Terms Used In Utah Code > Title 35A > Chapter 15 > Part 2 - School Readiness Board and Account

  • Act: means a voluntary bodily movement and includes speech. See Utah Code 76-1-101.5
  • Alien: means a person who is not a citizen or national of the United States. See Utah Code 76-9-1002
  • Alternative nicotine product: includes :
    (i) pure nicotine;
    (ii) snortable nicotine;
    (iii) dissolvable salts, orbs, pellets, sticks, or strips; and
    (iv) nicotine-laced food and beverage. See Utah Code 76-10-101
  • Arrest: Taking physical custody of a person by lawful authority.
  • Board: means the School Readiness Board, created in Section 35A-15-201. See Utah Code 35A-15-102
  • Cigar: means a product that contains nicotine, is intended to be burned under ordinary conditions of use, and consists of any roll of tobacco wrapped in leaf tobacco, or in any substance containing tobacco, other than any roll of tobacco that is a cigarette. See Utah Code 76-10-101
  • Cigarette: means a product that contains nicotine, is intended to be heated or burned under ordinary conditions of use, and consists of:
    (a) any roll of tobacco wrapped in paper or in any substance not containing tobacco; or
    (b) any roll of tobacco wrapped in any substance containing tobacco which, because of its appearance, the type of tobacco used in the filler, or its packaging and labeling, is likely to be offered to, or purchased by, consumers as a cigarette described in Subsection (3)(a).   • City: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • Community Reinvestment Act: The Act is intended to encourage depository institutions to help meet the credit needs of the communities in which they operate, including low- and moderate-income neighborhoods. It was enacted by the Congress in 1977. Source: OCC
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Conduct: means an act or omission. See Utah Code 76-1-101.5
  • Contract: A legal written agreement that becomes binding when signed.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Department: means the Department of Workforce Services created in Section 35A-1-103. See Utah Code 35A-1-102
  • Electronic cigarette: includes an oral device that is:
    (i) composed of a heating element, battery, or electronic circuit; and
    (ii) marketed, manufactured, distributed, or sold as:
    (A) an e-cigarette;
    (B) an e-cigar;
    (C) an e-pipe; or
    (D) any other product name or descriptor, if the function of the product meets the definition of Subsection (4)(a). See Utah Code 76-10-101
  • Electronic cigarette product: means an electronic cigarette, an electronic cigarette substance, or a prefilled electronic cigarette. See Utah Code 76-10-101
  • Electronic cigarette substance: means any substance, including liquid containing nicotine, used or intended for use in an electronic cigarette. See Utah Code 76-10-101
  • Eligible private provider: means a child care program that:
    (i) is licensed under 4; or
    (ii) except as provided in Subsection (5)(b)(ii), is exempt from licensure under Section 26B-2-405. See Utah Code 35A-15-102
  • Evaluation: means an evaluation conducted in accordance with Section 35A-15-303. See Utah Code 35A-15-102
  • Executive director: means the executive director of the department appointed under Section 35A-1-201. See Utah Code 35A-1-102
  • Flavored electronic cigarette product: includes an electronic cigarette product that has a taste or smell of any fruit, chocolate, vanilla, honey, candy, cocoa, dessert, alcoholic beverage, herb, or spice. See Utah Code 76-10-101
  • Fraud: Intentional deception resulting in injury to another.
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: includes a person who:Utah Code 68-3-12.5
  • High quality school readiness program: means a preschool program that:
    (a) is provided by an eligible LEA, eligible private provider, or eligible home-based educational technology provider; and
    (b) meets the elements of a high quality school readiness program described in Section 35A-15-202. See Utah Code 35A-15-102
  • ICE: means the federal Immigration and Customs Enforcement agency of the United States Department of Homeland Security. See Utah Code 76-9-1002
  • Investor: means a person that enters into a results-based contract to provide funding to a high quality school readiness program on the condition that the person will receive payment in accordance with Section 35A-15-402 if the high quality school readiness program meets the performance outcome measures included in the results-based contract. See Utah Code 35A-15-102
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Kindergarten transition plan: means a plan that supports the smooth transition of a preschool student to kindergarten and includes communication and alignment among the preschool, program, parents, and K-12 personnel. See Utah Code 35A-15-102
  • Land: includes :Utah Code 68-3-12.5
  • LEA: means a school district or charter school. See Utah Code 35A-15-102
  • Nicotine: means a poisonous, nitrogen containing chemical that is made synthetically or derived from tobacco or other plants. See Utah Code 76-10-101
  • Nicotine product: means an alternative nicotine product or a nontherapeutic nicotine product. See Utah Code 76-10-101
  • Nontherapeutic nicotine device: includes a nontherapeutic nicotine inhaler or a nontherapeutic nicotine nasal spray. See Utah Code 76-10-101
  • Nontherapeutic nicotine device substance: means a substance that:
    (a) contains nicotine;
    (b) is sold in a cartridge for use in a nontherapeutic nicotine device;
    (c) is not purchased with a prescription from a licensed physician; and
    (d) is not approved by the United States Food and Drug Administration as nicotine replacement therapy. See Utah Code 76-10-101
  • Nontherapeutic nicotine product: means a nontherapeutic nicotine device, a nontherapeutic nicotine device substance, or a prefilled nontherapeutic nicotine device. See Utah Code 76-10-101
  • Offense: means a violation of any penal statute of this state. See Utah Code 76-1-101.5
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Person: means an individual, public or private corporation, government, partnership, or unincorporated association. See Utah Code 76-1-101.5
  • Place of business: includes :
    (a) a shop;
    (b) a store;
    (c) a factory;
    (d) a public garage;
    (e) an office;
    (f) a theater;
    (g) a recreation hall;
    (h) a dance hall;
    (i) a poolroom;
    (j) a cafe;
    (k) a cafeteria;
    (l) a cabaret;
    (m) a restaurant;
    (n) a hotel;
    (o) a lodging house;
    (p) a streetcar;
    (q) a bus;
    (r) an interurban or railway passenger coach;
    (s) a waiting room; and
    (t) any other place of business. See Utah Code 76-10-101
  • Possess: means to have physical possession of or to exercise dominion or control over tangible property. See Utah Code 76-1-101.5
  • Prefilled electronic cigarette: means an electronic cigarette that is sold prefilled with an electronic cigarette substance. See Utah Code 76-10-101
  • Prefilled nontherapeutic nicotine device: means a nontherapeutic nicotine device that is sold prefilled with a nontherapeutic nicotine device substance. See Utah Code 76-10-101
  • Property: includes both real and personal property. See Utah Code 68-3-12.5
  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Results-based contract: means a contract that:
    (a) is entered into in accordance with Section 35A-15-402;
    (b) includes a performance outcome measure; and
    (c) is between the board, a provider of a high quality school readiness program, and an investor. See Utah Code 35A-15-102
  • Retail tobacco specialty business: means the same as that term is defined in Section 26B-7-501. See Utah Code 76-10-101
  • SAVE program: means the federal Systematic Alien Verification for Entitlements program operated by the federal Department of Homeland Security. See Utah Code 76-9-1002
  • School readiness assessment: means the same as that term is defined in Section 53E-4-314. See Utah Code 35A-15-102
  • Signature: includes a name, mark, or sign written with the intent to authenticate an instrument or writing. See Utah Code 68-3-12.5
  • Smoking: means the possession of any lighted cigar, cigarette, pipe, or other lighted smoking equipment. See Utah Code 76-10-101
  • State: when applied to the different parts of the United States, includes a state, district, or territory of the United States. See Utah Code 68-3-12.5
  • State or local governmental agency: includes any private contractor or vendor that contracts with the agency to provide the agency's functions or services. See Utah Code 76-9-1002
  • Statute: A law passed by a legislature.
  • Tobacco paraphernalia: includes :
    (i) metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes with or without screens, permanent screens, hashish heads, or punctured metal bowls;
    (ii) water pipes;
    (iii) carburetion tubes and devices;
    (iv) smoking and carburetion masks;
    (v) roach clips, meaning objects used to hold burning material, such as a cigarette, that has become too small or too short to be held in the hand;
    (vi) chamber pipes;
    (vii) carburetor pipes;
    (viii) electric pipes;
    (ix) air-driven pipes;
    (x) chillums;
    (xi) bongs; and
    (xii) ice pipes or chillers. See Utah Code 76-10-101
  • Tobacco product: means :
    (a) a cigar;
    (b) a cigarette; or
    (c) tobacco in any form, including:
    (i) chewing tobacco; and
    (ii) any substitute for tobacco, including flavoring or additives to tobacco. See Utah Code 76-10-101
  • Tobacco retailer: means :
    (a) a general tobacco retailer, as that term is defined in Section 26B-7-501; or
    (b) a retail tobacco specialty business. See Utah Code 76-10-101
  • Town: includes , depending on population, a metro township as defined in Section 10-3c-102. See Utah Code 68-3-12.5
  • United States: includes each state, district, and territory of the United States of America. See Utah Code 68-3-12.5
  • Venue: The geographical location in which a case is tried.
  • verification of immigration status: means the determination of a person's immigration status by:
    (a) a law enforcement officer who is authorized by a federal agency to determine an alien's immigration status; or
    (b) the United States Department of Homeland Security, ICE, or other federal agency authorized to provide immigration status as provided by 8 U. See Utah Code 76-9-1002
