A person dependent for support upon another.

Alaska

means an individual who derives support primarily from another individual Alaska Statutes 09.38.500

California

means a person described in Section 300 California Welfare and Institutions Code 101

means a person identified by the California Victim Compensation Board because of his or her relationship to a California resident killed as a result of injuries sustained during the terrorist attacks of September 11, 2001 California Education Code 70010.1

means the spouse or child of an eligible employee, subject to applicable terms of the health benefit plan covering the employee, and includes dependents of guaranteed association members if the association elects to include dependents under its health coverage at the same time it determines its membership composition pursuant to subdivision (z) California Insurance Code 10700

Connecticut

as used in this chapter , means a blood relation or the spouse of a Connecticut soldier, sailor or marine who, at the time of the calling of such soldier, sailor or marine into active military or naval service, is actually and solely dependent upon such soldier, sailor or marine for support and maintenance Connecticut General Statutes 27-80

means a member of the injured employee’s family or next of kin who was wholly or partly dependent upon the earnings of the employee at the time of the injury Connecticut General Statutes 31-275

Delaware

includes all persons other than the injured employee who are entitled to compensation under the elective schedule set forth in this chapter, and wherever the context requires it, includes the personal representatives and the surviving spouse of the deceased, and guardians of infants or trustees for incompetent persons Delaware Code Title 19 Sec. 2301

means a spouse, a child under the age of 26 years, and an unmarried child of any age who is medically certified as totally disabled and dependent upon the parent Delaware Code Title 18 Sec. 7202

Idaho

means a natural person who is recognized under the law of this state to be wholly or partially dependent upon the victim for care or support and includes a child if under the age of eighteen (18) years or incapable of self-support and unmarried and includes a child of the victim conceived before the victim’s death but born after the victim’s death, including a child that is conceived as a result of the criminally injurious conduct Idaho Code 72-1003

means a spouse, a child or any other individual listed as having coverage under the primary policy holder’s or subscriber’s health benefit plan Idaho Code 41-5501

Indiana

has the meaning set forth in 37 U Indiana Code 10-17-12-5.5

means a biological child, adopted child, or stepchild of a qualified veteran Indiana Code 21-14-12.3-1

Iowa

shall mean and include a spouse, child, mother, father, grandparent, or grandchild who is in need of and entitled to support from a person who is declared to be legally liable for such support Iowa Code 252A.2, Iowa Code 252A.2

Kansas

means a natural person wholly or partially dependent upon the victim for care or support, and includes a child of the victim born after the victim’s death Kansas Statutes 74-7301

Missouri

as used in this chapter shall mean:

(a) A wife upon a husband with whom she lives or who is legally liable for her support, and a husband upon a wife with whom he lives or who is legally liable for his support Missouri Laws 287.240

Montana

has the meaning provided in 33-22-140 Montana Code 33-31-102, Montana Code 2-18-701

means a natural person who is recognized under the law of this state to be wholly or partially dependent upon the victim for care or support and includes a child of the victim conceived before the victim’s death but born after the victim’s death, including a child that is conceived as a result of the criminally injurious conduct Montana Code 53-9-103

means a payee’s spouse, a minor child of the payee, or any person for whom the payee is legally obligated to provide support, including spousal maintenance Montana Code 33-20-1402

means an individual recognized as a dependent by a uniformed service Montana Code 13-21-102

means the spouse of the employee or account holder or a child of the employee or account holder if the child is:

(a)under 23 years of age and enrolled as a full-time student at an accredited college or university or is under 19 years of age;

(b)legally entitled to the provision of proper or necessary subsistence, education, medical care, or other care necessary for the health, guidance, or well-being of the child and is not otherwise emancipated, self-supporting, married, or a member of the armed forces of the United States; or

Nebraska

shall mean a spouse, an unmarried child under the age of nineteen years, an unmarried child who is a full-time student under the age of twenty-three years and who is financially dependent upon the parent, and an unmarried child of any age who is medically certified as disabled and dependent upon the parent Nebraska Statutes 44-5238

Nevada

has the meaning ascribed to it in NRS 604A Nevada Revised Statutes 675.020

New Hampshire

means the employee’s widow, widower, children, parents, persons in the direct line of ascent or descent, or next of kin, who were wholly or partially dependent, in fact, upon the earnings of the employee for support at the time of the injury New Hampshire Revised Statutes 281-A:2

North Carolina

An eligible Plan member other than the subscriber North Carolina General Statutes 135-48.1

An individual wholly or substantially dependent upon the victim for care and support and includes a child of the victim born after his death North Carolina General Statutes 15B-2

means an individual recognized as a dependent by a uniformed service North Carolina General Statutes 163-258.2

Ohio

includes a person who otherwise would be a “qualifying relative” and thus a “dependent” under section 152 of the Internal Revenue Code but for the fact that the person fails to meet the income and support limitations under section 152(d)(1)(B) and (C) of the Internal Revenue Code Ohio Code 5747.01

means a person who is recognized as a dependent by one of the uniformed services Ohio Code 3511.01

Rhode Island

includes a spouse or child or any other person who is in need of or entitled to support from a person who is declared to be legally liable for the support of that dependent Rhode Island General Laws 15-24-3

means a person wholly or partially dependent upon the income of the victim at the time of his or her death or would have been so dependent but for the incapacity due to the injury from which the death resulted Rhode Island General Laws 12-25-17

means any child who requires the protection and assistance of the court when his or her physical or mental health or welfare is harmed, or threatened with harm, due to the inability of the parent or guardian, through no fault of the parent or guardian, to provide the child with a minimum degree of care or proper supervision because of:

(i) The death or illness of a parent; or

South Carolina

means a spouse, an unmarried child under the age of nineteen years, an unmarried child who is a full-time student between the ages of nineteen and twenty-two and who is financially dependent upon the parent, and an unmarried child of any age who is medically certified as disabled and dependent upon the parent South Carolina Code 38-71-1330

means an individual recognized as a dependent by a uniformed service South Carolina Code 7-15-610

Tennessee
