(a) A person commits an offense if, with intent to hinder the arrest, prosecution, conviction, or punishment of another for an offense under § 76.02 or 76.03, the person:
(1) harbors or conceals the other;
(2) provides or aids in providing the other with any means of avoiding arrest or effecting escape;
(3) warns the other of impending discovery or apprehension; or
(4) tampers with any physical evidence that might aid in the discovery or apprehension of the other.
(b) An offense under this section is of the same degree as the offense under § 76.02 or 76.03 for which the person committed the act described by Subsection (a).

Terms Used In Texas Penal Code 76.04

  • Act: means a bodily movement, whether voluntary or involuntary, and includes speech. See Texas Penal Code 1.07
  • Another: means a person other than the actor. See Texas Penal Code 1.07
  • Arrest: Taking physical custody of a person by lawful authority.
  • Conviction: A judgement of guilt against a criminal defendant.
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Person: means an individual or a corporation, association, limited liability company, or other entity or organization governed by the Business Organizations Code. See Texas Penal Code 1.07
