  • Abandoned: means the failure of the parent to provide reasonable support and to maintain regular contact with the child, including providing normal supervision. See Arizona Laws 8-201
  • Abandonment: means the failure of a parent to provide reasonable support and to maintain regular contact with the child, including providing normal supervision. See Arizona Laws 8-531
  • Abuse: means the infliction or allowing of physical injury, impairment of bodily function or disfigurement or the infliction of or allowing another person to cause serious emotional damage as evidenced by severe anxiety, depression, withdrawal or untoward aggressive behavior and which emotional damage is diagnosed by a medical doctor or psychologist and is caused by the acts or omissions of an individual who has the care, custody and control of a child. See Arizona Laws 8-201
  • Accident potential zone one: means an area three thousand feet wide by five thousand feet long that starts at the end of each clear zone and that is centered and measured on the extended runway centerline, terminating eight thousand feet from the end of each runway and, for an ancillary military facility described in paragraph 7 of this section, includes an area delineated as accident potential zone one in the map described in paragraph 7 of this section.   • Accident potential zone two: means an area three thousand feet wide by seven thousand feet long that starts at the end of each accident potential zone one and that is centered and measured on the extended runway centerline, terminating fifteen thousand feet from the end of each runway, except that, for Luke air force base, accident potential zone two extends thirty thousand feet southwest from the end of each runway and, for an ancillary military facility described in paragraph 7 of this section, includes an area delineated as accident potential zone two in the map described in paragraph 7 of this section.   • Account: means withdrawable capital deposited with or invested in an association in accordance with any plan authorized by this chapter unless such term is otherwise designated or qualified. See Arizona Laws 6-401
  • Accounting services: means services that are commonly and historically performed by accountants, including recording or summarizing financial transactions, bookkeeping, analyzing or verifying financial information, reporting financial results, financial planning or providing attest services, compilation services, tax services or consulting services. See Arizona Laws 32-701
  • Accredited institution: means any public or private regionally or nationally accredited college or university that is accredited by an organization recognized by the council for higher education accreditation or its successor agency. See Arizona Laws 32-701
  • Accused: means a person who has been arrested for committing a criminal offense and who is held for an initial appearance or other proceeding before trial. See Arizona Laws 13-4401
  • Acquired entity: means an entity in which all of one or more classes or series of interests are acquired in an interest exchange. See Arizona Laws 29-2102
  • Acquiring entity: means the entity that acquires all of one or more classes or series of interests of the acquired entity in an interest exchange. See Arizona Laws 29-2102
  • Acquisition of control: means any transaction whereby a person obtains, directly or indirectly, control of a bank, trust company, savings and loan association or controlling person. See Arizona Laws 6-141
  • Acquittal:
    1. Judgement that a criminal defendant has not been proved guilty beyond a reasonable doubt.
    2. A verdict of "not guilty."
     
  • Action: includes any matter or proceeding in a court, civil or criminal. See Arizona Laws 1-215
  • Administrative charge: means the amount that may be assessed for the costs of processing a notice of payment due or notice of toll evasion, including the costs to collect unpaid tolls and to pursue an administrative hearing to enforce a toll evasion. See Arizona Laws 28-7751
  • Adopted rule: means a final rule as defined in section 41-1001. See Arizona Laws 1-215
  • Adult: means a person who is eighteen years of age or older. See Arizona Laws 8-201
  • Advertisement: means any written or oral publication, dissemination, solicitation or circulation that is intended to directly or indirectly induce any person to enter into an agreement for contracting services with a contractor, including business cards and telephone directory display advertisements. See Arizona Laws 32-1101
  • Advisory letter: means a nondisciplinary letter to notify a licensee that either:

    (a) While there is insufficient evidence to support disciplinary action, the board believes that continuation of the activities that led to the investigation may result in further board action against the licensee. See Arizona Laws 32-900

  • Aeronaut: includes any aviator, pilot, balloonist and other person participating in the operation of aircraft while in flight. See Arizona Laws 28-8201
  • Aesthetics: means any one or a combination of the following practices if they are performed for cosmetic purposes:

    (a) Massaging, cleansing, stimulating, manipulating, exercising, beautifying or applying oils, creams, antiseptics, clays, lotions or other preparations, either by hand or by mechanical or electrical appliances. See Arizona Laws 32-501

  • Affidavit: A written statement of facts confirmed by the oath of the party making it, before a notary or officer having authority to administer oaths.
  • Affirmed: In the practice of the appellate courts, the decree or order is declared valid and will stand as rendered in the lower court.
  • Agency: means an agency licensed by the division to place children for adoption. See Arizona Laws 8-531
  • Aggregate withdrawal value: means the sum of all payments made on all accounts of the association, all dividends and bonuses credited or allocated to such accounts and all dividends credited to "divided profits" for subsequent crediting to accounts on maturity, less all withdrawals, retirements and other proper deductions from accounts and all unpaid charges on the accounts.   • Aircraft: includes a balloon, airplane, amphibian and craft used for navigation through the air. See Arizona Laws 28-8201
  • Airport: means an area of land or water that is designed and set aside for the landing and taking off of aircraft and that is utilized or to be utilized in the interest of the public for those purposes. See Arizona Laws 28-8461
  • Airport hazard: means a structure, tree or use of land that obstructs the air space required for flight of aircraft in taking off or landing at an airport or that is otherwise hazardous to aircraft taking off or landing. See Arizona Laws 28-8461
  • Airport hazard area: means an area of land or water on which an airport hazard might be established if not prevented as provided in this article. See Arizona Laws 28-8461
  • Airstrip: means a strip of ground that is artificially or naturally surfaced and that is designed and used at an airport or landing field for the landing and takeoff of aircraft. See Arizona Laws 28-8461
  • Alarm subscriber: means any person who:

    (a) Leases, rents or purchases any monitored alarm system or service from an alarm business. See Arizona Laws 32-101

  • Alcohol: means any substance containing any form of alcohol, including ethanol, methanol, propynol and isopropynol. See Arizona Laws 28-101
  • Amendment: A proposal to alter the text of a pending bill or other measure by striking out some of it, by inserting new language, or both. Before an amendment becomes part of the measure, thelegislature must agree to it.
  • Amortization: Paying off a loan by regular installments.
  • Ancillary military facility: means :

    (a) For political subdivisions described in paragraph 9, subdivision (a) of this section, the military auxiliary airfield that is identified on the map that is designated as Luke air force base auxiliary airfield #1, that is dated March 1, 2004 and that is on file in printed format at the state land department on the effective date of this amendment to this section pursuant to section 37-102. See Arizona Laws 28-8461

  • Annuity: A periodic (usually annual) payment of a fixed sum of money for either the life of the recipient or for a fixed number of years. A series of payments under a contract from an insurance company, a trust company, or an individual. Annuity payments are made at regular intervals over a period of more than one full year.
  • Answer: The formal written statement by a defendant responding to a civil complaint and setting forth the grounds for defense.
  • Any highway purpose: includes any one or more of the following purposes:

    (a) Payment of highway obligations. See Arizona Laws 28-7501

  • Appellate: About appeals; an appellate court has the power to review the judgement of another lower court or tribunal.
  • Appraisal: A determination of property value.
  • Appropriate filing authority: means :

    (a) With respect to corporations, business trusts and limited liability companies, the commission. See Arizona Laws 29-2102

  • Appropriation: The provision of funds, through an annual appropriations act or a permanent law, for federal agencies to make payments out of the Treasury for specified purposes. The formal federal spending process consists of two sequential steps: authorization
  • Approve: means , in the case of an entity, that its governors and interest holders take whatever steps are necessary under its organizational documents, governing statute and other law to do all of the following:

    (a) Propose a transaction subject to this chapter. See Arizona Laws 29-2102

  • Architect: means a person who, by reason of knowledge of the mathematical and physical sciences and the principles of architecture and architectural engineering acquired by professional education and practical experience, is qualified to engage in the practice of architecture and is registered as an architect pursuant to this chapter. See Arizona Laws 32-101
  • Architect services: means those professional architect services that are within the scope of architectural practice as provided in Title 32, Chapter 1. See Arizona Laws 28-7361
  • Armed nuclear security guard: means a security guard who works at a commercial nuclear generating station, who is employed as part of the security plan approved by the nuclear regulatory commission and who meets the requirements mandated by the nuclear regulatory commission for carrying a firearm. See Arizona Laws 13-4901
  • Arrest: means the actual custodial restraint of a person or the person's submission to custody. See Arizona Laws 13-4401
  • Articles of organization: means the articles required by section 29-3201. See Arizona Laws 29-3102
  • Assets: (1) The property comprising the estate of a deceased person, or (2) the property in a trust account.
  • Associate director: means the associate director of the division. See Arizona Laws 3-361
  • Association: means every association to which this chapter applies as defined in the section concerning scope of chapter. See Arizona Laws 6-401
  • Attachment: A procedure by which a person's property is seized to pay judgments levied by the court.
  • Attest services: means the following services to be performed by the holder of a certificate issued by the board:

    (a) Audits or other engagements to be performed in accordance with the statements on auditing standards adopted by the American institute of certified public accountants. See Arizona Laws 32-701

  • Attorney-in-fact: A person who, acting as an agent, is given written authorization by another person to transact business for him (her) out of court.
  • Authority: means an intergovernmental public transportation authority established pursuant to this chapter. See Arizona Laws 28-9101
  • Authority: means the Arizona power authority. See Arizona Laws 30-101
  • Authorized emergency vehicle: means any of the following:

    (a) A fire department vehicle. See Arizona Laws 28-101

  • Automated driving system: means the hardware and software that are collectively capable of performing the entire dynamic driving task on a sustained basis, regardless of whether it is limited to a specific operational design domain. See Arizona Laws 28-101
  • Automated teller machine: means an automated device that is established by a bank, savings and loan association or credit union and that facilitates customer-bank communications activities, including taking deposits and disbursing cash drawn against a customer's deposit account or a customer's preapproved loan account, at a location separate from the home office or a branch. See Arizona Laws 6-101
  • Automobile graveyard: means an establishment or place of business maintained, used or operated for storing, keeping, buying or selling wrecked, abandoned, scrapped, ruined or dismantled motor vehicles or motor vehicle parts. See Arizona Laws 28-7941
  • Autonomous vehicle: means a motor vehicle that is equipped with an automated driving system. See Arizona Laws 28-101
  • Aviation fuel: means all flammable liquids composed of a mixture of selected hydrocarbons expressly manufactured and blended for the purpose of effectively and efficiently operating an internal combustion engine for use in an aircraft but does not include fuel for jet or turbine powered aircraft. See Arizona Laws 28-101
  • Bank: means a corporation that holds a banking permit issued pursuant to chapter 2 of this title. See Arizona Laws 6-101
  • Banking office: means any place of business of the bank at which deposits are received, checks are paid or money is loaned but does not include the premises used for computer operations, proofing, record keeping, accounting, storage, maintenance or other administrative or service functions. See Arizona Laws 6-101
  • Bankruptcy: Refers to statutes and judicial proceedings involving persons or businesses that cannot pay their debts and seek the assistance of the court in getting a fresh start. Under the protection of the bankruptcy court, debtors may discharge their debts, perhaps by paying a portion of each debt. Bankruptcy judges preside over these proceedings.
  • Barber: means a person who is licensed to practice barbering by the board. See Arizona Laws 32-301
  • Barbering: means any one or a combination of the following practices if they are performed on a person's head, face, neck or shoulders for cosmetic purposes:

    (a) Cutting, clipping or trimming hair. See Arizona Laws 32-301

  • Beneficiary: A person who is entitled to receive the benefits or proceeds of a will, trust, insurance policy, retirement plan, annuity, or other contract. Source: OCC
  • Board: means the state board of podiatry examiners. See Arizona Laws 32-801
  • Board: means the state board of chiropractic examiners. See Arizona Laws 32-900
  • Board: means the board of directors of an intergovernmental public transportation authority. See Arizona Laws 28-9101
  • Board: means the transportation board. See Arizona Laws 28-101
  • Board: means the state board of technical registration. See Arizona Laws 32-101
  • Board: means the barbering and cosmetology board. See Arizona Laws 32-301
  • Board: means the barbering and cosmetology board. See Arizona Laws 32-501
  • Board: means the Arizona state board of accountancy established by section 32-702. See Arizona Laws 32-701
  • Bond: means a bond secured solely by bridge construction revenues or a bond secured solely by highway improvement revenues as authorized and issued pursuant to this article. See Arizona Laws 28-7651
  • Bonds: means bonds of the board issued pursuant to this article. See Arizona Laws 28-7501
  • Branch: means any banking office other than the principal banking office. See Arizona Laws 6-101
  • Bridge construction revenues: means monies received pursuant to section 42-5032, subsection A and deposited in the bridge construction interest fund or redemption fund under section 28-7656, subsection A. See Arizona Laws 28-7651
  • Budget: means the annual highway program prepared by the department. See Arizona Laws 28-6901
  • Bus: means a motor vehicle designed for carrying sixteen or more passengers, including the driver. See Arizona Laws 28-101
  • Business: includes every trade, occupation and profession. See Arizona Laws 29-1001
  • Business: means a lawful activity, except a farm operation, that is conducted primarily by or for any of the following:

    (a) The purchase, sale, lease and rental of personal and real property and the manufacture, processing or marketing of products, commodities or other personal property. See Arizona Laws 28-7141

  • Business area: means an area that is outside municipal limits, that embraces all of the land on the same side of the highway on which one or more commercial or industrial activities are conducted, including all land within one thousand feet measured in any direction from the nearest edge of the actual land used or occupied for such activity, its parking, storage and service areas, its driveways and its established front, rear and side yards, that constitutes an integral part of such activity and that is zoned, under authority of law, primarily to permit industrial or commercial activity.   • Business corporation: means a business corporation, a close corporation, a professional corporation, a business development corporation and a benefit corporation. See Arizona Laws 29-2102
  • Business organization: means a partnership, professional corporation, professional limited liability company, limited liability company or limited liability partnership or any other entity that is recognized by the board and that is established under the laws of any state or foreign country. See Arizona Laws 32-701
  • Calendar year: means three hundred sixty-five days' actual time served without release, suspension or commutation of sentence, probation, pardon or parole, work furlough or release from confinement on any other basis. See Arizona Laws 13-105
  • Capital: means the aggregate primary capital and secondary capital. See Arizona Laws 6-351
  • Car sharing delivery period: means the period of time during which a shared vehicle is being delivered to the location of the car sharing start time as documented by the governing car sharing program agreement. See Arizona Laws 28-9601
  • Car sharing period: means the period of time that begins with the car sharing delivery period or the car sharing start time if there is no car sharing delivery period and ends at the car sharing termination time. See Arizona Laws 28-9601
  • Car sharing start time: means the time when a shared vehicle becomes subject to the control of the shared vehicle driver at or after the time that the reservation of the shared vehicle is scheduled to begin as documented in the records of a peer-to-peer car sharing program. See Arizona Laws 28-9601
  • Car sharing termination time: means the earliest of the following:

    (a) The agreed period of time established for the use of a shared vehicle in the governing car sharing program agreement expires and the shared vehicle is delivered to a location that is specified in the governing car sharing program agreement. See Arizona Laws 28-9601

  • Cease and Desist Letter: A letter requesting that a company stops the activity mentioned in the letter. Source: OCC
  • Certificate of limited partnership: means the certificate referred to in section 29-308, and the certificate as amended or restated. See Arizona Laws 29-301
  • Certificate of title: means a paper document or an electronic record that is issued by the department and that indicates ownership of a vehicle. See Arizona Laws 28-101
  • Certified public accountant: means an individual who has been issued a certificate of authority by the board to practice as a certified public accountant or who meets the limited reciprocity privilege requirements pursuant to section 32-725. See Arizona Laws 32-701
  • Chambers: A judge's office.
  • Chief executive office: means the place from which the main part of the partnership's business is managed. See Arizona Laws 29-1001
  • Child: means a person less than eighteen years of age. See Arizona Laws 8-531
  • Child developmental certified home: means a regular foster home that is licensed pursuant to section 8-509 and that is certified by the department of economic security pursuant to Section 36-593. See Arizona Laws 8-501
  • Child safety services: means a specialized child welfare program that is administered by the department as provided in this chapter and that investigates allegations of and seeks to prevent, intervene in and treat abuse and neglect, to promote the well-being of the child in a permanent home and to coordinate services to strengthen the family. See Arizona Laws 8-801
  • Chiropractic assistant: means an unlicensed person who has completed an educational training program approved by the board, who assists in basic health care duties in the practice of chiropractic under the supervision of a doctor of chiropractic and who performs delegated duties commensurate with the chiropractic assistant's education and training but who does not evaluate, interpret, design or modify established treatment programs of chiropractic care or violate any statute.   • Chop shop: means any building, lot or other premises in which one or more persons alters, destroys, disassembles, dismantles, reassembles or stores at least one motor vehicle or watercraft or two or more motor vehicle or watercraft parts from at least one vehicle or watercraft that the person or persons knows were obtained by theft, fraud or conspiracy to defraud with the intent to:

    (a) Alter, counterfeit, deface, destroy, disguise, falsify, forge, obliterate or remove the identity of the motor vehicles or motor vehicle parts, including the vehicle identification number for the purpose of misrepresenting or preventing the identification of the motor vehicles or motor vehicle parts.   • Claim: means an obligation for the payment of money or its equivalent and a sum or sums owed, due or asserted to be owed or due to another, for which a person is employed to demand payment and collect or enforce such payment, and includes:

    (a) Obligations for the payment of money to another, in the form of conditional sales agreements, notwithstanding the personal property sold thereunder, for which payment is claimed or may be or is repossessed in lieu of payment. See Arizona Laws 32-1001

  • Clear zone: means an area three thousand feet long measured along the extended runway centerline beginning at the end of all main military runways and three thousand feet wide centered on and measured at right angles to the extended runway centerline and, for an ancillary military facility described in paragraph 7 of this section, includes an area delineated as a clear zone in the map described in paragraph 7 of this section.   • Client: means a person or entity, other than one's employer, for whom accounting services are provided. See Arizona Laws 32-701
  • Clinical liaison: means a mental health expert or any other individual who has experience and training in mental health or developmental disabilities and who is qualified and appointed by the court to aid in coordinating the treatment or training of individuals who are found incompetent to stand trial. See Arizona Laws 13-4501
  • Cloned cellular or wireless telephone: means a cellular or wireless telephone in which the manufacturer's electronic serial number has been altered. See Arizona Laws 13-4801
  • Cloning paraphernalia: means the materials that are necessary to create a cloned cellular or wireless telephone and includes scanners to intercept electronic serial numbers, cellular telephones and mobile identification numbers, wireless telephones, cables, chips, burners, software and the computers containing the software to program a cloned cellular or wireless telephone's microchip with a false electronic serial number and mobile identification number combination and lists of electronic serial number and mobile identification number combinations.   • Collection agency: means :

    (a) All persons engaged directly or indirectly in soliciting claims for collection or in collection of claims owed, due or asserted to be owed or due. See Arizona Laws 32-1001

  • Commercial contractor: is synonymous with the terms "commercial builder" "industrial builder" and "public works builder" and means any person, firm, partnership, corporation, association or other organization, or a combination of any of them, that, for compensation, undertakes to or offers to undertake to, purports to have the capacity to undertake to, submits a bid or responds to a request for qualification or a request for proposals for construction services to, does himself or by or through others, or directly or indirectly supervises others, except within residential property lines, to:

    (a) Construct, alter, repair, add to, subtract from, improve, move, wreck or demolish any building, highway, road, railroad, excavation or other structure, project, development or improvement, or to do any part thereof, including the erection of scaffolding or any other structure or work in connection with the construction. See Arizona Laws 32-1101

  • Commercial nuclear generating station: means an electric power generating facility that is owned by a public service corporation, a municipal corporation or a consortium of public service corporations or municipal corporations and that produces electricity by means of a nuclear reactor and includes the property on which the facility is located. See Arizona Laws 13-4901
  • Commission: means the Arizona corporation commission. See Arizona Laws 29-2102
  • Commission: means the corporation commission. See Arizona Laws 29-3102
  • Commission: means Arizona power authority commission. See Arizona Laws 30-101
  • commit: means to assign legal custody. See Arizona Laws 8-201
  • Common law: The legal system that originated in England and is now in use in the United States. It is based on judicial decisions rather than legislative action.
  • Community: means a city, incorporated town, unincorporated town, community or village. See Arizona Laws 6-401
  • Comparable replacement dwelling: means a dwelling that is all of the following:

    (a) Decent, safe and sanitary. See Arizona Laws 28-7141

  • Compilation services: means providing a service of any compilation engagement to be performed in accordance with the statements on standards for accounting and review services. See Arizona Laws 32-701
  • Complaint: A written statement by the plaintiff stating the wrongs allegedly committed by the defendant.
  • Complaint: means a written statement of the essential facts constituting a public offense that is any of the following:

    (a) Made on an oath before a judge or commissioner of the superior court or an authorized juvenile hearing officer. See Arizona Laws 8-201

  • Comprehensive development: means an activity if all of the following apply:

    (a) The activity is comprised primarily of individual commercial or industrial activities. See Arizona Laws 28-7901

  • Concession: means any lease, ground lease, franchise, easement, permit or other binding agreement transferring rights for the use or control, in whole or in part, of an eligible facility by the department or other unit of government to a private partner in accordance with this chapter. See Arizona Laws 28-7701
  • Construction services: means either of the following for construction-manager-at-risk and job-order-contracting project delivery methods:

    (a) Construction, excluding services, through the construction-manager-at-risk or job-order-contracting project delivery methods. See Arizona Laws 28-7361

  • Construction-manager-at-risk: means a project delivery method in which:

    (a) There is a contract for construction services that is separate from the contract for design services, except that instead of a single contract for construction services, the department may elect separate contracts for preconstruction services during the design phase, for construction during the construction phase and for any other construction services. See Arizona Laws 28-7361

  • Consulting services: includes management advisory services, litigation support services, valuation services and other services that require the use of technical skills, education, observation, experience and knowledge to develop an analytical approach to process and to present findings, conclusions or recommendations. See Arizona Laws 32-701
  • Continuance: Putting off of a hearing ot trial until a later time.
  • Contract: A legal written agreement that becomes binding when signed.
  • Contract: means all types of department agreements, regardless of what they are called, for procurements pursuant to this article. See Arizona Laws 28-7361
  • Contractor: means any person who has a contract with the department. See Arizona Laws 28-7361
  • Contribution: means any cash, property, services rendered, or promissory note or other binding obligation to contribute cash or property or to perform services, which a partner contributes to a limited partnership in his capacity as a partner. See Arizona Laws 29-301
  • Contribution: means property or a benefit described in section 29-3402 that is provided by a person to a limited liability company to become a member or in the person's capacity as a member. See Arizona Laws 29-3102
  • Control: means direct or indirect ownership of or power to vote twenty-five percent or more of the outstanding voting securities of a bank, trust company, savings and loan association or controlling person or to control in any manner the election of a majority of the directors of a bank, trust company, savings and loan association or controlling person. See Arizona Laws 6-141
  • Control: means direct or indirect ownership of or power to vote twenty-five percent or more of the outstanding voting shares of an in-state financial institution or to control in any manner the election of a majority of the directors of an in-state financial institution. See Arizona Laws 6-321
  • Controlling person: means any person directly or indirectly in control of a bank, trust company or savings and loan association. See Arizona Laws 6-141
  • Conversion: means a transaction authorized by article 4 of this chapter. See Arizona Laws 29-2102
  • Converted entity: means the converting entity as it continues in existence after a conversion. See Arizona Laws 29-2102
  • Converting bank: means a bank converting from a national to a state bank, or the reverse. See Arizona Laws 6-211
  • Converting entity: means the domestic entity that approves a plan of conversion pursuant to section 29-2403 or the foreign entity that approves a conversion pursuant to the law of its jurisdiction of organization. See Arizona Laws 29-2102
  • Conviction: means a judgment of conviction by any state or federal court of competent jurisdiction in a criminal cause, regardless of whether an appeal is pending or could be taken, and includes any judgment or order based on a plea of no contest. See Arizona Laws 32-701
  • Conviction: means :

    (a) An unvacated adjudication of guilt or a determination that a person violated or failed to comply with the law in a court of original jurisdiction or by an authorized administrative tribunal. See Arizona Laws 28-101

  • Corporation: means a business corporation or a nonprofit corporation. See Arizona Laws 29-2102
  • Correctional facility: means any place used for the confinement or control of a person:

    (a) Charged with or convicted of an offense; or

    (b) Held for extradition; or

    (c) Pursuant to an order of court for law enforcement purposes. See Arizona Laws 31-341

  • Cosmetic purposes: means for the purpose of beautifying, preserving or conferring comeliness, excluding therapeutic massage and manipulations. See Arizona Laws 32-501
  • Cosmetologist: means a person who is licensed to practice cosmetology pursuant to this chapter. See Arizona Laws 32-501
  • Counterclaim: A claim that a defendant makes against a plaintiff.
  • County highway: means a public road that is constructed and maintained by a county. See Arizona Laws 28-101
  • Court: means all state, county and municipal courts in this state. See Arizona Laws 13-4401
  • Court: means a justice of the peace, town magistrate, city magistrate, superior court commissioner or superior court judge. See Arizona Laws 31-331
  • CPA designation: means the title "certified public accountant" or any abbreviation or grammatical derivative of the term "certified public accountant". See Arizona Laws 32-701
  • Crime victim advocate: means a person who is employed or authorized by a public or private entity to provide counseling, treatment or other supportive assistance to crime victims. See Arizona Laws 13-4401
  • Criminal conduct allegation: means an allegation of conduct by a parent, guardian or custodian of a child or an adult member of the victim's household that, if true, would constitute any of the following:

    (a) A violation of section 13-3623 involving child abuse. See Arizona Laws 8-201

  • Criminal offense: means conduct that gives a peace officer or prosecutor probable cause to believe that a felony, a misdemeanor, a petty offense or a violation of a local criminal ordinance has occurred. See Arizona Laws 13-4401
  • Criminal proceeding: means any hearing, argument or other matter that is scheduled by and held before a trial court but does not include any deposition, lineup, grand jury proceeding or other matter that is not held in the presence of the court. See Arizona Laws 13-4401
  • Custodial agency: means any law enforcement officer or agency, a sheriff or municipal jailer, the state department of corrections or a secure mental health facility that has custody of a person who is arrested or in custody for a criminal offense. See Arizona Laws 13-4401
  • Custodian: means a person, other than a parent or legal guardian, who stands in loco parentis to the child or a person to whom legal custody of the child has been given by order of a court of competent jurisdiction. See Arizona Laws 8-531
  • Custodian: means a person, other than a parent or legal guardian, who stands in loco parentis to the child or a person to whom legal custody of the child has been given by order of the juvenile court. See Arizona Laws 8-201
  • Custody: means the imposition of actual or constructive restraint pursuant to an on-site arrest or court order but does not include detention in a correctional facility, juvenile detention center or state hospital. See Arizona Laws 31-341
  • Damages: Money paid by defendants to successful plaintiffs in civil cases to compensate the plaintiffs for their injuries.
  • Dangerous: means that, as a result of a mental illness, defect or disability, a person's continued behavior can reasonably be expected, on the basis of a mental health expert's opinion, to result in serious physical harm or death to another person. See Arizona Laws 13-4501
  • DCS report: means a communication received by the centralized intake hotline that alleges child abuse or neglect and that meets the criteria for a report as prescribed in section 8-455. See Arizona Laws 8-201
  • De minimis violation: means a violation which, although undesirable, has no direct or immediate relationship to safety, health or property damage. See Arizona Laws 3-361
  • De novo entry: means a newly established bank or savings and loan association which is not created through the acquisition of or merger with an in-state financial institution and control is through an out-of-state financial institution. See Arizona Laws 6-321
  • Deadly physical force: means force that is used with the purpose of causing death or serious physical injury or in the manner of its use or intended use is capable of creating a substantial risk of causing death or serious physical injury. See Arizona Laws 13-105
  • Dealer: means a person who is engaged in the business of buying, selling or exchanging motor vehicles, trailers or semitrailers and who has an established place of business and has paid fees pursuant to section 28-4302. See Arizona Laws 28-101
  • Decedent: A deceased person.
  • Deed: The legal instrument used to transfer title in real property from one person to another.
  • Defendant: means a person or entity that is formally charged by complaint, indictment or information of committing a criminal offense. See Arizona Laws 13-4401
  • Defense attorney: Represent defendants in criminal matters.
  • Deliver: means to send, transmit or transfer information or documents, including by United States mail, electronic mail, hand delivery or fax. See Arizona Laws 28-7751
  • Department: means the department of insurance and financial institutions. See Arizona Laws 32-1001
  • Department: means the department of transportation acting directly or through its duly authorized officers and agents. See Arizona Laws 28-101
  • department: means the department of child safety. See Arizona Laws 8-501
  • Department: means the department of health services. See Arizona Laws 30-651
  • Department: means the department of insurance and financial institutions. See Arizona Laws 6-101
  • Department: means the state department of corrections. See Arizona Laws 31-201
  • Department: means the department of child safety. See Arizona Laws 8-201
  • Dependent: A person dependent for support upon another.
  • Deposition: An oral statement made before an officer authorized by law to administer oaths. Such statements are often taken to examine potential witnesses, to obtain discovery, or to be used later in trial.
  • Deputy director: means the deputy director of the financial institutions division of the department of insurance and financial institutions. See Arizona Laws 32-1001
  • Deputy director: means the deputy director of the financial institutions division of the department. See Arizona Laws 6-101
  • Design services: means architect services, engineer services or landscape architect services. See Arizona Laws 28-7361
  • Design-build: means the process of entering into and managing a contract between the department and another party in which the other party agrees to both design and build a highway, a structure, a facility or other items specified in the contract. See Arizona Laws 28-7361
  • Design-builder: means any individual, partnership, joint venture, corporation or other legal entity that is appropriately licensed in this state and that furnishes the necessary design services, in addition to construction of the work, whether by itself or through subcontracts, including subcontracts for architectural and engineering services. See Arizona Laws 28-7361
  • Designating foreign company: means , with respect to any foreign series, the foreign limited liability company that designated or otherwise established the foreign series in accordance with the law of its jurisdiction of formation. See Arizona Laws 29-3102
  • Detention: means the temporary confinement of a juvenile who requires secure care in a physically restricting facility that is completely surrounded by a locked and physically secure barrier with restricted ingress and egress for the protection of the juvenile or the community pending court disposition or as a condition of probation. See Arizona Laws 8-201
  • Detention facility: means any jail or other place of detention of persons charged with or convicted of a crime, including town, city, county, or regional facilities. See Arizona Laws 31-331
  • Devise: To gift property by will.
  • Diagnostic mammography: means an x-ray imaging of the breast performed on persons who have symptoms or physical signs indicative of breast disease. See Arizona Laws 30-651
  • Digital breast tomosynthesis: means multiple low-dose images of the breast as an x-ray tube moves around an arc. See Arizona Laws 30-651
  • Digital network or software application: means any online-enabled application, software, website or system that is offered or used by a transportation network company and that enables a potential passenger to arrange a ride with a transportation network company driver. See Arizona Laws 28-9551
  • Director: means the director of the department of transportation. See Arizona Laws 28-101
  • Director: means the director of the department. See Arizona Laws 30-651
  • Director: means the director of the department. See Arizona Laws 31-201
  • Director: means the director of the department. See Arizona Laws 8-201
  • Disciplinary action: means any other regulatory sanctions imposed by the board in combination with, or as an alternative to, relinquishment, revocation or suspension of a certificate or registration, including the imposition of:

    (a) An administrative penalty in an amount not to exceed $2,000 for each violation of this chapter or rules adopted pursuant to this chapter. See Arizona Laws 32-701

  • Discovery: Lawyers' examination, before trial, of facts and documents in possession of the opponents to help the lawyers prepare for trial.
  • Dismissal: The dropping of a case by the judge without further consideration or hearing. Source:
  • Displacing agency: means the department in carrying out a program or project with federal or state financial assistance that causes a person to be a displaced person. See Arizona Laws 28-7141
  • Distribution: means a transfer of money or other property from a partnership to a partner in the partner's capacity as a partner or to the partner's transferee. See Arizona Laws 29-1001
  • Dividing entity: means the domestic entity that approves a plan of division pursuant to section 29-2603 or the foreign entity that approves a division pursuant to the law of its jurisdiction of organization. See Arizona Laws 29-2102
  • Division: means the highway division of the department of transportation. See Arizona Laws 28-6901
  • Division: means a transaction authorized by article 6 of this chapter. See Arizona Laws 29-2102
  • Division: means the financial institutions division within the department. See Arizona Laws 6-101
  • Division: means the department. See Arizona Laws 8-531
  • Division: means the environmental services division of the Arizona department of agriculture. See Arizona Laws 3-361
  • Docket: A log containing brief entries of court proceedings.
  • Doctor of chiropractic: means a natural person who holds a license to practice chiropractic pursuant to this chapter. See Arizona Laws 32-900
  • Domestic entity: means an entity whose internal affairs are governed by the laws of this state. See Arizona Laws 29-2102
  • Domestic entity: when used in this article in reference to a foreign jurisdiction, means an entity whose internal affairs are governed by the law of the foreign jurisdiction. See Arizona Laws 29-2501
  • domestic limited partnership: means a partnership formed by two or more persons under the laws of this state and having one or more general partners and one or more limited partners. See Arizona Laws 29-301
  • Domesticated entity: means the domesticating entity as it continues in existence after a domestication. See Arizona Laws 29-2102
  • Domesticating entity: means the domestic entity that approves a plan of domestication pursuant to section 29-2503 or the foreign entity that approves a domestication pursuant to the law of its jurisdiction of organization. See Arizona Laws 29-2102
  • Domestication: means a transaction authorized by article 5 of this chapter. See Arizona Laws 29-2102
  • Donor: The person who makes a gift.
  • Drive: means to operate or be in actual physical control of a motor vehicle. See Arizona Laws 28-101
  • Driver: means a person who drives or is in actual physical control of a vehicle. See Arizona Laws 28-101
  • Driver license: means a license that is issued by a state to an individual and that authorizes the individual to drive a motor vehicle. See Arizona Laws 28-101
  • Dual licensed contractor: is synonymous with the term "commercial and residential builder" and means any person, firm, partnership, corporation, association or other organization, or a combination of any of them, that for compensation undertakes to or offers to undertake to, purports to have the capacity to undertake to, submits a bid or responds to a request for qualification or a request for proposals for construction services to, does himself or by or through others, or directly or indirectly supervises others under a single license on commercial or residential property to:

    (a) Construct, alter, repair, add to, subtract from, improve, move, wreck or demolish any building, excavation or other structure or improvement, including any appurtenances, or to do any part thereof. See Arizona Laws 32-1101

  • Economic loss: means any loss incurred by a person as a result of the commission of an offense. See Arizona Laws 13-105
  • Electrical appliances: means devices that use electrical current and includes lasers and IPL devices as defined in section 32-516. See Arizona Laws 32-501
  • Electronic outdoor advertising: means signs, displays and devices with sign faces that are comprised of matrices of light or light-emitting devices that are static or capable of changing messages electronically by remote or automatic means. See Arizona Laws 28-7901
  • Electronic product: means :

    (a) Any machine or device designed to produce a beam of ionizing radiation as the result of the operation of an electronic circuit or component. See Arizona Laws 30-651

  • Electronic serial number: means the unique numerical algorithm that the manufacturer programs into the microchip of each wireless telephone. See Arizona Laws 13-4801
  • Electronic transaction and payment technology: means a system for recording and paying a toll electronically, including using a transponder, a reader system, automatic vehicle license plate recognition technology, a global positioning system or any other electronic means. See Arizona Laws 28-7751
  • Eligible facility: means any facility, whether real or personal property, developed or operated after September 30, 2009 in accordance with this chapter, including any existing, enhanced, upgraded or new facility that is any of the following:

    (a) Used or useful for the safe transport of people, information or goods via one or more modes of transport, whether involving highways, bridges, tunnels, conduits, railways, monorails, transit, bus systems, guided rapid transit, fixed guideways, ferries, boats, vessels, airports, intermodal or multimodal systems or any other mode of transport. See Arizona Laws 28-7701

  • Eligible highway project: means a highway project that is both:

    (a) On the federal aid system, national highway system or state route or state highway system. See Arizona Laws 28-7671

  • Embezzlement: In most states, embezzlement is defined as theft/larceny of assets (money or property) by a person in a position of trust or responsibility over those assets. Embezzlement typically occurs in the employment and corporate settings. Source: OCC
  • Emergency: means an immediate threat to public health, welfare or safety caused by flood, earthquake, hurricane, tornado, explosion, fire or other catastrophe such that compliance with normal bidding procedures for repair or reconstruction of transportation facilities would be impracticable or contrary to the public interest. See Arizona Laws 28-7361
  • Employer: means a person or entity that hires an individual to perform a service and that directs and controls the manner in which the service is performed. See Arizona Laws 32-701
  • Employment: includes vocational training and other educational and rehabilitative activities, whether or not for compensation. See Arizona Laws 31-331
  • Engineer: means a person who by reason of engineering education, training and experience may apply engineering principles and interpret engineering data. See Arizona Laws 32-101
  • Engineer services: means those professional engineer services that are within the scope of engineering practice as provided in title 32, chapter 1. See Arizona Laws 28-7361
  • Engineer-in-training: means a candidate for registration as a professional engineer who both:

    (a) Is a graduate in an approved engineering curriculum of four years or more of a school approved by the board or has four years or more of education or experience, or both, in engineering work that meets standards specified by the board in its rules. See Arizona Laws 32-101

  • Entering or remaining unlawfully: means an act by a person who enters or remains in or on a commercial nuclear generating station or a structure or fenced yard of a commercial nuclear generating station if that person's intent for entering or remaining is not licensed, authorized or otherwise privileged. See Arizona Laws 13-4901
  • Entering or remaining unlawfully: means an act by a person who enters or remains in or on a military reservation or facility or a structure or fenced yard of a military reservation or facility if that person's intent for entering or remaining is not authorized or otherwise privileged. See Arizona Laws 13-5001
  • Enterprise: means any person under the jurisdiction of the department other than a financial institution. See Arizona Laws 6-101
  • Entity: means any of the following:

    (a) A corporation. See Arizona Laws 29-2102

  • Equitable: Pertaining to civil suits in "equity" rather than in "law." In English legal history, the courts of "law" could order the payment of damages and could afford no other remedy. See damages. A separate court of "equity" could order someone to do something or to cease to do something. See, e.g., injunction. In American jurisprudence, the federal courts have both legal and equitable power, but the distinction is still an important one. For example, a trial by jury is normally available in "law" cases but not in "equity" cases. Source: U.S. Courts
  • Escape: means departure from custody or from a correctional facility in which a person is held or detained with knowledge that such departure is unpermitted or failure to return to custody or detention following a temporary leave granted for a specific purpose or for a limited period. See Arizona Laws 31-341
  • Escrow: Money given to a third party to be held for payment until certain conditions are met.
  • Event of withdrawal of a general partner: means an event that causes a person to cease to be a general partner as provided in section 29-323. See Arizona Laws 29-301
  • Evidence: includes both of the following:

    (a) A display on a wireless communication device of a department-generated driver license, nonoperating identification license, vehicle registration card or other official record of the department that is presented to a law enforcement officer or in a court or an administrative proceeding. See Arizona Laws 28-101

  • Ex officio: Literally, by virtue of one's office.
  • Excise taxes: means all unrestricted excise, transaction, franchise, privilege and business taxes, state shared sales and income taxes, fees for licenses and permits and state revenue sharing that are validly imposed by a political subdivision or contributed, allocated or paid to the political subdivision and not earmarked by the contributor or the political subdivision for a contrary or inconsistent purpose. See Arizona Laws 28-7681
  • Excise taxes: means all unrestricted excise, transaction, franchise, privilege and business taxes, state shared transaction privilege and income taxes, fees for licenses and permits and state revenue sharing that are levied and paid by a political subdivision or contributed, levied or paid to the political subdivision and not earmarked by the contributor or the political subdivision for a contrary or inconsistent purpose. See Arizona Laws 28-7691
  • Executive session: A portion of the Senate's daily session in which it considers executive business.
  • Executor: A male person named in a will to carry out the decedent
  • Extradition: The formal process of delivering an accused or convicted person from authorities in one state to authorities in another state.
  • Eyelash technician: means a person who is not licensed as a cosmetologist or aesthetician and who for compensation performs personal services limited to eyelash extensions. See Arizona Laws 32-501
  • Fair market value: The price at which an asset would change hands in a transaction between a willing, informed buyer and a willing, informed seller.
  • Family: means two or more persons who are living together in the same dwelling unit and who are related to each other by blood, marriage, adoption or legal guardianship. See Arizona Laws 28-7141
  • Farm: means any lands primarily used for agriculture production. See Arizona Laws 28-101
  • Farm operation: means an activity conducted primarily for the production of one or more agricultural products or commodities, including timber for sale and home use, and customarily producing the products or commodities in sufficient quantity to be capable of contributing materially to the operator's support. See Arizona Laws 28-7141
  • Federal Deposit Insurance Corporation: A government corporation that insures the deposits of all national and state banks that are members of the Federal Reserve System. Source: OCC
  • Federal deposit insurance corporation: includes any successor to the corporation or other agency or instrumentality of the United States that undertakes to discharge the purposes of the corporation. See Arizona Laws 6-101
  • Federal Reserve System: The central bank of the United States. The Fed, as it is commonly called, regulates the U.S. monetary and financial system. The Federal Reserve System is composed of a central governmental agency in Washington, D.C. (the Board of Governors) and twelve regional Federal Reserve Banks in major cities throughout the United States. Source: OCC
  • Federal securities laws: means the securities act of 1933, the securities exchange act of 1934, the public utility holding company act of 1935 and the investment company act of 1940, as amended. See Arizona Laws 32-701
  • Fee simple: Absolute title to property with no limitations or restrictions regarding the person who may inherit it.
  • Filing entity: means an entity that is created by the filing of a public organizational document. See Arizona Laws 29-2102
  • Final disposition: means the ultimate termination of the criminal prosecution of a defendant by a trial court, including dismissal, acquittal or imposition of a sentence. See Arizona Laws 13-4401
  • Finance services: means financing for a construction services project. See Arizona Laws 28-7361
  • Financial institution: means a person who does business under any other law of this state or law of another state or the United States relating to banks, trust companies, savings and loan associations, credit unions and savings banks. See Arizona Laws 32-1001
  • Financial institution: means banks, trust companies, savings and loan associations, credit unions, consumer lenders, international banking facilities and financial institution holding companies under the jurisdiction of the department. See Arizona Laws 6-101
  • Firm: means a business organization, a sole proprietorship or an individual who is registered pursuant to section 32-731. See Arizona Laws 32-701
  • Firm: means any individual or partnership, corporation or other type of association, including the association of a nonregistrant and a registrant who offers to the public professional services regulated by the board. See Arizona Laws 32-101
  • Fiscal year: The fiscal year is the accounting period for the government. For the federal government, this begins on October 1 and ends on September 30. The fiscal year is designated by the calendar year in which it ends; for example, fiscal year 2006 begins on October 1, 2005 and ends on September 30, 2006.
  • Foreclosure: A legal process in which property that is collateral or security for a loan may be sold to help repay the loan when the loan is in default. Source: OCC
  • Foreign entity: means an entity other than a domestic entity. See Arizona Laws 29-2102
  • Foreign limited liability company: means an unincorporated entity that is formed under the law of a jurisdiction other than this state and that would be a limited liability company if the unincorporated entity were formed under the law of this state and includes a foreign series for the purposes of this article. See Arizona Laws 29-3102
  • Foreign limited liability partnership: means a partnership or limited partnership that is formed or created under laws other than the laws of this state and that is qualified as a limited liability partnership under those laws. See Arizona Laws 29-1001
  • Foreign limited partnership: means a partnership formed under the laws of any state or other jurisdiction other than this state and having as partners one or more general partners and one or more limited partners. See Arizona Laws 29-301
  • Foreign series: means a series of a foreign limited liability company that has been established as such in accordance with the law of a jurisdiction other than this state. See Arizona Laws 29-3102
  • Forgery: The fraudulent signing or alteration of another's name to an instrument such as a deed, mortgage, or check. The intent of the forgery is to deceive or defraud. Source: OCC
  • Foster child: means a child placed in a foster home or child welfare agency. See Arizona Laws 8-501
  • Foster home: means a home that is maintained by any individual or individuals having the care or control of minor children, other than those related to each other by blood or marriage, or related to such individuals, or who are legal wards of such individuals. See Arizona Laws 8-501
  • Foster parent: means any individual or individuals maintaining a foster home. See Arizona Laws 8-501
  • Fraud: Intentional deception resulting in injury to another.
  • Freeway: means a divided arterial highway on the interstate or primary system with full control of access and with grade separations at intersections. See Arizona Laws 28-7901
  • Fully autonomous vehicle: means an autonomous vehicle that is equipped with an automated driving system designed to function as a level four or five system under SAE J3016 and that may be designed to function either:

    (a) Solely by use of the automated driving system. See Arizona Laws 28-101

  • Fund: means the highway expansion and extension loan program fund established by section 28-7674. See Arizona Laws 28-7671
  • Fund: means the residential contractors' recovery fund. See Arizona Laws 32-1131
  • General partner: means a person who has been admitted to a limited partnership as a general partner in accordance with the partnership agreement and named in the certificate of limited partnership as a general partner. See Arizona Laws 29-301
  • General partner: means a partner in a partnership and a general partner in a limited partnership. See Arizona Laws 29-1001
  • Geological practice: means any professional service or work requiring geological education, training and experience, and the application of special knowledge of the earth sciences to such professional services as consultation, evaluation of mining properties, petroleum properties and groundwater resources, professional supervision of exploration for mineral natural resources including metallic and nonmetallic ores, petroleum and groundwater, and the geological phases of engineering investigations.   • Geologist: means a person, who is not required to be a professional engineer, who by reason of special knowledge of the earth sciences and the principles and methods of search for and appraisal of mineral or other natural resources acquired by professional education and practical experience is qualified to practice geology as attested by registration as a professional geologist. See Arizona Laws 32-101
  • Geologist-in-training: means a candidate for registration as a professional geologist who both:

    (a) Is a graduate of a school approved by the board or has four years or more of education or experience, or both, in geological work that meets standards specified by the board in its rules. See Arizona Laws 32-101

  • Gift: A voluntary transfer or conveyance of property without consideration, or for less than full and adequate consideration based on fair market value.
  • Good cause: means factors that temporarily prevent a registrant from satisfying a particular requirement in a specific instance as determined by the board and may include:

    (a) A disability. See Arizona Laws 32-701

  • Good faith: means honesty in fact in the conduct or transaction concerned. See Arizona Laws 29-2102
  • Governance interest: means the right under the governing statute or organizational documents of an entity, other than as a governor, agent, assignee or proxy, to do any of the following:

    (a) Receive or demand access to information concerning, or the books and records of, the entity. See Arizona Laws 29-2102

  • Governing body: means the city or town council or other authority of a city or town, the board of supervisors of a county or the transportation board. See Arizona Laws 28-7201
  • Governing statute: means , collectively, the statute or statutes governing the internal affairs of an entity. See Arizona Laws 29-2102
  • Government: means the state, any political subdivision of the state or any department, agency, board, commission, institution or governmental instrumentality of or within the state or political subdivision. See Arizona Laws 13-105
  • Governor: means a person by or under whose authority the powers of an entity are exercised and under whose direction the business and affairs of the entity are managed pursuant to the governing statute and organizational documents of the entity. See Arizona Laws 29-2102
  • Grand jury: agreement providing that a lender will delay exercising its rights (in the case of a mortgage,
  • Grant agreement: means a written agreement between the director and the United States of America or any of its departments or agencies by which the director will receive a grant to construct a project or to reimburse the director for monies spent with respect to the project. See Arizona Laws 28-7611
  • Grant anticipation notes: means notes authorized by this article. See Arizona Laws 28-7611
  • Grant revenues: means any revenues the director will receive under a grant agreement, proceeds of grant anticipation notes and income and gain from the investment of these revenues and proceeds. See Arizona Laws 28-7611
  • Grantee: includes every person to whom an estate or interest in real property passes, in or by a deed. See Arizona Laws 1-215
  • Group foster home: means a licensed regular or special foster home that is suitable for placement of more than five minor children but not more than ten minor children. See Arizona Laws 8-501
  • Guardian: A person legally empowered and charged with the duty of taking care of and managing the property of another person who because of age, intellect, or health, is incapable of managing his (her) own affairs.
  • Habeas corpus: A writ that is usually used to bring a prisoner before the court to determine the legality of his imprisonment. It may also be used to bring a person in custody before the court to give testimony, or to be prosecuted.
  • Hairstyling: means any of the following:

    (a) Cutting, clipping or trimming hair. See Arizona Laws 32-501

  • Hairstylist: means a person who is licensed to practice hairstyling pursuant to this chapter. See Arizona Laws 32-501
  • Hearsay: Statements by a witness who did not see or hear the incident in question but heard about it from someone else. Hearsay is usually not admissible as evidence in court.
  • High noise or accident potential zone: means any property located in the following zones:

    (a) For Luke air force base in Maricopa county, within the 1988 noise contours developed and recognized by the regional planning agency in that county that includes the arrival and departure corridor that is the accident potential zone one and accident potential zone two plus the land area described as follows: starting two hundred feet from the south end of the westernmost runway at a width of one thousand five hundred feet west and two thousand five hundred feet east, measured perpendicular to the centerline of the runway, and extending southwesterly parallel to the runway for a distance of thirty thousand feet. See Arizona Laws 28-8461

  • highway: means the entire width between the boundary lines of every way if a part of the way is open to the use of the public for purposes of vehicular travel. See Arizona Laws 28-101
  • Highway improvement revenues: means monies received pursuant to section 42-5032, subsection B and deposited in the highway improvement interest fund or redemption fund under section 28-7656, subsection B. See Arizona Laws 28-7651
  • Highway project: means a highway project that is on the federal aid system, national highway system or state route or state highway system and that is included in the department's state highway construction plan or the transportation improvement plan of a regional association of governments, except that a highway project does not include any local street improvements. See Arizona Laws 28-7681
  • Highway project advance agreement: means a written agreement entered into in accordance with section 28-7677 and either Section 9-500. See Arizona Laws 28-7681
  • Highway project advance revenues: means any revenues a political subdivision receives under a highway project advance agreement, or as proceeds of highway project advancement notes, together with any earnings from the investment of the revenues. See Arizona Laws 28-7681
  • Highway project advancement notes: means notes authorized by this article. See Arizona Laws 28-7681
  • Home inspection: means a visual analysis for the purposes of providing a professional opinion of the building, any reasonably accessible installed components and the operation of the building's systems, including the controls normally operated by the owner, for the following components of a residential building of four units or less:

    (a) Heating system. See Arizona Laws 32-101

  • Home inspection report: means a written report that is prepared for compensation, that is issued after a home inspection and that clearly describes and identifies the inspected systems, structures and components of a completed dwelling and any visible major defects found to be in need of immediate major repair and any recommendations for additional evaluation by appropriate persons. See Arizona Laws 32-101
  • Home inspector: means an individual who is certified pursuant to this chapter as a home inspector and who engages in the business of performing home inspections and writing home inspection reports. See Arizona Laws 32-101
  • Home state: means the state that has granted the bank its charter, permit or license to operate. See Arizona Laws 6-101
  • Human driver: means a natural person in the vehicle who performs in real time all or part of the dynamic driving task or who achieves a minimal risk condition for the vehicle. See Arizona Laws 28-101
  • Immediate family: means a victim's spouse, parent, child, sibling, grandparent or lawful guardian. See Arizona Laws 13-4401
  • Impeachment: (1) The process of calling something into question, as in "impeaching the testimony of a witness." (2) The constitutional process whereby the House of Representatives may "impeach" (accuse of misconduct) high officers of the federal government for trial in the Senate.
  • Improved real estate: means real estate which is, or which from the proceeds of the loan will become, a home, combination of home and business property or other improved real estate. See Arizona Laws 6-401
  • In-home intervention: means a program of services provided pursuant to article 14 of this chapter while the child is still in the custody of the parent, guardian or custodian. See Arizona Laws 8-801
  • In-state financial institution: means a state or federal bank, savings bank, savings and loan association or holding company with its home office located in this state. See Arizona Laws 6-101
  • In-state financial institution: means a state or national bank or savings and loan association with its home office in this state, or holding company with its home office in this state. See Arizona Laws 6-211
  • In-state financial institution: means a state or federal bank, savings bank or savings and loan association with its home office in this state, or holding company with its home office in this state. See Arizona Laws 6-321
  • Incompetent to stand trial: means that as a result of a mental illness, defect or disability a defendant is unable to understand the nature and object of the proceeding or to assist in the defendant's defense. See Arizona Laws 13-4501
  • Indemnification: In general, a collateral contract or assurance under which one person agrees to secure another person against either anticipated financial losses or potential adverse legal consequences. Source: FDIC
  • Independent living program: includes a residential program with supervision of less than twenty-four hours a day. See Arizona Laws 8-201
  • Indian tribe: means any Indian tribe, band, group or community that is recognized by the United States secretary of the interior and that exercises governmental authority within the limits of any Indian reservation under the jurisdiction of the United States government, notwithstanding the issuance of any patent and including rights-of-way running through the reservation. See Arizona Laws 28-7671
  • Individual: means a person who is not a member of a family. See Arizona Laws 28-7141
  • Individual-owned shared vehicle: means one of the following:

    (a) If the shared vehicle is purchased in this state, a shared vehicle for which the owner certifies that the transaction privilege tax was paid on the purchase of the shared vehicle. See Arizona Laws 28-9601

  • Initiation of negotiations: means the date the department first makes personal contact with the owner or the owner's personal representative of the property sought to be acquired if the price to be paid for the property is discussed. See Arizona Laws 28-7141
  • Injunction: An order of the court prohibiting (or compelling) the performance of a specific act to prevent irreparable damage or injury.
  • Instructor: means a person who is licensed to teach barbering pursuant to this chapter. See Arizona Laws 32-301
  • Instructor: means a person who is licensed to teach cosmetology, aesthetics, nail technology or hairstyling, or any combination thereof, pursuant to this chapter. See Arizona Laws 32-501
  • Insurance corporation: means the federal deposit insurance corporation or such other instrumentality of, or corporation chartered by, the United States as may be established for the purpose of insuring the accounts of savings and loan associations or any other equivalent deposit insurer approved by the deputy director. See Arizona Laws 6-401
  • Inter vivos: Transfer of property from one living person to another living person.
  • Interest: means a governance interest or a transferable interest, including a share or membership in a corporation. See Arizona Laws 29-2102
  • Interest exchange: means a transaction authorized by article 3 of this chapter. See Arizona Laws 29-2102
  • Interest holder: means a direct holder of an interest. See Arizona Laws 29-2102
  • Interest holder liability: means :

    (a) Personal liability for an obligation of an entity that is imposed on a person either:

    (i) Solely by reason of the status of the person as an interest holder. See Arizona Laws 29-2102

  • Interest rate: The amount paid by a borrower to a lender in exchange for the use of the lender's money for a certain period of time. Interest is paid on loans or on debt instruments, such as notes or bonds, either at regular intervals or as part of a lump sum payment when the issue matures. Source: OCC
  • Intergovernmental agreement: means an agreement or contract that meets the requirements of Title 11, Chapter 7, Article 3. See Arizona Laws 28-9101
  • Interrogatories: Written questions asked by one party of an opposing party, who must answer them in writing under oath; a discovery device in a lawsuit.
  • Investment: means to put funds to use in order to secure profits. See Arizona Laws 6-401
  • Ionizing radiation: means gamma rays and x-rays, alpha and beta particles, high speed electrons, neutrons, protons and other nuclear particles or rays. See Arizona Laws 30-651
  • Job-order-contracting: means a project delivery method in which:

    (a) The contract is for indefinite quantities of construction and, at the election of the department, may or may not include a guaranteed minimum amount of work. See Arizona Laws 28-7361

  • Joint committee: Committees including membership from both houses of teh legislature. Joint committees are usually established with narrow jurisdictions and normally lack authority to report legislation.
  • Joint tenancy: A form of property ownership in which two or more parties hold an undivided interest in the same property that was conveyed under the same instrument at the same time. A joint tenant can sell his (her) interest but not dispose of it by will. Upon the death of a joint tenant, his (her) undivided interest is distributed among the surviving joint tenants.
  • Judgement: The official decision of a court finally determining the respective rights and claims of the parties to a suit.
  • Junk: means :

    (a) Old or scrap copper, brass, rope, rags, batteries, paper, trash, rubber debris or waste. See Arizona Laws 28-7941

  • Junkyard: means an establishment or place of business maintained, used or operated for storing, keeping, buying or selling junk or for maintaining or operating an automobile graveyard, including garbage dumps and sanitary landfills. See Arizona Laws 28-7941
  • Jurisdiction: means , for the purposes of examination, certification, firm registration or limited reciprocity privilege, the fifty states of the United States, the District of Columbia, the United States Virgin Islands, Guam, the Commonwealth of the Northern Mariana Islands or the Commonwealth of Puerto Rico. See Arizona Laws 32-701
  • Jurisdiction: when used to refer to a political entity, means the United States, a state, a foreign country or a political subdivision of a foreign country. See Arizona Laws 29-3102
  • Jurisdiction of formation: means the jurisdiction whose law governs the internal affairs of an entity. See Arizona Laws 29-3102
  • Jurisdiction of organization: means the jurisdiction whose law includes the governing statute of the entity. See Arizona Laws 29-2102
  • Jurisprudence: The study of law and the structure of the legal system.
  • Juvenile court: means the juvenile division of the superior court. See Arizona Laws 8-531
  • Juvenile court: means the juvenile division of the superior court when exercising its jurisdiction over children in any proceeding relating to delinquency, dependency or incorrigibility. See Arizona Laws 8-201
  • Knowingly: means , with respect to conduct or to a circumstance described by a statute defining an offense, that a person is aware or believes that the person's conduct is of that nature or that the circumstance exists. See Arizona Laws 13-105
  • Land surveying practice: means performing one or more of the following professional services:

    (a) Measuring land to determine the position of any monument or reference point that marks a property line, boundary or corner for the purpose of determining the area or description of the land. See Arizona Laws 32-101

  • Land surveyor: means a person who by reason of knowledge of the mathematical and physical sciences, principles of land surveying and evidence gathering acquired by professional education or practical experience, or both, is qualified to practice land surveying as attested by registration as a land surveyor. See Arizona Laws 32-101
  • Land surveyor-in-training: means a candidate for registration as a professional land surveyor who both:

    (a) Is a graduate of a school and curriculum approved by the board or has four years or more of education or experience, or both, in land surveying work that meets standards specified by the board in its rules. See Arizona Laws 32-101

  • Landscape architect: means a person who, by reason of professional education or practical experience, or both, is qualified to engage in the practice of landscape architecture as attested by registration as a landscape architect. See Arizona Laws 32-101
  • Landscape architect services: means those professional landscape architect services that are within the scope of landscape architectural practice as provided in Title 32, Chapter 1. See Arizona Laws 28-7361
  • Law enforcement officer: means a peace officer, sheriff, deputy sheriff, municipal police officer or constable. See Arizona Laws 8-201
  • Lawful representative: means a person who is designated by the victim or appointed by the court and who acts in the best interests of the victim. See Arizona Laws 13-4401
  • Lawsuit: A legal action started by a plaintiff against a defendant based on a complaint that the defendant failed to perform a legal duty, resulting in harm to the plaintiff.
  • Lease: A contract transferring the use of property or occupancy of land, space, structures, or equipment in consideration of a payment (e.g., rent). Source: OCC
  • Leg: means that part of the lower limb between the knee and the foot. See Arizona Laws 32-801
  • legal custody: means a status embodying all of the following rights and responsibilities:

    (a) The right to have physical possession of the child. See Arizona Laws 8-531

  • Letter of concern: means an advisory letter to notify a registrant that, while the evidence does not warrant disciplinary action, the board believes that the registrant should modify or eliminate certain practices and that continuation of the activities that led to the evidence being submitted to the board may result in board action against the registrant. See Arizona Laws 32-701
  • Letter of concern: means an advisory letter to notify a podiatrist that while there is insufficient evidence to support a disciplinary action the board believes the podiatrist should modify or eliminate certain practices and that continuation of the activities that led to the information being submitted to the board may result in action against the podiatrist's license. See Arizona Laws 32-801
  • Liabilities: The aggregate of all debts and other legal obligations of a particular person or legal entity.
  • License: means a license to practice podiatry. See Arizona Laws 32-801
  • License: means a license to practice chiropractic. See Arizona Laws 32-900
  • License: means an authorization for the person who is listed on the electronic, paper or other records maintained by the registrar to act in the capacity of a contractor. See Arizona Laws 32-1101
  • License: means a license, a certificate of registration or any other evidence of the satisfaction of the requirements of a licensing authority for the practice of a professional service. See Arizona Laws 29-4101
  • Licensed person: means a person who is duly licensed by at least one licensing authority to provide at least one of the categories of professional services rendered by the professional limited liability company. See Arizona Laws 29-4101
  • Licensing authority: means the officer, board, agency, court or other authority empowered by law to license or otherwise authorize the rendition of a professional service. See Arizona Laws 29-4101
  • Lien: A claim against real or personal property in satisfaction of a debt.
  • Limited liability partnership: means a partnership or limited partnership that has filed a statement of qualification under section 29-1101. See Arizona Laws 29-1001
  • Limited partner: means a person who has been admitted to a limited partnership as a limited partner in accordance with the partnership agreement. See Arizona Laws 29-301
  • Limited partner: means a limited partner in a limited partnership. See Arizona Laws 29-1001
  • Limited partnership: means a limited partnership created under chapter 3 of this title, predecessor law or comparable law of another jurisdiction. See Arizona Laws 29-1001
  • Limited reciprocity privilege: means the permission to practice as a certified public accountant in this state pursuant to section 32-725 for an individual whose principal place of business is outside of this state. See Arizona Laws 32-701
  • Limousine: means a motor vehicle providing prearranged ground transportation service for an individual passenger, or a group of passengers, that is arranged in advance or is operated on a regular route or between specified points and includes ground transportation under a contract or agreement for services that includes a fixed rate or time and is provided in a motor vehicle with a seating capacity not exceeding fifteen passengers including the driver. See Arizona Laws 28-101
  • Litigation: A case, controversy, or lawsuit. Participants (plaintiffs and defendants) in lawsuits are called litigants.
  • Livery vehicle: means a motor vehicle that:

    (a) Has a seating capacity not exceeding fifteen passengers including the driver. See Arizona Laws 28-101

  • Loan repayment agreement: means one or more loan agreements, instruments or other agreements providing for repayment of a loan or other financial assistance and entered into by this state or its agencies, including the department, or a political subdivision or Indian tribe. See Arizona Laws 28-7671
  • Local authority: means any county, municipal or other local board or body exercising jurisdiction over highways under the constitution and laws of this state. See Arizona Laws 28-101
  • Local governing board: means town council, city council or board of supervisors, or any combination thereof. See Arizona Laws 31-331
  • Longitudinal access: means access to or use of any part of a right-of-way of a highway that extends generally parallel to the right-of-way for a total of thirty or more linear meters. See Arizona Laws 28-7381
  • Low-voltage electric fence: means a fence that meets all of the following requirements:

    (a) Has an electric fence energizer that is powered by a commercial storage battery with a rated voltage of not more than twelve volts and that produces an electric charge on contact with the fence. See Arizona Laws 32-101

  • Magistrate: means an officer having power to issue a warrant for the arrest of a person charged with a public offense and includes the chief justice and justices of the supreme court, judges of the superior court, judges of the court of appeals, justices of the peace and judges of a municipal court. See Arizona Laws 1-215
  • Maintenance services: means routine maintenance, repair and replacement of existing facilities, structures, buildings or real property. See Arizona Laws 28-7361
  • Majority in interest of the members: means , at any particular time, one or more members that hold in the aggregate a majority of the interests in the limited liability company's profits held at that time by all members, disregarding any profit interests held by persons that are not members. See Arizona Laws 29-3102
  • Management advisory services: means advisory services consisting of the development of findings, conclusions or recommendations for the recipient's consideration and decision making. See Arizona Laws 32-701
  • Manager: means a person that under the operating agreement of a manager-managed limited liability company is responsible, alone or in concert with others, for performing the management functions stated in section 29-3407, subsection C. See Arizona Laws 29-3102
  • Manager-managed limited liability company: means a limited liability company that qualifies under section 29-3407, subsection A. See Arizona Laws 29-3102
  • Member: means a person that both:

    (a) Has become a member of a limited liability company under section 29-3401 or was a member in a company when the company became subject to this chapter under section 29-3110. See Arizona Laws 29-3102

  • Member-managed limited liability company: means a limited liability company that is not a manager-managed limited liability company. See Arizona Laws 29-3102
  • Mental health expert: means a physician who is licensed pursuant to Title 32, Chapter 13 or 17 or a psychologist who is licensed pursuant to Title 32, Chapter 19. See Arizona Laws 13-4501
  • Mentor: means a barber who is approved by the board to train a person in a department of economic security-approved apprenticeship program in barbering in an establishment that is licensed by the board. See Arizona Laws 32-301
  • Mentor: means a cosmetologist who is approved by the board to train a person in a department of economic security-approved apprenticeship program in cosmetology in an establishment that is licensed by the board. See Arizona Laws 32-501
  • Merger: includes consolidation. See Arizona Laws 6-401
  • Merger: means a transaction authorized by article 2 of this chapter. See Arizona Laws 29-2102
  • Merger: includes consolidation. See Arizona Laws 6-211
  • Merging entity: means an entity that is a party to a merger and that exists immediately before the merger becomes effective. See Arizona Laws 29-2102
  • Military airport: means an airport that is operated by an armed force of the United States and that is primarily used for military fixed wing aircraft operations, excluding a runway or airstrip that is not immediately adjacent to facilities primarily used for operational control, maintenance and permanent parking of aircraft. See Arizona Laws 28-8461
  • Military reservation or facility: means any land or facility that is owned or leased by or designated to the Arizona national guard. See Arizona Laws 13-5001
  • Military training route: means a low level military route that allows department of defense aircraft to conduct flights that may be as low as one hundred feet above the ground at speeds in excess of two hundred fifty knots indicated air speed as delineated in the military training route map pursuant to section 37-102. See Arizona Laws 28-8461
  • Minor children: means persons under eighteen years of age. See Arizona Laws 1-215
  • Mobile identification number: means the cellular or wireless telephone number that the cellular or wireless telephone carrier assigns to the wireless telephone. See Arizona Laws 13-4801
  • Monitored alarm: means a device that is designed to detect an entry on any premises and that if activated generates a notification signal. See Arizona Laws 32-101
  • Month: means a calendar month unless otherwise expressed. See Arizona Laws 1-215
  • Moral turpitude: means an offense, whether a misdemeanor or felony, that is related to extortion, burglary, larceny, bribery, embezzlement, robbery, racketeering, money laundering, forgery, fraud, murder, voluntary manslaughter or a sexual offense that requires the individual to register pursuant to section 13-3821. See Arizona Laws 1-215
  • Mortgage: The written agreement pledging property to a creditor as collateral for a loan.
  • Motor vehicle: means any self-propelled vehicle. See Arizona Laws 13-4701
  • Municipality: means an incorporated city or town. See Arizona Laws 28-9101
  • Nail technician: means a person who is licensed to practice nail technology pursuant to this chapter. See Arizona Laws 32-501
  • Nail technology: means any of the following:

    (a) Cutting, trimming, polishing, coloring, tinting, cleansing or otherwise treating a person's nails. See Arizona Laws 32-501

  • Named on a license: means required to be identified pursuant to section 32-1122, subsection B. See Arizona Laws 32-1101
  • National Bank: A bank that is subject to the supervision of the Comptroller of the Currency. The Office of the Comptroller of the Currency is a bureau of the U.S. Treasury Department. A national bank can be recognized because it must have "national" or "national association" in its name. Source: OCC
  • National bank: means a national banking association located in this state. See Arizona Laws 6-211
  • National Credit Union Administration: The federal regulatory agency that charters and supervises federal credit unions. (NCUA also administers the National Credit Union Share Insurance Fund, which insures the deposits of federal credit unions.) Source: OCC
  • neglected: means :

    (a) The inability or unwillingness of a parent, guardian or custodian of a child to provide that child with supervision, food, clothing, shelter or medical care if that inability or unwillingness causes substantial risk of harm to the child's health or welfare, except if the inability of a parent, guardian or custodian to provide services to meet the needs of a child with a disability or chronic illness is solely the result of the unavailability of reasonable services. See Arizona Laws 8-201

  • Newborn infant: means a child who is under thirty days of age. See Arizona Laws 8-201
  • Nonprofit corporation: means a nonprofit corporation, a cooperative marketing association, an electric cooperative nonprofit membership corporation, a nonprofit electric generation and transmission cooperative corporation, a fraternal or benevolent society or a corporation sole. See Arizona Laws 29-2102
  • Nonresident: means a person who is not a resident of this state as defined in section 28-2001. See Arizona Laws 28-101
  • Nonserious violation: means a violation that may have had a direct or immediate relationship to safety, health or property damage, but which does not constitute a de minimis violation or a serious violation, unless the violator did not, and could not with the exercise of reasonable diligence, know of such safety, health or property damage risk in which case the violation is de minimis. See Arizona Laws 3-361
  • Notice of payment due: means the written notice to pay the required tolls and administrative charges for vehicular use of a toll facility. See Arizona Laws 28-7751
  • Notice of toll evasion: means the second written notice of failure to pay a required payment as described in section 28-7759 that is delivered after notice of payment due is delivered. See Arizona Laws 28-7751
  • Oath: includes an affirmation or declaration. See Arizona Laws 1-215
  • Oath: A promise to tell the truth.
  • Obligation: means a primary or contingent liability for the payment of money. See Arizona Laws 6-351
  • Obligation: means a debt, loss or liability or any other obligation arising in any manner, regardless of whether it is secured, contingent or liquidated. See Arizona Laws 29-2102
  • Obligation: An order placed, contract awarded, service received, or similar transaction during a given period that will require payments during the same or a future period.
  • On-demand autonomous vehicle network: means a passenger transportation network that uses a digital network or software application to connect passengers to fully autonomous vehicles for transportation, exclusively or in addition to other vehicles, including transportation for hire and transportation for compensation. See Arizona Laws 28-9701
  • Operating agreement: means the agreement, whether or not referred to as an operating agreement and whether oral, implied, in a record or in any combination thereof, of all the members of a limited liability company, including a sole member, concerning the matters described in section 29-3105, subsection A. See Arizona Laws 29-3102
  • Operating units: means districts, state agencies, federal Indian agencies, cities and towns. See Arizona Laws 30-101
  • Operation: means adjustments or procedures by the user required for the equipment to perform its intended functions. See Arizona Laws 30-651
  • Operations services: means routine operation of existing facilities, structures, buildings or real property. See Arizona Laws 28-7361
  • Operator: means a person who drives a motor vehicle on a highway, who is in actual physical control of a motor vehicle on a highway or who is exercising control over or steering a vehicle being towed by a motor vehicle. See Arizona Laws 28-101
  • Organizational documents: means the public organizational document and private organizational documents of an entity. See Arizona Laws 29-2102
  • Organize: means to incorporate, form, create or otherwise organize. See Arizona Laws 29-2102
  • Organizer: means a person that acts under section 29-3201 to form a limited liability company. See Arizona Laws 29-3102
  • Out-of-home placement: means the placing of a child in the custody of an individual or agency other than with the child's parent or legal guardian and includes placement in temporary custody pursuant to section 8-821, voluntary placement pursuant to section 8-806 or placement due to dependency actions. See Arizona Laws 8-501
  • Out-of-state bank: means a bank, savings bank or savings and loan association that is approved by the deputy director pursuant to section 6-322 and that has a charter, a permit or any other license to operate that is issued by a state other than this state. See Arizona Laws 6-101
  • Out-of-state financial institution: means a state or federal bank, savings bank, savings and loan association or holding company with its home office in a state other than this state. See Arizona Laws 6-101
  • Out-of-state financial institution: means a state or national bank or savings and loan association with its home office in a state other than this state, or holding company with its home office in a state other than this state. See Arizona Laws 6-211
  • Out-of-state financial institution: means a state or federal bank, savings bank or savings and loan association with its home office in a state other than this state, or holding company with its home office in a state other than this state. See Arizona Laws 6-321
  • Outdoor advertising: means any outdoor sign, display, light, device, figure, painting, drawing, message, plaque, poster, billboard or other thing that is designed, intended or used to advertise or inform and the message of which is visible from any place on the main traveled way of the interstate, secondary or primary systems. See Arizona Laws 28-7901
  • Oversight: Committee review of the activities of a Federal agency or program.
  • Owner: means :

    (a) A person who holds the legal title of a vehicle. See Arizona Laws 28-101

  • owners of record: includes a person, firm, partnership, association or corporation. See Arizona Laws 28-7201
  • Parent: means the natural or adoptive mother or father of a child. See Arizona Laws 8-501
  • Parent: means the natural or adoptive mother or father of a child. See Arizona Laws 8-531
  • Parent-child relationship: includes all rights, privileges, duties and obligations existing between parent and child, including inheritance rights. See Arizona Laws 8-531
  • Parties: includes the child, the petitioners and any parent of the child required to consent to the adoption pursuant to section 8-106. See Arizona Laws 8-531
  • Partner: means a limited or general partner. See Arizona Laws 29-301

  • Partnership: means an association or entity formed under section 29-1012, a predecessor law or a comparable law of another jurisdiction. See Arizona Laws 29-1001
  • Partnership: A voluntary contract between two or more persons to pool some or all of their assets into a business, with the agreement that there will be a proportional sharing of profits and losses.
  • Partnership agreement: means any valid agreement, written or oral, of the partners as to the affairs of a limited partnership and the conduct of its business. See Arizona Laws 29-301
  • Partnership agreement: means the agreement, whether written, oral or implied, among the partners concerning the partnership, including amendments to the partnership agreement. See Arizona Laws 29-1001
  • Partnership at will: means a partnership in which the partners have not agreed to remain partners until the expiration of a definite term or the completion of a particular undertaking. See Arizona Laws 29-1001
  • Partnership interest: means a partner's share of the profits and losses of a limited partnership and the right to receive distributions of partnership assets. See Arizona Laws 29-301
  • Passenger: includes a person who rides in aircraft but has no part in its operation. See Arizona Laws 28-8201
  • Peace officers: means sheriffs of counties, constables, marshals, policemen of cities and towns, commissioned personnel of the department of public safety, personnel who are employed by the state department of corrections and the department of juvenile corrections and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a multicounty water conservation district and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by community college district governing boards and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the Arizona board of regents and who have received a certificate from the Arizona peace officer standards and training board, police officers who are appointed by the governing body of a public airport pursuant to section 28-8426 and who have received a certificate from the Arizona peace officer standards and training board, peace officers who are appointed by a private postsecondary institution pursuant to section 15-1897 and who have received a certificate from the Arizona peace officer standards and training board and special agents from the office of the attorney general, or of a county attorney, and who have received a certificate from the Arizona peace officer standards and training board.   • Pedestrian: means any person afoot. See Arizona Laws 28-101

  • Petition: means a written statement of the essential facts that allege delinquency, incorrigibility or dependency. See Arizona Laws 8-201
  • physical escort: means temporarily touching or holding a child's hand, wrist, arm, shoulder or back to induce the child to walk to a safe location. See Arizona Laws 8-501
  • Physical force: means force used upon or directed toward the body of another person and includes confinement, but does not include deadly physical force. See Arizona Laws 13-105
  • Physical medicine modalities: means any physical agent applied to produce therapeutic change to biologic tissues, including thermal, acoustic, noninvasive light, mechanical or electric energy, hot or cold packs, ultrasound, galvanism, microwave, diathermy and electrical stimulation. See Arizona Laws 32-900
  • Plaintiff: The person who files the complaint in a civil lawsuit.
  • Plan: means a plan of merger, interest exchange, conversion, domestication or division, as applicable. See Arizona Laws 29-368

  • Pleadings: Written statements of the parties in a civil case of their positions. In the federal courts, the principal pleadings are the complaint and the answer.
  • Podiatric medical assistant: means an unlicensed person who has completed an education program approved by the board, who assists in a podiatric medical practice under the supervision of a podiatrist and who performs delegated procedures commensurate with the assistant's education and training but who does not diagnose, interpret, design or modify established treatment programs or perform any functions that would violate any statute applicable to the practice of podiatric medicine.   • Podiatrist: is synonymous with podiatric physician and surgeon and means a person who, within the limits of this chapter, is registered and licensed to practice podiatry by means of performing full body physical examinations within the profession's scope of practice and diagnosing or medically, surgically, mechanically, manipulatively or electrically treating ailments of the human foot and leg but not amputating the leg or entire foot or administering an anesthetic other than local.   • Podiatry: is synonymous with chiropody and means diagnosing or medically, surgically, mechanically, manipulatively or electrically treating ailments of the human foot and leg but not amputating the leg or entire foot or administering an anesthetic other than local. See Arizona Laws 32-801
  • Political subdivision: means a county, city, town or special taxing district authorized by law to construct or assist in the construction of an eligible highway project or a county, city, town or special taxing district established pursuant to section 48-5102 to construct or assist in the construction of a transportation project.   • Political subdivision: means a county, city or town. See Arizona Laws 28-7681

  • Post-conviction release: means parole, work furlough, community supervision, probation if the court waived community supervision pursuant to section 13-603, home arrest or any other permanent, conditional or temporary discharge from confinement in the custody of the state department of corrections or a sheriff or from confinement in a municipal jail or a secure mental health facility.   • Post-conviction relief proceeding: means a contested argument or evidentiary hearing that is held in open court and that involves a request for relief from a conviction or sentence. See Arizona Laws 13-4401
  • Power: means electric power or electric energy, or both. See Arizona Laws 30-101
  • Power of attorney: A written instrument which authorizes one person to act as another's agent or attorney. The power of attorney may be for a definite, specific act, or it may be general in nature. The terms of the written power of attorney may specify when it will expire. If not, the power of attorney usually expires when the person granting it dies. Source: OCC
  • Practice of accounting: means providing accounting services for a client or an employer. See Arizona Laws 32-701
  • Precedent: A court decision in an earlier case with facts and law similar to a dispute currently before a court. Precedent will ordinarily govern the decision of a later similar case, unless a party can show that it was wrongly decided or that it differed in some significant way.
  • Preconstruction services: means services and other activities during the design phase. See Arizona Laws 28-7361
  • premises: includes :

    (i) Buildings. See Arizona Laws 28-7901

  • Presiding officer: A majority-party Senator who presides over the Senate and is charged with maintaining order and decorum, recognizing Members to speak, and interpreting the Senate's rules, practices and precedents.
  • Pretrial conference: A meeting of the judge and lawyers to discuss which matters should be presented to the jury, to review evidence and witnesses, to set a timetable, and to discuss the settlement of the case.
  • Prevention: means the creation of conditions, opportunities and experiences that encourage and develop healthy, self-sufficient children and that occur before the onset of problems. See Arizona Laws 8-201
  • Primary capital: means the aggregate of the following:

    (a) Common and perpetual preferred stock. See Arizona Laws 6-351

  • Primary system: means that portion of connected main highways located in this state that are officially designated by the board and approved by the United States secretary of transportation pursuant to 23 United States Code. See Arizona Laws 28-7901
  • Primary system: means that portion of connected main highways located in this state that are officially designated by the board and approved by the United States secretary of transportation pursuant to 23 United States Code. See Arizona Laws 28-7941
  • Principal: means an individual who is an officer of the corporation or is designated by a firm as having full authority and responsible charge of the services offered by the firm. See Arizona Laws 32-101
  • Principal address: means the mailing address of a limited liability company or foreign limited liability company, whether or not located in this state. See Arizona Laws 29-3102
  • Prior act: means any statute of this state that, before June 25, 1960, has governed the formation or operation of associations of the type described in the section of this chapter concerning scope of the chapter. See Arizona Laws 6-401
  • Prisoner: means a person who has been convicted of a criminal offense against a victim and who has been sentenced to the custody of the sheriff, the state department of corrections, a municipal jail or a secure mental health facility. See Arizona Laws 13-4401
  • Prisoner: means a person incarcerated in a detention facility who has been charged with or convicted of a misdemeanor, or a person incarcerated for nonpayment of a fine, for contempt or as a condition of probation for any criminal offense. See Arizona Laws 31-331
  • Private partner: means a person, entity or organization that is not the federal government, this state, a political subdivision of this state or a unit of government. See Arizona Laws 28-7701
  • Probable cause: A reasonable ground for belief that the offender violated a specific law.
  • Professional engineer: means a person who, by reason of special knowledge of the mathematical and physical sciences and the principles and methods of engineering analysis and design acquired by professional education and practical experience, is qualified to practice engineering and is registered as a professional engineer pursuant to this chapter. See Arizona Laws 32-101
  • Professional limited liability company: means a limited liability company organized under this chapter for purposes that include rendering one or more categories of professional services. See Arizona Laws 29-4101
  • Professional service: means a service that may be lawfully rendered only by a licensed person or person otherwise authorized by a licensing authority to render the service. See Arizona Laws 29-4101
  • Profits: means , as determined by the application of proper accounting principles, gross income less the aggregate of operating and other expenses, losses actually sustained and not charged to reserves under this chapter and interest paid or accrued on borrowings and non-recurring charges. See Arizona Laws 6-401
  • Property: means all property, real, personal or mixed, tangible or intangible, or any interest in such property. See Arizona Laws 29-1001
  • Property: includes both real and personal property. See Arizona Laws 1-215
  • Property: means all property, whether real, personal or mixed or tangible or intangible, or any right or interest therein. See Arizona Laws 29-3102
  • Proprietor alarm: means any alarm or alarm system that is owned by an alarm subscriber who has not contracted with an alarm business. See Arizona Laws 32-101
  • Prosecute: To charge someone with a crime. A prosecutor tries a criminal case on behalf of the government.
  • Protected agreement: means any of the following:

    (a) A record evidencing indebtedness and any related agreement in effect on the effective date of this section. See Arizona Laws 29-2102

  • Protective supervision: means supervision that is ordered by the juvenile court of children who are found to be dependent or incorrigible. See Arizona Laws 8-201
  • Public law: A public bill or joint resolution that has passed both chambers and been enacted into law. Public laws have general applicability nationwide.
  • Public transportation: means local transportation of passengers by means of a public conveyance. See Arizona Laws 28-9101
  • Public-private agreement: means an agreement entered into pursuant to article 1 of this chapter. See Arizona Laws 28-7751
  • published: means printed in the English language in a newspaper of general circulation published in the community in which the association's business office is located or if no such newspaper exists in said community then in the county in which such business office is located. See Arizona Laws 6-401
  • Qualified distributors: means persons and operating units. See Arizona Laws 30-101
  • Qualified foreign entity: means a foreign entity that is authorized to transact business in this state pursuant to a filing with the appropriate filing authority. See Arizona Laws 29-2102
  • Qualified purchasers: means persons and operating units privileged under this chapter to purchase power developed on the main stream of the Colorado river. See Arizona Laws 30-101
  • Qualified young adult: means a former dependent child who is at least eighteen years of age and not over twenty-one years of age, who meets the criteria for an extended foster care program pursuant to Section 8-521. See Arizona Laws 8-201
  • Qualifying party: means a person who is responsible for a licensee's actions and conduct performed under the license and who either:

    (a) Has an ownership interest in the license. See Arizona Laws 32-1101

  • Quorum: The number of legislators that must be present to do business.
  • Radiation: means :

    (a) Ionizing radiation, including gamma rays, x-rays, alpha and beta particles, high speed electrons, neutrons, protons and other nuclear particles or rays. See Arizona Laws 30-651

  • Radiation machine: means any manufactured devices or products producing any of the following:

    (a) X-rays for medical, industrial, research and development or educational purposes. See Arizona Laws 30-651

  • Radioactive material: means any material or materials, solid, liquid or gaseous, that emit radiation spontaneously. See Arizona Laws 30-651
  • Real property: Land, and all immovable fixtures erected on, growing on, or affixed to the land.
  • Reason for leaving care: means one of the following:

    (a) Reunification with a parent or primary caretaker. See Arizona Laws 8-501

  • Receiving foster home: means a licensed foster home that is suitable for immediate placement of children when taken into custody or pending medical examination and court disposition. See Arizona Laws 8-501
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and is retrievable in perceivable form. See Arizona Laws 29-2102
  • Record: means information that is inscribed on a tangible medium or that is stored in an electronic or other medium and that is retrievable in a perceivable form. See Arizona Laws 29-3102
  • Recourse: An arrangement in which a bank retains, in form or in substance, any credit risk directly or indirectly associated with an asset it has sold (in accordance with generally accepted accounting principles) that exceeds a pro rata share of the bank's claim on the asset. If a bank has no claim on an asset it has sold, then the retention of any credit risk is recourse. Source: FDIC
  • Referral: means a report that is submitted to the juvenile court and that alleges that a child is dependent or incorrigible or that a juvenile has committed a delinquent or criminal act. See Arizona Laws 8-201
  • Registered foreign series: means a foreign series that is registered to do business in this state pursuant to a statement of registration filed by the commission. See Arizona Laws 29-3102
  • Registered mail: includes certified mail. See Arizona Laws 1-215
  • Registrant: means any certified public accountant or firm that is registered with the board. See Arizona Laws 32-701
  • Registrant: means a person who is registered or certified by the board. See Arizona Laws 32-101
  • Registrar: means the registrar of contractors. See Arizona Laws 32-1101
  • Registration: means a registration or certification that is issued by the board. See Arizona Laws 32-101
  • Regular foster home: means a licensed foster home that is suitable for placement of not more than five minor children. See Arizona Laws 8-501
  • Related courses: means :

    (a) Business administration. See Arizona Laws 32-701

  • Relative: means a grandparent, great-grandparent, brother or sister of whole or half blood, aunt, uncle or first cousin. See Arizona Laws 8-501
  • Release: means no longer in the custody of a custodial agency and includes transfer from one custodial agency to another custodial agency. See Arizona Laws 13-4401
  • Remand: When an appellate court sends a case back to a lower court for further proceedings.
  • Reporter: Makes a record of court proceedings and prepares a transcript, and also publishes the court's opinions or decisions (in the courts of appeals).
  • Request to intervene: means a notification by an automated driving system to a human driver that the human driver should promptly begin or resume performance of part or all of the dynamic driving task. See Arizona Laws 28-9701
  • Rescission: The cancellation of budget authority previously provided by Congress. The Impoundment Control Act of 1974 specifies that the President may propose to Congress that funds be rescinded. If both Houses have not approved a rescission proposal (by passing legislation) within 45 days of continuous session, any funds being withheld must be made available for obligation.
  • Residential contractor: means a contractor as defined in section 32-1101 who is licensed to perform work on residential property pursuant to this chapter and who engages in residential contracting. See Arizona Laws 32-1131
  • Restitution: The court-ordered payment of money by the defendant to the victim for damages caused by the criminal action.
  • Restrictive behavior management: means an intervention or procedure that attempts to guide, redirect, modify or manage behavior through the use of any of the following:

    (a) Physical force to cause a child to comply with a directive. See Arizona Laws 8-501

  • Resulting bank: means the bank resulting from a merger or conversion. See Arizona Laws 6-211
  • Retail: means sales to others than persons or operating units. See Arizona Laws 30-101
  • Retail electric customer: means a person that purchases electricity for that person's own use, including use in that person's trade or business, and not for resale, redistribution or retransmission. See Arizona Laws 30-801
  • Right of survivorship: The ownership rights that result in the acquisition of title to property by reason of having survived other co-owners.
  • Right-of-way: when used within the context of the regulation of the movement of traffic on a highway means the privilege of the immediate use of the highway. See Arizona Laws 28-101
  • Rights: means any right that is granted to the victim by the laws of this state. See Arizona Laws 13-4401
  • Roadway: includes all or part of a platted or designated public street, highway, alley, lane, parkway, avenue, road, sidewalk or other public way, whether or not it has been used as such. See Arizona Laws 28-7201
  • Runway: means an artificially surfaced strip of ground that is designed and used at an airport for the landing and takeoff of aircraft. See Arizona Laws 28-8461
  • Safety rest area: means a site established and maintained by or under public supervision or control for the convenience of the traveling public within or adjacent to the right-of-way of the interstate or primary systems. See Arizona Laws 28-7901
  • salon: means an establishment that is operated for the purpose of engaging in the practice of barbering. See Arizona Laws 32-301
  • Salon: means any of the following:

    (a) An establishment that is operated for the purpose of engaging in the practice of cosmetology, aesthetics, nail technology or hairstyling, or any combination of the listed practices. See Arizona Laws 32-501

  • Scheme of common ownership: means an ownership scheme in which the owners have recorded irrevocable rights to use common areas. See Arizona Laws 28-7901
  • School: means any public institution established for the purposes of offering instruction to pupils in programs for preschool children with disabilities, kindergarten programs or any combination of grades one through twelve. See Arizona Laws 28-8461
  • School: means an establishment that is operated for the purpose of teaching barbering or cosmetology. See Arizona Laws 32-301
  • School: means an establishment that is operated for the purpose of teaching barbering, cosmetology, aesthetics, nail technology or hairstyling, or any combination of the listed practices. See Arizona Laws 32-501
  • School district: means a political subdivision of this state with geographic boundaries organized for the purpose of the administration, support and maintenance of the public schools or an accommodation school. See Arizona Laws 28-8461
  • School district development plan: means any proposal to build or expand a school but does not include repairing, maintaining or remodeling an existing school. See Arizona Laws 28-8461
  • seclusion: means placing a child against the child's will in a room in which the child is unable to open the door in order to prevent the child from doing harm to self or others. See Arizona Laws 8-501
  • Secondary capital: means the aggregate of the following:

    (a) Limited life preferred stock. See Arizona Laws 6-351

  • Secondary system: means that portion of connected highways located in this state that are officially designated by the board and approved by the United States secretary of transportation pursuant to 23 United States Code. See Arizona Laws 28-7901
  • Secure state mental health facility: means a secure behavioral health residential facility that is licensed pursuant to Section 36-425. See Arizona Laws 13-4501
  • Semitrailer: means a vehicle that is with or without motive power, other than a pole trailer or single-axle tow dolly, that is designed for carrying persons or property and for being drawn by a motor vehicle and that is constructed so that some part of its weight and that of its load rests on or is carried by another vehicle. See Arizona Laws 28-101
  • Serious physical injury: means an injury that is diagnosed by a medical doctor and that does any one or a combination of the following:

    (a) Creates a reasonable risk of death. See Arizona Laws 8-201

  • Serious violation: means a violation of this article or a rule adopted under this article which produces a substantial probability that death or serious physical harm could result, unless the violator did not, and could not with the exercise of reasonable diligence, know of such safety or human health risk, in which case the violation is nonserious. See Arizona Laws 3-361
  • Service: means major adjustments or repairs, usually requiring specialized training or tools, or both. See Arizona Laws 30-651
  • Service of process: The service of writs or summonses to the appropriate party.
  • Service territory: means the geographic area in which a public power entity or public service corporation owns, operates, controls or maintains either electric distribution facilities or natural gas distribution facilities and that additional area in which the public power entity or public service corporation has agreed to extend electric distribution facilities or natural gas distribution facilities, whether established by a certificate of convenience and necessity, by official action by a public power entity or by contract or agreement.   • Settlement: Parties to a lawsuit resolve their difference without having a trial. Settlements often involve the payment of compensation by one party in satisfaction of the other party's claims.
  • Shared vehicle driver: means an individual who has been authorized to drive the shared vehicle by the shared vehicle owner under a car sharing program agreement. See Arizona Laws 28-9601
  • Shared vehicle owner: means the registered owner, or a person or entity designated by the registered owner, of a vehicle that is made available for sharing to shared vehicle drivers through a peer-to-peer car sharing program. See Arizona Laws 28-9601
  • Shelter care: means the temporary care of a child in any public or private facility or home that is licensed by this state and that offers a physically nonsecure environment that is characterized by the absence of physically restricting construction or hardware and that provides the child access to the surrounding community. See Arizona Laws 8-201
  • SIB cooperative agreement: means a cooperative agreement or agreements entered into by the Arizona department of transportation with the United States department of transportation pursuant to this article and the federal SIB act. See Arizona Laws 28-7671
  • Sign: means to do either of the following with present intent to authenticate or adopt a record:

    (a) Execute or adopt a tangible symbol. See Arizona Laws 29-2102

  • Sign: means , with present intent to authenticate or adopt a record, to either:

    (a) Execute or adopt a tangible symbol. See Arizona Laws 29-3102

  • Sole proprietor: means the owner of a sole proprietorship. See Arizona Laws 32-701
  • Sole proprietorship: means a business that is owned by one individual and that does not have a legal distinction between the owner and the business. See Arizona Laws 32-701
  • Source material: means :

    (a) Uranium, thorium or any other material that the governor declares by order to be source material after the United States nuclear regulatory commission or any successor has determined the material to be source material. See Arizona Laws 30-651

  • Sources of radiation: means radioactive materials, radiation machines and electronic products. See Arizona Laws 30-651
  • Special foster home: means a licensed foster home that is capable of handling not more than five minor children who require special care for physical, mental or emotional reasons or who have been adjudicated delinquent. See Arizona Laws 8-501
  • Specific single project: means a project that is constructed at a single location, at a common location or for a common purpose. See Arizona Laws 28-7361
  • State: means a state, territory or possession of the United States, the District of Columbia or the Commonwealth of Puerto Rico. See Arizona Laws 29-301
  • State: means a state of the United States, the District of Columbia, the Commonwealth of Puerto Rico or any territory or insular possession subject to the jurisdiction of the United States. See Arizona Laws 29-1001
  • State: means a state of the United States and the District of Columbia. See Arizona Laws 28-101

  • State highway: means a state route or portion of a state route that is accepted and designated by the board as a state highway and that is maintained by the state. See Arizona Laws 28-101
  • State route: means a right-of-way whether actually used as a highway or not that is designated by the board as a location for the construction of a state highway. See Arizona Laws 28-101
  • Statement: means a statement of partnership authority under section 29-1023, a statement of denial under section 29-1024, a statement of dissociation under section 29-1064, a statement of dissolution under section 29-1075, a statement of merger under section 29-2205, a statement of qualification as a limited liability partnership under section 29-1101, a statement of foreign qualification under section 29-1106 or an amendment or cancellation of any of the foregoing.   • Statute: A law passed by a legislature.
  • Statute of limitations: A law that sets the time within which parties must take action to enforce their rights.
  • Statutory agent: means the agent of a limited liability company or foreign limited liability company that is authorized to receive service of any process, notice or demand required or permitted by law to be served on the company. See Arizona Laws 29-3102
  • Structure: means an object that is constructed or installed by a human including a building, tower, smokestack or overhead transmission line. See Arizona Laws 28-8461
  • Structure or fenced yard: means any structure, fenced yard, wall, building or other similar barrier or any combination of structures, fenced yards, walls, buildings or other barriers that surrounds a commercial nuclear generating station and that is posted with signage indicating it is a felony to trespass. See Arizona Laws 13-4901
  • Structure or fenced yard: means any structure, fenced yard, wall, building or other similar barrier or any combination of structures, fenced yards, walls, buildings or other barriers that surrounds a military reservation or facility and that is posted with signage indicating it is a felony to trespass. See Arizona Laws 13-5001
  • Subcontractor: means a person who contracts to perform work or render service to a contractor or to another subcontractor as a part of a contract with the department. See Arizona Laws 28-7361
  • Subpoena: A command to a witness to appear and give testimony.
  • Summons: Another word for subpoena used by the criminal justice system.
  • Surviving entity: means the entity that continues in existence after, or that is organized as a result of, a merger. See Arizona Laws 29-2102
  • Taxi: means a motor vehicle that has a seating capacity not exceeding fifteen passengers, including the driver, that provides passenger services and that:

    (a) Does not primarily operate on a regular route or between specified places. See Arizona Laws 28-101

  • Taxi meter: means a device that automatically calculates at a predetermined rate the charge for the hire of a vehicle and that indicates the charge. See Arizona Laws 28-9501
  • Telecommunication facility: means any cable, line, fiber, wire, conduit, innerduct, access manhole, handhole, tower, hut, pedestal, pole, box, transmitting equipment, receiving equipment or power equipment or any other equipment, system or device that is used to transmit, receive, produce or distribute by wireless, wireline, electronic or optical signal for communication purposes. See Arizona Laws 28-7381
  • Temporary restraining order: Prohibits a person from an action that is likely to cause irreparable harm. This differs from an injunction in that it may be granted immediately, without notice to the opposing party, and without a hearing. It is intended to last only until a hearing can be held.
  • Tenancy in common: A type of property ownership in which two or more individuals have an undivided interest in property. At the death of one tenant in common, his (her) fractional percentage of ownership in the property passes to the decedent
  • Territory in the vicinity: means any property located in the following zones:

    (a) For Luke air force base in Maricopa county, the zone is ten miles to the north, south and west and four miles to the east parallel from the center of the main runway of a military airport. See Arizona Laws 28-8461

  • Testify: includes every manner of oral statement under oath or affirmation. See Arizona Laws 1-215
  • Testify: Answer questions in court.
  • Testimony: Evidence presented orally by witnesses during trials or before grand juries.
  • Therapeutic procedures: means the application of clinical skills and services, including therapeutic exercise, therapeutic activities, manual therapy techniques, massage and structural supports, to improve a patient's neuromusculoskeletal condition. See Arizona Laws 32-900
  • Threading: means a service that results in the removal of hair from its follicle from around the eyebrows and from other parts of the face with the use of a single strand of cotton thread and an over-the-counter astringent, if the service does not use chemicals of any kind, wax or any implements, instruments or tools to remove hair. See Arizona Laws 32-501
  • Threat to public safety: means charged with the commission of any of the following:

    (a) A crime involving the discharge, use or threatening exhibition of a deadly weapon or dangerous instrument or the infliction of physical injury on another person. See Arizona Laws 13-4501

  • Toll evasion: means the failure to pay in full a notice of payment due within the required time. See Arizona Laws 28-7751
  • Toll facility: means either of the following:

    (a) Any new highway, roadway, lane, bridge, tunnel or other facility for surface transport of people or goods that is subject to payment of a toll for its use, for which an alternative route exists that accommodates the same type of motor vehicles, except for rail or other fixed guideway transit. See Arizona Laws 28-7751

  • Toll nonpayment: means the failure to pay in full an applicable toll for the use of a toll facility. See Arizona Laws 28-7751
  • Toll operator: means the department in its capacity of imposing and collecting tolls for the use of a toll facility, any public or quasi-public agency appointed by the department to impose or collect tolls for the use of a toll facility that is owned by the department, any private partner authorized to impose and collect tolls by a public-private agreement or any contractor or vendor retained by the department, public agency or private partner to carry out toll collection and enforcement and related customer service functions.   • Tort: A civil wrong or breach of a duty to another person, as outlined by law. A very common tort is negligent operation of a motor vehicle that results in property damage and personal injury in an automobile accident.
  • Trade dress: means a removable and distinct logo, insignia or emblem attached to or visible from the exterior of either of the following:

    (a) A transportation network company vehicle during the performance of transportation network services. See Arizona Laws 28-9551

  • Trailer: means a vehicle that is with or without motive power, other than a pole trailer or single-axle tow dolly, that is designed for carrying persons or property and for being drawn by a motor vehicle and that is constructed so that no part of its weight rests on the towing vehicle. See Arizona Laws 28-101
  • Transaction: means a merger, an interest exchange, a conversion, a domestication or a division, as applicable. See Arizona Laws 29-368

  • Transferable interest: means the right, as initially owned by a person in the person's capacity as a member, to receive distributions from a limited liability company, whether or not the person remains a member or continues to own any part of the right, and applies to any fraction of the interest, by whomever owned.   • Transportation network company: means an entity that has been issued a permit pursuant to this article, that operates in this state, that uses a digital network or software application to connect passengers to transportation network services provided by transportation network company drivers and that may but is not deemed to own, operate or control a personal motor vehicle of a transportation network company driver. See Arizona Laws 28-9551
  • Transportation network company driver: means an individual who receives connections to potential passengers and related services from a transportation network company in exchange for payment of a fee to the transportation network company and who operates a motor vehicle that is both of the following:

    (a) Owned, leased or otherwise authorized for use by the individual. See Arizona Laws 28-9551

  • Transportation network company vehicle: means a motor vehicle that meets all of the following:

    (a) Has a seating capacity not exceeding eight passengers, including the driver. See Arizona Laws 28-9551

  • Transportation network services: means the transportation of a passenger between points chosen by the passenger and arranged with a transportation network company driver through the use of a transportation network company's digital network or software application beginning when a transportation network company driver accepts a request for transportation network services received through the transportation network company's digital network or software application, continuing while the transportation network company driver provides transportation network services in a transportation network company vehicle and ending when the passenger exits the transportation network company vehicle or when the trip is canceled.   • Transportation project: means all or a portion of a project that is included in the state's transportation improvement program or a plan, as defined in section 28-6351, including the project planning, environmental work, design, right-of-way acquisition or construction for the transportation project and associated rolling stock and operating systems but not including an eligible highway project. See Arizona Laws 28-7671

  • Truck: means a motor vehicle designed or used primarily for the carrying of property other than the effects of the driver or passengers and includes a motor vehicle to which has been added a box, a platform or other equipment for such carrying. See Arizona Laws 28-101
  • Trust account: A general term that covers all types of accounts in a trust department, such as estates, guardianships, and agencies. Source: OCC
  • Trustee: A person or institution holding and administering property in trust.
  • Type: means , with regard to an entity, the generic form of that entity, such as listed in paragraph 17 of this section. See Arizona Laws 29-2102
  • Unit of government: means any agency, office or department of this state, city, county, district, commission, authority, entity, port or other public corporation organized and existing under statutory law or under a voter approved charter or initiative, and any intergovernmental entity. See Arizona Laws 28-7701
  • Unzoned commercial or industrial area: means an area that is not zoned under authority of law and in which land use is characteristic of that generally permitted only in areas that are actually zoned commercial or industrial under authority of state law, that embraces all land on the same side of the highway on which one or more commercial or industrial activities are conducted, including all land within one thousand feet measured in any direction from the nearest edge of the actual land used or occupied by this activity, its parking, storage and service areas, its driveways and its established front, rear and side yards, and that constitutes an integral part of this activity. See Arizona Laws 28-7901
  • Unzoned industrial area: means an area that is not zoned under authority of state law and in which the land use is characteristic of that generally permitted only in areas that are actually zoned industrial under authority of state law and that embraces all land on the same side of the highway on which one or more industrial activities are conducted, including all land within one thousand feet measured in each direction parallel to the highway from the nearest edge of the industrial building or activity on the land. See Arizona Laws 28-7941
  • Uphold: The decision of an appellate court not to reverse a lower court decision.
  • User fees: Fees charged to users of goods or services provided by the government. In levying or authorizing these fees, the legislature determines whether the revenue should go into the treasury or should be available to the agency providing the goods or services.
  • Vehicle for hire: means a taxi, livery vehicle or limousine. See Arizona Laws 28-9501
  • Vehicle for hire company: means a company that offers local transportation through use of a taxi, livery vehicle or limousine or a combination of taxis, livery vehicles or limousines. See Arizona Laws 28-9501
  • Vehicle identification number: means the number that the manufacturer or the United States or a state department of transportation assigns to a motor vehicle for the purpose of identifying the motor vehicle or a major component part of the motor vehicle. See Arizona Laws 13-4701
  • Venue: The geographical location in which a case is tried.
  • Victim: means a person against whom the criminal offense has been committed, including a minor, or if the person is killed or incapacitated, the person's spouse, parent, child, grandparent or sibling, any other person related to the person by consanguinity or affinity to the second degree or any other lawful representative of the person, except if the person or the person's spouse, parent, child, grandparent, sibling, other person related to the person by consanguinity or affinity to the second degree or other lawful representative is in custody for an offense or is the accused. See Arizona Laws 13-4401
  • Victim advocate: work with prosecutors and assist the victims of a crime.
  • Victim Impact Statement: A written or spoken statement by the victim or his or her representative about the physical, emotional, and financial impact of a crime on the victim. The statement is given to the court before sentencing.
  • Voting security: means any security presently entitling the owner or holder of such security to vote for the election of directors of a bank, trust company, savings and loan association or controlling person, excluding, in the case of a savings and loan association, votes attributable to savings accounts. See Arizona Laws 6-141
  • Wholesale: means sales to qualified distributors of power. See Arizona Laws 30-101
  • Wilfully: means , with respect to conduct or to a circumstance described by a statute defining an offense, that a person is aware or believes that the person's conduct is of that nature or that the circumstance exists. See Arizona Laws 1-215
  • Wireless telephone: means a communication device that transmits radio, satellite or other mobile telephone communication. See Arizona Laws 13-4801
  • work crew: means a group of prison inmates who possess the skills and training to work at prison sites and to participate, under the security supervision of correctional service officers, in any phase of prison construction, maintenance, renovation or conversion. See Arizona Laws 31-250
  • Work furlough administrator: means a probation officer, sheriff, or other person authorized by the local governing board to perform the functions of the work furlough administrator. See Arizona Laws 31-331
  • worker: means a person who has been selected by and trained under the requirements prescribed by the department and who assists in carrying out the provisions of this article. See Arizona Laws 8-801
  • works: means each and every facility necessary or convenient for producing, storing, generating, firming or transmitting power, and all rights-of-way, lands or interests in land, the use or occupancy of which are necessary or appropriate in the maintenance and operation of all such facilities. See Arizona Laws 30-101
  • Writ: A formal written command, issued from the court, requiring the performance of a specific act.
  • Writ: means an order or precept in writing issued in the name of the state or by a court or judicial officer. See Arizona Laws 1-215
  • Writ of certiorari: An order issued by the Supreme Court directing the lower court to transmit records for a case for which it will hear on appeal.
  • Writing: includes printing. See Arizona Laws 1-215
  • Young adult administrative review: means an administrative review of a voluntary extended foster care case plan with the qualified young adult, the department's case specialist or designee, an independent party who is not responsible for the case management of or the delivery of services to the qualified young adult and any other individual the young adult invites. See Arizona Laws 8-201
