of 1986, as amended to a date designated by rules adopted by the commissioner. See Iowa Code 508F.1
  • Internal Revenue Code: means the same as defined in section 422. See Iowa Code 450B.1
  • Internet: means the federated international system that is composed of allied electronic communication networks linked by telecommunication channels, that uses standardized protocols, and that facilitates electronic communication services, including but not limited to use of the world wide web; the transmission of electronic mail or messages; the transfer of files and data or other electronic information; and the transmission of voice, image, and video. See Iowa Code 4.1
  • Internet site: means a specific location on the internet that is determined by internet protocol numbers, by a domain name, or by both, including but not limited to domain names that use the designations ". See Iowa Code 4.1
  • Iowa state university: means the Iowa state university of science and technology. See Iowa Code 267.1
  • Joint meeting: An occasion, often ceremonial, when the House and Senate each adopt a unanimous consent agreement
  • Joint resolution: A legislative measure which requires the approval of both chambers.
  • Joint session: When both chambers of a legislature adopt a concurrent resolution to meet together.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Jurisdiction of formation: means the state or country the law of which includes the organic law governing a domestic or foreign corporation or eligible entity. See Iowa Code 490.140
  • Land: includes land that is not open to the general public. See Iowa Code 461C.2
  • land surveyor: shall mean a person licensed as a professional land surveyor under the provisions of chapter 542B. See Iowa Code 468.3
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: means a contract between a lessor and lessee pursuant to which the lessee obtains a present possessory interest in tangible property without obtaining legal title in such property. See Iowa Code 437A.3
  • Lease: means a contract between a lessor and lessee pursuant to which the lessee obtains a present possessory interest in tangible property without obtaining legal title in such property. See Iowa Code 437B.2
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legacy: A gift of property made by will.
  • Legatee: A beneficiary of a decedent
  • Legislature: means the Iowa general assembly. See Iowa Code 462B.1

  • Lender: means a person whose name appears on the records of the museum as the person legally entitled to property held or owing by the museum. See Iowa Code 305B.2
  • lessee: means a nonresident alien, foreign business, or foreign government, or an agent, trustee, or fiduciary acting on behalf of the nonresident alien, foreign business, or foreign government, or any other trade or business which is under the lessee's common control as provided in 26 U. See Iowa Code 9I.3
  • levee: shall be construed to include, in addition to its ordinary and accepted meaning, embankments, revetments, retards, or any other approved system of construction which may be deemed necessary to adequately protect the banks of any river or stream, within or adjacent to any county, from wash, cutting, or erosion. See Iowa Code 468.3
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • Liability: means a secured or contingent debt or obligation arising in any manner. See Iowa Code 521I.1
  • Liability: means a debt or obligation placed with the unit for collection that is greater than one thousand dollars. See Iowa Code 272D.1
  • License: means a privilege granted by the commission to fish, hunt, fur harvest, pursue, catch, kill, take in any manner, use, have possession of, sell, or transport all or part of a wild animal, bird, game, or fish, including any privilege related to a license granted by issuance of a stamp or a payment of a fee. See Iowa Code 483A.1A
  • License: includes licenses for hunting and fishing, or other recreational activity. See Iowa Code 272D.1
  • License agent: means an individual, business, or governmental agency authorized to sell a license. See Iowa Code 483A.1A
  • License document: means an authorization, certificate, or permit issued by the department or a license agent that lists and confers one or more license privileges. See Iowa Code 483A.1A
  • Licensed: includes registered, certified, admitted to practice, or otherwise legally authorized under the laws of this state. See Iowa Code 489.1101
  • Licensed commercial gear: means any commercial gear that is licensed as provided in this chapter and that, when in use, has the proper tags attached as provided by this chapter. See Iowa Code 482.2
  • Licensed health care provider: means and includes a physician and surgeon, osteopathic physician and surgeon, dentist, podiatric physician, optometrist, pharmacist, chiropractor, or nurse licensed pursuant to chapter 147, a hospital licensed pursuant to chapter 135B, and a nursing facility licensed pursuant to chapter 135C. See Iowa Code 519A.2
  • Licensed producer: means an agent, broker, or reinsurance intermediary licensed pursuant to the applicable provision of the insurance law of any jurisdiction. See Iowa Code 521C.2
  • Licensee: means a person to whom a license has been issued, or who is seeking the issuance of a license. See Iowa Code 272D.1
  • Licensing authority: means the supreme court, or an instrumentality, agency, board, commission, department, officer, organization, or any other entity of the state, which has authority within this state to suspend or revoke a license or to deny the renewal or issuance of a license authorizing a person to engage in a business, occupation, profession, recreation, or industry. See Iowa Code 272D.1
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Lienholder: means a person holding a security interest. See Iowa Code 462A.2

  • Life and health insurer: means an insurance company licensed under chapter 508, a fraternal benefit society organized under chapter 512B, or a licensed property and casualty insurer writing only accident and health insurance under chapter 515. See Iowa Code 521E.1

  • Life estate: A property interest limited in duration to the life of the individual holding the interest (life tenant).
  • Life insurance producer: means any person licensed in this state as a resident or nonresident insurance producer who has received qualification or authority for life insurance coverage or a life line of coverage pursuant to chapter 522B. See Iowa Code 508E.2
  • Limited licensee: means a person at least eighteen years of age or an entity authorized to sell certain insurance coverages relating to the rental of vehicles. See Iowa Code 522A.2

  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livestock: includes but is not limited to an animal classified as an ostrich, rhea, or emu. See Iowa Code 4.1
  • Livestock: means swine, sheep, poultry, cattle, ostriches, rheas, or emus. See Iowa Code 267.1
  • Local amount: means the first forty-four million four hundred forty-four thousand four hundred forty-five dollars of the acquisition cost of any major addition which is an electric power generating plant and the total acquisition cost of any other major addition. See Iowa Code 437A.3
  • Local taxing authority: means a city, county, community college, school district, or other taxing authority located in this state and authorized to certify a levy on property located within such authority for the payment of bonds and interest or other obligations of such authority.   • Management plan: means the document that states the goals and objectives of a specific protected water area which has been proposed for designation, the specific description of the area to be protected, land use agreements with property owners, the specific management programming considerations for the area, the in-depth project evaluations, analysis, justifications, and cost estimates, the proposed acquisition of fee title and conservation easements and other agreements, and the specific design and layout of facilities. See Iowa Code 462B.1
  • Management plan: means the document that states the goals and objectives of a specific protected water area which has been proposed for designation, the specific description of the area to be protected, land use agreements with property owners, the specific management programming considerations for the area, the in-depth project evaluations, analysis, justifications, and cost estimates, the proposed acquisition of fee title and conservation easements and other agreements, and the specific design and layout of facilities. See Iowa Code 462B.1
  • Manager: means a person that under the operating agreement of a manager-managed limited liability company is responsible, alone or in concert with others, for performing the management functions stated in section 489. See Iowa Code 489.102
  • Manager-managed limited liability company: means a limited liability company that qualifies under section 489. See Iowa Code 489.102
  • Managing general agent: means any person who engages in all of the following:
     (1) Negotiates and binds ceding reinsurance contracts on behalf of an insurer or manages all or part of the insurance business of an insurer, including the management of a separate division, department, or underwriting office, and who acts as an agent for such insurer whether known as a managing general agent, manager, or other similar term or title. See Iowa Code 510.1B
  • Mandatory-control-level risk-based capital: means the product of seven-tenths and the insurer's authorized-control-level risk-based capital. See Iowa Code 521E.1
  • Mandatory-control-level risk-based capital: means the product of seven-tenths and the health organization's authorized-control-level risk-based capital. See Iowa Code 521F.2
  • Manufacturer: means a person engaged in the business of manufacturing or importing new and unused vessels, or new and unused outboard motors, for the purpose of sale or trade. See Iowa Code 462A.2
  • Manufacturer: means a person who manufactures and sells tobacco products. See Iowa Code 453A.42
  • Manufacturer: means a person who manufactures or produces a household hazardous material for resale in this state. See Iowa Code 455F.1
  • Manufacturer: means a person engaged in the business of manufacturing or importing new and unused vessels, or new and unused outboard motors, for the purpose of sale or trade. See Iowa Code 462A.2
  • Manufacturing: means physical or chemical modification of one or more materials to produce packaging or packaging components. See Iowa Code 455D.19
  • master-metered facility: means any multi-occupancy premises where units are separately rented or owned and where electricity or natural gas is used in centralized heating, cooling, water-heating, or ventilation systems, where individual metering is impractical, where the facility is designated for elderly or handicapped persons and utility costs constitute part of the operating cost and are not apportioned to individual units, or where submetering or resale of service was permitted prior to 1966. See Iowa Code 437A.3
  • master-metered facility: means any multi-occupancy premises where units are separately rented or owned and where individual metering is impractical, where the facility is designated for elderly or handicapped persons and utility costs constitute part of the operating cost and are not apportioned to individual units, or where submetering or resale of service was permitted prior to 1966. See Iowa Code 437B.2
  • Material relationship: means a familial, financial, professional, employment, or other relationship that would reasonably be expected to impair the objectivity of the director's judgment when participating in the action to be taken. See Iowa Code 490.143
  • Maximum allowable cost: means the maximum amount that a pharmacy will be reimbursed by a pharmacy benefits manager or a health carrier for a generic drug, brand-name drug, biologic product, or other prescription drug, and that may include any of the following:
  • Maximum allowable cost list: means a list of prescription drugs that includes the maximum allowable cost for each prescription drug and that is used, directly or indirectly, by a pharmacy benefits manager. See Iowa Code 510B.1
  • Medical malpractice insurance: means insurance coverage against the legal liability of the insured and against loss, damage, or expense incident to a claim arising out of the death or injury of any person as the result of negligence or malpractice in rendering professional service by any licensed health care provider.   • Member: means a person that has become a member of a limited liability company under section 489. See Iowa Code 489.102
  • Member: means a person who on more than one occasion, pursuant to the provisions of a corporation's articles or bylaws, has a right to vote for the election of a director or directors of a corporation, irrespective of how a member is defined in the articles or bylaws of the corporation. See Iowa Code 504.141
  • Member guaranty association: means the Iowa life and health insurance guaranty association created pursuant to chapter 508C or any other state life and health insurance guaranty association which is or becomes a member of the facility pursuant to the plan of operation. See Iowa Code 508D.3
  • Member insurer: means an insurer or health maintenance organization which is licensed or which holds a certificate of authority to transact in this state any kind of insurance or health maintenance business for which coverage is provided under section 508C. See Iowa Code 508C.5
  • Member-managed limited liability company: means a limited liability company that is not a manager-managed limited liability company. See Iowa Code 489.102
  • Membership: refers to the rights and obligations a member or members have pursuant to a corporation's articles, bylaws, and this chapter. See Iowa Code 504.141
  • Membership: means the rights of a member in a domestic or foreign nonprofit corporation. See Iowa Code 490.140
  • Mentor: means an individual employed by a school district or area education agency as a school district administrator or a retired administrator who holds a valid license issued under chapter 272. See Iowa Code 284A.2
  • Mentor: means an individual employed by a school district or area education agency as a teacher or a retired teacher who holds a valid license issued under chapter 272. See Iowa Code 284.2
  • Merger: means a transaction pursuant to section 490. See Iowa Code 490.140
  • Migratory game bird: means any wild goose, brant, wild duck, snipe, rail, woodcock, or coot. See Iowa Code 484A.1

  • Money: means the same as defined in section 554. See Iowa Code 554E.1
  • month: means a calendar month, and the word "year" and the abbreviation "A. See Iowa Code 4.1
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Mortgagee: The person to whom property is mortgaged and who has loaned the money.
  • Mortgagor: The person who pledges property to a creditor as collateral for a loan and who receives the money.
  • Motorboat: means any vessel propelled by an inboard, inboard-outdrive, or outboard engine, whether or not such engine is the principal source of propulsion. See Iowa Code 462A.2
  • Motorboat: means any vessel propelled by an inboard, inboard-outdrive, or outboard engine, whether or not such engine is the principal source of propulsion. See Iowa Code 462A.2
  • Municipal electric cooperative association: means an electric cooperative, the membership of which is composed entirely of municipal utilities. See Iowa Code 437A.3
  • Municipal utility: means all or part of an electric light and power plant system or a natural gas system, either of which is owned by a city, including all land, easements, rights-of-way, fixtures, equipment, accessories, improvements, appurtenances, and other property necessary or useful for the operation of the municipal utility. See Iowa Code 437A.3
  • Municipality: means any city or county in the state. See Iowa Code 461C.2
  • Mutual benefit corporation: means a domestic or foreign corporation that is required to be a mutual benefit corporation pursuant to section 504. See Iowa Code 504.141
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • Natural gas company: includes a combination natural gas company and electric company. See Iowa Code 437A.3
  • Natural gas competitive service area: means any of the fifty-two natural gas competitive service areas described as follows:
     (1) Each of the following municipal natural gas competitive service areas:
     (a) Taylor county, except for those areas of Taylor county which are contained within another municipal natural gas competitive service area as described in this subsection. See Iowa Code 437A.3
  • natural gas service: means such service provided by natural gas pipelines permitted pursuant to chapter 479. See Iowa Code 437A.3
  • Navigable waters: means all lakes, rivers, and streams, which can support a vessel capable of carrying one or more persons during a total of six months in one out of every ten years. See Iowa Code 462A.2
  • Negative trend: means a negative trend over a period of time as determined in accordance with the trend test calculation included in the risk-based capital instructions. See Iowa Code 521E.1
  • Net actual generation: means net electrical megawatt hours produced by a plant during the preceding calendar year. See Iowa Code 437A.3
  • Net capacity factor: means net actual generation during the preceding calendar year divided by the product of nameplate capacity times the number of hours the plant was in the active state during the preceding calendar year. See Iowa Code 437A.3
  • Net direct premiums: means gross direct premiums written on liability insurance as reported in the annual statements filed by the insurers with the commissioner, including the liability component of multiple peril package policies as computed by the commissioner, less return premiums for the unused or unabsorbed portions of premium deposits. See Iowa Code 519A.2
  • Net direct written premiums: means direct gross premiums written in this state on insurance policies subject to this chapter, less return premiums and dividends paid or credited to policyholders on such direct business. See Iowa Code 518C.3
  • network: means pharmacies that have contracted with a pharmacy benefits manager to dispense or sell prescription drugs to covered persons of a health benefit plan for which the pharmacy benefits manager manages the prescription drug benefit. See Iowa Code 510B.1
  • New cogeneration facility: means any of the following:
     (1) A cogeneration facility, regardless of capacity, which is first placed into service on or after January 1, 2009, that uses the same energy source for the sequential generation of electrical or mechanical power in combination with steam, heat, or other forms of useful energy and meets the criteria to be a qualifying cogeneration facility as defined in the federal Public Utility Regulatory Policies Act of 1978, 16 U. See Iowa Code 437A.3
  • New electric power generating plant: means any of the following:
     (1) An electric power generating plant that is owned by or leased to an electric company, electric cooperative, municipal utility, or any other taxpayer, and that initially generates electricity subject to replacement generation tax under section 437A. See Iowa Code 437A.3
  • Nolo contendere: No contest-has the same effect as a plea of guilty, as far as the criminal sentence is concerned, but may not be considered as an admission of guilt for any other purpose.
  • Nonassociated asset: means any of the following:
  • Noncancer health risk: means the potential for adverse systemic or toxic effects caused by exposure to noncarcinogenic hazardous substances expressed as the hazard quotient for a hazardous substance. See Iowa Code 455H.103
  • Nonfiling entity: means an unincorporated entity that is of a type that is not created by filing a public organic record. See Iowa Code 490.140
  • nonpublic school: means those nonpublic schools accredited by the department of education as provided in section 256. See Iowa Code 285.16
  • Nonresident: means every person who is not a resident of this state. See Iowa Code 462A.2
  • Nonresident: means a person who is not a resident as defined in subsection 10. See Iowa Code 483A.1A
  • Nonresident: means every person who is not a resident of this state. See Iowa Code 462A.2
  • Nonrevenue water: means the difference between the total number of gallons of water carried through the water utility's distribution system and the number of gallons of water delivered to consumers using the water utility's distribution system. See Iowa Code 437B.2
  • oath: includes affirmation in all cases where an affirmation may be substituted for an oath, and in like cases the word "swear" includes "affirm". See Iowa Code 4.1
  • Oath: A promise to tell the truth.
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Obligor: means a person with a liability placed with the unit. See Iowa Code 272D.1
  • on-site facility: means an electric power generating plant that is wholly owned by or leased in its entirety to a person and used to generate electricity solely for consumption by such person on the same parcel of land on which such plant is located or on a contiguous parcel of land. See Iowa Code 437A.3
  • Operate: means to navigate or otherwise use a vessel or motorboat. See Iowa Code 462A.2

  • Operating agreement: means the agreement, whether or not referred to as an operating agreement and whether oral, in a record, implied, or in any combination thereof, of all the members of a limited liability company, including a sole member, concerning the matters described in section 489.   • Operating property: means all property owned by or leased to an electric company, electric cooperative, municipal utility, or natural gas company, not otherwise taxed separately, which is necessary to and without which the company could not perform the activities of an electric company, electric cooperative, municipal utility, or natural gas company. See Iowa Code 437A.3
  • Operating property: means all property owned by or leased to a water utility, not otherwise taxed separately, which is necessary to and without which the water utility could not perform the activities of a water utility. See Iowa Code 437B.2
  • Operator: means a person who operates or is in actual physical control of a vessel. See Iowa Code 462A.2
  • Operator: means a person who operates or is in actual physical control of a vessel. See Iowa Code 462A.2
  • Organic law: means a statute principally governing the internal affairs of a domestic or foreign business corporation, nonprofit corporation, or unincorporated entity. See Iowa Code 504.141

  • Organic record: means a public organic record or private organic record. See Iowa Code 504.141
  • Organic rules: means the public organic record and private organic rules of a domestic or foreign corporation or eligible entity. See Iowa Code 490.140
  • Organizer: means a person that acts under section 489. See Iowa Code 489.102
  • Outlays: Outlays are payments made (generally through the issuance of checks or disbursement of cash) to liquidate obligations. Outlays during a fiscal year may be for payment of obligations incurred in prior years or in the same year.
  • Overissue: means the purported issuance of any of the following:
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Oversight organization: means the Iowa commissioner of insurance and the state insurance commissioner, or other state official charged with the responsibility of regulating the insurance industry in the same or similar manner as the Iowa commissioner of insurance, from the state of domicile of each member guaranty association. See Iowa Code 508D.3
  • Owner: means a person, other than a lienholder, having the property right in or title to a motorboat or vessel. See Iowa Code 462A.2

  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Partnership agreement: means the partners' agreement, whether oral, implied, in a record, or in any combination, concerning the limited partnership. See Iowa Code 488.102
  • Party: means a recipient of a notice or document required as part of an insurance transaction, including but not limited to an applicant, an insured, a policyholder, or an annuity contract holder. See Iowa Code 505B.1
  • Passenger: means a person carried on board a vessel, including the operator, and anyone towed by a vessel on water skis, surfboards, inner tubes, or similar devices. See Iowa Code 462A.2

  • personal property: include money, goods, chattels, evidences of debt, and things in action. See Iowa Code 4.1
  • Personal property: All property that is not real property.
  • Personal watercraft: means a vessel, less than sixteen feet in length, which is propelled by a water jet pump or similar machinery as its primary source of motor propulsion and is designed to be operated by a person sitting, standing, or kneeling on the vessel rather than being operated by a person sitting, standing, or kneeling inside the vessel. See Iowa Code 462A.2
  • Pharmacist: means the same as defined in section 155A. See Iowa Code 510B.1
  • Pharmacy: means the same as defined in section 155A. See Iowa Code 510B.1
  • Pharmacy acquisition cost: means the cost to a pharmacy for a prescription drug as invoiced by a wholesale distributor, and reduced by any discounts, rebates, or other price concessions applicable to the prescription drug that are not shown on the invoice and are known at the time that the pharmacy files an appeal with a pharmacy benefits manager. See Iowa Code 510B.1
  • Pharmacy benefits manager: means a person who, pursuant to a contract or other relationship with a third-party payor, either directly or through an intermediary, manages a prescription drug benefit provided by the third-party payor. See Iowa Code 510B.1
  • Pharmacy benefits manager affiliate: means a pharmacy or a pharmacist that directly or indirectly through one or more intermediaries, owns or controls, is owned and controlled by, or is under common ownership or control of, a pharmacy benefits manager. See Iowa Code 510B.1
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plan: means a plan of domestication, conversion, merger, or share exchange. See Iowa Code 490.120
  • Plan: means a plan of entity conversion or merger. See Iowa Code 504.111
  • Plan sponsor: means any of the following:
  • plant life: means any member of the plant kingdom, including seeds, roots, and other parts thereof. See Iowa Code 481B.1
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Pole miles: means miles measured along the line of poles, structures, or towers carrying electric conductors regardless of the number of conductors or circuits carried, and miles of conduit bank, regardless of number of conduits or ducts, of all sizes and types, including manholes and handholes. See Iowa Code 437A.3
  • Policy: means an individual or group policy, group certificate, contract, or arrangement of life insurance owned by a resident of this state, regardless of whether delivered or issued for delivery in this state. See Iowa Code 508E.2
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire.   • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Premium: means amounts or consideration, by whatever name called, received on covered policies or contracts less returned premiums, considerations, and deposits and less dividends and experience credits. See Iowa Code 508C.5
  • Premium: includes any premium or payment or other consideration payable for coverage under a group or individual policy. See Iowa Code 509B.1
  • Prescription drug: means the same as defined in section 155A. See Iowa Code 510B.1
  • Prescription drug benefit: means a health benefit plan providing for third-party payment or prepayment for prescription drugs. See Iowa Code 510B.1
  • Prescription drug order: means the same as defined in section 155A. See Iowa Code 510B.1
  • Presence: means a location in Iowa at which a student participates in any structured activity related to a school's distance education course of instruction, with the exception of proctored examinations. See Iowa Code 261B.2
  • Preserve: means an area of land or water formally dedicated under this chapter for maintenance as nearly as possible in its natural condition though it need not be completely primeval in character at the time of dedication or an area which has unusual flora, fauna, geological, archaeological, scenic, or historical features of scientific or educational value. See Iowa Code 465C.1
  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Principal and primary residence or domicile: means the one and only place where a person has a true, fixed, and permanent home, and to where, whenever the person is briefly and temporarily absent, the person intends to return. See Iowa Code 483A.1A
  • Principal office: means the principal executive office of a limited liability company or foreign limited liability company, whether or not the office is located in this state. See Iowa Code 489.102
  • Principal office: means the office where the principal executive office of a limited partnership or foreign limited partnership is located, whether or not the office is located in this state. See Iowa Code 488.102

  • Printing: means , as used in chapter 7A and this subchapter, the reproduction of an image from a printing surface made generally by a contact impression that causes a transfer of ink, the reproduction of an impression by a photographic process, or the reproduction of an image by electronic means and shall include binding and may include material, processes, or operations necessary to produce a finished printed product, but shall not include binding, rebinding or repairs of books, journals, pamphlets, magazines and literary articles by any library of the state or any of its offices, departments, boards, and commissions held as a part of their library collection.   • Private organic record: means any record, other than a public organic record, if any, that determines the internal governance of an unincorporated entity. See Iowa Code 504.141
  • Private organic rules: means any of the following:
     (1) The bylaws of a domestic or foreign business or nonprofit corporation. See Iowa Code 490.140
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Proceeding: includes a civil suit and criminal, administrative, or investigatory actions. See Iowa Code 504.141

  • Property: means anything of value that is subject to ownership, and includes but is not limited to property classified as real, personal, mixed, tangible or intangible, or any present or future interest in such property. See Iowa Code 508F.1
  • Property and casualty insurer: means an insurance company licensed under chapter 515 but does not include monoline mortgage guaranty insurers, financial guaranty insurers, or title insurers. See Iowa Code 521E.1
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prospective protected water area: means a water area designated by the commission for which an in-depth study for permanent designation as an element of the protected water area system is conducted. See Iowa Code 462B.1
  • Protected groundwater source: means a saturated bed, formation, or group of formations which has a hydraulic conductivity of at least forty-four-hundredths meters per day and a total dissolved solids concentration of less than two thousand five hundred milligrams per liter. See Iowa Code 455H.103
  • Protected party: means any of the following:
  • Protected water area: means a water area permanently designated by the commission for inclusion in the protected water area system. See Iowa Code 462B.1
  • Protected water area system: means a total comprehensive program that includes the goals and objectives, the state plan, the individual management plans, the prospective protected water areas, the protected water areas, the acquisition of fee title and conservation easements and other agreements, and the administration and management of such areas. See Iowa Code 462B.1
  • Protected-series manager: means a person under whose authority the powers of a protected series are exercised and under whose direction the activities and affairs of the protected series are managed under the operating agreement, this article, and this chapter. See Iowa Code 489.14102
  • Protected-series transferable interest: means a right to receive a distribution from a protected series. See Iowa Code 489.14102
  • Protected-series transferee: means a person to which all or part of a protected-series transferable interest of a protected series of a series limited liability company has been transferred, other than the company. See Iowa Code 489.14102
  • Proxy voting: The practice of allowing a legislator to cast a vote in committee for an absent legislator.
  • Public benefit: means a positive effect, or reduction of negative effects, on one or more communities or categories of persons or entities, other than shareholders solely in their capacity as shareholders, or on the environment, including effects of an artistic, charitable, economic, educational, cultural, literary, medical, religious, social, ecological, or scientific nature.   • Public benefit corporation: means a domestic or foreign corporation that is required to be a public benefit corporation pursuant to section 504. See Iowa Code 504.141
  • Public benefit provision: means a provision in the articles of incorporation which states that the corporation shall pursue one or more identified public benefits. See Iowa Code 490.1701
  • Public defender: Represent defendants who can't afford an attorney in criminal matters.
  • public funds: means public funds as defined in section 12C. See Iowa Code 12B.10C
  • Public organic record: means the record, if any, that is filed of public record, to create an unincorporated entity. See Iowa Code 504.141

  • Putative shares: means the shares of any class or series, including shares issued upon exercise of rights, options, warrants or other securities convertible into shares of the corporation, or interests with respect to such shares, that were created or issued as a result of a defective corporate action, and any of the following applies:

  • Receivership court: means a court in an insolvent or impaired insurer's state having jurisdiction over the conservation, rehabilitation, or liquidation of the insolvent or impaired insurer. See Iowa Code 508C.5
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Iowa Code 489.102

  • Reinsurance intermediary-broker: means a person, other than an officer or employee of the ceding insurer, who solicits, negotiates, or places reinsurance cessions or retrocessions on behalf of a ceding insurer without the authority or power to bind reinsurance on behalf of the ceding insurer.   • Reinsurance intermediary-manager: means a person who has authority to bind or manage all or part of the assumed reinsurance business of a reinsurer, including the management of a separate division, department, or underwriting office, and acts as an agent for the reinsurer whether known as a reinsurance intermediary-manager or manager, or known by any other similar term or title. See Iowa Code 521C.2
  • Reinsurer: means a person licensed in this state as a reinsurer with the authority to assume reinsurance. See Iowa Code 521C.2
  • Related provider trust: means a titling trust or other trust established by a licensed viatical settlement provider or a financing entity for the sole purpose of holding the ownership or beneficial interest in purchased policies in connection with a financing transaction. See Iowa Code 508E.2
  • Release: means any spilling, leaking, pumping, pouring, emitting, emptying, discharging, injecting, escaping, leaching, dumping, or disposing into the environment of a hazardous substance, including the abandonment or discarding of barrels, containers, and other closed receptacles containing any hazardous substance, but excludes all of the following:
  • Religious corporation: means a domestic or foreign corporation that engages in religious activity as one of the corporation's principal purposes. See Iowa Code 504.141
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Rental agreement: means any written agreement setting forth the terms and conditions governing the use of a vehicle provided by a rental company for rental. See Iowa Code 522A.2
  • Rental company: means any person or entity in the business of primarily providing vehicles intended for the private transportation of passengers to the public under a rental agreement for a period not to exceed ninety days. See Iowa Code 522A.2
  • Rental period: means the term of the rental agreement. See Iowa Code 522A.2
  • Renter: means any person obtaining the use of a vehicle from a rental company under the terms of a rental agreement for a period not to exceed ninety days. See Iowa Code 522A.2
  • Replacement tax: means the excise tax imposed on the generation, transmission, delivery, consumption, or use of electricity or natural gas under section 437A. See Iowa Code 437A.3
  • Replacement tax: means the excise tax imposed on the delivery of water under section 437B. See Iowa Code 437B.2
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Required information: means the information that a limited partnership is required to maintain under section 488. See Iowa Code 488.102
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Resident: means a person as defined in section 483A. See Iowa Code 482.2

     (1) Pursues through the business of the corporation the creation of a positive effect on society and the environment, taken as a whole, that is material taking into consideration the corporation's size and the nature of its business. See Iowa Code 490.1701
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Resulting insurer: means a dividing domestic stock insurer that survives a division or a new domestic stock insurer that is created by a division. See Iowa Code 521I.1
  • Retailer: means any person engaged in the business of selling tobacco, tobacco products, alternative nicotine products, or vapor products to ultimate consumers. See Iowa Code 453A.42
  • Retailer: means a person offering for sale or selling a household hazardous material to the ultimate consumer, within the state. See Iowa Code 455F.1
  • Revised risk-based capital plan: means a risk-based capital plan that has been rejected by the commissioner and has been revised by the health organization, with or without the commissioner's recommendation. See Iowa Code 521F.2
  • Revised risk-based capital plan: is a risk-based capital plan which has been rejected by the commissioner and has been revised by the insurer, with or without the commissioner's recommendation. See Iowa Code 521E.1
  • right of contribution: means any benefit provided by a person to a limited partnership in order to become a partner or in the person's capacity as a partner. See Iowa Code 488.102
  • Right of rescission: Right to cancel, within three business days, a contract that uses the home of a person as collateral, except in the case of a first mortgage loan.   • Sale: means any transfer, exchange, or barter, in any manner or by any means whatsoever, for a consideration, and includes and means all sales made by any person. See Iowa Code 453A.42
  • Sale: means any sale, offer for sale, or attempt to sell or lease any land, to the public in this state, for cash or on credit. See Iowa Code 543C.1
  • Satellite facility: means a secured facility at which collection and storage of household hazardous materials and hazardous materials from conditionally exempt small quantity generators are accomplished prior to transportation of these materials to a regional collection center. See Iowa Code 455F.1
  • School: means an agency of the state or political subdivision of the state, individual, partnership, company, firm, society, trust, association, corporation, or any combination which meets any of the following criteria:
  • School board: means the board of directors of a school district or a collaboration of boards of directors of school districts. See Iowa Code 284A.2

  • Sequester: To separate. Sometimes juries are sequestered from outside influences during their deliberations.
  • Serious injury: means the same as defined in section 702. See Iowa Code 462A.2
  • Service area: means the geographical area within this state to which the water utility delivers water and related services. See Iowa Code 437B.2
  • Service of process: The service of writs or summonses to the appropriate party.
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.

  • State plan: means a long-range comprehensive document that states the goals and objectives of the protected water area system, establishes the procedure and criteria for prospective protected water area designation, provides the format for prospective area analysis, establishes a priority system for prospective area study, recommends potential areas for inclusion into the system, institutes interagency coordination, and outlines general administrative and management needs to develop and administer this system.   • Statewide amount: means the acquisition cost of any major addition which is not a local amount. See Iowa Code 437A.3
  • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Storage: means any keeping or retention of tobacco products for use or consumption in this state. See Iowa Code 453A.42
  • Stranger-originated life insurance: means a practice or an act to initiate a life insurance policy for the benefit of a third-party investor who, at the time of policy origination, has no insurable interest in the insured. See Iowa Code 508E.2
  • Structured settlement annuity: means an annuity purchased in order to fund periodic payments for a plaintiff or other claimant in payment for or with respect to personal injuries suffered by the plaintiff or other claimant. See Iowa Code 508C.5
  • Student: means a person who enrolls in or seeks to enroll in a course of instruction offered or conducted by a school. See Iowa Code 261B.2
  • Subpoena: A command to a witness to appear and give testimony.
  • Subscriber: means a person who subscribes for shares in a corporation, whether before or after incorporation. See Iowa Code 490.140
  • Summons: Another word for subpoena used by the criminal justice system.
  • Surplus: means total statutory surplus less capital stock calculated in accordance with the current national association of insurance commissioners' accounting practices and procedures manual. See Iowa Code 521I.1
  • Tax year: means a calendar year beginning January 1 and ending December 31. See Iowa Code 437A.3

  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent

  • Threatened species: means any species which is likely to become an endangered species within the foreseeable future throughout all or a significant portion of its range. See Iowa Code 481B.1
  • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.

  • Viatical settlement purchaser: means a person who provides a sum of money as consideration for a life insurance policy or an interest in the death benefits of a life insurance policy, or a person who owns or acquires or is entitled to a beneficial interest in a trust that owns a viatical settlement contract or is the beneficiary of a life insurance policy that has been or will be the subject of a viatical settlement contract, for the purpose of deriving an economic benefit. See Iowa Code 508E.2
  • Viaticated policy: means a life insurance policy or certificate that has been acquired by a viatical settlement provider pursuant to a viatical settlement contract. See Iowa Code 508E.2
  • Viator: includes but is not limited to an owner of a life insurance policy or a certificate holder under a group policy insuring the life of an individual with a terminal or chronic illness or condition except where specifically addressed. See Iowa Code 508E.2
  • Voluntary transfer: includes a sale, voluntary assignment, gift, pledge, or encumbrance; a voluntary change of legal or equitable ownership or beneficial interest; or a voluntary change of persons having voting rights with respect to any transferable interest, except as proxies. See Iowa Code 489.1101
  • Vote: includes authorization by written ballot and written consent. See Iowa Code 504.141
  • Voting group: means all shares of one or more classes or series that under the articles of incorporation or this chapter are entitled to vote and be counted together collectively on a matter at a meeting of shareholders. See Iowa Code 490.140
  • Voting power: means the total number of votes entitled to be cast for the election of directors at the time the determination of voting power is made, excluding a vote that is contingent upon the happening of a condition or event that has not occurred at the time. See Iowa Code 504.141
  • Voting power: means the current power to vote in the election of directors. See Iowa Code 490.140
  • Voting trust beneficial owner: means an owner of a beneficial interest in shares of the corporation held in a voting trust established pursuant to section 490. See Iowa Code 490.140
  • Wake: means any movement of water created by a vessel which adversely affects the activities of another person who is involved in activities approved for that area or which may adversely affect the natural features of the shoreline. See Iowa Code 462A.2
  • Water area: means a river, lake, wetland, or other body of water and adjacent lands where the use of those lands affects the integrity of the water resource. See Iowa Code 462B.1

  • Watercraft: means any vessel which through the buoyant force of water floats upon the water and is capable of carrying one or more persons. See Iowa Code 462A.2

  • Watercraft education certificate: means a certificate, approved by the commission, which is issued to a qualified applicant who is twelve years of age or older who has successfully completed a watercraft education course approved by the department. See Iowa Code 462A.2
  • Waters of the state: means all of the waters under the jurisdiction of the state. See Iowa Code 482.2
  • Waters of this state under the jurisdiction of the commission: means any navigable waters within the territorial limits of this state, and the marginal river areas adjacent to this state, exempting only farm ponds and privately owned lakes. See Iowa Code 462A.2
  • week: means seven consecutive days. See Iowa Code 4.1
  • Wholesale distributor: means the same as defined in section 155A. See Iowa Code 510B.1
  • Withdrawal of a certificate of noncompliance: means a document provided by the unit certifying that the certificate of noncompliance is withdrawn and that the licensing authority may proceed with issuance, reinstatement, or renewal of the person's license. See Iowa Code 272D.1
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
  • Writing fee: means the amount paid by the boat owner to the county recorder for handling the transaction. See Iowa Code 462A.2
