AADT: means the average annual daily traffic as determined by the department using accepted engineering practices. See Maine Revised Statutes Title 23 Sec. 562
Absentee voter: means a person who qualifies under section 751 to cast an absentee ballot. See Maine Revised Statutes Title 21-A Sec. 1
Academic programming agreement: means an agreement between an interim program and a responsible school through which the responsible school agrees to accept the academic programming, credits and documentation of achievement of standards completed by a student in the interim program. Accelerator: means a program that supports entrepreneurs by providing training, business assistance and mentors in a time-limited training program. See Maine Revised Statutes Title 5 Sec. 15301
Accessible voting system: means a voting system that is accessible for individuals with disabilities, including nonvisual accessibility for the blind and visually impaired, in a manner that provides the same opportunity for access and participation, including privacy and independence, as for other voters. Accessory dwelling unit: means a self?contained dwelling unit located within, attached to or detached from a single-family dwelling unit located on the same parcel of land. See Maine Revised Statutes Title 30-A Sec. 4301
Acknowledged father: means a man who has established parentage under subchapter 3. See Maine Revised Statutes Title 19-A Sec. 1832
Active ingredient: means any ingredient that will prevent, destroy, repel, control or mitigate pests or that will act as a plant regulator, defoliant or desiccant. See Maine Revised Statutes Title 7 Sec. 604
Actuary: means the individual or the organization designated by the board to be the technical advisor to the board under section 17107. See Maine Revised Statutes Title 5 Sec. 17001
Adjourn: A motion to adjourn a legislative chamber or a committee, if passed, ends that day's session.
Adjudicated parent: means a person who has been adjudicated by a court of competent jurisdiction to be the parent of a child. See Maine Revised Statutes Title 19-A Sec. 1832
Administrator: means the Superintendent of Consumer Credit Protection within the Department of Professional and Financial Regulation. See Maine Revised Statutes Title 10 Sec. 1308

Adult education: means education programs primarily operated for individuals beyond the compulsory school ages and administered by school administrative units. See Maine Revised Statutes Title 20-A Sec. 1

Adult education: means an education program primarily operated for individuals beyond the compulsory school age that is administered by school administrative units through a career pathways and service system and that, except as provided in section 8602-B, includes intake, assessment, advising, instruction and individual learning plans; is guided by data management and analysis, annual monitoring and annual professional development plans; uses appropriately certified staff; is designed to meet identified local needs; makes use of partnerships and alignment with workforce development, postsecondary institutions and support services; and offers at least 3 of the following:

Adult education program costs: means those costs identified in section 8607-A. See Maine Revised Statutes Title 20-A Sec. 8601-A

Adult learners with disabilities: means individuals who have been determined eligible as students with disabilities under the federal Individuals with Disabilities Education Act who are 16 years of age or older and under 21 years of age and who have neither received a regular high school diploma nor turned 20 years of age during the prior school year; individuals who are eligible under Section 504 of the Rehabilitation Act of 1973 and individuals who are eligible under the federal Americans with Disabilities Act of 1990. Adult workforce training and retraining: means courses or activities eligible for state funding that serve any of the following adult learners:

Advertisement: means all representations, other than those on the label, disseminated in any manner or by any means, relating to seed within the meaning of this subchapter. See Maine Revised Statutes Title 7 Sec. 1042

Advertisement: means a commercial message in any medium that directly or indirectly aids, promotes or assists a rental-purchase agreement, but does not include in-store merchandising aids such as window signs and ceiling banners. See Maine Revised Statutes Title 9-A Sec. 11-105

Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.

Adviser: means a person who, at the request of the issuer, a confirmer or another adviser, notifies or requests another adviser to notify the beneficiary that a letter of credit has been issued, confirmed or amended. See Maine Revised Statutes Title 11 Sec. 5-1102

Affiliate: means any person who controls, is controlled by or is under common control with any other person. See Maine Revised Statutes Title 10 Sec. 1672

Affiliate: means any company that controls, is controlled by, or is under common control with another company. See Maine Revised Statutes Title 9-B Sec. 131

Affiliated: means a person, directly or indirectly through one or more intermediaries, who controls, is controlled by or is under common control of, another person. See Maine Revised Statutes Title 10 Sec. 1395

Affiliated unit: means a school administrative unit that is affiliated with another school administrative unit that operates a center. See Maine Revised Statutes Title 20-A Sec. 8301-A

Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.

Age-friendly community: means a community where policies, services, settings and structures support and enable older people to actively age in place and that recognizes the capabilities, resources and needs of older adults, plans to meet the needs of older adults in flexible ways that support healthy and active aging, promotes the inclusion and contributions of older adults in all areas of community life, respects the self-determination and independence of older adults and protects those older adults who are most vulnerable. Agency: means an agency, school, organization, facility or institution. See Maine Revised Statutes Title 20-A Sec. 7001

Agency: means any office or any place of business of a foreign bank located in any state of the United States at which credit balances are maintained incidental to or arising out of the exercise of banking powers, checks are paid, or money is lent, but at which deposits may not be accepted from persons who are citizens or residents of the United States. See Maine Revised Statutes Title 9-B Sec. 1311

Agency: means a branch office of a financial institution at which all or part of the business of the institution is conducted, but the records pertaining to such business are maintained at another office of the institution, and not at such agency office. See Maine Revised Statutes Title 9-B Sec. 131

Agency enforcement action: means an enforcement action initiated by an agency against a small business. See Maine Revised Statutes Title 5 Sec. 90-O

Agent: means any person who sells or distributes licensed commodities in commerce for or on behalf of producers or others and whose operations may include planting, cultivating, harvesting, grading, packing and furnishing containers, supplies or other services. See Maine Revised Statutes Title 7 Sec. 452

Agent: means an individual appointed to serve in the capacity of a superintendent. See Maine Revised Statutes Title 20-A Sec. 1

Aggrieved person: means any person who bids on a contract or grant and who is adversely affected, financially, professionally or personally, by that contract or grant award decision. See Maine Revised Statutes Title 5 Sec. 1825-A

Agreement: means the bargain of the parties in fact, as found in their language or inferred from other circumstances and from rules, regulations and procedures given the effect of agreements under laws otherwise applicable to a particular transaction. See Maine Revised Statutes Title 10 Sec. 9402

Agreement: means any writing which is substantially prepared in advance of a consumer loan or consumer lease and which a supervised lender or lessor furnishes to a consumer for the consumer to sign in connection with that loan or lease. See Maine Revised Statutes Title 10 Sec. 1122

Agricultural commodity: means any and all agricultural, horticultural and vineyard crops and products when produced or sold in this State, either in their natural state or as processed by the producer, including such products as:

Agricultural enterprise: includes a business or activity that attracts visitors to a farm for the purpose of supplementing income from the primary crop or livestock operation. See Maine Revised Statutes Title 7 Sec. 434

Agricultural products: include floricultural, horticultural, viticultural, forestry, nut, dairy, livestock, poultry, bee and any farm products. See Maine Revised Statutes Title 13 Sec. 1774

Agricultural seeds: shall include the seeds of grass, forage, cereal and fiber crops and any other kinds of seeds commonly recognized within this State as agricultural or field seeds, and mixtures of such seeds, except seeds of cereals grown in Maine and sold directly from grower to grower and not labeled as seed. See Maine Revised Statutes Title 7 Sec. 1042

Aircraft: means a machine or device designed for flight. See Maine Revised Statutes Title 12 Sec. 10001

Airmobile: means any vehicle propelled by mechanical power that is designed to travel upon a cushion of air on or within 2 feet of the water or land surface of the earth. See Maine Revised Statutes Title 12 Sec. 13001

Airport authority: means a quasi-municipal entity formed and chartered pursuant to this chapter to operate an airport and provide air transportation services. See Maine Revised Statutes Title 6 Sec. 172

Airport sponsor: means a municipality, county or group of municipalities or counties that owns and operates an airport and accepts funds or property from the FAA. See Maine Revised Statutes Title 6 Sec. 172

Alcohol-related or other drug-related motor vehicle incident: means a conviction or administrative action resulting in the suspension of a motor vehicle operator's license for a violation under formerTitle 29, section 1311-A;Title 29, section 1312, subsection 10-A;Title 29, section 1312-C;Title 29, section 1312-B;Title 29, section 1313-B;Title 29, section 2241, subsection 1, paragraph N;Title 29, section 2241-G, subsection 2, paragraph B, subparagraph (2);Title 29, section 2241-J;Title 29-A, section 1253;Title 29-A, section 2411;Title 29-A, section 2453; Title 29?A, section 2454, subsection 2;Title 29-A, section 2456;Title 29-A, section 2457;Title 29-A, section 2472, subsection 3, paragraph B and subsection 4;Title 29-A, section 2503; Title 29-A, sections 2521 to 2523; or Title 29-A, section 2525 or the rules adopted by the Department of the Secretary of State for the suspension of commercial drivers' licenses. Alpine tundra: means high-elevation, treeless areas beyond the timberline that are dominated by low herbaceous or shrubby vegetation and, specifically, areas that are designated as alpine tundra by the Department of Agriculture, Conservation and Forestry by rule pursuant to Title 5, chapter 375, subchapter 2. See Maine Revised Statutes Title 12 Sec. 13001

Alternate payee: means a spouse, former spouse, child or other dependent of a member or retiree who is recognized by a domestic relations order as having a right to receive all or a portion of the benefits payable by the retirement system with respect to that member or retiree. See Maine Revised Statutes Title 5 Sec. 17001

Alternative education program: means a program in which the primary purpose is to provide at-risk students with curricula and assessment in a setting designed to effectively meet the student's academic, social and relational needs. See Maine Revised Statutes Title 20-A Sec. 1

Alternative learning: means an educational option that a public school or publicly supported program offers at-risk students by offering some combination of the following: alternative education programs; small class size; flexible scheduling; relevant alternative curricula and assessment; mentoring adults; skilled teachers; a focus on social, emotional and relationship skills; collaboration among home, school and social service agencies; and any other measures designed to accommodate the needs of at-risk students. Amortization: Paying off a loan by regular installments.

Amount financed: means "amount financed" as defined by Title 9-A, section 1-301, subsection 5. See Maine Revised Statutes Title 10 Sec. 1122

Amusement owner: means a person, the State or a political subdivision of the State that owns an amusement ride or, if the amusement ride is leased, the lessee. See Maine Revised Statutes Title 8 Sec. 802

Ancient burying ground: means a cemetery established before 1880 in which burial is restricted to:

Animal: means all vertebrate and invertebrate species, including but not limited to humans and other mammals, birds, fish and shellfish. See Maine Revised Statutes Title 7 Sec. 604

Annual base compensation: means a member's gross compensation, based upon amounts reported by the member's employer on the member's previous year's federal wage and tax statement, that is used the first day of each April for setting the amount of coverage prior to retirement for participants in the group life insurance program administered by the board. See Maine Revised Statutes Title 5 Sec. 17001

Annual percentage rate: The cost of credit at a yearly rate. It is calculated in a standard way, taking the average compound interest rate over the term of the loan so borrowers can compare loans. Lenders are required by law to disclose a card account's APR. ^{Source: FDIC}

another department: means a department of the State other than the Department of Health and Human Services. See Maine Revised Statutes Title 22 Sec. 21

another program: means a program of the department not defined as a program in subsection 10 or a program of another department that is approved for addition to the EBT system. See Maine Revised Statutes Title 22 Sec. 21

Any election: means primary and general elections and referenda, whether regular or special. See Maine Revised Statutes Title 21-A Sec. 1

Appeals board: means the State Civil Service Appeals Board. See Maine Revised Statutes Title 5 Sec. 7032

Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.

Applicant: includes the person filing an application for registration of a mark under this chapter, his legal representatives, successors or assigns. See Maine Revised Statutes Title 10 Sec. 1521

Applicant: means any person applying for a license under this subchapter. See Maine Revised Statutes Title 7 Sec. 452

Applicant: means a person at whose request or for whose account a letter of credit is issued. See Maine Revised Statutes Title 11 Sec. 5-1102

Application for credit: means any communication, oral or written, by a person to a creditor requesting an extension of credit to that person or to any other person, and includes any procedure involving the renewal or alteration of credit privileges or the changing of the name of the person to whom credit is extended;

Appointing authority: means the officer, board, commission, person or group of persons having the power by virtue of the Constitution of Maine, a statute or lawfully delegated authority to make appointments. See Maine Revised Statutes Title 5 Sec. 7032

Appraisal: A determination of property value.

Approved: means approved by the board. See Maine Revised Statutes Title 32 Sec. 4902

Approved equal: means any goods or service other than specified in the bid proposal that in the opinion of the State Purchasing Agent is equivalent in character, quality and performance to the goods or service specified in the bid proposal. See Maine Revised Statutes Title 5 Sec. 1825-A

Approved private school: means a private school approved for attendance purposes under Maine Revised Statutes Title 20-A Sec. 1

Approved public treatment facility: means an alcohol treatment facility operating under the direction and control of the department or providing treatment under this subchapter through a contract with the department under section 20008, or any facility funded in whole or in part by municipal, state or federal funds. See Maine Revised Statutes Title 5 Sec. 20003

Approved treatment facility: means a public or private alcohol treatment facility meeting standards approved by the department in accordance with section 20005 and licensed pursuant to subchapter 5 and other applicable provisions of state law. See Maine Revised Statutes Title 5 Sec. 20003

Aquarium: means an enclosed container used in importing, possessing or displaying nonnative and exotic species of fish or other aquatic organisms that has a closed operating system, that is located within a home, exhibition building or other permanent all-season structure and that does not allow the discharge of water or aquatic organisms into the inland waters of the State. See Maine Revised Statutes Title 12 Sec. 10001

Aquatic plant: means a plant species that requires a permanently flooded freshwater habitat. See Maine Revised Statutes Title 12 Sec. 13001

Area of sales responsibility: means the geographical area agreed to by the dealer and the manufacturer in the dealer agreement within which the dealer has the exclusive right to display the manufacturer's new recreational vehicles of a particular line make to the retail public. See Maine Revised Statutes Title 10 Sec. 1432

Arraignment: A proceeding in which an individual who is accused of committing a crime is brought into court, told of the charges, and asked to plead guilty or not guilty.

Arrest: Taking physical custody of a person by lawful authority.

Article: means a product as distinguished from its trademark, label or distinctive dress in packaging;

Articles: means the articles of incorporation. See Maine Revised Statutes Title 13 Sec. 1774

Articulation agreement: means an agreement between a center or region and a postsecondary institution that:

ASHRAE: means the American Society of Heating, Refrigerating and Air-Conditioning Engineers, Inc. See Maine Revised Statutes Title 10 Sec. 1413

Assets of the investment trust fund: means the funds appropriated or otherwise provided to fund the investment trust fund, together with the interest, earnings and returns on the funds. See Maine Revised Statutes Title 5 Sec. 17431

Assistive device: includes , but is not limited to, manual wheelchairs, motorized wheelchairs, motorized scooters and other aids that enhance the mobility of the individual; hearing aids, telephone communications devices for the deaf, or TDD, assistive listening devices and other aids that enhance an individual's ability to hear; voice synthesized computer modules, optical scanners, talking software, braille printers and other devices that enhance a sight-impaired individual's ability to communicate; and any other assistive device that enables a person with a disability to communicate, see, hear or maneuver. Association: means a corporation organized under this subchapter, or a similar domestic corporation, or a foreign association or corporation if authorized to do business in this State, organized under any general or special Act as a cooperative association for the mutual benefit of its members, as agricultural producers, and which confines its operations to purposes authorized by this subchapter and restricts the return on the stock or membership capital and the amount of its business with nonmembers to the limits placed thereon by this subchapter for associations organized hereunder. Association: means an organization:

Association of producers: means any association of producers of agricultural products organized and existing under this subchapter. See Maine Revised Statutes Title 13 Sec. 1955

Atlantic salmon: means the anadromous fish species Salmo salar that customarily migrates from inland waters to the ocean as part of its life cycle. See Maine Revised Statutes Title 12 Sec. 10001

Attorney-at-law: A person who is legally qualified and licensed to practice law, and to represent and act for clients in legal proceedings.

Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.

ATV: includes , but is not limited to, a multitrack, multiwheel or low-pressure tire vehicle; a motorcycle or related 2-wheel, 3-wheel or belt-driven vehicle; an amphibious machine; or other means of transportation deriving motive power from a source other than muscle or wind. Authority: means the Finance Authority of Maine. See Maine Revised Statutes Title 10 Sec. 9201

Authority: means the Combat Sports Authority of Maine created under section 522. See Maine Revised Statutes Title 8 Sec. 521

Authorized participants: means competitors, officials, referees, judges, promoters, managers, physicians, timekeepers and knock-down timekeepers. See Maine Revised Statutes Title 8 Sec. 521

Autoloading firearm: means a firearm that reloads itself after each shot and requires that the trigger be pulled for each shot. See Maine Revised Statutes Title 12 Sec. 10001

Automated telephone calling device: means any system or equipment, including a facsimile machine, that selects, dials or calls telephone numbers and plays recorded messages or attempts to send facsimiles. See Maine Revised Statutes Title 10 Sec. 1498

Automated transaction: means a transaction conducted or performed, in whole or in part, by electronic means or electronic records in which the acts or records of one or both parties are not reviewed by an individual in the ordinary course of forming a contract, performing under an existing contract or fulfilling an obligation required by the transaction. See Maine Revised Statutes Title 10 Sec. 9402

Automobile graveyard: includes an area used for automobile dismantling, salvage and recycling operations. See Maine Revised Statutes Title 30-A Sec. 3752

Automobile recycling business: means the business premises of a dealer or a recycler licensed under Title 29-A, sections 851 to 1112 who purchases or acquires salvage vehicles for the purpose of reselling the vehicles or component parts of the vehicles or rebuilding or repairing salvage vehicles for the purpose of resale or for selling the basic materials in the salvage vehicles, as long as 80% of the business premises specified in the site plan in section 3755-A, subsection 1, paragraph C is used for automobile recycling operations. Automotive product: shall mean any product sold or distributed by a retailer for use with a motor vehicle, whether or not such product is essential for the maintenance of the motor vehicle and whether or not such product is also used for non-automotive purposes;

Average personal income growth: means the average for the prior 10 calendar years, ending with the most recent calendar year for which data is available, of the percent change in personal income in this State, as estimated by the United States Department of Commerce, Bureau of Economic Analysis. Bail: Security given for the release of a criminal defendant or witness from legal custody (usually in the form of money) to secure his/her appearance on the day and time appointed.

bail: means the obtaining of the release of the defendant upon an undertaking that the defendant shall appear at the time and place required and that the defendant shall conform to each condition imposed in accordance with section 1026 that is designed to ensure that the defendant shall refrain from any new criminal conduct, to ensure the integrity of the judicial process and to ensure the safety of others in the community. Bailee: means a person that by a warehouse receipt, bill of lading or other document of title acknowledges possession of goods and contracts to deliver them. See Maine Revised Statutes Title 11 Sec. 7-1102

Baitfish: means only those species in the following list:

Baitfish trap: means a device used to take baitfish fitted with rigid entrance or exit holes and having a volume no greater than 50 cubic feet. See Maine Revised Statutes Title 12 Sec. 10001

Ballot labels: means the pages, cards or other material containing the names of offices and candidates and the referendum questions to be voted on that are placed on the voting device to conform with the voting system in use. See Maine Revised Statutes Title 21-A Sec. 808

Baseline: Projection of the receipts, outlays, and other budget amounts that would ensue in the future without any change in existing policy. Baseline projections are used to gauge the extent to which proposed legislation, if enacted into law, would alter current spending and revenue levels.

Basic literacy instruction: means instruction, based on individual needs and goals, for adults whose skills in reading, writing, numeracy, speaking or listening are below the grade 12 level. See Maine Revised Statutes Title 20-A Sec. 8601-A

Bear bait: means an animal or plant or derivative of an animal or plant used to attract bear. See Maine Revised Statutes Title 12 Sec. 10001

Beginner fantasy contestant: means an individual who has entered fewer than 51 fantasy contests offered by a single fantasy contest operator. See Maine Revised Statutes Title 8 Sec. 1101

Beneficial insects: means those insects that, during their life cycle, are effective pollinators of plants, are parasites or predators of pests or are otherwise beneficial. See Maine Revised Statutes Title 7 Sec. 604

Beneficiary: means a person or persons designated by a member to receive a benefit under this Part or a person otherwise entitled to receive a benefit under this Part. See Maine Revised Statutes Title 5 Sec. 17001

Beneficiary: means a person who under the terms of a letter of credit is entitled to have its complying presentation honored. See Maine Revised Statutes Title 11 Sec. 5-1102

Bequest: Property gifted by will.

Bereavement services: means emotional support services related to the death of a family member, including, but not limited to, counseling, provision of written material, social reorientation and group support for up to one year following the death of the client who was terminally ill. See Maine Revised Statutes Title 22 Sec. 8621

Beverage container: means a can, bottle, jar or other container made of aluminum or metal that is sealed by a manufacturer and contained, at the time of sale, a beverage, as defined by Title 38, section 3102, subsection 1, but does not include a beer keg. See Maine Revised Statutes Title 30-A Sec. 3771

Bid: means a written offer or proposal by an exhibitor to a distributor, in response to an "invitation to bid" stating the terms under which the exhibitor will agree to exhibit a motion picture. See Maine Revised Statutes Title 10 Sec. 1901

Biennial base year appropriation: means :

Billing period: means the time period for payment agreed to by 2 parties or, in the absence of an agreement, the calendar month within which work is performed. See Maine Revised Statutes Title 10 Sec. 1111

Blend stock: means ethanol, methanol or any other products blended with gasoline to produce motor fuel. See Maine Revised Statutes Title 10 Sec. 1453

Blender: means any person who blends blend stock with gasoline or who sells or distributes blend stock for the purpose of being blended with gasoline. See Maine Revised Statutes Title 10 Sec. 1453

Blind bidding: means the solicitation of bidding for, solicitation of negotiation for, or solicitations of offers for or agreeing to terms for the licensing or exhibition of a motion picture if the motion picture has not been trade screened. See Maine Revised Statutes Title 10 Sec. 1901

Blood-borne pathogen test: means a test that indicates the presence of a specific blood-borne transmissible infectious agent. See Maine Revised Statutes Title 22 Sec. 831

Board: means the board of directors. See Maine Revised Statutes Title 13 Sec. 1774

Board: means the State Board of Licensure for Geologists and Soil Scientists. See Maine Revised Statutes Title 32 Sec. 4902

Board: means the Technical Building Codes and Standards Board established in Title 5, section 12004-G, subsection 5-A. See Maine Revised Statutes Title 10 Sec. 9721

Board: means the Board of Licensure of Foresters. See Maine Revised Statutes Title 32 Sec. 5501

Board: means any authority, board, commission, committee, council and similar organization, including independent organizations, established or authorized by the Legislature to fulfill specific functions the members of which do not serve full time. See Maine Revised Statutes Title 5 Sec. 12002

Board: means the Maine Agricultural Bargaining Board provided for in this Article. See Maine Revised Statutes Title 13 Sec. 1955

Board: means a bureau, board or commission listed in Title 10, section 8001 or 8001-A, other licensor that is affiliated with or is a part of the Department of Professional and Financial Regulation, the Board of Overseers of the Bar or any other state agency or municipality that issues a license authorizing a person to engage in a business, occupation, profession or industry and any state agency, bureau, board, commission or municipality that issues a license or permit to hunt, fish, operate a boat, operate a snowmobile, operate an ATV or engage in any other sporting or recreational activity. See Maine Revised Statutes Title 19-A Sec. 2101

board: means the board of directors of an airport authority. See Maine Revised Statutes Title 6 Sec. 172

Board: means the Kim Wallace Adaptive Equipment Loan Program Fund Board. See Maine Revised Statutes Title 10 Sec. 371

Board: means the Small Enterprise Growth Board. See Maine Revised Statutes Title 10 Sec. 382

Board: means the board of directors of the authority. See Maine Revised Statutes Title 8 Sec. 521

Board: means the Board of Directors of the Maine Health Data Organization established pursuant to section 8703. See Maine Revised Statutes Title 22 Sec. 8702

Board of directors: means the governing body with statutory powers and duties for a school administrative district. See Maine Revised Statutes Title 20-A Sec. 1

Board of trustees: means the Board of Trustees of the Maine School of Science and Mathematics. See Maine Revised Statutes Title 20-A Sec. 8203

Board of trustees: means the Maine Rural Development Authority Board of Trustees. See Maine Revised Statutes Title 5 Sec. 13120-B

Bond: means a revenue obligation security, bond, note, debenture, certificate or other evidence of indebtedness of the State or any political subdivision of the State. See Maine Revised Statutes Title 10 Sec. 361

bond bank: means the Maine Municipal Bond Bank created by section 5951. See Maine Revised Statutes Title 30-A Sec. 5903

Bonds: means bonds of the bank issued under this chapter. See Maine Revised Statutes Title 30-A Sec. 5903

Borrower: means a debtor or retail buyer under a finance agreement. See Maine Revised Statutes Title 10 Sec. 1500-H

Bounds of the watercourse: means the high-water marks of the shorelines of the lakes and ponds, the high-water marks of the intervening and connecting waters and the high-water marks of the banks of the streams and rivers of the watercourse. See Maine Revised Statutes Title 12 Sec. 1872

Bow: means the forward half of a watercraft. See Maine Revised Statutes Title 12 Sec. 13001

bow: includes a compound bow, a recurve bow and a long bow. See Maine Revised Statutes Title 12 Sec. 10001

Boxing: means a combative sport for compensation that features the use of gloved fists in attack and defense. See Maine Revised Statutes Title 8 Sec. 521

Branch: means any office or any place of business of a foreign bank located in any state of the United States at which deposits are received. See Maine Revised Statutes Title 9-B Sec. 1311

Brand name: means a word, name, symbol or device, or any combination thereof, that identifies the commercial feed of a distributor or registrant and distinguishes it from that of others. See Maine Revised Statutes Title 7 Sec. 712

Brand name: means the term, designation, trademark, product name or other specific designation under which individual plant or soil amendments are distributed. See Maine Revised Statutes Title 7 Sec. 776

Brand-name drug: means a prescription drug marketed under a proprietary name or registered trademark name, including a biological product. See Maine Revised Statutes Title 22 Sec. 8731

Bridge: means a structure, including supports, designed principally to carry motor vehicles that is erected over a depression or an obstruction, such as water, a highway or a railway, and has an opening measured along the center of the roadway of more than 20 feet between the undercropping of abutments or spring lines of arches or the extreme ends of openings for multiple boxes. See Maine Revised Statutes Title 23 Sec. 562

Broker: means any person engaged in the business of negotiating sales of licensed commodities in commerce for or on behalf of the seller or the purchaser, respectively. See Maine Revised Statutes Title 7 Sec. 452

BTU: means British Thermal Unit which is the amount of thermal energy required to raise one pound of water one degree Fahrenheit. See Maine Revised Statutes Title 10 Sec. 1413

Budget authority: Authority provided by law to enter into obligations that will result in outlays of Federal funds. Budget authority may be classified by the period of availability (one-year, multiyear, no-year), by the timing of congressional action (current or permanent), or by the manner of determining the amount available (definite or indefinite).

Budget failure: means the failure of a region, by August 1st of any fiscal year, to approve a budget for the region that is at least equal to the sum of the total allocations for career and technical education of the member school administrative units in the region. See Maine Revised Statutes Title 20-A Sec. 8301-A

Building code: means any part or portion of any edition of a code that regulates the construction of a building, including codes published by the International Code Council or Building Officials and Code Administrators International, Inc. See Maine Revised Statutes Title 10 Sec. 9721

Bulk: means in nonpackaged form. See Maine Revised Statutes Title 7 Sec. 776

Bureau: means the Bureau of Parks and Lands. See Maine Revised Statutes Title 12 Sec. 1801

Bureau: means the Bureau of Health. See Maine Revised Statutes Title 22 Sec. 1692-A

Bureau: means the Bureau of Financial Institutions. See Maine Revised Statutes Title 9-B Sec. 131

Business: shall mean any lawful activity, excepting a farm operation conducted primarily:

Business day: means any day of the calendar year other than a Saturday, Sunday or legal holiday. See Maine Revised Statutes Title 21-A Sec. 1

Buyer: means a person who buys or contracts to buy goods. See Maine Revised Statutes Title 11 Sec. 2-103

Cable television company: means any person owning, controlling, operating, managing or leasing a cable television system within the State. See Maine Revised Statutes Title 30-A Sec. 2001

Camping trailer: means a trailer constructed with collapsible partial side walls that fold for towing by another vehicle and unfold at the campsite to provide temporary living quarters for recreational, camping or travel use. See Maine Revised Statutes Title 10 Sec. 1432

Candidate: means any person who has filed a petition under either sections 335 and 336 or sections 354 and 355 and has qualified as a candidate by either procedure, or any person who has received contributions or made expenditures or has given consent for any other person to receive contributions or make expenditures with the intent of qualifying as a candidate. See Maine Revised Statutes Title 21-A Sec. 1

Canoe: means a form of small watercraft with no rudder or sails that is long and narrow, sharp on both ends or sharp on one end and blunt on the other end usually propelled by paddles or a small motor. See Maine Revised Statutes Title 12 Sec. 1872

capital: means the sum of common stock, paid-in common stock surplus, perpetual preferred stock, undivided profits and other capital reserves; [PL 1997, c. See Maine Revised Statutes Title 9-B Sec. 131

Capital improvement: includes construction of new structures, replacement of existing structures, removal of closed structures and rehabilitation of existing structures. See Maine Revised Statutes Title 23 Sec. 562

Capital reserve fund: means any capital reserve fund created or established as provided in section 6006, subsection 1-A. See Maine Revised Statutes Title 30-A Sec. 5903

Capital responsibility: means the responsibility to provide all resources needed to make capital improvement to a structure. See Maine Revised Statutes Title 23 Sec. 562

Care plan: means a written service delivery plan that the interdisciplinary team, in conjunction with the client, shall develop to reflect the changing care needs of the client. See Maine Revised Statutes Title 22 Sec. 8621

Career and technical education: means a course or program of education designed to create or improve job-related skills that is part of a secondary school or middle school level curriculum and approved by the commissioner according to this chapter. See Maine Revised Statutes Title 20-A Sec. 8301-A

Carrier: means a person that issues a bill of lading. See Maine Revised Statutes Title 11 Sec. 7-1102

Carrier: means an insurance company licensed in accordance with Title 24-A, including a health maintenance organization, a multiple employer welfare arrangement licensed pursuant to Title 24-A, chapter 81, a preferred provider organization, a fraternal benefit society or a nonprofit hospital or medical service organization or health plan licensed pursuant to Title 24. See Maine Revised Statutes Title 22 Sec. 8702

Carryforward: means that portion of the state ceiling for any calendar year which is unallocated to specific bond issues during that calendar year and which is available to be carried forward to be used in later years under the United States Code, Title 26. See Maine Revised Statutes Title 10 Sec. 361

Carrying costs: means reasonable costs incurred for the maintenance, protection and security of a speculative industrial building prior to occupancy, including, but not limited to, insurance, taxes and interest. See Maine Revised Statutes Title 5 Sec. 13120-B

Case law: The law as laid down in cases that have been decided in the decisions of the courts.

Cash price: means the price for which the merchant would sell the property to the consumer for cash on the date of the rental-purchase agreement. See Maine Revised Statutes Title 9-A Sec. 11-105

Caucus: means a meeting of a political party or committee. See Maine Revised Statutes Title 21-A Sec. 1

Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.

Center: means an administrative entity established pursuant to this chapter that provides career and technical education to secondary students and middle school level students. See Maine Revised Statutes Title 20-A Sec. 8301-A

Center preschool: means the preschool program established and operated by the Maine Educational Center for the Deaf and Hard of Hearing and the Governor Baxter School for the Deaf at the Governor Baxter School for the Deaf. See Maine Revised Statutes Title 20-A Sec. 7402

Center school: means the kindergarten to grade 12 programs established and operated by the Maine Educational Center for the Deaf and Hard of Hearing and the Governor Baxter School for the Deaf at the Governor Baxter School for the Deaf located at Mackworth Island or at a location determined by the school board in accordance with section 7407, subsection 17. See Maine Revised Statutes Title 20-A Sec. 7402

Central voter registration system: means a single electronic information system and database for voter registration information maintained by the Secretary of State and used by all municipal jurisdictions in the State. See Maine Revised Statutes Title 21-A Sec. 1

Certificate of immunization: means a written statement from a physician, nurse or health official who has administered an immunizing agent to a child, specifying the dosage administered and the date it was administered. See Maine Revised Statutes Title 20-A Sec. 6353

Certification mark: means a mark used in connection with the goods or services of a person other than the certifier to indicate geographic origin, material, mode of manufacture, quality, accuracy or other characteristics of the goods or services or to indicate that the work or labor on the goods or services was performed by members of a union or other organization;

Certification mark: means a mark used upon or in connection with the products or services of one or more persons other than the owner of the mark to certify regional or other origin, material, mode of manufacture, quality, accuracy or other characteristics of such goods or services, or that the work or labor on the goods or services was performed by members of a union or other organization. See Maine Revised Statutes Title 10 Sec. 1521

Challenged ballot: means a ballot cast by one whose eligibility to vote has been questioned during election day. See Maine Revised Statutes Title 21-A Sec. 1

Chambers: A judge's office.

Change orders: means a written amendment to the home construction contract which becomes part of and is in conformance with the existing contract. See Maine Revised Statutes Title 10 Sec. 1486

Charitable purpose: means the relief of poverty, the advancement of education or religion, the promotion of health, the promotion of a governmental purpose or any other purpose the achievement of which is beneficial to the community. See Maine Revised Statutes Title 13 Sec. 5102

Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.

Charter: means a private and special law or a series of private and special laws that establishes an airport authority and defines its responsibilities and authority. See Maine Revised Statutes Title 6 Sec. 172

Charter territory: means the territorial limits of an airport authority as defined in its charter. See Maine Revised Statutes Title 6 Sec. 172

Chief executive officer: means the Chief Executive Officer of the Finance Authority of Maine. See Maine Revised Statutes Title 20-A Sec. 11401

Chief Information Officer: means the person who holds the lead information technology position within the executive branch that directs, coordinates and oversees information technology policy making, planning, architecture and standardization. See Maine Revised Statutes Title 5 Sec. 1972

Chief judge: The judge who has primary responsibility for the administration of a court but also decides cases; chief judges are determined by seniority.

Child: means any natural or legally adopted, born or unborn, progeny of a member. See Maine Revised Statutes Title 5 Sec. 17001

Child: means and includes every child entering school. See Maine Revised Statutes Title 20-A Sec. 6353

Child: means an individual of any age whose parentage may be determined under this chapter. See Maine Revised Statutes Title 19-A Sec. 1832

Child: means an individual, whether over or under the age of majority, who is or is alleged to be owed a duty of support by the individual's parent or who is or is alleged to be the beneficiary of a support order directed to the parent. See Maine Revised Statutes Title 19-A Sec. 2802

Child Development Services System: means the state intermediate educational unit under section 7209, subsection 3, and any regional sites it chooses to establish and maintain, to ensure the provision of child find activities, early intervention services and free, appropriate public education services to eligible children. Child or children: means a person who has not attained the age of 18 years. See Maine Revised Statutes Title 1 Sec. 72

Child support: means money paid directly to a parent, to another person or agency awarded parental rights and responsibilities with respect to a child or to the department on behalf of a child receiving public assistance and medical or dental insurance coverage provided on behalf of a child pursuant to court order. See Maine Revised Statutes Title 19-A Sec. 1501

Child support order: means a support order for a child, including a child who has attained the age of majority under the law of the issuing state or foreign country. See Maine Revised Statutes Title 19-A Sec. 2802
