76-5-307. Definitions. As used in Sections
76-5-308 through
76-5-310.1 of this part:

“Child” means an individual younger than 18 years old. |

Terms Used In Utah Code 76-5-307
- Act: means a voluntary bodily movement and includes speech. See Utah Code 76-1-101.5
- Affinity: means a relationship by marriage. See Utah Code 76-1-101.5
- Conduct: means an act or omission. See Utah Code 76-1-101.5
- Consanguinity: means a relationship by blood to the first or second degree, including an individual's parent, grandparent, sibling, child, aunt, uncle, niece, or nephew. See Utah Code 76-1-101.5
- Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
(2) |
“Commercial purpose” includes direct or indirect participation in or facilitation of the transportation of one or more individuals for the purpose of:
(a) |
charging or obtaining a fee for the transportation; or |
(b) |
obtaining, exchanging, or receiving any thing or item of value or an attempt to conduct any of these activities. |

(3) |
“Facilitation” regarding transportation under Subsection (2) includes providing:
(a) |
travel arrangement services; |
(b) |
payment for the costs of travel; or |
(c) |
property that would advance an act of transportation, including a vehicle or other means of transportation, a weapon, false identification, and making lodging available, including by rent, lease, or sale. |

(4) |
“Family member” means an individual’s parent, grandparent, sibling, or any other individual related to the individual by consanguinity or affinity to the second degree. |
