Terms Used In Vermont Statutes > Title 16 > Chapter 9 - School Districts

  • Abatement: means any set of measures designed to eliminate lead hazards permanently in accordance with standards established by appropriate State and federal agencies. See
  • Accept: means to solicit, receive, or agree to receive. See
  • Accredited training program: means a training program that has been approved by the Commissioner of Health to provide training for individuals engaged in lead-based paint activities or RRPM activities. See
  • Action level: means four parts per billion (ppb) of lead. See
  • Adult: means an individual who is at least 18 years of age. See
  • Adverse event: is a ny untoward incident, therapeutic misadventure, iatrogenic injury, or other undesirable occurrence directly associated with care or services provided by a health care provider or health care facility. See
  • advertisement: means all representations disseminated in any manner or by any means, other than by labeling, for the purpose of inducing, or which are likely to induce, directly or indirectly, the purchase of food, drugs, devices, or cosmetics. See
  • Advice and consent: Under the Constitution, presidential nominations for executive and judicial posts take effect only when confirmed by the Senate, and international treaties become effective only when the Senate approves them by a two-thirds vote.
  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affidavit: means the Vermont campaign finance affidavit required under section 2982 of this chapter. See
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Aftermarket stain and water resistant treatments: means treatments for textile and leather consumer products used in residential settings that have been treated during the manufacturing process for stain, oil, and water resistance but excludes products marketed or sold exclusively for use at industrial facilities during the manufacture of a carpet, rug, clothing, or shoe. See
  • Agency of Education: means the Secretary and staff necessary to carry out the functions of the Agency. See
  • Agent: means an individual:

  • Alcoholic: means a person with the condition of alcoholism. See
  • Alcoholism: means addiction to the drug alcohol. See
  • Alternative water source: means :

  • Ambulatory surgical center: means any distinct entity that operates primarily for the purpose of providing surgical services to patients not requiring hospitalization and for which the expected duration of services would not exceed 24 hours following an admission. See
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Anatomical gift: means a donation of all or part of a human body to take effect after the donor's death for the purpose of transplantation, therapy, research, or education. See
  • Annual meeting: when applied to towns shall mean the annual town meeting in March or an adjournment thereof. See
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Antimicrobial pesticide: means a product regulated by the federal Insecticide, Fungicide and Rodenticide Act that is intended to:

  • Anything of value: means , without limitation, tangible or intangible property, money, commercial interests, or governmental employment. See
  • Appeal: A request made after a trial, asking another court (usually the court of appeals) to decide whether the trial was conducted properly. To make such a request is "to appeal" or "to take an appeal." One who appeals is called the appellant.
  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approved drug-checking service provider: means a provider who complies with operating guidelines developed by the Department of Health pursuant to section 4240a of this title. See
  • Approved substance abuse treatment program: means a treatment program that is approved by the Secretary as qualified to provide treatment for substance abuse. See
  • Arrest: Taking physical custody of a person by lawful authority.
  • Articles of organization: means initial, amended, and restated articles of organization and articles of merger. See
  • Asbestos: means the asbestiform varieties of chrysotile (serpentine); crocidolite (riebeckite); amosite (cummingtonite-grunerite); anthophyllite; tremolite; and actinolite. See
  • Asbestos abatement: means the repair, enclosure, removal, encapsulation, or any other activity for the evaluation or control of any material which contains more than one percent asbestos by weight. See
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Authoritative source: means a physician licensed in the State, superintendent of a State institution or private hospital, medical officers of the armed forces of the State or United States, State and territorial health officers, and personnel of the Department of Health designated by the Commissioner of Health. See
  • Bakery: means all buildings, rooms, basements, cellars, lofts, or other premises or part thereof used, occupied, or maintained for the purpose of producing for sale bread, cakes, pies, or other food products made either wholly or partially with flour. See
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Benchmark unlawful dosage: means the maximum recommended therapeutic dose, or maximum daily dose, as determined by the Department by rule. See
  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • between: as used in this title in respect to a specified age of a student, shall mean the period of time commencing on the birthday of the child when he or she becomes the age first specified and ending on the day next preceding the birthday of the child when he or she becomes the age last specified. See
  • biennially: shall mean the year in which a regular session of the General Assembly is held. See
  • Biological product: means a virus, therapeutic serum, toxin, antitoxin, vaccine, blood, blood component or derivative, allergenic product, protein (except any chemically synthesized polypeptide), or analogous product, or arsphenamine or derivative of arsphenamine (or any other trivalent organic arsenic compound), applicable to the prevention, treatment, or cure of a disease or condition in human beings. See
  • Bisphenols: means any member of a class of industrial chemicals that contain two hydroxyphenyl groups. See
  • Bloodborne pathogen: means a pathogenic microorganism that is present in human blood and can cause disease in humans. See
  • Blueprint: means the State's program for integrating a system of health care for patients, improving the health of the overall population, and improving control over health care costs by promoting health maintenance, prevention, and care coordination and management. See
  • Board: means the Green Mountain Care Board established in chapter 220 of this title. See
  • Board of Pharmacy: means the State Board of Pharmacy so designated under 26 Vt. See
  • Brand name: means the registered trademark name given to a drug product by its manufacturer or distributor. See
  • Building: means any structure, facility, addition, or wing that may be occupied or used by children or students. See
  • Bullying: means any overt act or combination of acts, including an act conducted by electronic means, directed against a student by another student or group of students and that:

  • Business: includes every trade, occupation, profession, and other lawful purpose, whether or not carried on for profit. See
  • Campaign: means any organized or coordinated activity undertaken by two or more persons, any part of which is designed to influence the nomination, election, or defeat of any candidate or the passage, defeat, or modification of any public question. See
  • Candidate: means an individual who has taken any affirmative action to become a candidate for public office. See
  • Candidate: means an individual who has taken affirmative action to become a candidate for State, county, local, or legislative office in a primary, special, general, or local election. See
  • candidate: includes the candidate's committee, except in regard to the provisions of section 2947 of this subchapter. See
  • Cannabis: means all parts of the plant Cannabis sativa L. See
  • Capable: means that a patient has the ability to make and communicate health care decisions to a physician, including communication through persons familiar with the patient's manner of communicating if those persons are available. See
  • Caucus: From the Algonquian Indian language, a caucus meant "to meet together." An informal organization of members of the legislature that exists to discuss issues of mutual concern and possibly to perform legislative research and policy planning for its members. There are regional, political or ideological, ethnic, and economic-based caucuses.
  • Causal analysis: means a formal root cause analysis, similar analytic methodologies, or any similarly effective but simplified processes that use a systematic approach to identify the basic or causal factors that underlie the occurrence or possible occurrence of a reportable adverse event, adverse event, or near miss. See
  • Certificate: means a certificate of approval issued to a hospital, laboratory, or nursing home under section 4207 of this title. See
  • Certified: means completion of an accredited training program by an individual. See
  • Charity: An agency, institution, or organization in existence and operating for the benefit of an indefinite number of persons and conducted for educational, religious, scientific, medical, or other beneficent purposes.
  • Chemical: means a substance with a distinct molecular composition or a group of structurally related substances and includes the breakdown products of the substance or substances that form through decomposition, degradation, or metabolism. See
  • Chemical of high concern to children: means a chemical listed under section 1773 or designated by the Department as a chemical of high concern by rule under section 1776 of this title. See
  • child: means an individual from the time of birth to 18 years of age. See
  • Child care facility: means a child care facility or family child care home as defined in 33 V. See
  • Child care facility: means a child care facility or family day care home licensed or registered under 33 Vt. See
  • Child-occupied facility: means a building or portion of a building constructed prior to 1978, visited regularly by the same child, six years of age or under, on at least two different days within any week, provided that each day's visit lasts at least three hours and the combined weekly visits last at least six hours and the combined annual visits last at least 60 hours. See
  • children: means an individual or individuals under 18 years of age, except where specified as a child or children six years of age or younger. See
  • children: means an individual or individuals under 12 years of age. See
  • Chronic care: means health services provided by a health care professional for an established clinical condition that is expected to last a year or more and that requires ongoing clinical management attempting to restore the individual to highest function, minimize the negative effects of the condition, prevent complications related to chronic conditions, engage in advanced care planning, and promote appropriate access to palliative care and pain and symptom management. See
  • Circumstantial evidence: All evidence except eyewitness testimony.
  • Cleaning product: means an institutional compound intended for routine cleaning, including general purpose cleaners, bathroom cleaners, glass cleaners, carpet cleaners, floor care products, and hand soaps. See
  • Client: means a person who is provided treatment services by an approved substance abuse treatment program, substance abuse crisis team, or designated substance abuse counselor. See
  • Cocaine: means coca leaves except coca leaves and extracts of coca leaves from which cocaine, ecgonine, and derivatives of ecgonine or their salts have been removed; cocaine, its salts, optical and geometric isomers, and salts of isomers; ecgonine, its derivatives, their salts, isomers, and salts of isomers; or any compound, mixture, or preparation which contains any quantity of any of the substances referred to in this subdivision. See
  • Commercial facility: means any building constructed for the purposes of commercial or industrial activity and not primarily intended for use by the general public, including office complexes, industrial buildings, warehouses, factories, and storage facilities. See
  • Commissioner: means the Commissioner of Health. See
  • Commissioner: means the Commissioner of Health. See
  • Commissioner: means the Commissioner of Health or the Commissioner's designee. See
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Consumer product: means any product that is regularly used or purchased to be used for personal, family, or household purposes. See
  • Contaminant: means a trace amount of a chemical or chemicals that is incidental to manufacturing and serves no intended function in the children's product or component of the children's product, including an unintended by-product of chemical reactions during the manufacture of the children's product, a trace impurity in feed-stock, an incompletely reacted chemical mixture, and a degradation product. See
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Contractor: means any firm, partnership, association, corporation, sole proprietorship, or other business concern as well as any governmental, religious, or social organization or union that agrees to perform services. See
  • Contribution: means a payment, distribution, advance, deposit, loan, or gift of money or anything of value, paid or promised to be paid for the purpose of influencing an election, advocating a position on a public question, or supporting or opposing one or more candidates in any election. See
  • Conviction: A judgement of guilt against a criminal defendant.
  • Corporation: A legal entity owned by the holders of shares of stock that have been issued, and that can own, receive, and transfer property, and carry on business in its own name.
  • Corrective action plan: means a plan to implement strategies intended to eliminate or significantly reduce the risk of a recurrence of an adverse event and to measure the effectiveness of such strategies. See
  • corrosive: means any substance that in contact with living tissue will cause substantial destruction of tissue by chemical action, but shall not refer to action on inanimate surfaces. See
  • cosmetic: means :

  • Cosmetics: means articles intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body or any part thereof for cleansing, beautifying, promoting attractiveness, or altering appearance, and articles intended for use as a component of such an article. See
  • Crack cocaine: means the free-base form of cocaine. See
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • de-leading: means activities conducted by a person who offers to eliminate or plan for the elimination of lead-based paint or lead hazards. See
  • Decedent: A deceased person.
  • Decedent: means a deceased individual whose body or part is or may be the source of an anatomical gift. See
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: In a civil suit, the person complained against; in a criminal case, the person accused of the crime.
  • Delegate: means an individual employed by a health care provider or pharmacy or in the Office of the Chief Medical Examiner and authorized by a health care provider or dispenser or by the Chief Medical Examiner to request information from the VPMS relating to a bona fide current patient of the health care provider or dispenser or to a bona fide investigation or inquiry into an individual's death. See
  • Deliver: means the actual, constructive, or attempted transfer or prescription of a regulated drug, whether or not there exists an agency relationship. See
  • Dentist: means a person authorized by law to practice dentistry in this State and who has a license issued to the person under this chapter authorizing him or her to use regulated drugs in connection with his or her professional practice. See
  • Department: means the Department of Health. See

  • Depressant or stimulant drug: means :

  • Designated substance abuse counselor: means a person approved by the Secretary to evaluate and treat substance abusers, pursuant to the provisions of this chapter. See
  • Deteriorated paint: means any interior or exterior lead-based paint or other coating that is peeling, chipping, chalking, or cracking or any paint or other coating located on an interior or exterior surface or component that is otherwise damaged or separated from the substrate. See
  • Detoxification: means the planned withdrawal of an individual from a state of acute or chronic intoxication under qualified supervision and with or without the use of medication. See
  • Director: means the Director of Occupational Health. See
  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Disinterested witness: means a witness other than the spouse, reciprocal beneficiary, child, parent, sibling, grandchild, grandparent, or guardian of the individual who makes, amends, revokes, or refuses to make an anatomical gift, or another adult who exhibited special care and concern for the individual. See
  • Dispense: includes distribute, leave with, give away, dispose of, or deliver. See
  • Dispenser: means any person who "dispenses" or engages in "dispensing" as those terms are defined in 26 V. See
  • Dissociation: means a complete termination of a member's continued membership in a limited liability company for any reason. See
  • Dissolution: means an event under section 4101 of this title which requires a limited liability company to wind up its affairs and to terminate its existence as a legal entity. See
  • Distribution: means a transfer of money or property from a limited liability company to a member in the member's capacity as a member or to a transferee of the member's distributional interest. See
  • Distributional interest: means the right of a member or transferee to receive a distribution from a limited liability company. See
  • Distributor: means any person or entity that distributes cleaning products commercially, but excludes retail stores. See
  • Division: means the Division of Occupational Health. See
  • Docket: A log containing brief entries of court proceedings.
  • Document of gift: means a donor card or other record used to make an anatomical gift. See
  • Domestic: when applied to a corporation, company, association, or copartnership shall mean organized under the laws of this State; "foreign" when so applied, shall mean organized under the laws of another state, government, or country. See
  • Donor: The person who makes a gift.
  • Donor: means an individual whose body or part is the subject of an anatomical gift. See
  • Donor registry: means a database that identifies donors and complies with the provisions of section 5250t of this title. See
  • drug: means :

  • Drug diversion investigator: means an employee of the Department of Public Safety whose primary duties include investigations involving violations of laws regarding prescription drugs or the diversion of prescribed controlled substances, and who has completed a training program established by the Department of Health by rule that is designed to ensure that officers have the training necessary to use responsibly and properly any information that they receive from the VPMS. See
  • drug paraphernalia: means all equipment, products, devices, and materials of any kind that are used, or promoted for use or designed for use, in planting, propagating, cultivating, growing, harvesting, manufacturing, compounding, converting, producing, processing, preparing, testing, analyzing, packaging, repackaging, storing, containing, concealing, injecting, ingesting, inhaling, or otherwise introducing into the human body a regulated drug in violation of chapter 84 of this title. See
  • Drug-checking: means the testing of a substance to determine its chemical composition or assist in determining whether the substance contains contaminants, toxic substances, or hazardous compounds. See
  • Due date: means the date by which an owner of rental target housing or a child care facility shall file with the Department the RRPM compliance statement required by section 1759 of this title. See
  • Dwelling: means any residential unit, including attached structures such as porches and stoops, used as the home or residence of one or more persons. See
  • Ecstasy: means 3,4-methylenedioxymethamphetamine, including its salts, isomers, or salts of isomers. See
  • Educational institution: means a Vermont public or independent school or a postsecondary school that offers or operates a program of college or professional education for credit or a degree in Vermont. See
  • Election: means the procedure whereby the voters of this State, or any of its political subdivisions, select persons to fill public offices or act on public questions. See
  • Election: means the procedure whereby the voters of this State or any of its political subdivisions select a person to be a candidate for public office or to fill a public office or to act on public questions, including voting on constitutional amendments. See
  • Electioneering communication: means any communication that refers to a clearly identified candidate for office and that promotes or supports a candidate for that office or attacks or opposes a candidate for that office, regardless of whether the communication expressly advocates a vote for or against a candidate, including communications published in any newspaper or periodical or broadcast on radio or television or over the Internet or any public address system; placed on any billboards, outdoor facilities, buttons, or printed material attached to motor vehicles, window displays, posters, cards, pamphlets, leaflets, flyers, or other circulars; or contained in any direct mailing, robotic phone calls, or mass electronic or digital communications. See
  • Electorate: means the qualified voters in a school district voting at a properly warned school district meeting. See
  • Elevated blood lead level: means having a blood lead level of at least five micrograms per deciliter of human blood, or a lower threshold as determined by the Commissioner. See
  • Employee: means any person engaged in service to an employer for wages, salary, or other compensation, excluding an independent contractor. See
  • Employer: means a person who employs one or more persons. See
  • Employer: means the organization on whose behalf a worker is employed or volunteering when rendering health services to a source patient pursuant to this subchapter. See
  • Entity: means a person other than an individual. See
  • Environmentally preferable cleaning product: means a cleaning product that has a lesser or reduced effect on human health and the environment when compared to competing products serving the same purpose. See
  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Establishment: means food manufacturing establishments, food service establishments, lodging establishments, children's camps, seafood vending facilities, and shellfish reshippers and repackers. See
  • Evidence: Information presented in testimony or in documents that is used to persuade the fact finder (judge or jury) to decide the case for one side or the other.
  • Evidence-based: means based on criteria and guidelines that reflect high-quality, cost-effective care. See
  • Ex officio: Literally, by virtue of one's office.
  • Executor: A male person named in a will to carry out the decedent
  • Expenditure: means a payment, disbursement, distribution, advance, deposit, loan, or gift of money or anything of value, paid or promised to be paid, for the purpose of influencing an election, advocating a position on a public question, or supporting or opposing one or more candidates. See
  • Eye bank: means a person that is licensed, accredited, or regulated under federal or state law to engage in the recovery, screening, testing, processing, storage, or distribution of human eyes or portions of human eyes. See
  • Facility: means any institutional, commercial, public, private, or industrial structure, installation, or building or private residence and its grounds. See
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • federal act: means Title VI of the Public Health Service Act (42 U. See
  • federal act: means the federal Food, Drug and Cosmetic Act, 21 U. See
  • Federal drug laws: means the laws of the United States relating to one or more of those drugs which are defined in this chapter as regulated drugs. See
  • Fees: shall mean earnings due for official services, aside from salaries or per diem compensation. See
  • Fiduciary: A trustee, executor, or administrator.
  • filed: means deposited in the regularly maintained office of the official with whom the filing is to be made. See
  • Firm: means a company, partnership, corporation, sole proprietorship, or individual doing business; an association or business entity; a State or local government agency; or a nonprofit organization. See
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • following: when used by way of reference to a section of the law shall mean the next preceding or following section. See
  • Food: means articles of food, drink, confectionery, or condiment for human consumption, whether simple, mixed, or compound, and all substances and ingredients used in the preparation thereof. See
  • food: means :

  • food packaging: means a package or packaging component that is intended for direct food contact. See
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Four-year general election cycle: means the 48-month period that begins 38 days after a general election for a four-year-term office. See
  • Fraud: Intentional deception resulting in injury to another.
  • Full name: means an individual's full first name, middle name or initial, if any, and full legal last name, making the identity of the person who made the contribution apparent by unambiguous reference. See
  • gender identity: means an individual's actual or perceived gender identity, or gender-related characteristics intrinsically related to an individual's gender or gender-identity, regardless of the individual's assigned sex at birth. See
  • General election: means the election held on the first Tuesday after the first Monday in November, in even-numbered years. See
  • General election period: means the period beginning the day after the primary election and ending the day of the general election. See
  • General hospital: is a hospital of which not more than 50 percent of the total patient days during the year are customarily assignable to the following categories of cases: chronic, convalescent and rest, drug and alcoholic, epilepsy, developmental and psychiatric disabilities and mental conditions, and tuberculosis, and which provides adequate and separate facilities and equipment for the performance of surgery and obstetrics, or either, and for diagnostic X-ray and laboratory services.   • Generic drug: means a drug listed by generic name and considered to be chemically and therapeutically equivalent to a drug listed by brand name, as both names are identified in the most recent edition of or supplement to the U. See
  • Generic name: means the official name of a drug product as established by the U. See
  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Give: means to offer, present, confer, pay, or deliver; also to agree or promise to do any of the foregoing. See
  • Global payment: means a payment from a health insurer, Medicaid, Medicare, or other payer for the health services of a defined population of patients for a defined period of time. See
  • Governmental unit: means a state, or political subdivision thereof, or any department, division, board, or other agency of any of the foregoing. See
  • Grace period: The number of days you'll have to pay your bill for purchases in full without triggering a finance charge. Source: Federal Reserve
  • Green cleaning: means a practice that includes:

  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Guardian: means a person appointed by a court to make decisions regarding the support, care, education, health, or welfare of an individual. See
  • Hallucinogenic drugs: means stramonium, mescaline or peyote, lysergic acid diethylamide, and psilocybin, and all synthetic equivalents of chemicals contained in resinous extractives of Cannabis sativa, or any salts or derivatives or compounds of any preparations or mixtures thereof, and any other substance that is designated as habit-forming or as having a serious potential for abuse arising out of its effect on the central nervous system or its hallucinogenic effect in the rules adopted by the Department of Health under section 4202 of this title.   • hazardous substance: means any substance or mixture of substances that:

  • Hazing: means any act committed by a person, whether individually or in concert with others, against a student in connection with pledging, being initiated into, affiliating with, holding office in, or maintaining membership in any organization that is affiliated with an educational institution; and that is intended to have the effect of, or should reasonably be expected to have the effect of, humiliating, intimidating, or demeaning the student or endangering the mental or physical health of a student. See
  • Health care practitioner: means an individual licensed by the Board of Medical Practice or the Office of Professional Regulation to provide professional health care services in this State. See
  • Health care professional: means an individual, partnership, corporation, facility, or institution licensed or certified or authorized by law to provide professional health care services. See
  • Health care provider: means an individual licensed, certified, or authorized by law to provide professional health care service in this State to an individual during that individual's medical or dental care, treatment, or confinement. See
  • Health care provider: means a person, partnership, corporation, facility, or institution, licensed or certified or authorized by law to administer health care or dispense medication in the ordinary course of business or practice of a profession. See
  • Health care services: means services for the diagnosis, prevention, treatment, cure, or relief of a health condition, illness, injury, or disease. See
  • Health care worker: means any individual or employee of a health care provider who provides medical or other health services in the course of the worker's employment. See
  • Health hazard: means any material, including biological material or energy, or both, in any form from any source that can adversely affect the health of any employee, or can adversely affect the health of any person exposed in a place of employment or any person adversely exposed from a source in a place of employment. See
  • Health officer: means Commissioner of Health, the Commissioner's designee, or a local or district health officer. See
  • Health services: means activities and functions that are directly related to care, treatment, or diagnosis of a patient, including emergency medical treatment. See
  • Heroin: includes every substance not chemically or physically distinguishable from it and preparations containing heroin or its derivatives, by whatever name identified and whether produced directly or indirectly by extraction from substances of vegetable origin, or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis, as designated by the Department of Health by rule. See
  • Hospital: means an institution for the care and treatment of the sick and injured licensed as a hospital under chapter 43 of this title and a hospital conducted, maintained, and operated by the United States or the State of Vermont, approved under this chapter as proper to be entrusted with the custody and use of regulated drugs under the direction of a physician or dentist, confirmed by an official written order signed by a person authorized to prescribe such drugs. See
  • Hospital: means a place devoted primarily to the maintenance and operation of diagnostic and therapeutic facilities for inpatient medical or surgical care of individuals suffering from illness, disease, injury, or deformity, or for obstetrics. See
  • Hospital: includes public health centers and general, tuberculosis, mental, chronic disease, and other type of hospitals and related facilities, such as laboratories, out-patient departments, nurses' homes and training facilities, and central service facilities, operated in connection with hospitals, but does not include any hospital furnishing primarily domiciliary care. See
  • Hospital: means a place devoted primarily to the maintenance and operation of diagnostic and therapeutic facilities for in-patient medical or surgical care of individuals who have an illness, disease, injury, or physical disability, or for obstetrics. See
  • Hospital: means a facility licensed as a hospital under the law of any state or a facility operated as a hospital by the United States, a state, or a subdivision of a state. See
  • Hospital: means a hospital required to be licensed under chapter 43 of this title. See
  • Impaired judgment: means that a person does not sufficiently understand or appreciate the relevant facts necessary to make an informed decision. See
  • importer: means the owner of the product. See
  • Incapacitated: means that a person, as a result of his or her use of alcohol or other drugs, is in a state of intoxication or of mental confusion resulting from withdrawal such that the person:

  • Independent dust clearance: means a visual examination and collection of dust samples, by a lead-based paint inspector or lead-based paint inspector-risk assessor who has no financial interest in either the work being performed or the property to be inspected and is independent of both the persons performing the work and the owner of the property. See
  • Independent expenditure-only political committee: means a political committee that conducts its activities entirely independent of candidates; does not give contributions to candidates, political committees, or political parties; does not make related expenditures; and is not closely related to a political party or to a political committee that makes contributions to candidates or makes related expenditures. See
  • Independent school: means a school other than a public school, which provides a program of elementary or secondary education, or both. See
  • Independent third party: means a nationally recognized organization that has developed a program for the purpose of certifying environmentally preferable cleaning products. See
  • Indictment: The formal charge issued by a grand jury stating that there is enough evidence that the defendant committed the crime to justify having a trial; it is used primarily for felonies.
  • inhabitants: shall mean the population of the political division referred to, as ascertained by the national census last completed before the time when such population is a material fact. See
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Inspection: means a surface-by-surface investigation to determine the presence of lead-based paint and other lead hazards and the provision of a report explaining the results of the investigation. See
  • Intentional unsafe act: shall mean an adverse event or near miss that results from:

  • Intentionally added: means the addition of a chemical in a product that serves an intended function in the product component. See

  • Interchangeable biological product: means a biological product that the U. See
  • Interim controls: means a set of measures designed temporarily to reduce human exposure or likely exposure to lead hazards, including specialized cleaning, repairs, maintenance, painting, temporary containment, ongoing monitoring of lead hazards or potential hazards, and the establishment of management and resident education programs. See
  • Intoxicated: means a condition in which the mental or physical functioning of an individual is substantially impaired as a result of the presence of alcohol or other drugs in his or her system. See
  • irritant: means any substance, not corrosive within the meaning of subdivision (11) of this section, that on immediate, prolonged, or repeated contact with normal living tissue will induce a local inflammatory reaction. See
  • Jurisdiction: (1) The legal authority of a court to hear and decide a case. Concurrent jurisdiction exists when two courts have simultaneous responsibility for the same case. (2) The geographic area over which the court has authority to decide cases.
  • Justice: when applied to a person, other than a Justice of the Supreme Court, shall mean a justice of the peace for the county for which he or she is elected or appointed. See
  • Know: means to have actual knowledge. See
  • label: means a display of written, printed, or graphic matter upon the immediate container of any article and a requirement made by or under authority of this chapter that any word, statement, or other information appearing on the label shall not be considered to be complied with unless such word, statement, or other information also appears on the outside container or wrapper, if any there be, of the retail package of the article, or is easily legible through the outside container or wrapper. See
  • Laboratory: means a laboratory approved under this chapter as proper to be entrusted with the custody and use of regulated drugs for scientific and medical purposes and for purposes of instruction. See
  • Law enforcement officer: means a law enforcement officer certified by the Vermont Criminal Justice Council as provided in 20 V. See
  • Lead hazard: means a condition that causes exposure to lead from contaminated dust, lead-contaminated soil, lead-containing coatings, or lead-contaminated paint that is deteriorated or present in accessible surfaces, friction surfaces, or impact surfaces that would result in adverse human health effects. See
  • Lead-based paint: means paint or other surface coatings that contain lead in an amount:

  • Lead-based paint abatement supervisor: means any individual who has satisfactorily completed an accredited training program approved by the Commissioner and has a current license issued by the Department to perform abatement work supervision. See
  • Lead-based paint activities: means :

  • Lead-based paint inspector: means an individual who has satisfactorily completed an accredited training program approved by the Commissioner and has a current license issued by the Department to conduct lead-based paint inspections. See
  • Lead-based paint inspector-risk assessor: means an individual who has satisfactorily completed an accredited training program approved by the Commissioner and has a current license issued by the Department to conduct lead-based paint inspections and risk assessments. See
  • Lead-based paint project designer: means an individual who has satisfactorily completed an accredited training program approved by the Commissioner and has a current license issued by the Department to prepare lead abatement project designs, occupant protection plans, and abatement reports. See
  • Lead-safe RRPM supervisor: means an individual who has completed an accredited RRPM training program approved by the Commissioner and, if performing services for compensation, has a current license issued by the Department. See
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Legislative leadership political committee: means a political committee established by or on behalf of a political party caucus within a chamber of the General Assembly. See
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a license to practice their profession issued to one of those persons listed in subdivisions (1)(A) through (F) of this section by the person's respective professional board under the applicable laws of this State, or a license issued by the Department of Health under section 4206 of this title to a person not subject to the jurisdiction of any such professional board. See
  • License: means the document issued to an individual, entity, or firm indicating that the standards for licensure for each discipline, category of entity, or firm established in this chapter have been met. See
  • Licensee: means a person who engages in lead-based paint activities or RRPM activities and has obtained a license to perform such activities for compensation. See
  • Licensing agency: means the Department of Health. See
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Local board of health: means the local health officer, with the selectboard of the town or city council of a city. See
  • Local election: means any election that deals with the selection of persons to fill public office or the settling of public questions solely within a single municipality. See
  • Lodging establishment: means a place where overnight accommodations are regularly provided to the transient, traveling, or vacationing public, including hotels, motels, inns, and bed and breakfasts. See
  • Lysergic acid diethylamide: includes any salts or derivatives or compounds of any preparations or mixtures of lysergic acid diethylamide or any preparation, mixture, or compound containing any lysergic acid diethylamide. See
  • Magistrate: shall mean any Supreme Court Justice, Superior judge, District judge, or Probate judge. See
  • Maintenance: means work intended to maintain and preserve target housing, a child-occupied facility, a pre-1978 facility, a commercial facility, bridge, or other superstructure. See
  • Manager: means a person that under the operating agreement of a manager-managed limited liability company is responsible, alone or in concert with others, for performing the management functions stated in subsection 4054(c) of this title. See
  • Manner sufficient to transmit: means consistent with current guidelines of the Centers for Disease Control and Prevention, as determined by a physician licensed to practice medicine in Vermont. See
  • Manufacturer: means a person authorized by law to manufacture, bottle, or pack drugs in this State and who has a license issued to the person under this chapter to compound, mix, cultivate, produce, or prepare regulated drugs, but does not include a pharmacy that compounds such drugs to be sold or dispensed on prescriptions at retail. See
  • Manufacturer: means any person, firm, association, partnership, corporation, organization, joint venture, importer, or domestic distributor of firefighting agents or equipment. See
  • Manufacturer: means :

  • Manufacturer: means any person or entity engaged in the process of manufacturing cleaning products for commercial distribution. See
  • Mass media activity: means a television commercial, radio commercial, Internet advertisement, mass mailing, mass electronic or digital communication, literature drop, newspaper or periodical advertisement, robotic phone call, or telephone bank, that includes the name or likeness of a clearly identified candidate for office. See
  • maternal death: means :

  • Medical facilities: means diagnostic or diagnostic and treatment centers, rehabilitation facilities and nursing homes as those terms are defined in the federal act, and such other medical facilities for which federal aid may be authorized under the federal act. See
  • Member: means a person that has become a member of a limited liability company under section 4051 of this title and has not dissociated under section 4081 of this title. See
  • Member-managed limited liability company: means a limited liability company that is not a manager-managed limited liability company. See
  • Methamphetamine: includes any quantity of the substance, its salt, isomers, salts of isomers, optical isomers, and salts of its optical isomers. See
  • Minor: means an individual who is under 18 years of age. See
  • misbranded package: means any retailed package of a hazardous substance, intended for household use, that fails to bear a label:

  • Month: shall mean a calendar month and "year" shall mean a calendar year and be equivalent to the expression "year of our Lord. See
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Motor vehicle: means all vehicles propelled or drawn by power other than muscular power, including snowmobiles, motorcycles, all-terrain vehicles, farm tractors, vehicles running only upon stationary rails or tracks, motorized highway building equipment, road-making appliances, or tracked vehicles or electric personal assistive mobility devices. See
  • Municipality: shall include a city, town, town school district, incorporated school or fire district or incorporated village, and all other governmental incorporated units. See
  • Municipality: means any city, town, incorporated village, town fire district, or other political subdivision that provides firefighting services pursuant to general law or municipal charter. See
  • narcotic drugs: means opium, coca leaves, pethidine (isonipecaine, meperidine), and opiates or their compound, manufacture, salt, alkaloid, or derivative, and every substance neither chemically nor physically distinguishable from them, and preparations containing such drugs or their derivatives, by whatever trade name identified and whether produced directly or indirectly by extraction from substances of vegetable origin, or independently by means of chemical synthesis or by a combination of extraction and chemical synthesis, as the same are so designated in the rules adopted by the Department of Health under section 4202 of this title. See
  • Near miss: means any process variation that did not affect the outcome, but for which a recurrence carries a significant chance of a serious adverse outcome. See
  • Nondriver identification card: means a nondriver identification card issued by the Vermont Department of Motor Vehicles pursuant to 23 V. See
  • Nurse: means any person authorized by law to practice nursing in this State. See
  • Nursing home: means a facility, other than a hospital, operated for the purpose of providing lodging, board, and nursing care to persons who are sick, have an infirmity or disability, or are convalescing, approved under this chapter as proper to be entrusted with the custody and use of regulated drugs prescribed for such individual patients under its care under the direction of a physician or dentist, confirmed by an official written order signed by a person authorized to prescribe such drugs. See
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • Occupant: means any person who resides in, or regularly uses, a dwelling, mobile dwelling, or structure. See
  • Occupational disease: means a disease caused by exposure to an occupational health hazard. See
  • Official written order: means an order written on a form prescribed for that purpose by the U. See
  • Operating agreement: means any form of description of membership rights and obligations under section 4003 of this title, stored or depicted in any tangible or electronic medium, which is agreed to by the members, including amendments to the agreement. See
  • Organ procurement organization: means a person designated by the Secretary of the U. See
  • Organization: means a fraternity, sorority, athletic team, association, corporation, order, society, corps, cooperative, club, or other similar group, whose members primarily are students at an educational institution, and that is affiliated with the educational institution. See
  • Organized community-based needle exchange program: means a program approved by the Commissioner of Health under section 4478 of this title, the purpose of which is to provide access to clean needles and syringes, and which is operated by an AIDS service organization, a substance abuse treatment provider, or a licensed health care provider or facility. See
  • Ortho-phthalates: means any member of the class of organic chemicals that are esters of phthalic acid containing two carbon chains located in the ortho position. See
  • Outlet: means a drinking water fixture currently or reasonably expected to be used for consumption or cooking purposes, including a drinking fountain, an ice machine, or a faucet as determined by a school district, supervisory union, independent school, or child care provider. See
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means any person who, alone or jointly or severally with others:

  • Package: means a container providing a means of marketing, protecting, or handling a product and shall include a unit package, an intermediate package, and a shipping container. See
  • Packaging component: means an individual assembled part of a package, such as any interior or exterior blocking, bracing, cushioning, weatherproofing, exterior strapping, coatings, closures, inks, and labels, and disposable gloves used in commercial or institutional food service. See
  • Palliative care: means interdisciplinary care given to improve the quality of life of patients and their families facing the problems associated with a serious medical condition. See
  • Parent: means a parent whose parental rights have not been terminated. See
  • Part: means an organ, an eye, or tissue of a human being. See
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Party candidate listing: means any communication by a political party that:

  • Patient: means a person admitted to or receiving health care services from an ambulatory surgical center. See
  • Patient: means a person who is 18 years of age or older and under the care of a physician. See
  • Patient: means a person admitted to a hospital on an inpatient basis. See
  • Payment reform: means modifying the method of payment from a fee for-service basis to one or more alternative methods for compensating health care professionals, health care provider bargaining groups created pursuant to section 9409 of this title, integrated delivery systems and other health care professional arrangements, manufacturers of prescribed products, medical supply companies, and other companies providing health services or health supplies, for the provision of high-quality and efficient health services, products, and supplies while measuring quality and efficiency. See
  • Permit: means any permit or license issued pursuant to this title. See
  • Persistent bioaccumulative toxic: means a chemical or chemical group that, based on credible scientific information, meets each of the following criteria:

  • Person: means any individual, business entity, labor organization, public interest group, or other organization, incorporated or unincorporated. See
  • Person: shall include any natural person, corporation, municipality, the State of Vermont or any department, agency, or subdivision of the State, and any partnership, unincorporated association, or other legal entity. See
  • Person: means any individual, company, corporation, association, partnership, the U. See
  • Person: means any individual, firm, partnership, corporation, company, association, or joint stock association, and the legal successor thereof. See
  • Person: means an individual, corporation, business trust, estate, trust, partnership, limited liability company, association, joint venture, public corporation, government or governmental subdivision, agency, or instrumentality, or any other legal or commercial entity. See
  • Person: means a natural person, corporation, partnership, trust, society, club, association, or other organization, including municipalities and the State. See
  • person: includes an individual, partnership, corporation, and association. See
  • Person: includes an individual, partnership, corporation, association, trust, or other institution or entity. See
  • Personal estate: shall include all property other than real estate. See
  • Personal property: All property that is not real property.
  • Personal protective equipment: means clothing designed, intended, or marketed to be worn by firefighting personnel in the performance of their duties, designed with the intent for use in fire and rescue activities, and includes jackets, pants, shoes, gloves, helmets, and respiratory equipment. See
  • PFAS: means a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom. See
  • Pharmacist: means any person authorized by law to practice pharmacy in this State; but nothing in this chapter shall be construed as conferring on a person any authority, right, or privilege that is not granted to him or her by the pharmacy laws of his or her state. See
  • Pharmacist: means a natural person licensed by the State Board of Pharmacy to prepare, compound, dispense, and sell drugs, medicines, chemicals, and poisons. See
  • Pharmacy: means any place registered as such by the Board of Pharmacy in which drugs, prescriptions, or poisons are possessed for the purpose of compounding, dispensing, or retailing, or in which drugs, prescriptions, or poisons are compounded, dispensed, or retailed, or in which such drugs, prescriptions, or poisons are by advertising or otherwise offered for sale at retail and which has a license issued to it under this chapter authorizing the retail dealing of regulated drugs. See
  • Physician: means a person authorized by law to practice medicine in this State and who has a license issued to the person under this chapter authorizing him or her to use regulated drugs in connection with his or her professional practice. See
  • Physician: means an individual authorized to practice medicine or osteopathy under the law of any state. See
  • Physician: means an individual licensed to practice medicine under 26 Vt. See
  • Place of employment: means any work place or place where an employee is engaged in performance of his or her work or duties, or which is used in connection with an employee's employment. See
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plea: In a criminal case, the defendant's statement pleading "guilty" or "not guilty" in answer to the charges, a declaration made in open court.
  • Pledging: means any action or activity related to becoming a member of an organization. See
  • poison: means any toxic substance that falls within any of the following categories:

  • Political party: means a political party organized under chapter 45 of this title and any committee established, financed, maintained, or controlled by the party, including any subsidiary, branch, or local unit thereof, and shall be considered a single, unified political party. See
  • Political party: is a ny group of individuals that has organized and filed its certificate of organization with the Secretary of State, pursuant to chapter 45 of this title. See
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practitioner: includes a physician, dentist, veterinarian, surgeon, or any other person who may be lawfully entitled under this chapter to distribute, dispense, prescribe, or administer regulated drugs to patients. See
  • Pregnancy-associated death: means the death of a woman while pregnant or within one year following the end of pregnancy, irrespective of cause. See
  • Pregnancy-related death: means the death of a woman while pregnant or within one year following the end of pregnancy, irrespective of the duration and site of the pregnancy, from any cause related to or aggravated by her pregnancy or its management, but not from accidental or incidental causes. See
  • Prescribe: means an order for a patient made or given by a practitioner. See
  • Prescriber: means any duly licensed physician, dentist, veterinarian, or other practitioner licensed to write prescriptions for the treatment or prevention of disease in man or animal. See
  • Prescription: means an order for a regulated drug made by a physician, physician assistant, advanced practice registered nurse, dentist, or veterinarian licensed under this chapter to prescribe such a drug which shall be in writing except as otherwise specified in this subdivision. See
  • Prescription drug: means any human drug required by federal law or regulation to be dispensed only by a prescription, including finished dosage forms and active ingredients subject to Section 503(b) of the federal Food, Drug and Cosmetic Act. See
  • Presentence report: A report prepared by a court's probation officer, after a person has been convicted of an offense, summarizing for the court the background information needed to determine the appropriate sentence. Source: U.S. Courts
  • President pro tempore: A constitutionally recognized officer of the Senate who presides over the chamber in the absence of the Vice President. The President Pro Tempore (or, "president for a time") is elected by the Senate and is, by custom, the Senator of the majority party with the longest record of continuous service.
  • Preventive care: means health services provided by health care professionals to identify and treat asymptomatic individuals who have risk factors or preclinical disease, but in whom the disease is not clinically apparent, including immunizations and screening, counseling, treatment, and medication determined by scientific evidence to be effective in preventing or detecting a condition.   • Primary: means any election that precedes a general or special election, for the purpose of permitting political parties to nominate, from among all of the candidates for any office, only that number of candidates equal to the number of persons to be elected to that office at the succeeding general or special election. See
  • Primary election period: means the period beginning the day after primary petitions must be filed under section 2356 of this title and ending the day of the primary election. See
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Probate: Proving a will
  • Probation: A sentencing alternative to imprisonment in which the court releases convicted defendants under supervision as long as certain conditions are observed.
  • Procurement organization: means an eye bank, an organ procurement organization, or a tissue bank. See
  • Professional board: means :

  • Proper name: means the nonproprietary name of a biological product. See
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Prospective donor: means an individual who is dead or near death and has been determined by a procurement organization to have a part that could be medically suitable for transplantation, therapy, research, or education. See
  • Protective custody: means a civil status in which an incapacitated person is detained by a law enforcement officer for the purposes of:

  • Psychiatric disability: means an impairment of thought, mood, perception, orientation, or memory that limits one or more major life activities but does not include intellectual disability. See
  • Psychiatric hospital: means a hospital for the diagnosis and treatment of mental illness. See
  • Public facility: means a house of worship; courthouse; jail; municipal room; State or county institution; railroad station; school building; social hall; hotel, restaurant, or building used or rented to boarders or roomers; place of amusement; factory; mill; workshop or building in which persons are employed; building used as a nursery, convalescent home, or home for the aged; tent or outdoor structure used for public assembly; and barn, shed, office building, store, shop, shop other than a workshop, or space where goods are offered for sale, wholesale, or retail. See
  • Public health hazard: means the potential harm to the public health by virtue of any condition or any biological, chemical, or physical agent. See
  • Public health risk: means the probability of experiencing a public health hazard. See
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public office: means any office in the U. See
  • Public question: means an issue that is before the voters for a binding decision. See
  • Public safety personnel: means an individual employed or volunteering for a fire department, police department, or ambulance service. See
  • Public school: means an elementary school or secondary school operated by a school district. See
  • Publicly owned buildings and offices: means enclosed indoor places or portions of such places owned, leased, or rented by State, county, or municipal governments, or by agencies supported by appropriation of, or by contracts or grants from, funds derived from the collection of federal, State, county, or municipal taxes. See
  • Quorum: The number of legislators that must be present to do business.
  • real estate: shall include lands, tenements, and hereditaments and all rights thereto and interests therein, and pews or slips in places of public worship shall be treated as real estate. See
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reasonably available: means able to be contacted by a procurement organization without undue effort and willing and able to act in a timely manner consistent with existing medical criteria necessary for the making of an anatomical gift. See
  • Recipient: means an individual into whose body a decedent's part has been or is intended to be transplanted. See
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See
  • Reference product: means the single biological product licensed pursuant to 42 U. See
  • Refusal: means a record created under section 5250g of this title that expressly states an intent to bar other persons from making an anatomical gift of an individual's body or part. See
  • Registration: means the annual registration of licenses and certificates under this chapter. See
  • Registry number: means the number assigned under rules adopted by the Department of Health to each person authorized under this chapter to use, prescribe, dispense, possess, or administer a regulated drug in connection with his or her professional practice. See
  • Regulated drug: means :

  • Remainder: An interest in property that takes effect in the future at a specified time or after the occurrence of some event, such as the death of a life tenant.
  • Renovation: includes the performance of activities for the purpose of converting a building or part of a building into target housing or a child-occupied facility when it results in the disturbance of a painted surface. See
  • Rental target housing: means target housing offered for lease or rental under a rental agreement as defined in 9 V. See
  • Repair: means the restoration of paint or other coatings that have been damaged, including the repair of permanent containment around lead-based paint materials in a facility. See
  • Risk assessment: means an on-site investigation by a lead-based paint inspector-risk assessor to determine and report the existence, nature, severity, and location of lead hazards, including information gathering about the age and history of the property and occupancy by children six years of age or younger, visual inspection, limited wipe sampling, or other environmental sampling techniques, other appropriate risk assessment activities, and a report on the results of the investigation. See
  • RRPM: means the Renovation, Repair, Painting, and Maintenance Program that pertains to projects that disturb lead-based paint on target housing and child-occupied facilities. See
  • RRPM activities: means lead-safe renovation, repair, painting, and maintenance practices as required by section 1759 of this chapter and as adopted by rule by the Commissioner. See
  • Rug or carpet: means a thick fabric used to cover floors. See
  • Safety system: means the comprehensive patient safety surveillance and improvement system established pursuant to this chapter and the rules adopted pursuant to this chapter. See
  • said: when used by way of reference to a person or thing shall apply to the same person or thing last mentioned. See
  • Sale: means transfer for a consideration or barter or exchange or an offer or express or implied promise to transfer for a consideration or barter or exchange, and each such transaction made by any person, whether as principal, proprietor, agent, servant, or employee. See
  • Salvage food: means any food product from which the label on the packaging has been lost or destroyed or which has been subjected to possible damage as the result of an accident, fire, flood, or other cause that prevents the product from meeting the specifications of the manufacturer or the packer, but is otherwise suitable for human consumption. See
  • School: means :

  • School: means a public or independent prekindergarten, kindergarten, elementary, or secondary school, or any postsecondary school as defined in 16 V. See
  • School board: means the board of school directors elected to manage the schools of a school district, the prudential committee of an incorporated school district, the supervisory union board of directors, and the supervisors of unorganized towns and gores. See
  • School district: means town school districts, union school districts, interstate school districts, city school districts, unified union districts, and incorporated school districts, each of which is governed by a publicly elected board. See
  • School district meeting: means a duly warned meeting of a school district at which questions are presented to the electorate. See
  • School officers: shall include all persons, other than teachers, who have to do with matters pertaining to public schools. See
  • School year: means the year beginning July 1 and ending the next June 30. See
  • Seafood vending facility: means a store, motor vehicle, retail stand, or similar place from which a person sells seafood for human consumption. See
  • Secretary: means the Secretary of State. See
  • Secretary: means the Secretary of Human Services or designee. See
  • Secretary: means the Secretary of Education. See
  • Secretary of Health and Human Services: means the Secretary of Health and Human Services of the United States. See
  • Serious bodily injury: means bodily injury that creates a substantial risk of death or that causes substantial loss or impairment of the function of any bodily member or organ or substantial impairment of health or substantial disfigurement. See
  • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • sexual orientation: means female or male homosexuality, heterosexuality, or bisexuality. See
  • Short-term rental: means a furnished house, condominium, or other dwelling room or self-contained dwelling unit rented to the transient, traveling, or vacationing public for a period of fewer than 30 consecutive days and for more than 14 days per calendar year. See
  • Sign: means , with the present intent to authenticate or adopt a record:

  • Single source: means an individual, partnership, corporation, association, labor organization, or any other organization or group of persons that is not a political committee or political party. See
  • Single-user toilet facility: means a single-occupancy restroom with at least one water closet and with an outer door that can be locked by the occupant. See
  • Ski wax: means a lubricant applied to the bottom of snow runners, including skis and snowboards, to improve their grip and glide properties. See
  • Source patient: means an individual who, in the course of receiving health services, may have exposed a health care worker, public safety personnel, or emergency personnel to blood or bodily fluids in a manner sufficient to transmit a bloodborne disease. See
  • Special election: means an election that is not provided for by law to be held at stated intervals. See
  • State: when applied to the different parts of the United States may apply to the District of Columbia and any territory and the Commonwealth of Puerto Rico. See
  • State: means a state of the United States, the District of Columbia, Puerto Rico, the U. See
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico, or any territory or insular possession subject to the jurisdiction of the United States. See
  • State Board: means the State Board of Education established by chapter 3 of this title. See
  • State office: means the office of Governor, Lieutenant Governor, State Treasurer, Secretary of State, Auditor of Accounts, and Attorney General. See
  • Statute: A law passed by a legislature.
  • Stem cell and stem cell-related products: means any articles that contain or consist, or purport to contain or consist, of one or more of the following, when intended for implantation, transplantation, infusion, or transfer into a human recipient and when intended for use in the diagnosis, cure, mitigation, treatment, or prevention of any disease or condition based on or in connection with a proven or purported attribute of stem cells:

  • Student: means any person who:

  • Subpoena: A command to a witness to appear and give testimony.
  • Substance abuse crisis team: means an organization approved by the Secretary to provide emergency treatment and transportation services to substance abusers pursuant to the provisions of this chapter. See
  • Summons: Another word for subpoena used by the criminal justice system.
  • Superintendent: means the chief executive officer of a supervisory union and each school board within it. See
  • Superstructure: means a large steel or other industrial structure, such as a bridge or water tower, that may contain lead-based paint. See
  • Supervisory district: means a supervisory union that consists of only one school district, which may be a unified union district. See
  • Supervisory union: means an administrative, planning, and educational service unit created by the State Board under section 261 of this title, that consists of two or more school districts; if the context clearly allows, the term also means a supervisory district. See
  • sworn: shall include affirmed. See
  • Target housing: means any dwelling constructed prior to 1978, except any 0-bedroom dwelling or any dwelling located in multiple-unit buildings or projects reserved for the exclusive use of elders or persons with disabilities, unless a child six years of age or younger resides in or is expected to reside in that dwelling. See
  • Technician: means an individual determined to be qualified to remove or process parts by an appropriate organization that is licensed, accredited, or regulated under federal or state law. See
  • Telemedicine: means the delivery of health care services such as diagnosis, consultation, or treatment through the use of live interactive audio and video over a secure connection that complies with the requirements of the Health Insurance Portability and Accountability Act of 1996, Pub. See
  • Telephone bank: means more than 500 telephone calls of an identical or substantially similar nature that are made to the general public within any 30-day period. See
  • Terminal: means an establishment primarily engaged in the wholesale distribution of crude petroleum and petroleum products, including liquefied petroleum gas from bulk liquid storage facilities. See
  • Terminal condition: means an incurable and irreversible disease which would, within reasonable medical judgment, result in death within six months. See
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Tissue: means a portion of the human body other than an organ or an eye. See
  • Tissue bank: means a person that is licensed, accredited, or regulated under federal or state law to engage in the recovery, screening, testing, processing, storage, or distribution of tissue. See
  • Town: shall include city and wards or precincts therein; "selectboard members" and "board of civil authority" shall extend to and include the mayor and aldermen of cities; "trustees" shall extend to and include bailiffs of incorporated villages; and the laws applicable to the inhabitants and officers of towns shall be applicable to the inhabitants and similar officers of all municipal corporations. See
  • Town: includes "city. See
  • Transcript: A written, word-for-word record of what was said, either in a proceeding such as a trial or during some other conversation, as in a transcript of a hearing or oral deposition.
  • Transfer: includes an assignment, a conveyance, a sale, a lease, an encumbrance, including a mortgage or security interest, a gift, and a transfer by operation of law. See
  • Treatment: means the broad range of medical, detoxification, residential, outpatient, aftercare, and follow-up services that are needed by substance abusers and may include a variety of other medical, social, vocational, and educational services relevant to the rehabilitation of these persons. See
  • Trial: A hearing that takes place when the defendant pleads "not guilty" and witnesses are required to come to court to give evidence.
  • Trustee: A person or institution holding and administering property in trust.
  • Two-year general election cycle: means the 24-month period that begins 38 days after a general election. See
  • Ultimate user: means a patient who uses a prescription drug. See
  • Venereal disease: means syphilis, gonorrhea, and any other sexually transmitted disease which the Department finds to be of significance and amenable to control. See
  • Vermont campaign finance qualification period: means the period beginning February 15 of each even-numbered year and ending on the date on which primary petitions must be filed under section 2356 of this title. See
  • Vessel: means every description of watercraft used or capable of being used as a means of transportation on water. See
  • Veterinarian: means a person authorized by law to practice veterinary medicine in this State and who has a license issued to the person under this chapter authorizing him or her to use regulated drugs in connection with his or her professional practice. See
  • Village: shall mean an incorporated village. See
  • VOSHA Code: means this chapter and 21 Vt. See
  • Voter: means an individual who is qualified to vote in an election in this State or a political subdivision of this State, and whose name is registered on the checklist of a political subdivision of the State. See
  • VPMS: means the Vermont Prescription Monitoring System established under this chapter. See
  • Wellness services: means health services, programs, or activities that focus on the promotion or maintenance of good health. See
  • Wholesaler: means a person authorized by law, when so required, to sell at wholesale drugs in this State and further has a license issued to the person under this chapter to supply others than consumers with drugs or preparations containing a regulated drug that the person has not produced or prepared. See
  • Worker: means emergency personnel, health care worker, or public safety personnel. See
  • workplace: means an enclosed structure where employees perform services for an employer, including restaurants, bars, and other establishments in which food or drinks, or both, are served. See
  • Year: means a calendar year. See
