Terms Used In Texas Education Code > Title 2 > Subtitle C

  • Association: means an entity governed as an association under Title 6 or 7. See Texas Government Code 30.00304
  • Authorized corporate surety: means a domestic or foreign corporation authorized to engage in business in this state for the purpose of issuing surety, guaranty, or indemnity bonds that guarantee the fidelity of an executor or administrator. See
  • Business: means a trade, occupation, profession, or other commercial activity. See Texas Government Code 30.00304
  • Certificate of formation: means :
    (A) the document required to be filed with the filing officer under Chapter Texas Government Code 30.00304
  • Child: includes an adopted child, regardless of whether the adoption occurred through:
    (1) an existing or former statutory procedure; or
    (2) an equitable adoption or acts of estoppel. See Texas Estates Code 113.152
  • City secretary: includes a city clerk or, in a city that has no city secretary or clerk, the city officer who performs the duties of a city secretary. See Texas Election Code 171.028
  • Claims: includes :
    (1) liabilities of a decedent that survive the decedent's death, including taxes, regardless of whether the liabilities arise in contract or tort or otherwise;
    (2) funeral expenses;
    (3) the expense of a tombstone;
    (4) expenses of administration;
    (5) estate and inheritance taxes; and
    (6) debts due such estates. See Texas Estates Code 113.153
  • Corporate fiduciary: means a financial institution, as defined by Section Texas Estates Code 113.154
  • Corporation: means an entity governed as a corporation under Title 2 or 7. See Texas Government Code 30.00304
  • County office: means an office of the county government that is voted on countywide. See Texas Election Code 171.028
  • Court: means and includes:
    (1) a county court in the exercise of its probate jurisdiction;
    (2) a court created by statute and authorized to exercise original probate jurisdiction; and
    (3) a district court exercising original probate jurisdiction in a contested matter. See Texas Estates Code 113.1541
  • Department: means the Department of Agriculture. See Texas Education Code 66.82
  • Devisee: includes a legatee. See Texas Estates Code 113.156
  • Director: means an individual who serves on the board of directors of a foreign or domestic corporation. See Texas Government Code 30.00304
  • Distributee: means a person who is entitled to a part of the estate of a decedent under a lawful will or the statutes of descent and distribution. See Texas Estates Code 113.157
  • District office: means an office of the federal or state government that is not voted on statewide. See Texas Election Code 171.028
  • Docket: means the probate docket. See Texas Estates Code 113.158
  • Domestic: means , with respect to an entity, that the entity is formed under this code or the entity's internal affairs are governed by this code. See Texas Government Code 30.00304
  • Domestic entity: means an organization formed under or the internal affairs of which are governed by this code. See Texas Government Code 30.00304
  • Entity: means a domestic entity or foreign entity. See Texas Government Code 30.00304
  • Estate: means a decedent's property, as that property:
    (1) exists originally and as the property changes in form by sale, reinvestment, or otherwise;
    (2) is augmented by any accretions and other additions to the property, including any property to be distributed to the decedent's representative by the trustee of a trust that terminates on the decedent's death, and substitutions for the property; and
    (3) is diminished by any decreases in or distributions from the property. See
  • Exempt property: means the property in a decedent's estate that is exempt from execution or forced sale by the constitution or laws of this state, and any allowance paid instead of that property. See Texas Estates Code 113.201
  • Filing instrument: means an instrument, document, or statement that is required or authorized by this code to be filed by or for an entity with the filing officer in accordance with Chapter Texas Government Code 30.00304
  • Final canvass: means the canvass from which the official result of an election is determined. See Texas Election Code 171.028
  • Foreign: means , with respect to an entity, that the entity is formed under, and the entity's internal affairs are governed by, the laws of a jurisdiction other than this state. See Texas Government Code 30.00304
  • General partner: means :
    (A) each partner in a general partnership; or
    (B) a person who is admitted to a limited partnership as a general partner in accordance with the governing documents of the limited partnership. See Texas Government Code 30.00304
  • General partnership: means a partnership governed as a general partnership under Chapter Texas Government Code 30.00304
  • Governing person: means a person serving as part of the governing authority of an entity. See Texas Government Code 30.00304
  • Gubernatorial general election: means the general election held every four years to elect a governor for a full term. See Texas Election Code 171.028
  • Heir: means a person who is entitled under the statutes of descent and distribution to a part of the estate of a decedent who dies intestate. See Texas Estates Code 113.203
  • Independent candidate: means a candidate in a nonpartisan election or a candidate in a partisan election who is not the nominee of a political party. See Texas Election Code 171.028
  • Independent executor: means the personal representative of an estate under independent administration as provided by Chapter Texas Estates Code 113.205
  • Internal Revenue Code: means the Internal Revenue Code of 1986, as amended. See Texas Government Code 30.00304
  • Judge: means the presiding judge of any court having original jurisdiction over probate proceedings, regardless of whether the court is:
    (1) a county court in the exercise of its probate jurisdiction;
    (2) a court created by statute and authorized to exercise probate jurisdiction; or
    (3) a district court exercising probate jurisdiction in a contested matter. See Texas Estates Code 113.207
  • Land commissioner: means the Commissioner of the General Land Office. See Texas Government Code 312.011
  • Law: means , unless the context requires otherwise, both statutory and common law. See Texas Government Code 30.00304
  • lien: include :
    (1) a deed of trust;
    (2) a vendor's lien, a mechanic's, materialman's, or laborer's lien, an attachment or garnishment lien, and a federal or state tax lien;
    (3) a chattel mortgage;
    (4) a judgment; and
    (5) a pledge by hypothecation. See
  • Limited liability company: means an entity governed as a limited liability company under Title 3 or 7. See Texas Government Code 30.00304
  • Limited partnership: means a partnership that is governed as a limited partnership under Title 4 and that has one or more general partners and one or more limited partners. See Texas Government Code 30.00304
  • Livestock: means cattle, horses, mules, asses, sheep, goats, llamas, alpacas, exotic livestock, including elk and elk hybrids, and hogs, unless otherwise defined. See Texas Education Code 66.82
  • Local canvass: means the canvass of the precinct election returns. See Texas Election Code 171.028
  • Measure: means a question or proposal submitted in an election for an expression of the voters' will. See Texas Election Code 171.028
  • Member: means :
    (A) in the case of a limited liability company, a person who is a member or has been admitted as a member in the limited liability company under its governing documents;
    (B) in the case of a nonprofit corporation, a person who has membership rights in the nonprofit corporation under its governing documents;
    (C) in the case of a cooperative association, a member of a nonshare or share association;
    (D) in the case of a nonprofit association, a person who has membership rights in the nonprofit association under its governing documents; or
    (E) in the case of a professional association, a person who has membership rights in the professional association under its governing documents. See Texas Government Code 30.00304
  • Minor: means a person younger than 18 years of age who:
    (1) has never been married; and
    (2) has not had the disabilities of minority removed for general purposes. See Texas Estates Code 113.210
  • Next of kin: includes :
    (1) an adopted child or the adopted child's descendants; and
    (2) the adoptive parent of the adopted child. See Texas Estates Code 113.252
  • Nonprofit association: means an association governed as a nonprofit association under Chapter Texas Government Code 30.00304
  • Nonprofit corporation: means a corporation governed as a nonprofit corporation under Chapter Texas Government Code 30.00304
  • Officer: means an individual elected, appointed, or designated as an officer of an entity by the entity's governing authority or under the entity's governing documents. See Texas Government Code 30.00304
  • Official oath: means the oath required by Article XVI, Section Texas Government Code 312.011
  • Organization: means a corporation, limited or general partnership, limited liability company, business trust, real estate investment trust, joint venture, joint stock company, cooperative, association, bank, insurance company, credit union, savings and loan association, or other organization, regardless of whether the organization is for-profit, nonprofit, domestic, or foreign. See Texas Government Code 30.00304
  • Partner: means a limited partner or general partner. See Texas Government Code 30.00304
  • Partnership: means an entity governed as a partnership under Title 4. See Texas Government Code 30.00304
  • Person: means an individual or a corporation, partnership, limited liability company, business trust, trust, association, or other organization, estate, government or governmental subdivision or agency, or other legal entity, or a series of a domestic limited liability company or foreign entity. See Texas Government Code 30.00304
  • Person: includes a natural person and a corporation. See Texas Estates Code 113.253
  • person interested: means :
    (1) an heir, devisee, spouse, creditor, or any other having a property right in or claim against an estate being administered; and
    (2) anyone interested in the welfare of an incapacitated person, including a minor. See Texas Estates Code 113.206
  • Personal property: includes an interest in:
    (1) goods;
    (2) money;
    (3) a chose in action;
    (4) an evidence of debt; and
    (5) a real chattel. See Texas Estates Code 114.001
  • personal representative: include :
    (1) an executor and independent executor;
    (2) an administrator, independent administrator, and temporary administrator; and
    (3) a successor to an executor or administrator listed in Subdivision (1) or (2). See Texas Estates Code 114.004
  • Presidential primary election: means an election held under Subchapter A, Chapter Texas Election Code 171.028
  • Property: includes tangible and intangible property and an interest in that property. See Texas Government Code 30.00304
  • Proposition: means the wording appearing on a ballot to identify a measure. See Texas Election Code 171.028
  • Real property: includes estates and interests in land, whether corporeal or incorporeal or legal or equitable. See Texas Estates Code 114.003
  • Secretary: means the:
    (A) individual designated as secretary of an entity under the entity's governing documents; or
    (B) officer or committee of persons authorized to perform the functions of secretary of an entity without regard to the designated name of the officer or committee. See Texas Government Code 30.00304
  • Statewide office: means an office of the federal or state government that is voted on statewide. See Texas Election Code 171.028
  • Statutory probate court: means a court created by statute and designated as a statutory probate court under Chapter Texas Estates Code 113.1541
  • Straight-party vote: means a vote by a single mark, punch, or other action by the voter for all the nominees of one political party and for no other candidates. See Texas Election Code 171.028
  • Succeeding: means immediately following. See Texas Government Code 312.011
  • Surety: includes a personal surety and a corporate surety. See Texas Estates Code 114.005
  • Swear: includes affirm. See Texas Government Code 311.005
  • Uniform election date: means an election date prescribed by Section Texas Election Code 171.028
  • Voting station: means the voting booth or other place where voters mark their ballots or otherwise indicate their votes at a polling place. See Texas Election Code 171.028
  • Ward: means a person for whom a guardian has been appointed. See Texas Estates Code 114.006
  • written: means an expression of words, letters, characters, numbers, symbols, figures, or other textual information that is inscribed on a tangible medium or that is stored in an electronic or other medium that is retrievable in a perceivable form. See Texas Government Code 30.00304
