Terms Used In Iowa Code 321.502

  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Director: means the director of the department. See Iowa Code 321I.1
  • following: when used by way of reference to a chapter or other part of a statute mean the next preceding or next following chapter or other part. See Iowa Code 4.1
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • state: when applied to the different parts of the United States, includes the District of Columbia and the territories, and the words "United States" may include the said district and territories. See Iowa Code 4.1
 The notification, provided for in section 321.501, shall be in substantially the following form, to wit:

 To …………………… (Here insert the name of each defendant and the defendant’s residence or last known place of abode as definitely as known.)  You will take notice that an original notice of suit against you, a copy of which is hereto attached, was duly served upon you at Des Moines, Iowa, by filing a copy of said notice on the ………… day of ……………., …………, with the director of transportation of the state of Iowa. Dated at ……………………, Iowa, this ………… day of ……………., …………………………………………Plaintiff. By……………………….Attorney for plaintiff.
